At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County , New
York held at the Town Hall , 126 East Seneca Street , Ithaca , New York, there were present :

CALL TO ORDER : Supervisor Valentino called the meeting to order at 5: 33 p . m . , and led the
assemblage in the Pledge of Allegiance .
AGENDA ITEM NO. 6 - REPORT OF FIRE COMMISSIONERS ,
Bob Romanowski , Board of Fire Commissioners - The Board was supplied with a report on all
response calls handled by the City of Ithaca Fire Department.
A presentation of accommodation was made to Firefighter Shawn M . Flynn at the last
Commission meeting for an emergency medical response he made . On April 25 , 1997 ,
Firefighter Flynn saved the life of a baby choking on a piece of plastic.
The deadline for applications for the position of an Administrative Assistant for Financial Affairs
will be June 12 , 1997 . The position should be filled by July 1 , 1997 .
1 would like to thank the Town Board for sending a letter to the City of Ithaca about the Fire
Department facilities .

The City Council does not expect there to be controversy over a charter change .
The City is changing the due date for the Operating Budget by moving the date forward a month .
Department Heads are concerned because they do not know how this will affect them . The
budget would be need to ready for discussion in August or September.
The False Alarm Task Force in place to study the fire alarms , and define possible solutions to
problems . The overall goal would be to reduce the false alarm calls while increasing the level of
life safety provided . Some people disconnect their systems rather than having an alarm go off or
having to pay a fine . The problem is the maintenance and policing of these systems .
Councilwoman Carolyn Grigorov - Would a good intent call be included in this?
Mr. Romanowski - A good intent call is someone who calls and who is not sure if the Fire
Department should respond . The Fire Department would check into the situation , but they do not
respond with five or six trucks . There is a minimal response to calls of that nature .
During the month of April , there were 13 malicious false calls , 34 system malfunctions , and 164
unintentional false alarms . The Fire Department could submit a report of response calls to the
Town Board every month .
Supervisor Valentino - I receive that report and could supply a report to the Board members
interested in receiving a copy .
Mr. Romanowski - The Chapter " C " Committee is continuing the development of a program for
the delivery of minimum mandated requirements for fire prevention code in places of public
assembly. This is an outgrowth of the 1997 budget process . No date has been scheduled for
the issuance of this report . If anyone would like to know more about this , they could contact the
Fire Chief.
I would like to encourage the Town to follow up on the personnel issues for Fire Station No . 6 .
Supervisor Valentino - I will contact the Fire Chief about Fire Station No . 6 .
AGENDA ITEM NO. 30 - CONSIDER AMENDMENTS TO THE RESTRICTIVE COVENANTS
FOR THE EASTWOOD COMMONS SUNNYHILL HOMEOWNERS ASSOCIATION :
Attorney for the Town , John Barney - When a Homeowners Association was formed there was a
Declaration of Restrictive Covenants the Board approved . The Town requires , as part of those
restrictive covenants , that the developer would not amend them without this Board' s approval of
the amendment .
The Sunnyhill units have been sold and are now owned by individual homeowners . The
homeowners have a question about how to maintain certain levels of insurance and deductibles .
They also want to know what to do with them .

The homeowners would like to remove the requirement that every single amendment to the
restrictive covenants have to come before the Town Board . This Board received a proposed
resolution of amendments that would alter the requirements for the handling of insurance
matters . It would also eliminate the requirement of every amendment to the covenants coming
before the Town Board . Amendments would only come before this Board for approval if thirty
percent or more of the units were owned by the same individual .
Supervisor Valentino - