Motion by Supervisor Schwan; seconded by Councilman Desch,
RESOLVED, that the minutes of November 8, 12, and 19, 1973 be
approved, as presented.
Unanimously carried.
PUBLIC HEARING
REZONING TAX PARCEL 43-2-9HERBERT AND. LENORA MONKEfiEYER ^
Proof of posting and publication having been presented the Supervisor
opened the public hearing on. the proposed rezoning of Parcel 43-2-9,
owned by Herbert and Lenora Monkemeyer, and considered a part of the
'Springwood" Development, from R-30 to Multiple Residence.
Supervisor Schwan read a letter dated December 4, 1973 from Frank
R. Ligucri, Commissioner of Planning, Tbmpkins County Department of
PJanning, in which Mr. Liguori acknowledged receipt of the rezoning
proposal for review under Section 239m, noting it to be consideration
of an addition to the multiple residence zone of one parcel of land,
100 by 150 feet. Mr. Liguori said the rezoning proposal as submitted
"will have no significant, deleterious impact on intercommunity. County
cr State interests. Therefore, no rec(»imendation is indicated by the
County Planning Department and you are free to act without prejudice."
, ' It appeared that no persons wished to be heard concerning the pro
posed rezoning. The Supervisor, therefore, closed the hearing and
the Board took the following action:
Motion by Supervisor Schwan; seconded by Councilman Desch,
RESOLVED, that the Town Board of the Town of Ithaca hereby amends
the Zoning Ordinance of the Town of Ithaca by re-zoning Tax Parcel
No. 43-2-9 owned by Herbert and Lenora Monkemeyer, and considered a
part of the "Springwood" Development, from R-30 to Multiple Residence.
This amendment shall take effect ten (10) days after posting and
publication herebf as required by Section 265 of the Town Law.
Unanimously carried.

residence.
6. The existing ditch on the west boundary will be shown
on the Site Plan, and
FURTHER, it is to be understood that final approval of the
Site Plan shall be given to Phase 1 only and that future
phases must be approved by the Planning Board and the Town
Board prior to the issuance of any building permit for said
future phases.
The Board reviewed site plans presented by Evan Monkemeyer and
Geoffrey Netzler, Architect. The Board approved of the plans gen
erally, but requested that an electrical design, including site light*
ing, be submitted for approval before a building permit is issued,
that the center hydrant now on King Road be moved inside the Project
on a 6-inch main, and the center hydrant on the plans, along King
Road, be deleted, and that footing drains be required on the east
side of Ainits B and C. Items 5 and 6 in the Planning Board resolu
tion were accounted for by the re-zoning adopted at the meeting of
the Town Board (Decenjaer 10, 1973) and by indication on the plans
with respect to the ditch on the west boundary.
It appearing that no persons wished to be heard, the hearing was
closed and the Bocurd took the following actions

RESOLVED, that upon the recommendation of the Planning Board of the
Town of Ithaca, the Town Board of the Town of Ithaca approves Site
Plan #73-461 (Phase 1, 25 units), dated October 23, 1973, last

such approval beihg contingent upon the fulfillment of the following
conditions;

SEWERING OF FOREST HOME AREA, SLATERVILLE ROAD
AREA, GLENSIDE ROW AREA, CODDINGTON ROAD AREA
AND ELM STREET EXTENSION AREA .
The Supervisor noted that a piiblic hearing was held on this matter
on November 12, 1973 and another public hearing was held on December
10, 1973 to consider an amended map, plan and report, and the Decem
ber 3, 1973 meeting was adjourned until December 10, 1973 to give the
Town Attorney an opportunity to prepare a formal proposed resolution
to authorize this improvement.
The Supervisor read the proposed resolution. Discussion was brief
since this matter had already been taken up at two public hearings.
Supervisor Schwan noted that should the proposal be authorized, fol
lowing past precedent, people would not be requiired to hook up to the
system for ten years as long as their existing systjsm is satisfactory.
Should the system fail, however, prior to the expiration of the ten
years, it would be necessary to hook up. Where the facility is made
available, the benefit charge will be billed whether it is used or
not.
There was some emphasis in the discussion on the fact that the entire
area of the Town of Ithaca is considered to be the benefited area,
and all Town residents pay for the system rather than just the par
ticular areas being sewered.

Nicholas ChaOona delivered to the Board seven postcards from
people who had nOt previously replied to the post-card survey which
the Town conducted in March, 1973, All the seven cards indicated the
people did not want sewer (Elm StreOt Extension area)• Supervisor
Schwan said only four o£ the seven cards were applicable to the case.
The other three refer tojWest Haven Road and Coy Glen Road where it
is not intended to put sewer, and the tount is still about 16 to 14
in favor of the proposal to sewer. Coiincilman Powers noted, ih any
event, the whole proposal is subjeot tb permissive referendum.

