SPECIAL BOARD MEETING
March 25, 1^74 - 7s30 p.m.
At a Special Meeting Of the Town Board of the Town of Ithaca, Tompkins
County, New York, held at the TOwh of Ithaca Offices at 108 East Green
Street, Ithaca, New York, on the 25th day of March, 1974, at 7s30 p.m.,

Public Hearing - Project I - Bolton Point ~ Modification (Supply)
Proof of posting and piiblication having been presented. Supervisor
Schwan opened the public hearing at 7:30 p.m.
n Supervisor Schwan explained the basic changes proposed in the Bolton
Project I are twos (1) the original resolution stated that the
pl^t would be at Bolton Point, the modification merely
saying ^at the filtration plant will be constructed 1,100 feet down
Tu from the original site, and (2) a change in the amount ofthe Town of Ithaca's share of the total cost of the project.
Motion by Supervisor Schwan; seconded by Councilman Powers,
^SOLVED, that the indicated changes in Project I (Modification of
Plans for the Establishment of the Town Wide Water Supply Benefited
Area of the Town of Ithaca, Tompkins County, New York - Bolton Point)
as tlie legal notice published in the Ithaca Journal on
March 14, 1974, be approved. (Town Clerk's note: See later resolu
tion relating to republication of this notice of public hearing.)
The motion was put to a roll call vote, with the following results:
Councilman Del Rosso, voting Aye
Councilmcui Powers, voting Aye
Supervisor Schwan, voting Aye
The resolution was thereupon duly adopted.
Public Hearing - Project II - Bolton Point - Modification (Distribution)
Proof of posting and publication having been presented. Supervisor
( Schwan opened the public hearing at 7:30 p.m.
Supervisor Schwan explained that the modification in this case is
that the Town of Lansing is included in the project and that the
Town of Ithaca's involvement in terms of bonded indebtedness is
being increased from $1.42Q,7GO to $1,460,700, the increase being
based on additional inrormation in terms of water consumption re
ceived after the Town Board hearing in April of 1973.

Motion by Supervisor Schwan: seconded by Councilman Powers,
RESOLVED, that the indicated modifications in Project II (Modification
of Plans for the Establishment of the Tbwn Wide Watet Distribution
Benefited Area of the Town of Ithaca, Tompkins County, New York -
Bolton Point) as outlihed in the le^al notice published in the Ithaca
Journal on March 14, 1974 be approved, subject to preparation of an
appropriate resolution by the Town Attbmey to be adopted at the next
regular meeting of the Town Board to bo held on the 8th day of April,
1974.
The motion was put to a roll call vote, with the following results;

Councilman Powers# voting Aye
Supervisor Schwan, voting Aye
The resolution was thereupon duly adopted.
For the record, no persons appeated to speak for or against the fore
going modifications, and thte hearings were thereupon closed.

Because of errors made by the Ithaca Journal in its publication of
March 14, 1974 with respect to the order for a public hearing in the
matter of the modification of plans for the establishment of the Town
Wide Water Supply Benefited Area of the Town of Ithaca (Bolton Point
Project I), the Board took the following actions;
^ Motion by Supervisor Schwan? seconded by Councilman Powers,
j WHEREAS, after reviewing the order and notice of public hearing
as published in the Ithaca Journal with respect to Bolton Point Pro
ject I (Modification of Plans for the Establishment of the Town Wide
Water Supply Benefited Area of the Town of Ithaca, Tompkins County,
Mew York), it was determined that the Ithaca Journal had not published
the notice of public hearing correctly in that certain parts of the
order for the public hearing which was adopted by the Town Board on
March 11, 1974 had been erroneously omitted by the newspaper in print
ing the notice of public hearing,
NOW, THEREFORE, BE IT RESOLVED;
That the notice of public hearing be republished in exactly the
same form as originally submitted to the Ithaca Journal by the Town
Clerk and as originally adopted by the Town Board on March 11, 1974,
but changed only to provide that the public hearing will be held on
April 8, 1974 at 5;30 p.m.
It is understood that until the next public hearing is held as
ordered below, on April 8, 1974, the Town Board preserves all rights
in the proceedings which it may have under the aforesaid notice dated
March 11, 1974, which was erroneously published on March 14, 1974.
A roll call vote was taken, with the following results;

