Call to Order
Deputy Supervisor Burbank called the meeting to order at 10 : 00 a . m . and led the
assemblage in the Pledge of Allegiance .
Agenda Item No . 3 — Board Comments
The board discussed having photographs taken for the Town ' s website .
Deputy Supervisor Burbank commented that it was Councilwoman Gittelman ' s last meeting
and that he wishes her many other happy engagements .
Aqenda Item No . 4 — Discussion of 2008 Committees
Councilman Engman introduced the agenda item and stated he would like to discuss the
Human Services and Recreation Committee . He proposed the creation of a fifth board
committee that would include recreation , human services , code enforcement , and
engineering because there were some things left out of the committee structure .
The board discussed the pros and cons of establishing a fifth town board committee .
Deputy Supervisor Burbank wrapped up discussion by asking board members to forward
his/her opinions to Councilman Engman for his use in making 2008 committee
appointments .
Agenda Item No. 5 — Consider and Approve Recognition of Teamsters Local 317
Deputy Supervisor Burbank directed the board ' s attention to the resolution in the packets.
With no comments on the resolution , Councilman Cowie moved the resolution and it was
seconded by Councilwoman Leary . Deputy Supervisor Burbank called for a vote ,

TB RESOLUTION NO. 2007-201 : RESOLUTION RECOGNIZING TEAMSTERS
LOCAL 317 AS EXCLUSIVE REPRESENTATIVE FOR CERTAIN DEPARTMENT
OF PUBLIC WORKS EMPLOYEES
WHEREAS, by letter dated November 5, 2007, William E. Arnault, Business Agent for
Teamsters Local 317 ("Teamsters ' , notified the Town of Ithaca Supervisor that the
Teamsters had obtained authorization cards from a majority of the employees in the Town 's
Department of Public Works designating the Teamsters as their exclusive representative for
collective bargaining purposes in accordance with the New York Taylor Law, and
WHEREAS, said letter requested the Town of Ithaca to recognize the Teamsters as the
exclusive representative of certain Department of Public Works employees in certain
classifications or titles for the purposes of collective bargaining, and
WHEREAS, said letter further stated the Teamsters would be willing to have a third party
verify through a card check that a majority of the employees had so designated the
Teamsters, and
WHEREAS, the Town Board of the Town of Ithaca passed a resolution at its November 19,
2007 meeting in which it agreed to have the Reverend David Jones of Bethel Grove Bible
Church, or another mutually acceptable party, conduct such a card check, and
WHEREAS, Reverend Jones did not appear on the date of the card check, December 17,
2007, so the Town Supervisor and Teamsters representative agreed to have Enfield Town
Justice Betty Poole conduct the card check, and
WHEREAS, Justice Betty Poole conducted the card check on December 17, 2007, and she
verified a majority of the employees in the Department of Public Works position titles listed
in the Teamster's November 5, 2007 letter had designated the Teamsters as its exclusive
representative for the purposes of collective bargaining, and
WHEREAS, the Town Board has determined that it is in the best interests of the Town, and
the goodwill of its Department of Public Works employees, to recognize the Teamsters
instead of rejecting the Teamster's request, which would likely result in a Teamster petition
for certification filed with the Public Employment Relations Board,
THEREFORE BE IT RESOLVED, that effective January 1 , 2008, the Town Board
recognizes Teamsters Local 317 as the exclusive representative for collective bargaining
purposes of all full-time probationary and full-time post-probationary Department of Public
Works employees in the following position titles: Laborer, Motor Equipment Operator, Heavy
Equipment Operator, Working Supervisor, Maintenance Worker, Engineering Technician 1,
Senior Engineering Technician, Heavy Equipment Mechanic, and Assistant Automotive
Mechanic. Excluded from this recognition are all seasonal, temporary, and part-time
employees and all other employees of the Town of Ithaca, and
BE IT FURTHER RESOLVED, that in accordance with the requirements of Section 201 . 6 of
the New York Civil Service Rules and Regulations, the Town Clerk of the Town of Ithaca is
hereby authorized and directed to publish a written notice of this recognition of Teamsters

Local 317 in the Ithaca Journal published in the City of Ithaca, Ithaca, New York, for not less
than one ( 1) day, and to post a copy of same on the signboard of the Town of Ithaca and in
the Department of Public Works Facility for not less than five (5) working days, and
BE IT FURTHER RESOLVED, that after said publication and posting are complete, the
Town Clerk of the Town of Ithaca is hereby authorized and directed to deliver to the
Teamsters a copy of this resolution and verification that said publication and posting
occurred.

