At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County, New York, held
at the Town Hall , 126 East Seneca Street, there were present:

Call to Order: The Supervisor called the meeting to order at 5 : 33 p . m . , and led the assemblage in
the Pledge of Allegiance .
Agenda Item No. 3 — Report of Board of Representatives
Tim Joseph , Board of Representatives — The County Board has been occupied with the Capital'
Program and the tobacco revenues . These are two items that could be related . The Capital
Program includes the public safety building , the radio and towers project, the new library, the old
library, Coddington Road and many other items that make it the biggest year for Capital Projects . It
comes along at the same time that the County is receiving revenue from tobacco funds .
Many board members feel it makes good sense to use the tobacco settlement money to take of
capital projects . However, there are others who feel it should be used for health issues and for
tobacco prevention . Then there. are others who feel the money should not be designated for
anything in particular. We seem to be locked into a three-way disagreement with no way of having a
majority vote .
Councilman Lesser — The County considered solar power for the new library. I understand the
interest in conservation , but wonder if it is financially viable even with the 50% State subsidizing .
What kind of message would be sending if we put it into place ?

Mr. Joseph — I think that it was a mistake to try solar power as a money saving choice , which was
done in the first place . The figures did not hold up . We need to know the expense involved in putting
the solar panels on . When we looked at the cost it was determined that it will either save money or
lose money. It all depends on the future cost of electricity from the grid . The cost of the system and
what it will produce is known . This is not new technology. Solar technology is well established . We
know how much electricity we will get out of the system and what it will cost us . We do not know
what to compare it with . The optimistic projection is that utility rates will decrease one percent per
year. If that is true , we will pay an extra $ 10 , 000 to $ 15 , 000 per year by having the solar system .
Agenda Item No. 4 = Report of Fire Commissioners :
Gregory Kirkpatrick , town representative on the Board of Fire Commissioners commented on his
written report . See Attachment #1.
Resolution No. 58 - Recommendation of Appointment Board of Fire Commissioners.
WHEREAS, Robert Romanowski's term on the Ithaca Board of Fire Commissioners as a Town of
Ithaca representative expires on June 30, 2000; and
WHEREAS, Mr. Romanowski wishes to re-appointed to the said position; and
WHEREAS, the appointment to the said position is made by the City of Ithaca Common Council
based upon a resolution recommending appointment by the Town of Ithaca Town Board; now,
therefore, be it
RESOLVED, the governing Town Board hereby requests and recommends that the City of Ithaca
Common Council appoint Robert Romanowski as a Town of Ithaca representative on the Board of
Fire Commissioners for a three year term commencing July 1 , 2000 through June 30, 2003.
MOVED Supervisor Valentino, SECONDED Councilwoman Russell. A vote on the MOTION resulted
as follows: Supervisor Valentino, aye; Councilwoman Russell, aye; Councilwoman Grigorov, aye;
Councilman Klein, aye; Councilman Conley, aye; Councilman Lesser, aye; Councilman Niederkorn,
aye. Carried unanimously.
Agenda Item No. 5 - T21 Tompkins County Highway Projects, Hanshaw Road and Coddington
Road :
Ward Hungerford , Tompkins County Highway Manager provided the board with an update of the
Hanshaw Road and Coddington Road projects . During the discussion about Coddington Road the
board asked questions about where the project would start and end , whether there would be
shoulders , and items such as when the project would start and end .
After a brief discussion , the board expressed these concerns :

"The road does need work , and good pedestrian and bicycle shoulders are needed , especially north
of the Ithaca College exit .
'Widening the driving lanes is unnecessary and undesirable, and there is no need for an alternative
route for 96B traffic . There was concern about including these items in the grant application .
Valentino, Grigorov, Lesser, Russell (and others) commented , and there was general agreement .
Comments were also submitted by the public. See Attachment #2 and #3.
Agenda Item No. 6 = PERSONS TO BE HEARD .
Leon Zaharis, 1398 Mecklenburg Road approached the Town Board and requested that the speed
limit on Mecklenburg Road be reduced . He told the board of the problems with speeding and
pedestrians with the present speed .
As a result of the discussion the Town Board adopted the following resolution :
Resolution No. 59 = Speed Limit Reduction Request Mecklenburg Road (Route 79).
WHEREAS, Mecklenburg Road (Route 79) is a road within the Town of Ithaca; and a reduction of
the speed limit has been requested; now, therefore be it
RESOLVED, the governing Town Board hereby requests, through the County of Tompkins, that
the State of New York Traffic Safety Division consider a linear speed limit of 40 MPH for the portion
of Mecklenburg Road (Route 79) from the Town of IthacalTown of Enfield line to 100 feet west of
West Haven Road.
MOVED Councilman Lesser, SECONDED Councilman Conley. A vote on the motion resulted as
follows: Supervisor Valentino, aye; Councilwoman Russell, aye; Councilwoman Grigorov, aye;
Councilman Klein, aye; Councilman Conley, aye; Councilman Lesser, aye; Councilman Niederkorn,
aye. Carried unanimously.
David Ritchie , 160 Crescent Place presented a survey to the Town Board showing the percentage of
residents in the neighborhood of Coddington Road who would "favor paving the shoulders" during the
Tompkins County repair project , (see attached survey) . The Town Board discussed the concerns of
the neighborhood residents with Mr. Ritchie .
Agenda Item No. 7 — Driveway Easement for Timothy Ciaschi Across Trail Strip.
Resolution No. 60 - Approval of Easement to Timothy Ciaschi Woolf Park on Woolf Lane.
BE IT RESOLVED, that the Town Board hereby grants an easement to Timothy Ciaschi to
construct an easement for a driveway across the Town of Ithaca trail north of Woolf Park /Tax Parcel

23. 4 . 40), just east of Grove Road, such easement to be 25 feet in width, to terminate when the road
extension between Grove Road and Woolf Lane is completed and conveyed to the Town as a public
roadway, and, it is further
RESOLVED, that the Town Supervisor be, and she hereby is authorized to execute such
easement, on behalf of the Town in form satisfactory to her, with the advice of the Attorney for the
Town, and she is further authorized to execute such additional documents and to take such further
steps as she deems appropriate or desirable to effectuate the foregoing resolution.
MOVED Councilwoman Grigorov, SECONDED Councilman Conley. A vote on the motion resulted
as follows: Supervisor Valentino, aye; Councilwoman Russell, aye; Councilwoman Grigorov, aye;

Agenda Item No. 8 - Resolution Supporting the Quality Communities Demonstration Program
Grant.
Mr. Walker - I did not think the language within the proposed resolution is correct . We do not have a
fluidized bed incinerator at the Wastewater Treatment Plan .
Mrs . Noteboom - This is the resolution presented to me by the City of Ithaca to use for the gran
application . This resolution has already been presented to the city for inclusion in the application .
We sent them a letter saying that after its formal adoption by the Town Board we would send a
certified copy to the City. This what I was told to do .
Supervisor Valentino - I think there is something missing . Unfortunately, this draft was sent to the
state as part of the grant application the city submitted .
Mr. Walker - Where did the information come from ?
Supervisor Valentino - It is from the City of Ithaca .
Councilwoman Russell - The grant application was for funding from the state to support the Regional
Planning Committee that was formed for this county. There are two paragraphs that do not fit the
intent of the resolution .
Attorney Barney - The Town can adopt another resolution to modify the previously approved
resolution .
Councilwoman Russell - There is a letter from Mayor Cohen that says , " below is a resolution that
Jerry Cook sent me from another community that you can use as a model . " It was taken frog
another municipality, which has a specific project that involves sludge disposal .

Supervisor Valentino - We will need to make corrections to the resolution . I will talk with Mayor
Cohen . The letter that was sent is fine . We will look at the grant and draft a new resolution for the
June meeting .
Councilwoman Russell — This one also has the wrong dollar amount.
Attorney Barney — Does the grant say that the Town is planning on passing this resolution ?
Supervisor Valentino — Yes .
Attorney Barney — We did not certify that we had passed this resolution ?
Supervisor Valentino — We were careful in the wording of the letter to indicate that formal adoption of
the resolution was forthcoming . The grant application was done very quickly. Someone from the city
had to hand carry it to Albany to make the deadline . It was a tight schedule for applying for this
grant . There were several different entities working on it . Somebody at the City should have looked
at our resolution more closely,
A enda Item No. 9 — Local Law No. 1 /1982 and Local Law No. 8/1985 Related to Park Use.
Supervisor Valentino — The law was written in 1982 and needs to be updated , but I wanted the board
members to have the information . We can defer this to another date .
Councilwoman Grigorov — I was surprised that pedestrians have to give way to bicyclists .
Councilwoman Russell — I was surprised that cross-country skiing and horses are prohibited .
Councilwoman Grigorov — Cross-country skiing is allowed , downhill skiing is prohibited .
Supervisor Valentino — I need to have volunteers to serve on a committee to review the local laws ,
and to make recommendations and changes . Then we can bring this item back to the board . I would
like to have Councilman Niederkorn , Councilman Lesser, and Councilwoman Russell serve on the
committee.
Councilman Klein — I think that we should ask Rick Schoch the Parks Maintenance Manager on the
com m ittee.
Supervisor Valentino — The Highway Superintendent and the Town Clerk should also serve on the
committee. Mrs . Noteboom is responsible for some items in the local law. I would also like to serve
on the committee .
Mrs. Noteboom — This is before the board because last month the Fingerlakes Running Club came
before the board about an event they will be holding on the South Hill Trail . We thought they would
need a permit because of the local laws , but the local laws really deal with park use .

