SPECIAL TOWN BOARD MEETING
JULY 31 , 1997
5 : 30 P . M.
At a special meeting of the Town Board of the Town of Ithaca , Tompkins County, New York,
held at the Town Hall , 126 East Seneca Street, Ithaca , New York, there were present:
PRESENT: Catherine Valentino , Town Supervisor; Carolyn Grigorov, Councilwoman ; Edward
Conley, Councilman ; Mary Russell , Councilwoman ; John Wolff, Councilman .
EXCUSED: Ellen Harrison , Councilwoman ; David Klein , Councilman .
ALSO PRESENT : Joan Lent Noteboom , Town Clerk; John Barney, Attorney for the Town ; Daniel
Walker, Director of Engineering ; Alfred Carvill , Secretary to the Supervisor.
EXCUSED : Fred Noteboom , Highway Superintendent; Jonathan Kanter, Director of Planning ;
Andrew Frost, Director of Building and Zoning .
OTHERS : Shirley Raffensperger, 139 Pine Tree Road .
CALL TO ORDER: Supervisor Valentino called the meeting to order at 5 : 45 p . m . , and led the
assemblage in the Pledge of Allegiance .
AGENDA ITEM NO. 3 - EXECUTIVE SESSION :
A. POSSIBLE ACQUISITION OF TOWN PROPERTY:
Motion made by Councilman John Wolff, seconded by Councilwoman Mary Russell to move into
Executive Session to discuss the possible acquisition of Town property . Motion carried unanimously.
The Board began Executive Session at 5 : 46 p . m .
Motion made by Councilwoman Carolyn Grigorov, seconded by Councilman Edward Conley to resume
regular session . Motion carried unanimously. The Board resumed regular session at 6 : 35 p . m .
There were no actions taken as a result of the Executive Session .
AGENDA ITEM NO, 4 - OTHER BUSINESS :
Attorney for the Town , John Barney - The Town owns a walkway through Forest Home that leads from
Forest Home Drive to Warren Road . There have been ongoing discussions with Cornell University for
the Town to buy a small piece of land . The path crosses onto the Cretser property at the comer.
Councilwoman Grigorov - Who are the property owners next to the Cretsers?
Attorney Barney - The Bouldins . There is a steep hill to the Warren Road intersection from Forest
Home ,
Councilman Conley - Would that be an uphill hike from the walkway?

APPROVED - AUGUST 11, 1997
Attorney Barney - Yes , it cuts across back lots . Rich Schoch , Highway/Parks Department has been
revising the upgrades of the walkway. My law office represents the buyers , the Westmonts. One of my
partners in the law firm brought this matter to my attention . The buyers are willing to convey a small
strip of land , eight feet by 26 feet to the Town , which has the Town ' s trail already on it. The question
for the Town Board is whether the Town needs it, and does this need to go through a subdivision
process.
Councilman Conley - Would there be monetary compensation made?
Attorney Barney - No , the buyers wish to convey this strip because they do not want the liability.
Councilman Conley - How long has the trail been there?
Director of Engineering , Daniel Walker - The trail has been there quite a while. The owners have been
keeping the area clean .
Attorney Barney - The trail could be moved but it would be a considerable expense as a retaining wall
would have to be built because of the topography in the area .
Supervisor Valentino - The buyers are willing to give this strip of land to the Town?
Attorney Barney - Yes , the Town Board should enact a formal resolution accepting this .
Director of Engineering Walker - Was this a former subdivision ?
Attorney Barney - " No . "
Director of Engineering Walker - The Planning Staff could put this through the subdivision process .
Attorney Barney - The Town Board would need a resolution for acceptance . If the Town could do this
without subdivision approval , the Town could acquire the deed sooner. If the Town needs subdivision
approval it would take longer to acquire the deed .
Councilwoman Russell - The Town would have the conveyance first, then the subdivision approval?
Attorney Barney - No. I am not sure this needs a subdivision approval .
RESOLUTION NO. 122: Motion made by Supervisor Valentino, seconded by Councilwoman
Grigorov that the Town Board of the Town of Ithaca accepts the proposed conveyance of an 8 foot by
26 foot strip of land at 206 Forest Home Drive, which underiies the current location of the Town 's trail
running from Forest Home Drive to Warren Road.
A vote on the resolution resulted as follows :
Supervisor Valentino, aye ; Councilwoman Grigorov, aye ; Councilman Conley, aye; Councilwoman
Russell , aye; Councilman Wolff, aye . Motion carried unanimously.
AGENDA ITEM NO. 5 = ADJOURNMENT:
As there was no further business to come before the Town Board a motion was made by
Councilwoman Grigorov, seconded by Councilman Conley to adjourn . Motion carried unanimously .

Supervisor Valentino adjourned the meeting at 6 : 43 p . m .

BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby accepts
the proposed conveyance of an 8 foot by 26 foot strip of land at 206 Forest Home
Drive , which underlies the current location of the Town ' s trail running from Forest Home
Drive to Warren Road .
