SPECIAL TOWN BOARD MEETING
DECEMBER 29 , 2000
10 : 00 A. M .
At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County , New York held at
the Town Hall , 215 North Tioga Street , there were present :
PRESENT : Catherine Valentino , Supervisor; Mary Russell , Councilwoman ; Carolyn Grigorov ,
Councilwoman ; David Klein , Councilman ; Ed Conley , Councilman ; Tom Niederkorn , Councilman .
EXCUSED : Bill Lesser, Councilman .
PRESENT : Debby Kelley, Deputy Town Clerk ; John Barney , Attorney for the Town ; Dan Walker,
Director of Engineering ; Fred Noteboom , Highway Superintendent ; Jon Kanter, Director of Planning ;
Al Carvill , Budget Officer; Judy Drake , Human Resources Specialist .

Call to Order : The Deputy Supervisor called the meeting to order at 10 : 15 a . m . , and led the
tssemblage in the Pledge of Allegiance .
.- upervisor.genda Item No . 3 - Appointment of, and Administration of Oath of Office to Deputy Town
Attorney Barney administered the Oath of Office to Deputy Supervisor Russell.
Agenda Item No . 5 - Confirmation of Arrangements and Appointment of the Attorney for the
Town for the Year 2001 .
Councilman Klein - What is the hourly rate ?
Attorney Barney - The hourly rate is $ 145 . 00 per hour.
RESOLUTION NO. .201 - ARRANGEMENTS FOR TOWN LEGAL COUNSEL FOR 2001
BE IT RESOLVED, that the governing Town Board of the Town of Ithaca hereby agrees to
confirm the arrangements discussed and presented for the appointment of the Attorney for the Town,
for the year 2001 as per the attached letter of understanding as presented by John C. Barney, Esq. ,
of the firm Barney, Grossman, Roth & Dubow.

Agenda Item No. 4 - PERSONS TO BE BEARD.
Fred Wilcox ; 109 Juniper Drive - I would like to thank Jonathan Kanter for his services to me , as the
Chair of the Planning Board , to other members of the Planning Board and to the Town . I am going to
miss him . He has made me look better and made my job easier.
Attorney Barney - Mr. Kanter has brought stability to the office of Town Planner. Mr. Kanter will be
missed very much .
Mr. Kanter - I appreciate the nice comments . I enjoyed working for the Town .
Agenda Item No 6 - Changing the Town Supervisor's Part-time Position to a Full-time
Position .
Councilwoman Grigorov - The resolution was not in the packet . The committee did not decide this .
Councilman Klein - I saw this item on the agenda , but it caught me by surprise . It is appropriate to
discuss it .
Supervisor Valentino - I remembered previous conversations being changing the position from pa
time to full-time for the benefits . It would not be an increase in salary .
Councilman Klein - It would be appropriate for the committee to have another meeting . Mrs . Drak
did send the committee a report . The committee needs to have a final meeting to approve the report
and make a formal recommendation .
I do not remember discussing benefits . We recognized the Deputy Supervisor's position consumed a
great deal of time . The committee also recognized the Supervisor's position was a full -time position .
We focused on if the Town was ready for a Town Manager. The committee felt in order to attract
candidates to the Supervisor position the salary would need to be adjusted , The salary is out of
balance for what it should be .
Mrs . Drake - The only benefits discussed was if the position would allow them to go onto the
retirement system . We did not specifically talk about whether the person would be treated as a full-
time employee for health insurance . Any Town Board Member or Town Supervisor has the option to
take the health insurance at 50% contribution . The change would be if the Supervisor received health
insurance at 100% paid by the Town .
Councilman Klein - Could we provide the benefits without making it a full -time position ?
Supervisor Valentino - It would be a bigger benefit than what our other employees receive . I did not
want the benefits of the Town Supervisor to be better than our employees . I also did not want th
Supervisor's benefits to be less .

ouncilwoman Grigorov - I am not sure it would be legal for some part-time employees to receive
iealth insurance at no cost .
Attorney Barney - It is an issue we need to look at .
Councilman Klein - Supervisor Valentino , would you object to the committee formalizing the
recommendation ?
Supervisor Valentino - No . I would not object . The committee should have one final meeting . The
final recommendation was put together, but it was not endorsed .
Councilman Niederkorn - I am concerned because it is a political position to which people are elected .
I do not know what "full-time " might mean to the next Town Supervisor. It might mean 30 hours per
week or it might mean 10 hours per week ,
Supervisor Valentino - Full -time employees need to work at least 35 hours per week .
Councilman Niederkorn - It is a problem . There might be a lot of people who would like to run for the
position of Supervisor and would be eligible , but could not put in 35 hours per week .
Supervisor Valentino - The workload is a full -time workload . The Supervisor needs to delegate hours
to the Deputy Supervisor. It enables us to attract people to the position . Someone with a full -time job
t�ouncilman ould not hold the Supervisor's position , We could attract someone to the position if they did job
haring with the Deputy Supervisor. We want the position to attract interest ,
Niederkorn - We would need to make it clear in the resolution . We cannot stop anyone
from running for office . It is hard to tell who would win the election .
Supervisor Valentino - The concern is trying to set up a position with the flexibility to attract persons to
the position .
Attorney Barney - I do not know if it would be appropriate for the Town Board to determine the
relationship between the Supervisor and Deputy Supervisor with another administration . The
resolution should deal with the current situation , The Board needs to keep in mind that a different
Town Board might have a different approach to how they want to handle the positions .
Councilman Klein - The Deputy Supervisor position did not have to be a Town Board Member. Any
future Supervisor could appoint an elector of the Town . It is not required to be a Town Board
Member.
Supervisor Valentino - There needs to be a procedure that is used . It allows for the Town Board to
have some control over what happens . I would like to have checks and balances .
Attorney Barney - The resolution could state , " in the current situation , the Town Supervisor's position
is functioning as a full -time position , and for this next budget year, the position shall be considered a
full -time position " . This would not lock the position in as a full -time position .

