December 31, 1969, in the Town of Ithaca Offices at I08 E. Green Street, Ithaca, New York. PRESENT: William B. Kerr, Supervisor Noel Desch, Councilman Victor Del Rosso, Councilman ABSENT: Harry U. Baker, Councilman n ALSO PRESENT: Walter Schwan, Planning Board Chairman James Buyoucos, Attorney for the Town Marion Morey, Sup't of Highways WHCUl & WTKO Representatives Peter Francese Thomas Mills and Mrs. Mills Donald Franklin, Assessor Paul Tavelli, Justice oil the Peace Dale Lashnits, Ithaca Journal David Cowan, Zoning Officer The meeting was called to order by William B. Kerr, Supervisor. * * RESOLUTION 497 - APPROVAL OF MINUTES Motion was made by Coundilman Desch and seconded by Councilman McElwee, that the minutes of the meeting of the Town Board held on December 8, I969 as submitted to the Board be approved. Carried. * * ^ 7! RESOLUTION 498 - APPROVAL OF WARRANTS ' " Motion was made by Councilman Del Rosso and seconded by Councilman McElwee, that warrants dated December 31j 19^9 as submitted to the Board be approved for payment. Carried. * * Savey Construction Company Complaint by Thomas Mills 108 Pineview Terrace Pineview Terrace and Hickory Lane - Roads did not meet Town stan dards. Town has deed but did not accept roads. Letter to be written to Mr;„Russel Savey to advise that Town will not issue, him any additional building permits until roads meet Town requirements. * * n RESOLUTION 500 - RESIGNATION OF JUSTICE OF PEACE PAUL TAVELLI Supervisor Kerr read letter of Justice of Peace, Paul Tavelli, asking Town to accept his resignation effective December 31, 19^9 or as soon thereafter as conveniently possible. VOTED RESOLVED to accept this resignation. * * RESOLUTION 499 - IVAN C. BURRIS REFUND $100.00 Motion was made by Supervisor Kerr and seconded by Councilman Del Rosso, that since work was completed at 203 Blackstone Ave., Ithaca, New York, Mr. Burris would be refunded $100.00. Carried. n 1 RESOLUTION 501 - DEPOSITORIES FOR OFFICIAL FUNDS Motion was made by Supervisor Kerr and seconded by Councilman McElwee, tha the Tompkins County>Trust Company be and the same hereby is designated as depository for all moneys com.ing into the hands of the Supervisor and the Town Clerk of the Town of Ithaca, County of Tompkins and.-: BE XT FURTHER RESOLVED that the First National Bank and Trust Co. of Ithaca be and the same is designated for all moneys coming in to the hands of the Receiver of Taxes for the Town of Ithaca, County of Tompkins. RESOLVED that this designation shall continue in effect until re voked by action of said Town Board. RESOLUTION 502 - TRANSFER OF FUNDS Supervisor Kerr moved that approval for the transfer of $3000.00 from the contingency account #10,000 to: Town Hall and Office $1,166.09 Insurance Account 1,712.71 Annual Audit 25,00 Attorney Account 96.00 Councilman McElwee seconded the motion and an all "aye" vote carried. * * RESOIUTION 503 - SUPERVISOR'S RECORDS - AUDIT Motion was made by Councilman McElwee and seconded by Supervisor Kerr that certified Public Accountants, Maxfield, Randolph and Carpenter be engaged to audit the account books and records of the Town of Ithaca Supervisor for the year I969. Carried. RESOLUTION 504 - OFFICIAL NEHSPAPER Supervisor Kerr made the motion, seconded by Councilman McElwee, that the Ithaca Journal be designated as the official newspaper for the Town for the year 1970. Carried. * * RESOLUTION 505 - OFFICIAL MEETING DATES FOR 1970 Supervisor Kerr moved that the Town Board meetings be held the first Monday after the first Tuesday of each month except as the Town Board shall otherwise authorize. The motion was seconded by Councilman McElwee. Carried. * * RESOLUTION 506 - APPROVAL OP OFFICIAL BONDS VOTED RESOLVED to approve the bonds for the following officials: Supervisor Walter Schwan $100,000. Town Clerk, Edward P. Riley 50,000. Justice Fred Hartsock 4,000. Highway Sup't., Marion Morey 4,000. * * RESOLUTION 508 - TOWN CLERK SALARY Councilman McElvjee made the motion, seconded by Councilman Del Rosso, that the Town Clerk's salary be raised to $8,000.00. Carried. * * RESOLUTION 509 - PLANNING BOARD APPOINTMENTS Discussion of appointments - Selection. Councilman Del Rossomade the motion, seconded by Councilmaji Desch that; j | (1) Robert Christiansen 1212 Trumansburg Road Ithaca, New York (2) Fredric Scott 246 Sapsucker Woods Road Ithaca, New York (3) Barbara Holcomb l4l Northview Road Ithaca, New York be appointed to the Planning Board, effective