CALL TO ORDER: Supervisor Valentino called the meeting to order at 10 : 37 a. m . , and led the assemblage in the Pledge of Allegiance. Town Justice Clarence Larkin - I would like to express an open invitation to Town Board Members to attend the Justice Court sessions on Tuesday or Wednesday nights. My court time has been moved from 7 : 00 p. m . back to 5 : 30 p. m . . We see approximately 40 to 50 people each night. I would expect that amount for the next court date on January 6 , 1998 . 1 want to extend the invitation to the Town Board to attend court because the Town Board will be making decisions about space for the court in the new Town Hall now and in the future. Court is held at 121 East Court Street on Tuesday and Wednesday nights. The Town Board viewing what the Justices do could help the Board make decisions about the new court room in the new Town Hall. AGENDA ITEM NO. 3 on ADMINISTRATION OF OATH OF OFFICE - TOWN BOARD MEMBERS . A. Town Board Member, Carolyn Grigorov Be Town Board Member, Edward Conley co Town Board Member, Ellen Harrison D. Town Justice, Clarence Larkin - Town Justice Larkin submitted his oath to the State of New York, Tompkins County, and the Village of Cayuga Heights. AGENDA ITEM NO. 4 on PERSONS TO BE HEARD. Supervisor Valentino - Donald Stephenson is present to discuss the rezoning on East Shore Drive for the Cornell Lake Source Cooling Project, (Agenda Item No . 8 ) . His concerns relate to the water quality and the temperature of the lake should the project be completed . Those issues could be heard now they are different from the rezoning issue. Salm , Vice President for Business and Administrative Affairs, Ithaca College - See attached . The Town Board reviewed the letter from Thomas R. Salm expressing thanks to the Town of Ithaca for the help with the construction projects on the Ithaca College campus. (NOTE : The formal adopted resolution is hereto attached. ) AGENDA ITEM NO, 12 - CONSIDER REFUND OF 1997 WATER AND SEWER BENEFIT ASSESSMENT AND AUTHORIZATION FOR RECEIVER OF TAXES TO ISSUE CORRECTED 1998 TAX BILL FOR SEWER BENEFIT ASSESSMENT : Supervisor Valentino - The Town cannot issue corrected bills once the tax bills have been mailed. We will be considering a refund of the 1997 and 1998 sewer benefit assessment for a property owned by P - TOWN BOARD MEETING 5 DECEMBER 31, 1997 APPROVED - FEBRUARY 9, 1998 Donald Crittendon . This refund is a recommendation of the Water/Sewer Special District Assessment Review Committee. Councilman David Klein - The draft letter written by Daniel Walker, Town Engineer to Donald Crittenden was done at the request of the Water/ Sewer Special District Assessment Review Committee. The committee agreed with Mr. Walker's determination . Town Clerk, Joan Noteboom - The resolution needs to state that the refund will not be made until after the tax bill has been paid in full . Councilman Klein - That was mentioned in Mr. Walker's letter to Mr. Crittenden . RESOLUTION NO. 232: Motion made by Councilman Klein, seconded by Supervisor Valentino that the Budget Officer is hereby authorized and directed to issue a refund to Donald Crittenden, 173 Bundy Road for an over charge of water and sewer benefits. (NOTE : The formal adopted resolution is hereto attached . ) AGENDA ITEM NO. 8 - CONSIDER REFERRING THE REQUEST FOR REZONING ON EAST SHORE DRIVE FOR THE CORNELL LAKE SOURCE COOLING PROJECT TO THE PLANNING BOARD . Liz Vastbinder, Project Coordinator Cornell University Lake Source Cooling Project - Cornell has meet with the Access Committee to discuss the Special Land Use District (SLUD) . Some great progress made. George Hascup, Architect for Cornell University Lake Source Cooling Project - I am here to present a revised design of the building based on comments received from the last meeting . The height is critical because of the nature and size of the pumps. There is a very important need to have a crane to move the pumps so they can be maintained . Initially the site was on the other side of East Shore Drive, but it was moved 80 feet from the road right-of-way to set it in the hill . Approximately one-third of the building front is embedded into the slope. The back side of the building will be close to the top of that slope. The general idea of massing is to develop a horizontal character. Important aspects of the design are service and access. Large trucks deliver these pumps. Maintenance vehicles would arrive upon the slope and turn around to maintain access. Approximately one third of the actual driveway appears to the right. That is basically a motor port or access point, for servicing the building and to allow the public to arrive at the building to examine the contents and site. The nature of the building height itself is very special and unique . It is not by accident that Cornell planned this here. It was because of the great water resources and Cornell 's instinct to