RESOLUTION 373 - APPROVAL OF MINUTES Motion was made by Supervisor Kerr and seconded by Councilman DelRosso that the minutes of March 10, I969 as sidsmitted by the Town Clerk be approved. The discussion Supervisor Kerr moved that a Public Hearing be held to consider re-zoning from R-30 to Multiple Residence a tract of land on the Northeast side of Snyder Hill Road owned by Eastern Heights Inc. Said Hearing will be held at 5:00 P.M., D.S.T., May 12, 1969 in the Common Council Room, 3i*d floor. City of Ithaca, 108 E. Green Street, Ithaca, New York. Duly Passed. * * * RESOLUTION 376 - FOREST HOME WATER DISTRICT U.S. SAVINGS BONDS MATURED TWO (2) $1,000. BONDS Supervisor Kerr moved that these bonds be reinvested. Councilman McElwee seconded. An all "aye" vote carried. RESOLUTION 377 - At a regular meeting of the Town Board of the Town of Ithaca, Tompkins, County, New York, held at the Town Offices, in the City of Ithaca, New York, on the l4th day of April, I969, at 4:00 o'clock P.M., Eastern Standard Time. The meeting was called to order by Supervisor William Kerr, and upon roll being called, the following were PRESENT; William B. Kerr, Supervisor Andrew McElwee, Councilman Harry Baker, Councilman Victor DelRosso, Councilman Noel Desch, Councilman ABSENT: 4/14/69 The foliowing resolutiori'^'^as-ofJ'ered by Councilmaxi Desch, who moved its adoption^ seconded by Councilman McElwee, to-wit: BOND RESOLUTION DATED APRIL 14, I969. A RESOLUTION AUTHORIZING THE ISSUANCE OF AN ADDITIONAL $185,000 SERIAL BONDS OF THE TOWN OF ITHACA, TOMPKINS COUNTY, NEW YORK, TO PAY A PART OF THE COST OF CONSTRUC TION OF A SEWER SYSTEM TO SERVE SOUTH HILL SEWER DISTRICT IN SAID TOWN. WHEREAS, The South Hill Sewer District has been duly established as a sewer district in the Town of Ithaca, Tompkins County, New York, pursuant to Article 12-A of the Town Law and more particularly in accordance with an order of this Town Board adopted on the 12th day of December I966; and WHEREAS, the maximum amount proposed to be expended for the improvements in said district and for the acquisition of the necessary lands and rights in lands was thereunder determined to be $840,000; and WHEREAS, pursuant to proceedings heretofore had and taken under Section 209-h of the Town Law and more particularly, an approving order of the State Comptroller dated February 4, I969 and an order of this Town Board dated March 10, I969, it has been determined to be in the public interest to increase the aforesaid maximum amount to be expended for improvements in said district from $840,000 to $1,025,000; and WHEREAS, it is now desired to provide for the authorization of bonds to finance such additional amount; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Ithaca, Tompkins County, New York, as follows: Section 1. For the specific object or purpose of paying a part of the cost of a sewer system in and for South Hill Sewer District in the Town of Ithaca, Tompkins County, New York, there are hereby authorized to be issued an additional $185,000 serial bonds of said Town pursuant to the Local Finance Law. Section 2. The maximum estimated cost of construction of the aforesaid sewer system is now determined to be $1,025,000 (an increase of $185,000) and the plan for the financing thereof is as follows: A) By the issuance of $840,000 serial bonds of said Town heretofore authorized to be issued pursuant to a bond resolution adopted by this Town Board on May 8, 196?; and B) By the issuance of the $185,000 serial bonds herein authorized to be issued. n Section 3« It is hereby determined that the period of probable usefulness of the aforesaid specific object of purpose is forty (4o) years pursuant to subdivision 4 of paragraph A . f" of Section 11.00 of the Local Finance Law. The maximum maturity of serial bonds herein authorized will be in excess of five (5) - years and will not exceed thirty (30) years computed from March 25, 19^8, the date of the first bond anticipation note issued in anticipation of the $840,000 serial bonds herein above described. 4/14/69 Section 4. The faith and credit of said Town of Ithaca,Tompkins County, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such bonds as the same become due and payable. IThere shall be annually apportioned and assessed upon the several lots and parcels of land within ^ said South Hill Sewer District which the Town Board shall determine and specify to be especially benefited by the improvement, an amount sufficient to pay the principal and interest on said bonds as the same become due, but if not paid from such sources, all the taxable real property in said Town shall be subject to the ''i levy of ad valorem taxes without limitation as to rate or amount sufficient to pay the principal of and interest on said bonds as the same shall become due. Section Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 6. The validity of such bonds may be contested only if 1) Such bonds are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not sub stantially complied with, 1 and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such bonds are authorized in violation of the provisions of the Constitution. Section 7» This resolution, which takes effect immediately, shall be published in full in The Ithaca Journal, the official newspaper of said Town, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. Town Clerk (S E A I L) I RESOLUTION 378 - SNYDER HILL WATER DISTRICT- APPLICATION TO WATER RESOURCES COMMISSION A motion was made by Councilman Desch