I do not think these laws are applicable for trails. We should not have them fill out a permit , or
charge them a fee. They are going to provide a liability insurance form for allowing them to use the
trail . I am going to require that they announce and post the event . They are going to be bringing in
two portable toilets , and they will provide parking at the local school . I am not going to require them
to fill out the permit application or pay the fee .
Attorney Barney - I would also like to be on the committee to better understand the changes to the
local laws when drafting the new ones .
Supervisor Valentino - The committee will work on the local laws , and bring their recommendations
back to the board .
After a brief discussion by the board, the Town Supervisor made the following appointments to the
Park and Trail Use Committee: Catherine Valentino, Town Supervisor* Thomas Niederkorn,
Councilman; William Lesser. Councilman; Mary Russell, Councilwoman; John C. Barney. Attorney for
the Town; Joan Lent Noteboom, Town Clerk; Fred Noteboom, Highway Superintendent; Rich
Schoch, Parks Maintenance Manager.
Agenda Item No. 10 - Use of Voting Machines by School Districts & Villa a of Cam a Hei hts
Supervisor Valentino - Why are we delivering voting machines to locations in the Town of Caroline?
Mrs . Noteboom - The voting machines are used for the Ithaca School Board elections .
Supervisor Valentino - Caroline has their own voting machines .
Mrs . Noteboom - They will not allow the school district to use their voting machines .
Mr. Noteboom - We have never delivered the machines to Caroline before . This is what prompted
the discussion .
Mrs . Noteboom - The Ithaca City School District borrows their voting machines from local
municipalities to hold their school board elections and mock elections . It was not an issue when we
were delivering machines to one or two locations in the Town of Ithaca . We have been so generous
that everyone wants the Town of Ithaca to provide them . The cost is becoming expensive .
The Ithaca City School District is made up of other taxpayers than just ours . It is also comprised of
many surrounding municipalities . Why should our taxpayers be paying for providing for the
machines?
I recommend that the Supervisor write a letter and explain that the cost is becoming too expensiv
for the Town to provide the machines to so many locations .

Supervisor Valentino — I will call Don Barber about the Caroline school . I think that the Town of
Caroline should be providing the machines . I would like to see a motion that the Town of Ithaca does
not provide any voting machines outside of the Town of Ithaca .
Councilwoman Grigorov — Does it include the Northeast School ?
Supervisor Valentino — The Northeast School is in the Town of Ithaca . The Cayuga Heights School
is in the Town of Ithaca .
Mr. Noteboom — The Village of Cayuga Heights does not own any voting machines .
Supervisor Valentino — We provide the Village of Cayuga Heights with voting machines . They pay
taxes for them . I do not have a problem supplying the schools within the Town of Ithaca with voting
machines .
As a result of the conversation Councilman Lesser made the following motion:
Resolution No. fit - Approval of Use of Votina Machines by Ithaca City School District and
Villa a of Cayuga Heights.
WHEREAS, the voting machines owned by the Town of Ithaca have been utilized by the
Ithaca City School District and Village of Cayuga Heights for school board elections and village
elections, and
WHEREAS, there is a significant cost to the town for the delivery and administration of
paperwork when these voting machines are loaned to the said entities, and
WHEREAS, the Ithaca City School District has requested that a voting machine now be
delivered within the boundaries of the Town of Caroline which would significantly add to the cost for
the Town of Ithaca; now, therefore be it
BE IT RESOLVED, the governing Town Board hereby approves the use of voting machines
owned by the Town of Ithaca by the Ithaca City School District in only those locations which are
located within the boundaries of the Town of Ithaca; and, be it further
RESOLVED, the governing Town Board also approves the use of the voting machines owned
by the Town of Ithaca within the boundaries of the Village of Cayuga Heights.
MOVED Councilman Lesser, SECONDED Supervisor Valentino. A vote on the motion resulted as
follows: Supervisor Valentino, aye; Councilwoman Russell, aye; Councilwoman Grigorov, aye;

Mrs. Noteboom — Do we still want to have the machines delivered for the government class and the
Student Council elections?
Supervisor Valentino — Yes . I think that it is a good service .
Mr. Noteboom — We have never had a problem with delivering the machines to the schools .
Councilman Klein — The school district election is May 16th .
Mrs . Noteboom — We cannot stop the delivery to the Caroline school this year , it is to late . They
need to be set up and sealed . We will need to do it this year.
Councilman Conley — Who volunteered the Town of Ithaca?
Mrs. Noteboom — Last year the day before the election the school district told us that the Town of
Caroline would not allow them to the machines . They asked the Town of Ithaca to help out .
Agenda Item No 11 — Amendments to the Water/Sewer Benefit Assessment Formula .
Supervisor Valentino — We can pass a resolution to change the formula because the requiremen
are not under a Local Law. Should we name the specific parcels to be excluded ?
Attorney Barney — No , it should be done as an amendment to the Water/Sewer Assessment Formula
that would exclude parcels that are owned by the State of New York for which no water or sewer
connections are provided .
Councilman Lesser — Is the State responsible for capital costs?
Attorney Barney — The Water and Sewer Benefit Assessments include an operating and
maintenance component , and a capital component . If the assessment were just for capital costs ,
then they would owe the money. Once we move into operating and maintenance , we have crossed
over the line that the statue allows .
Councilman Lesser — Could we partition it and say that a certain amount is operational and a certain
amount is capital ?
Attorney Barney — That could be done .
Supervisor Valentino — All the billings total only $ 122 . The problem is the staff time and everything
involved in the procedure exceeds the amount we would receive .
Councilman Klein — When we worked on the revision to the formula we were more conscious of t
portion of the assessment that was to go to capital cost . In prior years it was much more flexib
We did ask Mr. Carvill for the debt service . We are trying to raise the capital cost .

Mr . Walker — We are using fees generated from sales to cover some of the capital cost . I do not
think that the benefit assessment covers it .
Councilman Klein — I think that we are trying to keep the capital costs down .
Councilwoman Russell — Is that a statutory requirement ?
Attorney Barney — The capital costs are typically taken out of the sales .
Supervisor Valentino — It also helps us understand our investments , our debt services , the operating
expenses, and the revenues that are generated .
Resolution No. 62 - Approval of Amendments Water/Sewer Benefit Assessment Formula.
BE IT RESOLVED, that the water/sewer benefit formula used for determining the benefit
conferred upon parcels by reason of sewer and water projects be amended to eliminate any
advalorum assessments on lands owned by the State of New York which are not using water or
sewer service.
MOVED Supervisor Valentino, SECONDED Councilwoman Grigorov. A vote on the motion resulted
as follows: Supervisor Valentino, aye; Councilwoman Russell, aye; Councilwoman Grigorov, aye;

Agenda Item No. 12 — Owner Occupancy Requirements for Sapsucker Woods & Cayuga Vista
Developments:
Mr. Frost — A memorandum regarding this item was presented to the board last month .
Councilman Klein — Should we refer this to the Planning Board ? Is this something that has been
between the Town Board and Planning Board ?
Attorney Barney — The Planning Board had approved the Cayuga Vista Development .
Councilman Klein — Councilwoman Grigorov and I served on the Planning Board at the time of the
approval of the developments .
Councilwoman Grigorov — It was felt there was a big concession being given to the owner for their
development on the condition that it be owner occupied .
Attorney Barney — The Sapsucker Woods development was governed and handled by the Town
Board, The Planning Board might have had some involvement .

