Supervisor Schwan called the meeting to order at 5:15 p.m.
APPROVAL OF MINiTTES
Motion by Supervisor Schwan; seconded by Councilman McElwee,
RESOLVED, that the minutes of the meeting of January 10, 1972 be
approved with the amendment to include the appointment of the Town
Highway Superintendent, Marion Morey, and the Town Clerk, Edward L.
Bergen, for a term of two years beginning January 1, 1972 and ending
December 31, 1973• �
Unanimously carried.
� REPORTS
James V. Bu oucos Town Attorne . Mr. Buyoucos reported that he
atterided t e mee ng of e Assoc a on of Towns in New York City and
�; gave two talks, one to town supervisors, and one to town attorneys,
� � with respect to water and sewer improvements. He said they were
extremely interested; many questions were asked by attorneys repre-
senting very large districts outside the Metropolitan area.
Mr. Buyoucos reported on two legal decisions. The first was with
respect to Vincent Franciamone which, in essence, restored Mr. Fran-
ciamone's premises to their original condition to comply with the law,
the center portion of the premises to be changed to a carport, the
accessory building to be used only for storage. Side yard requirements
were waived due to the investment already made by Mr. Franciamone.
Mr. Franciamone will receive an order to comply with the decision
and will have 30 days to do so after service of the order. The second
decision was with respect to the Rumsey Sand Gravel bank. The decision
in this case achieved one object of the Town which was to obtain a

determination that Rumsey was subject to the regulations of the Town
in terms of getting a permit. Two negative aspects of the decision
Mr. Buyoucos noted he would like to discuss with the Board in execu-
tive session.
Mr. Buyoucos presented to the Board two deeds (and map) from
Arthur A Prince to the Town of Ithaca, one for a 50 ft. strip for road
purposes only, and one for St. Catherine's Circle. Town Board approval
of these had been held up pending presentation of the map. The Town ;�
Clerk was instructed to file the map and record the deeds on February 1, !
15, 1972. Mr. Buyoucos said the Town Board should approve the road � �
but refuse to give Mr. Prince any building permits until he complies
with hooking up water and sewer service and hydrants. The Board has n
accepted St. Catherine's Circle but no building permits will be issued
until water and sewer is installed and the hydrants hooked up. Mr.
Francese was instructed to talk to the Zoning Officer, David Cowan,
about this, and the Town Clerk was instructed to notify Mr. Prince by
registered letter, return receipt requested.
Peter K. Francese Plannin� Consultant. Mr. Francese presented
copies o e propose s gn or inance o e Board members and re-
quested that they read same, and after reading, adopt a resolution
to hold a public hearing in March. He indicated the number of exist-
ing non-conforming signs in the Town of Ithaca is quite small, par-
ticularly as compared with the City of Ithaca. Mr. Francese indicated
that the proposed sign ordinance differed particularly from the City�s
in that it lays down guidelines for the Planning Board in approving
signs.
Motion by Councilman Desch; seconded by Supervisor Schwan,
RESOLVED, that the Town Board hold a public hearing on March 13, 1972,
the Board's regular meeting date, at 6;00 p.m., to consider the
adoption of a local law regulating signs and billboards in the Town
of Ithaca. (`�

Attorney Robert I. Williamson, speaking on behalf of Park Displays,
Inc., a locally based corporation which constructs and maintains
billboards in the Tompkins County area, includin� the Town of Ithaca,
objected to the proposed sign ordinance in that, in effect, it
eliminates billboards by allowing them only one year of existence as
a non-conforming use. He said they would accept control, but they
did not want to be totally eliminated. He asked the Board to consider
Park Displays� request when they review the ordinance. The Board sug-
gested that Mr. Williamson present within a week or ten days some sug-
gested regulations and recommendations, particularly with respect to
the number, location, and size of the billboards owned by Park Displays,
Inc.
Hugh (Sam) MacNeil, County Representative. Mr. MacNeil reported
the Coun y Sewer gency passe e a op on o No. 1 Sewer District for
the four towns (Ithaca, Dryden, Lansing and the Villa�e of Cayuga
Heights). He suggested there might be a petition that would force
this matter to a permissive referendum, a referendum of the four muni-
cipalities. The petition would require only 100 signatures. The �••�
petition would have to be presented within 30 days.
Mrs. Barbara Holcomb Chairman of the Plannin Board. Mrs.
Holcom repor e a e oun y P ann ng Boar s s in the pro-
cess of organizing. This organization has temporary officers and is
being organized on a trial basis since it is not in conformity with
the County Gharter. Should the organization be successful ihe idea
is that the Charter will be amended. So far the time of the group has
been spent in orienting the members as to what planning functions the
County is involved in and the status of planning in the various muni-
cipalities in the County. The second and third meetin�s of the County
Planning Board were devoted to long preliminary discussions of what
are called planning goals and questions regarding the validity of

