CALL TO ORDER
The meeting was called to order at 5 : 30 p . m . and Supervisor Valentino led the assemblage in
the Pledge of Allegiance
Agenda Item No . 3 : Persons to be Heard and Board Comments
Invitation from Cornell
Supervisor Valentino told the Board the president of Cornell and his wife have invited the
Town Board to have breakfast at their home on March 4 , 2005 at 8 : 30 a . m .
Board and Committee Assignments
Supervisor Valentino asked Board members to let her know if they would like their committee
assignments changed .
There will be openings on the Planning , Zoning , and Conservation Boards and the Town
Clerk' s office will be sending letters asking if members would like to be reappointed .
Additionally, the Town will need to appoint Planning and Zoning Board chairs at their year-
end meeting .
Sales Tax Information
Supervisor Valentino gave sales tax information from David Squires to Councilman Stein and
asked that other Board members receive copies .
Coddington Road Lighting District
Councilman Lesser asked Ms . Hunter if she could research establishment of the Coddington
Road Lighting District . Councilman Burbank asked if it could be undone if the community
decides it no longer wants it . Mr. Walker felt it could be undone . It would mean abandoning
the lights and having them removed . Procedurally , no one was sure how to go about it.
Councilman Stein asked why you would not want the lights . Mr. Burbank told him some of
his neighbors wish they didn 't have the lights because they cannot see the stars . Ms .
Gittelman stated that was why she didn 't want street lights .

Supervisor Valentino opened the public hearings at 5 : 45 p . m . The hearings were posted and
published as required .
In response to questions from Councilman Engman , Mr. Walker explained that some of the
districts were set up to be paid for based on frontage and some of the districts are set up on
an ad valorum basis . The older ones tend to be ad valorum and the newer ones , like
Coddington Road , are based on frontage . Mr. Engman asked if they came out to be roughly
equal for the homeowners? Mr. Walker felt it was more equitable if it was based on front
footage . Mr. Carvill explained that the annual cost of lighting the lights in each district is
what determines the value that's in the light district tax rate . For example , if the Coddington
Road area expenses approximately $6 , 000 per year to light their lights , the total linear
footage is divided into that cost and that rate is assigned to each property owner on their tax
bill . Equitably speaking everyone ' s paying their fair share at the greater or lesser amount of
the footage that they own , similarly with the assessed valuation . Mr. Barney thought the early
theory was that those who have more expensive homes have a correspondingly greater
benefit from the light. Recent thinking is that light is light and it really doesn 't matter how
much the value of your home is , so it is how much of your footage is lit up .

OTHER BUSINESS
Cass Park Pool Survey and Recreation Survey
Supervisor Valentino told the Board that she has arranged for the survey of Cass Park Pool
use and the Recreation Survey sent to residents in the fall newsletter to be analyzed by
Professor Cindy vanEss and graduate students at Cornell University . Regarding the Cass
Park Pool , Ms . vanEss has looked at the survey and reported to Supervisor Valentino that the
survey results provide sufficient data for statistical analysis and that pool use breaks down as
follows : 35 % City of Ithaca , 25 % Town of Ithaca , 31 % other Tompkins County residents , 9 %
outside Tompkins County . 40% of the users are from places other than the Town of Ithaca or
the City of Ithaca .

Intermunicipal Water Commission Agreement Increasing the Water Rate Charges and
Application Fees (Attachment #1 — proposed agreement)
Supervisor Valentino opened the public hearing at 6 : 00 p . m . The hearing was posted and
published as required . There was no one present to address the Board and Supervisor

