Agenda Item No . 3 — Report from Tompkins County Legislature Tim Joseph appeared before the Board on behalf of the County Legislature and reported as follows : The Recreation Partnership resolution will be before the Health and Human Services Committee this coming Wednesday and should be before the Legislature at their next meeting . Mr . Joseph did not fore see any problems . The big news- for the County is the purchase of the building at the Cornell Research Park to house the County Health Department . Mr. Engman asked for confirmation that the County is buying the building , but leasing the land and wanted to know how long they were leasing the land for. Mr. Joseph told him that all of the property in the Research Park is leased stating it is mainly a strategy to ensure that it maintains its park- like setting and so that Cornell retains the right to have a say over what one can do on the property . The lease is for 60 years with an option to renew for 40 . 1 Final Approved 911012007 Councilman Burbank asked about bus service to the site . Mr . Joseph told him the routes to the location are as good as any place else , except downtown Ithaca and Cornell . He told Mr. Burbank that bus service is better than the current site on West Hill and this was one of the things the County looked at when choosing the site . Mr . Joseph remarked that there is no question in his mind that the current location is a better location , but he did not feel it was 4 '/z million dollars better. There were no further comments or questions . Agenda Item No . 4 — Report of City of Ithaca Common Council There was no representative from Common Council to address the Board . Agenda Item No . 5 — Report of Fire Commission — See Attachment # 1 Bob Romanowski appeared and read his monthly report to the Board . Agenda Item No . 7 - Consider award of contract for Trumansburg Road Water Improvements Mr. Walker had the bid results for the Board . There were 5 bidders ; 3 of the bids were on target with the engineer' s estimate ; 2 were quite a bit higher. LRS Excavating was the apparent low bidder. Mr . Walker recommended that the Town aware the contract to LES Excavating . Supervisor Valentino moved the award of contract . Councilman Stein seconded the motion . There were no questions from the Board . TB RESOLUTION NO . 2007 -130 : Authorization for Award of Contract for Construction of the Trumansburg Road Water Improvement. WHEREAS , the Town of Ithaca on August 8 , 2007 received bids for the Town of Ithaca Trumansburg Road Water Main Improvement consisting of construction of approximately 2 , 700 linear feet of 10 " Ductile Iron Pipe water main and 3200 lineal feet of 12 " Ductile Iron Pipe Water main , with appurtenances on Trumansburg Road , and ; WHEREAS , the Town Engineer has reviewed the bids and qualifications of the bidder and has recommended that the low bid of $ 578 , 170 . 00 for the total project made by LRS Excavating , Inc . of 24 Ross Road , Lansing , NY , is a qualified bid , and WHEREAS , the maximum amount authorized to be expended by the Town of Ithaca for the aforesaid improvement is $693 , 000 , now ; THEREFORE , BE IT 2 Final Approved 911012007 RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the award of the contract for the Trumansburg Road Water Main Improvement project to LRS Excavating , Inc . of 24 Ross Road , Lansing , NY , subject to final approval of the contract documents by the Town Engineer and Town Attorney , and be it further RESOLVED , that the Town Supervisor is hereby authorized and requested to execute such contract upon such approval ; and be it further RESOLVED , that the Town Engineer be , and he hereby is , authorized to approve change orders to such contract upon receipt of appropriate justification provided that the maximum amount of such change, orders shall not in the aggregate exceed $ 10 , 000 . 00 without prior authorization of this Board , and provided further that the total project cost , including the contract , engineering , legal and other expenses does not exceed the maximum authorized cost of the project . Carried unanimously . Agenda item No . 8 — Consider Award of Contract for Hanshaw Road Water Line The Board had the bid results for the project . Mr . Walker reported that one bidder came in very low . He was concerned about it and the next day received a fax from the bidder saying they had made a major mistake in one of their bid items , leaving $ 30/unit out of a 5 , 000 unit item resulting in a $60 , 000 error in their bid . According to instructions in the Town ' s bid documents , any contractor that admits they made a big mistake , which Mr. Walker believes this is , will be allowed to withdraw their bid and Mr. Walker allowed Highlander to withdraw their bid . The next low bidder was LRS Excavating . Their bid was only $ 600 . 00 higher than the engineer' s estimate . Regarding any concern that we have two contracts to the same contractor , Mr . Walker felt the contractor was large enough to handle both contracts . Ms . Valentino asked about the timeframe for completion . Mr. Walker told her the timeframe was 120 days for each project and LRS is comfortable doing the projects within the timeframe . Mr. Walker recommended the award of contract to LRS . Supervisor Valentino moved the resolution of award . Mr . Burbank seconded the motion . 3 Final Approved 911012007 TB RESOLUTION NO . 2007 - 131 : Authorization for Award of Contract for Construction of the Hanshaw Road Water Improvement. WHEREAS , the Town of Ithaca on August 8 , 2007 received bids for the Town of Ithaca Hanshaw Road Water Main Improvement consisting of construction of a new 8 " water main to run on the South side of Hanshaw road from 1305 Hanshaw road east to 1466 Hanshaw road , and ; WHEREAS , the Town Engineer has reviewed the bids and qualifications of the bidder and has recommended that the responsive low bid of $459 , 250 . 00 for the total project made by LRS Excavating , Inc . of 24 Ross Road , Lansing , NY , is a qualified bid , and WHEREAS , the maximum amount authorized to be expended by the Town of Ithaca for the aforesaid improvement is $ 524 , 000 . 00 , now ; THEREFORE , BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the award of the contract for the Hanshaw Road Water Main Improvement project to LRS Excavating , Inc . of 24 Ross Road , Lansing , NY , subject to final approval of the contract documents by the Town Engineer and Town Attorney , and be it further RESOLVED , that the Town Supervisor is hereby authorized and requested to execute such contract upon such approval ; and be it further RESOLVED , that the Town Engineer be , and he hereby is , authorized to approve change orders to such contract upon receipt of appropriate justification provided that the maximum amount of such change orders shall not in the aggregate exceed $ 10 , 000 . 