APPROVAL OF MINUTES Motion by Councilman Desch; seconded by Councilman McElwee, RESOLVED, that the minutes of the September l4, 1970 regular meeting be approved as submitted. Carried. APPROVAL OF WARRANTS Motion by Councilman McElwee; seconded by Supervi RESOLVED, that warrants in the following amounts General Highway East Ithaca Water Dist. WALKWAYS AND BIKEWAYS Mrs. Livesay appeared before the Town Board, cited increased traffic resulting from Town growth, and requested that the Board consider the need for separate walkways and bicycle paths along town roads. She cited the advantages of such walkways and bicycle paths for the towns people, and requested Town support for a "pilot" program in the Snyder Hill Road area to Rt. 366 and the Cornell Campus. Members of the Town Board cited some of the practical problems, such as cost, ability to perform within existing rights of way, terrain, safety in walking and cycling, particularly against the flow of traffic, parking, etc. Mr. Buyoucos, Town Attorney, suggested that there might also be considerable legal problems to look into. Two resolutions in support of Mrs. Livesay's request were read to the Board, one by Jim Costello, President of the Ithaca Youth Council for Civic Affairs, and the other by Barbara Brown, League of Women Voters. Supervisor Schwan read a letter signed by seven citizens of the Town of Ithaca requesting that the Town Board support Mrs. Livesay's pro posed "pilot program in the Snyder Hill area with respect to a bicycle path from the Snyder Hill Road area down to Route 366 and the Cornell Campus. ^7l - 2 - October 12, 1970 Mr. James M. Hartshorne, President of the Finger Lakes Runners Club furnished the Town Board with a statement with respect to the "estab lishment of a system of safe, convenient, and pleasant bikeways and bike paths throughout the area to meet the pressing needs of its community." Motion by Councilman Desch^ seconded by Councilman McElwee, RESOLVED, that the Town Board recognizes the need for the provision of bikeways in several areas of the Town and endorses the proposal that a sub-committee be formed as a part of the Town of Ithaca Park Council. Carried.n Councilman Desch further suggested that Mrs. Livesay suggest who the members of such a sub-committee might be and upon receipt of a list of people as prospective members formally adopt the sub-committee and that the sub-committee work through the Park Council with the Planning Board to develop a plan and a means of implementing the plan, work up a cost analysis, and recommend priority of areas where such bicycle paths might be provided first and when they arrive at that point report back to the Town Board with a recommendation. After some further discussion the Board felt it should make it clear to Mrs. Livesay that the Town could make no money commitment. ANNEXATION - MAPLE AVENUE SITE Supervisor Schwan reported that the Town had received three maps from SUDC, outlining Plans A, B, and C. Supervisor Schwan presented this material to the Board and read a letter from Mr. Scott Carlson, dated September 25, 1970. Supervisor Schwan reported that he had had no further communication from the City or Mr. Carlson since that time. APPOINTMENT OF TOWN CLERK Motion by Councilman McElwee; seconded by Councilman Desch, RESOLVED, that Edward L. Bergen be appointed Town Clerk, effective November 1, 1970, to conincide with Elizabeth K. Parrish, present Town Clerk, moving to Georgia. Carried. ROUTE 79 TRAFFIC Supervisor Schwan indicated there is nothing further the Town can do in this matter. Route 79 is part of the so-called State arterial system and trucks and bus companies have franchises from the State of New York to use this route. The Town has no further information on this and can do nothing further. DEPARTMENT OF TRANSPORTATION, NEW YORK STATE FOREST HOME DRIVE - ROUTE 392 n Supervisor Schwan had nothing further to report on this. Mr. Shub, Regional Planning Engineer, New York State Department of Transporta tion, had not reported back. REQUEST FOR LOWER SPEED LIMITS Supervisor Schwan read a letter from the New York State Department of Transportation from C. L. Ames, addressed to Mr, Howard Stevenson, County Superintendent of Highways, in which request for lower maxi mum speed limits on Warren Road, Hanshaw Road, and Bundy Road were denied. Supervisor Schwan advised that he had, in turn, written C. L. Ames, requesting information on what State requirements are regarding speed limits on roads within the Town of Ithaca when the speed limit is below State speed limits and also specifically re questing information regarding speed