Agenda Item No . 5A — Consider and Approve Authorization to enter into contract with
LeRoy Kotary to act as the Chief Negotiator during the Collective Bargaining
Negotiations with Teamsters Local 317 .
Deputy Supervisor Burbank next directed the board ' s attention to a resolution on -the table
and gave a brief overview of the resolution .
Councilman Engman moved the resolution and Councilman Cowie seconded . Deputy
Supervisor Burbank asked how the negotiator was selected . Ms . Drake explained the
Personnel Committee reviewed resumes of three individuals and recommended LeRoy
Kotary. There being no further discussion , Deputy Supervisor Burbank called for a vote .
TB RESOLUTION NO. 2007-202: Authorization to enter into contract with LeRoy
Kotary to act as the Chief Negotiator during the Collective Bargaining Negotiations
with Teamsters Local 317.
WHEREAS, the Personnel Committee has reviewed three (3) Requests for
Qualifications for Chief Negotiator for the initial Collective Bargaining Agreement with
Teamsters Local 317 representing certain employees of the Public Works Department, and
WHEREAS, the Personnel Committee in conjunction with Highway Superintendent
recommend LeRoy Kotary, Labor Relations Consultant, as the Chief Negotiator, at a rate of
$80 per hour for travel and time associated with the representation of the client,

Now, therefore, be it
RESOLVED, the Town Board of the Town of Ithaca does hereby authorize the Town
Supervisor to execute a contract with LeRoy Kotary, Labor Relations Consultant, to act as
the Town 's Chief Negotiator at $80 per hour for travel and time associated, and with said
contract being subject to the approval of the Attorney for the Town .

Agenda Item No . 6 - Consider and Approve recognition of Sandra Gittelman as
Outgoing Town Board Member
Deputy Supervisor Burbank moved the proposed resolution and Councilman Engman
seconded . Deputy Supervisor Burbank then read aloud the resolution and called for a vote .
TB RESOLUTION NO 2007=203 : Recognition of Sandra Gittelman 's Years of Service
to the Community
WHEREAS, Sandra Gittelman began her service to the Town of Ithaca as an appointed
member of the Joint Youth Commission; and
WHEREAS, Sandy served on the Town Board from January 1 , 2004 through December 31 ,
2007; and
WHEREAS, Sandy, in her role as Councilwoman, has contributed her valuable time and
energy to such committees as Recreation and Human Services, Recreation Partnership,
Personnel Committee and Board Policy and Protocol Committee; and
WHEREAS, the Town of Ithaca has greatly benefited from Sandy's thoughtful consideration,
intelligence, time, energy and her desire to serve our community in order to make it a better
place to live; and
WHEREAS, the Town of Ithaca is appreciative for Sandy's invaluable contributions and
years of exemplary service as a Town Board member;
NOW, THEREFORE

Agenda Item No . 7 — Consider and Approve Recognition of Catherine Valentino as
Outgoing Town Supervisor
Councilman Stein moved the resolution and Councilman Engman seconded . Councilman
Stein then read aloud the proposed resolution . Deputy Supervisor Burbank stated that he
would miss Supervisor Valentino ' s presence , her good humor, and ability to project a
positive image for the Town . He then called for a vote .
TB RESOLUTION NO. 2007-204 : Recognition of Catherine Valentino 's Years of
� Service to the Communit y
WHEREAS, Catherine Valentino has dedicated many years of her life to serving the
community she has so proudly lived in since 1958; and
WHEREAS, Cathy has a combined twenty-three years of service to the Town residents,
which includes January 1 , 1976 through December 31 , 1980 and January 1 , 1990 through
December 31 , 1995 as a Town Board member, and from January 1 , 19516 through
December 31 , 2007 as the Town Supervisor, and
WHEREAS, Cathy has demonstrated her leadership skills in many ways throughout the
years, such as being instrumental in forming the Recreation Partnership so that children
throughout the county could participate in affordable sports and activities; and
WHEREAS, Cathy has been a dedicated advocate for inter-municipal cooperation and
shared services by dedicating many hours to promoting the value of the Tompkins County
Municipal Officers ' Association and as a leader in the creation of the Tompkins County
Council of Governments, whose mission is to bring municipal officials together to improve
cooperation and promote governmental efficiency and effectiveness; and
WHEREAS, as the Town Supervisor, Cathy served in many capacities on several town
committees along with many intermunicipal boards and committees, such as the Southern
Cayuga Lake Intermunicipal Water Commission (Bolton Point) as Treasurer, the Sewer

