CALL TO ORDER: Supervisor Valentino called the meeting order at 7:00 p.m. and led the
assemblage in the Pledge of Allegiance.
Agenda Item No. 3 - Board Comments
There were none
Request for Additional Agenda Items
Supervisor Valentino asked the Board to add the following items to the evening's agenda:
"Approval, Authorization to add $1,500 to the adopted 2007 Town Budget for the purpose of
funding the Town's annual share to the Stormwater Management Coalition of Tompkins
County" and "Approval and Authorization to add $198,557 to the Adopted 2007 Fire
Protection Town Budget for the shared portion of administrative overhead costs for fire
protection provided by the City of Ithaca". It was all right with all members of the Board to
add the items.
Ms. Drake had a third addition relating to agenda item number 12, "Consider approval of
2007 Health Insurance Rates", regarding the flexible spending plan. There was discussion
of whether or not the issue should come before the Board since it had not been spoken of in
the context of a Personnel Committee meeting. Supervisor Valentino polled the Board asking
if they would like to discuss the flexible spending plan as an additional agenda item. In favor
were: Councilwoman Leary, Councilman Cowie. Councilman Engman, Councilwoman
Gittelman, Councilman Burbank, Supervisor Valentino; opposed. Councilman Stein. The
item was added to the evening's agenda.

Supervisor Valentino opened the public hearing at 7:00 p.m. There was no one present to
address the Board and Supervisor Valentino closed the public hearing.

Ms. Valentino reported having spoken with Steve Thayer the previous day and there are a
couple of very minor changes from what was sent them in their Board packets having to do
with health benefits. Ms. Valentino stated that the budget was gone over and approved by
the joint sewer committee that includes Councilman Stein and Bob Romanowski,

WHEREAS, pursuant to the Joint Sewer Agreement between the City of Ithaca, Town
of Ithaca, and Town of Dryden, the governing bodies for all parties to that agreement must j n
vote on approval of the Ithaca Area Wastewater Treatment Plant 2007 budget; and

WHEREAS, the City of Ithaca held public hearings to consider approval of the 2007
Ithaca Area Wastewater Treatment Plant Budget on October 16,19, and 25, 2006; and

RESOLVED, the Town Board of the Town of Ithaca hereby approves the 2007 Ithaca
Area Wastewater Treatment Plant Budget.

WHEREAS, (Item No. 1 above) $ 102,121.79 of delinquent water and sewer charges

2007 Town and County Tax Bills; and

WHEREAS, (Item No. 2 above) $ 4.48 of delinquent water and sewer charges to be
written off the books; and
WHEREAS, Town Code Chapter 261 and Town Code Chapter 210 provides for all
delinquent accounts for payment of water and sewer rents and related charges to be placed
on the ensuing years tax roll as a relevy;
NOW THEREFORE BE IT RESOLVED, that this governing Town Board approves
delinquent water and sewer charges of $ 67,267.74 and $ 34,854.05, respectively, for relevy
to the 2007 Town and County Tax Roll; and be it further
RESOLVED, that a certified copy of this resolution along with a listing of those relevied
water and sewer charges be given to Tompkins County Assessment Department for adding
these delinquent charges to the 2007 Town and County Tax Roll, the Town Budget Officer for
accounting purposes, and that Southern Cayuga Lake Intermunicipal Water Commission for
the purpose of reconciling and account billing purposes.

Agenda Item No. 9 - Public Hearing to Consider Adoption of 2007 Town of Ithaca
Preliminarv Budget as the 2007 Final Budget
Supervisor Valentino opened the public hearing at 7:20 p.m. Ms. Schlaughter was present
from the Human Services Coalition to answer any questions from the Board. There were
none and there was no one further from the public wishing to address the Board. Supervisor
Valentino closed the public hearing at 7:21 p.m.
Additional Agenda Item No. 2 - Approval and Authorization to add $198.557. to the
Adopted 2007 Fire Protection Town Budget for the shared portion of administrative
overhead costs for fire protection provided bv the City of Ithaca
Supervisor Valentino explained that this omission was her mistake. She told the Board there
is money in the revenue side of the budget to cover the expense. She asked for Board
approval to add this to the budget line. Mr. Stein asked for confirmation that this would not
change the fire levy. Ms. Valentino told him that this does not change the amount because
they had some extra money that they had accrued and it would not change the fire protection
tax at all.
I 'Supervisor Valentino asked for questions or comments from the Board. Mr. Engman had two
questions. Mr. Engman reported having learned at the last budget meeting that the Board is
going be saving about $90,000 in health insurance. He saw where $44,000 of that came into
the general townwide fund appropriations and another $6,500 shows up in part town
appropriations. That's about $50,000 of the $90,000. He asked where the rest of it went.
Ms. Valentino told him it was in the highway fund, water fund, and sewer fund, all the funds
that have employees attached to them. Mr. Engman questioned the supervisor's salary as
presented in the budget stating it seemed to him that it was $500 less than it should be. Ms.
Valentino told him she looked at that and she thought the salary reported for her for 2006 is
$500 more than it is supposed to be. Ms. Drake stated the Supervisor's 2007 total salary will
be $44,978, the budget number is rounded up to $44,990.
TB RESOLUTION NO. 2006-231: Approval And Authorization To Add $198.557.00 To
The Adopted 2007 Fire Protection Town Budget For The Shared Portion Of
Administrative Overhead Costs For Fire Protection Provided Bv The Citv of Ithaca
WHEREAS: To the 2007 Preliminary Budget an additional $198,557.00 needs to be added
to the City of Ithaca Fire Protection Contract budget (SF3410.491) for the Town's Share of
the administrative and overhead costs of the City's fire department, and
WHEREAS: Since the projected 2007 City Fire Department figures where not available
when preparing both the Tentative and Preliminary 2007 Town Budget the Town Supervisor