A RESOLUTION ESTABLISHING A BENEFITED AREA IN AND
FOR THE TOWN OF ITHACA, TOMPKINS COUNTY, NEW YORK,
TO BE KNOWN AS THE TOWN WIDE SEWER IMPROVEMENT
BENEFITED AREA, AND AUTHORIZING THE PROVIDING OF
A TOra SEWER UI4PR0VEMENT FOR SAID AREA.
Whereas, the Town Board of the Town of Ithaca, Tompkins County,
New York, has heretofore duly caused a plan, report and map to be pre
pared and filed in the office of the Town clerk of said Town in rela
tion to the providing of a sanitary sewer improvement for the area of
said Town outside of any village?, which area is the area benefited
by said improvement as hereinafter desdribed pxirsuant to Article 12-C
of the Town Law? and
WHEREAS, an order was duly adopted by said Town Board on
October 23, 1973, reciting the proposed improvement, a description
of the boundaries of the proposed benefited area, the maximum amount
proposed to be expended for said sewer improvement, the proposed
method of apportioning the cost of said sewer improvement, the pro
posed method of financing to be employed, the fact that said plan,
report and map were filed in the Town Clerk's Office for public in
spection specifying the Town offices on the third floor at 108 East
Green Street, Ithaca, New York, as the place where, and November 12,
1973 at 5:30 p.m., as the time when such Board would meet and hold a
public hearing on the authorization of the said improvement and estab
lishment of the said proposed benefited area and on the plan, report
and map filed in relation thereto, at which all persons interested in
the subject thereof would be hecurd concerning the same? euid

WHEREAS, the public hearing was duly held at bhe time ahd

WHEREAS, said Town board has duly considered the aforesaid
plan^ report and map, as amended, euid the evidence given at said pub
lic hearing; NOW, THEREFORE, BE IT
' RESOLVED, by the Town Board of the Town of Ithaca, TOmpkins
County, New York, as follows:
Section 1« Upon the evidence given at the aforesaid public
hearings it is hereby found and determined:
a) That all the property in the said benefited area
as hereinafter described is benefited by said sewer
improvement and that all property benefited by said
sewer improvement is included in said benefited area;
and
b) That it is in the public interest to establish such
benefited area as hereinaft^ described and to provide .
said sewer improvement as hereinafter authorized.
Section 2. The establishment of the aforesaid benefited area
to be designated and known as Town Wide Sewer Improvement Benefited
Area in said Town is hereby authorized and approved, said area to con-,
sist of the entire area of the Town of Ithaca outside of th^ Village
of Cayuga Heights, the only village located in said Town. \

Section 3. Construction of the aforesaid sewer improvement
substantially in accordance with the aforesaid plan, report and map,
as amended, consisting of eight inch seuiitary sewer lines, manholes,
four inch house laterals, force mains, pump and lift stations and N
other appurtenant facilities for connection to the existing sanitary
sewer system in said Town, is hereby authorized at a maximum estimated
cost of $970,000.00. Such cost shall be borne by the aforesaid bene
fited area, constituting the entire area of the Town of Ithaca, out'-
side of the Village of Cayuga Heights, and to the extent not paid
from revenues derived from sewer rents or other available funds, such
cost shall be assessed, levied cuid collected from the several lots
and parcels of land in said benefited area of the Town of Ithaca, in
just proportion to the amount of benefit which the sewer improvement
shall confer upon said lots and parcels, and such cost shall be finan
ced by the issuance of serial bonds of said Town to mature in annual
installments for a period not exceeding forty years.

REQUEST FOR 50 MILES PER HOUR MAXIMUM
SPEED ON TOWN AND COUNTY ROADS
Supervisor Schwan reporbed bhab bhe Town has had a requesb from
Howard A. Sbevenson, Jr., Commissioner of Public Works, Highway
Deparbmenb, Tompkins Counby, asking bhe Town Board bo consider a
resolubion for reducing bhe maximum speed on Town and Counby roads
" bo 50 miles per hour.