Councilwoman Grigorov — I remember that the Planning Board passed Sapsucker Woods because of
the owner occupancy requirement .
Mr. Frost — It was 1984 when Local Law No . 4 of 1984 was adopted . It related to Rocco Lucente ' s
Sapsucker Woods Road Subdivision . It permitted the conversion of 14 dwelling units into 4- unit
buildings for Multiple Residences . It is on Page 843 , of the appendix of the current Zoning
Ordinance . It is an R- 15 zone with the Multiple Residence buildings .
In the past several years the Town Board has been forestalling any enforcement for non -owner
occupancy in many of the buildings . We started issuing operating permits in 1983 . We found that a
lot of the buildings were not owner occupied . The owner occupancy requirements stated that 2 or 3
out of 5 years the building had to be owner occupied . At other times it could be rented . We found
many buildings were not owner occupied . We have issued new operating permits within the last few
months . We have had a lot of complaints and people threatening to sue the Town because the
owner occupancy restriction is not being enforced .
The Cayuga Vista properties have also been discussed in past years . We have not had any recent
complaints, but the same owner occupancy provisions are in place for those .
I am somewhat nervous about this because people will be upset that my office is not enforcing t
rules and regulations . I feel that the Town should either enforce or change the law.
Supervisor Valentino — I think that the last paragraph of Mr. Frost' s memo is the most important . It
states , "We should either take an active role in enforcement or change the law . We have been
ignoring it until this point . We have come to the point where we cannot ignore it anymore . I think that
we need to change the law.
Mr. Frost — The complaint has been that we are not enforcing the regulation . We had a small,
problem with students making noise at Cayuga Vista . Overall we have not had any complaints that
would have been controlled by owner occupancy. Sometimes there is excessive garbage and noise .
Supervisor Valentino — They can be controlled by our other regulations and laws .
Mr. Frost - I do not think that we are accomplishing much with this law.
Councilwoman Grigorov — These subdivisions would never have been approved in the first place
without these requirements .
Mr . Frost — In recent years the Town Board and the Planning Board have been careful not to impose
such conditions .
Supervisor Valentino — I think that history has shown us that it is a law that is almost impossible
enforce .

Councilman Niederkorn - Is this regulation in the Zoning Ordinance?
Mr. Frost - The Sapsucker Woods development is in the Zoning Ordinance .
Councilman Niederkorn - Mr. Lucente owned about four units . I cannot imagine that he would be
able to occupy all four.
Attorney Barney - The condition at the time , was when he sold the properties they had to be owner
occupied .
Councilman Niederkorn - It is almost impossible to enforce . You cannot make somebody live
someplace forever.
Supervisor Valentino - I think that we need to do more about it . We need to schedule public
hearings to receive other input .
Attorney Barney - The issue should be reviewed by the Planning Board because any changes would
be an amendment to the Zoning Ordinance ,
Mr. Frost - The Cayuga Vista development was clearly approved by resolutions during the Planning
Board ' s site plan approval . I think that the Planning Board needs to change the condition .
Councilwoman Grigorov - The Planning Board has also given concessions to individuals if they
agree to these requirements .
Attorney Barney — The Town Board should refer the matter to the Planning Board for a
recommendation . Then it could come back to the Town Board for a public hearing .
Mr. Frost — The Cayuga Vista development was not approved through a local law, it was approved by
resolutions of the Planning Board .
Attorney Barney — The Town Board always approves the restrictive covenant. I think it was in the
restrictive covenant .
Councilman Niederkorn - Are we going to give the Planning Board any directions as to what we are
thinking?
Attorney Barney - We can explain it on behalf of the Town Board .
Councilman Lesser - I think that they need to have an unbiased judgement . There is no point in the
Town Board telling the Planning Board what we think they should do .
Attorney Barney - I think that the very fact that the Town Board is referring the matter to the Planning
Board for a recommendation suggests that the Town Board is considering the matter .

Supervisor Valentino — When the Planning Board does put restrictions on a resolution , experience
shows that some of the conditions work very well . Experience also shows that some do not work

Agenda Item No 13 - Approval of Purchase of Security Systems for the New Town Halt :
Supervisor Valentino — Mr. Carvill worked out our capital budget for the Town Hall . He went back
when it was originally set up . Instead of looking at one year we looked at everything , even includin
the change orders . Mr. Carvill wrote a summary of where we are .
Mr. Carvill showed the original budgets from 4/ 1 / 1998 and 1 /1 /2000 . Some of the lines where we
had the electrical contracts and the plumbing contracts are in place . The budget changed from the
original budget of $ 1 . 7 million . The contract expenses have been included , and the summary also
shows the cash on hand and the cash that we have set aside .
We had some change orders from February, March , and May. When we add the change orders ,
furniture and networking we are very close to what we said we could spend on the project . There is
going to be more change orders , and we are going to have to figure out how to come up with the
extra money.
The referendum that formed the project together set the amount not to exceed $2 million . Some
items that were not in the capital budget can probably be taken from our General Fund .

Mr. Walker — We received four different quotes . There are two components . One is a card syste ,
as opposed to a key control system . The contract we are looking to set up provides a master k
system for the entire building that we would maintain .

The Fire Department will have a master key to open any door in the building. The access system is
only for the two exterior entrances to the building . One on Aurora Street at the side parking lot . This
is the primary employee entrance . It is intended that it remain locked at all times except in the
evenings when there are meetings held in the rear conference room .
The Buffalo Street door would have access to employees . We would limit access to employees after
closing. The door would remain open during the day.
One of the advantages of an access card system is that we can monitor employees in the building .
We can deactivate and activate cards . All four systems will provide that type of control .
We received quotes on two brands . The Glad system provided only the hardware and software with
little support . The Doyle , ADT and Sonitrol systems have security. They can provide a central office-
dispatching situation . We could include a door hold open alarm . If the door is kept open for more
than a certain period of time , it sends a signal to the central office and they notify the police . The
Glad system would not have that . They would have an internal alarm , but it would not call anyone .
Another feature includes three panic buttons . One each would be located at the Town Clerk's Office ,
the Court Clerk's Office and the Justice bench . If there was an emergency they could hit the button
and a signal would be sent to the central security office . The security office would then call the
police . Doyle and ADT have quick responses .
Mrs. Drake — We asked for municipal references and both Doyle and ADT had a good number of
municipal references . One of the references from Doyle was a village police station that had the
same panic buttons for their clerks and judges . They had rapid response when they pressed the
button . They thought that when the button was being pressed it was going right to the police station .
Councilman Klein — Is it on a dialer?
Mr. Walker — Yes . It is on a high- speed dialer.
Councilman Klein — Do they have a dedicated phone line ?
Mr . Walker — It would need an available phone line that would probably be dedicated .
Mrs . Drake — I spoke with a representative of a Department of Public Works . They have the access
system we were looking at . It was installed last December. They are now expanding the system .
Councilwoman Grigorov — Would we need to pay extra for the cards?
Mrs . Drake — We would need to purchase the cards with Doyle security. We were not sure which
system we wanted . The other systems include their cheapest cards .
Councilman Klein — Does the system come with a computer to issue cards ?

Mrs . Drake — We would be purchasing a windows based program . Doyle , ADT and Glad would have

Mrs . Drake — We could set the Buffalo Street entrance to open for Town Board meetings at 4 : 45 p . m .
and close at 9 : 00 p . m . It will do it automatically.
Councilwoman Russell — Which system has the programming?
Mrs . Drake — Sonitrol was the only system that had the administration .
Supervisor Valentino — It would be about $ 1 , 000 per year for maintenance cost .
Mrs . Drake — it would not take a lot of administration to run the system . It is not worth paying that
kind of money to have someone else do the administration . Doyle and ADT could be set up with a
modem to someone' s computer. If Town Hall were closed due to snow, i could go in and make sure
the doors were locked .
Councilman Lesser — What do we do now? We will have fewer doors .
Mrs . Drake — Now everyone has a key. There is no control . People can come in and out whenever
the want. We have had many occasions when front and back doors have been left open . This
building does not have any security.
Councilman Lesser — The initial cost is very attractive . We are talking about on -going cost of more
than $700 a year, it is $20 a month for monitoring , $20 a month for a phone line , $50 a year for
maintenance . The costs are also bound to increase. We are committing ourselves to a lot of on-
going expenses .
Mrs . Noteboom — I think the amount of security this system offers is well worth those monthly costs .
We are also going into a much different situation in the New Town Hall . We are now going to be
having the courts in the building . We are going to need extra security for the courts .
Councilman Klein — The use of the building is going to be more intense .
Mrs . Noteboom — The Town Clerk' s office is located in the front of the building. There are solid walls .
No one in the back is going to be able to see if we are in trouble .
Councilman Klein — I think that the alarm system at the Town Clerk' s office is mandatory .
Mrs . Noteboom — We are unable t0 see the Court Clerk' s to see if they are in trouble .

Management . My budget is going very well this year.

Mr. Walker — I have been talking with two different vendors . I received one quote of about $ 101000
that included two systems , one for the Town Justice side of the boardroom and the other at the Town
Board side . We need two sets of speakers. One set facing either end will not provide adequate
sound for the other side . We do have the option of 13 to 16 microphones .
The vendors have not had a chance to see the room in its finished state . They will view the rooms
next month .
Supervisor Valentino — This issue needs to be deferred until the June meeting . We need the vendors
to view the room and determine the acoustics of the building .
Councilwoman Russell — Is the cost of this equipment included in the budget?
Mrs . Noteboom — No . The security system , audio system , moving and furniture are not included in
the budget.
Agenda Item No 16 — Change Orders Related to the Renovation of the New Town Hall :
Mr . Walker — There are five specific change orders . One is to change the sheet vinyl flooring in the
two bathrooms and hallway in the front lobby. We eliminated these changes in the other bathroUm _
that brought the cost down to $2 , 823 .