00 without prior authorization of this Board , and provided further that the total project cost , including the contract, engineering , legal and other expenses does not exceed the maximum authorized cost of the project . Agenda Item No . 9 - Consider award of contract for Post Office entrance reconstruction — See Attachment #2 Mr. Walker reported that the bids for this project were opened on July 24 , 2007 . There were 3 bidders . The engineer' s estimate was $25 , 000 including contingencies . The 4 Final Approved 911012007 lowest bid was $ 39 , 800 , way over the estimate . One of the issues is the design of the railing . In the bid specs they were matching the design that the post office architects designed which was costing $ 15 , 000 . The engineer' s estimate also underestimated the cost of the structural concrete . Mr. Walker recommended that the Town reject all the bids ; it is in the best interests of the Town not to accept the bids because they are way out of budget . He felt the Town needed to redesign the project . Ms . Brock suggested language for a resolution . Mr . Stein moved the resolution . Ms . Valentino seconded the resolution . TB RESOLUTION NO . 2007 = 132 : Rejection of Bid Proposals for the Post Office Entrance Ramp Reconstruction RESOLVED , that the Town Board rejects all of the bids because award of the contract would not be in the best interest of Town because all of the bids are substantially over the budget for the project . Agenda Item No . 10 — Consider setting a public hearing regarding a proposed local law amending Chapter 270 , titled "Zoning " , of the Town of Ithaca Code to add water-related educational uses and additional yard regulations to the lakefront commercial zone . Mr . Engman moved adoption ; Councilwoman Gittelman seconded his motion . The Board agreed upon 6 : 30 p . m . as the time for the public hearing . TB RESOLUTION NO . 2007 -133 : Consider Setting Public Hearing regarding proposed Local Law Amending the Zoning Chapter of the Town of Ithaca Code to add water-related educational uses and additional yard regulations to the Lakefront Commercial Zone BE IT RESOLVED that the Town Board of the Town of Ithaca hold a public hearing at the Town Hall , 215 North Tioga Street , Ithaca , New York on the 10th day of September 2007 , at 6 : 30 pm for the purpose of considering a proposed local law amending the Zoning Chapter of the Town of Ithaca Code to add water- related educational uses and additional yard regulations to the Lakefront Commercial Zone , and it is further 5 Final Approved 911012007 RESOLVED , that at such time and place all persons interested in the proposed local law may be heard concerning the same ; and it is further RESOLVED , that the Town Clerk of the Town of Ithaca is hereby authorized and directed to publish a notice of such public hearing in the Ithaca Journal published in the City of Ithaca , Ithaca , New York , and to post a copy of same on the signboard of the Town of Ithaca , said publication and posting to occur not less than ten days before the day designated above for the public hearing . Agenda Item No . 11 - Consider acceptance of a portion of Larisa Lane as a Town of Ithaca roadway and acceptance of associated water and sewer improvements as Town of Ithaca facilities — See Attachment #3 Mr. Noteboom stated that his concerns regarding the catch basins had been addressed in the language of the resolution . Mr. Cowie asked what the urgency was and wondered why we couldn ' t consider acceptance once the caveats are fulfilled . Mr. Walker told him it was at the request of the property owner who wanted to start getting building permits . Ms . Valentino stated the Town would wait until things met staff' s satisfaction . Mr . Engman asked if the pedestrian walkway would be owned by the Town or the developer and who would maintain it . Mr. Walker told him that there are sidewalks going all the way around the road . The access for the pedestrian walkway , he thought , would become a Town responsibility once the whole development was finished . Ms . Valentino reminded the Board of the town ' s sidewalk policy stating that if it is a private , internal walkway the Town usually requires the developer to set up a walkway district . If it connects to the Town ' s network of walkways , then the Town takes responsibility . Ms . Valentino stated that this has been deemed to fall into the second category . Supervisor Valentino moved acceptance . Mr . Stein seconded the motion . TB RESOLUTION NO . 2007 -134 : ACCEPTANCE OF A PORTION OF LARISA LANE AS A TOWN OF ITHACA ROADWAY AND ACCEPTANCE OF ASSOCIATED WATER AND SEWER IMPROVEMENTS AS TOWN OF ITHACA FACILITIES , WHEREAS , Westview Partners , LLC , the developer, of the Westview Subdivision located on Schickel Road is offering for dedication to the Town of Ithaca for highway 6 i Final Approved 911012007 and utility purposes approximately 1 , 200 lineal feet of property 60 feet wide shown as the section of Larisa Lane running east from the end of the Phase I of Larissa Lane , at the approximate mid point of lot 6 as shown on the Subdivision Map entitled " Final Subdivision Map of Westview Subdivision , Located on Danby Road and Schickel Road , Town of Ithaca , County of Tompkins , State of New York , prepared by T . G . Miller P . C . , dated 6/22/2004" ; and WHEREAS , the Developer has constructed Phase 2 of the Westview Subdivision road , storm water facilities , water main , and sewer facilities to Town of Ithaca specifications , and WHEREAS , the Town Superintendent of Highways has advised the Town Board that said road has been constructed in accordance with the Town of Ithaca Highway specifications with the exception of 2 catch basins , and WHEREAS , the Town Engineer has advised the Town Board that the water , sewer and stormwater facilities have been constructed in accordance with the Town of Ithaca specifications , and WHEREAS , the Town Superintendent of Highways and the Town Engineer have recommended the acceptance of said parcel for dedication for highway and utility purposes with the conditions listed below ; NOW, THEREFORE , be it RESOLVED , that the Town Board of the Town of Ithaca hereby accepts as public roadway the portion of Larisa Lane described in the attached Schedule A subject to the following conditions : ( a ) Approval of catch basins by Town Highway Superintendent ( b ) Receipt of a warranty deed for then parcel from the Owner. (c) Receipt of a easement from the Owner for the temporary hammerhead turn around on lot 13 (d ) Approval of title to said road by the Attorney for the Town . Carried unanimously . Agenda Item fro . 