Councilman McElwee wanted to know about our responsibilities concerning
the Cayuga Heights School Guards. It was learned we had none but
Supervisor Kerr mentioned they were doing good jobs.

JANUARY 13, 1969
The following are minutes of a Regular Town Board Meeting held
in the Common Council Room, City of Ithaca and the Town of Ithaca
Offices, 108 E. Green St., Ithaca, New York at 4:00 o'clock P.M.
on the 13th day of January 19^9.
PRESENT: Supervisor William B. Kerr, Councilmen Andrew W.
McElwee, Noel Desch and Victor DelRosso.
ALSO PRESENT: Attorney James V. Buyoucos, Chairman of the
Planning Board Walter Schwan, Manley Thayer, Lozier Engineer
James Dunlap, Mr. Koetter and Mr. Wells--Architects for the
Eastern Heights, Inc., residents from Pine Tree Road, Snyder
Hill Road and nearby areas. Attorney William C. Barrett, former p*
Mayor of Ithaca-Hunna Johns, Attorney Helen Amdur of Dryden,
Supervisor Gary Lee of Dryden and Town Clerk Edward P. Riley.
Reporters from the Ithaca Journal, WHCU and WTKO.
RESOLUTION 3^0 - NEW TOWN JUSTICE-PAUL N. TAVELLI,
ATTORNEY
There was a few minutes discussion about having Paul N. Tavelli,
a young local attorney appointed Town of Ithaca, Justice of the
Peace.
Supervisor Kerr moved that Paul N. Tavelli be appointed Justice
of the Peace for the Town of Ithaca at $1,800. a year.
Councilman DelRosso seconded and it was unanimously approved.

RESOLUTION 3^1 - WARRANTS
Supervisor Kerr moved that warrants submitted to the Board be approved
for payment, with the exception of the Workmans Compensation Bid in
at $1995.00 and billed at $2455.00.Seconded by Councilman DelRosso
and unanimously approved.

Per Instructions: Clerk Riley phoned Mr. Bbothroyd who checked with
his Home Office. Learned it was a billing error, notified us immediately
and explained that a new corrected billing is on its way. •

RESOLUTION 3^2 - PETITION FOR CORRECTION OF
SPECIAL DISTRICT ROlX
Supervisor Kerr made the motion that since the roll for the
Slaterville Road area Sewer District was transcribed incorrectly^
the tax bills for the following Parcels should be as follows:
#2444 Parcel #56-3-14 Assessed to Charles Foote^ should not
I be charged in the district - the sewer charge should
be deleted and tax bill decreased $1191.55.
#2443 Parcel #56-3-13 Assessed to William Frandsen should be
charged an additional $1126.08
#3362 Parcel #56-3-12 Assessed to the Salvation Army should
be charged an additional $65.47.
Councilman McElwee seconded and unanimously passed with an all
"aye" vote.
(The above bills have been corrected and sent out.)

RESOLUTION 343 - MINUTES
A motion was made by Councilman McElwee that minutes of the Board
held on the 31st day of December 1968 be approved. Seconded by
Councilman Desch and unanimously adopted.

Councilman Desch moved that the new Official Town Map be adopted.
Seconded by Councilman McElwee and unanimously passed.

RESOLUTION 3^5 - EASTERN HEIGHTS-REZONING
Mr. Kerr read a letter from the Citizens Council. Attorney Wm..
Barret, representing objectors to the rezoning presented a petition
to the Town Clerk to be filed for a large number of people who
retained him as counsel. He spoke strongly against it. Former
Mayor Johns questioned Barrets statements which were not in
agreement with the way he talked as an Alderman on Council. Gerald
O'Brien read a three (3) page statement of Morris W. Opler, which
denied a need for Multiple Housing and said the traffic count on
Snyder Hill was erroneous. Mrs. Roger Livesay warned of traffic
problems.
Supervisor Gary Lee representing the Town Board of Dryden said the
Dryden Board strongly objected as Snyder Hill was going to be its
, I most restrictive Low Density Zoning. He then admitted Dryden was
using a Floating Zone and could end up with the same type of
development in the years ahead.

Manley Thayer pointed out that roads were not under discussion-
were the responsibility of the municipality and the development
was not concerned about the roads. There was a great deal of
free lance discussion all objecting to the development.
A vote was then taken and stands yes 3 ^

Those in favor were Supervisor Kerr^ Councilmen McElwee and
Desch, Councilman DelRosso abstained stating he wanted to see
the traffic problem alleviated and that he wants to take time
and make sure he votes as the people want.
Attorney James V. Buyoucos will give an opinion to the Board
after he has read the provisions of Section 265 of the Town Law.
It is a question of whether 3/^ vote is necessary or there is
only a majority vote required.
Attorney Buyoucos will soon report.

RESOLUTION 3^6 - TOWN ENGINEER-PLANNER
Councilman Desch made the following motion seconded by Councilman
DelRosso. Duly Passed.
That the specifications for Town Engineer-Planner presented
by Councilman Desch, Councilman DelRosso, Planning Board Chairman
Walter Schwan be accepted and applications for a man with the
specified requirements be now sought. (Copies of these n
specifications are in your folders.) j

RESOLUTION 3^7 - HUDSON STREET EXT.
Resolved that Planning Board investigate and determine advisability
of Therm Electric, request to have Town abandon road called
Hudson Street Ext. Duly Passed.

RESOLUTION 3^8 - PUBLIC HEARING-SOUTH HILL SEWER
DISTRICT
Since the approval from the State Department of Audit and Control
was not received, the Public Hearing scheduled for 5:00 P.M.
could not be held. An informal discussion with area residents
did ensure however and explanations of the flifficulties
encountered were explained by Lozier Engineer James Dunlap.
Responsibilities for the under estimaj^g^ of actual costs was
the main topic of concern. How much/work to do, when could
it be completed, who was holding it up (165 ftv). These were the
topics discussed. It was suggested since nothing further
could be done that this January 13^ 19^9 meeting be adjourned n
day to day at the call of the Supervisor. |
Supervisor Kerr made the following motion that this January 13, 1969
meeting be adjourned day to day at the call of the Supervisor.
Councilman McElwee seconded. Unanimously passed.