Albhough bhere was some quesbion as bo whebher ib was necessary bo
adopb bhe requesbed resolubion bo effecb a 50 miles per hour speed,
bhe Supervisor said Mr. Sbevenson would like bo have ib in case ib
was needed. The Board, bherefore, book bhe following acbion:

APPOINTMENT TO PLANNING BOARd!
Motion by Supervisor Schwan; Seconded by Councilman McElwee,
RESOLyED, that Robert Scahneli be re-appointed to the Town of Ithaca
Planning Board for a new seven-year term, commehcing January 1, 1974

Mr. Herbert Mahr, 103 Juddj Falls Road, asked the Board not to re-
appoint Mr• Scannell. 'He said the )?lanning Board was already too
''establishment" orieiited. Was composed of too many people who have
"achieved", own expensive homes, and are settled in th^ir ways. He
complained that there ate ^o young people on the Board, no people who
rent apartments, no pedpleiwith a different outlook; that there are
too many "experts" from Cbthell University 6n the Planning Board. He
recommended the apppintment of younger people^ more women, and fewer
"establishment" oriented peDple.

Supervisor Schwan thanked fiir. Mahr tor his suggestions and reviewed
the. personnel on the Planniilg ,Board. Mr is. Holcomb noted that the
Plahning Board as ptesehtly constituted gave representation to all
arees of the Town Of Ithaca, and that has been one of the criteria
for selection. The discussion which followed indicated that Mr.
Scannell was one of the most progressive and open-minded of the Plan
ning Board members. Mrs. Livesay agreed with the good things said
about Mr. Scannell, but expressed the hope that even if the Board did
re-appoint Mr, Scannell that it should open up the process to other
^ segments of the community and develop a list of such people for pos-
sible future appointments. The Town Board indicated a willingness
to consider any qualified person who is willing and able to serve.
Councilman Powers said the Board should seriously consider the in-put
received at the meeting by Mr. Mahr euid Mrs. Livesay and suggested a
decision on the appointment might be delayed and that the Board might
advertise for candidates. Mr. Powers had no reservations about Mr.
Scannell's qualifications, but noted the Board at this time had no
other candidate for comparison.
There being no further discussion a poll on the resolution was taken
with the following results

ROUTE 13 LIGHTS
The Supervisor was authorized to write a letter to the Department of
Trsmsportation suggesting that a study be made with regard to elimina
ting extraneous lights on Route 13, in view of the current energy
crisis.
PERSONS TO BE HEARD
Herbert Mahr, 103 Judd Falls Road. Mr. Mahr, in view of the
energy crisis and rising prices, renewed his suggestions that the
Town Board should make some plans with regard to (1) public transpor
tation and (2) re-think some ideas in planning and zoning. He sug
gested cooperation with Cornell University, the City of Ithaca, and
all agencies in Tompkins County to provide more public transportation,
and the construction of peripheral parking lots. Supervisor Schwan
noted that a transportation study by a Cornell University group is now
under way. Mr, Mahr suggested making some experiments with routes
rather than wait for a perfect design study of a system. With regard
to planning and zoning, Mr. Mahr suggested there should be a movement
away from the trend toward large supermarkets and developments and
toward more local neighborhood stores.
Supervisor Schwan indicated that there may well be tremendous \changes
in the American way of life which may require taking a new look at
transportation, planning and zoning problems. '

PLANNING BOARD RECOMMENDATION TO AMEND
ZONING ORDINANCE IN RELATION TO ONE AND
TWO-FAMILY DWELLINGS
Supervisor Schwan read a resolution adopted by the Planning Board on
November 20, 1973, recommending amending the Zoning Ordinance pf the
Town of Ithaca in respect to one and two-family dwellings, as follows;
WHEREAS, it has been determined by the Zoning Officer of the Town
of Ithaca that Article III, Section 4, paragraph 2; Article IV, Sec
tion 11, Paragraph 2? and Article V, Section 18, Paragraph 2 of ^e
Town of Ithaca Zoning Ordinance are unclear and therefore impossible
to interpret, and
WHEREAS, the Planning Board of the Town of Ithaca has determined
that a revision of these Articles is necessary to carry out the i.ntent
of the Zoning Ordinance, and

