`The meeting was held. at the Town Barns at 84.% 00 p . m . The minutes. of
the March meeting were approved .
1e The Board heard details of a Zoning Board of Appeals ' case con-
cerning property at 1031 Hinshaw Road , presently owned by Sheldon
and Eleanor Smith , The case was referred to the Planning Board be ®
cause the Board of Appeals felt that the awolicati_ on for ' variance
s±xbmi vted by the Smiths involved a basic principle -which. Lias in the
sphere of action of the PlantAng Board .
The problem is that the lot at 1031 Iianshmv is of sufficient 810 0.
to allow the const •ucti. on. of a��. additional res :i. c� ence at the 1� ear4 If

It was MOVED by Salumders and SECONDED by Phillips that the
Planning Board feel . that -who Zoning Board of Appeals should
maintain the present zoning regulations in the case of the
Sheldon. and Eleanor Smith property a.Iw 1031 Hanshawr Road and
that the Planning Board. will . issue a further statement of
policy at . a later date . The motion was CARRIED , ( Hurst
voted against the motion, ori the grounds that it is already
-the duty of the Zoning Board of Appeals to enforce the . ordin�
ante in this case and therefore the motion was not in. order . )
Mr , Wright , a resident of the area , asked that t1he size of lots
now specified in the Zoning Ordinance be reviewed with the idea 'chat
the prasea� b character of the neighborhood be protected by the use of
figures which more nearly correspond to existing conditions of the area ,

RESOLVED , that this Board recommends that the Town Bora.rd pass
a resolutiora authorizing and empowering the Town Planning
Board to approve plats showing lots , blocks oar" sites , with or
without streets or highways as authorized by Section 276 of
Article XTl' of the Town Law ,
Be it further RESOLVED , that in the enforcement of this pro
vision , our power shall generally be restricted to any tract
of land which. is divided into five or more parcels along exist
Ing or proposed streetso highways , easements or raodaays for
sale or r olc rent as building lots , regardless whether the lots