develop. Historically, this has been treated in a very special way. Most of the building is underground. The pipes that go into the lake are located underground . The pipes would go under the road to the lake. The pipes exit the building in the rear. The Engineer has stated that the pipes would not be seen because of the vibrations of the water. I tried to give the building a quality that relates to water works and not the industrial history of the area which was salt and sewage treatment. I tried to stratify the building into the landscape by using i TOWN BOARD MEETING 6 DECEMBER 31, 1997 APPROVED - FEBRUARY 9, 1998 geological attitudes toward the building by breaking the horizontal . The base was worked carefully to establish a long retaining wall at the foreground . That is a combination of concrete and stone to set up the base of the building . Glass was introduced to break up the facade and to make a significant transparency across the top. Belt and base course are critical , so I selected a thin steel overhang to give shower relief for the clear story. The Committee was interested in breaking the facade by putting in more transparencies. I would like to propose small punctuated focal point windows just below the clear storage. Those would have a powerful effect on the facade. It is a classical technique that has been used on other buildings in Collegetown . I have introduced a strong horizontal window reinforced at the base because of the comments received previously. People will actually see the exciting contents of these great machines through an extensive lower window. There is a corner glass window that is approximately 16 feet high . It will be bigger than any other transparency in the Town of Ithaca. It is emphasized by a strong canopy and can be shut with angle braces from below. It will also be reinforced by a porch that is 15 feet by 12 feet. People could view the pumps through the window on the porch , and people could also look at the lake from the porch . Another smaller canopy is being proposed to help break up the scale of the wall that goes along with that window. There is a gravel edged walk way, ramp type condition , so people could look at the building and have . a designation at the end to look at the pumps . It is a fire egress code requirement with a retaining wall to cut the building into the hill . The retaining wall and loading area were broken up with lower level planters. The wall will be equipped with landscaping . That is where site drainage will emerge. There will be plantings coming out of the base planters, so the wall is not a big vertical wall . This wall will be an interesting feature of the building to cut and break into the landscape. It is also functional if fire trucks need to turn around . The foreground wall in front of the loading platform was set up to provide a gateway quality. I have introduced a vertical mass that reinforces the connection to City Hall . The Chamber of Commerce has a nautical quality of steel rails that gives it a ship decked quality. I would like to make this building detailed with nice colored steel rails to lighten up the masonry quality. What is the building made of? We have upgraded the quality from block to CMU . We have introduced pre-cast concrete that can be made in a beautiful horizontal way with nice reveals. It is a much higher level of quality material which will make the facade more textured and shadowed rather than having the flat masonry technique. This is basically the design response that was developed . Councilwoman Harrison - What would people see while driving along East Shore Drive? How high is the wall , and what would be seen? Mr. Hascup - As people drive by the building there will be 10 to 15 feet of landscaping . People would be looking up slope. At the top of the slope people would see the wall and canopy. When people drive by the slope it will break the landscape and foreground . This building will be into the hill with subtle landscape. We have not tried to cover the architecture with a wall of trees. We have one compositional row of trees which would be transparent at one end . The other end has different textures. Attorney Barney - What kind of snow load could these fenestration take? Mr. Hascup - I have introduced canopy struts on the back wall section . The canopy will be designed to float away from the facade of the building with the angle struts below to support 100 pounds per foot. The canopies may be designed like a trellis depending upon the detail of the steel . The trellises and profile will be critical , and I would opt for an accent pipeline on the roof. 0 M TOWN BOARD MEETING 7 DECEMBER 31, 1997 APPROVED - FEBRUARY 9, 1998 Councilwoman Russell - The clerestory in the sketch looks like there is some reflection of darkness. Mr. Hascup - Rather than having the clerestory as a clear strip of glass, I introduced a reflective panel to