In the Matter
The Modification of Plans for the
Establishment of the Town Wide Water
Supply Benefited Area of the Town of
Ithaca, Tompkins County, New York.
WHEREAS, pursuant to the provisions of Article 12-C of the Town
Law and more particularly a resolution of this Town Board dated April
9, 1973, the Town of Ithaca, Tompkins County, New York, has hereto
fore established a benefited area in and for said Town to be known
^s the Town Wide Water Supply Benefited Area (Bolton Point Inter-
municipal Project), and has authorized the providing of a water im
provement for said area; and
WHEREAS, the plan, report and map prepared in connection with
the aforesaid water improvement provided for the construction of an
intake and water treatment plant at Bolton Point on Lake Cayuga in
the Town of Lansing, a raw water pump station, force mains, plant and
pump station roads and a transmission main, together with appurtenant
facilities and the acquisition of necessary lands or rights in land,
all at a meucimum estimated cost of $4,150,000; and
WHEREAS, the aforesaid proceedings provided that the proposed
improvement would constitute a comprehensive water improvement for
use as an interrounicipal water supply facility for the Towns of
Dryden, Ithaca and Lansing and the Village of Cayuga Heights, for
their joint use and operation pursuant to an agreement of municipal
cooperation and pursuant to which the share of the costs to be allo
cated to the Town of Ithaca were estimated then to be $2,551,000; and
WHEREAS, it has been determined to locate the aforesaid water
treatment plant at an alternate location, approximately 1,100 feet to t
the south of the location originally set forth on the aforesaid map
adjacent to the State Highway near a road leading from Bolton Point;
and
WHEREAS, present estimates indicate that the share of the Town
of Ithaca will be $2,324,000; and
WHEREAS, it is now desired to call a public hearing on the fore
going matters in the manner prescribed by Section 209-q of the Town
Law; NOW, THEREFORE, BE IT
ORDERED, by the Town Board of the Town of Ithaca, Tompkins County,
New York, as follows:

Section .1. A meeting of the Town Board of the Town of Ithaca,
Tompkxns County, New York, shall be held at 108 East Green Street,
Ithaca, New York, (Town Offices on third floor), on the 8th day of
April, 1974, at 5;30 o'clock P.M., Eastern Daylight Saving Time, for
the purpose of conducting a piiblic hearing on the modification of the
plans for the aforesaid improvement and the revised estimate of the
^ cost thereof to be borne by the Town of Ithaca, as set forth in the
preambles hereof, at which time all persons interested in the subject
matter may be heard concerning the same, aind for the purpose of taking
such further action on the aforesaid matters as is auti^rized or re
quired by law.
Section 2. The Town Clerk is hereby direcbed to give notice of
such public hearing by publishing a copy of this Order once in the
Ithaca Journal, the official newspaper of said Town and by posting a
copy thereof upon the signboard maintained by him pursuant to Section
30 of the Town Law and as required by the provisions of subdivision 3
of Section 209-q of the Town Law.
Section 3. This Order shall take effect immediately.
The question of the adoption of the foregoing Order was duly put
to a vote on roll call, which resulted as followss