The second change order included 5 or 6 different additional removals that had to be completed
throughout the project. The contractor totaled them at $2 , 734 . There was a window in the Justices'
bathroom that the architects missed on the drawings . The plans called for the window to be covered
by sheet rock, but I thought it was important to repair the window, not cover it . The contractor has to
replace the window glazing , and that will cost about $288 .
The next change order is to modify an existing beam in the arched roof of the entryway that is not in
the center of the opening . The opening is being widened to center it and keep it balanced .
Proposal 16 is to replace the Tioga Street main door with a new aluminum frame and all new
hardware. It is not a power door, but it will have insulated glass . The current door has a big gap
between the door and the hitch .
Supervisor Valentino — The old door would have made the lobby very drafty and cold . The door on
the Buffalo Street side was included to be replaced in the original contract .
Mr. Walker — The change orders total $ 11 , 270 .
Councilman Klein — I have been a strong proponent of the ceramic tile , but because of all the change
orders I would like to change my opinion and keep the sheet vinyl flooring in the bathrooms .
Mr. Walker — The ceramic tile has been ordered . It was over $4800 .
Councilman Lesser — Each change order is not big , but combined they are . At some point we need
to watch costs. Can we do this at another time?
Mr . Walker — We have ordered the door.
Councilman Lesser — What is the purpose of the Town Board going through the process of approving
change orders if all the decisions have been made ?
Mr. Walker — This is the formal process of changes being ratified by the board . The Town Board did
give me authority to make change orders up to $5000 . 1 discussed these with the Supervisor.
Supervisor Valentino — I was the strongest promoter of getting the new door. The old door has big
gaps and is single-paned . The heating bills generated because of the old door would have been very
large .
Councilman Lesser — We need to figure out where we are going to start controlling costs .
Mr . Walker — I have another $20 , 000 in change orders in process that are not included in the
amounts given to the board this evening . There will still be expenses in changing the Buffalo Street
steps . The brick foundation was beyond repair and needed to be replaced .

WHEREAS, the Town of Ithaca on January 3, 2000, entered into a contract for General
Construction for renovation of the Town Hall with Sarkisian Bros. , Inc. for the Original Contract Sum of
$969, 000. 00, and;
WHEREAS, during the process of demolition and construction on the project a number of
conditions were identified requiring changes to the original scope of the project plans which hay
required additional work to be performed by the Contractor, and,
WHEREAS, the Contractor has been asked to perform this additional work and prepare
Contractor Proposal Requests (CPR) describing the work and documenting the additional sums to be
paid for this additional work; and
WHEREAS, the Town Engineer and the Architect have both reviewed the following and have

Agenda Item No. 17 — Appointment of Members to Agricultural Land Preservation Advisory
Committee :
Supervisor Valentino — George Frantz, Assistant Town Planner has requested that we consider
having an appraisal of the Genex property, but I would rather delay this until the new committee can
look at it . We need to get our procedures in place . We need to look at the evaluations to determine
where they should be as a group . Beyond that , I think that Mr. Frantz has done a very good job of
looking at the ranking . He has a good case to be made for why we should think differently about it .
Mr. Frantz — The question is whether the Town Board would be comfortable going forward and
authorizing an appraisal of this parcel . Our policies state that the new advisory committee is to
review applications and make a recommendation to the Town Board as to whether we should
proceed with an appraisal of a property.
There are issues about this particular property that make me comfortable in recommending that the
Town Board authorize an appraisal without going through the committee . We received the
application April 12, 2000. My concern is that if we put off any Town Board action on authorizing the
appraisal of the property it is going to be a full two months between the time we received the
application and the time the Town Board authorized an appraisal . Then it would be another six
weeks before we would have the appraisal completed . We are looking at the end of July before we
have any hard information on how much the development rights of this property could cost the Town .
I received some negative feedback because of the amount of time it took us to do the appraisal on
the Ainslie property. I am concerned about delaying it . This particular parcel is 126 acres . It is
bounded on the north by Hayts Road , on the west by Sheffield Road and on the south by Bundy
Road . It is the site of Genex' s main production facility. It is their only parcel in the Town of Ithaca .
They own another 400 (+/-) acres across the road in the Town of Enfield that is adjacent to the
Ainslie property that we have a complete appraisal for.
AdL There is a possibility that we could start a critical mass of protected farmland by having two abutting
properties . The property is the highest ranked property in the Town of Ithaca according to the criteria
we set . It has the potential for being developed . It has about 1 . 3 miles of road frontage . A
landowner could easily have many lots along the road frontage . Most of the farmland is consistent

because the slopes have soils that are 50% to 75% covered in class 3 soils . It is about the best that
we can get in the Town of Ithaca . This particular track is covered 70% to 75% by class 2 soils . It is
one of the best agricultural lands in the Town .
Councilman Klein — Does Genex use it for crops?
Mr. Frantz — Yes . They use it for forage crops and they have planted corn . In our ranking , it is at the
top of the list . I do not see any possibility that the advisory committee would say " no " to an appraisal
on this property. Is it worthwhile to wait for the committee to review this property when it is the only
property that they have to review?
Supervisor Valentino — Is Genex requesting this ?
Mr . Frantz — Yes . We have an application form from Genex.
Councilwoman Grigorov — I think that we should make an exception for this . I think that it is a long
time to wait for the advisory committee to review it .
Councilwoman Russell — I think that it is one of the properties that needs to be appraised for t
program . Even if the committee ranks this in a different order of acquisition , it does not mean that
should not have it appraised now. il
Councilman Niederkorn — I think the advisory committee is going to have a lot more important things
to do than to decide whether or not they should authorize $ 1500 for an appraisal as their first action .
Supervisor Valentino — I think that in the past we received a new appraisal for $875 .
Councilman Niederkorn — The advisory committee' s first order of business should be to decide which
one of the members should ask the landowners if they want to sell .
Supervisor Valentino — How many appraisals do we have?
Mr. Frantz — We have one complete appraisal . We have two appraisals that should be complete
within the next two weeks . We could have an appraisal done on this property by the middle of June .
The committee would then have four property applications with the criteria , and the cost to acquire
the development rights "to each property. They would then be able to use it to start working .
Councilwoman Grigorov — Why does it take so long to get an appraisal?
Mr . Frantz — It takes four to six weeks . It is a different type of appraisal process . Now they are doing
two appraisals and finding comparable sales .

Councilman Lesser — Do we offer the appraised difference between the use rights and the
development rights? Could we offer a property owner anything and they could sell their development
rights for a dollar?
Mr . Frantz — The plan is to offer up to the appraised value .
Councilman Lesser — Genex has a big investment there . It is good land . It is going to stay as
farmland . If any parcel in the Town is going to stay as farmland for a long period of time it is going to
be the Genex property.
Do we want to use our money to buy land that is going to remain farmland ?
We want to use the money to buy land from the person who is undecided about staying in farming or
selling out. We should give them an offer.
Councilman Niederkorn — That is what the committee should be discussing .
Councilwoman Grigorov — We do need an appraisal before the committee can discuss the property.
Mr . Frantz — We ask in the application if the landowner is willing to sell the rights below market value .
If they are , they receive points to raise their score . They would move to the front of the line . Many
programs do have people willing to donate land .
Supervisor Valentino — I am concerned that our funding is stressed . We need to look at the property
that we want to buy. We are not obligated to buy a property just because we get an appraisal on the
property. If we think the land is not at risk , do we need the appraisal now?
Councilwoman Russell — It is important if we are going to apply for a grant through the State program .
We need to present a proposal that has a critical mass . This is a very stable farm . It will be a very
attractive business to base our critical mass around . I see it as an enhancement to the grant
application .
Supervisor Valentino — Does it make a difference that this is not really a farm ?
Councilwoman Russell — I do not think so . It is a farm . The idea is to protect farming as an industry.
Councilman Niederkorn - Supervisor Valentino , I do not understand what you meant by " our funding
is stressed " .
Supervisor Valentino — We have a certain number of dollars that we have set aside for a year to do
appraisals . I do not know if we are getting close to having spent that amount .
Mr . Frantz — To date , we are committed to spending about $4 , 900 . That amount does not include
this appraisal .

