PLAINING BOARD MINUTES
AT.RCH 17 o 1964
The meeting was called to order at 7 : 45 P . M .

order at 7 : 45 P . M . and read the legal ad regarding this
matter as it appeared in the Ithaca Journal News on March 9 ,
1964
Attorney Frank Albanese , representing Por . LeGrand Chase ,
outlined the present proposal -to the Board and presented a
map entitled " Hap of p.^ oposed Warren Road School Site " ,
drakr.a by Carl Crandall and dated 7/16/19590 The proposal ,
as shown , on this reap comprised of 18 lots , numbered 4
thru 21 , on the land zoned Multiple Residence , lying
• immediately north and
built on the north
east of the new . road
bth and east perimeter of the North
east School lands The Board accepted this map as a site
plan as required by Article 1X of the Ordinance and it was
. further outlined that the specific construction being
proposed is all for one family dwellings to be served with
both public water: - and sewer and located on lots as shown ,
having a total area of a minimum of 16800 square feet each
or 1800 square feet in excess of the area requirements for
R®15 Residence zones
After discussion involving questions and answers regarding
the specific proposal , Attorney Albanese was asked by Pyre
Liguori to express an opinion as to whether this Board should
rezone this area to R� 15 and approve the request with a
variance as to lot width, or if they should confine their
consideration to the approval of the site plan as presented ,
• for the specific development of the area , as presently
zoned9 under the provisions of Article 1Xe
Attorney Albanese informed the Board that after consider
able research. into this :subject he was of the opinion that
this Board did not have the legislature power required for
the rezoning of land , His contention was that Section 281
of Town Law empowers a Planning Beard to g-rFmt variances. :,

only to the specific requirements of an Ordinance , at the
time of approving a Platt, provided they do not increase
the density of popula.ti on of an area in an amount that
could be deemed unreasonable for the area ,
Mrs6 Elinor Smith was recognized by the Chairman , and spoke
as a representative of the residents of the immediate area
adjoining the; new school sand this proposed construction
si to � Her slatemen.t urged the Board to approve this proposal
on the grounds that the residents of the area would much
prefer to have the area develop with one family residences
as opposed to the previous plan. for Multiple Residences ,
Inrc Wiggins moved the following resolution : " Resolved that
the Planning Board of the Town of Ithaca grant final approval
to the site plan of Mro feGra.nd Chase as presented 3/17/64
on the reap by Carl Crandall dated 7f16/1959 and entitled
'PMap of proposed ..barren Road School Site " ,, showing lots
4 thru 211 upon condition thatpublic water and sever is
made available to each residence to be constructed on these
heretofore referred to lots , and upon further condition that
all requirements of the R- 15 residence zone be met except
the minium frontage requirements which shall be not less
than 84 feet , pursuant to powers granted to this Board under
Town law 281 and resolution of the Town Board dated 11/3/55 . 11
The motion was seconded by Mr , Waring and adopted by unani.M �
ous vote ,

the Board . Mro Stanton read a letter addressed to the
Zoning Board of .Appeals which stated OPPOs . tion to any

• in the Renwick area .; He filed said letter with the Zoning

the location of the cul � desae and indicated that sane was
required to enable him to sell a lot ddjoining an already
developed lot and give assurance to the purchaser that at
some later date , when the cul � da -sac would be built , that
this lanai could be built on . The Board cautioned Mr .
Boynton that none of these proposed lots could be built
upon until such time as they had frontage on an approved
read ; z-1Y° a Boynton agreed and advised that his potential
purchaser had been so notified .
A motion was made by Liguori. , seconded by Wiggins and
adopted by unanimous vote : " That the Boynton Preliminary
Sub �Divis -► on Layout by Ta Miller dated February 1964 be
accepted as a Preliminary Sub�Division Pland "
DEERFIELD SUBDIVISION Chairman Marion called the public
e�aring to cons i er e final approval of the Rocco Lucente
Deerfield Sub -Divisionp to order at 8033 P . M . and presented
proof of publ of cation of the legal notice of same as printed
in the Ithaca Journal Nevis of March 9 , 1964 .
With no persons appearing to be heard on this matter , the
Board , upon motion by Liguori and seconded by Vasse adopted
the following resolution by unanimous vote .* " Resolved
That this Board grant final approval of the proposed Lucente
Deerfield Sub Division as shown on the Crandall map as
revised to January 17 , 1 .064 , which includes only 25 lots
immediately adjoini-ng Salem Drive as it proceeds northerly
from Hanshaw Road . With this approval , this Board also
grants variance in depth requirements for those lots as
sho-vm on this proposal to be less than 150 feet deep , but
with total area in excess of the 15000 square feet R�15
requirement , and frontages in excess of 100 feet . "

Law 281 , when implemented by proper Town Board resolution ,
empowers a Planning Board to rebzone lauds ; within residentialp
• as long as reasonably the same density is maintained
VASSE MULTIPLE RESIDENCE Mr . Vasse challanged this Board

to provide needed services , etc . when growth and expansion
seem to be limited to 1 or 2 Family residences