PROPOSED REZONING OP
LAND OF LAGRAND CHASE
Supervisor Schwan reported that the Town of Ithaca Planning Board at
its meeting on February 26, 1974, by resolution, recommended that the
Town Board of the Town of Ithaca hold a public hearing to consider the
rezoning of a parcel of land off Ridgecrest Road in the Town of Ithaca
owned by Lagrand Chase, from R-30 to R-15.
Motion by Supervisor Schwan? seconded by Councilman Del Rosso,
RESOLVED, that the Town Board of the Town of Ithaca hold a public
hearing on April 8, 1974 at 5235 p.m. to consider the proposal to
rezone the property of Lagreuid Chase which is west of Ridgecrest Road
from R-30 to R-15, being the parcels designated on the tax map on file
in the Town Clerk's Office, Town of Ithaca, (Pcorcel 45-1-2.2) and con
taining approximately 53 acres, bounded on the south by the south line
of the Town of Ithaca, on the north by leunds of Schuylkill Investors,
Inc. (Beacon Hills - Pcircel 44-2-9), on the east by the west line of
the parcels of land which front on Ridgecrest Road (Parcels 45-1-2.3
through 45-1-22, inclusive), and on the west by the Swanson property
(45-1-1.2) and Schuylkill Investors, Inc. (Beacon Hills - Parcel
44-2-9).

The Town Clerk was instructed to prepare the required notices to
parties who may be affected or have an interest in the proposed re-
zoning •
EXTENSION OF TOWN AND COUNTY TAX WARRANT
Motion by Supervisor Schwan? seconded by Councilman Powers,
RESOLVED, that the Town Supervisor request the County to extend the
warrant for the collection of 1974 Town and County taxes to June 1,
1974.
Unanimously carried.

MAPLE AVENUE HOUSING PROJECT
DISTRIBUTION OF SHELTER RENTS
Supervisor Schwan reported that on January 21, 1974 the Town of Ithaca
received a check from Abbott Associates in the amount of $5,603.94
representing 10% of Shelter Rents f6r 1973 in lieu of taxes for the
tax year 1974 for the Maple Avenue Hbusing Project. It would appear,
according to statute, that the money should be distributed to the
Town of Ithaca (including Pire Protiection (9.0102%), the County of
Tompkins (8.4690%), and the.Ithaca City School District (82.52%),
this pro-ration based upoh 1974 tax rates in these three entities.
Motion by Supervisor Schwah; seconded by Councilman Powers,
RESOLVED, that the Town Ithaca disburse the total of $5,603.94
received from Abbott Associates, representing 10% of Shelter Rents
for 1973 in lieu of t^es for the tax year 1974 for the Maple Avenue

COUNTY REQUEST TO TOWN OF ITHACA TO
SHARE IN THE COST OF FLYING NEW AERIAL PHOTOS
Supervisor Schwan reported that the County of Tompkins is contemplat
ing over-flying the County to take a new set of aerial photographs
which would update the photos we now have by about six years. Mrs.
Holcomb indicated that the County's immediate request is for the Town
of Ithaca to pay a shcure of the actual flying expenses. The cost of
getting prints would be over and above that. The County is requesting,
that the Town of Ithaca contribute $100.00 toward the flying expenses
at this time.
Motion by Supervisor Schwan? seconded by Covincilman Powers,
RESOLVED, that the Town of Ithaca acquisces in the County of Tompkins
request for a contribution of $100.00 toward the cost of flying aerial
photographs of the County of Tompkins.

PLANNING ENGINEER - JOB APPLICATIONS
Barbara Holcomb, Planning Board Chairman, reported that six applica
tions have been received from applicants for the job of Planning
Engineer to replace Kenneth Kroohs who is leaving this summer. She
requested guidance from the Board on how to proceed to screen the
applicants and a decision about paying expenses to bring the appli
cants to Ithaca for interviews. '
It was the sense of the Board that the two or three most likely
applicants should be contacted by telephone and when the selection
comes down to a reasonable number they should be invited to Ithaca
and their expenses paid.
Motion by Supervisor Schwan? seconded by Councilman Del Rosso,
RESOLVED, that the Town Board authorizes portal to portal expense to
reimburse potential applicants for the job of Planning Engineer,
expenses to be paid on the submission of a voucher by those applicants
interviewed.
Unanimously carried.
