Agenda Item No. 3 = South Hill Recreation Way = Eric Lindstrom , Eric Lindstrom , 501 Hudson Street - We purchased our house in 1995 without prior knowledge of the Recreation Way . We were very delighted to find that our backyard was in fact abutting this wonderful trail . My wife is a marathon runner. We have a three-year-old daughter whom loves running up and down the trail . Everyone in the neighborhood just loves it . We cross country ski in the winter, run and walk in the summer. With this strange shape of a lot , my front yard is 101 feet wide and my back yard is 6 inches wide . I say this because I think it is funny. We have to shovel the front . In the spring of 2000 , WE, decided to finally clear out all the old lying brush , down trees and weeds that ran along the Recreation Way and the east end of our yard . I told the landscape company that thought it would be a half-day's work and two guys should be able to do it in no time . It ended up being a full day's work with four truckloads of debris just along the trail . Again , my property line is very interesting . I live in the City of Ithaca . The property line that I was cleaning abuts the trail , which the Town of Ithaca maintains . At the Hudson Street opening we would envision a whole new landscaping scenario that cleans out all the old brush, broken down trees , old debris , and lead all the back to the end of our lot . We would ask that the Town of Ithaca consider using either your own resources to assist us in removing the debris . Fall is a really good time to do it because there are no leaves on the trees . There is great isibility for what needs to be cleared out . From there in the spring , we could plant grass , ivy and 1 Minutes of Regular Meeting October 4, 2001 Approved 1118101 shrubs . We could dress up the gateway to the South Hill Recreation Way . The project overview shows exactly what w I are proposing to the Town of Ithaca . Supervisor Valentino - Is the debris your talking about on your property? Mr. Lindstrom - It is half-and-half. In order to make the area as charming as we would like it to be and as beautiful , we cannot just stop at the half waypoint . Surprising there were layers of foot deep leaves and other down', trees that had to be scooped up and taken away in dump trucks , four truck loads at a time . It was a big expense for us . We would like to move into the next phase of the project , which is more towards the front , the Hudson Street side of the path . We did not know if the Town had resources available to have a crew come in to do this or if there was a way that the Town could reimburse partially to our family for cleaning up the area . Supervisor Valentino - Where is the manhole ? Mr. Lindstrom - It is at the end of our property line in the back. Mr. Noteboom - It is the City sewer line . Councilwoman Grigorov - Does the Town maintain the trail ? I Mr. Noteboom - Yes . We maintain the trail . We would need to be careful . There are several issues involved . One is we are trying to maintain a certain wildness to that whole trail . We have dealt with it on many occasions down through there . I would suggest that we get a meeting set up with Mr. Lindstrom . We can look over the situation . We would need to abide by the City's Tree Ordinance . We could work out a solution to bring back to the board . Mr. Lindstrom - I would be agreeable to that . Councilwoman Russell i s - We also have our own policies regarding planting vegetation . Mr. Lindstrom - We would very much like that . We like to be able to walk someone around the area that we are talking about . There is a fence on the north side that was put up before we moved into the house . It has become a very nice entrance into the trail . Along the base of the fence there is some low growing greenery that always looks nice . The landscape would be much nicer if this sort of thing were addressed on either side of the opening . There is certain wildness associated with it . The other side of it is .the wildflower preserve . There is a difference between wildflowers and two feet of dead leaves and broken down trees . I Supervisor Valentino - We will contact the City and set up a meeting . Ms . Ritter - I would like to suggest that Ms . Ritter be involved in the discussions . . i Mr. Lindstrom - I love your meeting room . I am on the City's Economic Development Committee . was on the Landmarks Preservation . Consider Adjournment Minutes of Regular Meeting October 4, 2001 Approved 1118101 Venda Item No. 4 - Report of Tompkins County Board of Representatives. Tim Joseph , TC Board of Representatives - The County Board begins its budget deliberations tomorrow morning . We are going to start with the Capital Program . There are a couple of pieces on it that I wanted to tell you a little about . The first one is the Public Safety Communications System . We had several County, representatives attend a meeting in Albany of the committee working on the statewide network. They came back very encouraged about the State 's commitment to the project . They were telling us that the events of September 11 , 2001 in New York City have moved the State to give this a much higher priority . They said it was the Governor's top priority to get the statewide network done . They also agreed at the meeting to increase the level of coverage that they had been talking about . From the County's perspective , what we had been looking at with that project is the State looking for 95% coverage for car radios . Where as we wanted the same level of coverage for a handheld radio inside a framed building . We were talking about needing to pay the difference in cost between them even if we were working together with the State to do the project . At that meeting the State people who are managing it made the decision to go to essentially the same kind of coverage that we are looking for. It could mean that it is no cost or very low cost for the County . They also came back reporting to us that Tompkins County officials are on many of the key committees that are working on the project . We are being taken very seriously as the prototype for how the State will expand the system beyond . Their original plan will start in Albany and work outward . We have convinced them hat we are far enough along that they should start in Albany and move to Tompkins County. It was a ery promising report that we got back from there . he second that I wanted to tell the board about is the Aquifer Study. At the last meeting of the Capital Committee , everything at this point is a recommendation to the expanded Budget Committee ; we moved the study back to 2003 . This was done in order to give us time to negotiate with everyone that needs to be involved about funding it . All of you know that there has been some talk about the county wanting a 50/50 split on the local cost with Towns . At a recent meeting of town and county officials , there was a suggestion made that maybe we should take it out of sales tax before the sales tax is distributed . It would create a pool of money from the sales tax revenue that everyone is part of and uses it for this project . That was a very interesting idea , but either doing that or any kind of split between towns , county and city would require a great deal of negotiations . There are nine towns and the. city that would all have to sign onto the same agreement with the County . We felt that this is an important project , but it is also a long-term project . It is not urgent that it starts this year. We are looking at putting it off until next year to give time to negotiate all the details with all the interested parties . Councilman Lesser - As -the board is considering further investment in the airport , has there been any opportunity to discuss with US Airways. their long-term plans about the airport? The airline industry is undergoing a major change . I am aware that US Airlines has had some financial problems in the past . r. Joseph - There are always discussions going on about if we can get more service . It goes on ith Wny airline that we think we might be able to lure into coming to Ithaca . I do not know of anything ew that has been said since recent events in New York City. I am also concerned about what it 3 Minutes of Regular Meeting October 4, 2001 Approved 1118101 might mean for service here . The health of the airlines itself can affect service locally. I have to sa that I have raised concerns about the level of investment at the airport and whether it is sustainable with the revenues they are anticipating . US Airlines has already cut back the number of flights and the size of planes . Given that , I think it would be a good idea to be cautious about how much we are expecting to realize in revenues . Therefore , how much investment we are willing to take on , especially on things that are aimed on serving more and more carriers when the carriers do not seem to be there . Supervisor Valentino - Mr. Varvayanis sent me a copy of a resolution today passed by the Dryden Town Board favoring the idea of pooling the sales tax . It also reminded the County that he had already put $30 , 000 aside in his budget to fund the Aquifer Study. I am disappointed that it is going to be put off until 2003 . 