HomeMy WebLinkAboutTB Minutes 1965-03-08Inarch 8, 1965 The regular meeting of the Town Board of the Town of Ithaca was held Konday, March 8, 1965 at ^;00 P.M. in the Town Offices, 108 Fast Green Street, City of Ithaca, Board members present were: Supervisor William B. Kerr, Councilman Joseph T^^ayer and Councilman Frank C. Bishop. Also present were: Highway Sup't. Marion Morey, Assessor Robert J. Wells, Attorney James Buyoucos, Jqckson Hell and Mrs. Nicholas Bodraan. AnOPTTCN OF LOCAL LAW # 1 The new Article TX of the State Constitution extends the power to adopt local laws to towns. Attorney Buyoucos will report to the Town Board at the next meeting on the procedure for adopting Local Law .fl. NOHTHFAST 5FWFB niSTRICT CONTRACT The agreement with the Village of Cayuga Heights for Sewage Disposal for the new northeast sewer district was pre sented. The Board delayed action until they had time to study the agreement. APPROVAL OF MINUTES Councilman Mayer offered the following resolution and moved its adoption: RFSOLVFD, that the minutes of the February 15, 1965 meeting be approved. Seconded by Councilman Bishop Ayes - Kerr, Bishop, Mayer Noes - 0 Carried. SPFED LIMITS - PINE TRFF ROAD Councilman Mayer offered the following resolution and moved its adoption: WHEREAS, residents of the Pine Tree Road area of the town have informed the Board that two different speed limits exist on portions of Pine Tree Road, and - W^HERFAS, that portion of the road approximately 5OO feet, more or less, north of the intersection with Slaterville Road, is a 50 ^Ph speed zone and W^HERFAS, houses have been built recently in this area and the Slaterville Road (Rt. 79) speed limit is now ^5 mph, it would be deemed reasonable to request a lower speed limit, now BE IT RESOLVED, that this Board make an application joint ly with Tompkins County for an establishment of a 35 mph speed zone for the entire length of Pine Tree Road between its inter section with the Ellis Hollow Road and the intersection with Slaterville Road. Seconded by Councilmpn Bishop Ayes - Kerr, Mayer, Bishop Noes - 0 Carried. Supervisor Kerr also requested that Mr. Morey contact the proper authorities to put up at least two more 35 mph signs on the portion of the road now restricted to that speed. COBRESPONDFNCE - STATE TRAFFIC COMMISSION The State Traffic Commission notified the Town Board that their request jointly with the Town of Dryden for a reduced speed limit on Snyder Hill Road had been denied. The State also notified the town that a flashing signal would be installed at the intersection of Judd Falls Rd. and Route 366. CLERK - APPOINTIVE OFFICE No action was taken regarding the changing of the Town Clerk to an appointive rather than an elective position. After dis cussion it was decided to consider this at another meeting when the entire board is present. CROSSING GUARDS The two school crossing guards hired for duty near the new Northeast school were originally hired to work for !^2.5C per day. n 15 cause the local law, or an abstract thereof describing the same In general terms, to be published In the official news paper of the town. Section Proof of publication of the notice of public hearing required by section one hereof and proof of the posting and publication required by section three hereof shall be filed in the office of the town clerk. Section 5. Each local law shall be numbered consecutively beginning with number one for each calendar year. When a local law Is finally adopted, end certified copies thereof are required by section twenty-seven of the municipal home rule lew to be filed In the offices of town clerk, the state comptroller and the secretary of state, the town clerk shall accordingly assign to such local law Its appropriate number. Section 6. This local law shall take effect Immediately. Seconded by Councilman Mayer Ayes - Kerr, Mayer, Baker, McElwee and Bishop Noes - 0 Carried, SPEED ZONE - RENWICK HEIGHTS AREA Supervisor Kerr offered the following resolution and moved Its adoption: WHEREAS, the members of the Renwlck Heights Civic Association have expressed to the Town Board members their desire for a speed limit in their area and WHEREAS, the Civic Association has contacted the State Traffic Commission to request a meeting to discuss this problem now THEREFORE BE IT RESOLVED, that this board Jointly with the County of Tompklns request that the State Traffic Commission make a survey of this area and establish an area speed zone. Seconded by Councilman Bishop Ayes - McElwee, Kerr, Mayer, Baker and Bishop Noes - 0 Carried GL-ENSIDE LIGHTING DISTRICT The members of the Glenslde Light District have voted to add four additional 2500 lumen units @ $23,00 each (total cost $92.00) plus 99^* Circuit @ 2i^ per foot. The total additional cost to the district would be $116.85. Supervisor Kerr offered the following