RESOLUTION 4o6 - APPROVAL OF MINUTES
Motion was made by Councilman DelRosso and seconded by
Councilman Baker that the minutes of June 9. I969 as submitted
by the Town Clerk be approved. An all "aye vote carried.

RESOLUTION 40? - APPROVAL OF WARRANTS
Councilman McElwee made the motion^ seconded by Councilman Desch
that the warrants in the following amounts be paid.

RESOLUTION 4o8 - BID AWARD OF TRUCK-DUMP BODY
& SNOW PLOW EQUIPMENT
A motion was made by Supervisor Kerr and seconded by Councilman
Baker that the Town Board accept the bid from Brockway Motor Co.
at a net price of $17,937.00 which would not include tires, tubes
and flaks. A vote was taken with the following votes cast.

RESOLUTION k09 - N.Y.S. ELEC. & GAS EASEMENT
Supervisor Kerr made the motion, seconded by Councilman McElwee
that the Town authorize Supervisor Kerr to execute such instruments
and papers as may be necessary to grant easement and right of way
on Spencer Road as requested by the New York State Electric & Gas
Co. The easement and right of way to be granted and released is
ten (10) feet in width throughout its extent, lying and being as
follows.
The center line of said right of way to extend from the north
easterly to the southwesterly property lines of grantor's land sub
stantially parallel to the center line of Spencer Road and about
27 feet northwesterly therefrom, together with service extensions.
An all "aye" vote carried.

RESOLUTION 4lO - ARTHUR PRINCE-CHRISTOPHER LANE
Discussion of: Performance Bonds, Escrow Money, Penalties.
VOTED RESOLVED No Building Permits, No Certificates of Occupancy,
No Road Acceptance of Christopher Lane, until Mr. Prince cleans up
the debris areas. He will have until August 11, I969 to do so,
otherwise the Town will and back charge him.
An all "aye" vote carried.

RESOLUTION 4ll - BLUE CROSS-BLUE SHIELD-
RETIRED EMPLOYEES
VOTED RESOLVED: To revoke previous resolution for payment of
premiums on retired employees.
BE IT FURTHER RESOLVED: Henceforth Town will pay as its portion ^
or contribution of such premiums an amount not to exceed that |
contributed on respective retirement dates.
An all "aye" vote carried.

RESOLUTION 4l2 - SEWER ORDINANCE
James Buyoucos gave brief talk about ordinance. Town Clerk will
make copies of proposed' ordinance and mail to Board Members for
their review.
A motion was made by Supervisor Kerr and seconded by Councilman
McElwee that a Public Hearing be held August 11, I9S9 at 5:00
o'clock P.M. to consider the adoption of an Ordinance regulating
the use of public and private sewers and drains, private sewage
disposal, the installation and connection of building sewers, and
the discharge of waters and waste into'the public sewer systems
and providing penalties for violations thereof in the Town of
Ithaca, Tompkins County, New York.
An all "aye" vote carried.

RESOLUTION 4l3 - PUBLIC HEARING-GROFP ASSOCl-
ATES-MULTIPLE RESIDENCE TO
BUSINESS "C" TO BUSINES^-^D"
Councilman McElwee moved and Supervisor Kerr seconded the motion
that a Public Hearing be held on Monday the 11th of August at
4:30 P.M. to consider rezoning - 2 parcels of the former S.W.
Barnes farm, corner of Judd Falls Road and Ellis Hollow Road,
described as follows:
A. An approximately 7/10 acre strip or gore of land along
the westerly side of the proposed Forest Home By Pass Road.
From Multiple Residence to Business "C".
B. A parcel of about 2.2 acres lying adjacent south of (A)
and bound easterly by the west line of said proposed By
Pass Road, westerly by the 3.02 acre "Barnes Reserve"
and southerly by the Ellis Hollow Road from Multiple
Residence to Business "d".
An all "aye" vote carried.

Motion by Councilman McElwee, seconded by Councilman DelRosso that

RESOLUTION 4l5- STORM DRAINAGE-NORTHEAST AREA
WINTHROP DRIVE
Several residents from Winthrop Drive and Northeast Area appeared
and were heard. Letters from BOCES & City School district
acknowledged their awareness of the situation and a willingness
to cooperate. Supervisor Kerr discussed formation of Drainage
District and asked for opinions. Councilman McElwee said action
must be taken quickly as the problem was "immediate". Muddy water,
silt and future rains could be disastrous. Ditches were discussed-
Councilman Baker discussed having 4 ditches plus cleaning out cer
tain drainage pipes that were clogged. Councilman Desch explained
how the entire region was involved--Northeast Area, Village,
and Town of Lansing and how it would serve the best interests of all
to obtain the County Sewer Agency advice and counsel in the formation
of a drainage district and distribution of costs, instead of Town
taking unilateral action. It was decided that Councilman Desch
would ask the interim County Sewer Agency to consider the problem,
and that Mr. Desch would also talk with Mr. Egner and with Mr.
_ Schwan, to talk with Village Board. The discussion ended with
I Councilman McElwee making the motion, seconded by Councilman Baker
I i that a ditch, or ditches, at suitable locations and after study,
- be dug to give temporary relief to residents in the area of Winthrop
Drive as a temporary measure.
Duly passed.

RESOLUTION 4l6 - PUBLIC HARING
A motion was made by Supervisr Kerr and seconded by Councilman
McElwee that a Public Hearing be held on the 11th day of August
1969 at 5:30 P.M. in order to consider the adoption of an ordinance
establishing and imposing sewer rents pursuant to Article l4-f
of the General Municipal Law.
An all "aye" vote carried.

County operation of dump might be solution.