6 — Persons to be Heard and Board Comments 7 Final Approved 911012007 There was no one from the public wishing to address the Board . Councilman Stein reported having taken a walk along Simsbury Drive during the evening . His companion for the walk , stepping aside to avoid an oncoming car, fell into the drainage ditch . Mr. Stein wondered if there should be a neutral level zone between the drainage ditch and the road . Mr. Noteboom told him the only way to accomplish that would be to close the drainage ditch . Mr . Noteboom said he would go up and look at the area and could even put together a cost estimate to bring to public works . Agenda Item No . 18 - Discussion of proposed local law providing for a moratorium on development in the northeast corner of the Town for a period of one hundred eighty ( 180 ) days Supervisor Valentino reported that , while the possibility of calling a special meeting was discussed at the last Town Board meeting , the Board did not hold one . Mr . Engman , Mr. Stein , Ms . Valentino , Mr. Kanter , and Ms . Brock discussed what needed to be done . They determined that they wanted to hear more from Mr . Whitmore ' s report and asked Mr. Kanter to meet with 2 gentleman involved in the report . Mr. Kanter met with the individuals . After that they spoke internally about the idea that there seemed to be coming together enough information for the Town to consider enacting a moratorium for a limited period of time to do more research , gather more information , and see if there was a possibility of looking at rezoning for the area . August 17 2007 , Mr. Engman , Jonathan Kanter, Susan Brock , and Supervisor Valentino met and discussed the information that Ms . Brock had drafted on the local law and the moratorium and the information that would be important for the Town to have . The needed items were then placed on the agenda for the evening ' s meeting . Ms . Valentino asked Ms . Brock if she had any comments . She did not and Supervisor Valentino moved on to agenda item number 19 . Agenda Item No . 19 - Consider referral of proposed local law providing for a moratorium on development in the northeast corner of the Town for a period of one hundred eighty ( 180 ) days to Planning Board for a recommendation to Town Board Ms . Valentino and Mr. Kanter told the Board that the Planning Board would probably be able to get this on their agenda for September 4 , 2007 . Ms . Valentino asked what the Board thought about that . Mr. Stein asked if the Town Board needed the consent of the Planning Board to enact a moratorium and why is that they are considering referring the issue to the Planning Board . Ms . Valentino told him that historically the Town Board has never moved forward on an issue like this without referring it to the Planning Board if they would like to comment on it . Ms . Valentino told him that the Town Board is not bound ; it is the Town Board ' s prerogative to do the rezoning . She thought the Town Board always felt getting the Planning Board ' s input was valuable . 8 Final Approved 911012007 Mr . Engman stated that they had also talked about referring the issue to the Conservation Board . Ms . Ritter stated the Conservation Board would be meeting September 6 , 2007 . Mr . Engman recommended adding Conservation Board to the resolution . Mr . Stein stated he understood there was a possibility of a lawsuit coming out of the Board ' s decision to impose a moratorium . He asked if one of the Town ' s Boards recommended against it whether it weakened or make it more possible if they should decide to have a moratorium to successfully defend themselves against a lawsuit . Ms . Brock stated she thought that the rationale for the moratorium is very clearly laid out in the draft law. It goes through the Comprehensive Plan that the Town drafted a number of years ago , the Open Space Plan that looks at the unique natural area inventory prepared by the Environmental Management Council . If the Town Board were to decide that it was appropriate to institute the moratorium , Ms . Brock thought there was ample support in the existing documents for the moratorium . S\She stated that since a moratorium is really considered a change to the Zoning Ordinance , the Town will be following all of its normal procedures for whenever it amends the Zoning Ordinance and that always includes referral to the Planning Board for a recommendation . On occasion , the Planning Board may not particularly agree with a particular proposal , but it has been the practice of the Town to seek their advice . Mr. Stein moved referral of the law , Councilman Engman seconded the motion . There was no further discussion . TB RESOLUTION NO , 2007 - 135 : Referral of proposed local law providing for a moratorium on development in the northeast corner of the Town for a period of 180 days to the Planning Board and Conservation Board for recommendation RESOLVED , that the Town Board of the Town of Ithaca refer proposed local law providing for a moratorium on development in the northeast corner of the Town for a period of 180 days to the Planning Board and Conservation Board for recommendations . Agenda Item No . 20 — Consider setting a public hearing regarding the proposed local law providing for a moratorium on development in the northeast corner of the Town for a period of 180 days 9 Final Approved 911012007 The Board agreed upon 6 : 45 p . m . as the time for the public hearing . Councilman Engman moved the resolution , Supervisor Valentino seconded the motion . Agenda Item No . 21 — Discussion of hiring a consultant to study and report to the Town Board on the biological and ecological features of the land subject to the proposed development moratorium Councilman Engman reported having talked about this in their meetings and stated he ' s had some concerns about whether the Town really needed to do this . He thought the Town would to expend between ten and fifteen thousand dollars on the study . Looking at the fiscal situation , Mr . Engman stated the Town is down $ 150 , 000 in its free balance from the preceding month and has been heading in a downward direction for some time . He stated he was getting a little concerned about the budget . In addition , he thought the document that Ms . Brock drew up is incredibly strong . He did not know whether the Town would be able to make it any stronger and also , it is his understanding that the Town has done other conservation zones without outside consultants . Mr. Engman was not quite clear why the Town would need additional here ; they have excellent data from the unique natural area , they have guidance from the Environmental Management Council , and they have the study that looked at the hydraulic situation at the site . It- 10 Final Approved 911012007 seemed to