SPECIAL BOARD MEETING
April 26, 1988
At a Special Meeting of the Town BocU?d of the Town of Ithaca,
Tcnpkins County, New York, held at the Town Offices at 126 East
Seneca Street, Ithaca, New York, on the 26th day of April, 1988,
there were:
PRESENT: Noel Desch, Supervisor
Henry McPe^, Councilman
Shirley Raffensperger, Councilwcraan
Robert Bartholf, Councilman
Raymond Bordoni, Councilman
Thomas Cardman, Councilman
ABSENT: Patricia Leary, Councilwcman
ALSO PRESENT: Eric Whitney, Assistant Engineer
PLEDGE OF ALLEGIANCE
The Supervisor led the assemblage in the Pledge of Allegiance.
CONDEMNATION ACTIOJ FOR EASEMENT
Supervisor Desch e3q)lained that the property owner, William L.
Lower, would not sign an easement allowing the sewer to be extended
across his property adjoining West Haven Road. The extension of
the sewer is to provide municipal sewer service to properties in
the Town of Ithaca on the east side of West Haven Road and to the
north of Elm Street. Therefore, it would be necessary for the Town
to consider condemnation and schedule a public hearing.
Councilman McPeak asked v^y this public hearing was necessary?
Supervisor Desch replied, to determine that it is in the public
interest to proceed with condemnation.
Councilman McPeak questioned if we were talking about taking the
v^ole piece of land by eminent domain?
Supervisor Desch replied no, just an easement to permit the sewer
to go in. He went on to say that if the lot were developed this
would benefit the lot. If it develops as a road it will not hurt
the road.
RESOLUTIOJ NO. 125
Motion by Councilman Bartholf; seconded Councilman McPeak,
RESOLVED, that the Town Board of the Town of Ithaca will meet at
6:30 P.M., on May 9, 1988 and will at this time conduct a public
hearing, pursuant to Article 2 of the New York State Eininent Domain
Procedure Law to determine the need to acquire under the Town's
power of eminent domain to determine the location of temporary and
permanent easements for a sewer main, proposed to be located
through the lands of Tax Parcel No. 29-6-24.1, owned by William L.
Town Board 2 i^ril 26, 1988
Lower, adjoining West Haven Poad in the Town of Ithaca, v^ich sewer
main would be a public project to extend the Town-wide sewer.
(Desch, McPeak, Raffensperger, Bartholf, Bordoni and Cardraan voting
Aye. Nays - none).
WATER ACXXXINT REFUND
Councilman McPeak questioned how this was determined, was the meter
replaced or what? The resolution says the meter registered three
times more water than was used. How was this determined?
Councilman Bordoni noted that Mr. Boote works with him and that the
refund missed the March meeting by a day and the man is getting
anxious for his refund. He stated that this was a wrong meter
reading.
RESOLOTIOJ NO. 126
Motion by Councilman Bordoni; seconded by Councilman Cardman,
WHEREAS, the water meter at the hone of Robert Boote, 662
Coddington Road has been registering three times more water than he
has actually been using,
NCW TflEREEDRE BE IT RESOLVED, that the Town Board of the Town of
Ithaca herel^ authorize a refund of $332.09 for water and $28.54
for water surcharge, total refund of $360.63 be made to Robert
Boote, 662 Coddington Road, Ithaca, New York. Account Number
F-791.
(Desch, McPeak, Raffensperger, Bartholf, Bordoni and Cardman voting
Aye. Nays - none).
S\:ipervisor Desch stated that this evening he would be meeting with
a small groi:^) of people on the Klondike Manor project, including
representatives from the neighborhood group along with Councilwoman
Raffensperger and Montgomery May and William Lesser from the
Planning Board to see if we can't determine if there is any common
ground to settle on the direction for that whole project.
Councilman Bartholf stated that he had a question relating to the
water and sewer down on Taughannock Boulevard. He stated that he
has had quite a few people coming up to him and asking him vtet was
going to happen and he thought that perhaps he and the Town
Engineer could get together and may be have an open night v^re
these people can come in and we could try and talk to them about
it.
Supervisor Desch remarked, there are a lot of questions, they all
got a letter but there still are a lot of questions.
Councilman Bartholf replied, they are asking how are we going to
puitp it up, v4iat do we use and vtot is the cost.
Supervisor Desch agreed that the cost has to be a big concern. He
suggested that Councilman Bartholf and Town Engineer Flumerfelt get
together and set a time and notify the residents.
Town Board 3 April 26, 1988
Councilman Cardman noted that last week he and Supervisor Desch had
discussed scheduling a meeting of the Town Board, Planning Board
and Zoning Board of i^>peals on Corprehensive Planning.
Svpervisor Desch replied that the joint meeting will be held on May
3rd, that's the Planning Board meeting night and the Comprehensive
Planning Guidelines will be the only item on the agenda.
Supervisor Desch noted a meeting with the Fire Station Design
Ccranittee today at 4:00 P.M. He went on to say that it was
apparent we have a major problem with the design of the fire
stations again so we will be hearing the report from the architect
today.
Councilman Bordoni noted a notice the Board received urging them to
be aware of the Butterfield site plan before the May 9th meeting.
Supervisor Desch replied that the Butterfield project is the Auble
developnent on King Road. It is basically the site of the former
Beacon Hills, vdiich seme of you may remember. It's just about
opposite Ridgecrest Road and the project has been approved several
times but the developer has ccme back with seme subtle changes
which do have an iiipact on the road network vdiich have pretty well
been sorted out with staff and staff is now happy. You need to
take a second to look at the proposals. He went on to say that the
Jones project is unlikely to be ready. That is in the same area
but it is downhill from Ridgecrest but it is primarily off of Troy
Road. There is a circular road grid involved with that project.
Councilman Bartholf noted that there were a couple of houses on
that side of the road now.
Supervisor Desch replied that just down hill from the Butterfield
project. Some of that is Deer Run and seme are lots that Erdman
sold off individually that are being built upon by individmls.
Councilwcman Raffensperger noting the mono about the Ellis Hollow
Elderly Housing resolution and she stated that she had sent a note
to the Town Attorney reminding him he was going to check on legal
status of the fire tax benefit levies.