Agenda item No. 7 = Consider Adoption of Amendment to the Southern Cayuga Lake
Intermunicipal Water Commission Agreement Increasing the Water Rate Charges and
Application Fees
TB RESOLUTION NUMBER NO . 2004=164 : Approving Amendment to the Southern
Cayuga Lake Intermunicipal Water Commission Agreement Increasing the Water Rate
Charges .
WHEREAS , the Town entered into an agreement of intermunicipal cooperation with
several other municipalities creating the Southern Cayuga Lake Intermunicipal Water
Commission and authorizing the construction by such Commission of the Bolton Point water
treatment plant and related transmission and other facilities , which agreement was restated
as of June 5 , 1979 and which agreement has been subsequently amended from time to time
(such agreement as so amended being hereinafter referred to as the "Agreement") ; and
WHEREAS , the Agreement included a schedule of the water rates to be charged ,
which schedule has been amended from time to time ; and
WHEREAS , the parties to the Agreement wish to amend the Agreement to increase
the water rates ; and

WHEREAS , a copy of the proposed amendment to the Agreement has been submitted
to this Board ; and
WHEREAS , a resolution was duly adopted by the Town Board of the Town of Ithaca
for a public hearing to be held by said Town on November 4 , 2004 , at 6 : 00 p . m . to hear all
interested parties on the proposed changes to the water rates and related agreement; and
WHEREAS , said public hearing was duly held on said date and time at the Town Hall
of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on
behalf of or in opposition to said proposed amendment , or any part thereof; and
WHEREAS , the Town Board finds it is in the best interests of the Town and its citizens
to effect the proposed reductions ;
NOW , THEREFORE , BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby
determines , pursuant to Part 617 of the Implementing Regulations pertaining to Article 8 of
the Environmental Conservation Law (the State Environmental Quality Review Act
[" SEQRA"] ) , that adoption of said proposed amendment is a Type II action , constituting
" routine or continuing agency administration and management , not including new programs
or major reordering of priorities that may affect the environment" and thus may be processed
without further regard to SEQRA ; and it is further
RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the amendment to
the Southern Cayuga Lake Intermunicipal Agreement amending the water rate schedule to
increase the water rates as set forth in the proposed agreement submitted to this meeting ,
which increase is generally from $2 . 04 per thousand gallons of water to $2 . 21 per thousand
gallons of water; and it is further
RESOLVED , that the Town Board sign such amended agreement as the act of the Town and
the Town Board ,

RESOLUTION NO . 2004-165 - SEQR : Local Law Amending the Town of Ithaca Code to
Adopt a New Water Rate Schedule Effective January 1 , 2005 for Water Rates , Charges ,
and Other Fees Chargeable to Consumers of Water in the Town of Ithaca
WHEREAS , this action is the enactment of a local law amending the Town of Ithaca
Code to adopt a new Water Rate Schedule effective January 1 , 2005 for water rates ,
charges , and other fees chargeable to consumers of water in the Town of Ithaca ; and
WHEREAS , said proposed local law would establish a new Schedule A - Water Rate
Schedule , which includes a new rate charged for water consumption of $ 3 .44 per 1 , 000
gallons ( reflecting an increase from the current rate of $ 3 . 20 per 1 , 000 gallons) ; and
WHEREAS , this is an unlisted action for which the Town of Ithaca Town Board is
legislatively determined to act as Lead Agency in environmental review with respect to the
enactment of local laws ; and
WHEREAS , the Town Board , at a public hearing held on November 4 , 2004 , has
reviewed and accepted as adequate the Short Environmental Assessment Form , Parts I and
II for this action ;
RESOLVED , that the Town of Ithaca Town Board hereby makes a negative
determination of environmental significance in accordance with the New York State
Environmental Quality Review Act for the above referenced action as proposed and ,
therefore , neither a Full Environmental Assessment Form , nor an Environmental Impact
Statement will be required .