Councilman Klein - We will need to reconvene the committee .
The Town Board decided to defer this agenda item until a later date.
Agenda Item No . 7 - Resolution for Deputy Supervisor's Position .
This item was removed from the agenda .
Agenda Item No 8 - Resolution Appointing an Interim Town Clerk.
Supervisor Valentino - Mrs . Noteboom 's resignation will take affect December 31 , 2000 . We have
hired a new Town Clerk . She will be starting January 16th . We need to fill the position until the new
Town Clerk starts .
RESOLUTION NO. 206 - RESOLUTION APPOINTING AN INTERIM TOWN CLERK.
WHEREAS, the Town Clerk; Joan Noteboom, has submitted her resignation effective
December 31 , 2000 which resignation has been accepted by the Town Board; and
WHEREAS, the Town Board has concluded a search for a replacement for Mrs. Noteboom,
but the new Town Clerk will not begin her duties until January 16, 2001 ; and
WHEREAS, it is essential to have a person acting as Town Clerk until the new Town Cle
begins work; and
WHEREAS, Deborah Kelley has been the Deputy Town Clerk for a number of years and ii
fully familiar with the position and is prepared to accept the responsibilities of Acting Town Clerk until
a new Town Clerk begins work; now therefore be it
RESOLVED, that Deborah Kelley is hereby appointed interim Acting Town Clerk effective
January 1 , 2001 to January 16, 2001 , or until the new Town Clerk begins work, if later.

,Agenda Item No 9 - Resolution Appointing an Interim Receiver of Taxes.
Supervisor Valentino - Mrs . Kelley is being appointed interim Receiver of Taxes . Ms . Hunter will not
be appointed Receiver of Taxes . We need to review the position of Receiver of Taxes .
Mrs . Drake - Should the third Whereas be eliminated ? It sounds as if Mrs . Kelley is being appointed
Receiver of Taxes for the year 2001 .

ttorney Barney - We need to research residency requirements . We might need to pass another
esolution eliminating the residency requirements for Receiver of Taxes .
RESOLUTION NO. 202 - RESOLUTION APPOINTING AN INTERIM RECEIVER OF TAXES.
WHEREAS, the Receiver of Taxes, Joan Noteboom, has submitted her resignation effective
December 31 , 2000, which her resignation has been accepted by the Town Board; and
WHEREAS, the Town Board is in the process of conducting a search for a replacement for
Mrs. Noteboom but has not yet appointed her successor; and
WHEREAS, it is essential to have a person acting as Receiver of Taxes until the search is
concluded and a new Receiver of Taxes has been appointed; and
WHEREAS, Deborah Kelley has been the Deputy Receiver of Taxes for a number of years
and is fully familiar with the position and is prepared to accept the responsibilities of Acting Receiver
of Taxes until a new Receiver of Taxes is appointed; now therefore be it
RESOLVED, that Deborah Kelley is hereby appointed interim Acting Receiver of Taxes
pending appointment of a new Receiver of Taxes upon completion of a search for same.

Aqenda Item No 13 - Discussion of Pavilion at the East Shore Park on East Shore Drive .
Supervisor Valentino - Do we have new information on the pavilion ?
Mr. Noteboom - We have the sketches of the pavilion .
Councilman Klein - It is a nice pavilion . It is different than the standard park pavilion . The pavilion if
open . It is the size of a single car garage . The pavilion roof is metal .
Councilwoman Russell - Are there benches?
Mr. Noteboom - It appears the benches are on the outside of the pavilion and the tables are on each
corner of the pavilion .
Councilwoman Russell - There is no place to sit inside the pavilion .
Councilman Klein - The structure is fine . The built in tables need to be changed .
Mr. Noteboom - The board can request changes to the design .
Councilman Klein - The design of the pavilion is attractive . The built- in tables take away from the
flexibility of the pavilion .
Councilman Conley - The tables and benches would need to be heavy enough so that they do not
disappear.

r. Noteboom - There are ways that we can fasten the tables and benches down . The tables are
ndercover unless there is a strong storm . The park on Brown Road has the benches inside the
avilion . It allows people to get out of the rain .
Does the board want to have tables in the pavilion ?
Supervisor Valentino - We do not want a lot of tables .
Councilman Klein - We might only need the benches .
Councilwoman Russell - The public might want to eat lunch inside the pavilion .
Councilman Klein - It does not need to be a large table . It could be 3 x 3 foot table .
Mr. Noteboom - The tables would encourage people to use the pavilion on a regular basis .
I will try to get the changes to the board by the February board meeting .