reinforce the look and break it up a little . Councilman Conley excused himself from the meeting at 11 : 20 a. m . . Mr. Hascup - What makes the building special and more fitting , is the preparation walls. The beginning wall in front and the walls setting up the corner reinforce the canopy, hopefully this will compose the facade horizontally. Introducing the glass at a lower level does not fit the functional purpose of the building . We are trying to balance it by lighting the facade , but not give it a huge amount of transparency. The number one issue will be the vibrations. That will be harder to control with the code issue aspects. Attorney Barney - What is the circular device on the pole which is shown on the sketch plan? Mr. Hascup - That is a site drainage for local ground water. Councilman Klein - A productive work session was held a few weeks ago with Mr. Hascup, Councilwoman Russell , and myself. Some of the design elements discussed at that meeting have been incorporated in a short period of time. The building design presented to the Town Board today has been significantly improved from the material that was reviewed earlier. I like the incorporation of the nautical elements of punctured windows and massing . There have been a lot of elements introduced to break the scale of the building , such as higher quality products of pre-cast stone for the walls. Discussions with the landscape architect were made as well . I think we are moving in the right direction . I would have been opposed to referring this to the Planning Board without these revisions. The draft resolution certainly provides the Board with enough information . It does not commit us to buy into this in its entirety at this point. I think it is appropriate for the Planning Board to conduct some extensive hearings. When this is released to the public their comments would be extremely important in terms of the design of the building . I appreciate the effort that has been spent in making this a better building . Generally, Cornell is headed in the right direction . Councilwoman Grigorov - They have made it an interesting building without decorating it. Donald Stephenson , 936 A East Shore Drive - The water quality results from this summer have severe health implications for this basin of the lake. The analysis supplied to the Town Board shows the different points where the water quality was tested . The inlet receives a clean health record , but it is the foot of the lake that has problems. The figures in the far column are most relevant, (see attached) . The other column is an accounting of intestinal tract bacteria related to fecal matter that is an index which includes a coli and other strange bacterial . The relevant numbers to compare these figures with is 200 . If it is over 200 it is unhealthy. Swimming is not allowed at Stewart Park, but there is a swimming pool at Cass Park which is close to the lake. This is nothing new, but it is not something that has been addressed very well . It does constitute a health risk. If it were a County bathing area, then the figures could not read over a 1 , 000 or they would consider closing it immediately. Still there are people that swim there. I live on the shore of the lake, and I have seen kids from the Stewart Park summer camp take a canoe out on a hot summer day just to flip it over to get wet. It is also a lake that is supposed to be classified as Class " A" water by the Department of Environmental Conservation (DEC) standards. That means it includes uses of A, B , and C (drinking water, swimming , TOWN BOARD MEETING 8 DECEMBER 31 , 1997 APPROVED - FEBRUARY 9. 1998 and contact sports) , but it is suitable for these purposes. This is a risk that goes beyond diminished property values and a diminished tax base. It puts certain segments of the population who do not just get their drinking water from the lake or rely on rental properties at risk. There are people of all ages who use the East Shore Sailing Club Marina. These people capsize their boats and end up in the water. It is also a health risk for the users of drinking water from Bolton Point. Bolton Point is approximately one and one half miles north of the proposed Lake Source Cooling Project Site. The out fall is short and goes back into the basin , but on the sketch map the Board saw earlier, this basin could be as dirty as it was this summer. All the sewer plants were running up to code , but it was an accident that was waiting to happen . Town of Ithaca residents and the residents of East Shore Drive experienced a terrible smell this past summer. The Chamber of Commerce was irate . There are two sewer plant pipes running into this basin . This basin , except where it is dredged for the boat channel , is quite shallow. There is a northerly wind that predominates and blows material on the surface towards Stewart Park. When the waves break they move a lot of material . The nature of this material is suspect. Although the water and sewer plants have the capacity to handle regular conditions , they do not have enough capacity to handle heavy rain or heavy snow melt conditions. The Cayuga Heights Waste Water Treatment Plant gives a two hour tour. I recommend that everyone take the tour. They have a capacity of 2 million gallons per day, but they can get an overflow of six million gallons after a heavy rain or snow melt. They cannot store the excess in the clarifying chambers of the round vast because there is not enough room for that much water. What they do is treat it with a bit of chlorine and move it into the lake . If they tried to back it up and put it through the process, they would end up sending bathroom water out of the mantel that covers the drain . It would get sent back to the lake. This happens not only from the Cayuga Heights facility, but also from the Ithaca Area Wastewater Treatment Facility which also gets over loaded . A new pipe would need to be considered to go into the same basin . Everyone knows that germs, plus warmth , makes illness. The drinking water facility at Bolton Point serves the Village and Town of Lansing , the Village of Cayuga Heights, Ithaca College, and parts of the Town of Ithaca. It also includes the retirement community at Kendal , Hospicare, and some schools in the area . Government studies show that a coli grows in lake water conditions without human intestinal tract and temperature conditions. There have been other studies which show disasters from these water works showing the elderly and children with stressed immune systems. They show people with diabetes, pregnant women , and people who are fighting an illness such as cancer are at the highest risk. Bolton Point has 5 , 000 accounts, and that could be a household or a larger community. Many of these accounts are in the Town of Ithaca . Several of these people have conditions that should be acknowledged . We cannot say it is the Village of Cayuga Heights facility or the Ithaca Waste Water Treatment Plant, but we can keep the lake from getting any worse. We can work on being able to swim again at Stewart Park. That is something that I , and a number of other concerned citizens are currently working on . We are working on removing the materials that go into garbage disposal units into composting instead of putting it into the drain and into the lake . That material is just be more for bacteria to grow on . TOWN BOARD MEETING 9 DECEMBER 31, 1997 APPROVED - FEBRUARY 9, 1998 This involves a comprehensive involvement and we should encourage people to think of the lake as a community resource for the Town of Ithaca. We should also make it as good a lake as we would like it to be. I do not think that Cornell University should put warm water discharge pipes into the shallow sensitive basin of the lake when we have been using this basin as a holding tank for raw sewage for so long . I have respect for Cornell's designs and considerations on how they work with the community, but they must realize that adding warm water to the lake makes a breeding ground for germs. The worse case scenario, these germs are put into the drinking water at Bolton Point. Thank you . Councilwoman Grigorov - Mr. Stephenson mentioned the count of 200 being unsafe. Would that be for drinking water? Mr. Stephenson - No, that is for swimming and contact. Councilwoman Russell - Was this issue addressed in the Draft Environmental Impact Statement (DEIS)? Mr. Stephenson - " No. " Councilman Klein - Was this addressed in the Final Environmental Impact Statement (FEIS)? Mr. Stephenson - " No. " Ms. Vastbinder - This was responded to during public comments. Mr. Stephenson - Not in so many words. It is not shown that there is clean water in this basin to add warmer water to. It only addresses the point of what could be deep in the lake coming into and returning to the basin . There is more than enough phosphorous in this basin for germs to grow on . Phosphorous is just one of the nutrients that different organisms need for growth . Councilwoman Harrison - What is the Town Board 's role of the water quality issues as we look at the rezoning? The Town Board is considering rezoning this piece of land , these potential issues have obvious implications in terms of what we see and public access. I am not sure that rezoning is directly related to the water quality issues. I am trying to get a better idea of what the Town Board's role is. Attorney Barney - This is not any different from other re-zonings where the Board looks at the potential environmental impact for the whole project. There are other people with greater capabilities than we have charged with examining water quality issues, but that does not preclude this Board from making a decision . Councilwoman Harrison - Has anyone from Bolton Point looked into these issues? Supervisor Valentino - Bolton