1 was hoping that we could get worked out . Mr. Joseph - This is only where things stand now. I have to say that I am skeptical of getting something that complicated worked out in time for the budget . I do think that the sales tax pool was a very interesting idea . I would like to explore it . A big question is whether the City is in or not . It makes a big difference . The question has also been raised whether the Towns are going to use the information . There are some towns , thankfully not the Town of Ithaca , who have been very reluctant to undertake any kind of land use controls . Some of them sit on the major aquifers . The issue has been raised whether it makes sense to collect a lot of information about an aquifer if the people who are in a position to protect it do not intend to use the information . Supervisor Valentino - There is a flip side to that . If you do not have the basic information that you need on how to set up a land use policy, it is like the chicken and the egg scenario . I hope the County received the information about " Creating Open Government" from the League of Women Voters . I wanted to encourage everyone to attend . It is October 9th at Town Hall . We received a letter stating the Town needed to appoint someone to the County Recycling Solid Waste Center, formerly known as the Neighborhood Advisory Committee . I sent a letter a couple of years ago saying that we were not going to appoint anyone anymore because we did not see the value of the committee . I had Ms . Hunter do research on the committee . It seems like they have not had a meeting since November 4 , 1999 , The County might want to consider the current status of the committee . Mr. Joseph - I will take that message back and see if we can eliminate a committee . Supervisor Valentino - October 14th is the open house and celebration of the Cayuga Heights Fire Department , Councilman Lesser - It was included in the correspondence . Agenda Item No. 5 - Report of Fire Commissioners . Mr. Romanowski submitted his report to the board. Supervisor Valentino - We really appreciate Mr. DuMont coming in and giving us this presentation . I want everyone to be aware that the Town Board is not going to make a decision on the proposal tonight . We think we nEled to take the time to give it thoughtful consideration . We will not be making any comments . We will hear the presentation and thanking you for the presentation . Bryan Pitzer, 119 Cambridge Place - We would like to thank the board for the time you have set aside for us . I would like to give my thoughts on why you should consider this request carefully. Possibly some of you knew my son . If not , I can only describe him as wonderful and amazing . He is wonderful because of his ability to care for all kinds of people and amazing because he touched so many lives and hearts in a short 19 years . Brent lived nearly his entire life in Ithaca . Our immediate and extended families have lived in Ithaca in decades . We decided early on that Ithaca imbedded the values and diversities that few communities offer. By raising our children in this environment , we believed that they would develop into strong , socially conscious adults . This was certainly Brent . His circle of friends ran begamant , from very young to old , from very liberal to very conservative , from white to black and all shades in between . His interest ranged from youth in high school sports to drum circles at Stewart Park, from water sports to snowboarding to environmental issues . His love of nature lead to his major in Environmental Sciences . Brent touched so many people in his short time . The naming of this park in Brent's honor would mean so much to his Ithaca High School classmates , their parents , and wide , wide range of others hat he touched within -the community and who admired him for his nonjudgmental and accepting characteristics that made everyone his friend . Brent was always willing to listen to people 's problems . Many times he would end a discussion by suggesting that they head to what is now East Shore Park to watch a sunset . He considered it a very special place , which is why the proposal is being suggested in the first place . Thank you for attention and considering our proposal . Jeff DuMont , Ithaca - I would like to thank the distinguished board members for allowing us this opportunity to make a proposal . I would like to thank the supporters of Brent and his family for coming out . It makes it a little easier to stand up here . I am a Physical Education teacher who spends most of his time with Kindergartners and First Graders . This is the most adults I have seen in one room in the past ten years . I would like to propose -the simple fact that we would like to change the name of East Shore Park to " Brent Pitzer Park" . It is very fitting . We lost one of the greatest young members of our community. That says a lot that we have some outstanding young members of our community. Among those people Brent stood out as a shining example in his acceptance of others and his enthusiastic participation in life. The place that I knew Brent the most from was from the East Shore Marina . The Pitzers have docked their boat there for about thirty years . They are not very many people who have pent more time at that little intimate arena that the Pitzers and myself . I ran a business out of the ocation before Cornell ':; cooling plant displaced me. Brent was one of my employees. He was the 5 Minutes of Regular Meeting October 4, 2001 Approved 1118101 only fifteen year old I knew that ever signed a business check . He really was above and beyond wha most typical young people would be . A simple story about Brent and his love for this marina was a little test that I pulled on him a few years back . I was doing work on the Pitzers' boat . They were having trouble with a fuel pump . After two hours of sweat I pulled it out . I had talked like a trucker for the two hours prior to that . I look at Brent and said , "we are done with this fuel pump so we can just toss it in the drink" . When I through it over my shoulder into the water he about dropped . It was only about five feet deep . So I shortly thereafter jumped in and pulled it out . The expression on his face told me everything . He was appalled by the fact that I would dispose of something into this precious marina . That , in a nutshell , is what Brent was about in that particular location . There was a story that somebody told me about a grandson of theirs who does not live here . They drew a picture and in the picture the center of the world was Ithaca , New York . That was much like Brent . I think that if Brent were to draw that picture he would put East Shore Marina as the center of his world . We spent a great deal of time at that location.. We spent a number of evenings watching. the sunset . I highly recommend that everyone go there to watch a sunset . There is nothing quite like it here in Ithaca . We have some other people who would like to speak in regards to Brent . They might want to share a small story about the nature of him . Mainly, we are feeling bad for ourselves . Losing someone is a difficult thing . We know he is in a better place . We miss desperately and this is about our pain . We need a place to remember him . We need a place to talk to people about the positive things about Brent . We think this is the most fitting place in Town . If these circumstances weren 't such as they are , I would not be here making a proposal . If East Shore Park were not a Town park, this would not be happening . I think: it is a blend of circumstance and opportunity . I would ask kindly that you consider this proposal and give us the opportunity to help mend our wounds and move on without forgetting a wonderful member of our community. Bill Brown = My family and I are good friends with the Pitzers' . My son , Eric , went to middle school and high school with Brent . They both attended the University of Vermont last year together. They were the closest of friends . We have supporters here today to show their enthusiasm for this proposal . Many of them could not be here today due to other commitments . There are people who do not live in the area any more , but are supporters of the proposal . They have sent me numerous emails and letters that they would like to submit to the board . Most of the letters have multiple authors . Many of the letters are from Ithaca residents and some are not . Some of the letters come from as far away as Kentucky , Ohio and California . Mr. Brown submitted the letters to the board and read a few letters to the board. This proposal before you is not a frivolous loss of a young person too early. It is a serious and well- reasoned attempt to honor both Brent's memory and the park he loved . I think we need to keep that in mind . I think that by renaming this park we are also honoring the park itself. Few of us can claim a lifetime love affair with the natural beauty of Cayuga Lake and a commitment to the preservation and usage of its parks . Brent can , particularly East Shore Park where he spent nearly every summer day enjoying water sports in his teenage years . Then later on teaching those to others . Most often publics 6 Minutes of Regular Meeting October 4, 2001 Approved 1118101 laces are named for those who are fortunate to live long lives or who have money, or who have oth . The fact that Brent's life long commitment to East Shore Park was tragically cut short at nineteen years should riot de-sway you from renaming this park and adopting this proposal . Those nineteen years packed in more love and care for the natural beauty of East Shore than most people demonstrate in a typical lifetime . In fact , honoring Brent and the park in this fashion will demonstrate to other young people that regardless of age you can make a difference . Thank you for considering the proposal . Jessica ? - I am lucky to be able to attend this meeting tonight . I just transferred to Cornell . Unlike most of my friends who are away from school , I am here . I am very honored that this is being brought up tonight . I feel that the lake is something that Brent honored very much . My family has owned a boat almost my entire life ; he brought a new aspect to my love of the lake . If we were given the opportunity to rename (East Shore Park " Brent Pitzer Park" it would be a wonderful place for our friends to go and really remember him and think of the times that we had . Thank you . Liz Pitzer Belinski - Brent was my nephew. My family has been her since I was two years old . We have always been involved with the lake and the environment . What means the most to me came from my ten-year-old son . He had to write a character description in school . He does have some difficulties with school . Ms. Belinski read her sons character description. I think that for my family it says it all . I thank you for hearing us out . ancy Culligan - Brent i4% my nephew. I was trying to think of what I would say tonight when I came , appen to pick up my grandson who is six years old . He was at his babysitters on Danby Road . I picked him up . We were coming down Danby Road from Town of Danby to the Town of Ithaca and as everyone in Ithaca knows , the lake is so beautiful . Tonight , will all the leaves it was beautiful . He said , " Oh , grandma ! Look at the sun over the hill and the pretty leaves . Can we go to Brent's park tonight and watch the sunset? " I have taken him there many times . Brent and I both loved the sunsets . I think it says !it all . We have another generation going to the lake to watch the sunsets . It would be a great honor for our family for you to name this park in the honor of Brent Pitzer. Mark Chandler - I was sitting here thinking of my favorite passage from the Old Testament . It is after Moses crossed the Red Sea . What did they do? They put up twelve stones . Why did they put up twelve stones? God told Moses to put up twelve stones so that generations from there they would remember this great event . I was thinking of this . Someday , years from now, I may be sitting with my grandson on that bench , He may ask , " Who is Brent? " I am going to be reminded . I will remind him of a great person that once lived . He still lives in a lot of people 's heart . I think that today; more than ever, we need good people to remember. Models to pass on . This is a great idea . 