limits on State roads within the Town of Ithaca, County roads within the Town of Ithaca, and Town roads within the Town of Ithaca. Supervisor Schwan said he might have further information for the Board at the next meeting. n - 3 - October 12, 1970 FRAUDSEN REQUEST FOR REFUND ON I969 SEWER TAX Supervisor Schwaui read a letter from William Prandsen, dated April 3, 1970, requesting refund on 1969 Sewer tax, and also a letter of October 6, 1970. This matter was turned over to Attorney Buyoucos for his recommendation on this request, INSURANCE REVIEW - ROBERT BOOTHROYD, JR. Robert Boothroyd, Jr., of R. S, Boothroyd Agency, Inc., presented 1 material to the Board outlining the Town's present insurance cover age, and suggested certain categories in which he believed it would be in the Town's best interest to increase its coverage. He particu- larly recommended an increase in the Town's excess liability coverage from $1,000,000 to $5,000,000. APPOINIMENT OF ELECTION INSPECTORS Motion by Supervisor Schwan; seconded by Councilman Desch, RESOLVED, that Helen Sundell, 310 Forest Home Drive, and Mrs. Fred Ridgecrest Road, be approved as Election Inspectors for 1970-71. Carried. RESIGNATION - HARRY BAKER Supervisor Schwan read letter of resignation from Harry Bak'^r, dated September 28, I970. AUTHORIZATION TO BID - HIGHWAY SUPERINTENDENT ' Motion by Councilman Desch; seconded by Supervisor Schwan, RESOLVED, that Marion Morey, Highway Superintendent, be authorized •• to prepare bids on truck with snow plow and spreader, and small . portable roller. . : . Carried. In connection with Town equipment, Cbuncilinan DelRosso brought up the matter of depreciation of such equipment as a sound business pra,ctice and suggested that this should be looked into by the Board. general agreement on this. Attorney Biiyoucos only suggest-ing there might be something- in the Highway Law, General Municipal Law, or Town Law with respect to the replenishment of equipment arid the possible requirement for a permissive referendum. Attorney Buyoucos-requested that the Town Clerk look into this. Motion by Councilman Desch^ seconded by Councilman McElwee, . RESOLVED, that Councilman DelRosso and Marion Morey, Highway Super-^' intendentj make a study of Town equipment in relation to depreciating it in accordance with sound business practice. Carried. VOTING MACHINES Mr. Morey, Highway Superintendent, requested permission to move the Voting machines from the old School House at Coy Glen to the Meeting Room at the Town Highway barns. This request was granted. Supervisor Schwan and Mr. Morey are to inspect all the voting machines to see if one machine should be replaced this year line with the Town*s replacement policy. 176 - 6 • October 12, 1970 REPORTS ' . P ; V • ; Mrs. Carl Valentino, Park Council, reported as follows: 1. The Town would get all the State Aid it was entitled to for Coddington Road, but that'the Town had not applied for^ .anything on the amount they contribute to the Youth Bureau and that Mr. Sebring had advised her he thought the Town is entitled to something. H 2. Care should be taken to see that the natural beauty of the Coy Glen area is preserved and that the area is not despoiled. Super visor Schwan agreed and indicated that the matter is-being followed and that the Board would make a report and advise Mrs. Valentino what is being done. j,-, I • > C James A. Buyoucos, Town Attorney, reported as^jfollows: 1. The Town has started another action against Mr. Lucente, charging Mr. Lucente with further contempt of court. This has been scheduled for a hearing sometime next month. 2. The Town has started another injunction action against Mr. Lucente for violation of the ordinance relating to occupancy as it was amended this year. 3. Mr. Buyoucos suggested that the people in the Town should study the amendment to the Zoning Ordin^ce which was made ^rlier this year because there are more restrictive pro visions than heretofore with respect to occupancy. n I Kenilworth sign situation has been taken care of.The attorneys for the owners have seen to compliance. ^ LAWRENCE lACOVELLI | I The matter of Mr. Iacovelli*s request for refund of taxes on four m discussed, and it was felt by the Boardat the Town cannot refund taxes for a prior year, but that future taxes would be based on Mr. lacovelli's ownership of two parcels rather than four, ANTHONY LEONARDO - DANBY ROAD Schwan read the resolution contained in the minutes of Board meeting of November 6, I969 in which the Town agreed tnat.'Mr, Leonardo should be granted some cost relief and that the Town pay for 125 feet - house to connection.