WHEREAS , a resolution was duly adopted by the Town Board of the Town of Ithaca
for a public hearing to be held by said Town on November 4 , 2004 , at 6 : 05 p . m . to hear all
interested parties on a proposed local law entitled "A LOCAL LAW AMENDING THE TOWN
OF ITHACA CODE TO ADOPT A NEW WATER RATE SCHEDULE EFFECTIVE JANUARY
11 2005 FOR WATER RATES , CHARGES , AND OTHER FEES CHARGEABLE TO
CONSUMERS OF WATER IN THE TOWN OF ITHACA" ; and
WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal ;
and
WHEREAS , said public hearing was duly held on said date and time at the Town Hall
of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on
behalf of or in opposition to said proposed local law, or any part thereof; and
WHEREAS , pursuant to Part 617 of the Implementing Regulations pertaining to Article
8 of the Environmental Conservation Law, the State Environmental Quality Review Act
("SEQRA) , it has been determined by the Town Board that adoption of said proposed
ordinance would not have a significant effect upon the environment and could be processed
without further regard to SEQRA ,
NOW , THEREFORE , be it
RESOLVED , that the Town Board of the Town of Ithaca hereby adopts said local law
entitled "A LOCAL LAW AMENDING THE TOWN OF ITHACA CODE TO ADOPT A NEW
WATER RATE SCHEDULE EFFECTIVE JANUARY 1 , 2005 FOR WATER RATES ,
CHARGES , AND OTHER FEES CHARGEABLE TO CONSUMERS OF WATER IN THE
TOWN OF ITHACA, " a copy of which is attached hereto and made a part of this resolution ;
and it is further
RESOLVED , that the Town Clerk is hereby authorized and directed to file said local
law with the Secretary of State as required by law.

Agenda Item No . 15 - Public Hearing for Consideration and Adoption of Town of Ithaca
2005 Preliminary Budget as Town of Ithaca 2005 Final Budget
Councilman Lesser thanked Supervisor Valentino and the staff for their efforts to minimize
the amount of tax increase in the 2005 budget .
Supervisor Valentino opened the public hearing at 6 : 20 p . m . the hearing was posted and
published as required . There was no one present to address the Board and the hearing was
closed at 6 : 21 p . m .
Councilman Engman stated he felt pretty comfortable with the budget. The one thing he he
was a little uncomfortable with is the Open Space Fund and the reduction from a $70 , 000
contribution to the fund to $ 50 , 000 . He was uncomfortable for two reasons : 1 ) if the

development goes in across from the hospital , the Town should have money in the budget to
help create some sort of pedestrian access down the hill because Route 96 is too dangerous
for children and cyclists ; 2 ) he felt the Town was making good progress with the Agriculture
Committee and gaining some of their confidence and cooperation and he would hate for this
to be seen as a step back from the Town ' s commitment to their purchase of development
rights program . Supervisor Valentino voiced her agreement and stated she had it on her
short list of things that as revenues come in the Board could consider a budget amendment
to increase that contribution . The end of the first quarter of 2005 the Town would be an
appropriate time to revisit the budget and make possible amendments .
Supervisor Valentino warned the Board that the anticipated unappropriated fund balance
going in to 2005 was not as flush as it has been in past years . The State recommends 20 %
of the operating fund budget be kept in fund balance as a safety net. Supervisor Valentino
and Mr. Carvill anticipate going into 2005 with between 1 . 2 and 1 . 4 million . Supervisor
Valentino stated that traditionally the Town has come in with between 2 or 2 . 7 million . They
knew they would get to this point because the Town used those funds for different projects .
They will know more precisely where they stand and if money will be available for budget
amendments after the first quarter of 2005 .
Mr. Carvill explained to the Board that money can be transferred out of the General Fund into
Part Town and Highway , but transfers cannot go the other way , from Part Town or Highway
to General Fund . Councilman Stein asked if this was true of fund balances remaining at
year' s end and whether you can correct for sending too much money from the General Fund
into Part Town or Highway . Mr. Carvill told him that you could because surpluses fall back
into fund balance . Councilman Stein asked at what point during the budget process do
Board members have an input into the budget. Supervisor Valentino told him that the Board
can have input as soon as the Tentative Budget is turned over to the Town Clerk on
September 30th . Supervisor Valentino explained how many of the funding requests come up
through committee to the Department Heads who put the requests into their budgets . The
first run through of the budget has all of the committee funding recommendations .
Councilman Burbank stated one budgetary unknown relates to the payments to the City for
Cass Park and that the Town and City will presumably arrive at what seems to be a fair
figure . There is a $ 50 , 000 placeholder in the budget . Councilman Burbank stated that if we
were to determine the more appropriate figure would be closer to $ 100 , 000 we would have
three choices : 1 ) discover that our fourth quarter receipts were better than anticipated ; 2)
deplete our fund balance outside the safety zone ; 3) or, at this stage , effect the tax rate to
accommodate the contingency of finding the appropriate figure is closer to $ 100 , 000 .
Councilman Burbank asked if this was the only stage at which the tax rate could be raised .
Supervisor Valentino told him that this was the only stage that , if you wanted to bring the
number up to $ 100 , 000 , something she strongly recommended they not do , you could raise
the tax rate 5 % , which would be the increase needed . In response to questions from
Councilman Stein , Supervisor Valentino stated $ 50 , 000 represents a 5 % increase in the tax
rate ; every $ 10 , 000 is 1 % increase . Mr. Carvill added the currently proposed $ 112 , 000 tax
increase represents 9Y2% . If Mr. Burbank is proposing to raise taxes $50 , 000 , that' s roughly
half of the proposed increase , so you are going to be raising the tax rate roughly 5 % , or from
12 cents per thousand to 18 cents .