certain':assumptions. There.was a report from the Day Care,Center�
�nd such a report will go out periodically. Various people are �
reporting to the County Flanning CoaZition on their activities. Mrs.
Holcomb felt the County rlanning Board could be a ver�Y�fruitful group.
FINAL AtrROVAL - MONKEMEYER �SITE 1'LAN
Supervisor Schwan read a letter dated December 21, 1971 from William
J. Mobbs, Civil Engineer, Tompkins County Highway Department, to
Evan Monkemeyer regar.ding proposed "Housing for Skyrise Associates"
project on East K3ng Road, saying he had examined the project with
regard to curb cuts and dr.ainage.�.oad to roadside ditches and found
same acceptabie. �
Mr. Schwan also read letter dated December 17, 1971 to Evan Monkemeyer
, from John E. Shannon, Resident Engineer, Tompkins County, New York
State Department of Transportation, saying they have no objection to
�he proposed cleaning of the natural drainage outlet draining the �
proposed Monkemeyer property on East King Road, culvert for the drain-
age outlet being located on Route 96B and more specifically described
as Station 91 #� 02 Ithaca Danby Part 1 State Highway 5043 Tompkins
County.
Supervisor Schwan also read a letter dated December 17, 1971 from
Edward Whitlock, 115 E. King Road, to Evan Monkemeyer giving Mr.
Monkemeyer permission to clean out�the stream that runs through
Mr. Whitlockts property, the cleaning out to be at no cost to Mr.
Whitlock.
The Supervisor a].so read a memorandum from the Planning Board to

MARINE MIDLAND BANK - SITE PLAN APPROVAL

Supervisor Schwan read a memorandum dated February 8,'1972 from the
Planning Board recommending to the Town Board that they accept the
proposed site plan for the Marine Midland Bank with certain listed
changes.
Motion by Councilman Desch; seconded by Supervisor Schwan,
RESOLVED, that the Town Board approve the site plan for the Marine
Midland Bank as presented by the bank's representatives on the con-
dition that��here be a single curb cut for Exit on Judd Falls Road�
north of the parking lot, tha� is to say, the existing en�rance on
Judd Falls Road, and with the further stipulations that (1) the
plantings along Mitchell Street and Judd Falls Road be low enough so
they do not obstruct the sight lines for automobile traffic leaving
the bank to Mitchell Street or Judd Falls Roa.d, and (2) that this,.
site plan approval does not include approval for any signs.
Unanimously carried.
Mr. Mil.ligan and the developer, Mr. Yuniss, were not certain that
the project would proceed with the changes in their proposed exi.t,.
but this was not.considered to be a problem of the Tow� Board. �

Ellis Hollow Road and the East Ithaca area be referred to the Plan-
!'' ning Board for further study, keeping in mind the possibility of the
,; Town of Ithaca becoming a suburban town wit�h the power to regulate
--- its own speed limits, or in consideration �of all thes•e individual �
requests being combined in �one request to .the Department of Trans-
� portation, in conjunction with the Tompkins County Hi�hway Department.

FOREST HOME BRIDGE5 AND R�UTE 392
Supervisor Schwan read the minutes of a meeting of the Forest Home
Improvem�nt Association held on February 10, 1972. Although the Town
Attorney said it might not require a public he�ring for the Town to
take over Route 392 leadin� to the Forest Home bridges, he felt it
would be wise to do so anyway. It appears_ the County has no objec.tior� �..
to taking over the two bridges at Judd Falls Road and Caldwell Road `j��=
so long as they are b.rought up to the County's speci�fications. Super-
visor Schwan said the Town would not take aver the road from the State. `
unt3.1 such time as the bridges are brou�ht ��p to �the spec3ficat3.ons' of
the County. Supervisor Schwan said he had talked to Mr. Ames of the
Department of Transportation and there was a willingness on�their
part to rebuild and/or repair the two bridges if the Town would take
over Route 392. The County would then mana�e and maintain the bridges. _

Supervisor Schwan read a memoran'dum dated February 8, 1972 from the;�-
Plannin� Board with �respect to �.a :request for a sign permit for East�� �
Hi17. Plaza and F.B.C. The memorandum indicated that the Planning
Board had noted that nei�her of the si�n proposais�.presented•.by
Kennilworth Associates for the East Hill Plaza signs and the F.B.C.