1 admire Mr. DuMont for coming up for this and the others for putting this idea into reality. I hope that you will take your children and grandchildren and be able to talk about what you have heard . One thing that impressed me during the week of the celebration , we had a campfire out at the Browns' . Kids came from all over had come „ I knew Brent all his life and had never met these kids . In one semester, Brent had made all these friends . I asked how they met Brent . They all gave their testimonies. One ellow said he was " a nobody" on campus . He did not know anybody and he walked by Brent and he aid hi . Brent walked him all the way to his house and they became best friends . That's the type of 7 Minutes of Regular Meeting October 4, 2001 Approved 1118101 guy we have to remember. It is that type of personality that we need to pass on . This is what this bench is about . It is about the twelve stones that they put up after the Red Sea , Mr. DuMont - I would like to thank the board again . It is said that innocence is the only thing that we are given at birth and that is taken away from us . I think that Brent and a lot of his friends had their innocence ripped away from them a bit prematurely . He was truly a wonderful kid . It is important for me to express that in no means I mean to tribulize anyone else's pain that has lost a son or a daughter. I do not mean to belittle anyone else 's son by saying Brent was much better than anyone that I knew was . It is important for me to express that he had a way about him that brought the best out in anyone . It did not matter if it was on a chance meeting or if you knew him all your life . There was a great kindness and consideration in this person that every one of us could take a little bit with us . We would like to share that with all of you . It would give us avenue to talk about this person and share some of the wonderful stories that we have about him with the people . It has been said that a person does not truly die until the last one who remembers him is gone . We would like to keep his memory alive forever. This would give us a wonderful opportunity to do that . I thank you all again for your time . Supervisor Valentino - I would like to thank everyone for coming . Thank you sometimes seems like a very simple a word , but thank you for sharing your thoughts and memories with the board . It is important to all of us to hear your thoughts . Thank you . Councilmen Lesser - I do not know how often other people are down to our new park. It gets a great deal of use . There are constantly people down there enjoying the lake and sunset . The park is a tremendous service to the whole Ithaca community. Supervisor Valentino - I worked on the proposal for the park. It never occurred to me that the park would not be as successful as it turned out to be . I am thankful that we were able to save the small parcel of land for the park. Will Burbank, 132 Glenside Road - It is very hard to follow up on that . It was a very moving presentation . I did want to bring to your attention two things that I think the Town has been doing very well at recently and compliment you . One has to do with the newly dedicated Tutor Park in my neighborhood . I attended the ceremony. I was delighted to see Councilman Lesser and Councilman Klein . I was very thankful that the Town had taken upon itself to not only create a park, but to remember the people that had been displaced very long ago . I would also like to compliment you on the finally reworked website . I am delighted to see it . It is working well . It seems to be running at about two or three times the speed of your old one . It makes it much more efficient to negotiate . I would hope that it is still in the form of development . Supervisor Valentino - VVe reviewed the budget once . We know that there is no increase in the tax rate . There is no increase in the fire rate . There is a decrease in the lighting districts . Our water and sewer benefit charges will remain the same . The budget is pretty much the same as we have seen it . The only exception now is through our Capital Projects Committee . There is planning for capital . projects . I think Mr. . Carvill has added pie charts to the budget . It displays the Town 's money and the money we have spent . lit is much easier for people to look at . We did not ask anyone to make any cuts in their budget . The Department Heads did a good job of keeping their budgets down . We have healthy fund balances as well . Does the board have any questions? ouncilman Niederkorn Mr. Carvill , could you tell us in a summary where the increased revenue is oming from primarily? 9 Minutes of Regular Meeting October 4, 2001 Approved 1118101 Mr. Carvill - The increased revenue to the Town is from real property taxes and sales tax revenues . I is also from other government services . Only one percent of our budget is makes up any form stat or federal aid . All of our revenue is generated from retail sales and or real property taxes . Councilman Niederkorn - What is the percentage of real property taxes versus sales tax? Mr. Carvill - The Highway Department is funded totally by sales tax revenues . Another portion is by the CHIPS (Consolidates Highway Improvements Program) and from intermunicipal services that we may have performed for other local communities . The General Townwide Fund is made up more than 50% of real property taxes . Local resources , fees and a small portion make up the differential by sales tax revenue . The remainder of the sales tax revenue that is generated is to support the General Townwide Fund . It is zoning and planning . Water and sewer benefit assessment rates are provisions to pay for debt as well as user charges for water and sewer use . In examining some of our revenues in the tentative budget , there has already been an impact in the changes I felt pertinent to make . I reduced the sales tax revenue interest earnings based upon economic factors . There has been an economic slow down domestically and worldwide . There are forces that are working to help cushion the economic decline that so many municipalities are examining . Once such force is accommodating monetary policy of the Federal Reserve Bank. As in past recessions, it is customary for the Federal Reserve Fund discount rate to be pushed to zero . This economic stimulate drives the nominal rate to a target of 2% . In response to this rate change , I have initiated a change in the tentative estimated budget on interest earnings to certain operating funds . The change is slight totaling $23 , 000 . It is a nominal impact to Town cash reserves or our fund balance . The retail and whole sale profit indicators are showing declining consumer spending The aggressive federal spending augments this downward turn as Congress has shifted its budge attention to a wartime front . It is aiming towards the rebuilding and the modernization of the domestic as well as global infrastructures . This will become evident as both private and public consumers direct their intentions to increase security and communications cost . In concert with one another, these markets are economic forces are used by our best analysts in predicting a decline in retail sales of 1 % . Internet sales have already been predicted at $ 13 . 3 billion nationwide . It is a relative figure . What does this mean to the estimated sales tax revenue for our Town budget in the 2002 is questionable . Our budget options are twofold . The estimated figure can be left at the levels that we have already deemed to be reasonable as calculated or the estimated sales tax can be reduced for the year 2002 for another 1 % level . This calculates to $ 18 , 600 . The amount itself is nominal . The fund balance will have little or no impact upon the now or estimated unreserved fund balance cash we have on hand . It is available to the Town beginning January 1st . However, it does give heedance to our close monitoring of these major revenue sources as well as our future spending during our new and upcoming year as requisite . Based on that research , I felt it prudent to take a step of dropping the sales tax revenue just in case . If we benefit , we are not dependent upon it . We have cash reserves if we fall short that can cushion the 1 % very easily. Expenditure levels have not risen any higher than last year. We have been able to manage it quite well . I feel confident in presenting them to the board . Councilman Niederkorn - It would be very helpful to have Mr. Carvill speculate on the sales tax and property tax as a continuing source of revenue . 10 Minutes of Regular Meeting October 4, 2001 Approved 1118101 r. Carvill - I have had conversations with the County Assessment Department . We are at full value now . Without continued development and increased housing development , assessed valuation is going to stay the same . We do not see any increase in assessed valuation what-so-ever. They are predicting no increase . Since September 11th , housing and reconstruction has dropped of 6% . In talking to the banks , ani: icipating future needs , refinancing and reconstructing has been brought to a halt. Federal funding for continued housing , such as FHA that does low mortgage loans, has examined their approved applications and restructured the approval concept . They have separated the weakest and strongest and cut some of them out . We have already seen a redirection of FEMA and Federal funds to an increase to downstate New York and Washington D . C . I have been in contact with the State . I have had some concerns about some of the future capital budget as presented . I wanted to know if the state would pull the plug on some of the commitments that have already been given to us . The Hannah Pew Trail has a ten year window. We have one year reimbursement for the Maple Avenue Reconstruction . These funds are large . We have been told no , but already the state has cut non - profit organizations from their budget . Where does that measure go ? I really do not know. I have done as much research as I can . Councilman Niederkorn - Should we be concerned about a flat property tax in the next few years? Should we be concerned about a slowly rising if at all sales tax? The only thing that we know for sure is that the expense