MARCH 9, 1970
■Minutes of the Regular Monthly Meeting of the Town Board of Ithaca
held at the Town Offices, 108 E. Green St., Ithaca, New York on
March 9, 1970, commencing at 4:00 p.m.

RESOLUTION 544 - APPROVAL OF MINUTES
Motion was made by Supervisor Schwan and seconded by Councilman Deschthat the minuts of the meeting of the Town Board held on February I6,
1970, as -submitted by the clerk be approved.
Carried.

RESOLUTION 5^5 - APPROVAL OF WARRANTS
Motion was made by Councilman Desch and seconded by Supervisor Schwan,
that warrants^ dated March 9, 1970, as submitted to the Town Board
be approved for payment:

RESOLUTION 546 - RENEWAL OF BOND ANTICIPATION NOTES
A motion was made by Councilman Del Rosso and seconded by Councilman
Desch that the Board approve renewal of the following bond anticipation
note s *Ellis Hollow Road Sewer District $ 90,000.00East Ithaca Water District 44,000.00
South Hill Sewer District Note #1 300,000.00
South Hill Sewer District Ext.#! 106,000.00
South Hill Sewer District 130,000.00
2nd South Hill Water Ext. #1 58,000.00
2nd South Hill Water Ext. #2 13,000.00
2nd South Hill Water Note #2 210,000.00
and authorize the supervisor to execute such renewals and such

instruments as may he legally required to effect such renewals.

RESOLDTIOW 5^7 - ANTHONY PETITO, 1337 TRUMANSBURG ROAD
SEWER PERMIT = 26-4-32
VOTED RESOLVED that Anthony Petito's request for a sewer perm.it at
1137 Trum.ansburg Road be granted. (Subject to presentation of County
Board of Health's letter that advised Mr. Petito the house discharge
at this address must be corrected and tiat it was preferred discharge
be connected/directed into the sewage lift station of the Truraansburg
Road Sewer District.)
Carried.
Eastern Heights Request letter of Credit - Release
Eastern Heights request for release of letter of credit (60,000.00)
was discussed briefly. Action tabled.
RESOLUTION S'tS - EDWARD P. RILEY, 300 FOREST HOME DRIVE
RESIGNATION
Mr. Riley gave, and the Town Board accepted, his resignation as Town
Clerk effective May 1, 1970.
VOTED RESOLVED to accent Mr. Riley's resignation, effective May 1,
1970.
RESOLUTION 549 - ASSESSMENT BOARD
Supervisor Schwan made the motion, seconded by Councilm.an Desch, that
Walter Schwan, Supervisor, be appointed to the Assessment Review Board
pursuant to Section 305 (Sub. B) of the Tompkins County Charter and
Code.

RESOLUTION 550 - PROTEST LETTER
SEWER SERVICE CHARGES - 3 UNITS

Dear Sir:
The Town and County Tax bill for sewer service charges me for three
units. I am sure that you are aware of the present situation. As
of now, I am not benefited by the sewer district. The town does not
have a legal righ t to charge me for sewer services that are not
available to me.
If sewer services should become available to me, I would like to suggest
that a resolution be made to reduce the charge. Since I only have
one hundred feet of frontage, the charge should be reduced two units
or I would like the Town Board to show cause why it should stand as
it is.
Please keep in mind that any determination by the Town Bc^rd or its
respective officers is subjectto Court review, (end of letter)

Discussion of matter - very brief. Board explained that assessor's
charge was based on the three (3) units in existence at the above
address and that two (2) of these units are illegal.
Supervisor Schwan made the motion, seconded by Councilman Desch that
bills for two (2) units be refunded to Mr.• Franciamone after Mr.
Pranciamone pays his present bill.

RESOLUTION 551 ji ESTABLISHMENT OF EXTENSION OF ELLIS
HOLLOW ROAD SEWER DISTRICT
^ PUBLIC HEARING CANCELLED
VOTED RESOLVED that the public hearing be cancelled. Maps and plans
presented by Tompco failed to clearly represent boundaries.

RESOLUTION 552 - PUBLIC HEARING - ESTABLISHMENT OF
EXTENSION TO ELLIS HOLLOW SEWER EXT. #1
At a meeting of the Town Board of the Town of Ithaca, held at the
Town Offices in the City of Ithaca, Tonpkins County, New York, on •
the 9th day of March, 1970.

