TOWN BOARD MINUTES
JANUARY 15, 1968
The following are minutes of a Regular Meeting of the Town
Board held in the Town of Ithaca Offices at 108 East Green
Street, City of Ithaca at ^:00 P.M., Monday January 15, I968.
PRESENT; Supervisor William B. Kerr, Councilmen Andrew W.
McElwee, Joseph N. Mayer, Jr.
ABSENT: Councilmen Harry N. Gordon, Harry U. Baker and
Superintendent of Highways Marion Morey.
Also Present: Engineer James Dunlap, Attorney James V. Buyoucos,
Planning Board Chairman Noel Desch, Bill O'Boyle, Lozier Field
Engineer, Journal Reporter Roger Langley, Clerk Myrtle Hewitt,
resinents from Snyder Hill, West Hill and South Hill.
PUBLIC HEARING--ZONING ORDINANCE
The Public Hearing scheduled for the purpose of considering
the advisability of re-adopting, re-enacting and amending the
existing Zoning Ordinance of the Town of Ithaca was called
to order by Supervisor William B. Kerr at 4:00 P.M. Proof
of publication and posting were presented. Several interested
resiients from the Snyder Hill area were present. They were
particularly concerned with Article I, Sec. 1, para. 5.
Definition of Family and par. 11. definition of Boarding House.
After a brief discussion the residents present were satisfied
that the proposed definitions given were adequate and they
left and Supervisor Kerr declared the hearing closed at 4:35 P.M.,
vriiereupon he offered the following resolution and moved its
adoption:
RESOLVED that the Existing Zoning Ordinance of the Town
of Ithaca be re-adopted, re-enacted and amended as set forth
and contained in the following Sections of the Ordinance.
Art. I. Sec.l. para. 5. Definition of Family and par. 11,
definition of Boarding House.
Art. IX. Site Plan Approval. Sec. 46 and Sec. 46-a.l.
Art. XIV. Sec, 75> third paragraph, relating to fees
for a building permit.
Art. XIV. Sec. 80, relating to amendments, omits the
requirement that any amendment shall be submitted to the Board
of Appeals and to the Town Planning Board for a report before
being acted upon by the Town Board.
The motion was seconded by Councilman McElwee.
The motion was rescinded as requested by Attorney Buyoucos due
to the fact that the Zoning Board of Appeals had not held a
public hearing to review the Zoning Ordinance and a report
had not been submitted by The Town Planning Board. Both Boards
were requested to fulfill these requirements before the next
Regular Meeting of the Town Board.
RESOLUTION 174 - DESIGNATION OF SALARIES
Supervisor Kerr offered the following resolution and moved its
adoption:
VOTED resolved that the following salaries be approved for the

RESOLUTION 175 - TOWN EMPLOYEES-HOSPITALIZATION
VOTED resolved that all personnel both retired and active
being served by the New York State Hospitalization Insurance
through the Town of Ithaca group at the present time will have
their full coverage paid by the Town of Ithaca, retroactive
to January 1, 1968.

RESOLUTION 176 - SUPERVISOR'S ANNUAL REPORT
VOTED resolved that the Supervisor shall submit to the Town
Clerk within 60 days after the close of the fiscal year a
copy of his Annual Report and be it further
RESOLVED that a summary of this report shall be published in
The Ithaca Journal, the official newspaper of the Town of
Ithaca.

RESOLUTION 177 - BOARD OF REVIEW-GRIEVANCE DAY
VOTED resolved that the following members aet as a Board of
Review for Grievance Day 1968-date set as June 18, 1968:
Supervisor William B. Kerr, Assessor Doanld P. Franklin and
Councilman Andrew W. McElwee.

RESOLUTION 178 - RESIGNATION-ZONING OFFICER
VOTED resolved to accept the resignation of Donald Franklin
as Zoning Officer and Building Inspector effective February 1,
1968.

RESOLUTION 179 - APPOINTMENT-ZONING OFFICER
VOTED resolved that David Cowan, l4o Forest Home Drive be
apnointed as Zoning Officer and Building Inspector effective
February 1, I968 at a yearly salary of $2000. Office hours
to be set to include 8 to 10 hours weekly.

