The Regular ° ;ecting of the Town of Ithaca Planning Board was held
on Tu+?� sday , August 13 , 1968 at 7 : 30 P . i! , at the Town of Ithaca
Offices , 108 Fast Green Street , Ithaca , New Yor', v .
Vemhers of the oard present ; Acting Chairman Tlalter Schwan ,
John Vasse , Elmer Phillips , Dan rka ';- er , P.eginalci Collins , Zoning
Officer David Cowan , Noel Desch , and Secretary Cheryl Beninati .
The meeting was calledto order. at 7 : 30 P . F . by Actino; Chairman
Walter Schwan ,
EAST' M1 ? HEIGHTS , INC . - Snydcr 1111. 1 road - 400 units
Eastern Heights , Inc . , by its attorney , Marley I3 . Thaler , appeared
with a proposal to build 400 units on 6 . 9 acres on Snys7er Dill Poac
adjacent to the mown of Dryden town line . Potr . Thaler stated that
5 . 5 acres would he reserves? for ra.r}ps , anc! that there grill be Par
ing facilities for 528 tars . The units will he concrete frame with
masonry infill , and they will be basically two-bedroom units .
• It was pointed out that this area is Part of the water district put
in for Fastern Peights , anti sewer and mains are alr? ady in area .
Hany area residents appeared in opposition to the Proposal . !Ar .
George Tlolha inquired as to the lay- out , etc . , to ir-71hich ` ?r . Thaler
replied that if this Board recommended re - zoning, to the Town Board ,
Eastern Heights , Inc . would have to come ?pack before the Planning
Board for approval of the site plan and lay- out of buildings , etc .
Mr . Schwan pointeO out that this roard is interester. only tonight
in the concept of this plan and not Vie specific location of the
buildings on the land .
Questions arose as to the schooling of children who would he in
this area , and ^ ir . Schwan replied Vlat the Planning Board has nothing
to do with the schools these chile? ren will attend and cannot take
this into consi0eration in making any decision . ►lr . Phillips stated
that he has asked for a liason T-Ath the School Poard but has receives?
none .
! `r . O ' Drien inquired whether t?ze Board would state the, other
considerations with respect t_o this proposal , other than density ,
to which he was answered : l ) traffic floc•.= ; 2 ) slraina. ge ; 3 ) density ;
4 ) compliance with zoning or0inance .
It i-17as again pointed out that this hearinc* tonight is merely for
preliminary approval , and , if granted , the Town Board decit? es whether
or not to re- zona , After the Towr P)oa. rd ' s public hearing , the
planners then come back for approval of site plan from the Planning
Board .
The question of fire protection was also raises. - this is in the

Mr . Opler questioned what he considered to be indecent haste on the
part of Eastern Heights , who has already been given permission to
build 160 homes in the area , the majority of which are not occupied .
He also stated that the traffic situation has become difficult , and
the Town must have some experience with what Eastern Heights has
done and will do in the immediate future . Mr . Opler stated he
feels the proposal submitted tonight is premature . ?"Sr . Thaler
replied that these 400 units will not all be built at once , but will
be phased in several stages .
There were several move opposing comments from the area residents .
This hearing was closed at 8s50 P . M .
BARNES PROPOSAL - JUDD FALLS ROAD & ELLIS HOLL01.17 ROAD
Mr . Edward King , attorney , appeared representing Mr . Barnes who has
a 38 acre farm across from Ides at the corner of Judd Falls Road and
Ellis Hollow Road , Mr . Barnes is applying for a change in zoning
to Business " C " & " D " on the west side of farm , " C " area to be
about 25 acres and " D" area to be about 2 acres .
Mr . King stated that the eastern portion will be applied for re-
zoning to Multiple Residence , although there is no definite proposal
for this , as yet . At present , this area is a non- conforming agricul -
tural use .
Mr . King presented a survey of the area and a topo map showing con -
tours . He pointed out that this is gently rolling land in its
entirety . He also stated that this request is not for a specific
development but merely that the area be re - zoned from R- 30 to
a commercial district . Discussion was had concerning the loop road
from Route 13 to South Hill bypassing Forest Home , also the traffic
density in this particular area .
This hearing was closed at 9 : 40 P . P7 .
FAITH BIBLE CHURCH
Mr . Morrissey appeared representing the Faith Bible Church , whose
plans have already been approved and for which a building perm it
has been issued . However , financial problems arose , and the plan
had to be changed . Upon motion by ;sir . Phillips , seconded by Mr .
Vasse and carried by unanimous vote , it was moved that the plan of
the Faith Bible Church dated July 9 , 1968 and submitted tonight be
accepted with the provision and alteration that the wall of the
Church be 30 rather than 20 feet from the north boundary and that
the Church be moved diagonally approximately 15 - 20 feet east leaving
an adequate roadway between the southTPrest corner of the Church and
the current gully .
LAYTOTT - 5 - LOT SUBDIVISION - PIURIEL STREET
Mr . Layton appeared requesting preliminary approval . Upon motion
by Mr . Phillips , seconded by Pyr . Collins and carried by unanimous
vote , it was moved that preliminary approval be granted and that
a variance be granted on the lot fronting on Muriel Street .

CORNELL UNIVERSITY - BUS BARN
Cornell University presented a plan for a bus barn which is being
funded by the State Dormitory Agency which does not fall under
zoning . However , Cornell wanted this plan put on record .
Upon motion by Mr . Phillips , seconded by Por . Raker and carried by
unanimous vote , it was moved that the Planning Board accepts Cornell
University ' s submission of a plan for the new bus station facility
that meets the zoning requirements . We would trust that landscap-
ing in the front might be included and hope that repair work will
be limited to within the building or behind the building .
BARNES PROPOSAL
Upon motion by Mr . Phillips , seconded by "Rr . Vasse and carried by
unanimous approval , it was moved that the proposed Business " C "
area of approximately 22 acres submitted on the map called " The
Crossroads " be recommended to the Town Board for re- zoning . It is
further proposed that the area in yellow , approximately 215 X 180
feet , be zoned Business " D " , and that , furthermore , the developer in
his final plan include the corner gas station , approximately 180 X
250 feet , from the corner to the Judd Falls site so that the station
and access station be unified for access to Judd Falls Road . The
Planning Board feels that the location of this potential business
area is one of the most strategic developments for business in the
Town , in no way conflicts with current residential development , and is
located on main avenues of transportation . The Board feels , further ,
that the development is in harmony with Section 78 of the Zoning
Ordinance .
Upon motion by Mr . Phillips , seconded by Mr . Baker and carried
by unanimous vote , it was moved that the developer work with the
Town and the County to rectify the current road intersection that
has historically proved hazardous by planning to bring Judd Falls
Road intersection to Mitchell Street at a more nearly right angle
and that the Pine Tree Road intersection with Mitchell Street be
negotiated with the aforementioned parties and the University so that
it comes in perpendicular to the Mithhell Street or Ellis Hollow
Road and opposite the access to the Business " C " request as
shown on the map .
EASTERN HEIGHTS PROPOSAL
Upon motion by Mr . Phillips , seconded by Mr . Collins , and carried
by unanimous vote , it was moved that this proposal be tabled .
Mr . Vasse and Mr . Phillips were appointed to investigate this pro-
posal further .
This meeting adjourned at 11 : 00 P . M .
