SPECIAL MEETING OF THE ITHACA TOWN BOARD
FRIDAY, SEPTEMBER 22, 2006 AT 5:30 P.M.

THOSE PRESENT: Supervisor Valentino, Councilman Burbank, Councilman Engman,
Councilman Stein, Councilman Cowie, Councilwoman Leary
STAFF PRESENT: Tee-Ann Hunter, Town Clerk; Susan Brock, Attorney for the Town.
EXCUSED: Councilwoman Gittelman
OTHERS PRESENT: None.
CALL TO ORDER
Supervisor Valentino called the meeting to order at 5:30 p.m. and led the assemblage in
the Pledge of Allegiance.
Agenda Item No. 3. - Consider entering Executive Session to Discuss Information
Relating to Current Prosecution of Criminal Offense
Supervisor Valentino stated the board needed to consider entering into Executive
Session to discuss information relating to current prosecution of criminal offenses. Ms.
Brock added that they should further state, "which would imperil effective law
enforcement if disclosed."
TB RESOLUTION NO. 2006-191: Enter Executive Session to discuss information
which would imperil effective law enforcement if disclosed
BE IT RESOLVED that the Town Board of enter into executive session at 5:31 p.m. to
discuss information relating to current prosecution of criminal offenses, which would
imperil effective law enforcement if disclosed.

SECONDED: Councilman Burbank

TB RESOLUTION NO. 2006-192: Return to Regular Session
BE IT RESOLVED that at 6:00 p.m. the Town Board of the Town of Ithaca return to
regular session.

IB RESOLUTION NO, 2006-193: Enter Closed Session to Seek Advise of Counsel
BE IT RESOLVED that the Town Board of the Town of Ithaca enter into closed session
AT 6:01 p.m. to seek advise of counsel.

IB RESOLUTION NO. 2006-194: Return to Regular Session
BE IT RESOLVED that at 6:07 p.m. the Town Board of the Town of Ithaca return to
regular session

Procedure for Scheduling Meetings of Committees of the Town Board
Councilman Stein asked how meetings of Town Board committees are scheduled. He
stated he has scheduled many meetings in his work through Cornell and he schedules
these meetings by sending people an email asking their availability. Councilman Stein
tries to find a place and time that all people can meet. Councilman Stein stated was not
able to attend a couple of Town committee meetings because the meetings were not
scheduled in that way. There was a meeting a few months ago where he received an
email stating that there was a meeting at a certain time. He called back saying he was
not able to attend. The answer he received was that the time was okay with everyone
else so the committee was going to go ahead and meet.
Councilman Stein reiterated that his schedule is rather complicated and if someone
picks a random time for a meeting, then the chances are good that he would not be able
to attend. He asked that Town Board committee meetings be scheduled so that the

staff person or chair of the committee will ask members when they can attend and try
very hard to set a meeting time when Town Board members are available.
Supervisor Valentino asked for comments. Councilman Engman thought that it was a
reasonable approach, and added that in some cases it may not be feasible to have all
three board members present, but at least two members should agree to that particular
time and place for the meeting. Councilman Stein stated that if two board members are
not present then there is not a quorum and the committee cannot meet. He
understands that it may not always work out where there is a time everyone can meet,
but felt an attempt should be made in that way rather than presenting members with a
time for a meeting. Councilman Engman thought that it made sense. Supervisor
Valentino added that is what is usually done and she does not have a problem with
following that procedure.
ADJOURNMENT
On motion by Councilman Stein moved seconded by Councilwoman Leary, the meeting
was adjourned at 6:12 p.m.