Mr. Engman they had a plethora of information already and it is a matter of simply putting it together. He stated he was skeptical of the need for a consultant . Ms . Valentino stated she had a different opinion . She thought , from the things she read in Mr. Kanter' s memo and through discussions with Susan Ritter and the Attorney for the Town , it seemed to her that this kind of study would help the Town strengthen their need for a conservation zone in the specified area . She thought it would be very important for the Town to have the strongest information possible to cover all bases to be able to thoroughly justify the conservation zone . Regarding the other conservation zones the Town has done , Ms . Valentino stated they were very much different from this one . The Town has never really done one that looked at features the way the Town has with this one . The other ones had some very clear distinctions like very steep slopes . This would be the Town ' s first time going in this area in this kind of a conservation zone . Mr . Stein stated he was certainly not an expert in ground water and even less of an expert in conservation zones and what' s unique and what isn 't unique . He stated he makes not judgment on his own as to how strong the Town ' s case is . He felt the Town only gets one bite of this apple and it' s a pretty tasty apple . The Town has spent a lot of time worrying about this problem and he really wants to make the bite the Town gets as strong as possible . To him , considering the amount of money the Town has already spent on the problem , this was not the time to worry about an expenditure of this magnitude . He was in favor of taking the chance that it is going to increase the town ' s case and make it stronger. Mr . Burbank stated he agreed with Engman and it was not about the money . Mr. Burbank ' s concern was that it may in fact create problems in terms of timing and in terms of getting the kind of data the Town needs . Mr . Burbank had full confidence that the Town has the ability in- house to give adequate justification . Mr . Kanter had a word about timing . If the Town were to hire a consultant and found the Town needed some more time in the spring , because it looks like it might be valuable to not only do some field work this fall and also do some follow up in early spring regarding some of the scarce plant species and amphibians . The moratorium certainly could be extended if it were justified based on this kind of cause . Certainly the Town does not want to drag this whole thing out , but if there are legitimate reasons to take the time need to do it , an extension of another three months or even another three after that is certainly a legitimate thing to consider . He did not think time , and that is the reason for doing the moratorium , so time really isn 't a factor and you can study this to degree that you want to . Ms . Valentino thought extending moratoriums for a good reason was fairly standard and asked Ms . Brock for confirmation . Ms . Brock told her, yes , stating the Town needs to be making good progress ; it can 't be just blindly extending without working hard to reach a resolution of the issues . If a three-month were needed she did not think that would be a problem legally . 11 Final Approved 911012007 Mr. Cowie asked where the 10 to 15 thousand dollar estimate came from . Mr. Kanter referred the question to Sue Ritter. Ms . Ritter reported that she was able to talk to someone at Sterns and Wheeler . They discussed the idea of spending two days at the site this fall and coming back and spending two days in the spring , when they would get a better idea on flowering plants , vernal pools , and amphibian movements . The person at Sterns and Wheeler estimated that it would be about 12 thousand dollars to do the work on what Ms . Ritter estimated at the time of their conversation would be about 50 or 60 acres . Ms . Leary asked if the Town ' s main concern in doing the study the plant species or is it the flooding and the drainage in the area . Mr. Kanter told her that the further study would be for the plant species , the birds , and amphibians ; documenting specifically where they had been sited or located . That' s the information the Town does not feel has been sufficiently documented . The hydrological aspect has been covered in the study previously conducted . Ms . Leary asked for confirmation that the drainage problem affects the plant species . Mr . Kanter told her that was the hardest part of an ecological study ; to document the effect of changing drainage patterns on plants and wildlife . He was not sure whether the study the Town was talking about could actually give the Town conclusive evidence on that , but what the Town would like to find out more about is actual locations and inventory of the scarce plant species and the bird species of concern . These were things mentioned in the Osman / Wesley letter . Mr. Kanter stated that based on his meeting with them , they could not tell him where any of these things had been observed within the unique natural area . From the Planning staff' s viewpoint , to provide the necessary documentation for a conservation zone to cover specific parcels , you need to have some documentation regarding the specific parcels rather than a generic statement regarding the overall unique natural area . Ms . Leary asked , then , if the Town ' s main concern would be things like plants species , but not the fact that all the residents ' basements are flooded . Mr. Kanter told her that was another part of the concern and something that the Board would want to address in a conservation zone , but enough staff and Board members feel there has been additional information provided in the drainage study to include that as another aspect of the conservation zone . That is not what the Town would be looking to provide further information on . That is something about which the Town could use the existing documentation on hydrology to use as part of a justification for a conservation zone . To do that , Mr. Kanter thought the Town would also need to change the language of the Town ' s current conservation zone to include considerations of natural drainage considerations . Mr. Engman stated that Mr. Kanter had covered one of the major concerns that he had : the very short time period . He continued stating you can 't really do a proper ecological study in just one season ; you really should have a full year, but at least the Town could cover fall and spring . You ' re looking at spring migrations not only of birds , but of amphibians and other types of critters . Emergent vegetation is sometimes only identifiable in the spring and later on they disappear and other stuff comes up . He told the Board it was very difficult to proper ecological study in a short period of time . 