Town of Ithaca Planning Board
July 2 .1 , 1970
The regular meeting of the Town of Ithaca Planning Board
was held July 21 , 1970 in the Town of Ithaca offices , 108 E .
Green Street , Ithaca , New York .
Present : Chairman Robert Scannell , Hwy Baker , Robert
Christianson , Barbara Holcomb , Peter Francese ( Planning . Consultant ) ,
Fred Scott , Bud Garrity ( WHCU ) , Jim McRae ( WTKO ) , and Charlene
Lawson ( secretary ) .
Iq Baker made a motion to accept the minutes of the May
meeting . The motion was seconded by Bob Christianson and unani -
mously passed .
Bob Christianson made a motion that the Planning Board
recognize final approval on the Otis Drew subdivision on Poole
Road . - Barbara Holcomb . seconded the motion and it was unanimously
passed .
A motion was . made by Bob Christianson that the Planning
Board recommend to the Town Board that Mr__ . . Sam Slack be appointed
to replace Mr : Paul Teavelli . as a member of the Planning Board .
Baker seconded the motion , and it was unanimously favored .

Peter Francese discussed the use of the DeWitt Junior High
School building . It was decided that this building should not
remain in public hands since there is no use for it at the present
time . . Fred Scott moved that the DeWitt Junior High School not be
kept in public hands and Barbara Holcomb seconded this motion . It
was unanimously carried . ,
Changing in Zoning Ordinances
Peter Francese presented . the proposed changes in the Zoning
Ordinances . These include :
District R - 9 has been eliminated by combining it with R - 15 ,
with a minimum lot width of 100 feet . An additional residential
section , R - 5 , will be established for trailer parks only .
Multiple residence district ( R - 10 ) will be a floating . zone . The
Planning Board recommended that the density in these areas should
be limited to lO units per acre instead o' f the presently permitted
17 . 4 . Also , all existing sewer and water districts shall be re -
zoned from R - 30 to R - 15 . Cluster housing and multiple residences
will be permitted only in the R - 15 zone .

Agricultural districts shall remain except that residential .
development would be permitted only after the land is- rezoned
for residential use . It was recommended by Robert Scannell that .
land that is ideally suited for agricultural use be zoned such
that it . can be retained for farming land only . Regulations will
be added to govern the dumping of junk automobiles , pollution
from animal wastes , and the construction of accessory . buildings .
A building permit will be required for the construction of any
accessory buildings , primarily for assessment purposes and to
keep track of developments .
Business districts A and B will be combined into one district .
District C will be relabeled B and District D will become C .
District E will be abolished . Sign regulations will be strengthened
and tighter controls be established on site trash disposal .
Barbara Holcomb recommended that when violations occur , that there
be some legal follow - u. p .
The two existing light and heavy industrial districts shall
remain . There will be additions to the light industrial district
of those businesses previously included in District C such as
plumbing operations . It was recommended that a special district
Business C be set up for such things as lumber yards , feed stores ,
used car lots , greenhouses , brick yards , and farm implement
dealers . It was also recommended that perhapssuch recreationally
oriented business45as dance facilities and theaters could be in -
cluded inlDistrict B . Thus , parking lots used . . by the shopping
centers during the day could also be put to use at night .
Lands owned by public institutions such as Cornell University ,
Finger Lakes Park - Commission , Ithaca College , etc . shall be
classified P - 1 . Such lands , when sold , would be subject to re -
zoning before any us.e- could be made of it .
Several definitions will also be added to the Ordii ,�ance and
the penalties for violation of the ordinances will be stiffer and
will be enforced .
At next month ' s meeting , Peter Francese will discuss the
location and mapping of these districts .
Special . Exceptions . Section 74 .
A proposed amendment to the zoning ordinance was presented .
Robert Scannell made an addition to the proposed amendment so
that it shall read : .

Section 74 . Special Exceptions .
Where - .there - are practical difficulties or special conditions
which make . applic-ation of these regulatio- ns unreasonable or
impossible to comply with ; and when , in its judgment , the public
:convenience and . welfare _ will be substantially served . and the
appropriate use . of neighboring property will not , in the opinion
of.- the , Town Board , be ' substant-ial ly - or permanently i njuxed , : the
Town - Board may - in a specific case , after - puol i c notice and hearing
and after referal to the Planning Board for an opinion as per
the procedure outlined in section 46 ( 2 ) above , authorize the
follow -ing special exceptions - to the regulations :
1 . Cemetery
+ : 2 . : : Hospital or . Health Care Faci 1 i ties .
- - 3 . Radio or Television transmitting or broadcasting
station
It was recommended that facilities such as dog kennels ,
veterinary hospitals , and dancing . facilities be added to the
_list of exceptions - pf `'- could be put in a business district - , but
by specia .l _ permIt only because of the particular problem involved
such as noise . -
Avresolution was - made by Bob Christianson that we recommend . _ .
to the Town Board that they approve Section 74 . Special Exceptions .
The motion was seconded by Barbara Holcomb and unanaimousiy approved .
WTKO Towers
Discussion was held about the relocation of . the WTKO towers
approximately 1 , 000 . feet north of their first site proposal . The
Board - agreed that with the new Section 74 , this should be
agreeable . A public hearing will be scheduled after the Town
Board has given its approval . to Section 74 .
A motion was made by Barbara Holcomb to adjourn the meeting .
Fred Scott seconded it , and the motion was unanimously passed .
The meeting was adjourned at 9 : 45 p . m .
