FIRE CONTRACT The Board received a copy of updates on the Fire negotiations with the City of Ithaca. Supervisor Valentino stated they had reached a tentative agreement. The contract is back at the City and Chief Wilbur has some questions that need to be cleared up. Agenda Item No. 5 - Public Hearing to Consider Authorizing Acquisition of an Agricultural Easement Supervisor Valentino opened the public hearing at 10:15 a.m., notice of which had been posted and published. There was no one present to comment and Supervisor Valentino closed the public hearing at 10:18 a.m. TB RESOLUTION NO. 2002-210 - Authorizing The Execution Of An Agricultural Conservation Easement Agreement With Garv And Lisa Ferguson For A Conservation Easement On Propertv On Sheffield Road, Ithaca. New York WHEREAS, the Town of Ithaca has in place a program for the acquisition of agricultural conservation easements for the purposes of preserving suitable lands for conservation and agricultural use, pursuant to the Park, Recreation and Open Space Plan adopted on December 8,1997; and WHEREAS, the Town of Ithaca has negotiated extensively with Lisa and Gary Ferguson for such an easement on approximately forty acres of their land located on ^ Sheffield Road in the Town of Ithaca (the "Conservation Easement"); and 1^ WHEREAS, a copy of the proposed Conservation Easement between the Town and Lisa and Gary Ferguson has been presented to this Board; and WHEREAS, the Town Board has considered the proposed easement; and December 31, 2002 Year End Meeting Approved February 10,2003 WHEREAS, the Town Supervisor and Director of Planning who have been involved in n j the negotiations recommend the approval of the proposed easement; and WHEREAS, the Town has established a reserve fund for open space preservation and park and recreation facilities, and said fund contains sufficient monies for the purpose of the acquisition of this Conservation Easement; and WHEREAS, the acquisition of said agricultural conservation easement has been determined to be an "Unlisted Action" pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental , Quality Review Act and the laws and regulations of the Town of Ithaca, the implementation of which as proposed, the Town Board has determined, will not result in any significant adverse environmental effects; and WHEREAS, the Town Board has held a public hearing on December 31, 2002 to consider comments from the public regarding the proposed acquisition of the Conservation Easement; NOW, THEREFORE, be it RESOLVED, that the Town of Ithaca hereby authorizes the execution of the proposed p Conservation Easement agreement with Gary and Lisa Ferguson for the receipt by the i Town of a conservation easement on approximately 40 acres of land on Sheffield ' Road in the Town of Ithaca, such agreement to be in substantially the form submitted to the Board; and it is further RESOLVED, that the Town of Ithaca authorizes the payment to the Fergusons the sum of $71,000 for such easement upon closing the transfer, receipt of the executed deed of the easement, and approval of the attorney for the Town of the title to such easement; and it is further RESOLVED, that the payment of said funds to be made from the Town reserve fund entitled Parks and Open Space Reserve Fund; and it is further RESOLVED, that the Town pay the incidental costs (recording fees, abstracting fees and other similar expenses) not anticipated to amount to more than an additional $1,000, as incurred in order to effectuate such closing; and it is further RESOLVED, that the Town Supervisor and Deputy Town Supervisor be, and either hereby is, authorized to execute said Conservation Easement agreement on behalf of the Town, with such modifications to the agreement as the person executing the agreement may approve with the advice and assistance of the Director of Planning and the Attorney for the Town; and it is further n I RESOLVED, that the execution of such agreement by the Supervisor or Deputy ' Supervisor shall be due evidence of the approval of any modifications to the agreement by such person; and it is further December 31, 2002 Year End Meeting Approved February 10, 2003 RESOLVED, that pursuant to General Municipal Law Section 6 (c), this resolution is subject to a permissive referendum in accordance with Article 7 of the Town Law, and the Town Clerk is directed to publish and post a notice of adoption of this resolution, within ten days of its adoption, together with a copy or an abstract of the resolution and a notice stating it is subject to a permissive referendum. Carried Unanimously Agenda Item No. 10 - Consider Appointment of Deputy Supervisor Supervisor Valentino stated Councilwoman Russell had agreed to serve as Deputy Supervisor for another year. TB RESOLUTION NO.