12 Final Approved 911012007 Mr. Engman stated his second concern . The Town has already heard from two of the very best field biologists , if not the best in the State , study the area . He did not feel the Town would find better consultants and it seemed to him as though they were trying to disprove some of the work of the best people that are already available . That seemed strange to him . Mr . Engman continued stating he finds the arguments so strong that Susan Brock has put together that , even if the report came back that said , we looked hard we didn ' t find something specifically in this spot , in this spot , in this spot , still what they are talking about in the conservation zone option is the extension of an existing conservation zone , it is not the creation of a new one . What they are talking about is an ecological community and you have to look at an entire area and the additional area supports those species that might not actually be on one area . That is why there are buffer zones around wetlands . There may be absolutely nothing of interest in the buffer zone , but it helps protect the wetland that has the interesting and valuable characteristics . Mr . Engman felt these were the types of things the Board needed to be thinking about : the biological corridors , the ecological communities , and how big of an area you need to support that type of ecological community . Mr . Engman cited the case of the northern harrier that will use lands of great distance in their hunting . The Board needs to look at the entire picture and even if the report were to come back somewhat negative from the viewpoint of the actual species , Mr . Engman stated he would still find the argument strong enough to go ahead with the conservation zone and he , therefore , did not quite see the point of going through the exercise of doing the study . Mr. Cowie wondered , given the expertise the Town has and in - house skills , if there was anyway to put a more concrete form to the information the Town has . Mr. Kanter told him his answer would be " no " . His recommendation is that the Town should hire a consultant to do the work . If part of the purpose of a conservation zone would be buffer the more special place of the Sapsucker Woods Sanctuary , he did not think staff could tell the Board what the area they needed to be . He thought the Town could use the argument that the unique natural area was designated by the County to do that . When he asked Robert why the boundaries of the most recent version of the unique natural area , updated in 1999 / 2000 , was drawn the way it was , he could not give him a concrete answer . Mr . Kanter stated those are things that leave him feeling a little bit uncomfortable . His recommendation is to hire an independent consultant who hasn 't looked at the issue . Mr . Stein thought the Board should be making the decision based on the most information they can get . He did not know what would come out of it , but stated the amount money , while he did not want to minimize 10 to 12 thousand dollars , felt the issue was coming to a point where the Town is coming to a conclusion . Staff recommends hiring a consultant ; he does not understand the issue well enough to make a judgment himself. He thought the Town ought to try to find out everything they can and is in favor of hiring a consultant assuming that the price is in the range that they are talking about . All the Town is trying to do at this point is take a look at the pros and cons . The pros are more information , the cons are more money . The Board does not 13 Final Approved 911012007 know that until they go out and talk to people who tell them what there is to learn and how much it is going to cost . Mr. Stein wanted , at least , to take that further step . Ms . Leary asked if the Town was saying they needed the study in order to justify the moratorium or does the Town need the study in order to go ahead and declare the area a unique natural area . Ms . Valentino thought the Town was very serious about looking at the area as a much needed conservation zone . In order to support a conservation zone , the Town has to have as much information about the elements of a conservation zone to justify doing it . In her mind , the moratorium gives the Town the time to slow down and get all that information together to move forward . Ms . Leary wondered if, by going ahead with another study , the Town was not saying that the Town does not have enough information to go by now . Her feeling is that , based on the study the Town just did and what they know from the experts that they' ve talked to , is that there is probably enough justification to make it a conservation zone based on the geology of the area and the flooding . It' s nice to add the plants , but if it came back and said there ' s not a big deal with the plants , it' s still a problem for the residents . Ms . Valentino asked Ms . Brock if she had any comments . She did not . Ms . Valentino stated that the Town does have a lot of information . That is why when they looked at that information they said it seems reasonable , but you can never have enough good information when you ' re going to be making your case . Whenever you ' re going to make a case for anything , you have to try to get as much good information as you can possibly get. To not do that is not a wise thing to do . Councilman Burbank thought if the Board were to hire a consultant , it would be critically important that they have a subcommittee formed to consider the scope of the project and to evaluate providers . Ms . Valentino agreed . Mr . Stein asked how the Board could come to a conclusion of the discussion . Ms . Brock told him the thinking was that there would be discussion at the evening ' s meeting and if the Town Board was interested in hiring a consultant the details of that hiring and the consideration of a resolution would be discussed at a subsequent meeting Mr. Stein asked that the Supervisor appoint a committee of Town Board members to examine the question of developing a scope of study for a request for proposals to look at the biological / ecological features of the land subject to the proposed development moratorium . Ms . Gittelman seconded the motion . Mr. Kanter asked that " request for qualifications " be added to the resolution . Mr. Stein and Ms . Gittelman accepted the addition . Town Board - Committee to develop scope of study regarding development moratorium in northeast corner of the Town of Ithaca 14 Final Approved 911012007 RESOLVED , that the Town Supervisor appoint a Town Board Committee to examine the question of developing the scope of study for an RFP ( request for proposals) or