Minutes of the Regular Monthly Meeting of the Town Board of Ithaca
held at the Town Offices, 108 E. Green St., Ithaca, New York, on

RESOLUTION 528 - APPROVAL OF MINUTES
Motion was made by Council man Desch and seconded by Councilman McElwee
that the minutes of the meeting of theTown Board held on January 12,^
1970^ SIS submitted by thee clerk be approved. An all "aye" vote carried.

RESOLUTION 529 - APPROVAL OF WARRANTS
Motion was made by Councilman McElwee and seconded by Councilman Desch,
that warrants dated February l6, 1970, as submitted to the Town Board
be approved for payment:

RESOLUTION 530 - WILLIAM FRANDSEN TAX PROTEST
Supervisor Schwan explained Mr. William Frandsen's protest letter (sewer
tax $1,107.29) and Town's inability to obtain water for the property.
(Letter is on file.) Board discussed the matter and thought it an
unfair assessment.
Supervisor Schwan made the motion, seconded by Councilman Desch, that
$1,107.29 less $1.00 be refunded to William Frandsen on plat 56-3-13
(34 acres) at 15^6-50 Slaterville Road.

RESOLUTION 531 - EASTERN HEIGHTS ASSN. PARK AND GREEN AREAS
Request Town accept two (2) acres of land set aside by Eastern Heights
Association for park area with Town grade and grass area, carry the
liability insurance and flail mow area two or three times per year.
Association members would help when possible.
Discussion - No decision on request made. Councilmsin Del Rosso pushed
for Board to set a policy for acceptance of areas. "The matter should be
tabled until ground rules are laid out." "Set a policy, that's all
I'm asking for." "Treat everyone alike," "Let Peter (Planning
Consultant) look into it and lay the groundwork—now." he advised.
Councilman Del Rosso made the motion, seconded by Councilman Desch,
that Mr. Francese plan and propose a policy for the Town to adopt and
use in determination of acceptance/rejection of offered areas. Report
in April.

South Hill Sewer and Water District
Anxious and concerned taxpayers from the South Hill Sewer/Water District
appeared in a body. At about 4:30 p.m. the Board Room was "standing room"
only.
Supervisor Schwan advised those present that an application was being
prepared for submission to the Farm Home Administration requesting a
loan for the sewer/water district at 5^ over a period of forty years.
This would not greatly reduce the taxpayers present burden, if the loan
can be negotiated.
Supervisor Schwan explained how a public hearing could be called to dis
solve the district and call for a referendum asking the district to pay
75^ and the Town to pay 25^ of the indebtedness. The supervisor thought
such a method would be unsuccessful since Weat Hill has no water and sewer
services and Eastern Heights is at present a higher unit cost.
U.S. Congressman, Howard Robison, has been contacted and no further
advice other than what Board knows at present has been offered. The
congresman is also interested in seeking a solution.
Mr. Sam Peters and Alexander Meek will try to form a committee composed
of owners of large acreage and average home owners to consider changing
present unit formula charges, and bring their findings to the attention
of the Board.
Eastern Heights Association Water/Sewer Assessment Errors

Explanation wanted for apparent errors in water/sewer assessment.
Statement of Eastern Heights association:
1. Water/Sewer District calls for additional unit per apartment.
Some overlooked.
2. Water budget increase of 50% over 1969.
3. Sewer units decrease from 493*2 in 1979 "to 492.9 in 1970
Detailed explanation requested. (Written) Board discussed and explained
to Association that (1) no change in present assessment roll (2) Super
visor Schwan will reply as soon as reasonably possible after discussion
with assessor.

RESOLUTION 532 - SECOND SOUTH HILL WATER DISTRICT EXT. #1
H. F. CARY & SONS
Lozier engineers recommended payment of H F Cary & Sons, since
contract was fully completed in fall of I968.
Council McElwee made the motion, seconded by Councilman Desch that
the total retained amount ($4,5o0.70) as of January 26, 1970 be paid
in full.
Carried.

RESOLUTION 53^ - SOUTH HILL SEWER, ITHACA COLLEGE, 41-1-24
Tax map incorrect - was billed for 10 units - should be 8.9 units.
Councilman McElwee made the motion, seconded by Councilman Desch,
that excess tax of $90.86 on 1.1 units, be refunded.

RESOLUTION 535 - COUNTY SEWER AGENCY
Supervisor Schwan made the motion, seconded by Councilman McElwee,
that Noel Desch be Town of Ithaca Representative to County Sewer
Agency.
Carried.

