CA PLANNING BOARD "RI ' , Ur.CES DECEMBER 12 , 1967 The Regular Meeting of the Town of Ithaca Planning Board was held on Tuesday , December 12 , 1967 at the Town of Ithaca Offices , 108 East Green Street , Ithaca , New York , at 7 : 30 PQM , Members of the Board present : Chairman 'doel Desch , James Lacy , Reginald Collins , Elmer Phillips , Dan Baker , Robert Scannell , John Vasse , Walt Schwan and Secretary Cheryl SA Reninati , Others present: Anthony Ceracche , Anton E mer. , James Roodlev , TToward Stevenson , Walter J ,, Wiaai.ns , and Steven nuvdash CERACCT?E CLUSTER DEVELOPMENT Mr . Antos. Egner , the planner , reviewed the minutes of the November 14 , 1967 Planning Board held on this matter and the modifications suggested therein : ( 1 ) The developer agrees to comply with the modification that the rights of way of all streets shall be reduced from 80 feet to 60 feet . ( 2 ) The developer disagrees with the modification that the total number of approved lots shall not exceed a maximum of 190 lots and the method of accomplishing this reduction . Mr . Egner stated that the normal zoning requirements would allow 220 units and any reduction from 208 would be very unfair to the developer it was noted that the plan as submitted at tonight ' s meeting showed 210 lots . ( 3 ) Mr . Egner stated that the developer will pave all cul � de - sacs at his own expense but disagreed with the Board ' s requirement that the developer also pave all the streets . Mr . Egner pointed out that there has been no precedent set in the Town for developers being required to pave the roads, at their own expense . ( 4 ) The developer agrees to level off , top soil and seed the plav � ground area no:r-&th of Lots 42 - 47 for the creation of a baseball field in accordance with the requirements se =c forth in the final approval of the Planning Board , but the developer disagreed with the requirement that he pave an area for off_ street parkin; in this area . The developer does not anticipate any such need since this area will be uslEd by area residents who will be walking to the area , ( 5 ) The developer has not agreed to purchase the land involving the future right of way of West Haven Road Extension , and Mr . Egner stated he felt it would be wrong of the Board to require this purchase , ( 6 ) The developer has agreed that all street: names shall be subject to approval at presentation of final plat. ( 7 ) The developer agrees that all utilities shall conform to master plan of the Town of Ithaca and are subject to the approval of the Health Department and Town consultants . Planning Board Minutes - December 12 , 1967 Pape 2 ( 8 ) The developer has not applied to the Town Board for the estaba lishment of a water and sewer district to include the complete subdivision inasmuch as the developer wants the modifications questioned above to be clarified , ( 9 ) The developer agrees that a detailed landscaping plan will be made available to the Board prior to final approval , In short , the basic objections are : ( 1 ) The number of lots ( 2 ) The paving of the roads , ( 8 ) The purchase of a right of way for the future extension of [Fest Haven Road . ( 4 ) The paving of an off- street parking area in the play areas . Mr . Egner revz.ewed the revised plan submitted at tonight ' s meeting , pointe ing out the increases in lot size to make a minimum on all lots of 109000 square feet . Mr . Wiggins emphasized the legality of allowing 208 lots in this develop - ment and questioned the Board ' s reason for taking away 18 lots from this developmento Mro Wiggins also stated that it is very unfair of the Board to ask this developer to pave the roads since no other developer has been asked to do this in the Town of Ithaca . Mr . Desch stated that it is the responsibility of the Planning Board to promote the healthy welfare and general amenity of any particular neigh ® borhood in question and that 190 lots would be the maximum number this Board could feasibly approve .: This number fits the development that should take place in this area and makes it compatible with present de � velopments and future developments on adjacent property , However , it is up to the developer to decide which lots should be eliminated . Thr , Wiggins also questioned the legality ofthe Board ' s requirement that the developer purchase someone else ' s land . This matter was adjourned until Executive Sessiono REVIEW OF FUTURE ROAD NETWORK Mr . Desch stated that there has never been a Town highway Map , and this is something the Board is trying to obtain ., Mr . Howard Stevenson was present and brought the members up to date on various plans for Town Highways . Review was especially had concerning a possible Forest Home by®pass Sections of the Town map were enlarged and taped together for review and suggestions by the Board . Upon motion by Mr . Phillips , seconded by Mr . Vasse and carried by unanimous vote , it was moved that the above map :be taken to an engineer for preparation of another map to be submitted to the Town Board and asked to place it as the initial stages for a road plan for development of the Town of Ithaca . r J Planning Board Minutes e December 12 , 1967 Page 3 as a a• ♦• as n .. s. •. . At the suggestion of Mr . Vasse , after discussion , the Board will look into putting lights between the Hospital and Bundy Road where many pedestrians are now walking along the shoulder of the road , :: 4 ' A * * o A Upon motion by Mr . Collins , seconded by Mr . Schwan and carried by unanir^ous vote , it was moved that the Board goes on record as being in favor of. continuing Route 89 into the City without interruption , .4 .+. e. * .. A a * .4 .. a. .. s. as .• n +• e RE - ADOPTION , RE ®ENACTMENT AND AMENDMENT OF ZONING ORDINANrF Review was had of the memorandum of James Vo Buyoucos , Town Attorney , concerning the re - adoption , recx- enactment and amendment of the Town of Ithaca Zoning Ordinanceo G e4 of L A aC J .4. . d. .4 s. .. .• a. .• . e• o All members concurred with the suggestions for building permit rates . The charging of fees for Zoning Board of Appeals hearings was opposed , and they should be left as they now are . a. .4 .4 .4 . .. .. a . .. .. so Drafts for Subdivision Regulations were prepared by Robert Scannell and given to Elmer 'Phillips and taalt Schwan for a report at the next meeting . CLUSTER DEVELOPMENT John Vasse left the room and did not participate in the discussion or the voteo Conditions reiterated : ( 1 ) The r17bt of wav for all streets shall be 60 feet instead of 80 feet , Further , the radii of the 900 bends on the interior streets shall be a minimum of 100 feet , ( 2 ) Number of Lots . ( a ) Lots 24 , 25 , 22 , 23 , 168 and 187 on the revised plan dated December 12 , 1967 were questioned � the Board is skeptical about developing these=_ lots because of the gas line , ( b ) ThEere was also the question of developing Lots 188 and 189 because of the drainage pattern in these two lots . ( d ) The southeast corner of the new Plan could be developed better in accordance with the suggestions as stated in the minutes of the November 149 1967 meeting . ( e ) Paving the streets - Noel Desch is to check on the legality of this Board being able to require this , If it is legally possible , this will be a requirement . It was noted that the developer stated he would pave tine cul � de ® sacs Upon motion by Mr . Lacy ,, seconded by Mr .