RFQ ( requests for qualification ) to look at the biological and ecological features of the land subject to the proposed development moratorium . Supervisor Valentino agreed . Ms . Valentino asked if anyone in the audience wanted to address the Board . Bill Sonnenstuhl I 'd just like to make a comment. I 'm not a biologist and not an ecologist although I am a social scientist and I know that a bad study can do as much damage as a good study. In fact we do a lot of damage. So when I hear that you 're going to try to replicate what two of the best biologists at Cornell University have done by letting out a contract to do a study of this area over two days, two days in the fall and two days in the spring, I think that's ludicrous. I think that you should try to replicate their study and by replicating their study you 're going to have to go out over many months, probably a year, and have a whole battalion of experts and it's going to cost you far more than 12 or 15 thousand dollars. So one of things I would suggest that you do is call up Nancy Osman and ask her for her data, her raw data, all of her observations up there, for all of the people who worked on that study. I think that you will find that the places that you 're trying to replicate that there are really issues of conservation can be found relatively easily because you 've really probably the best data already there but you need to ask them for that data . 16 Final Approved 911012007 Ms . Valentino thanked Mr . Sonnenstuhl and asked if there was anyone else that wanted to speak . There was no one . Mr . Kanter reported that he did meet with Robert Wesley and Mark Whitmore . Nancy Osman was out of town . He stated he asked Mr . Wesley the questions Mr. Sonnenstuhl had recommended , to see if he could get documentation , and Mr . Wesley could not provide it . Mr . Kanter stated he would be happy to contact Nancy Osman when and if she was available . He told Mr. Sonnenstuhl if he could have Ms . Osman contact the Town , it would be great , but as of now the Town ' s attempts to get that kind of documentation have not been successful . It certainly would help the Town to have that information and would help , if the Town hires a consultant , for them to have the information to be able to confirm where those observations occurred because that is really key in terms of what the Town is proposing to do . Mr . Stein commented that he learned a great deal in the experience of the last consultant on the groundwater problem . He too could not believe with the amount of time they were going to spend that they would be able to do anything . He reported he found there was an enormous benefit to having a neutral expert person to evaluate information that he was not capable of evaluating . A neutral , technical evaluation of other people ' s data can be a very important function . He stated he was hoping for something like that to come out of the proposed study . Agenda Item Flo . 17 — Consider adoption of a Local Law Amending Chapter 270 , Titled "Zoning , " of the Town of Ithaca Code Regarding Amateur Radio Facilities Councilman Engman moved adoption and Supervisor Valentino seconded the motion . Mr . Engman asked if the Town had a procedure set up to warn folks who want to put up a communication tower that someone needs to check with the County regarding potential interference with the County communication system . Mr. Kanter told him they hadn ' t really thought about it , but could put something on the Town website . Ms . Brock told him that the Town Board has not enacted any type of restrictions or resolutions regarding the County request for notification of projects that might impact their communication system . Ms . Brock thought that once the Town made their decision it' s possible they may need to amend the zoning law to require any structure above a certain height to go through a special process . She supposed that , in the meantime , people would need to come in for a building permit and that process may be a place where applicants could receive verbal notification that they need to check with the 23 Final Approved 911012007 County . She hoped that the amateur radio community that is so concerned with emergency communication would understand the importance of not interfering with the County' s system . However, until the Town enacts something we cannot force people to do that . Kris Mershrod , amateur radio operator Thank you very much for the approval of this change in the zoning. That's really appreciated. The question of potential interference of the tower as a structure, I don 't see that it would cause a blocking, but if there were interference because of frequency, that would either mean the County system was out of frequency or the amateur were out of the assigned frequencies allotted. If that were the case that there were some sort of inter-modulation or something then the amateur radio operator would have to correct that immediately. That 's part of the FCC regulations. I think it's 197. So I don 't think you have to worry about having given permission and this sort of a structure because they are such small structures, small profiles, unless it were right next to, and it can 't be because of the regulation if the tower falls over it can 't hit another persons property. I just don 't think it would be a concern. But it would be worth putting in there and that you 'd be covered, but I don 't think it's a worry. Ms . Hunter reported having given a presentation to the New York State Archives who have nominated the project for a New York State Education award . Ms . Hunter told the Board she did not want to see these materials and the effort get shelved and wanted to explore the possibility of working with the Board to move the materials out into the greater community . She told the Board that the Town owns the materials and because of this are the people who would have to do something either by giving them to somebody else or by working with someone to get them distributed . She asked the Board if they would be interested in working with her to do this . Mr. Engman reported having spoken with Ms . Hunter about this . He thinks the project is exciting and has had some experience in working with students on these types of programs . He stated he would be eager to work on a committee or small group that would help promote this , adding he had a bunch of ideas about how to do that . Ms . Valentino stated that she , too , is interested in moving this project forward . Ms . Valentino stated that she was setting up a committee of Mr. Engman and herself to work with Ms . Agenda Item No . 