WHEREAS, control of density is necessity to preserve the environ
mental quality of the Town and to prevent overburdening of water,
sewer and road facilities, and
WHEREAS, a two-family dwelling requires more on-site parking area
than a one-family dwelling, therefore
BE IT RESOLVED, that the Zdhlng Ordinance of the Town of Ithaca
be amended as follows: ;i
Article III, Section 4, Paragraph it To be deleted in its entire
ty-
Article IV, Section 11, Paragraph 2; Amended to read:
"A two-family dwelling provided that the
minimum lot size for such use shall be
20,000 sq. ft., ahd further provided, that
in all subdivisions proposed after the effective
date of this amendment that in no case shall the
density in each subdivision exceed 3.5 units per
gross acre."
Article V, Section 18, Paragraph 2: Amended to read:
"A two-family dwelling."
The remainder of the paragraph to be deleted.
During the discussion that followed, the question was asked if an
' I apartment could be put in an existing house, under the proposed amend
ment. This would not be possible unless the house is an a 20,000
squcure foot lot. If, however, the apartment already exists, it is
permissible even if the lot is less than 20,000 square feet. Mrs.
Livesay felt the proposed amendment might work a hardship on elderly
couples who might wish to put in an apartment after the family is
grown. There might be other hardship situations. Councilman Powers
suggested a variance might be obtained in hardship cases. In view of
the ambiguity of the present Ordinance with respect to the definition
of a basement and in order to have in-put from the public, the Board
felt a public hearing should be scheduled.
Motion by Supervisor Schwan; seconded by Councilman McElwee,
RESOLVED, that the Town Board of the Town of Ithaca shall hold a
public hearing at the Town Offices at 108 East Green Street, Ithaca,
New York, on the 7th day of January at 6:30 p.m. to consider a pro
posal to amend the Zoning Ordinance of the Town of Ithaca as follows:
Article III, Section 4, Paragraph 2s To be deleted in its
entirety.
Article IV, Section 11, Paragraph 2: Amended to reads
^ "A two-family dwelling provided that the minimum
lot size for such use shall be 20,000 square feet

APPOINTMENT - ZONING OPPIGER
Supervisor Schwan noted again that Mr® David Cowan had moved into
the Town of Ulysses and v/as, therefore, no longer eligible to be the
Zoning Officer of the Town of Ithaca.
There was discussion of appointihg Reynolds Metz, Assistant Zoning1 j Officer, as the new Zoning dfficer for the Town of Ithaca.
Motion by Supervisor Schwan? secbnded by Councilman McElwee,
RESOLVED, that Reynolds Met^ be appointed Zoning Officer of the Town
of Ithaca beginning January 1, 1974, with David W. Cowan acting as
his assistant.
Unanimously carried.
REPORTS OP TOWN OFFlCIAll^
Barbara Holcomb, Chairman, Planning Board. Mrs. Holcomb re
ported that the Planning Board is contemplating a joint meeting with
the Town Board the third or fourth week in January. She indicated
that the new ordinance comprehends many new ideas, and is very unlike
the present Zoning Ordinance.
Marion Morey, Highway Superintendent. Ite. Morey reported
that one of the Highway Department men (Bert Dean) was charged with
driving an overweight truck and had paid a $100 fine. Supervisor
Schwan said he would look into the matter of having State Highway
Law amended with respect to municipal trucks, since the law as present
ly constituted can create economic hardship for municipalities.
Mr. Morey reported that the price of asphalt will probably
be up next year by 20%, if it can be obtained at all.
FLOOD DAMAGE REIMBURSEMENT
Supervisor Schwan reported that the Town of Ithaca will be reimbursed
by the Federal government to the extent of $6,540 for flood damage in
the Town of Ithaca, but that it will probably be some six months be
fore the money is actually received. All the requests for reimburse
ment were approved.
TRANSFER OF FUNDS
Motion by Supervisor Schwan; seconded by Councilman Desch,
RESOLVED, that the following transfers of funds be made:
From the General Fund, from A1940.4 to A1620.4, $1,319.85; from A1940.4
to A1410.1, 8 cents; from 1940.4 to A1910.4, $3,383.97; from A1940.4
to A1430.1, $784.33; from A1940.4 to A5010.4, $74.35; from A1940.4 to
A5132.4, $209.98; from A1940.4 to A9030.8, $655.66; from A2810 to
A8030.0, $3,060.62, and from B1990.4 to B9030.8, $80.11, total from
General Fund being $9,568.95.
From the Highway Fund, from DS5142 to DR5110, $7,000.00 (Item IV) to
(Item I) - (result of flood damage).
Unanimously carried.
TYPEWRITER PURCHASE
Supervisor Schwan reported that another typewriter is required for
the office and that there aresufficent funds in the equipment budget
for such purchase. This typewriter will be used primarily by Nancy
Fuller, Deputy Clerk, who will be working full time beginning January
1, 1974.
Motion by Supervisor Schwan; seconded by Councilman Desch,
RESOLVED, that the Town Board authorizes the purchase of an IBM
Selectric Typewriter for the purchase price of $495.00.

WEST VILLAGE - WATER PRESSURE
County Representative Hugh (Sam) MacNeil suggested that the Town
might look into the possibility of hooking West Village onto the Town
system So they may have additional pressure there. Supervisor Schwan
^ said he would have Lozier Engineers look into it.