side is going to continue to have pressure . Should we be concerned about I rvenue sources? Are we going to be able to pull a rabbit out of the hat and have a zero percent tax crease year after year'? upervisor Valentino - No . The outlook for the next three years for municipalities is pretty bleak . It is not as bleak for the Town of Ithaca as it is for some others . We are not carrying any significant debt load . We are not paying old bonds that hide interest . In the future , I think, the indications are that sales tax revenues are going to decline . It is our major source of revenue . The projections are that the property values will be stable . The good news is that I do not think we will be facing any major budget increases . We have good reserve funds . We will have to be very conservative on the expense side . The revenue side is not going to be there . Councilman Lesser - I wonder if there might be some hope on the cost side . We have seen in recent years with a relatively high level of economic activity in the County we have seen construction costs increase . Is there a reason to believe that if there is an economic slowdown , could we anticipate some expenditure such as the expenditures on the Highway Garage declining below certain levels? Would paving prices decline? Supervisor Valentino - Historically we have seen a decline . Mr. Noteboom - The cost does decline . I am not sure under these circumstances there would be a direct coalition . fupervisor Valentino - We can move forward on the Highway Facility . We can move forward on that n lood very good time . If we have to go to bonding , the interest rates are extremely low. It will be very for the taxpayers . It will not be a big bond issue . Supervisor Valentino - This budget has been approved with some changes by the Bolton Point Commission , The Commission made changes to the budget per my recommendation . On the very first line of revenues , I took out the 11 cents . We had originally projected $ 155 , 000 as interest income for Bolton Point . We have lowered that to $ 117 , 000 . The last line of revenues was changed . Instead of saying , "Transfer to Capital Projects" the appropriate title is , "Appropriated Fund Balance " . It is an appropriation for some projects plus money that we are using from the fund balance to keep the budget down . The total revenues are $ 1 , 867 , 281 . It makes it balance with the appropriations the way that it should in the budget . The excess revenues and stabilization are really not meaningful to be in that part of the budget . So I left two items that showed the closeout fund balance from last year. Bolton Point has an extremely healthy budget . Staff has been very careful about expenses . 12 Minutes of Regular Meeting October 4, 2001 Approved 1118101 ne of the reasons we have the substantial fund balance is because we are moving towards bringing n two new partners , Cornell and the City. Most of the fund balance would be used up along with the City funds to get the project put together. Councilman Niederkorn - Is there going to be any change in the rate? Supervisor Valentino - No . The rate will stay the same this year. We used a little of the fund balance to make it work. The Bolton Point rate and our customer rate will stay the same . There is no change in that either. Councilman Klein - Is this year the end of the zebra mussels? Supervisor Valentino - The end of the zebra mussels was last year. Doug Austic , Town of Ulysses Supervisor - We understand that there may be some questions about our request to the Town regarding our proposed water district . The concern is our planning and zoning regulations . Councilman Klein - Supervisor Valentino had specific questions . It would be the easiest way to deal with it . Sue Poolvorde , Town of Ulysses Town Board - Most of our growth has been in the residential area in the past ten years . We have identified where the new construction of houses has actually gone in . We have had some new construction at the south end of Route 96 , which is near the Town of Ithaca . The commercial strip on Route 96 in the Town of Ulysses really has not changed . We did have some new industrial and commercial development . Everyone said after the Octopus was straightened out that there would be a mass coming up to the Town of Ulysses . That is not happening . We do have subdivision regulations . We have had two come into the town over the last several ears . The one on DuBois Road is not full . The subdivisions are not full . There has not been a lot rowth in the Town of Ulysses . Our zoning ordinance allows for a minimum of one acre lot . People oming out to the rural areas and buying five acres or more . We are not seeing a lot of small 15 Minutes of Regular Meeting October 4, 2001 Approved 1118101 residential lots . We are the northwest corner. We are not near Cornell or Borg Warner. The folks that are out here want: the rural setting . They treasure the rural setting . The Town of Ulysses lost population during the last census . The size of households is also dropping . We have two districts in our current Zoning Ordinance , residential and agricultural . We are in the process of redoing our Zoning Ordinance . We went through the comprehensive planning process . It was a community effort . We want to maintain the rural setting that we have . We had a strip along Route 96 that was designated a business district . The Comprehensive Plan came up with different classifications for commercial . They will be further refined in the Zoning Ordinance . Commercial 1 is encouraging businesses that are tourist focused , for example , motels . Commercial 2 is the traditional commercial district . It consists of retail stores and gas facilities . Commercial 3 is the light industrial component . There is space on Route 96 to other things . We would like to encourage clustering through the new Zoning Ordinance . We still have a lot of farming . Some of the farming has been lost closer to the lake , but we still have a lot of farming in the rest of the town . We are trying to protect the farmland . The town has hired George Frantz as a consultant to help us out to do that . We are looking at , through the consultant , reaching out and looking at different ways to keep the Town of Ulysses rural . There is going to be growth . We would like to deal with the residential district . We want the Zoning Ordinance to create different levels of residential zones . We want to be able to get safe , reliable drinking water to our residents of in the Village of Jacksonville that have had their wells polluted . They have struggled for many years with this issue . Through the update of the Zoning Ordinance we are going to try to come up with zones that will maintain the rural character of the Town , but also allow different types of development to occur. We have a need for senior citizens housing development . There are a lot of seniors that are moving back north . We do not have places for them to live in the Town of Ulysses . We have Juniper Manor in the Village , but they have a waiting list . We want our starting families to be able to stay in the area . The Town of Ithaca is wresting .with updating your ordinance and coming up with the tools to do so . We would like to have the Zoning Ordinance in place before we complete the water district . Mr. Austic - Commercial can only develop in the areas where there currently is commercial development . There is a lot of space in the old Babcock building that could be used . The current Zoning Ordinance requires a minimum of 150 feet road setback . Many lots are not big enough to meet setback requirements . This is the reason that nothing has developed up through there in the last 30 years . There is a lot available in the residential zone . Most of the area on Route 96 has been established as residential for many years . Only two houses have been built on Route 96 during the past 50 years . Councilwoman Grigorov - Wouldn 't adding water change the activity? Councilwoman Russell - It has out in Lansing . 16 Minutes of Regular Meeting October 4, 2001 Approved 1118101 r. Austic - I do not think so . There is very little road frontage left that is not already a house or ctively farmed . Our new Zoning Ordinance will have an Agricultural District . It will have restrictions on selling off lots for houses . It will make it harder to build in an Ag . District unless you meet certain requirements . We are riot accepting open farms to be in the water districts . The farmer will not have the interest to sell the land for lots . Councilman Klein - The farmer will be assess one unit that connects with the house . Mr. Austic - If there is not a house on the property, then there is no assessment . Ms . Poolvorde - We looked at the water district . Most of the corridor is developed . There are some areas that could be developed . Some buildings could have adaptive reuse . It is something that we put into our Comprehensive Plan to encourage . Our residents have a lot of acreage because they want that much acreage . We cannot guarantee that the next owner would do that , but that is what are hoping . Mr. Austic - We have a Washington Heights Trailer Park that was purchased by someone a number of years ago and has bE�en cleaned up . It looks a lot better than it used to . We had to remove seven or eight mobile homes from there because of the water quality . The owner may want to put four or five mobile homes back, in when we get the water district . We have a wide range of houses from modular homes to doublewides . We do not allow singlewides in the Town of Ulysses unless they are t n a park. s . Poolvorde - Our history in the town has shown that there has not been a big growth . Lansing as mentioned . Lansing is on the side of the lake that has seen a lot of the growth associated with the major employment centers over there . We do not expect that kind of thing to happen . It is not a bad thing for us if housing developments come in . We would like to see some different types of housing . We would like, clustering . Subdivisions have not been a big thing . We will still have the restriction as far of sewers . We have Health Department requirement for the minimum lot size to accommodate sewer. Vie do not expect sewer. Mr. Austic - People in the Town of Ulysses do not want to live in the Village . They would rather own five acres and build a house . They like the rural character. Councilman Klein - Did the Village system have the capacity to extend to Jacksonville? Mr. Austic - It would have cost three quarters the cost of this project . If we did service to Jacksonville , it would be the end of our capabilities . Coming from this direction will allow us to meet the need as they arise . The Village of Trumansburg has started to think it would be worth it to them to look into coming into the system . Their system will service their Village and a few other places. Councilman Niederkorn - Where is the Target store going to be located ? s . I do not think the large stores would be tha dependent upon a water system . Supervisor Valentino - They could figure out a way if they really wanted to locate out there . Ms . Poolvorde - The Comprehensive Plan is a start . Mr. Austic - We would like to aim more towards tourist businesses . Councilwoman Grigorov - Could the water district be extended ? Mr. Austic - Yes . It could be extended . The area on Route 96 does have water problems . It would be expensive to build a water system in the Town of Ulysses . If you were to go a mile , you might pick up two or three houses . Councilman Klein - There is probably a lot of rock . Mr. Austic - We would need to run the water line where there is enough use to make it worthwhile . Ms . Poolvorde - We have had people come in and ask for water. It is something that we will have to wrestle with . It is not from the growth perspective . People need water in their house . Councilman Niederkorn - Have you voted on this? Ms . Poolvorde - Yes . The district is formed . Councilman Niederkorn - It makes absolute sense to me . I do not see anything wrong with a little more development in the Town of Ulysses . They need to provide safe water. Their residents are willing to pay for it . Mr. Austic - The kind of commercial development that we would encourage would not need public water. They might have a few bathrooms for employees , but that would be it . Councilwoman Grigorov - I think everyone would like Jacksonville to have good water. We wanted to make sure that there would not be some unexpected consequence . Ms . Poolvorde - Our residents like where they live . They understand that there will be some growth . There is some interest in having available housing as they get older. We do not have this available . The Route 96 corridor might provide some opportunity. It is on the T-Cat bus route . It is an area that would make sense to have that kind of housing development to go in . Councilman Klein - Is there a mandatory tie- in ? Ms . It includes the ebt service . Supervisor Valentino - It is not that expensive . Ms . Poolvorde - We spent a lot time figuring out the districts so that it would be economically feasible . The Town has been wrestling with this issue of getting good water to Jacksonville since the early 1980s . Mr. Austic - We are asking permission to transport water through your lines . Andy Hillman , Town of Ulysses - The only way we could have insured that this would not create any development we did not like would be provide water to Jacksonville . We will have the Comprehensive Plan and Zoning Ordinance in place before we have water. We are doing this in an order that does not always occur. It is the most logical way to go . We appreciate your support on it . Supervisor Valentino - The Town of Ulysses needs the Town of Ithaca to allow the water to come through our lines . Mr. Austic - We will need a pump station on Woolf Lane to get to us . It will increase the water pressure in that subdivision and up to the townline . The tank will also allow the Town of Ithaca to t oake repairs to your tank on West Hill . You would have a backup system in place if something were happen to your system . It is good for both municipalities . It is better for us . r. Walker - There is a benefit to the Woolf Lane and Trumansburg Road area in the Town of Ithaca . We do not have fire flow out there now for the hydrants . By extending the line and having a tank, it will provide adequate pressure for domestic use and fire flow. It will eliminate a big concern that have had since I have been with the Town . We do not have that reliability right now to protect our residents . Mr. Austic - We tried to make it so that it would help everyone . Mr. Kanter - Have you gone ahead with SEAR review? Ms . Poolvorde - We apologize for the omission . We have this information in our heads . We can write something up and use it as an amendment to the SEAR . I think our lowest equivalent is about $20 , 000 . Mrs . Drake - Our lowest salary is $25 , 000 . He is a Highway laborer. Councilman Lesser - Our employees have a good benefit program . Mrs . Drake - There are a few changes that will be reflected in the Preliminary Budget . Since I had given my budget over to Mr. Carvill , my secretary left and we had to do some changing around in positions . Drake - Currently our plan is a $ 10 . 00 co-pay per office visit . The drug rider is $5 , $ 15 and $35 . As you can see , there is an 11 . 6% percent increase for family and individual coverage . There are options open to the board if they wanted to take the options to reduce the premiums . We could increase the co- pay and the co- pay on drug riders . My recommendation at this point would be not to change any of that . If we wanted to change it , I would ask for the opportunity to talk with the employees and get a feel from them . I would like to discuss whether they would like to have an increase in co-pay, drug rider or cost sharing with the Town . I would like that opportunity. I would also like the opportunity to look at other insurance companies next year. I Yesterday , the merger between Univera and Blue Cross/Blue Shield under the Excellus umbrella went through . They project no changes in 2002 because it is so close to open enrollment . They are expecting product changes for 2003 . We might be seeing changes in rates . Univera is community rated . It is not just rated on Town of Ithaca premiums versus costs . It is based on the Cayuga Area Plan . They are not expecting huge increase . Councilman Klein - What is the actual dollar increase? I Mrs . Drake - It is a 120,0 increase . Mr. Carvill - I think the premium increased about $23 , 000 . Councilman Klein - What do we pay currently? Mrs . Drake - We pay aIbout $26 , 000 per month . Councilman Klein - We are holding the line on many other items . I would like to consider going to some of the options , especially in light of the news that Mr. Carvill gave us tonight . We have been pretty generous with our salary increases . I think it would put things in balance when things are a little tight . i Supervisor Valentino We would like to leave it alone this year. Next year we would like to spend a good chunk of our time next year working with the employees . Mrs . Drake - Bolton Point is in a union setting at this point . Supervisor Valentino � I was asked to go to a meeting with Sheriff Peter Meskill . The Sheriff had been providing a Deputy t in the morning at Boynton . They have a terrible traffic problem there . He would be there for about 20 minutes every morning . Sheriff Meskill said that with the cuts in his budget from the County it would no longer permit him to have a patrol officer at the school in the morning . He is asking; for some help from the school district . It costs about $45 per day to have the officer there . The total cost is about $8 , 000 per year. Judy Pastel has gone to the School Board and they will pay half the cost . They are looking for the Town to pay the other half . The school has a plan for improving the driveway. They think they are going to get funding to improve the driveway over the next year. That means 'we would no longer need to have the officer. We have never had a crossing guard at the crossing area . In talking with the school and Sheriff Meskill , everyone feels that the officer directing traffic is much more urgent than a crossing guard . I am asking the board if we would be willing to contract with the Sheriff for our share for $4 , 000 . Councilman Klein - Would it be for pick up as well ? Supervisor Valentino - It is for the morning . The officer will be doing other duties as well . He will be ticketing speeders . Councilman Klein - Is he at Cayuga Street and East Shore Drive? Supervisor Valentino - He is located near Route 13 . Councilwoman Russell - The traffic in the parking lot becomes backed up and it impedes on passing traffic. i Councilman Lesser - We provide crossing guards . How is it determined what crossing guards we are going to provide for which intersection ? Supervisor Valentino - It is mainly determined by working with the school system . Councilman Klein - Is it mandated by the State that we have. a crossing guard ? Mr. Noteboom - The State mandates where we need to have a crossing guard . Councilman Lesser - So , whenever there is a school crossing within the Town we are obliged to provide a crossing guard ? Mr. Noteboom - Yes . It is State law. The County claims that this is not a real cut . Supervisor Valentino - I have talked with our County representatives . We know that they need to make cuts in the budget . We need the extra protection . We have been urging the County to maintain the level of coverage . What has happened to the Sheriff's Department is really unfair. They were asked earlier in the year not to fill their vacancies , as they should have so that they could save some money for the budget . Now the County is saying that it is an increase in the budget to add those people . They really are not adding people . They did what they were asked to do by not filling the positions . Now , by filling them , the County is making it an increase in their budget . I think it is really unfair. It is not just maintaining it ; it is a real decrease in the number of Sheriff's Deputies that we have on the highway. Councilman Lesser - It is unfortunate . The State for many years controlled it's budget by often passing expensing to more local level . It is an unfortunate example of where it is happening within the local level . Certainly, we are not going to endanger the school children in our community. We are being asked to pick up what has always been a County expense . Mr. Carvill - Does the school district get any State aid support for security around its building ? t rupervisor Valentino - No . r. Carvill - In light of the events that have taken place , it should be the position of the State to otect our children . Councilman Lesser - In Executive Session , the Purchase of Development Rights Committee has a proposal to the board . Councilman Klein - The COC has been waiting for the final draft of the Zoning Ordinance for final review . I do not know if we will be seeing it at our next meeting . Attorney Barney - Yes . We finished the draft and it has been given to Mr. Kanter in two versions . One is the clean copy and the other is the comparison version . Mr. Kanter is in the process of getting it duplicated . Councilman Klein - Then we will have an opportunity to compare the marked up copy to this copy to te what has taken place . he e main event in Public Works was to interview three architectural firms for the Highway Garage . did have a consensus of one firm . Probably at our next meeting we will make a recommendation . Councilwoman Grigorov - The Cayuga Lake Watershed Restoration & Protection Plan is available . Ms . Hunter made a copy for everyone . We also have a copy of the agreement that some municipalities have signed . Our ideal is that next time we could pass a resolution . Everyone will have had time to read the plan and the agreement . Supervisor Valentino - Councilwoman Grigorov has put a lot of work into this committee . Councilwoman Grigorov - The library should have a copy of the plan as well . Supervisor Valentino - The color copy is very pretty. Agenda Item No. 22 - Monthly Report of Town Officials . a. Town Clerk b. Director of Engineering Mr. Walker - The West Hill project is moving ahead . I expect the water main to be installed by the nd of next week. They are building the building now . We have received all our permits and have eviewed them . We are in good shape right now. There were a few issues with restoration plans. 