Point has reviewed this information and submitted comments that there would be no significant change in water quality due to this project. Councilman Klein - Who reviewed this at Bolton Point? Director of Engineering Walker - Paul Tunison , a chief operator. Councilman Klein - DEC will issue the permit after looking at the biological functions. Director of Planning Kanter - Both the DEC and the Health Department. TOWN BOARD MEETING 10 DECEMBER 31 , 1997 APPROVED - FEBRUARY 9 1998 Mr. Stephenson - For the record , I still feel that this issue has not been adequately addressed . I have not seen any information that Bolton Point or anyone else has been represented . I am a Cornell trained biologist, and a concerned member of the community. 1 am not against progress, invasion, or anything that would be just right. However, a lot of people use this water. There are people in the Town of Ithaca who get their drinking water from the lake. Chlorine or florin cannot kill specific germs. Bolton Point is a fairly open facility. I do not know who would pay for designs to make it safer if it could be, but we need to cut things down that go into this basin . The Cornell Lake Source Cooling Project is a step backwards. No one has denied that warm water does not make for better growing of bacteria. Director of Engineering Walker - Mr. Stephenson keeps mentioning warming , but he has not mentioned specifics. The discharge temperature would be 55 degrees. Ms. Vastbinder - At some points, it would be warmer than the lake water. Director of Engineering Walker - The benefit of this project, for a stagnant water without any flow, would be a tremendous amount of flushing action . That action would dilute a lot of material that may be in that area right now. The biggest improvement for the water basin over the past ten years was putting sewers along the lake shore . Septic systems from the existing homes along that lake were and are the biggest source of pollution in that basin . The water did not fall out, there was not a lot of circulation there. It is a very shallow area, and it does warm up significantly in the summer time. There is a tremendous amount of vegetated growth of algae. The algae is causing decomposition of natural material causing most of the problems. I do not see where re-circulating lake water that is already there and bringing colder water in during the summer months would create a problem . Councilwoman Harrison - The Cryposporidium does not grow. They are not a bacteria. They must be in the intestinal system of animals to grow and reproduce. Mr. Stephenson - The Cryposporidium are in 97 percent of all lakes. Councilwoman Harrison - I am not saying that they are not there and that they would not be potentially entering the lake, but they will not be growing more because the lake is warmer. They grow in the intestine, and they are little eggs in the lake water. Bacteria is the problem because they can reproduce and grow where the algae is . Director of Engineering Walker - Bolton Point is not an old and out dated facility. Bolton Point is 25 years old. It has the a "state of the art" sand filtering system with a flocculation system. The water quality is measured coming out, and it is much higher than any other source in the area. The filtration system exceeds all State requirements for removing things like Cryposporidium as that is the way to remove it. Bolton Point has a very low back wash sedimentation load because the water is high quality from the lake. We chlorinate and microscopically inspect the water as it comes through . The Bolton Point facility will meet State standards for at least the next 25 years. This is a modern plant that is well maintained . Mr. Stephenson - Sending a volume of water through this basin will also stir it up , and the jets are pointed northward and angled 20 degrees from the horizon . The water would be sent away from Stewart Park and would be propelled northward . This will stir up sediment. It was the Department of Public Works who did not want to take out the rotting vegetation because they were worried it was so deep they would only make the problem worse. TOWN BOARD MEETING 11 DECEMBER 31, 1997 APPROVED - FEBRUARY 9, 1998 Director of Engineering Walker - Right, along the shore line where there is a depth of vegetation where the surface layer has to cross over, but as soon as it were stirred up there would be questions raised. Not water quality issues, but odor issues because it was on the lake shore . Councilwoman Harrison - Attorney Barney, Supervisor Valentino, and Director of Planning Kanter and I met with several representatives from Cornell University to discuss the opportunity of insuring and maintaining public access to the lake. It was a good meeting . Once this project is completed and operational Cornell is interested in selling off the piece of property that is on the lake side of East Shore