Protest Letter - improper assessment - wants refund - Board discussed
the matter and took no action. Will talk with assessor. No basis
for refund - has plenty of access to land.

Eastern Heights Snyder Hill Rd.
Water District
Eastern Heights requests release from indemnity agreement with Town
of Ithaca. Further reduction in charges in event Tompco utilizes
water district.
No action. Councilman McElwee requested Town Clerk to check the
1967 minutes for resolution concerning agreement.

RESOLUTION 536 - HOLIDAYS, VACATIONS, SICK LEAVE, HOURS
Councilman McElwee made the motion, seconded by Councilman Desch,
that thw Town Office be open from 9iOO o'clock A.M. to 5iOO o'clock
P.M., except on the following holidays: Memorial Day, the Fourth
of July> Labor Day, Thanksgiving, Christmas and New Years Day.

After 2 years 2 weeks
Sick leave - 1 day a month - 12 days a year. No accumulation.

RESOLUTION 537 - NORTHEAST SEWER, PURCHASE OF ADDITION TO
NORTHEAST SEWER
Short discussion of purchase - Councilman McElwee wanted better
terms. Councilman Del Rosso made the motion, seconded by Councilman
Desch, that the Town (Northeast Sewer District) purchase fron Cornell
University/Tompkins County/Otto Schoenfeld, the addition to the
Northeast Sewer line for $26,603.00 plus interest at 3.5^ compounded
annually from August 1, 19^7 to February 15^ 1970 for a total amount
of $29,039.26.
A vote was taken with the following votes cast;

RESOLUTION 538 - ROAD SPECIFICATIONS FOR TOWN ACCEPTANCE
Supervisor Schwan proposed subdivision roads be surfaced with oil
and stone in addition to present requirements of I8 inch gravel
top road. Thus eliminating disintegration during fall and winter
months and thus permitting Highway Department to blacktop in spring
with minimum difficulty. Rocco Lucente thought it would add higher
costs to already high construction and discourage many developers
who would build elsewhere.
Councilman McElwee objects reasoning that now is the time for
Board to encourage developers to build. Not create added costs,
and especially encourage developers in South Hill area, to help
reduce costs of the South Hill Sewer/Water districts.
Supervisor Schwan made the motion, seconded by Councilman Desch,
^ that the Town adopt the following road sepcifications:
' 1. .3 gallons per square yard of primer on the gravel base.

2. \^en cured app. 50 lbs. #1 or #2 stone, per square yard,
leveled with broom or drag, penetrated with .7 gal. per
square yard of asphalt (MC35 70b, 66d)
3. Sealed with app. 20 lbs. #1A stone and compact.

RESOLUTION 539 - ROCCO LUCENTE,
MAPLEWOOD DRIVE, PINEWOOD PLACE
VOTED RESOLVED to accept Maplewood Drive and Pinewood Place - with
stipulation that street markers be erected.

In the matter of the establishment of Extension No. 1 to the Ellis
Hollow Road Sewer District in the Town of Ithaca, County of Tompkins,
State of New York, pursuant to Article 12-A of the Town Law.
WHEREAS a map, plan and report have been prepared, in such manner
and in such detail as has heretofore been determined by the Town
Board of the Town of Ithaca, relating to the establishment of an
extension to the Ellis Hollow Road Sewer District in the Town of
Ithaca, Tompkins County, New York, which was established by Final
Order of the Town Board dated June J, 19^5^ a copy of which was
recorded in the County Clerk's Office at Ithaca, New York, on
June 9> 1965; and
WHEREAS such map, plan and report have been duly filed in the Town
Clerk's Office in said Town; and
WHEREAS said map, plan and report prepared by John S. MacNeill, Jr.
competent engineer, duly licensed by the State of New York, showing
the boundaries of the proposed district extension, and a general
plan of the sewer facilities to be constructed, and a report of
"the proposed method of operation; and
WHEREAS said map shows all outlets and the terminus and course of
each proposed main sewer, together with the location and a general
'description of all public works required, including such lands and
easements, if any, to be acquired; and
WHEREAS the boundaries of the proposed district extension are more
particularly set forth and described hereinafter in Schedule A; and
WHEREAS the improvements proposed consist of the construction
and installation of sewer mains, sewer laterals,manholes and
appurtenances for the purpose of supplying a public sewer system to
the properties in the proposed district extension, and which system
shall be connected with and drain into the City of Ithaca sewer
system through the facilities of the said Ellis Hollow Road Sewer
District; and
WHEREAS the proposed method of financing the cost of said improve
ment is as follows: the expenses of the establishment of said
district extension and of constructing the improvements proposed
therefor, and for the acquisition of any lands and rights-of-way,
shall be borne entirely by the owners of the lands in the said
district extension in such proportions and amounts as said owners
amongst themselves shall agree. All expenses and charges for the
operation and maintenance of the improvements in said district
extension, which may be properly chargeable to said district extension
shall be borne by local assessments upon the several lots and parcels
of land in said district extneion which the Town Board shall determine
and specify to be especially benefited thereby in just proportions to
the amount of benefits which the improvement shall confer upon the
same; and
WHEREAS it is contemplated that the maximum amount proposed to be
expended for said improvement and for the acquisition of the
necessary lands and easements is $250,000.00 or thereabouts a portion
of which may include the expense of constructing sewer facilities
jointy with owners of properties in the adjacent portion of Ellis
Hollow Road Saewer District.
WHEREAS said map, plan and the report describing said improvements
are on file in the Town Clerk's Office for public inspection, it
is hereby
ORDERED that the Town Board of the Town of Ithaca shall meet and
hold a public hearing at 108 E. Green St., Town Offices, Town of
Ithaca, in the City of Ithaca, on the 9'th day of March 1970 at 4:00
o'clock P.M. on that day, to consider said map, plan and report, and
to hear all persons interested in the subject thereof concerning the
same, and to take such action thereon as is required or authorized
by law.