RESOLUTION l80 - WARRANT
VOTED resolved to approve the warrant dated January 15, I968
in the following amounts;

RESOLUTION I8I - MINUTES
VOTED resolved to approve minutes dated December 11th and
December 29th, I967.

PUBLIC HEARING--SOUTH HILL WATER DISTRICT-INCREASE TO m EXPENDED
The Public Hearing was called to order at 5:00 P.M. by Supervisor
Kerr for the purpose of determining whether or not it is in the
public interest to authorize an increase of such maximum
amount by an additional sum of $210,000.00 so that the total
maximum amount proposed to be expended for improvement in
such district shall be $480,000.00. Subject district being
more specifically known as Second South Hill Water District
(1966). Affidavit of publication and posting were presented.
Several residents from the affected area were present and enter
ed into an Informal discussion. They were informed that
approval had been authorized by the State Department of
Audit and Control upon the grourids that the public interest
will be served by the proposed increase and that the addition
al amount to be expended will not be an undue burden upon the
property of the district. The residents were also Informed
that bids within the limits of the proposed increase were
opened as of this date (January I5) and found to be in order
by the Engineer.
Supervisor Kerr asked for objections to this added increase
from, the floor and since there were none he declared the
hearing closed at 5:4o P.M.
The Board thereupon duly resolved to authorize said increase
subject to a permissive referendum as provided in Sect. 209-H
of the Town Law.

RESOLUTION l82 - REFUNDS ON ASSESSMENTS
VOTED resolved that the East Ithaca Water District Special
Assessment Roll Is Incorrect and that all monies except the
hydrant charge to Cornell University should be refunded upon
payment of the tax bills.
BE IT FURTHER resolved that In the South Hill Water District
Louis Bonanni was Incorrectly charged $13.50 and this amount
shall be refunded,
ALSO RESOLVED in the Renwlck Heights Sewer District, parcel
17-4-14, owned by Andrew S. Schultz was charged with a dwelling
unit which does not exist therefore $85.55 shall be refunded.

RESOLUTION I83 - SNYDER HILL WATER DISTRICT
ACCEPTANCE OF PUMP STATION
VOTED resolved by the Town Board that acceptance of the Pump
Station for the Snyder Hill Water District be subject to title
and deed being accepted by the Tovm Attorney James V .Buyoucos.

RESOLUTION l84 - STREET AND SEWER EASEMENTS
VOTED resolved by the Board that streets in the Eastern
Heights subdivision namely Joanne Drive and Regency Lane not
be accepted as Town Roads until final inspection can be made
in the spring to insure that all specifications and require
ments have been made by the developer. Also all easements
will be subject to approval by the Town Attorney.

RESOLUTION I85 - RELOCATION OF WATER FACILITIES
VOTED resolved that the Supervisor of the Town of Ithaca,
County of Tompkins be authorized to sign a supplemental
agreement in connection with the cost of relocating municipally
ovmed facilities (water lines) maintained for public use
whereby the original agreement dated October 11, I963 is
inadequate for the purposes thereof and is hereby supplemented
by an increase from $4426.00 to $5,161.89
and "shall be deemed executory only to the extent of moneys
available and that no liability shall be incurred by the State
beyond moneys available for the purpose except as provided
in the Supplemental Agreement, and the terms and provisions of
agreement dated October 11, 1963 shall continue to be in full
force and effect."

RESOLUTION I86 -RELEASE UNDER AN AGREEMENT
IN CONNECTION WITH COST OF
RELOCATING MUNICIPALLY OWNED
FACILITIES MAINTAINED FOR
PUBLIC USE
VOTED resolved that the Supervisor of the Town of Ithaca,
County of Tompkins is hereby authorized to execute all
General Release Forms concerning project RC 66-I9, Ithaca
Danby, SH 5043:, SH 5122, Tompkins County, per agreement
dated October 11, I963 entitled _|^Agreement in Connection with
the Cost of Relocating Municipally Owned Facilities Maintained
for Public Use" (Sub^division 24 Section 10 of the Highway Law).