Joint Committee; the Tompkins County Water Resources Council, the Recreation
Partnership and the Ithaca Tompkins County Transportation Council, and
WHEREAS, during Cathy's term of office, the Town experienced many milestones, such as
the purchase of the downtown Post Office for renovation into a new Town of Ithaca Town
Hall; renovations to the Public Works Facility; updates to the Zoning Ordinance; creation of
a Park and Open Space Plan; first Purchase of Development Rights; opening of the Tutelo
Park and ball field and completion of projects that brought affordable housing and eldercare
into the Town; and
WHEREAS, the Town of Ithaca has greatly benefited from Cathy's thoughtful consideration,
intelligence, time, energy and her ongoing desire to serve this community by making it a
better place to live; and
WHEREAS, the members of the Ithaca Town Board, on behalf of the citizens of the Town of
Ithaca, appreciate Cathy's invaluable contributions and years of dedication, devotion and
exemplary service to the Town;
NOW, THEREFORE
BE IT RESOLVED, that the Town Board of the Town of Ithaca, on behalf of the Town and its
citizens, expresses its sincere appreciation, admiration and gratitude to Catherine Valentino
for her distinguished, dedicated and productive service to our community.

Honor of Outgoing Town Supervisor, Catherine Valentino
Deputy Supervisor Burbank introduced the agenda item . Councilman Engman moved the
resolution and Councilman Cowie seconded .
Councilman Engman summarized the resolution for the board and audience .
Deputy Supervisor Burbank called for a vote .
TB RESOLUTION NO. 2007=205: RESOLUTION NAMING TUTELO PARK BASEBALL
FIELD "VALENTINO FIELD "

WHEREAS, Catherine Valentino has provided invaluable service to the Town of Ithaca and
the Tompkins County community during her twenty three (23) years on the Ithaca, Town
Board, including twelve ( 12) years as Town Supervisor from 1996-2007, and
WHEREAS, her many accomplishments include careful stewardship of the Town 's fiscal
matters and reduction of Town debt, oversight of the Town 's move into the U. S. Post Office
facility as the new Town Hall, support for the Town 's parks and trails, founder and active
participant on the Recreation Partnership, participation on the Tompkins County Council of
Governments, negotiation of intermunicipal sewer and fire protection agreements, years of
service as a Commissioner on the Southern Cayuga Lake Intermunicipal Water
Commission, Tompkins County Water Resources Council, and Ithaca Tompkins County
Transportation Council, and
WHEREAS, the Town Board wishes to have Supervisor Valentino 's accomplishments and
her many years of service to the Town and greater Tompkins County community recognized
in a tangible and lasting manner, and
WHEREAS, the Town 's Policy on Naming Town Parks states that the name of a Town park
may be based upon the name of a person who has made significant contributions through
service to the Town or general community for a long period of time and in a significant,
usually official, role, and
WHEREAS, the Town Board believes such criteria apply equally to the naming of specific
locations within a Town park, such as a baseball field,
THEREFORE BE IT RESOLVED, that the Town Board of the Town of Ithaca hereby names
the baseball field at Tutelo Park "Valentino Field " in honor of Supervisor Valentino, and in
recognition of her tireless work as a founder and participant on the Recreation Partnership
as well as her service in many other roles to the Town, its citizens, and the residents of
Tompkins County.

Agenda Item No . 9 — Consider Amendment to the 2008 Town of Ithaca Bud &t
Deputy Supervisor Burbank provided some background information about the new, revised
2008 SPCA Contract . Passing this resolution at this meeting would ensure continued dog
control services through 2008 with the SPCA and allow the Board to research alternative
dog control providers for 2009 . Councilman Engman moved the resolution and Councilman

Cowie seconded . Ms . Brock pointed out a small typo in the first Whereas — " as" should read
"was" . Councilman Engman and Councilman Cowie agreed to the suggested change .

TB RESOLUTION NO. 2007-206: Amendment to the 2008 Ithaca Town Budget
WHEREAS, at the November 8, 2007 Town Board meeting the 2008 Town Budget
was adopted, and
WHEREAS, at the December 10, 2007 Town Board meeting the Town Board
accepted the Tompkins County Society for the Prevention of Cruelty to Animals (SPCA)
proposal, effective January 1 , 2008, to provide the Town with animal control services to the
Town of Ithaca for an annual charge of $31 , 050. 00, and
WHEREAS, the adopted 2008 Town Budget reflects a budgeted amount of
$20, 700, 00, now, therefore, be it
RESOLVED, the Town Board of the Town of Ithaca hereby approves, authorizes and
directs the Town Budget Officer to increase from Fund Balance , the adopted 2008 SPCA
budget line A3510. 400 by $ 10, 350. 00.

TB RESOLUTION NO. 2007-207: Records Management Disposition Listin_g
WHEREAS, the Records Management Officer has determined that the attached
listing of outdated and duplicate copies of records are eligible for disposition according to
the State Archives and Records Administration (SARA) Records Retention and Disposition
Schedule MU- 1; and
WHEREAS, the Records Management Officer (Town Clerk) has reviewed and
approved the disposition of the said records; now, therefore, be it
