He explained that the homeowners hz \•e not received any answers to the immediate problem , either prom t .e Village or the Town and if this situation continues man., - of the :zomeowners will either take legal action or move . Mr . Desch .ind Mr . Phillips spoke of the Town Planning Boards position ( see a.3sa minutes of O . t . 108 1967 ) and indicated there is no legal alternate route for th< water in the Town of Ithaca and that even if P ,,vad ditches were built in the Town the problem in the Villcrage would no4 be improved Due cognizance of the pooblem will be taken as the remaining open land is developed . :Perhaps i pond and/or check dams can be included if feasiblee Mr . Desch has discusses the problem with the Mayor of the Village and the position of the Toin Planning Board was stated as detailed above . The planning boce.rd stated to Mr . Lewis that a report of the problem will be written to the sPown Board as part of an. overall report of development within the % own and the problems associated therewith . Vasse be it Resolved Planning Board Minutes November 145, 196) rage 2 the proposal of TvIre Gray to construct a 4 un:? t motel addition ( 4 bedrooms and accompalying baths ) be approved contingent upon Health Department approval of the sewage disposal system and water systeme It is also stated for the record that it does .not seem practical to expand these facilities on this parcel beyond this additiong regardless of the .fact that the duplex house may be demolished . Approval was unanimous . BEN BOYNTON SUBDIVISION GU(xAR BLISH LANE, The Planning Board upon request of Mrm Boynton and the Town attorney reviewed the revised plan of the previously approved plat . Water will be provided by individual wells: Resolved the revised plan . on file in the Town Office ( under Planning Board .approval date of 11/14/67 ) is acceptable and in accordance with the subdivision regulation upon motion by Lacy , seconded by scannelle Approval was unanimous . The chairman has had several discussions with, members of the `,Nest Nall :association , the architects and Supervisor Keraro Resolved the preliminary plan of " Sunrise Park Subdivision " dated 10/10/67 ( Sheet 2 ) is approved with the following modifications : ( 1 ) Rights �of �way of all streets shall be reduced from 80 feet to 60 feet . Portions of street righf. s �cf,%Agtr y " fronting " on building lots shall be straight from 'block corner to block corner and not meander . This is a reduction of 19 lots from the plans as drawn . Minimum lot size shall be 10 , 000 square feet . This shall be accomplished as follows : a ¢ Consolidation of lots 147 through 163 ( 17 lots ) into 9 conventional 150000 square foot lots . ,sunrise Road shall be constructed by the developer to Corral Road . Cenral Court can become a cul de sac@ No lots with streets on front and back yard shall be permitted © bi Consolidation of lots 190 through 209 ( 20 lots ) into 12 lots by elimination of two cul de sacs so as to provide conventional. 159000 square foot ( or larger ) lots in the area bounded by " Pasture " Road and Mecklenburg . ( 6 ) All street names shall be subject to approval at pre sentation of final plate ( 7 ) All utilities shall ' conform to master plan of the Town of Ithaca and are subject to the approval of the Health Department and Town Consultants iozier Associates . In particular , water and sanitary sewer lines shall be sized to handle remaining portion of the Town which can reasonably benefit from the system . Some of the culverts must be a.ncrea.sed in size . ( 8 ) The developer should proceed to apply to the Town Board for the establishment of -& water district and a sewer district to include the complete subdivisiono ( 9 ) A detailed landscaping plan must be made available to the board. prior to final approval . Item I The interpretation of the cluster concept has been ncoorporated into Town Law and this Town Planning Board has the authority to evaluate such proposals . Many such subdivisions are in existence in New York State and have been proven successful ( several, by the architect of record ) * Item II The Planning Board has no authority to evaluate the type duality of thE! homes to be built . Minimum size is specified in the zoning ordinance . The town is hopeful of hiring a building inspector to work with the Zoning officer to minimize the possibility of coafe violations and poor quality workmanship ® ITEI'I III Unfortunately traffic increase in this area is inevitable * The proposed layout Minimizes the hazard element of the problem Further development of adjacent lands will provide additional outlets from the West dill area . This board can already forsee the need for a Hector Street Bypass .- to be linked up with the Cliff Street bypass ( Route 96 ) . Item IV We are very concerned about the question of additional e` u�onal facilitiese The subdivision plans will be automaticly available to the school board since the same architect is working with the schools on site studies for additional facilities . The Planning Board hopes that these site studies will be completed by the time final approval is given to the subdivision so that ® sufficient sidewalks can be programmed and provided by the developer . Beyond this the Planning Board has no authority other than an advisory role to the school board . Item V The Park areas will be maintained by the town taxpayer un eesv �s the people living in the subdivision wish to form a Park Association . Perhaps the West Ithaca Association could take the initiative to develop a complete Town Park on this lande This could certainly unify the residents of this entire section of the Town of Ithaca . Other Towns have done this successfully . In conclusion this board firmly believes that ,Test Ithaca and '- Vie entire town an4 city community will benefit far more from T" development a:3 propooed than by a piece meal-stereotyped bs. a ` _ by block strip deielopment . The foresight and cooperation of thy - evelopers and t?ie architect is greatly appreciated9 PITCHES Pi;' , rRTY OCCUTANCY PROBLEM _ Mrs Gerard O ' Brkona ,30 Snyder Hill Road , appeared before the board and expresUt� ' ctncern about the construction of 2 houses which are being rental to students . He questioned the inter pretation of the zonln£ ordinance on the occupancy requirement, Mro Phillips was to chick the original interpretation of the ordinance and notify t , e chairman prior to the next meeting .