33 Minutes of Regular Meeting October 4, 2001 Approved 1118101 Councilman Niederkorn - Is there some re- landscaping taking place? Mr. Walker - We went through the whole process . We went before the City Public Works Committee three time with a landscaping plan . We went before the Planning Board . Everything was approved . Then the Forester said we had to replace all the trees we took off with an equivalent diameter inch number of trees . He wanted us to put in 80 trees . There was not enough room to put that number of trees . He then wanted us to plant them elsewhere in the City or pay him $75 per inch . They received that from Cornell during Lake Source Cooling . We will be planting at three to six moderately sized Hackberry trees . We will be planting Maples , Oaks , and different shrubs to dress the site up . All Public Works people were happy with what were are doing . We had some discussions with the Building Inspectors at the City. They are not nearly as reasonable as our people we found out . It will look very attractive when it is done . I had to assure City residents that it was not a road through there . c . Highway Superintendent Councilwoman Russell - Could you updates us on the Maple Avenue project? i Mr. Noteboom - It is all torn up . They started a week ago Wednesday . They plan to be done in five weeks . The subbase is done and they have started underground drainage . Progress is being made . d . Director of Planning Councilman Niederkorin - I read a letter some time ago from Leslie Chatterton of the City of Ithaca regarding the front doors of this building . Mr. Walker - I have meeting scheduled with her for last Tuesday. I am waiting for it to be rescheduled . The main issue is that we originally were not going to replace the front doors . We were going to leave the original double brass doors . I did not think it was a major change to the site plan . The City decided that they were concerned about it . I explained that we were having mechanical problems with the doors . We needed to replace the doors for energy efficiency and security. Councilman Klein - They were not historic doors . Mr. Walker - The only difference is from the top of the door down . It is now a single door with a glass pane adjacent to it . We took out a metal panel that said U . S . Postal Service and replaced it with a glass panel with the Town of Ithaca on it . They had more concerns with what happened to the entrance on the Post Office side . They were to approve the lighting before it was put it and it was not done . I do not see it as a major issue . I will come back to the board with a report . Councilman Niederko in - I think the entrance to the Post Office is an obstacle course . It does not seem to make any sense . Mr. Walker - There were some design issues as far as how far the entrance came out . Some of the things were shifted from design documents . There was a slight grade change that caused problems . Mr. Walker - We have had a couple of complaints . It is our building . The Post Office is leasing it . They have the contention that they do not have any responsibility. Attorney Barney - As owner of the property , the Town has some liability . Our arrangements with the Post Office say that they, have custody and control of it . Councilman Niederkorn .- It is an accident waiting to happen . Mr. Walker - We are looking at installing railings on the handicap ramp side . Councilman Niederkorn - The TCAT group would like to have enough radius at the Linderman Creek entranceway to turn the bus around . It might be something the Planning Board would like to keep in mind . Mr. Kanter - The project has not gotten past the sketch plan stage . It is something that the Planning Board is interested in . The developers represented that the drives within the development were designed in a way that could accommodate a bus should it come into the development . I do not think it has been tested because the buses do not come into the site . Councilman Klein - The school buses come into the site . r. Kanter - It is a different vehicle . School buses are a little easier to accommodate . Supervisor Valentino - Linderman Creek residents have signed a petition and sent it to TCAT. TCAT will not take their buses into the site because of liability . It is a private drive . It is weird to me because the school district does allow the school buses to enter the site . Mr. Walker - Originally the school buses were not going to go in either. The roadway was designed as a Town road . The road that goes into the first phase is built to Town standards . There is enough room for the bus to make the turn . It is a regular intersection . The driveway within the development is plenty big enough for the bus to drive all the way around . I doubt if TCAT wants to drive an extra half-mile to make a loop -to come all the way out . There are quite a few kids in the development now. They make two or three stops along the loop road . It is definitely much safer for the kids . Councilwoman Grigorov There is a big safety problem with the residents having to cross Route 79 to wait for the TCAT bus . Councilman Niederkorn - Would it be useful for TCAT to send a formal communication to the Planning Department requesting it be considered when the time is right? r. Kanter - Yes . It would also be helpful for them to indicate that they would be willing to into the evelopment . 35 Minutes of Regular Meeting October 4, 2001 Approved 1118101 Supervisor Valentino - ITCAT has said they are not willing to go in there . Councilman Niederkorn - Apparently the attitude has changed . Mr. Kanter - It makes sense to plan ahead and design ahead . It also makes sense not to over design for something that is not going to happen . Mr. Walker - The 50 foot radius would take up over 100 feet of width . It is wider than what they are proposing for the rightof-way . It could be incorporated into their entrance driveway. It is tight for a bus to turn in . We can, do it with our plow trucks . I think they turn quicker than some buses . i Councilman Niederkor'n - I will suggest they send the Town a letter telling us what they are interested in , if they are interested at all . Mr. Kanter - The Planning Board did give final approval to the EcoVillage Second Neighborhood Group . There is already some construction starting up . We are already involved in inspections and compliance features of the plan . We need to add the Transportation Committee to the list of committees on the agenda . Tompkins County came and gave a very good presentation on their Vital Communities Initiative at the Planning Board meeting this week. They are scheduled to appear before the Town Board at the November meeting . Our fall newsletter was mailed this week. We have copies here if anyone has not received it . e. Director of Building & Zoning Mr. Frost - Every three months I provide the board with a breakdown of revenues received . Our revenues are running ahead of what we anticipated for the year 2001 . We did have a fire occur in an apartment complex with a wood stove . There was no major damage or injuries . The Zoning Board of Appeals also denied an appeal at their September meeting . Mr. Walker - The property line goes down the middle of the alley . We had an agreement with Race to use the far end of the alley . Attorney Barney - Someone will have to clean it up . We do not think there is anything down there . If something is down there and it is ruptured then they should have to pay for it . Councilman Niederkorn - I can see if they ruptured something . They do not know if they are going to buy the site . Councilman Lesser - The resolution states if any is damaged . Attorney Barney - At this moment we do not know of any tanks . We are not under any obligation . If they dig down and discover a tank, we do not want to be faced with the clean up costs . C. i i 1 . 0 AUTHORIZATION I 1 Property owners within the proposed Water District No . 3 in the Town of Ulysses submitted an i informal petition requesting the Town take steps necessary to create a water district to service the area . On behalf of the people , the Town Board of the Town of Ulysses authorized Barton & Loguidice , P . C . (B &L) to prepare a Map , Plan & Report (MP& R) for the proposed Town of Ulysses Water District No . 3 . This MP&R has been prepared in accordance with New York State Town Law, Article 12A, " District Formation By Town Board Resolution " . On July 31 , 2001 the Town of Ulysses held a Public Hearing for the purposes of forming Water District No . 3 . As a result of the Hearing , the Town authorized B&L to make revisions to the proposed district boundary to accommodate concerns voiced by Town residents . Revisions to the proposed District included the elimination of eight (8) parcels fronting Krums Corners Road and the addition of seven (7) parcels fronting I ' Jacksonville Road north of the Jacksonville Hamlet. I ' 2.0 BACKGROUND I Jacksonville is presently served by private wells with a long history of ' gasoline leaks and failing septic stems . Additionally , Tompkins County Department of Health has documented that about 25 % of the wells sampled in Jacksonville tested positive for coliform bacteria , and ' nearly all showed significant levels of nitrate. e 586. 