- 2002-211 - Reappointment of Deputy Town Supervisor. BE IT RESOLVED, Mary Russell is hereby re-appointed as Deputy Town Supervisor by Catherine Valentino, Town Supervisor, for a term continuing to January 1, 2004. BE IT RESOLVED, Deborah Kelley is hereby re-appointed as Receiver of Taxes, for a term continuing to January 1, 2004, at the annual salary of $5,175.00. Carried Unanimously Agenda Item No. 7 - Public Hearing to Consider Extension of Memorandum of Understanding with the CItv of Ithaca for Fire Protection Supervisor Valentino opened the public hearing at 10:30 a.m. comment and she closed the public hearing at 10:32 a.m. There was no one present to Supervisor Valentino stated that while the contract negotiations have taken longer than they should, this is an agreement that changes considerably the way the Town contracts for fire protection. It sets up a system that puts a mechanism in place so that every five years the renewal process should be extremely simple. The final results should be well worth the effort spent negotiating the contract. In answer to questions from Councilman Klein, Supervisor Valentino stated she had been pushing for the for the Fire Department monies to be set up in a separate account from the City's General Fund so that the revenues and expenditures could be monitored. The City was not in favor of that. As an alternative they proposed vouchering the Town monthly. This was acceptable to the Town. The Town would keep the interest on its contributions. TB RESOLUTION NO. 2002- 217 - Authorizing The Execution Of A Memorandum Of Understanding With The City Of Ithaca Regarding Fire And Emergency Service Protection December 31, 2002 Year End Meeting Approved February 10, 2003 WHEREAS, the Town of Ithaca has been negotiating with the City of Ithaca regarding a new fire contract; and WHEREAS, the parties have not finalized the full contract and accordingly would like to continue the arrangements previously in existence for fire protection services and emergency services pending the execution of a new contract; and WHEREAS, the City has extended such prior arrangements by the execution of a series of Memoranda of Understanding pursuant to which the City provides fire and emergency service protection for a substantial portion of the Town-wide fire protection district; and WHEREAS, the last memorandum of understanding expires December 31, 2002; and WHEREAS, to assure continued fire protection service and emergency medical service the Town Supervisor has executed a further Memorandum of Understanding with the City pursuant to which the City of Ithaca Fire Department will continue to provide such services until March 31, 2003; and WHEREAS, a copy of the Memorandum so executed has been submitted to this meeting; and WHEREAS, a the Town Board set a public hearing on said Memorandum for December 31, 2002, at 10:30 o'clock a.m., at the Town Hall, 215 North Tioga Street, in the City of Ithaca, Tompkins County, New York, at which time and place all persons interested in the subject thereof could be heard concerning the same; and WHEREAS, notice of said public hearing was duly published as required by law; and WHEREAS, said public hearing was duly held at the place and at the time aforesaid and all persons interested in the subject thereof were heard concerning the same; and WHEREAS, the Town Board believes it to be in the best interests of the Town of Ithaca to enter into a Memorandum of Understanding, pending completion of the fire contract negotiations; WHEREAS, the Town Board, at an earlier meeting, has reviewed and approved, with certain alterations, the terms of the code enforcement arrangements; NOW, THEREFORE, be it RESOLVED, that the Town Board approves the above referenced arrangements for provision of fire protection and emergency medical services for a portion of the Town of Ithaca as more fully set forth in said Memorandum, being the portion of the Town not covered by the contract for such services with the Village of Cayuga Heights for a period ending upon the execution of a new full contract for such services or March 31, 2003, whichever is earlier; and it is further December 31, 2002 Year End Meeting Approved February 10,2003 RESOLVED, that the Town Board hereby authorizes the execution of such Memorandum of Understanding by the Town Supervisor on behalf of the Town. Carried Unanimously Agenda Item No. 13 - Consider Authorization to Enter Into Arrangements for the Preparation of a Grant Application for Funding for Completion of a Joint Hazard Mitigation Plan Supervisor Valentino reported on a meeting of Municipal Officers, Tompkins County and Town of Ithaca staff, and other municipal representatives including Tim Joseph, to discuss the State mandated Hazard Mitigation Plan. The focus of their discussion was how to coordinate the preparation of a joint grant application. Supen/isor Valentino reported that the meeting went very well, intermunicipal cooperation at its best. The County is going to take a leadership role and the Towns and Villages are going to provide