Mrs . Drake - This is a promotional appointment .
Councilman Klein - What happened to the current occupants of the jobs?
Mrs . Drake - We had four Heavy Equipment Operator positions available . We determined the need to
fill one of the positions . We had Motor Equipment Operators that had been working above their title
for a couple of years . We wanted to put them in the right classification . One of our Heavy Equipment
Operators has been out on workman 's comp for over one year. We needed to utilize that position .
The person being promoted to Heavy Equipment Operator position was a Motor Equipment Operator .
We needed to fill that position . We still have an open Motor Equipment Operator position open .
Resolution No 210 - Promotional Appointment of Heavy Equipment Operator.
WHEREAS, there is presently a vacancy in one of the full time position of Heavy Equipme
Operator in the Highway Department; and
WHEREAS, the Human Resources Specialist and Highway Superintendent interviewed 2
candidates from those who applied for the said promotional position; and
WHEREAS, the said individuals have determined that Tim Eighmey, Motor Equipment
Operator, possess the necessary knowledge and skills to satisfactorily perform the duties of the
Heavy Equipment Operator and make the recommendation for appointment: now, therefore, be it
RESOLVED, the Town Board of the Town of Ithaca does hereby approve the regular
promotional appointment of Tim Eighmey as a full time Heavy Equipment Operator for the Highway
Department, effective January 1 , 2001 ; and be it further
RESOLVED, this is a 40 hours a week position, at the hourly wage of $ 13. 50, which is an
estimated annual salary of $28, 080, in Job Classification "i', with full time benefits; and be it further
RESOLVED, if the said successfully completes the mandatory 8 week probationary period,
there will no further action required by the Town Board.

possess the necessary knowledge and skills to satisfactorily perform the duties of the Motor

promotional appointment of that Montague Mouillesseaux as a full time Motor Equipment Operator for
the Highway Department, effective January 1 , 2001 ; and be it further

estimated annual salary of $23, 920, in Job Classification "H'; with full time benefits; and be it further

Mrs . Drake - Mrs . Noteboom was appointed January 1 , 2000 for a two year term . I had it as filling
Mrs . Noteboom 's term .
Councilman Klein - The appointment is effective January 16 , 2001 through December 31 , 2001 . It is
a one year appointment . Is Ms . Hunter aware that the position is a one year appointment?
Mrs . Drake - Ms . Hunter has been a Town Clerk . She is knowledgeable regarding terms of
appointment .
Mr. Carvill - Could it be a three year appointment?

Attorney Barney - The law requires it to an appointed position every two years . The local law woul
need to be changed .
Supervisor Valentino - We need to explain the situation to Ms . Hunter. I spoke with the Supervisor of
Ledger. The Supervisor said Ms , Hunter has been an outstanding Town Clerk . Her writing skills are
excellent . Ms . Hunter has been able to get them three records management grants . The biggest
positive about Ms . Hunter is that she is a people person . She has two daughters and they attend
Lansing School . Ms . Hunter felt that moving here would not be a problem .
Councilman Klein - Are we appointing Ms . Hunter as Town Clerk and Receiver of Taxes ?
Supervisor Valentino - No . Ms . Hunter is being appointed Town Clerk . Mrs . Kelley has been
appointed as Receiver of Taxes for this tax season , We need to have more discussion regarding the
Receiver of Taxes position .
Councilman Klein - Do we need to include in the resolution how many months she has to become a
Town of Ithaca resident?
Mrs . Drake - It is part of the job description that she is a Town of Ithaca resident within six months .
Councilman Klein - Is there a probationary period ? We usually have a probationary period when we
appoint other positions .
Mrs . Drake - No . Ms . Hunter is still required to wait six months before she can use vacation time
This is an at-will appointment of the Town Board .
Attorney Barney - The board could remove an at-will appointment at anytime with or without cause .
The board could only remove a permanent appointment with cause .
Resolution Ho 212 = Appointment of Town Clerk.
WHEREAS, due to the December 31 , 2000 resignation of the Joan Noteboom, there will be a
vacancy in the full time appointed position of Town Clerk; and
WHEREAS, the Town Supervisor, Deputy Town Supervisor and Human Resources Specialist
interviewed 4 candidates from those who applied for the said position; and
WHEREAS, the said individuals have determined that Tee-Ann Hunter, possess the necessary
knowledge and skills to satisfactorily perform the duties of the Town Clerk and make the
recommendation for appointment; now, therefore, be it
RESOLVED, the Town Board of the Town of Ithaca does hereby appointment Tee-Ann Hunter
as the appointed Town Clerk, effective January 16, 2001 : and be it further
RESOLVED, this is a full time salaried position based on 37. 5 hours a week position, at a
annual salary of $36, 500, in Job Classification "I"', with full time benefits; and, be it further