006R/8. 01 BARTON & LOG UIDICE, P. I J 1 r In 1985 and 1986 , the Town attempted to form a water district to serve the , Hamlet of Jacksonville , but was unsuccessful due to lack of public support and ' seemingly high proposed user costs . In June 1999 the Town Board authorized B& t L o reexamine the feasibility of providing water to the residents of the Town of Ulysses , and in particular, to the residents of Jacksonville . The resulting October 1999 Town of Ulysses Water Supply Study, which was addended August 2 , 2000 and July 9 , 2001 , evaluated several water supply alternatives and funding scenarios for providing water to the residents of Jacksonville . The reexamination concluded that water service from the Town of Ithaca would result in the lowest per user cost of the alternatives considered . Additionally, as a result of the reexamination , the project's point ranking was elevated by the New York State Department of Health , enabling the project to qualify for interest free financing . As described in the July 9 , 2001 addendum to the 1999 Town of Ulysses Water Supply Study, the Town is proposing to install water mains along Perry City Road (County Route 142) from NYS Route 96 to Jacksonville Road and Jacksonville Road from Perry City Road to the Hamlet of Jacksonville , as well as short spurs north of the Hamlet of Jacksonville along Jacksonville Road ; northwest of the Hamlet along Route 96 ; along Swamp College Road ; and along Colegrove Road . The new water lines will provide these areas with municipal drinking water and fire protection . 3 . 0 PROPOSED WATER SYSTEM BOUNDARY A map of the proposed boundary of the Town of Ulysses Water District No. 3 is included on the "District Map" included as Figure 1 in Appendix A of this report. ' 4.0 PROPOSED WATER SYSTEM i The Town of Ulysses Water District No . 3 will receive water from the Town of ' Ithaca via a connection to an existing transmission main located along NYS Route 96 at the Town Line . Ten-inch PVC water main will be constructed along NYS Route 96 between the southern Ulysses town line to the intersection with Cold Springs Road to the North , with the exception of a section of 12-inch PVC main between the intersections of Van Dorris Road and Perry City Road , Twelve-inch PVC main will be installed along Van Dorn 's Road , extending from the proposed 260 , 000 gallon water storage tank to the proposed Route 96 main . An 8-inch PVC water main will be ' constructed along acksonville Road South of the Hamlet to Perry - City Road and 9 ( rY tY ) ' Perry City Road (east of NYS Route 96 to Jacksonville Road) to form a loop that will provide added system redundancy and reduced system headloss . In addition , approximately 1 . 6 miles of 8-inch water main is proposed to be constructed along Cold Springs Road (east of NYS Route 96) as well as several short sections along Van Dorn Corners Road , Colegrove Road , Jacksonville Road (north of the Hamlet of Jacksonville) I and Swamp College Road . A booster pump station is proposed to be located in the Town of Ithaca near the corner of Deboise Road and Wolf Road . The proposed water system is shown on Figure 2 , Appendix C . Services will be provided for each existing developed parcel within the proposed Water District No . 3 . ' Each services will be terminated with a curb box and a curb stop at the roe line . All property rtY ' owners would be required to connect to the water supply system and would be required to disconnect their private well supply. The water user would be charged a fee to pay for the cost of a water meter at the time of connection (approximately $ 100) . 5.0 WATER USAGE AND SOURCE OF SUPPLY The proposed Water District will receive its water from the Town of Ithaca through a new intermunicipal agreement between the Towns of Ulysses and Ithaca . . ' Water storage will be provided by a new 260 , 000 gallon water storage tank to be i located on Van Dorn Road in the Town of Ulysses . The average daily demand (ADD) for the proposed district was calculated based upon the initial number of Equivalent Dwelling Units within proposed Water District No . 3 . The estimated initial ADD for the proposed district is 69 , 060 gallons per day (gpd ) based on 345 . 3 EDUs , using an average per JEDU water usage of 200 gpd . As presented in the 1999 Town of Ulysses ' Water Supply Study, Addendum No . 2 , design AAD is 115 , 000 gpd in order to accommodate future buildout. Peak daily demand ( PDD) is estimated to be twice the ' expected ADD , therefore the projected future PDD is estimated to be 230 , 000 gpd . 586 006RI8. 01 -5- BARTON & LOGUIDICE, P. C. 6 . 0 HYDRAULIC ANALYSIS A computer-based hydraulic model of the P roposed improvements was developed in order to assess proposed system performance during various demand scenarios . The simulations below were completed for the proposed improvements . The output data for each simulation has been included in Appendix C . Scenario 1 : Maximum Daily Demand Only Scenario 2 : 1000 gpm fire flow at the end of the Cold Springs Road water main Scenario & 500 gpm fire flow at the intersection of Perry City Road and , Jacksonville Road . Normal pressure will vary between 34 PSI to 108 PSI depending on the ground elevation of the point of service and the elevation of the water in the proposed tank. ' Services that are expected to have normal pressure in excess of 85 PSI would be required to install pressure reducing valves to protect existing plumbing systems from ' high pressure . According to the New York State Department of Health Standards, the minimum allowably: pressure during all flow conditions , including fire flow is 20 PSI . Available pressures in the proposed district will meet or exceed the recommended minimum during a fire demand upon construction of all the water mains which are ' proposed under thi's improvement. 586 006RI8. 01 -6- BARTON & LOGUIDICE, P. All Town maps are being catalogued in the map database. Park and Open Space The Engineering staff is coordinating with the Highway Department and Planning Department on the Hanna Pew Trail project. T.G . Miller is finalizing the Boundary and Topographic Survey Work. As soon as the survey is completed, project plan development will proceed and design development will be initiated. Highway Contract administration for the Maple Avenue reconstruction project has been started with the Award of the contract and Notice to Proceed issued to Suitkote. Work started the week of September 17 with milling of the Road Surface. Sub base is being completed and the project is scheduled for substantial completion by the end of October. 911 /Emergency Operations Center Committee The Town Engineer is the Town of Ithaca representative on the building committee. Program development for the proposed 91 l /EOC addition at Station 5 site is being finalized and the schematic design was presented to the Committee on August 15 , and was reviewed at an October 1 meeting. The project will be coming to the Town Board for approval to use the Town owned property, a Memorandum of Understanding is being prepared by the County. The project will also require a special approval by the Board of Appeals and Site Plan Approval by the Planning Board. STORM WATER MANAGEMENT East Hill The Eastern Heights drainage improvement project includes the work completed on Park Lane and the stabilization of the drainage channel above Rte. 79 adjacent to the Ewing' s property. This portion of the drainage channel will be stabilized with heavy rock RipRap and the final design is being completed to build the protection this fall . Additional work is being planned for this project to protect a NYSEG main gas supply line. NYSEG will be paying for the work for the gas line protection. EARTH FILL PERMITS The City of Ithaca application for the proposed demolition and construction spoil disposal site on the Landstrom lot was submitted by the Superintendent of Public Works on April 16, 2000. The Town Engineer reviewed the application and determined that it wa:5 incomplete and has responded by letter to the City with a list of additional information required to complete the application. No activity has occurred since the response to the City. Two permit applications for pond construction have been received for parcels on Coddington Road. Both applications have been reviewed and forwarded to the Zoning Board of Appeals for approval with a recommendation for approval by the Town Engineer. WATER PROJECTS Integrated Water System Final project planning and design work on improvements for the integrated water system is on hold until completion of the revised SCLIWC agreement. TOWN ENGINEERS REPORT 10/4/01 West Hill Water System Installation of the Pump Station on Oakwood Lane and construction of 2000 feet of 10 Ductile Iron Pipe was started in September. Work is proceeding smoothly and substantial completion is expected in early November. The Contractor will be completing basic site restoration this fall and the Town of Ithaca parks department will be completing landscaping work around the Oakwood Tank site in the spring. This will include new tree and shrub plantings in a plan developed with the City of Ithaca. The Engineering Staff is continuing to work on preliminary plans and an engineering report for the part of the West Hill Water System behind the Biggs complex and the Hospital . Sapsucker Woods Road Watermain The contractor for the Lab of Ornithology project has completed installation of the 12" watermain that will serve the new facility. SEWER PROJECTS Joint Sewer Agreement The SJS partners are continuing to work on the revised agreement for the Ithaca Area WasteWater Treatment Facility and jointly used interceptor sewers. Intermunicipal Sewer System The Intermunicipal sewer Committee has been continuing to work on the Draft Agreement for expanding the partnership in the sewer system. The Intermunicipal Sewer Group includes the three existing partners in the Joint Sewer Subcommittee of the City of Ithaca, The Town of Ithaca, and The Town of Dryden, plus the three potential partners which are the Village of Lansing, The Village of Cayuga Heights and the Town of Lansing. The group is also working on the scope of the Environmental Impact Statement required by NYSDEC. A public hearing for the SEQR review of the project is scheduled for September 6. North East Sewer Improvements The Contractor has completed the Hanshaw Road sewer main contract. The Town Highway and Parks Department is completing the restoration of the site, which includes replanting trees and shrubs in the spring according to plans developed with the individual