27 — Report of town Committees Carrowmoor Committee Councilman Engman reported that the committee had met several times and met with the developer and talked about some ideas about mitigation measure for the project . Mr. Engman reminded the Board that the developer has sort of the right to develop 300 units on the property he currently owns . If the Town decides to rezone some agricultural zoned land that he has bought , then the project could actually be a 400- unit development . The committee has felt that there ought to be some mitigation measures because of the size of the project , some things that the community would get out of it . The committee talked with them about the possibility of some of the units selling at the average income level of the community . They also talked about the fact that the project will add transportation issues . Mr . Engman reported that Mr. Burbank had met with the City and talked about some potential trails that might lead down into the City . The developer has also talked about shuttles and vans to mitigate the transportation problem . The third thing the committee talked about is the fact that there isn 't enough water pressure at the area . The developer seemed to understand and accept the responsibility for designing something that would provide for sufficient water pressure for the development . The fourth major area is phasing . The committee was concerned that the Town would accept roads and then they wouldn 't be able to sell the units . The developer seemed to recognize that issue also and gave assurances that the Town would be able to work in a phasing schedule . The committee will be meeting with the developer the following day . Mr. Engman thought they were getting ' to the point where they were eager to get going and they do want some feedback . Mr . Engman felt that following this next meeting they should be able to come to the Board with a recommendation about what to do next . Town Clerk Interview Committee Ms . Drake reported that the committee interviewed 5 candidates and has selected 3 for second interviews . She hoped that they would have a hiring recommendation for the next Town Board meeting . Agenda Item No . 28 — Intermunicipal Organizations Recreation Partnership Ms . Valentino told the Board that approval of the revised Partnership agreement should be in front of the Town Board at the September meeting . Tompkins County Council of Governments Mr . Engman reported that the Council is getting ready to bid out the proposal for health insurance . They are augmenting on regular work crews for their six weeks of employment. e Hot patching for surface treating roads, water breaks, and other spots were done . e Various grades of gravel were hauled for stock . o The second pass around Town with our roadside mower was done . e Repairs were made to several catch basins on Judd Falls Road m Inter-municipal cooperation included helping the city of Ithaca paving, helped the Town of Caroline and Village of Cayuga Heights with shoulders, and did some mowing for the Town of Danby . We also picked up an excavator for the Village of Cayuga Heights and the town of Danby borrowed our rubber tired roller . o The decking on the upstream bridge at Forest Home was welded . ® We installed a new road crossing pipe at Pinewood Place . ® We re-shaped the lawn at the end of Tareyton Drive where we installed a new storm water drainage system when we re-constructed the cul-de-sac . PARKS AND TRAILS ❑ Our Summer Youth Corp workers began July 21,11 . They have been doing weekly site inspections, changing garbage bags, litter collection, playground inspections, plantings and watering at beautification grant sites, assisting with ball field mulching, staining, maintenance at Tutelo Park, trail trimming, weeding, etc . ❑ Regular grounds maintenance continued . Abundant rain has keep lawns growing and green. ❑ Posting of Glenside and Dress Woods Preserves was done with our new boundary marker signs . Work on the Pine Tree Road and transit plaza section of Pew Trail continued getting it ready for granite curbing to be installed early in August. to The proposed new playground at Eastern Heights Park was presented to the Town Planning Board and approved with some minor changes to the site work . ❑ Many of the bikeways and nature trails were trimmed to cut back over-hanging brush. The mowed trails at our East Ithaca Preserve has to be trimmed by our staff as the volunteers ha not yet gotten organized enough to do that task as we originally planned . ❑ Woodchip mulching around park signs, benches and plantings was done . ❑ New blacktop walkways were backed up with crushed limestone and topsoil as needed . ❑ Dozens of flowering shrubs, ornamental grasses, annuals and perennials purchased with our beautification grant were planted at Town Hall, East Shore Park, and the various Welcome to Tompkins County signs . ❑ Rich Schoch and Toby Brown attended a half day seminar on Playground Safety and Inspection. ❑ New park and trail identification signs were put up at Tareyton Park, Dress Woods Preserve and entrances to Pew Trail ❑ Dead shrubs were removed at Grandview Park and re-seeded to grass . CURRENT PLANNING DEPARTMENT PROJECTS/FUNCTIONS The following have been accomplished over the past month. Comprehensive Plan Review Committee : The Comprehensive Plan Review Committee met on July 16, 2007 and completed review of Chapter III "Goals, Objectives and Recommended Actions" of the Plan. The Committee also began discussion of 2008/2009 Budget implications of a Comprehensive Plan update, such as staffing needs and the possibility of hiring a consultant to perform certain tasks in the Plan update. The Committee is making progress on reviewing the Plan, and hopes to have recommendations to the Town Board regarding an update of the . Plan by September or October. The next Committee meeting is scheduled for Monday, August 20, 2007 at 4 : 00 p .m. to review Chapters IV (Plan Synthesis) and V (Implementation Strategies) of the Plan. Codes and Ordinances Committee (COQ : The Committee met on July 18 , 2007 and completed review of a draft law regarding wind energy facilities, and continued discussion regarding comments received on the draft stream setback law . The next COC meeting is scheduled for August 15 , 2007 . Tentative agenda items include continuation of review of preliminary comments received regarding draft stream setback law and an introduction to the proposed stormwater management local law that staff has been working on. Transportation Plan: The Town Board adopted the Transportation Plan at the July 9, 2007 meeting. Staff is preparing the Plan sections for final printing, with the additional corrections noted at the July 91h meeting incorporated. Transportation Committee : The Committee cancelled its July meeting and tentatively cancelled the August meeting. Conservation Board : The