and seconded by Councilman DelRosso that Supervisor Kerr be authorized to apply to the Water Resources Commission for completed works in the Snyder Hill Water District. A vote was taken with the following votes cast: Supervisor Kerr aye Councilman Desch aye Councilman Baker aye Councilman McElwee aye Councilman DelRosso aye * * * RESOLUTION 379 - SNYDER HILL WATER _ WILLIAM FRANDSEH Voted Resolved that Supervisor Kerr request the Board of Public ^ Works of the City of Ithaca for inclusion of the William Frandsen property in the Extension No. 1, Snyder Hill Road Water District. Duly voted and unanimously passed. * 4/14/69 RESOLUTION 38O-MOSQUITO CONTROL-SUNRISE SPRAYING SERVICE A motion v/as made by Supervisor Kerr and seconded by Councilman 1*1 McElwee that the Mosquito Control Program for the Town of Ithaca be continued. Terms and-price are the same as they were last year $900.00. Treatments of two week intervals to the breeding areas in the Town of Ithaca. A vote was taken and the resolution unanimously adopted. * * * RESOLUTION 38I - CAYUGA HEIGHTS-INFILTRATION- SEWER LINEg; Supervisor Kerr explained that the Village is searching for sources of infiltration into the sewer lines. The Village Board set aside a sum of money to pay the cost of this search ^d requested that the Town also set aside a sum not to exceed $250.00 to pay the cost for inspections of houses in the Town served by the Village Sewer System. A motion was made by Supervisor Kerr and seconded by Councilman Desch tl:B,t the sum of $250.00 be set aside for this purpose. Duly voted and passed. * * * I I RESOLUTION 382 - SOUTH HILL SEWER DISTRICT EXT. 1 Voted Resolved to release the following amounts on the final estimates to Bill Auble Construction Corp^ presented to Lozier Engineers. The Town will exercise its retainage fee per contracts. South Hill Sewer District Ext. #1 $4519.90 South Hill Sewer District Ext. #2 5519.97 Second South Hill Water District Ext. #2 551.10 * * * RESOLUTION 383 - PLANNING-LAND USE - TOWN OF ITHACA All had opinions in this matter. Supervisor Kerr and Councilman Desch discused the Federal 701 Planning Grant in terms of value to the Town. Present and future. Supervisor Kerr felt that since the Town needs land usage planning now^ it might not be wise to wait on the Federal Grant. It could take too long a time and because of "these circumstances it might be adviseable for the Town "to go it alone and have this study done by Egner and Niederkorn Associates, Inc. or some other qualified firm. Councilman Desch thought it would be more feasible to plan sections of the Town making sure plans in each area would not interfere in an over all study i I and that an effective land usage plan should be done by the County. If we do act now, we should apply for assistance to develop a Master Plan, and perhaps the government may be acting more quickly in these projects, than it has in the past. Supervisor Kerr made the motion, seconded by Councilman Desch that the Town apply for Federal 701 Planning Grant, the Town continue having Frank Liquori look for a Town Planner, and should it become evident the funding is being delayed for too long a period, the Town then finance the study by a competent consultant. An all "aye" vote carried. * * * 4/14/69 UNFINISHED BUSINESS AND GENERAL ORDERS 1. Board advised Sup't. of Highways Moray to set up specifications for purchase of Heavy Duty Truck to replace the present one. The present truck is a 1958^ troublesome^ has 117,000 miles. These vehicles have a normal life use of 10 years and were the main reasons for the Sup't. action in requesting a new truck. 2. The Blatchly Property will have to use the present reliable map. There will be no new road survey. It would solve n no problems and serve no purpose, since the State and County would still put their future roads where they choose. 3. George Ideman letter. Mr. Ideman was dissatisfied with the check for $100.00 and returned same. He wanted $152.25. No action taken by Board. 4. Ithaca School District Invoice. This invoice was returned by the Town Clerk per instructions. No further action taken by Board and no response from the School District. 5. Traffic Count Planning Board. RUN OFF PROBLEMS NORTHEAST JR. HIGH BOCES Planning Board Chairman Walter Schwan was requested to get cost estimates for doing studies from Northeast walkway to Lansing Town Line and Warren Road to Dryden Town Line. These cost estimates are to come from John McNeil of Cortland and also from Lozier Engineers of Ithaca, New York. 4/14/69 71 7. Planning Board recommendation for revision of the Zoning Ordinance returned to Walter Schwan^ Chairman for further study. Agricultural Section 51 was acceptable and new definition of a family was agreed upon after suggestions by Supervisor Kerr, Councilman McElwee and Councilman Desch. No action or public hearing until further study is finished and again presented, 8. Sanitary Sewer Ordiance drafted by Attorney James Buyoucos in I965 and never acted on. Copies to be sent to the Board members on this proposed ordinance^ so that all may study it for further discussion and future action. 9. May 5^ 1969 will be CLEAN UP DAY for the Town of Ithaca. Supt. of Highways will make arrangements to pick up trashy etc. on that day. Notice will be in the Ithaca Journal. 10. Advise Harold Cornelius, Cayuga Heights Village Sewer Department, he has the Boards permission to repair the manhole opposite Lansing East Apartments. This meeting adjourned at 7:15 P.M. Edward P.