January 1, 1970. Carried. * * RESOLUTION 510 - PETER FRANCESE TOWN PLANNING CONSULTANT Discussion of fees - duties - first needs - properties - aims - ^ reports to the Board - revision of zoning laws - Councilman McElwee made the motion, seconded by Councilman Desch, that Peter Francese be appointed Town Planning Consultant at $1250.00 a month. Carried. f * * South Hill Sewer Rock. Costs No action. Councilman McElwee explained "There is incomplete infor mation." Original line - where it was put in. Law suit. James Buyoucos should not represent the Town. Snyder Hill Road Water district Ext. #1 Frandsen property - Supervisor Kerr stated, "He(Frandsen)has been very good about it. The Board feels that Frandsen must be included. Board is hopeful. * * RESOLUTION 511 - CATHERINE GAPPHEY M DEPTUY CLMK I 1 Supervisor Kerr discussed raising Deputy Clerk's salary. Motion was made by Councilman McElwee and seconded by Councilman Del Rosso, that Miss Gaffney's salary be raised to $80.00 per week. Carried. * * 121" RESOLUTION 512 - HIGHWAY SCALE Supervisor Kerr made the motion, seconded by Councilman McElwee that highway scale be Raised 10^ per man and work week reduced from 44 hour week to 4o hour week. Carried. RESOLUTION 513 - JUSTICE OF THE PEACE ! i Supervisor Kerr made the motion- seconded by Councilman Del Rosso, that salary of resigning Justice of the Peace, be prorated and paid to Justice of the Peace, KFred Hartsock, until a new appointment is ^ made. Carried. * * RESOLUTION 51^ - PUBLIC HEARING TOMPCO Motion was made by Councilman McElwee and seconded by Supervisor Kerr, that: WHEREAS, TOMPCO BETTER HOUSING, INC. has petitioned the Town Board for a change in 2one from Residence DLitrict R-30 to Residence District R15 for the following described area being ac quired by TOMPCO BETTER HOUSING, INC. from Cornell Niversity and for approval of the developmiant of said site with variable lot sizes as an average density, planned unit development, the said area be ing approximately described as follows: Being a parcel of about 50 acres of land on the north side of Ellis Hollow Road as shown !*l on the survey prepared for the Cornell University Department of ! Buildings and Properties by R. L. MacDowell Jr. dated December 5> ' 1969^ and substantially described as follows: Beginning in the center line of Ellis Hollow Road about 615 feet easterly from lands formerly of Barnes; thence northerly 230 feet; thence westerly 601.75 feet(the preceding two courses running along lands of Cornell University); thence northerly along lands formerly of Barnes later of Groff Associates, 1097.84 feet; thence along lands of Cornell University easterly 201.54 feet and southeasterly 2118.29 feet and southerly 1199.50 feet to the cnnter line of Ellis Hol low Road; thence westerly along the center line of Ellis Hollow Road 835.88 feet to the point or place of beginning. NOW, THERFORE., BE IT RESOLVED that a public hearing be held at the Town Offices on January 12, 1970 at 5:00 P.M. to consider the above matters and the advisibility of amending the zoning ordinance, and the Town Clerk is hereby directed to take such steps as may be required to hold said public hearing. Carried. * * Therm Electric Therm Request Hudson Street Ext. Thorough discusssion. Board extrememly sympathetic, but cannot convey this road to Therm at present time. Examination of right- of-way for water/sewer lines, plus pedestrian/vehicle traffic of residents in area will be necessary in considering the matter. (Letter to Therm Electric). The Board wished to express its gratitude and appreciation for the fine services received from retiring Justice of the Peace, Paul N. Tavelli, Pheobe Bartholomew, Bookkeeper and last but not least, out-going Supervisor, William B. Kerr. There were literally hundreds of townspeople who, knowingly, or not, were touched by this man. Bill had a deep interest in, and love for politics. He helped in molding, the fresh faces stepping into the new scenes and challenges of 1970. A walking encyclopedia of Town affairs, there was always time for those who wanted to learn, Let's not forget our library and how hard he worked to make it pos sible. He loved his work and the public that had so much confidence in his abilities. We sincerely wish them all continued success. * * RESOLUTION 50? - BOARD AUDIT OP OFFICIAL RECORDS Voted Resolved that the following sudits were made and approved by the members of the Town of Ithaca Board.