Conservation Board met on July 5 , 2007 to discuss the status of committee work, update on the draft stream setback law, and candidates for the open Board position. The Conservation Board cancelled its August meeting. The next meeting is scheduled for September 6, 2007 . Cornell T-GEIS : The consultant team continues to prepare draft sections of the T-GEIS , which are being reviewed by the Project Team. Carrowmoor Committee: The Committee met on July 16 and August 1 , 2007 . Discussion continued on issues associated with the proposal , including traffic and transportation, affordable housing, number of housing units in the development, and other aspects, such as impacts of the development on the School District, guarantees for completion of project phases and infrastructure, water pressure available and improvements needed, and whether more open space could be preserved on the site. West Hill Trail Connections : Representatives from the Town, City, and the ITCTC Executive Director met on July 17, 2007 to continue discussion regarding potential bicycle and pedestrian trail connections from West Hill in the Town into the City of Ithaca. Maps of possible corridors and affected parcels were identified, and the group will be scheduling a site visit to look at potential areas for trails. Economic Development Collaborative: The group met on July 26, 2007 and heard updates from members on a number of projects and initiatives, including the Cayuga Green, Inlet Island developments . and Collegetown Vision Study in the City; the Wine Center that is being sponsored by the Downtown Partnership; the new car share program that is being set up by ITCTC; a report by the infrastructure work group that is looking at sewer and water issues in outlying areas; and the Route 13 and Route 96 Corridor Studies being coordinated by the County Planning Department. 4 sr. This became an issue this past spring when the Town Hall ' s internet connection was unavailable for almost 2 weeks and subsequently the Public Works staff could not access any data from their own file server which resides in their own building . Removal of this interdependence is also in keeping with the Town ' s " disaster plan " to designate the Public Works facility as a Command Center in the event that Town Hall was uninhabitable . New "field-hardy" Panasonic Toughbook tablet notebooks for Code Enforcement and Public Works staff. These devices allow staff to carry job specific software into the field and connect to the Town 's network via Verizon Wireless' s EVDO broadband network , thus providing staff access to all Town ' s network resources while on the job site . Sites included public works both the youth corps and office support ; non-profits such as Lifelong and the YMCA, small business such as the Bookery Il , and French Lavender; human services including Alterra and Northeast Kids Count ; hospitality with the Convention & Visitors Bureau ; educational at the Museum of the Earth, Positive News, American Learning at Cornell and Computer All stars as well as here in Town Hall . The wide range of opportunities reflects the skills , abilities, and interests of a very diverse group of youth . This year more youth were referred and hired outright by employers with budgets for summer employment familiar with the program . Personal services to help youth find employment do not exist unless an individual ' s family is extremely hard shipped . The increase in minimum wage has older, more permanent candidates vying for positions that were traditionally available for youth. Additionally local youth who filled positions at Cornell were displaced by college students this year. A program element includes meeting with other providers of youth employment opportunities to prevent duplication and assure a continuum of service for youth who will benefit from services . The meetings are coordinated by county youth services and are extremely helpful in assisting the public to the correct place . This year also presented more youth facing greater employment challenges such as English as a second language and disabilities requiring different approaches to employment opportunities . Two youth declined positions they were offered and the placements were filled with alternates . The recreation unit hired an intern Anna Gill . Anna has wonderful technical savvy and an exquisite artistic sense as well as being delightful and self directed . I am in awe of her talent and honored to work with her. She has incredible skill and talent . As the Chamber of Commerce has an initiative to keep local talent in Tompkins County I am encouraging them to look at our talented young people . One youth is working at the visitor ' s bureau and I am talking with Doug Levine about the program . A plethora of benefits can be gained for the youth and the community. r Recreation Partnership Negotiations continue amongst the partners on forging a new agreement. Recreation and Human Service Committee The committee met and reviewed its goal and the youth coordinators work plan with many of the objectives met or in process . Staff will be meeting with representatives of the Cal Ripkin League to ascertain how the inaugural season of Tutelo Ball field went . The weather affected the growth of the turf requiring suspension of summer play and public works addressed the issue with more seed and watering. As a result determining routine costs of ongoing maintenance will be difficult. In a related matter the committee reviewed a draft of a Recreation Facility Use Brochure . Content was determined after a series of internal meetings and the design by Anna Gill . The document should be available after approval by the committee . The Town will be holding and hosting in its lobby an Art exhibit celebrating National Senior Center Week on Monday September 10 from 3 : 30 - 5 : 30 prior to board meeting . This same meeting is the traditional student work initiative recognition program so a nice event will be planned . Joint programming with Lifelong is a first step in meeting public official activities The committee responded favorably to a request for use of Board Room for possible youth court program by Southern Tier Mitigation Project . The committee ask staff to invite Leslie Jones Project Director to board meeting in September or October for action by board on request . When the agenda is set Ms . Jones will be delighted to attend and support documentation will be provided . Related Activity Planning for the Fall Tutelo Park Celebration continues . Time and activities will be expanded and an active fund raising campaign is in process . On July 25 1 also attended with Anna Gill a community meeting sponsored by County Youth Services to address issues youth workers dealing with the schools .