Supervisor Valentino stated that the budget as presented did not contain an increase in the
tax rate. It will remain at $1.68. The increase in the levy is 2.1%. There is a decrease in
appropriations and spending of $56,120, which included the special districts. Without the
special districts, this year's appropriations and spending are $45,364 less than last year.

Additional Agenda Item No. 3 - Flexible Spending Plan Debit Card
Ms. Drake told the Board the flexible spending plan is a medical savings plan that will allow
employees to set aside a certain dollar amount to pay for co-pays, prescriptions pays, also for
over the counter medications. Every year employees have to decide on a dollar amount to
put into the savings plan and they need to use it or lose it, which has been extended to 15
months. The Town's current plan is a paper trail plan; an employee saves their receipts, gets
a paper claim form, makes copies, sends it in. EBS then sends them back a check to
reimburse them. Ms. Drake reported having been made aware of a debit card system. The
debit card system takes away some of the paperwork. When an employee designates their
yearly amount, the money would go on a debit card. When the employee goes to the doctor
or fills a prescription, instead of paying in cash and then asking for reimbursement they would
give the debit card and have the co-pay come off their balance. Employees would still need
to keep receipts in case of an audit. Regarding administrative costs, the Town currently pays
$3.00 per person per month. This program would increase per person costs to $4.25 per
person per month. Offering the flexible spending plan reduces the FICA and medicare tax
that the employer pays because the payroll deductions come pre-tax reducing the employer's
FICA and Medicare. The fees are paid by the savings the employer sees in the FICA and
Medicare.

Councilman Stein reported being a big user of the flex program at Cornell. It seems to him
that the debit card is a system that invites abuse. This is particularly true with the over the
counter medicines, prescription-less glasses, and so forth. Mr. Stein stated he actually does
a fair amount of deducting for those sorts of things. He sends in forms and they often reject
them or they write back and ask for more information. There is always a problem with the
flex plans, when you come to the end of the year and have money left over you think I'm
going to loose this so what is it that I ought to do to make sure that I don't loose the money. It
seems to Mr. Stein that if someone had the opportunity to go and just have the card swiped
even though people said you may be audited he thought there would be a temptation that a
lot of people couldn't resist. If people like it, they can do it with a debit card the same way,
namely the way they pay Mr. Stein off is they direct deposit the money in his checking
account. That's the way the reimbursement is transferred to him. From the point of view of
the employee he was not quite sure what the advantage is and stated he won't vote for it until
he is able to ask somebody at Cornell who manages things what they think of it and whether
there Is really a problem. This is the concern that led Mr. Stein to say it needed more
discussion. It is not the cost to the Town, he stated he was just wondering whether this is
essentially wise policy. Ms. Drake told him there are systems built in for dealing with misuse.
There are fees charged, the card is stopped, and the individual will not get to participate the
next year. Ms. Drake told the Board that the provider did not encourage the card for use in
purchasing over the counter drugs; those items would probably be audited and individuals
would have to provide receipts to BBS. The main use for the card is for prescription drugs,
and doctor and dentist visit co-pays. Individuals can access their card balance and will be
denied charges that exceed that balance.
Mr. Stein stated he would be voting against this. Not because he thought it was a particularly '
bad thing. He stated he thought that the committee system is not working well and there are
a number of issues that have come up that have convinced him that many committees do not
get to see things In an appropriate time frame and this is an example of that. He thought all
of these things could have been worked out in a more efficient environment of a few people
meeting rather than at the Board meeting. He stated he understood about time pressures,
but time pressures come two ways. One is that there is a deadline and the other is that you
didn't start early enough to consider it. Both of those lead to time pressures. If the Board has
a committee system where it's supposed to go through two levels then it becomes the
obligation of the chair of the committee and the staff to make sure that things do get
presented to that committee in a timely frame. Ms. Valentino asked if Ms. Drake had sent out
a memo about this. Ms. Drake responded that she had sent one to the personnel committee.
Mr. Stein reported having responded to that memo stating he had some problems. Ms.
Valentino indicated that he had not asked for a meeting in that reply and Mr. Stein stated that
was the implication. Mr. Cowie stated that if Mr. Stein had said he wanted to meet, he would
have called a meeting. He did not get that sense, nor did he get the sense that this issue
was that important. Mr. Cowie felt there were other issues that they could talk about where
this was a problem, but this particular one is not the strongest case on that particular front.
Mr. Cowie asked what the percentage of enrollment was in the flex plan. Ms. Drake told him
there were 28 employees enrolled in the program.

