HomeMy WebLinkAboutTB Minutes 1970-08-171 TOWN OP ITHACA Town Board Adjourned Regular Meeting August 17, 1970 PRESENT: Walter Schwan, Supervisor Harry Baker, Councilman Noel Desch, " Andrew McElwee, " ALSO PRESENT: James Buyoucos, Town Attorney Peter Francese, Planning Consultant Howard Stevenson, Tompkins Co. Comm. of Pub. Works Supervisor Schwan called meeting to order at 8:00 p.m. Supervisor Schwan advised that Mr, Stevenson was present at his invitation. Mr. Stevenson expressed his feelings with reference to the drainage problem in the Northeast in the area of the new Junior Hi^ School and BOCES. There was considerable discussion with reference to ponding and the size of pipe at Warren Road. Final result of the discussion was that Supervisor Schw^ would write ^ letter to BOCES and suggest that in light of the fact that it is the feeling of the Board that they are diverting water, they should make a rec^uest to the County for permission to leave the restriction in the culvert. ANNEXATION Supervisor Schwan called the ^Board's attention to the request from SUBC to annex a parcel of land in the Maple Avenue area. He showed the site SUDC proposed for their housing; and a map showing the-area requested to be annexed to the City. The housing site cpmprises approximately 4.70 acres; the area to be annexed into the City comprises approximately 25 acres. The question was raised as to why the City wished to annex land far in excess of the SUDC requirements. Planning Consultant Francese said that he was of the opinion that the UDC law allowed agreement between municipalities to permit IHA to use the land and rent units, ^e board-was polled to get their feeling on the einnexation. member^ indicated they were aigainst the annexation,with Coun^cilman pesch abstaining. After further discussion the following points were made against annexation; 1. Not in the best interest of the development of the' Town of Ithapa. 2. Will isolate, several pieces of property. 3. Not annexing a problem area (Koppers). Loss of per papita aid based on population of Cornell j quarters. Attorney Buyoucos felt the Bosrd should first prepare for -the joint public hesring. Question was raised as to whether or not we could ask the City to postpone hearing beyond September 2o', also whether or not the City might be asked to withdraw petition and reflle. Final decision was that we would wait to hear what the City's reply is to our request to delay hearing ^ to September 28th, and then go ahead with the joint hearing, I t It was further bointed out that the boundary line of the ; 1 PS®® requested :Xo be annexed had a periphery of approximately 4800; feet witlj only 280 feet contiguous to the City, \ir'' -2- August 17> 1970 ZONING ORDINANCE A motion was tabled at the August 10th meeting which read as follows: "RESOLVED, that a public hearing be set to amend the Zoning Ordinance to take into account Section 7^ - Special Exceptions." Planning Consultant Prancese was to have rewritten this amendment, however,he stated he was not clear as to exactly what the Board wanted. After considerable discussion the amendment was referred back to the Planning Consultant. No action was taken on the motion. MAGISTRATE'S ASSOCIATION I ' Justices Blye and Hart^ock requested permission from the Board to attend a meeting of the NYS Assoc. of Magistrates at Kerhonkson, New York, September 13-16, 1970. Motion by Councilman Desch; seconded by Councilman McElwee RESOLVED, that Justices Blye and Hartsock be authorized to attend a meeting of the NYS Association of Magistrates, September 13-16, 1970. Carried. Meeting was adjourned at 10:00 p.m. The Board then went into executive session to consider the draft of the revised Zoning Ordinance. arrlsh>ethK. Tow?f Clerk n n n- RESOLVED, that the Ithaca City School District, deed, to the Town of Ithaca, a strip of land not to exceed twenty feet in vndth for the purpose of constructing a drainage ditch, along the southern boundary of the Northeast Junior High School site from the western boundary east to a point where a drainage ditch veers to the west and grant an access easement to the Tov/n of Ithaca for the purpose of maintenance with the following stipulations and reservations: The ditch be no more than two feet wide at the bottom, nor more than eight feet wide at the top and not exceed three feet in depth. The ditch be constructed, seeded or sodded and maintained by the Town of Ithaca including regular grass trimming. The area so deeded revert to the Ithaca City School District when and if the land is no longer needed for the foregoing purpose. A sketch, indicating the exact location and ditch details, be submitted to Mr. Egner, for approval, with any charges incurred by Mr. Egner to be a Town of Ithaca responsibility. Construction of a ditch be coordinated with Streeter Associates, general contractor for the Northeast Junior High School. Dirt from the ditch be removed from the site. The sanitary sewer line of the Northeast Junior High School be completely protected—at all times—by the Town of Ithaca. An easement, providing ten feet on the south side of the sanitary sewer line and twenty feet in width where the sewer line turns south to Winthrop Drive, be reserved by the Ithaca City School District. The Town of Ithaca shall bear all expenses for 1) the construction and maintenance of the ditch, 2) any survey deemed necessary and 3) the property transfer. The Town of Ithaca is to assume full responsibility for the ditch and save the^Ithaca City School District harmless from any action arising from the flow of water therein including all water collected by or channeled into the ditch. k) The Town of Ithaca shall not construct a dike on the \ Ithaca City School District side of the ditch and shall \ allow any surface or other water from the school site to run into the ditch at all points along the ditch. AND BE IT FURTHER RESOLVED, that the administration be and hereby is directed to notify the Town of Ithaca, imnediately, of the intent of the Board of Education, so that the Town of Ithaca may proceed to plan accordingly. AND BE IT FURTHER RESOLVED, that the school attorney consult with the Town of Ithaca attorney and draw up the necessary instruments for execution by the president of the Board of Education.