In response to Councilman Lesser, Supervisor Valentino reported the following items were on
her short list for possible future funding : increase Parks and Open Space by $20 , 000 ;
possible addition of $5 , 000 to Recreation Programming ; possible additional funding needed
for Storm Water Management; increase Transportation Plan by $5 , 000 . At this time , the
Cass Park Facility is not on her short list . She reported having sent the City the MOU
regarding Cass Park funding for 2004 . The City did not put any Town money for Cass Park
in their 2004 budget. When the Town signs off on the MOU , the City will have $50 , 000 that
they did not plan on .
Councilman Lesser asked if the sales tax the Town receives in the fourth quarter is roughly
equivalent for the fourth quarter sales tax we received last year would the Town then have
sufficient funds to cover the short list items and perhaps make an additional contribution to
Cass Park . Or, would the Town have to go over the sales tax receipts from fourth quarter last
year in order to cover the contingency items . Mr. Carvill said he anticipates the surplus in
sales tax will be between $68 , 000 and $ 82 , 000 . This would adequately meet a large portion
of what is on Supervisor Valentino' s list to propose to the Board . It would be necessary to
look at first quarter disbursements and analyze that in terms of what will be the anticipated
fund balance ending the first quarter.
Councilman Engman stated he did not want to raise the 2005 tax rate and would feel
comfortable if the Board agreed to review the figures and priorities at the March 2005
meeting . He asked that the Board make a commitment to do this in March .
Supervisor Valentino told the Board that at some point she would like to propose to Cornell
President Lehman that Cornell provide some funding for the town 's purchase of development
rights program . She felt it would be important to Cornell to see farmland preserved . The
Town is going to need to look for grants and other money for the purchase of development
rights program .
Mr. Kanter asked that money for the continuing the Lake Source Cooling consultant be added
to the Town 's short list. The Town has expended just about all the money that was in the
agreement for Cornell to pay for the Town ' s hiring of a consultant for the monitoring process .
Mr. Kanter did not know how much money would be needed but will be talking with Paul
Wertman from Benchmark to get an estimate .

adoption of the 2005 Preliminary Town of Ithaca Budget as the 2005 Town of Ithaca Final

budget as presented by the Town Supervisor and Budget Officer; now, therefore , be it