Councilman Niederkorn — I think that if there is the possibility of getting some substantial State
funding we could do a conditional approval . If the monies are available then we could proceed with
the appraisal . It is clear we are not going to be able to buy a lot of development rights unless we
receive more money.
Mr. Frantz — We could make a purchase offer contingent upon receipt of a State grant . I spoke with
a representative from Agricultural and Markets in Albany and they hope to send out another round of
Requests for Proposals sometime this summer. If we have the appraisal , we would be ready to
move forward .
Councilwoman Russell — That would be a big advantage .
Councilman Niederkorn — Assuming that there is money in the budget , I would like to proceed with
the appraisal for the Genex property.
Supervisor Valentino — I would like to make it clear that the Town Board sees this as an unusual
opportunity. I want to make sure that this does not become the practice on how we do things . Next
time , I would like this to go through the committee .
Mr . Frantz — It could be addressed by saying , "that given the time limits the highest- ranking parcel
the Town " .
Attorney Barney — Why is it a problem for it not to go through the committee?
Councilman Niederkorn — It is not a problem to send it through the committee . It is not a problem to
do it this way either.
Attorney Barney — What is the rationale ?
Supervisor Valentino — The rationale is that there are opportunities for grant funding that might be
available .
Resolution No. 66 - APPOINTMENT OF MEMBERS AGRICULTURAL LAND PRESERVATION
ADVISORY COMMITTEE.
WHEREAS, the Town Board on July 12, 1999 adopted the Policies and Procedures Manual
for the Town of Ithaca Agricultural Land Preservation Program; and
WHEREAS, said policies and procedures call for the establishment of the Town of Ithaca
Agricultural Land Preservation Advisory Committee to (a) advise the Town Board on all proposed
policies, rules and regulations for the administration of the program; (b) review all applications for
participation in the program; and (c) make recommendations to the Town Board regarding
agricultural conservation easement acquisitions; and

Mr. Frost — We need to send letters to the residents .

Supervisor Valentino — There is a resolution from the Planning Board to establish a system of regular
traffic counts . Have we started talking with the County about that? I know that we said we were
going to talk with Ward Hungerford .
Mr . Noteboom — Yes . I have talked with Mr. Hungerford .
Councilman Lesser — Has the County started any programs?
Mr. Noteboom — We have a small window of opportunity in May before Cornell University and Ithaca
College close for the summer. We missed that window in the spring . We are now going to be doing
traffic counts in the fall . I was trying to get some arranged for the spring , but it did not work out .
Councilman Lesser — Could we suggest what they look at?
Mr . Noteboom — We make suggestions on Town roads . We have tried to get regular traffic counts on
many of our roads . All roads do not need regular traffic counts . We have not had the equipment to
do it . I initiated some discussions with the County about the Town buying more counters for them to
use , and then they would do the traffic counts on our roads . The County has designated personnel
for the traffic counts .
Supervisor Valentino — We have some traffic counts from the NESTS study. We could establish
some type of baseline with that information .
Mr . Frantz — The last big traffic count effort for Town roads was 1988 or 1989 .
Supervisor Valentino — The consultants for NESTS did new traffic counts .

Mr. Frantz — It was used for the Comprehensive Plan . The NESTS study did a good job for East Hill .
West Hill and South Hill also need to have traffic counts done .
Supervisor Valentino — The Planning Board resolution talks about East Hill neighborhoods .
Councilman Lesser — Could we get assistance from the County to analyze the data ?
Mr. Noteboom — The County has software . The information is downloaded into the software . It
comes out with a regular report of speed , traffic and the types of vehicles . The old counters are
getting tired as they have been around for many years . They only give the count. They do not
classify the vehicles . The new counters would give information on the type of vehicles traveling the
road . They would also give the weight of the vehicle .
Councilman Lesser — Does staff have time to use the software?
Mr. Noteboom — I have started discussions with the County about doing it for us . We would be
providing the County with extra counters .
Councilman Lesser — it would be helpful for the next meeting if we could have a report about what we
might expect from the County.
Mr . Noteboom — Sometimes , I can get a count from the State . The State did a count on the end of
Caldwell Road because of the traffic light .
Councilman Niederkorn — I assume that doing a study that is meaningful will cost the Town money .
Supervisor Valentino — It is one thing to have the counts , and it is another thing to analyze what they
mean . We can start by getting some counts .
The City of Ithaca received funding from the State to build a gateway pedestrian bridge over Route
13 . At some point they decided it would be a good idea to communicate with us about it since half of
it is in the Town of Ithaca . They have sent us the plans , but we haven 't had any further
conversations with Bill Grey about it . I think they are looking for help with maintenance of the bridge .
Mr . Grey told me that he thinks that the State might pay for some of it .
Mr . Walker — Does this trail have a link to South Hill ?
Councilman Niederkorn — The trail goes up to Axiom .
Councilwoman Russell — Is it our trail ?
Mr . Frantz - No . There was a staff discussion several years ago . It was a meeting with State , City
and Town staff. There were some serious questions on the part of State and Town staff as to the
need for this bridge given the fact that the State decided to move the Black Diamond Trail south .

The Black Diamond Trail goes under Route 13 at the new railroad bridge crossing . Then they would
come back to Buttermilk. There was no other conversation . Then last year I read in the Ithaca
Journal about how the City has received a grant for this bridge .
Councilwoman Grigorov — Is there a map that shows the location of the bridge?
Mr. Frantz — There is a connection from South Hill Trail down to Buttermilk Falls State Park. The
connection does not need this bridge. This bridge is going to be very nice . As far as a question of
expenditure of scarce public resources , the State and Town staff has a big problem with the building
of this bridge .
Councilwoman Russell — We would eventually be able to hook up from the South Hill Trail over to the
Black Diamond Trail .
Mr. Frantz — It would be connected in two locations . This is going forward . The City's plan is to build
it this year . The grant was unexpected . I do not recall any discussion with us about this .
Supervisor Valentino — It is interesting that they can go ahead and build a bridge in the Town of
Ithaca without our approval .
Mr. Walker — If they move it far enough it could be entirely in the City.
Councilwoman Russell — Do we need to build a trail to hook up to it?
Mr. Frantz — That is another question .
Supervisor Valentino — I wanted to let the board know about the project because the City sent the
information . I think they are looking to us for help .
Councilwoman Russell — Is this going to obligate the Town to build our trail to hook up to the bridge?
Supervisor Valentino — It depends upon what we want to do . We need to have the Planning
Department look at our trail and see if there is a benefit to the Town .
Mr . Frantz — It might prove beneficial once all the trails in the Town are built to assist with the
maintenance . We do not know at this point .
Supervisor Valentino — I sent information to you in the packet regarding the Nationwide Coalition for
the Gun Control Code of Conduct .
Councilman Klein — It was from Elliot Spitzer. We do not have a Police Department . It is n
relevant .
Supervisor Valentino — We could send a letter of support to the County.

Councilman Lesser — The letter could indicate that we support or endorse the concept .
Councilman Klein — We could recommend it to the Police Department .
Supervisor Valentino — They are looking for support saying that they need to buy weapons from
responsible manufacturers who use safety triggers .
Supervisor Valentino — We received a letter from Steve Whicher on May 15t that showed the
Tentative Assessment Roll on open land . It shows the increase in assessment actually did not occur.
He sent the numbers showing the changes . Staff did some work to see how it affected the Town of
Ithaca .
It is interesting that Mr. Whicher indicates the overall change was a minus 3 . 8% for agricultural
parcels and minus 2 . 68% for the conservation parcels . If we look at the individual parcels in the
Town of Ithaca the percentage change on agricultural parcels ranged from an increase in some
cases of 91 . 6% , and a decrease on other parcels of 54 . 8 0/0. He balanced it out . The percentages of
changes were substantial . It tells us the assessments were way off before , and they tried correcting
them .
We have to ask if they are still incorrect. We do not know what it means . I am still working with the
staff so that we can ask questions about what has happened . I am afraid that they looked at the
overall assessment and made it as a target , and then adjusted things around those numbers . It does
worry me .
Mr . Whicher included a $9 . 5 million assessment for Longview in our tax roll . Longview is tax exempt .
Mrs . Noteboom — They have to pay the fire , and the water/sewer benefit assessments .
Supervisor Valentino — Longview was not aware that they had to pay the fire tax. It is a worry for
them . If Mr. Whicher is still including the $9 . 5 million in our assessment roll it is a large portion that
we are not getting money for. Percentages are suspicious numbers .

Mr. Noteboom — Irene Stein came to the MPO meeting and asked if the local municipalities were
interested in sending a resolution of support for the Senior Highway Bill ,
Councilwoman Grigorov - I do not understand why they are doing it .