WHEREAS, the Town authorized providing employees a Flexible Spending Program
effective January 1, 2005; and
WHEREAS, the Personnel Committee discussed the option to change the plan to
allow the use of a debit card claim system, at an additional administration charge of $1.25 per
enrollee per month; and
WHEREAS, the Personnel Committee recommends changing the Flexible Spending
Plan to allow the use of a Debit Card claim system as the increase in the administrative
charge would be less than the saving the Town is experiencing in FICA and Medicare taxes;

Ms. Drake explained that this is the State required short-term disability. The Town had not
sent out a request for proposal on it for a very long time and so they sent one out. The rate
came in 50 cents lower than what the Town is currently paying. Ms. Drake was
recommending changing carrier to Highmark Casualty. The Board had no questions for Ms.
Drake.
TB RESOLUTION NO. 2006-236: Award Statutory Disability Insurance Provider.
WHEREAS, the Town of Ithaca has last quoted the Statutory Disability Insurance in
1998, in which the Town did not change providers since the incumbent reduced the monthly
premium to $5 per person per month; and
WHEREAS, the Town's insurance broker Haylor, Freyer and Coon, Inc, completed a
Request For Proposals for Statutory Disability Insurance for the Town; and
WHEREAS, there were 7 proposals received and evaluated by Doug Bolman, Haylor,
Freyer and Coon, Inc and the Human Resources Manager, and presented to the Town Board
at the November 9, 2006 meeting for review; and

WHEREAS, the Human Resources Manager recommends the proposal submitted by ^
Highmark Life and Casualty at the rate of $4.50 per person per month, retroactive beginning '

submitted by Highmark Life and Casualty as the provider of statutory disability insurance for
the Town at $4.50 per person per month; and, be it further

Highmark Life and Casualty for the statutory disability insurance retroactive to October 1,

Agenda Item No. 15 - Consider Approval of an Additional Firefighter for the Citv of
Ithaca
Supervisor Valentino reported that there was a proposal brought before the City for an
additional firefighter. She heard from Mayor Peterson who wanted to know if Supervisor
Valentino would agreed to it and if she had a sense of whether the Town Board would agree
to it. Ms. Peter did not want to bring this to Common Council for a vote unless there was a
reasonable sense that the Town Board would pass it. Ms. Valentino reported having told Ms.
Peterson that because the effect on the Town is only $10,997, the need is pretty clear, and
there is money in the budget that would cover the cost she bring it to the Board and tell them
she supported it. Mr. Stein asked why it was only $10,000. Ms. Valentino told him that was
the Town's percentage of the cost; $46,000+ is a firefighter's starting pay. The costs to be
shared, which is not a full year's salary, is $33,722. This has not been included in the fire
budget yet. Mr. Carvill reported a $14,000 surplus in the fire budget and that would handle
the $11,000 increase.

Supervisor Valentino reported having received a call from John Lampman from the County
Highway Department. He was wondering about the Town's support for a school speed zone
in front of the Coddington Road Community Center. If the Board was in favor of the request
he asked that Ms. Valentino write a letter of support. The Board authorized Ms. Valentino to
write the letter.
Agenda item No. 18 - Consider Executive Session to Discuss Employment History of a
Particular Person
The Board determined the issue should go to the Personnel Committee before coming before
the full Board.
Mr. Cowie thought if the committee structure is going to function the information gathering
and analysis should happen at the committee level and be presented to the Board for full
discussion. Rather than the Board informing the committee, the committee would inform the
Board.
