TC»4PC0 PUBLIC HEARING - 5:15 p.m. RESOLUTION #556 - EXTENSION OP SEWER DISTRICT BOUNDARIES Moved by Victor Del Rosso; seconded by Noel Desch (See copy of complete resolution in Minute Book.) 0 Carried, RESOLUTION #557 - INTENT OP THE K)ARD Moved by Noel Desch; seconded by Victor Del Rosso , ^ ^ RESOLVED, that it is the intent of the Town Board, subject to re(3uirements of laW as to procedures, and in cooperation with the appropriate City of Ithaca officials, to provide such additional facilities in the water and sewer districts servicing the Tompco and Kenllwoifth subdivisions as future development in such sub.- divisions warrant. Carried. RESOLUTION #558 - TOWN CLERK AND DEPUTY CLERK Moved by Walter Schwan; seconded by Noel Desch RESOLVED, that Mrs. Elizabeth K. Parrish be appointed Town Clerk and Receiver of Taxes, effective April 6, 1970, at a starting salary of $7,500.00 with a review in 6 months; and BE IT FURTHER RESOLVED, that Mrs. Patricia Post be appointed Deputy Clerk and Receiver of Taxes, effective March 24, 1970. Carried. RESOLUTION #559 - RICHARD BLATCHLEY WATER CONNECTION Request received from Richard Blatchely, 131 Honness Lane, for aid in payment of water connection to property at 1430 Slatervllle Road; main is across street. Moved by Walter Schwan; seconded Victor Del Rosso RESOLVED, that the Town of Ithaca will pay one-half the cost based on bill from Paul Mancini & Sons, dated October 15> 1969- Total cost of bill is $458.25; Town's share, or $229.13, to be charged to Extcncion of the East State St. Ext,. Water District. Carried. RESOLUTION #560 - PUBLIC REARING - W T K 0 Moved by Noel posoh; seconded by Victor Del Rosso RESQLVED, that a Public Hearing be held at the regular Town- Board Meeting on April 13, 1970 to consider the request received from W T K 0 for re-zoning a parcel of land on East King Road for radio towers and transmitter building. Carried. Request was made to Planner Peter Prancese that he obtain additional bids for renovation of the Town Offices. Meeting adjourned at 6:30 p.m. .Walter J. Present: Wftltiftr SchWftn Noel Desch Victor Del Rosso Supervisor Councilman Councilman CounciIman Councilman In the Matter of the Establishment of the Ellis Hollow Road Sewer District, Extension No. 1, in the Town of Ithaca, County of Tompkins, State of New York, pursuant to Article 12-A of the Town Law. WHEREAS a map, plan and report relating to the establish ment of the proposed Ellis Hollow Road Sewer District, Extension No. 1, prepared by , a comnetent John S. Mac Nelll Jr. engineer, duly licensed by the State of New York, in manner and in such detail as has been determined by the Town Board of Ithaca, has been duly filed with the Town Clerk of Ithaca, in accordance with the requirements of Article 12-A of the Town Law, and V7HEREAS, an order was duly adopted by the Town Board of Ithaca on the 9th day of March, 1970, reciting the filing of said map, plan and report, the improvements proposed, the boundaries of the proposed district extension, the estimated expense thereof, the proposed method of financing, the fact that the map, plan and report describing the same, are on file in the Town Clerk's Office for public inspection, and stating all other matters requirejJ to be stated by law, and specifying the 23rd day of March, 1970 at o'clock P.M. on that day, as the time, and the Town Offices D>00 at 108 East Green Street in the City of Ithaca, New York as the place where the said Town Board would meet to consider said map. OUCOS& BARNEY rroRNinrs at Law NG9 BANK BUILDING CA« NEW YORK UBSO plan and report, and to hear all persons Interested in the subject thereof concerning the same, and to take such action thereon as is required or authorized by law, and WHEREAS such order was duly published and posted as required by law, and WHEREAS a hearing on said matter was duly held by said To\>m Board on this 23rd day of March, 1970, beginning at Si00 o'clock P.M. of the day at the Town Offices at 108 East Green Street in the City of Ithaca, New York, and full discussion of the matter having been had, and all persons desiring to be heard having been duly heard, NOW, upon the evidence given upon such hearing, and upon motion of Waltrr J, Schwan, Suprevisor ' seconded by Noel Desch, Councilman , it is RESOL^/ED AND DETERMINED: (a) That the notice of hearing was published and posted as required by law, and is otherwise sufficient. (b) That all property and property owners within the pro posed distribt extension are benefited thereby. (c) That all the property and propertv owners benefited are included v/ithin the limits of the proposed district extension. (d) That it is in the public interest to establish such sewer district extension. FURTHER RESOLVED AND DETERMINED that the establishment of a sewer district extension, as set forth in said map, plan and report, be approved; that the improvement therein mentioned be constructed, and the necessary easements and lands be acquired, upon the required funds being made available and provided for; and such district extension shall be known and designed as the Ellis Hollow Sewer District, Extension No. 1, in the Town of Ithaca, and shall be bounded and described as set forth in Schedule A which is annexed hereto and made a part hereof. -2- ^UCOS& BARNEY rORNCYS AT UAW ICS BANK BUILDING ;A, new YORK lAOSO It is intended to include all property within said boundaries# FURTHER RESOLVED that the method of financing the cost of said improvement is as follows: All the expenses of the establish ment of said district extension, including, without limitation, legal and engineering expenses incurred by the Town, and of con structing the improvements proposed therefor, and for the acquisi tion of any lands and rights of way, shall be borne entirely by the owners of the lands in the said district extension. All expenses and charges, including, without limitation, charges for the operation and maintenance of the improvements in said district extension, which may be properly chargeable to said district extension, shall be borne by local assessments upon the several lots and parcels of land in said district extension which the Town Board shall determine and specify to be especially benefited thereby in just proportions to the amount of benefits which the improvement shall confer upon the same. Without limiting the foregoing, the word "expense" shall be deemed to include all costs tin< expenses as defined by Section 202, paragraph 5, of the Town Law, FURTHER RESOLVED that this resolution is subject to a permissive referendum as provided in Section 209-e of the Town Law, The adoption of the foregoing resolution was duly put to a vote, and upon roll call, the votevas as follows: Walter J.