Mr . Noteboom — It sounded like it was a study. There are certain actions on highways that seem to
prove senior citizens have more frequent problems with , such as more accidents when performing a
left - hand turn . They are studying different design standards that might need to be built into a road to
accommodate some of these actions .
Supervisor Valentino — The crosswalk signs in the City are awful . Cars can always make a left turn .
You are always competing with traffic turning left . In some cities , when they have a crosswalk sign all,
the traffic stops .
Councilwoman Grigorov — The intersection of Cayuga Street and Green Street has a four-way red
light .
Councilman Klein — It has been there for a number of years .
Supervisor Valentino — Should we ask Ms. Stein to talk to the board about it?
Mr . Noteboom — I suggested to Ms . Stein that she contact the Supervisor and talk to the board if she
felt strongly about it.
Supervisor Valentino — It made me feel more mindful of some of the problems .
Councilman Niederkorn — Mrs . Noteboom , in your report it indicates that we are going to be clos
July 19th through July 21St. Then it states that we are closing Town Hall May 18th to work on sortin
and packing records . What is staff going to be doing between May 18th and July 19th when they need
records?
Mrs . Noteboom — All departments are now sorting and packing. This has not been accomplished as
well as it could have been . I am hoping the work on May 18 will give staff a boost to go through
inactive records .
Supervisor Valentino — We did this last year. Everyone worked on the files .
Councilwoman Russell — We are trying to determine the amount of things needing to be moved .
There are a lot of files that do not need to be moved .

Mr. Frost — We have issued a permit for the relocation of the Moore House .
Supervisor Valentino — I do not know how they can move it . They do not have a foundation at the
place it will go .
Mr . Frost — The Village of Cayuga Heights has issued the permit to move the house .

Mr. Frantz — I understand that the week of May 22"d they are going to move the house . They want to
do it with some fanfare .
Supervisor Valentino — They have not done anything . They have only staked out the location of the
house .
Councilwoman Russell — The house is supposed to be brought up to road level .
Mr. Walker — They might keep the house on blocks for a while .
Mr . Frost — We issued two more permits for apartment buildings . We have four under construction ,
with a total of 32 dwelling units .
c. Director of Engineering — See Attachment #7.
Mr . Walker — I have a slide presentation of the completed Wyckoff Road Water Main project. 1011r.
Walker showed slides of the project.
The first problem was that we thought we were connected to six-inch water main . It was an eight-
inch water main . There was a four- inch water main on Wyckoff Road that served many houses in the
Village of Cayuga Heights . At the intersection of Wyckoff Road and Sunset Road there are new
services going to the houses off the eight- inch main . It will improve the service to those houses .
Our contractor did not hurt the quality of the road very much . The contractor has been performing
well in keeping the area clean . The building was installed May 1 St. It was constructed in about four
hours.
Councilwoman Russell — What color is the brick?
Mr. Walker — The brick is red .
Supervisor Valentino — Ron Anderson is very pleased with the building .
Mr. Walker — It is a pre-cast concrete system . The brick facing is concrete on the outside . The
insulation is cast into the concrete . The inside of the structure is a concrete face . It does not require
additional finish . It is different than the structures put up on the master meter project . We had to
finish it with concrete . The doors are going to be painted forest green . We will be putting a peaked
roof on this with an overhang over the doors . We are going to be planting shrubs to screen the
building .
Supervisor Valentino — Why are we doing all this in the Village of Cayuga Heights ?
Mr . Walker — It is the proper location for the pit .

Mr . Walker — The guide rail has been shortened , the vegetation has already started to cover the
building , and the new fire hydrant is on the end of the old line .
Supervisor Valentino — Ron Anderson thank the Town of Ithaca .
Mr. Walker — I have a revised schedule for the Town Hall . We are about a month and a half behind
what we thought would be the original schedule. Our completion date is scheduled for mid to late
June . We will start packing the first week of July. The furniture will be delivered July 5`h and installed
by July 12th . The actual move will occur the week of July 17"' .
Mrs . Noteboom — We told the furniture vendor that it has to be installed and ready to go by July 151" .
They said that they could do it. I have movers that need a definite date .
Supervisor Valentino — Our contractors want to be done by the end of May or early June . They have
been putting on extra people to complete the job.
Mr . Walker — We are into the final finishes in many of the areas . The basement is almost complet
The Post Office has not finished yet .
Councilman Niederkorn — I would like to come to the presentation . It is easier for me to see the
project than just have a report.

explained what to look at with the budget and how it operates . He explained the key factors and why
the reserve funds are certain percentages for different categories . 1 am very appreciative that
took the time to spend with us to explain the system .

WHEREAS, Lakeview Cemetery Co. , Inc. has requested a refund of water and sewer benefit
charges for the Lakeview Cemetery on the basis that assessment units were incorrectly calculated;

WHEREAS, the Town Engineer has reviewed the request for a reduction of water and sewer
benefit units and has determined that the correct number of units for the parcel is 1 unit for water and
1 unit for sewer, and that the assessment for 2000 was for 4. 65 units for water and 4. 65 units for

Councilman Klein — At the Public Works Committee meeting we did discuss if Mr. Noteboom would
get a new highway facility. After the report on the New Town Hall , I am not sure when that would
happen . We are going to start looking at it again . We want to put together a capital budget for
consideration of a new highway facility. We started preliminary review of the culvert policy and the
repair of the driveways .
In reading Mr. Kanter's report , the architects who are doing the PRI Museum just won two National
Design Awards from the American Institute of Architects . This project should be exciting.
Mr. Frantz — I can give a copy of the site plan to the board members .
Councilwoman Grigorov — I have a request from the Cayuga Lake Watershed Municipal
Organization . The information was in the packet . Has the board had a chance to check off the
items ? They are trying to collect information .
Councilwoman Russell — Would you like the board to turn these in ?
Councilwoman Grigorov — Yes . I can send them in . There was an article in the paper today about
Six Mile Creek Water Exhibition at the DeWitt Historical Society .

Councilwoman Russell — Did everyone receive a copy of the letter that was sent under Mr. Kanter' s
name and my name with comments about the Waste Management Facility at the Veterinary School?
Supervisor Valentino — I thought that it was a very good letter.
Councilman Lesser — What do you expect to happen .
Councilwoman Russell — I do not know. We want to see what happens as a result of our letter.
Supervisor Valentino — Councilwoman Russell and I have been going to the Recreation Partnership
meetings. It looks like we are close to coming back to the municipalities with a proposal for their
approval of the program . We are waiting for the County. They are a key part in making sure that this
proposal is going to work . We have separated out the programs from the facilities . We think that the
City is going to agree . We hope that the County will share in hiring a consultant to look at the
problems of the high cost of the maintaining Cass Park.
I need to contact the City regarding the water agreement. The general part of the agreement is all
right , but we might be asking Attorney Barney to draft a resolution for Bolton Point that each
municipality could use . The problem with the water agreement is the Cornell portion of the contrac
They are unable to be a partner at this point because of the difference between municipalities an
private entities . Cornell is behind in getting the contract together. We are hopeful they will get ba
on track with that quickly . The other problem is from the City. They need to put together the leas
agreement for their facilities in the City that are going to be leased to Bolton Point .
The sewer agreement is a mess right now. I do not know how we are going to sort it out and put it
back together. We did not receive the grant money that was anticipated . The scope of the project
needs to be looked at differently. We are not sure what that would mean .
The Town of Ithaca does not need the extra capacity. I would like to sell some of our capacity to the
City. We have more than we will ever need . Our main reason for being involved is the
environmental benefits . It will lower the phosphorous in the lake and help the Village of Cayuga
Heights plant be more effective . The new things that we have seen from the State say that we will
not be able to do the phosphorous at the level that we had hoped with the money that is available .
We need to do more research on some of the other components that might still be able to help us
reduce the phosphorous levels in Cayuga Lake .
Councilwoman Russell — The engineers at the City feel that they can put together some strategies for
doing some phosphorous removal . It will not be the same level that we were planning on doing
because we did not get the funding that we thought we were going to get . It is difficult to iron out all
the problems with this agreement and sort out who is going to for what , in what amounts . We do not
have any idea how much more funding will be available . The engineers at the City are going to pu
together a memo outlining what they think we can do and in what sequence .

The New York State Department of Environmental Conservation said that they would like to see us
move forward and start on some of the projects . They want to see us make progress in moving into
the Environmental Impact Statement process . They thought both of those things would enhance our
ability to get grant funding in the future . It is very hard to see how to move ahead in the
Environmental Impact Statement process when we do not know what our proposal will be .
Councilman Klein — Will the additional grant be added to what we received ?
Councilwoman Russell — We received $7. 4 million on a $21 million project. We were expecting more
because there is more money left.
Supervisor Valentino — There are a few things that were " fluffed " on the City' s proposal that we can
take out . It might turn out to be better in the long run .
Councilwoman Russell — It will enhance our probabilities with the grant if we make the numbers more
realistic.
Councilman Klein — What happened at the furniture meeting?
Supervisor Valentino — We will not receive the final cost until Wednesday. It looks like the cost will
be closer to $ 135 , 00 or $ 140, 000 . We were assured that they could have everything set up on the
deadline that we gave them .
Councilman Klein — Are we authorized to make the purchase?
Mrs . Noteboom — It is on State Bid . We authorized it last month .