resolution and moved Its ad opt: ion: RESOLVED, that the town finance the addition of these lights to the Glenslde Light District for a sum not to exceed $300. and BE IT FURTHER RESOLVED, that the amount expended be repaid from the Glenslde Light District revenues collected In 1966, Seconded by Councilman Mayer Ayes - Kerr, Mayer, Baker, McElwee and Bishop Noes - 0 Carried, Mr. James Lacy of the N.Y. State Electric and Gas Corp. has notified the Supervisor that the contracts for lighting the portion of Rt, 13 within the town and also a proposal for the addition of additional lights on E, Shore Dr. were ready, but he was not present with them at this meeting. CROSSING GUARD'S PAY The Town Board felt that an adjustment In pay should be made for the school crossing guard working on Warren Rd. nearest the new Northeast school. Each guard now receives $2.50 per day, but the guard at the point nearest the school spends twice as much time as the guard at the corner of Warren and Hanshaw Rds. Supervisor Kerr offered the following resolution and moved Its adoption: RESOLVED, that the pay for the crossing guard nearest the school be adjusted to per day retroactive to March 1, I965 and BE IT FURTHER RESOLVED, that at the end of the school year the guards be asked to recommend any changes in hours or pay that they feel necessary for next year. Seconded by Councilman Baker Ayes - Kerr, Mayer, Baker, McElwee, Bishop Noes - 0 Carried. NOBgHEAST SFWFR DISTRICT A cilsousslon concerning the obtaining of easements for the northeast sewer district followed. Attorney Buyoucos stated that it might take longer than the time left before bids are scheduled to be awarded (Kay 10th), Councilman KcFlwee suggested that an addendum might be added to the bid that would allow the town more time before accepting the bid. Supervisor Kerr offered the following resolution and moved its adoption: HESOLVFD, that the Supervisor be authorized to advertise for bids and to set the date of bid opening for the Northeast Sewer District end BE IT FURTHER RESOEVFD, that if necessary an addendum be added to the bid that the town may have a greater length of time in which to accept a bid. Seconded by Councilman Kayer Ayes - Kerr, Kayer, Bishop, Baker and KcElwee Noes - 0 Carried. WOHKKEN'S COKPENSATION INSURANCE The town must notify the County by June 15th If they wish to withdraw from the County Workmen s Compensation Plan, Supervisor Kerr offered the following resolution and moved its adoption: RESOIVFD, that a specific proposal be obtained from a private Insurance Carrier and after consideration of that proposal a final decision be made. Seconded by Councilman Bishop Ayes - Kerr, Bishop, Baker, KcElwee and Kayer Noes - 0 Carried, ITHACA FESTIVAL In support of the Ithaca Festival the Town Board voted to endorse the resolution previously adopted by the town Planning Board. Councilman Kayer offered the following resolution and moved its adoption: RESOLVED, that in fulfilling our responsibilities in plan ning and future development of the Greater Ithaca area, we here by enthusiastically endorse the Ithaca Pestiva. We firmly believe that the creation of the Festival is compatible with the resources and the spirit of Ithaca as the educational, cultural and recreational center of the Finger Lakes region. Seconded by Supervisor Kerr Ayes - KcElwee, Kerr, Kayer, Baker, Bishop Noes - 0 Carried. CORRESPONDENCE 1) A copy of a bill introduced by Assemblywoman Constance Cook to amend the membership corporations law, in relation to non-profit waterworks corporations was presented. It is primarily of interest to the towns of Newflfeld and Lansing. 2) The State forwarded a duplicate copy of the order of the State Comptroller granting permission for the establishment of the Ellis Hollow Road Sewer District. 3) Letters were read and filed from Kayor Karcham of the Village of Cayuga Heights in regards to consolidation of town, village and city governments and in regards to the provisions of Sect. 277 of the Highway Law regarding Village exemption from paying taxes for Town Highway Items 3 and KULTIPLE RESIDENCE ZONE - SAPSUCKER WCOFS AREA Letters of protest from the Ornithology T.eb, Cornell University, and the Garden Gate Club, plus petitions signed by about 175 area residents in opposition to rezonlng from Residence to Kultiple Residence about 15 lots belonging to Rocco Lucente on Sapsucker Woods Road were received. They were referred to the town Planning Board for their consideration and recommendation. REZONING - SOUTH HII.L Supervisor Kerr stated that he had received no further Infor mation from Developer K. Jack Herman in regards to his plan for the 29.6 acre tract along the Danby Road, Councilman Bishop felt the land should not be rezoned until more details are n 13 Mow that the school has opened it has been found necessary