AGREEMENT TO CHANGE WATER RATE SCHEDULE
THIS AGREEMENT to change Water Rate Schedule is made as of the 1 st day of January, 2005 ,
between the TOWN BOARD OF THE TOWN OF DRYDEN, Tompkins County, New York, on its
own behalf and on behalf of all water districts in the TOWN OF DRYDEN served by the Southern
Cayuga Lake Intermunicipal Water Commission, (hereafter referred to as "Dryden"), the TOWN
BOARD OF THE TOWN OF ITHACA, Tompkins County, New York (hereinafter referred to as
"Ithaca"), the TOWN BOARD OF THE TOWN OF LANSING, Tompkins County, New York, on its
own behalf and on behalf of the Town of Lansing Consolidated Water District (the Town of Lansing
and such district are hereinafter collectively referred to as "Lansing Town'), VILLAGE OF
LANSING, on its own behalf and as successor to LANSING WATER DISTRICT 1 , Tompkins
County, New York, (hereinafter referred to as "Lansing Village"), and VILLAGE OF CAYUGA
HEIGHTS, Tompkins County, New York, (herein after referred to as "Cayuga Heights"), all of the
parties hereto sometimes collectively or individually referred to hereinafter as "Municipalities" or
"Municipality",
WITNESSETH:
WHEREAS, the above named municipalities have entered into an amended, supplemental, restated and
consolidated agreement of municipal cooperation for construction, financing and operation of an
intermunicipal water supply and transmission system dated as of June 5, 1979 as the same has been
amended from time to time (the "Agreement"); and
WHEREAS, pursuant to the Agreement each municipality agreed to pay to the Southern Cayuga Lake
Intermunicipal Water Commission (hereinafter referred to as "Commission'), water revenues based
upon, in part, a water rate schedule annexed as Exhibit I of Schedule A to the Agreement; and
WHEREAS, based on change 's in costs, the Commission believes it is advisable to adopt a new water
rate schedule in the form annexed to this modification agreement; and
WHEREAS , Schedule A of the Agreement provides that the water rate schedule may not be changed by
the Commission without the written agreement to such change of all the parties; and
WHEREAS , Exhibit I of Schedule A to the Agreement has been amended from time to time since the
initial date of the Agreement; and
WHEREAS, the parties believe it is necessary to amend Exhibit I of the Schedule A further; and
WHEREAS, the parties are willing to agree to such change;
NOW, THEREFORE, in consideration of the premises and the mutual undertakings of the parties
pursuant to the Agreement, the parties hereby agree that Exhibit I of Schedule A annexed to the
Agreement be amended effective January 1 , 2005 to read as set forth on the Exhibit I annexed hereto,
and such exhibit is adopted as Exhibit I, the water rate schedule, for all purposes under the Agreement .

This modification agreement may be executed in multiple counterparts which, when taken together,
shall constitute a complete document even though each of the counterparts may not bear the signatures
of all of the parties.

2005 WATER RATE SCHEDULE
EFFECTIVE JANUARY 1 , 2005
RATE STRUCTURE:
The flat rate charge per 1 , 0001 gallons shall be non-fluctuating and equal to two dollars and twenty-one
cents ($2 . 21 ) . This rate is equal to one dollar and sixty-five cents ($ 1 . 65) per 100 cubic feet . The
foregoing rate will be the rate charged for all regular quarterly bills sent after January 1 , 2005 . Actual or
base consumption may occur prior to January 1 , 2005 ,
MINIMUM EASE CHARGES :
Notwithstanding the foregoing rate structure, the following minimum base charges shall be applicable to
the meter size indicated below, for regular quarterly bills sent after January 1 , 2005 . The table below
shows the amount of water consumption that is permitted before the minimum base charge would be

Multiple Housing and mobile home parks of over two dwelling units, using a master meter, will be
computed as follows : The quarterly master meter reading will be divided by the number of dwelling
units and the water charge will be figured on this number as if the unit was individually metered . The
water charge will then be multiplied by the number of units on the master meter and this will be the
billing rendered . If the calculation of the water consumed per dwelling unit is less than the allowable
consumption for a three-quarter inch meter, then the billing will be calculated by multiplying the number
of units on the master meter times the minimum base charge for a three-quarter inch meter (e. g. , if there
were 20 dwelling units on the 'master meter, and total water consumption shown by the master meter
was 100, 000 gallons, the Commission billing would be $442 . 00 (20 units times $22. 10) rather than
$221 . 00 ( 100,000 gallons at $2 .21 / 1000 gallons))

