Minutes of the Regular Monthly Meeting of the Town Board of
Ithaca held November 6, 19^9 ^.t the Town Offices, 108 East
Green Street, Ithaca, New York commencing at 4:00 o*clock P.M,

The meeting was called to order by William B. Kerr, Supervisor.

RESOLUTION 466 - AgPROVAL OF MINUTES
Motion was made by Councilman McElwee and seconded by Supervisor
Kerr that the Board approve the Clerk's request for the
following insertions:
A. Amendment - Resolution 46l - Northerly spur of
Indian Creek Road to be called Happy Lane.
B. Inclusion - of following Resoluiton 465 which
had been inadvertantly ommitted
RESOLUTION 465 - OTTO SCHOENFELD
LEGRANDE CHASE
Councilman Desch made the motion seconded by Councilman McElwee
that Suspension for obtaining Building Permits(See Resolution
429)for Otto Schoenfeld and Legrand Chase, be rescinded and they
be so notified of this action.
Effective October 6, 19^9
Carried.
And the minutes of the meeting of the Town Board as submitted
by the Town Clerk be approved.
Carried.
RESOLUTION 46? - APPROVAL OF WARRANTS
Motion was made by Councilman McElwee and seconded by Supervisor
Kerr that Warrants dated November 6, I969 as submitted to the
Board be approved for payment of the following amounts:

PERSONS WISHING TO BE HEARD
Mrs. Libby deProsse
Mrs. deProsse readand issued to those present a statement of
the League df Women Voters of Tompkins County urging the Town
to increase its appropriations for recreation. It explained
that Town is presently using, extensively, therecreation pro
grams sponsored by the City, and that Towns should now start to
acquire natural areas and provide facilities.
The letter is on file.

RESOLUTION 468 - ANTHONY LEONARDO
DANBY ROAU
Supervisor Kerr explained that the Sewer line installed by the
Town passes within 30 to 4o feet of the houses adjoining the
Leonardo property but i6 over I85 feet from the rear of his
property. Board deliberated and decided Mr. Leonardo should be
granted some cost relief. Councilman McElwee made the motion
seconded by Councilman Desch that the Town pay for 125 feet -
house to connection.
Carried.
RESOLUTION 469 - VINCENT FRANCIAMONE
Mr. Pranciamone spoke in regard to water and sewer services for
his property. The Board listened respectfully and then explain
ed to Mr. Pranciamone about the following ordinance violations.
1. Converted breezeway to living quarters(Illegal)
2. Garage became an apartment(Illegal)
3. Present accessory Building(ship)is illegal.
4. This accessory Building(3)appears to be another
apartment. (Illegal)
Mrs. Pranciamone interupted the discussion at this point, whereat
Councilman McElwee assured him and remarked that "We wish to
keep you lawful, which becomes difficult." The Board deliberated.
Councilman McElwee then made the motion seconded by Councilman
Desch that the Zoning Officer, David Cowan, inspect the premises
for illegal water and sewer appendages and that construction
should show arrangements provide only for the original basic
building. No sewer - No water permits(othere than those issued to
plat - and only as described.)
Carried.
RESOLUTION 470 - PRANCIAMONE ^
CITY SEWERBILL ^
Motion was made by Supervisor Keer and seconded by Councilman
Desch that Bill for $52.18 be presented by City of Ithaca for
disconnecting the sewer services at the Pranciamone residence
be paid.
Carried.

RESOLUTION 471 - PRELIMINARY BUDGET
Proof of Notice having been presented the Public Hearing was
called to order at 4:30 P.M. by William B. Kerr, Supervisor.

Mrs, Beverly Livesay then asked the Board to consider an increase in
Recreation expenditures, as the Town children were enjoying the
benefits of participation in City programs. She advised the
Board to consider results if these programs become unavailable
to those outside the City who did no help to adequately subsi
dize such activities. The Board agreed and decided that a
study of the situation was needed to help in properly evaluating
the situation before taking action.

No other persons presented themselves to be heard and Supervisor
Kerr terminated the Hearing at 4:45 P.M.

Supervisor Kerr then made the motion seconded by Councilman Desch
that the Town Board of Ithaca adopt the Preliminary Budget as the
Annual Budget for the fiscal year beginning January 1, 1970 and
SE IT FURTHER RESOLVED that the Town Clerk of this Town shall
prepare and certify duplicate copies of the Annual Budget adopted
pursuant to Section 202-a of the Town Law, and deliver one copy
to the Supervisor of the Town to be presented by him to the Board
of Supervisors of Tompkins County.
Carried.
At this time Supervisor Kerr asked the Press to take note that
the $135000,00 increase would have no consequential effect on
Town of Ithaca Tax rate. "The net effect of this is that for
the first time in many years the General Fund has no taxes. This
is because the per capita revenues balance the General Fund ap
propriations, Since Village funds are excluded, there is no
tax for Cayuga Heights residents to the Town for 1970, and the
tax consequently is literally nothing.
RESOLUTION 472 - VILLAGE FIRE CONTRACT
Proof of Notice having been presented, the Public hearing was
called to order at 4:45 P.M. No persons desiring to be heard
presented themselves and Supervisor Kerr terminated the Hearing
at 4:47 PaM. Supervisor Kerr made themotion seconded by Council
man Baker that the contract with the Village of Cayuga Heights
and the Town of Ithaca, whereby the Village agrees to furnish
fire protection for the year 1970 to the Hamlet of Forest Home
and that portion of the Town to the north of Forest Home and
between the east boundary of the Village ofChyuga Heights and
the east boundary of the Town of Ithaca for the contract price
of $6500.00.