property owners. West Hill Sewer System Survey Work for the replacement of the Trumansburg Road Hospital sewer line has been completed by the Engineering Interns. The Town Engineer is in the process of developing a design and construction plan for replacement of this sewer line in 2001 . The Town Engineer has been looking at a possible sewer line along the North end of West Haven Road, which would serve possible frontage lots on land owned by Ecovillage. DEVELOPMENT REVIEW Site work for the PRI Museum of the Earth started in September. The Town Engineering staff has been inspecting the site periodically to ensure compliance with the approved site plan. The contractor has installed the required sediment and erosion control measures and is maintaining them. No site related problems have been noted. Ecovillage has started the site work for the second resident group with construction started on the roadways and driveway. Stripping of topsoil in the building area has started . Prior to the excavation work sediment control fence was installed below the construction area. Construction of fire protection improvements and sanitary sewers will start in mid October. Walker Page 2 10/04/01 Agenda # 2 2 Town of Ithaca Town Board , October 4, 2001 Highway Department Report for September 2001 Intermunicipal Coope�ratio_n Kings Way : We assisted the New York State Department of Transportation with repaving the truck pull off for State Route 96B (Danby Road) in return for our help paving the Town' s section of Kings Way . The intersection of Kings Way and East King Road was redesigned to slow down the traffic at the intersection. Shoulders : The Town of Ithaca worked with our neighboring Towns (Caroline, Danby, Newfield, Ulysses, and Enfield ) putting down shoulders . We work with our neighbors every year putting; down shoulders . The cooperative effort saves all the Towns' time and money . Maple Avenue The Maple Avenue project has finally started . We had a few problems with utilities to being with and have managed to resolve all conflicts so far . The funding for this project seems to be in place . We are expecting Maple Avenue to be completed by the end of October or the beginning of November . Parks and Trails Iacovelli Park: Iacovelli Park is substantially completed . The basketball court has been paved and basket will be installed and we will paint stripe the court in early October . Some benches need to be placed throughout the park also . The planting plan is being evaluated with the goal of purchasing the plant materials in the spring for planting. Other Park Projects : The Northeast Ithaca Walkway and the South Hill Recreation Way were surface treated in September . We continued to mow trail and park sites and we trimmed shrubs throughout the park and trail sites . Roads Crosswalks : We repainted the crosswalks and stop bars throughout the Town during September . We have trouble getting a striping company to come and do our small striping jobs when we need it done . We are considering purchasing the City of Ithaca ' s used striper to give us the capability to do these smaller jobs . Miscellaneous Projects : Other projects completed during September include : ■ Crest Lane turn-around was reconstructed, drainage improved, and the area repaved . ■ Continued work on the creation of a mixing system for the salt and Magic —o . ■ Hot patched several areas throughout the Town . ■ Worked on catch basin cleaning and maintenance . ■ Put out voting machines and polling place signs . Retrieved them after primary election . ■ Started storm water management underground drainage project on West Haven Road . Water and Sewer Hanshaw Road Back Lot Sewer: We completed the lawn restoration at the Hanshaw Road back lot sewer . We have met with property owners regarding replacement tree and shrub plantings to be installed in the spring of 2002 . Codes and Ordinances Committee : The Committee met on September 19 , 2001 and completed the review of proposed Zoning map changes . The next meeting is scheduled for Tuesday, October 16 , 2001 where the agenda will focus on approval of a revised Zoning Ordinance text for distribution to boards and committees for review and comment . The Committee will also consider a revised timeframe for completing the Zoning Ordinance revisions . Transportation Committee : The Committee met on September 27 , 2001 , and had further discussion regarding the scope and contents of a transportation plan , identification of available 2 i traffic data ( accidents , volumes) , identification of locations for volume and speed studies that might be conducted , and discussion of other traffic/transportation studies in progress by others (e . g . , Forest Home Traffic Calming Study, City Six Point Traffic Study, County Freight Transportation Study) . ITCTC Planning Committee : Town representatives attended the September 17 , 2001 meeting of the Ithaca-Tompkins County Transportation Council (ITCTC) Planning Committee . Agenda items included a presentation by Tompkins County on their Vital Communities Initiative , discussion regarding the upcoming Transportation Enhancement grant program, and updates on the NESTS Transit Project , Freight Transportation Study, and North Campus Gateway. Ithaca College — Proposed South Hill Conservation Zone : Town officials conducted a site visit at Ithaca College , accompanied by consultants Robert Wesley and Nancy Ostman , to further study portions of the campus relative to the proposed South Hill Conservation Zone . Based on input by the consultants and observations during the site visit, Planning staff will review possible Conservation Zone boundary modifications with the consultants , the Conservation Board and the special sub-committee that had been set up by the Town Board . The consultants are expected to provide a written report with their findings and recommendations in the near future . Ithaca College Master Plan : Town officials attended a presentation of Ithaca College ' s Master Plan work that has been prepared by Sasaki Associates . The preliminary Master Plan includes a construction program over the next ten to fifteen years of approximately 739,700 square feet of additional campus development, including 124 ,700 s . f. of academic space, 260,000 s . f. of residential space , .170,600 s . f. of athletic/recreation space, and 184 ,400 s . f. of administrative space . Three alternative schematic plans were presented, including parking modifications , showing possible locations and configurations of new development and redeveloped areas on the campus. It was agreed that another meeting between the Town and College would be set up soon to continue discussions regarding the College ' s Master Plan . Regional Sewer Project : Town officials attended the public Scoping session that was held on September 6 , 2001 at the Town of Lansing Town Hall to obtain public comments on the scope and content of the EIS that will be prepared . Approximately 75 people attended the session , and ten people provided comments at the session . The comment period on the draft Scoping Document closed on September 21 , 2001 . The next step will be for the NYS Department of Environmental Conservation to revise the draft Scoping Document and issue a final Scoping Document , after which the consultants will prepare the Draft EIS . Fall 2001 Newsletter: The Fall 2001 Newsletter was prepared and printed . The mailing to Town residents is scheduled to go out during the week of October lsc Agricultural Land Preservation Program : The Agricultural Land Preservation Committee will be meeting on October 1 , 2001 to discuss : the status of the Genex parcel and other properties where owners have been contacted to determine interest in the PDR program, the status of our request to the Park Foundation to extend the timeframe for the grant, discussion of a new application recently submitted by an interested landowner for the PDR program, and discussion of how to 3 X get more landowners interested in the PDR program . A committee report will be made at the October 4'h Town Board meeting . Update on Steeples Glen Proposal : It is our understanding that the Ernann Corp . is no longer pursuing the Steeples Glen proposal on the undeveloped portion of the Eastwood Commons site off of Honness Lane (although we have not received written confirmation from the Ernann Corp. ) . We have had discussions with the current owner of the property who has expressed interested in developing the vacant portion of the Eastwood Commons site (the Multiple Residence portion) pursuant to the approved site plan (received final site plan approval from the Planning Board. in 1987 with modifications of conditions in 1988 ) . This would not require any further Planning Board review unless modifications in the approved site plan were requested (except that there are several conditions , including final subdivision approval for delineating individual parcels around separate units and approval of a homeowners association to address use and maintenance of open space , that might require further Planning Board involvement) . Ulysses Water District No . 3 : A letter was sent to Supervisor Austic recommending that the Town of Ulysses provide more information and analysis regarding the possible growth inducing impacts of their proposed Water District No . 3 prior to issuing a Negative Declaration of Environmental Significance . (The letter is included in Board packets with other materials regarding the water district, and a discussion with Town of Ulysses representatives is scheduled for the October 4`h Town Board meeting . ) Route 366 Bridge Project : Representatives of the Town and Cornell met with NYS Dept . of Transportation (NYSDOT) officials on September 25 , 2001 to discuss landscaping, lighting , and other design elements relating to the Route 366 Bridge project . Based on this input, NYSDOT will be finalizing plans over the next couple of months , incorporating the realignment of Judd Falls Road to the east, the pedestrianibicycle bridge, and other elements that the Town Board had requested. According to NYSDOT , the State will be purchasing land and easements from Cornell for portions of the bridge project, and plans to convey these to the Town of Ithaca . Widewaters Site Development Plan , City of Ithaca : Planning staff reviewed materials forwarded by the City regarding the revised Widewaters site development plan (Elmira Road Shopping Center) , and sent a letter (dated September 25 , 2001 ) indicating that we still have concerns regarding stormwater management/water quality and traffic (copies of the letter were placed in Town Board member boxes) .
