At a special meeting of the Town Board of the Town of Ithaca , Tompkins County, New York ,
held at the Town Hall , 126 East Seneca Street , there were present :
PRESENT: Cathy Valentino , Supervisor ; Mary Russell , Board Member; Carolyn Grigorov, Board
Member ; David Klein , Board Member, Ed Conley, Board Member; Bill Lesser, Board Member ; Tom
Niederkorn , Board Member.
ALSO PRESENT: Joan Lent Noteboom , Town Clerk ; John Barney, Attorney for the Town ; Jonathan
Kanter , Director of Planning ; Judy Drake , Human Resources Specialist .
Call to Order: The Supervisor called the meeting to order at 5 : 32 p . m . , and led the assemblage in
the Pledge of Allegiance .
Agenda Item No. 3 — PERSONS TO BE HEARD.
There were no persons present to be heard.
Agenda Item No. 4 — Creation of Part Time Court Clerk Position .
Supervisor Valentino — Ray Bordoni would like to have his own part-time court clerk . We previously
abolished this position . We need to create the position again . It gives Mrs . Drake permission to
advertise the position . The person hired would work with Justice BordoniIs current court clerk for
training . The current court clerk would then discontinue her hours . She currently works about S
hours per work . We would discontinue the employment of Dianne McFall . She is the keyboard
specialist that works about 10- 12 hours per week . This equals about 20 hours .
There is also an agreement that if Mrs . Poole was only the court clerk for one Justice instead of two ;
there is the understanding that there would be a reduction in her hours . We can make up the
difference in the hours without it being an impact . It would be much better for Justice Bordoni ,
Councilman Klein — Do we have three clerks now?
Supervisor Valentino — We have two clerks and a keyboard specialist . Unfortunately, the keyboard
specialist has been being used as a court clerk .
Judy Drake , Human Resource Specialist — We have one full -time clerk and two typist .
Supervisor Valentino — Mrs . Poole ' s hours will be decreased to 37 . 5 hours per week .

Mrs . Drake — The new position will be 25 hours per week . It is the amount of hours that Sue Bordoni
was putting in when she left employment .
Supervisor Valentino — The salary that Ms . Bordoni was making was getting folded into Mrs . Poole' s
salary. It will need to be folded back out into Justice Bordoni ' s court clerk' s salary. We wrote it into
the agreement in case we made a change .
Resolution No. 71 — Creation of Part Time Court Clerk Position.
WHEREAS, at the 219198 Town Board Meeting the Town Board abolished the part- time Court
Clerk position due to the request of Justice Larkin and Justice Bordoni to consolidate and have one
full time Court Clerk; and
WHEREAS, Justice Bordoni has now requested he be allowed to appoint his own Court Clerk
on a part time basis, now, therefore, be it
RESOLVED, the Town Board does hereby approve the creation of a part-time Court Clerk
position pursuant to Section 41 of Civil Service Law, with no change in the current job description;
and be it further
RESOLVED, the said position shall be in job classification "I" as a 25 hours per week position,
eligible for part time benefits; and be it further
RESOLVED, the Human Resources Specialist is directed to file the necessary paperwork with
Tompkins County Personnel.
MOVED Councilman Klein, SECONDED Councilman Conley. A vote on the motion resulted as
follows: Supervisor Valentino, Aye; Councilwoman Russell, Aye; Councilwoman Grigorov, Aye;
Councilman Klein, Aye; Councilman Conley, Aye; Councilman Lesser, Aye, Councilman Niederkorn,
Aye. Carried Unanimously.
Agenda Item No. 5 — Motion to Enter an EXECUTIVE SESSION .
Motion made by Councilwoman Russell , seconded by Councilwoman Grigorov to enter into an
Executive Session to discuss a personnel matter. Carried unanimously. The Board entered
Executive Session at 5 : 36 p . m .
Motion made by Councilman Niederkorn , seconded by Councilman Conley to resume regular
session . Carried unanimously. The Board resumed regular session at 6 : 50 p . m .
Supervisor Valentino — Mr . Kanter and I talked about this . We decided to rescind the Genex
appraisal . It needs to go to the committee . There are other projects that might be a higher priority.

Councilman Niederkorn - I am not going to support this . It is not that important . It was not that
important Monday night . We voted for it and I do not see a reason why it should be rescinded .
Councilwoman Russell - I read in Mr. Kanter's memo that the policy in our procedures book is that
the properties are only to be appraised on the recommendation of the Agricultural Committee .
Mr . Kanter - That is correct .
Councilwoman Grigorov - We quickly formed the Agricultural Committee .
Supervisor Valentino - We formed the committee quickly so that we could send these things to them .
It is one of the reasons that we did it . I believe that the Agricultural Committee needs to evaluate
this . There are other considerations . I believe that we were misled on the urgency of doing this .
Councilwoman Russell - Is there an urgency for the New York State grant ?
Mr. Kanter - We have two other appraisals that are currently being conducted that are ahead of
Genex. We have a third appraisal that is done that may or may not be able to be applied to the
auction sale .
Councilman Lesser - What was compelling for me was the notion that there was something about
the grant application . If it were not the case , then I would assume that it wait .
Mr . Kanter - I think that we should wait . We have several possibilities of grants at this point .
Foundation grants have a more flexible timeframe . There is nothing about the grant application
process that would make us go ahead with the Genex appraisal . There are several people , including
Mr . Frantz, which figured that Genex is at the top of the criteria list . The committee has not reviewed
the criteria . They do not know what the criteria basis is .
Supervisor Valentino - There is a chance that Genex might donate the development rights to the
Town .
Mr . Kanter - This is a business , not a family or an individual farmer. There are policy questions that
need to be dealt with .
Resolution No. 71 - Rescind Resolution No. 6712000, Authorization to Obtain Appraisal for the
Potential Purchase of Agricultural Conservation Easements.
WHEREAS, on May 8, 2000 the Town Board adopted Resolution No. 6712000, a resolution
authorizing the Planning Department to obtain an appraisal of the property owned by Genex Coop
Inc. , 391 Pine Tree Road, at a cost not to exceed $875. 00; and
WHEREAS, the Town Board has had further discussion related to the same and has
determined that obtaining an appraisal may be premature; now, therefore be it

RESOLVED, the governing Town Board hereby rescinds Resolution No. 6712000,
`AUTHORIZATION TO OBTAIN APPRAISAL FOR THE POTENTIAL PURCHASE OF
AGRICULTURAL CONSERVATION EASEMENTS"
MOVED Councilman Conley, SECONDED Supervisor Valentino. A vote on the motion resulted as
follows: Supervisor Valentino, Aye; Councilwoman Russell, Aye; Councilwoman Grigorov, Nay;
Councilman Klein, Aye; Councilman Conley, Aye; Councilman Lesser, Aye; Councilman Niederkom,
Nay. Motion carried.
Agenda Item No. 6 - Motion to Adiourn .
As there was no further business to come before the Town Board , a motion was made by
Councilman Niederkorn , seconded by Councilman Conley to adjourn . Carried unanimously.
Supervisor Valentino adjourned the meeting at 6 : 57 p . m .