Mr. Ernest Squilla, Vice Presider�t:-of Kennilworth Associates, asked
the Board to make a deci.sion as to whether he could e�ect a sign 24
feet� high and asked whether �it c�ould be maintained unde.r the progos'ed �
sign ordinance. _
There was some discussion of the 20 ft, height requirement and some
feeling that it might be too restrictive...Councilman�McElwee felt..
that 24 feet was not unreasonably high.� Councilman I?esch did not feel
ihe Board should be pressured into passing on a section of the ordi=
nance before the ordinance�was enacted. Mr. Squillahsaid he would be
'�tailling to cut the sign down to 20 feet later if the -fi'inally enacted
ordinance should require it. � .
Motion by Supervisor S�chwan; seconded by Councilman McElwee,
RESOLVED, that Kennilworth Associates be authorized to�build a sign
2�.feet high, above grade, and 100 feet square, with the stipulation
t�at ,if the sign ordinance as finally enacted limits signs to 20 feet
in height the sign would be lowered to conform with the ordinance. �

I t appeared there �,re some dozen areas in the Town whe�re water ser- '
v`ices�are required'at this time, and where because of the moratorium
on water hook-ups imposed by the City of Zthaca water ta.ps are not
obtainable. Superviso'r Schwan posed the question: Tf the Town Board
should �et a request, f•rom thQ �'own of Dryden to suppor�� it 3.n a legal
action against.the City of Ithaca, is it the feeling o��the Board that
they should a.uthorize the Town At�orney to proceed witY� �he Dryden �
Town Attorney in such an actionY The Ithaca Town Attorney felt the.
Town Board could not commit itself to such action without knowing , .
what Dryden planned to do or allege in its complaint. The general
feeling of the Board was that such action would be premature and felt
the.n�atter should be held in abeyance until after the intergovern- ''.

MOBIL •IL GAS STATI7N (Judd:Falls Road.and Ellis Hollow Road)
Supervisor Schwan read a.memorandum dated January 18,,1972 from the
Planning Board�citing resolution recom4nending to the Town Board that
the present plan for the Mobil Oil Staiion at �he corner of Ellis
Hollo w a.nd Judd Falls.Roads is,,unsatis�actory until certain conditions

Mr. Pezzicara appe�,red on behalf of Mobi,l Oil Corp�oratibn and said
two 24 foai curb cu�s are unacceptable��o Mobil and that they.would
not build on that basis, He advised the Board that Mobil generally
builds on the basis of 35 foot curb cuts and that three curb cuts are
the minimum Mobil can accept. The Town Board agreed to two curb cuts
of 35 feet and approved Mobil's plan for the gas station con.tingent
upon the fo1].owing changes : � ' .
1. That the Entrance 2 be reduced io 35 feet in width and
be as far away from the.intersection of Judd Falls R.oad
and Ellis Hollow Road as possible.�
2. That Entrance 3 be eliminated.
3. That Entrance �+ be reduced to 35 feet in width and be
kept as far to the east as possible.
4. That the building shoulc� be moved to the south so �hat �
the side yard distance between the corner of the building �
and the lot line be equal to or greater than 20 fee�.

In a revised plan every effort should be made to reduce
the amount of asphalt.
That the revised plan should show a grassed-over area
between Entrances 2 and 4 with proposed low p�lantings,
7. That plantings along the east property line should create
a site break between the service station area and the
shopping center parking lot.
8. Thai any signs proposed for the service station must '
be approved�separately. - � �
9• That details of entrance and ex3t I3nes should be shown
on any revised plan.
YOUTH BUREAU

Supervisor Schwan read an agreement between the City of Ithaca and
the Town of ItYiaca for financial support of the City Recreation Pro-
gram, wherein it is agreed that the Town's share of the recreation
services rendered by the City Youth Bureau for the operati�on of a
recreation program is $7,91g.00. �
Moiion by Councilman Desc'h; s�econded by Councilman McElwee,
RESOL`TED, that the Supervisor of the Town of Ithaca be authorized to
sign the contract with the 'City�of Ithaca for the calendar year 1qT2
wherein it is agreed that the City of Ithaca will bill the Town of
Tthaca for $7,919.OQ, said amount bei`ng the ag�eed Town of Ithaca
share for the operation of a reereation program.

PARK COUNCIL
Mr. Peter Francese, Planning Consultarit, inquired about the status
of the Ithaca Park Council and indicated there is stil], a need for
some kind of charter. It was agreed that the Town Attorney woul.d
give this matter h�s earlie-st possible attention, certain other
matters having priarity at this .time.

Walter 0'Connell, Attorney, wanted to be put on record as pxotesting
the_�wording of a sign on the Danby Road which reads "Trucks and Buses"
(with an arrow). Mr. 0'Connell indicated that should you be driving
a pick-up truck, mini-bus (or'even a st`ation wagon) and'not follow�
�he direction of the'arrow, you are subject to fine. He felt�the
sign is ambiguous�and since it is under the jurisdiction of the Town
of Ithaca Justice Court he wan'ted to be_,p,ut on record as requesting
that the s3gn should specify "truoks" of a eertain groas weight. Mr.

0'Connell said he would write to Assemblywoman Constance E. Cook and
the Motor Vehicle Department. The Town Board was sympathetic with
Mr. 0'Connell's complaint and assured him of the Board's caoperation.