TOPICS OF DISCUSSION
Spruce Way--Frozen Water Line-- During the recent subOsero
weather, residents living on the recently accepted town
road of Spruce Way were without water because of frozen
water lines. Due to the urgency of the situation the Bill
Auble Construction Company under Sunervision of Bill 0'Boyle
was asked to dig in and locate the difficulty. The line was
found to be frozen where it crossed beneath the highway
due to inadequate depth coverage. This brought up the
question of responsibility of payment for the work involved,
1) should the Town take responsibility
2) should the property owner assume the debt or the
contractor from whom the new property owner purchased
the property
3) should the district share in what appears to be a
malinstallation?

It appeared to be the consensus of the Board that the contractor
should be held liable for this expense inasmuch as the line
was not laid the necessary depth.
Town Engineer-- More than ever before it now is the contention
of the Board that a Town Engineer is much in need to keep in
contact with the rapid development which is now taking place
in the Town and that construction specifications and acceptable
practices are adhered to, to aid in the elimination of any
malconstruction which might prove to be detrimental to the
Town in the future. The Board members were asked to recommend
eligible candidates for this position and report at the next
meeting.

Board held in the Town of Ithaca Offices at IO8 East Green
Street, City of Ithaca at 4:00 P.M. Monday, February 12, 1968.
PRESENT: Supervisor William B. Kerr, Councilmen Andrew W.
WcElvtee, Joseph N. Mayer, Jr. , and Harry N. Gordon.

RESOLUTION 18? - ACCEPTANCE OF ROADS
EASTERN HEIGHTS SUB-DIVISION
RESOLVED by the Town Board to accept roads in the Eastern
Heights sub-division more specifically known as Joanne Drive,
Regency Lane and the completed part of Eastern Heights Drive
subject to liability of Eastern Heights, Inc. to complete
roads in accordance with Town of Ithaca specifications.
BE IT FURTHER RESOLVED that the developer is hereby required
to deposit a minimum of $2000.00 in escrow to guarantee the
subject roads to be completed to the specifications set for
regulation town roads in the Town of Ithaca.

The Town Board discussed the matter of water and sewer in the
Eastern Heights subdivision and it was decided that upon ,
completion of all installations in all roads Eastern Heights, '
Inc. would accept instrument if necessary , to confirm title
of these facilities in the Town upon the understanding that j
all tests have been made and installations approved.

RESOLUTION I89 -ACCEPTANCE OF SEWER LINE
EASEMENTS
Eastern Heights, Inc.
RESOLVED that the Town Board accepts the easement for the
sev/er line from Eastern Heights^ Inc. along westerly side of
lots 1 thru 6 of block 12 as shown on the map entitled "Profile
of rear lot sewer for Joanne Drive made by John S. MacNeill, Jr.,
dated January 23, 1968.

RESOLUTION I90 - WATER & SEWER LINES
Eastern Heights, Inc.
RESOLVED that upon filing of a certificate by John MacNeill,Jr.
Engineer, that he has inspected and approved the installation
of sewer and water lines installed by Eastern Heights, Inc.
and has run the proper infiltration and pressure tests that
the Town upon the filing of such certificate accepts and will
maintain those portions of the sewer and water lines covered
by said certificates without further action.

RESOLUTION I9I - ADOPTION OF ZONING ORDINANCE
By resolution of the Town Board of the Town of Ithaca duly
adopted, at a Regular Meeting duly called and hel on' the 12th
day of February, I988, the existing zoning ordinance was amended,
revised and as thus amended and revised was re-enacted and re-
adopted in its entirety as set forth below. Changes and
revisions of the existing Zoning Ordinance consist essentially
of Art. 1, Sec. 5, Definition''of Family and paragraph 11,
Definition of Boarding and Rooming House, Art.IX, Site Plan
Approval, Sec. ^6 and 46-a.l, Art. XIV, Sec. 755 3rd paragraph,
as to building permit fees. Art. XIV, Sec. 80, the requirement
of submission of Amendments to the Planning Board and the
Board of Appeals for a report is omitted.

The Board authorized that advertising for bids be placed for
two (2) new voting machines at an approximate cost of $1653-
each.

RESOLVED to authorize the Clerk to place an order for a new
mimeograph machine at a state price of approximately $200.