I would like to go on record with the following statement :
From the Ithaca City limits to German Cross Road-there is a
speedway for cars going toward Ithaca on the Coddington Road and going
toward Candor on the Coddington Road.
This area is heavily populated with deer where as many as 15 deer a
year are killed in the road. I have talked with the Superintendent of
County highways about the problem and nothing has been done about this.
We need to put up deer crossing signs along at least that portion of
the Coddington Road.
And, I also think it would be a good idea to reduce the speed limit on
the Coddington Road from Northview Road (at least up to German Cross
Road (I know there are a large number of walkers in front of my house—I
believe these walkers only go perhaps to German Cross Road) ) to 35 miles
an hour so that children crossing the road and people walking and jogging
will have a much less chance of being hit by a vehicle.
It would also be safer if we were to have a paved berm on the road
thereby lessening the possibility of a person getting hit by a vehicle.
I have lived on the Coddington Road for 25 years. Something has to
be done before a tragedy occurs.

Coddington Rd . and Hudson St. Several people recounted their knowledge of
injuries and deaths of pedestrians along that stretch of road .
• People are sensitive to infringing on their own and others' front yards , especially
where the houses are close to Coddington Rd . already .
SOME FINAL THOUGHTS :
Most people surveyed -- the largest share of whom are Coddington Rd . residents --
would favor paving the shoulder as a " middle ground " between providing a sidewalk ,
with the actual roadway marked along its edge to delineate the shoulder from the
roadway -- both to create a safer shoulder and prohibit parking along the shoulder.
Some favor paving the shoulder simply to. stabilize it . Some do not favor paving the
shoulder because it will be seen as a wider roadway for cars . No-one expressed
agreement with widening the vehicular roadway beyond its current width , and several
expressed their disagreement with widening it .
The people who heard the idea favored Ithaca College creating a paved pathway down
from the college grounds directly to the junction of Coddington and Hudson Street ,
which would eliminate much of the foot traffic along Coddington from the IC entrance
down to Hudson .

TOWN CLERK' S MONTHLY REPORT
April 2000
Presented : Town Board Meeting , May 8 , 2000
Town Clerk : The Town Hall Furniture Committee is continuing the process for review
of the plans and purchase of furniture for the new Town Hall . Department Heads met
with Thresa and Shary of Corning Office Interiors , Inc . on April 27th to again review the
open work area . Final plans are being drawn for that area the first week of May . The
committee will meet with Thresa and Shary again at 8 : 30 a . m . on May 8 , to hopefully
finalize the order and review total costs .
Several moving companies have been contacted to provide estimates . Each company
is sending a representative to Town Hall to determine the quantity of what is to be
moved . Cost proposals will be received during the month of May , with the Town Board
reviewing the proposals at their June meeting .
The move is now planned for the week of July 17th through July 21 st . We will close
Town Hall from Wednesday , July 19th until Friday , July 21st . Movers will pack on that
Wednesday, and move/unpack the items from the old building to the new Town Hall on
Thursday . Staff will spend Friday unpacking and organizing the new offices . We plan
to be open for business at the New Town Hall on Monday , July 24th .
Records Management: A Records Management Day will be conducted on Thursday,
May 18th . Town Hall will be closed and all staff will work on sorting and packing
records for the move . Advertisements and radio announcements will inform the public
that we will be closed .
Tax Collection : The Year 2000 Tentative Assessment Roll has been received from
Tompkins County . The changes to the assessment roll for the water/sewer benefit
assessments have been submitted to the Division of Assessment . Notification of any
changes of benefit assessments on properties owned by the State of New York which
are charged " pennies" will be made after the May 8th meeting of the Town Board .

Route 366 Bridge over Cascadilla Creek
The New York State Department of Transportation has scheduled a public information
meeting for a project to replace the Route 366 bridge over Cascadilla Creek . The
meeting is scheduled for Thursday, May 18, 2000, at 6 :30 p .m. at the Boynton Middle
School Cafeteria, located at 1601 North Cayuga Street, Ithaca, NY .
New York State Multi-modal Program
Marty Luster' s office requested the Ithaca-Tompkins County Transportation Council
(ITCTC) staff to coordinate the submission of a prioritized list of projects for funding
under the New York State Multi-modal Program. The Town of Ithaca submitted our
Maple Avenue project for consideration. The members of the ITCTC Planning
Cominittee met for a project review to evaluate the submitted projects and to develop a
ranking system to send a prioritized list to Marty Luster' s office . Project proponents
had to attend this meeting to give a brief overview of their project, using maps or other
presentation aids . The outcome of the prioritization process was that the Town of
Ithaca' s Maple Avenue project was ranked # 1 on the list. Marty Luster' s office had
estimated that they would receive about $3 million but would not know how much they
had available until the New York State budget was approved .
Renwick Drive Bridge / Wycoff_ Road Water Line
Renwick Drive Bridge is scheduled to begin the middle of May . The Town has
completed the Wycoff Road water line . The Bridge contractor will now be able to install
a water valve at the,.bridge and not interrupt any water services

3 . The Commissioner shall prepare a senior highway user, assessment report, which shall
identify the specific needs of seniors that affect their ability to userrural, suburban and urban 1.
highways safely . Such report shall also include, but not be limited to, the followinng: (a)
Methods of using or improving traffic control devices to enhance the ability of senior drivers, at
any hour of the day, to view road signs and maintain safe lane positions; (b) Strategies to
enhance the ability of senior drivers to make safe left-hand turns, including improvements to
roadway design, and using or improving traffic control devices; (c) Methods of improving the
safety of senior pedestrians crossing highways, which may include pedestrian crossing design
enhancements; (d) A review of state and local laws and regulations as they relate to senior
highway users and their ability to use highways safely; (e) A review of the availability of
alternatives to driving for senior drivers, especially in rural areas; (f) Methods to identify
highway environments that are particularly hazardous to senior highway users; (g)
Identification of highway limitations; and (h) Strategies for improving senior driving behaviors
for highway safety.
4 . The Commissioner shall prepare a senior highway user recommendations report, which
shall be based upon the findings set forth in the senior highway users assessment report. Such
recommendations report shall set forth a draft Senior Highway User Assistance Plan and shall
include, but not be limited to, the following: (a) Strategies to implement traffic control device
changes to improve the safety of senior highway users; (b) Recommendations for changes to
intersection guidelines to improve senior pedestrian crossings and senior driver left-hand turns;
(c) Proposals for amending State or local laws or regulations to enhance, senior highway .user If 1 .
safety; (d) Recommendations for addressing other identified highway limitations affecting the

Storm drainpipes and catch basins were installed at Winthrop Drive, Joanne Drive,
Eastern Heights Drive, and Park Lane . A water service and sewer lateral were installed I

Our shoulder machine was rebuilt and refurbished with a new motor, belts, and paint

Town Engineer' s Report for 5/8/00
Town Board Meeting
DEVELOPMENT REVIEW
Museum of the Earth-PRI
The Town Engineer reviewed the revised drainage analysis and preliminary site plan for the proposed museum addition.
The storm water management plan includes several unusual features which were incorporated due to site limitations.
St. Catherine of Siena Church
The Town Engineer met with the contractor and reviewed the sediment and erosion control plan for the proposed site
improvements.
EARTH FILL PERMITS
No new fill permits were issued in the month of April.
City of Ithaca Proposed Spoil Site
Plans have not been submitted from the City of Ithaca. The City has indicated that they are in process of surveying the site
and preparing SEQR data.
WATER PROJECTS
Integrated Water System
The Cornell legal staff is in the process of reviewing the proposed lease agreement for the Cornell Water Plant and
comments are expected in the near future.
Warren Road Water Main Replacement
Work is completed and the Town Engineer is responding to additional claims by the Contractor.
Wyckoff Water Main Improvements
Installation of the water main was started April 12 and the work was substantially completed on May 3 , 2000, with the
setting of the PRV building. The water main has been tested and should be in service by May 12, prior to the start of
construction on the Renwick Drive bridge.
SEWER PROJECTS
The SJS partners are continuing to work on the revised agreement. The Town Engineer has been working with the other
municipal Engineers and the SJS attorney on technical details of the agreement.

TOWNHALL
Construction continued on the Town Hall project the month of April . Roof replacement was substantially completed on
April 28 , after many delays due to weather.
The general contractor has completed sheet rock work in the basement areas and on much of the fast floor. Work on
construction of the Buffalo Street ramp and stair replacement has continued and is scheduled for completion by mid-May.
The rear ramp and entrance has been started and should be completed by mid-May.
Installation of the Plumbing, Mechanical and Electrical work is following closely behind the general construction work.
The main Roof Top Unit for air conditioning and ventilation of the building was set on May 1 .
The general contractor for the Post Office continued work on demolition and framing work throughout April .