support. Mr. Kanter stated that even those municipalities that have already done their own plans seem willing to enter into a County-wide joint plan. The County has agreed to take the lead on this and will be putting together a grant application to try and get some State and Federal Funds to help put this plan together. The next step is for the County Board to discuss and, hopefully, give direction to the County Planning Department to take the lead on this. Supervisor Valentino stated we stand a much better chance of getting grant funding if the County is involved. Mr. Kanter reported the group had discussed a formula for allocating the cost of a consultant to prepare the grant application. Total assessed properly values or population were discussed as possible components of that formula. Ed Marx, Tompkins County Planning, will work on a formula. The total for each community should be in the $5,000.00 range. For purposes of keeping track of the process. Councilman Lesser suggested that we ask the County Representative to report on the project at our monthly board meetings. TB RESOLUTION NO. 2002- 218: Tompkins County Hazard Mitigation Plan WHEREAS; The Federal Disaster Mitigation Act of 2000 encourages and rewards local governments that initiate pre-disaster planning to identify and mitigate where practicable natural and technological hazards within their communities, and to promote the development of more disaster resistant communities; and Pre-disaster mitigation initiatives elsewhere in the United States have improved the ability of local governments to minimize the loss of life and property and disruption to the n December 31, 2002 Year End Meeting Approved February 10, 2003 economic well being of the community due to a disaster, and to lay the foundation for a speedier recovery should a disaster strike; and Residents of the Town of Ithaca are vulnerable to potential natural hazards such as flooding, severe weather including summer storms, windstorms, tornadoes, snowstorms and ice storms, fire and other natural hazards, and technological hazards such as transportation accidents and hazardous material spills; and A number of other municipalities including Tompkins County, the Towns of Caroline, Danby, Enfield, Groton, Lansing and Uylsses, and the Villages of Groton and Trumansburg, have expressed interest in collaborating in the preparation of a joint Hazard Mitigation Plan; and The adoption of said Hazard Mitigation Plan would make the Town of Ithaca eligible for state and federal funding for certain capital improvements and other initiatives to implement the adopted plan; and The Town of Ithaca is eligible to apply for funding from the State Emergency Management Office to cover up to seventy-five percent (75%) of the cost of preparing a Hazard Mitigation Plan; and The collaboration in the preparation of a joint Hazard Mitigation Plan would substantially reduce the cost of preparing such a plan to the Town of Ithaca. THEREFORE, BE IT RESOLVED: That the Town of Ithaca Town Board hereby authorizes the Town Supervisor, on behalf of the Town, to enter into arrangements with the above and other interested municipalities to prepare a grant application for submission to the State Emergency Management Office for the purpose of acquiring funds to complete a joint Hazard Mitigation Plan. Carried Unanimously Agenda Item No. 14 ~ Accept Resignation of Henry Cowan, Town Historian TB RESOLUTION NO. 2002 - 219 - Acceptance of Resignation of Town Historian, Henry Cowan WHEREAS, Henry Cowan, Town Historian, has submitted his resignation to Supervisor Valentino; now, therefore, be it December 31, 2002 Year End Meeting Approved February 10, 2003 RESOLVED, that Town Board of the Town of Ithaca does hereby accept the resignation of Henry Cowan, from the position of Town Historian, effective December 31, 2002. Carried Unanimously Agenda Item No. 15 - Consider Appointment of Town Historian The Board discussed with Ms. Hunter her intention to meet with Matthew Braun, Director of the DeWitt Historical Society to go over their contract and better define the services they will perform. Councilman Lesser suggested looking into the possibility of involving students from either Cornell or Ithaca College. Ms. Hunter stated she would also like to explore involving high school students. Councilman Klein suggested a retired individual may be a good candidate for the position of Historian. TB RESOLUTION NO. 2002- 220: Appointment of Town Historian WHEREAS, Henry Cowan, has resigned as Town Historian effective December 31, 2002; and WHEREAS, Tee-Ann Hunter, Town Clerk, expressed an interest in replacing Mr. Cowan as the Town of Ithaca Historian on an interim basis while the Town of Ithaca determines the role and duties of the Town Historian; now, therefore be it RESOLVED, the Town Board does hereby appoint Ms. Tee-Ann Hunter, 107 Hillcrest Drive, Ithaca, New York as Town Historian