Drive. Cornell would have a year-to-year lease with the people who are operating the marina, and continue the lease. Cornell needs to maintain a right-of-way easement between the building and the lake where the pipes will be running underneath the ground to maintain service to the pipes in the future. That leaves the easement area , and the area to the north for public viewing of the lake. There were discussions about whether the Town might be interested in purchasing that property for a Town park, and whether there might be some kind of provisional purchase action . In the current proposal there might be allowance of public access to a portion of this site, and if this were to occur whether there was some easement relationship the Town might accept that would transport liability issues to the Town as a Town park. There were a number of options discussed. The sense was that everyone needed to explore these facts further. We need to consider the Town 's potential interest in acquiring that property in the future, and what kind of statement might be made in terms of purchase. The Board needs to discuss potential easements. Cornell needs to talk about these same issues. Tom Lavigne, Cornell University Real Estate Department - I had discussions with Fred Rogers shortly after the meeting with the Town . Mr. Rogers agrees in concept to what was discussed . Councilwoman Harrison - We felt comfortable and understood what we were looking at. There are no reasons not to refer this to the Planning Board since we have looked at the architectural issues. RESOLUTION NO, 233: Motion made by Councilwoman Harrison, seconded by Councilwoman Grigorov that the Town Board by resolution refers the Comell Lake Source Cooling Project rezoning application to the Planning Board. Town Budget Officer Alfred Carvill - For the prior two years , $200 , 000 has been appropriated in the water and sewer funds for painting of the steel water tanks . Historically, this means that the fund balance has been accumulating excess revenue that has not been expended and appropriated for. Not knowing this contract was to be awarded during 1997 , $ 200 , 000 was budgeted in the 1998 budget for the same task. Director of Engineering Walker and I discussed taking $200 , 000 for this year's budget and encumbering it anticipating that this contract would equal or exceed $ 400 , 000 . Needless to say there is a lot of money. The Town could encumber the funds out of this year's budget, not minus this $ 120 , 000 , collapse the fund balance , or commit the funds from the 1997 budget in an expense line so that it does not go to expense in 1998 . In each instance the fund balance would show an expenditure. In which direction would the Board want to take? TOWN BOARD MEETING 12 DECEMBER 31 , 1997 APPROVED - FEBRUARY 9, 1998 Supervisor Valentino - I do not see a difference because it would be appropriated out of fund balance. If the $200 , 000 goes back to fund balance from the 1997 budget, and there is $200 , 000 in the 1998 budget to cover that expense, it seems easier not to encumber it. Judy Drake, Human Resources Specialist researched what the yearly cost would be to the town to process weekly paychecks. It would cost approximately $7 , 000 more a year to do weekly checks. The biggest concern , more than the money issue , is that the Town runs on a very tight budget. We are not over staffed and the time element of preparing weekly payrolls with the present staff that is available would not be practical . We are already short staffed and we would need to add another staff person to do the work that would not be getting done . I could safely say that I would not recommend this to the Board . IS - REPORT OF TOWN COMMITTEES : Budget Officer, Alfred Carvill - The Town financial records for the year ending 1997 will be closed on January 14, 1998 after all appropriate year end accruals have been made recognizing both revenues and expenses in this year's current operating budget. The Town has $3 . 6 million in investments . For the next 60 days, the Town has $ 1 million of operating cash between the General , Highway, and Water and Sewer Funds. That would carry the Town through until the collection of new tax revenues. Between 1976 and 1991 , the Town of Ithaca had indebted themselves by $ 12 . 4 million . As of December 31 , 1997 , the Town has outstanding debt of $ 6 million . The Town has paid 50 percent of the outstanding debt. Historically, by the year 2006 the Town would have liquidated the entire $6 million . Over the next eight years all the Town ' s debts will be paid off. The Town of Ithaca at the present time is not suffering any financial hardships. I am trying to look towards 1998 by improving the Water and Sewer collections. We have been very successful in getting all five commissioners , Town Clerks and bookkeepers, together for a demonstration of a new water and sewer billing system .