An annual charge for each fire protection main serving a fire suppression system will be billed along
with the first quarterly water bill of the calendar year. The annual charge for this service shall be $20. 00
per diameter inch of the pipe supplying the fire suppression system. The pipe supplying the fire
suppression system is the pipe needed to supply the fire suppression system, installed downstream of the
system control valve.
The water application fee shall ' be $ 170 . 00 for each new service for which application is made after
January 1 , 2005, plus the cost of a meter, tap, accessory materials and installation costs in a location
approved by the Southern Cayuga Lake Intermunicipal Water Commission.

A LOCAL LAW AMENDING THE TOWN OF ITHACA CODE TO ADOPT A NEW
WATER RATE SCHEDULE EFFECTIVE JANUARY 1 , 2005 FOR WATER RATES,
CHARGES, AND OTHER FEES CHARGEABLE TO CONSUMERS OF WATER IN THE
TOWN OF ITHACA,
Be it enacted by die Town Board of die Town of Ithaca as follows :
Section 1 . Chapter 261 of die Town of Idiaca Code is amended by deleting die water rate
schedule previously adopted as Schedule A to such chapter and inserting a new Schedule A water rate
schedule as set fords in dhis local law.
Section 2. Notwidistanding die provisions of die annexed water rate schedule, if there are
existing contracts between a ' bulk user and die Town pursuant to which die Town, for other
considerations, agreed to charge a water rate different than that required by die annexed schedule, die
Town may continue to honor such contracts at die rates therein prescribed or at such other rates as
may be agreed to between die Town of Ithaca and die other contract party. Nothing in this section
shall preclude die Town if it deems it advisable, from charging said bulk user die rates that would
otherwise be required by this local law.
Section 3 . In die event that any portion of dus local law is declared invalid by a final order of a
court of competent jurisdiction, die validity of die remaining portions shall not be affected by such
declaration of invalidity.
Section 4 . This local law shall take effect five days after its adoption or upon its filing with die
Secretary of State of die State of New York except that die water rate schedule annexed hereto shall
become effective with respect to all bills issued on or after January 1 , 2005 .

WHEREAS , $ 68 , 602 . 31 of outstanding accounts receivables for water and sewer charges
inclusive of penalties and related surcharges for the billing period 12/1 /03 , 3/1 /041 6/1 /04 , and 9/1 /04
remain unpaid and due to the Town as of October 15 , 2004 ; and

WHEREAS , (Item No . 1 above) $ 68 , 602 . 31 of delinquent water and sewer charges inclusive
of penalties and related surcharges for the billing period 12/ 1 /03 , 3/ 1 /04 , 6/ 1 /04 , and 9/1 /04 remain
unpaid and due to the Town as of October 15 , 2004 to be relevied onto the 2005 Town and Cou
Tax Bills ; and
WHEREAS , ( Item No . 2 above) $ 2 . 95 of delinquent water and sewer charges to be written
the books ; and
WHEREAS , Local Town Law No . 2 of 1976 "WATER RENTS" and Local Town Law No . 6 of
1986 "SEWER RENTS" provides for all delinquent accounts for payment of water and sewer rents
and related charges to be placed on the ensuing years tax roll as a relevy;
NOW THEREFORE BE IT RESOLVED , that this governing Town Board approves delinquent
water and sewer charges of $ 43 , 466 .40 and $ 257135 . 91 , respectively, for relevy to the 2005 Town
and County Tax Roll ; and be it further
RESOLVED , that a certified copy of this resolution along with a listing of those relevied water
and sewer charges be given to Tompkins County Assessment Department for adding these
delinquent charges to the 2005 Town and County Tax Roll , the Town Budget Officer for accounting
purposes , and that Southern Cayuga Lake Intermunicipal Water Commission for the purpose of
reconciling and account billing purposes .