for the term of January 1, 2003 through December 31, 2003 or until such time that the Town Board is able to fill the position. Carried Unanimously ^ Agenda Item No. 16 - NYS Association of Towns 2003 Training School & Annual ^ Meeting TB RESOLUTION NO. 2002-221: NYS Association Of Towns 2003 Training School & Annual Meeting December 31, 2002 Year End Meeting Approved February 10, 2003 WHEREAS, the NYS Association of Towns will be holding their 2003 Training School and Annual Meeting February 16-19, 2003 in New York City; and ^ WHEREAS, the attendance at said Training School and Annual Meeting by various Town Officials, Department Heads and employees will benefit the Town of Ithaca by providing additional schooling for these said individuals; now therefore be it RESOLVED, that the Town Board hereby approves the attendance of up to five persons, designated by the Town Supervisor, at the NYS Association of Towns 2003 Training School and Annual Meeting to be held in New York City on February 16-19, 2003; and be it further RESOLVED, the Town Board also approves the payment for overnight lodging; the registration fees; meals and travel on the cooperative municipal bus for each individual attending the said Training School and Annual Meeting. Carried Unanimously Agenda Item No. 9 - Consider Authorization for a Bond Anticipation Note for the n Financing of the Public Works Facilitv | Attorney Barney stated the Town Board did not need to consider this resolution; previously passed resolutions have already delegated to Supervisor Valentino the authority to use bond anticipation notes or serial bonds. Supervisor Valentino reported the Town was in the process of arranging for a Bond Anticipation Note with Tompkins Trust Company. The interest rate will be 1.95%. Mr. Carvill stated it would cost the Town 27,300,000 next year to borrow 1 Va million. Supervisor Valentino stated she will keep monitoring the market and sometime during the year may go ahead and serialize 1 million of it. OTHER BUSINESS Old Town Hall, 126 East Seneca Street In response to questions from Councilman Klein, Attorney Barney stated that the option agreement is only a 1-year agreement, there is not an automatic extension. The Town is getting $1,500.00 per month for maintaining the building under the option agreement with Ciminelli. Mr. Walker reported the Town is maintaining a low level of heat in the building and that there are some leaks developing in the roof. It hasn't started to deteriorate yet but we have to watch it. If we're going to keep it for 5 more years we may have to do some i maintenance work. The electricity is still on; the water has been shut off. The fire alarm is still active. There has been one break-in; the police are watching it more carefully. Mr. Walker does a walk-through once a month and walks around the building once a week. The SWAT team has used the building for practice purposes. OTHER BUSINESS Water Problems Supervisor Valentino spoke to the Board about the water supply problems the City of Ithaca and Cornell are having; the level of haloacedic acids exceed the new EPA standards. Town residents on West Hill get their water from the City and some of the Forest Home residents get their water from Cornell, so some Town residents are affected. The haloacedic acids are a disinfection by-product that occurs when chlorine reacts with organic substances in the water. There are approximately 600 Town services that are supplied by either City December 31, 2002 Year End Meeting Approved February 10, 2003 water or Cornell water. A notice is being sent to all these residents. Active efforts are being made at Bolton Point to make sure that we don't increase concentration of these chemicals in the Bolton Point water supply. These efforts include looking into alternate disinfection methods. Mr. Walker stated you could also use activated charcoal filtration to remove the acids. The letter that is being sent does not officially advocate that there is a need to filter the water and there is not a manufacturer out there that will guarantee that the commercially available sink filters will actually remove haloacetic acid. Approved In the 2003 Town Budget is a West Hill water line that will bring Bolton Point water to customers on West Hill. Councilwoman Russell stated she had received a call from Ruth Mahr of Forest Home expressing an interest in getting Forest Home's water from Bolton Point. Supervisor Valentino stated there might be some trade-offs with Cornell that could make that happen. OTHER BUSINESS Ithaca Tompkins County Transportation Council Councilman Lesser reported that Jonathan Kanter was elected Chair of the Ithaca Tompkins County Transportation Council's Planning Committee. Thank you to Town Staff Councilman Klein thanked the staff for an excellent year. Supervisor Valentino echoed Councilman Klein's sentiments and thanked the Town Board for their help and support.