The adoption of the foregoing order was duly put to a vote, and
upon roll call, the vote was as follows:

RESOLUTION 5^1 - BOCES - JUNIOR HIGH
^ NORTHEAST DRAINAGE AREA
VOTED RESOLVED to authorize Lozier Engineers to prepare preliminary
plan and cost estimates for storm sewer that would start on Warren
Road near BOCES Center, south to Winthrop Drive, west crossing
Northeast School property to Brandywine to ditch between Simsbury
and Christopher Land in order to greatly reduce run-off drainage
problems in this area.

Councilman McElwee and Councilman Desch appointed by Supervisor to
study and advise on proposal of a policy for Town's inspection of
water/Sewer lines - advisibility of inspector - consideration of
Escrow accounts established on engineers reports.

RESOLUTION 5^2 - EXTENSION OF WATER LINES THROUGH LANDS
OF CORNELL AND LANDS TO BE ACQUIRED BY
TOMPCO BETTER HOUSING
WHEREAS a certain parcel of land of about 50 acres owned by Cornell
University, a part of which is to be acquired by Tompco Better Housing,
Inc., and is shown on the survey map entitled "Parcel of Land to be
Conveyed by Cornell University to Tompco Better Housing, Inc."
R. L. McDowell, Jr., Licensed Surveyor, dated December 1969?
filed in the Town Clerk's Office, and also certain lands formerly
owned by Barnes, now reputedly of Kenilworth, Inc., and/or Grof
Associates, bounded on the east by the said 50-acre Cornell Parcel,
on the south by Ellis Hollow Road, and on the west by Judd Falls Road,
are all located in the East Ithaca Water District heretofore duly
established by the Town of Ithaca, and
WHEREAS Tompco Better Housing, Inc. plans to construct lateral water
mains and appurtenant facilities in the streets, adjacent highways
and easements acquired for that purpose within its said lands and
on adjacent lands on the west and the said owners of the said adjacent
lands also plan to construct water mains and appurtenant facilities
as aforesaid within their said lands, all of which construction and
any proceedings therefor shall be done at the sole expense of the
owners of said lands including the reimbursement to the Town of any
reasonable expenses incurred by the Town in connection with said
construction and proceedings.
The Town Board hereby expresses its intention to permit the connection
of such water mains with existing facilities of the East Ithaca Water
District subject to the following provisions and conditions; The
said facilities shall be constructed in accordance with the require
ments of the Town and the City of Ithaca, and any applicable
provisions of the Town Law or other laws and regulations and provided
the consents of all municipalities concerned to furnish water shall
be obtained and title to said facilities, including the rights granted
under any easements for said facilities will be forthwith conveyed

to the Town if and when the Town requests. All operation^ maintenance
and other charges and expenses will be apportioned and assessed among
the several parcels of land deemed benefited, in proportion to the
amount of the benefit conferred upon said parcels by said improvements

Matter discussed and promptly referred to Lozier for Dunlop to
evaluate basis for charging units. Where no pipe for part of
frontage, is the whole part sewable or not? Councilman Desch will
contact Mr. Misek.

Action was tabled on advice of Mr. Buyoucos. Problems concerning
rights-of-way, area residents, traffic and vuture use/value of
road to Town must be considered.