for the guard who is stationed nearest the school to work about twice as much time as the guard stationed at the corner of Hanshaw and Warren Roads, The Clerk was directed to contact the tusrds to see if it would be possible for them to alternate duty. It was the sense of the board that they should be paid in proportion to the time spent, SPRAYING CCMTHACT Supervisor Kerr read a letter from R. F. Pendelton regarding the contract for mosquito control in the town. Councilman Yayer offered the following resolution and moved its adoption: RESCIVFD, that the contract for mosquito control be renewed with Nr. Pendelton for the current year at a price of Seconded by Councilman Pishop Ayes - Kerr, Mayer, Bishop Noes - 0 Carried. REZONING - SOUTH Fill AH^^A Supervisor Kerr reported that he had received no more information from Mr. Herman in regards to the type and quality of motel construction proposed for the South Hill area, A petition signed by 32 residents of the area stated that they are not in favor of a motel, restaurant and bar being construct ed in this area. No further action was taken at this time, YOUTH BUREAU TKFATEB WORKSHOP Supervisor Kerr explained that the amount of |300. had not been included in this year's budget for payment to the Youth Bureau for the theater workshop program, Mr. Jackson Hall spoke in behalf of the Youth Bureau. He said he felt the program was worthwhile and the money well spent. If the Town and the Village of Cayuga Heights would each contribute |l50., the Youth Bureau could apply for an equal amount in State Aid. Councilman Mayer offered the following resolution and moved its adoption: RFSCLVFD, that #150. be appropriated from Contingency to pay the Youth Bureau for their theater workshop program. Seconded by Councilman Bishop Ayes - Kerr, Bishop, Mayer Noes - 0 Carried. SEWERS - FINE TRFE - nOWF.SS LANE ARFA Lozier Engineers, Inc. has forwarded a map and estimates of units involved and costs for a sevjer district in the Pine Tree Rd., Honness lane ares of the town. Supervisor Kerr plans to take a request for needs of sewer and water extension for this area, for the South Hill area, and for the Trumansburg Road area (plus the proposed Ellis Hollow Rd. Sewer district) to the Dep't. of Public Works at their Board meeting on March 10. PUBI-TC HEARINGS No public hearings will be held on the adoption of a Sanitary Sewer Ordinance or an Ordinance to control excavations under highvcays until recommendations have been received on both from the Planning Board, SPEGIAI. IMPROVEMENTS - ROADS Mr, Morey, Sup*t» of Highways, presented the agreement- for expenditures of Highway moneys pursuant to Section 284, Highway Law, It was approved by signing and forwarding to the County Highway Superintendent for approval before filing, WARRANT Councilman Mayer offered the following resolution and moved its adoption: EESCIVED, that Highway Bills #76 through #94 in the amount of #2,235.33 and General Fund Bills #89 through #119 in the amount of #11,307.50 be paid with the following reservation: the check 14 for Bill #99 to American Air Survey Is not to be mailed until Assessor R, J, Wells is certain the Company will correct an error In the mapping of the Pennsylvania Avenue area. Seconded by Councilman Bishop Ayes - Kerr, Bishop, Mayer, McElwee, Baker Noes - 0 Carried LOCAL LAW #1 Supervisor Kerr offered the following Resolution and moved Its adoption: RESOLVED, that a public hearing be held at the Town Office, 108 E. Green St., City of Ithaca on May 10, 1965 at ^:15 P.M. to hear all persons Interested In the adoption of Local Law #1. The law will provide In general for the manner In which the Town Board may adopt local laws pursuant to Municipal Home Rule Law and shall read as follows: A local law providing for public notices relating to adopt ion of local laws Be It enacted by the town board of the town of Ithaca as follows: Seclon 1. No local law shall be adopted by the town board of the town of Ithaca until a public hearing has been held there on In Its final form before such board not less than three nor more than thirty days after public notice has been given of the time and place of the holding of such public hearing. Such notice shall be given by the town clerk by causing the same to be publish ed once in the official newspaper of the town. Such notice shall contain the title of the proposed local law and a brief explan atory statement thereof. Section 2. The town clerk shall cause to be printed or otherwise reproduced copies of such proposed local law and shall, not later then the day such notice Is published, post one copy together with the notice of hearing In a conspicuous place In his office and shall also make copies of such proposed local law available at his office for Inspection by and distribution to any Interested person during business hours.
