He helped in molding, the fresh faces stepping into the new scenes and challenges of 1970. A walking encyclopedia of Town affairs, there was always time for those who weuited to learn. Let's not forget our library and how hard he worked to make it pos sible. He loved his work and the public that had so much confidence in his abilities. Schwan, Supervisor. n RESOLUTION 515 - APPROVAL OF MINUTES Motion was made by Councilman Desch that the minutes of the meeting December 3I3 19^9 record the fact that Councilman McElwee was in attendance, and then be approved as submitted bj^ the Town Clerk. Councilman McElwee seconded the motion. Carried. * * RESOLUTION 5l6 - APPROVAL OF WARRANTS Supervisor Schwan questioned the one South Hill Sewer bill in- volving costs. Councilman McElwee also questioned, but thought it should be paid. Councilman Desch made the motion, seconded by Councilman Del Rosso, that the warrants dated January 12, 1970 in the following amounts be approved: General $172,775.30 Highway 7,832.88 East Ithaca Water District 425.00 2nd South Hill Water District "^ 4,500.00 2nd South Hill W. Councilman McElwee made the motion, seconded by Councilman Desch, that attorney Barney take legal action to require Lucente to rip out extra kitchens and reduce electric meters in each house from present number to (2) two in the Sapsucker Woods apartment complex. Carried. RESOLUTION 518 - SNOW PLOWING NORTHEAST WALKWAY WINTHROP DRIVE SIDEWALK Councilman McElwee made the motion, seconded by Coucnilman Desch, that Supervisor Schwan be authorised to contract with either School District or Cayuga Heights Village, for provision of snow plowing services for Northeast walkway and Winthrop Drive sidewalk. RESOLUTION 519 - SOUTH HILL SEWER ANDWATER REFUND OF TAX""BILLS Supervisor Schwan explained that some South Hill residents were not yet included in the services provided, yet they were being taxed. Barney to search for owner of land on which water tank sits. n ** RESOLUTION 520 -AGREEMENT FOR NORTHVIEW/DANBY ROAD SPRUCEWAY James Dunlop, Lozier Engineer, advised Board it would be wise to accept this offer and that tt was a substantially low price for the work involved. Board discussed acceptance. Councilman McElwee made the motion, seconded by Councilman Del Rosso, that Marcelletti be authorized to do finish-work At firm price of $25,000.00. Carried. RESOLUTION 521 - FOREST HOME LIGHTING DISTRICT CONTRACT AUTHORIZATION VOTED RESOLVED that the written contract submitted by the New York State Electric & Gas Corporation for Lighting the streets and public places of District of Forest Home, Town of Ithaca, dated November 3, 1970, be, and the same hereby is, approved^ and a maoority of the members elected to this Board be, and they hereby are authorized and directed to execute the same in the name and in behalf of the Town of Ithaca. Carried. * f. : !'■ I I" RESOLUTION 522 - SOUTH HILL SEWER LEGAL ACTION $125>OQO»OQ Discussed having attorney other than James Buyoucos prosecute the matter, pending further investigation. * * RESOLUTION 523 - PUBLIC HEARING ^ TOMPCOn R-30' to R-15 ' ! Town Clerk submitted proof that the notice of meeting was posted on the Town bulletin board and published in the Ithaca Journal at least ten days before the public hearing and that notice of the meeting was duly mailed to all persons as required by Sec tion 264 of the Town Law as appears by the affidavit of Thomas Heiden verified the 8th day of January, 1970. Proof of notice having been presented, the public hearing was call ed to order by Walter J. Schwan, Supervisor. Hearing ls,sted about an hour with main concern centered on planned five(5) acre public green and responsibility of keeping it presentable. Peter Prancese explained that any Town work on green(if it became necessary)would be charged against the tax bills of these sub division residents. This protection would be legally provided for the Tompco contracts when purchasers seek to buy these homes. Supervisor ■ Schwan terminated the meeting at 6:00 P.M. U The following resolution was offered by Councilman McElwee, who moved its adoption, and was seconded by Councilman Desch, that the said lands be changed from an R-30 zone to an R-15 zone. A vote was taken with the following votes cast: Supervisor Schwan aye Councilman McElwee aye Councilman Desch aye Councilman Del Rosso aye A certified copy of the resolution is attached hereto: -K- * • RESOLUTION 524 - SOUTH HILL WATER/SEWER Town Office was crowded with people at 4:00 P.M. when Supervisor Schwan opened the meeting. He adjourned to the City Council Room. People of the district were surprised and distressed about their water/sewer assessments and wanted relief. Supervisor Schwan explained that the parent water district estimate was $270,000. and the parent sewer district estimate $840,000. Bids were taken on water district extensions, but none received on parent water district. Cost was upped to $480,000. and work at that price commenced. Rock removal costs were more than expected. Result - $1,800,000. There were about one hundred people attend ing and all had the sympath;^ of the Board. Supervisor Schwan summed up his explanation emphasizing the fact that Water/Sewer lines are built and the money borrowed. "We will investigate all alternatives to help, but the tax bills have to be paid as rendered. I.am sorry." Councilman Del Rosso made the motion, seconded by Councilman Desch, that Supervisor Schwan investigate advisability and possibilities of having another lawyer , engineer or competant authority evaluate the legal aspects of the contract and the discharge of same. All board members to explore any feasible ideas that might relieve the situation. Directi9n Town is going, 2nd South Hill Water or its extensions. 3. Pearsal Place Pumping Station can no longer take the load. (Schwan) | 4. Town cannot risk mandateing this increase ' ' (150,000 to 200,000) 5. College expanding. Town expanding, industry not expanding. 6. Ithaca College 1967(12 months, used 50^ of water - 100,000,000 gallons.) 7. Pumps not adequately handling it. 8. (Hannan)should have 200 gallons per minute, whole expenditure has to be made to accomplish any benefit. 9. (Hannan) Critical - All pump stations over-loaded two or three hot days would suck all water out of Danby, Pearsal Pumping Station. If pumped dry, N.C.R. would have no water. Also dangerous in event of fires. College will review problem and return with proposal for sharing cost, and any recommenda tions they feel in order. Further discussion soon. Carried RESOLUTION 526 JUSTICE OF THE PEACE WARREN A. BLYE 25§_W^REN-.R2A5 Supervisor Schwan made the motion, seconded by Councilman TDeschp'^ that Warren A. Blye be appointed Justice of the Peace. Carried. RESOLUTION 527 FARMERS ^HOME^ADMIlgSTO^ APPLiCATION Discussion-- Application to Farmers Home Administration for $1,800,000.00 10an at 5^. Bond sale. Need for Mr. Franchese to have two (2) weeks to study and prepare necessary papers. Unstable bond market—West Hill— Possibilities. Councilman Desch made the motion, seconded by Councilman McElwee, that Supervisor Schwan be hereby authorized to apply and execute such instruments as may be legally required in obtaining a loan from the Farmers Home Administration for $1,000,000.00. Carried. RESOLUTION 528 ANNUAL REPORT Councilman Desch made the motion, seconded by Councilman Mc Elwee that Supervisor Schwan be allowed to use Amnual Report to Audit sand Control for Town Annual Report.