Parcel No. 54-6-3, Residence District R-9. The 0.038 + / - acre triangular parcel is to be
consolidated with the adjacent parcel at 257 Pennsylvania Avenue, Town of Ithaca Tax
Parcel No. 54-6-5. The 0.038 + / - acre parcel includes an asphalt parking area that the
owners wish to keep with their house on Town of Ithaca Tax Parcel No. 54-6-5 when

CURRENT PLANNING DEPARTMENT PROTECTS
The following are accomplishments or issues that have been dealt with over the past
month.
SEOR Reviews for Zoning Board :oard : Two SEQR reviews for the Zoning Board were done
since the April report: (1 ) height variance to construct a single-family house, David
McCune, 260 Coy Glen Road; and (2) special approval to use the premises at 1305
Hanshaw Road as a temporary location for the Cayuga Heights Fire Station (while the
current facility in Cayuga Heights is rebuilt.
Codes and Ordinances Committee: The Committee met on April 2r, 2000 to continue
review of the business zones . The Committee completed review of Schedule I — Table of
permitted uses . There was a long discussion about whether this table should include all
of the permitted accessory uses . The consensus was to delete accessory uses from the
table, since it is an illustrative summary table. Samples of mixed use (residential use in
business zones) were reviewed. The consensus of the Committee was that it would be

desirable to include a mixed use provision in the business zones, and John Barney
agreed to write up a draft provision for the next meeting. The Committee began review
of Schedule II — Area, Width, Setback . . . Requirements. The next meeting is scheduled
for May 17', 2000.
Capital Pro.jects Planning Committee: The next meeting of the Committee is scheduled
for May 3`d. Proposed 2001 capital projects are to be submitted by department heads by
the middle of May for review at the June 76 Committee meeting .
North Campus Gateway Committee: The Committee met on April 11th, 2000, where
discussions on alternate designs continued. (A copy of the meeting summary prepared
by ITCTC is attached to this report. ) The next meeting is scheduled for May 9, 2000.
LWRP Planning Committee: The LWRP Oversight Committee met on April 11th to
review the draft plan, in anticipation of a public meeting to be held in late June. Key
issues of the LWRP that have been the focus of the process so far include dredging, open
space preservation, boating regulations and enforcement, and land use/ policy
consistency review.
Regional Planning Group — Sewer: The Regional Planning Group met with the
Department of Environmental Conservation in Cortland on April 28, 2000. Discussions
focused on clarifying NYS Bond Act grant funding for the intermunicipal sewer project.
It appears that the only additional funds approved in the latest round of funding beyond
the $7 million already committed was approximately $500,000. A new base project
description (based on anticipated funding) will be prepared by Stearns & Wheler,
project consultants. This has to be completed prior to continuing with discussion
regarding the scoping process for the Environmental Impact Statement. [Note: This is a
lot more complicated than can be summarized in this report. Mary Russell can provide
a more in depth report at the Town Board meeting.]
American Planning Association Conference, New York City : The Director of Planning
attended the American Planning Association National Conference in New York City
from April 15'h through 19' and attended numerous sessions dealing with a wide range
of planning subjects, including Partnerships for Farmland Preservation, Innovative
Regional Growth Management, Reversing Sprawl, Simulation and Visualization
Software, Environmental Performance Standards, Visual Interactive Zoning Code,
University-sponsored Neighborhood Revitalization, Visioning Process for Growing
Smart, and Certification vs. Licensing for Planners. Session notes, web site addresses,
and reference materials are available in the Planning Department.
County Assessment — Revaluation, Farm Parcels: As a result of proposed changes in
assessment of farm parcels in conjunction with the County Assessment Office's
revaluation process, Planning staff conducted an analysis of farm parcel assessments in
the Town of Ithaca. Assessments for past years were compared with the tentative
assessments for 2000-2001 . There was no distinct pattern . Assessments of some farm
properties increased, while others decreased. Overall, the total assessed value of farm
parcels studied in the Town decreased by about 3. 8 percent (from 99-00 to the tentative

00-01 assessments). Selected conservation / open space parcels were also analyzed, and
their assessed values decreased by about 2. 6 percent (from 99-00 to tentative 00-01 ).
Town Hall — Office Space Layout: The Director of Planning assisted with the preparation
of alternative floor plan layouts for the central, open office area in order to finalize the
furniture orders. Final layouts were discussed with the furniture contractors and final
furniture requirements and cost breakdowns will be provided to the Town Board
committee on May 8' to present for final approval by the Town Board that evening.
Cornell College of Veterinary Medicine — Waste Management Facility, EAF: In response
to an Environmental Assessment Form (EAF) received from the State University
Construction Fund regarding the proposed Waste Stream Management Facility at
Cornell's College of Veterinary Medicine, the Deputy Supervisor, Attorney for the Town
and Director of Planning prepared and sent a letter (dated 4 / 26 / 2000 — copies have been
placed in Town Board member mail boxes). It was apparent in the EAF description that
the proposed project is not well defined and may not be consistent with the
recommendations of the Cornell-Community Waste Management Advisory Committee,
which spent many hours in detailed analysis of this matter and issued a report with
recommendations regarding management of Cornell' s waste stream.

Discussion
Bill Gray discussed the potential to improve the existing Thurston Ave . Bridge to provide additional bicycle and pedestrian capacity.
He is currently investigating several engineering strategies that may be available to accomplish this goal . An alternative strategy
would be to construct a separate pedestrian bridge adjacent to the Thruston Ave. Bridge .
Cornell staff presented a number of updated draft proposals for road alignments aimed at achieving the goals of the NCGC. The committee
discussed the draft concepts, evaluating the different proposals. There was general agreement with the concepts presented . Specific
comments where provided to Cornell staff to fine-tune the proposals.
Kim Triggs, transportation analyst with the ITCTC, and Fernando de Ara26n presented the results of Tmodel runs of the study area
incorporating the design concepts proposed by the committee . John Gutenberger agreed to provide Kim with the proposed North Campus
employment and population figures. The committee reviewed the model output and made suggestions for further refinements. These will be
incorporated into the model and new results will be presented at the next meeting.
Next Steps
The next meeting of the NCGC will be Tuesday, May 9, 2000, 1 :30pm at the Cornell Transportation Services Bldg. (Bill Wendt ' s
office) .
Tentative agenda:
• Review the new draft concept maps and the new Tmodel outputs.
• Complete the project goal matrix to ensure that the proposals meet established goals.
• Thys VanCort will report on the City of Ithaca review of the NCGC ' s goals and objectives and process structure.

Human Resources Specialist Report for April 2000
Personnel Committee :
Attached is a copy of the March final minutes . At the April meeting the
committee reviewed the Violence in the Workplace policy and the Computer
Usage policy . The Violence policy was accepted as written with a few minor
changes . Councilman Lesser had some comments regarding the Computer
policy . This policy and comments will be forwarded on to the Records
Management Advisory Board for review .
The committee was able to review the Benefits Section of the manual with very
few corrections . The committee in May will review corrections and move on to
the Miscellaneous Section .
Safety Committee :
At the April meeting the committee discussed how the Safety Toed Shoe
program was working and discussed some issues that have come up . The
committee then focused their attention on finishing the Personal Protective
Equipment section of the manual . At the May meeting the committee will review
corrections , the Lock-out/ Tag out Policy and Rabies Policy.
Wellness Program :
In May their will be a " Lighten Up " program offered to the employees at a $ 10
refundable fee . This is a 5 week program that runs during the lunch hour, which
teach different weight management techniques .
Training and Development :
The following employees completed the "Office Professional Program " : Joy
Daley , Typist ; Dani Holford , Senior Typist; Sandra Polce , Senior Typist ; Mary
Bryant , Senior Typist , Carrie Coates , Deputy Town Clerk ; and Gail Kroll ,
Administrative Assistant . This program was designed to train the participants in
a full variety of key elements for office employees , including telephone skills and
time management skills .
Fred and I have been working with TC3 to develop a " Supervisory Training
Series" for middle management and front line supervisors . Many of these
employees have had little to no formal training on supervising before receiving
their promotion . At this point Fred and I are interested in fine tuning their abilities
as supervisors . The program we are working on would involve 3 hours per week
for 5 weeks .

Personnel — Civil Service :
Connie Clark , Principal Account Clerk , started April 3rd in the accounting office .
As per a meeting with Connie and Al Carvill , Budget Officer, after her first 4
weeks , she has picked up working on the Williamson Law Book program well .
Connie has also been a joy to work with and has a real desire to help out other
departments too .
Commercial Insurance :
There are no new claims to report for April .
The 2000 Dodge pickup was added to insurance with any recoup being due in
January 2001 .
1 am working with our representative from Titan and Ithaca Agency on claim
reporting procedures and claim communications . I have been experiencing
difficulties in communications with claims examiners from Titan .
Workers' Compensation :
The Town currently still has one employee out on Workers ' Compensation , with
no schedule date of return . We have requested a "functional capabilities test" , to
help determine if there is a light duty position available .
I have begun to write up a formal Transitional Duty program , as recommended
during the annual review by Norm Wiley , PERMA Safety Consultant . Fred
Noteboom , Norm Wiley and myself will review this program before it is referred to
the Town Board for approval .
Disability Insurance :
Currently , there are no employees out on disability .