In the matter of the Establishment of Extension No. 1 to the Ellis
Hollow Road Sewer District in the Town of.Ithaca, County of Tompkins,
State of New York, pursuant to Article 12-A of the Town Law.
WHEREAS a map, plan and report have been prepared, in such manner and
in such detail as has heretofore been determined by the Town Board
of the Town of Ithaca, relating to the establishment of an extension
to the Ellis Hollow Road Sewer District in the Town of Ithaca,
Tompkins County, New York, which was established by Final Order of
the Town Board dated June 7, 19^5^ a copy of which was recorded in
the County Clerk's Office at Ithaca, New York on June 9j 19^5; and
WHEREAS such map, plan and report have been duly filed in the
Town Clerk's Office in said Town; and
WHEREAS said map, plan and report were prepared by John S. MacNeill, Jr
competent engineer, duly licensed by the State of New York, showing
the boundaries of the proposed district extension, and a general
plan of the sewer facilities to be constructed, and a report of the
proposed method of operation; and
WHEREAS said map shows all outlets and the terminus and course of
each proposed main sewer, together with the location and a general
description of all public works required, including such lands and
easements, if any, to be acquired; and
WHE??EAS the boundaries of the proposed district extension are more
particularly set forth and described hereinafter in Schedule A; and
WHEREAS the improvements proposed consist of the construction and
installation of sewer mains, sewer laterals, manholes and appurtenances
for the purpose of supplying a public sewer system to the properties
in the proposed district extension, and which system shall" be
connected with and drain into the City of Ithaca sewer system through
the facilities of the said Ellis Hollow Road Sewer District; and

WHEREAS the proposed method of financing the cost of said improvement
is as follows: The expenses of the establishment of said district
extension and of constructing the improvements proposed therefor^
and for the acquisition of any lands and rights-of-way, shall be
borne entirely by the owners of the lands in the said district
extension in such proportions and amounts as said owners amongst
themselves shall agree. All expenses and charges of the operation
and maintenance of the improvements in said district extension,
which may be properly chargeable to said district extension, shall
be borned by local assessments upon the several lots and parcels of
land in said district extension which the Town Board shall determine _
and specify to be especially benefited thereby in just proportions j
to the amount of benefits which the improvements shall confer upon |
the same; and
WHEREAS it is contemplated that the maximum amount proposed to be
expended for said improvement and for the acquisition of the necessary
lands and easements is $250,000.00 or thereabouts a portion of which
may include the expense of constructing sewer facilities jointly'with
owners of properties in the adjacent portion of Ellis Hollow Road
Sewer District.;
WHEREAS said map, plan and the report describing said improvements are
on file in the Town Clerk!s Office for public inspection, it is hereby
ORDERED that the Town Board of the Town of Ithaca shall meet and
hold a public hearing at I08 E. Green St., Town Offices, Town of
Ithaca, in the City of Ithaca, on the 23rd day of March 1970
at 5:00 o'clock P.M. on that day, to consider said map, plan and
report, and to hear all persons interested in the subject thereof
concerning the same, and to take such action thereon as is required
or authorized by law.
The adoption of the foregoing order was duly put to a vote, and
upon roil call, the vote was as follows:

The order was thereupon duly adopted.

Rocco Lucente Road Requirements specifications
Mr. Lucente presented his reasons for the Board to re-examine its
recent road acceptance requirements by Town of Ithaca.
1. Undue hardship on area developers
2. Addition $500.00 costs per house
3. High interest charged facing new buyers
4. Suggested Town not accept roads in fall - wait until spring
Supervisor Schwan and Board gave the following reasons for having
the requirements:
1. Highway can work on old highways needing repairs.
2. Eliminate highway department's need for more man
power and money
3. Roads under old requirements if accepted in fall were
unfit for use in spring.n The new regulations would
correct this problem.
No action, but Peter Francese, Planning Consultant, will research
this particular matter.

RESOLUTION 553 - STUDY LOZIERS - SOUTH HILL WATER
PEARSALL PUMP STATION
Councilman Desch made the motion^ seconded by Supervisor Schwan
that Tl^n approve engineering study with map to show%mprovements/
means and methods of improvements^ and suggest formula,for users
to establish report and cost estimates - bond schedule"- use formula.
Carried.

Peter Prancese stated he was preparing tp^present request for loan
to Farm Home Administration sometime this week, personally.

■; RESOLUTION 55^ - NORTHEAST DRAINAGE STUDY
Co'uhcilman Del Rosso made, the motion, seconded by Councilman Desch,
that new study to consider new drainage. Plan for Northeast area.
Carried.

RESOLUTION 555 - BOARD MEETING - MARCH 23, 1970
The Board will meet again on March 23j 1970 at 5iOO o'clock P.M.