RESOLUTION 473 - CITY OF ITHACA
FIRE CONTRACT
Proof of Notice having been presented the Public Hearing was
called to order at 4:50 P.M. No persons desiring to be heard
presented themselves so Supervisor Kerr declared the Hearing
closed at 4:52 P.M.

RESOLUTION 475 - BOOKKEEPER APPOINTMENT

Supervisor Kerr made the motion seconded by Councilman Baker that
the Board appoint Patricia Post as Bookkeeper, effective November
17, 1969. This will enable her to work with the present
bookkeeper, Mrs. Bartholomew, until about the first of the year.
Salary - $5200.00

Board(in near future)will ask for a reversal of the City's re
fusal to include the Frandsen property in this district.

Old Business Gruenfeld Claim
219 Tareyton Ro'ad
Councilman McElwee and Baker reported on the claim and advised
against a settlement. Findings were as follows:
1. No work had been done since release was signed by
Gruenfeld.
2. Tenants at property(Gruenfeld's in Europe)thought
house was perfectly all right.
Board agreed and no action was taken.

RESOLUTION 478 - CHANGE HIGHWAY VOUCHER TOTAL
Supervisor Kerr made the motion seconded by Councilman McElwee
that Highway Voucher total be changed from $14,382.91
to 14,309.25
Check #4605 for $73.65 voided(previously paid) - $73.65

Inventory of Highway Machinery Tools and
Equipment
Pursuant to Highway Law, Section l42 (3)^ Sup't of Highways,
Marion Moray's inventory of Highway machinery, tools and equip
ment , accepted as presented, September 8, I909 is on file with
the Town Board at the Town Offices, 108 East Green St., Ithaca,
New York.

RESOLUTION 479 - DIVISION FOR YOUTH
RECREATION BROJECT
Supervisor Kerr made the motion seconded by Councilman McElwee
that the New York State Youth Recreation Project applicationi'£or
$1000.00 be approved and Supervisor Kerr be authorized to sign
an agreement with the City of Ithaca for the operation of the
Ithaca Youth Bureau during the year 1970.

Van Epps* Permit Violation? David Cowan''
Zoning Officer
1. No violation of a permit since none was ever issued.
2. Three general areas of sand and gravel bank operation pre
existed Town of Ithaca zoning:
No. 1. South Side of Coy Glen, and
No. 2. North side of Coy Glen, both Ithaca sand and
gravel.
3. Rumsey - Ithaca combined management in 1952 to 1954.
4. At No. 3 site several years ago, a short-term major hauling
operation took place in order to remove the "trabh" which
impeded sand and gravel operation. This was a one-shot deal,
not expected to reoccur.
5. The No.l site at Buttermilk Falls consists of only office
and concrete blending plant.
6. The No. 2 site on north side of Coy Glen is only a maintenance j—jshop for equipment. j
7. The No. 3 site on north side of Coy Glen is only remaining
active sand and gravel operation. Mr. Van Epps stated that
except for normal replacement or repair of Heavy Machinery,
no extension of the equipment nere had taken place recently.
8. Unless a specific violation of the Zoning Ordinance can be docu-
V mehted, the Zoning Officer can find no present cause for
action. Mr. Van Epps has indicated willingness todiscuss
at any time such annoyances or hardships which his operation
causes thfe neighbors, and which might be in his power to correct.
The Board appreciates Mr. Van Epps* willingness to cooperate
and expects hard topping of entrance road in March or Spril
of 1970, plus a greater concern for some method of reducing
or eliminating the matter of spilled sand and gravel.

RESOLUTION 400 - CATERPILLAR LOADER
VOTED RESOLVED that Highway Sup*t send caterpillar loader to
Syracuse Supply Co., Vestal, New York, for reconditoning.
Costs about $574.00 plus parts. ^

HIGHWAY FUN^
VOTED RESOLVED to transfer $3000.00 from Brush Fund to Snow
Fiind.

New car needed by Sup't of Highways. Present one has 100,000
miles. Councilman Baker thought new car should be bought.

South Hill Water - LOZIERS

Discussion - Reports
James Dunlop contact Ithaca College president for appoint
ment to discuss Town's plans for South Hill Water District.
Raponi - No problems anticipated - may move sewer N.C.R.
Final estimate should be ready in about two (2) months - Testing
of valve stems continues - Any additional problems with equip
ment will show in final report.

Sewer line originally built by Schoenfeld. Board members were
satisfied with price and agreement worked out between University,
County, and Town for the Town's purchase of the line.
EXCEPTION - Payment of interest charges - Board did not take kind
ly to interest clause. Supervisor Kerr stated: "That's the only
part I disagree with. We would have about 4,000 dollars ($4,000.)
interest charges and I don't think we should have to pay it.
The Board agreed and action was tabled.

CONNECTION N. E. SEWER LINE
TAX EXEMPTION OPINION
Re: BOCES - James Buyoucos
Since a ditch was dug and in a spirit of cooperation, tap in
Northeast Sewer District and water line was granted with the fol
lowing conditions:
A. Meets City of Ithaca requirements
B. Tap will be sealed by City of Ithaca and will
remain sealed until it is determined what payment
will be made by BOCES towards cost of water district.
Further:
Mr. Buyoucos advised that there is an ambiguity in the law, inso
far as the State Dormitory Authority is concerned
upon the opinion of the Attorney General. The Town Attorney
recommends Town assess State Dormitory Authorities or other
owners of property for cost of construction and instalation of
^ improvements in the special districts involved, until such time
as matter is resolved either in courts or by the legislature.
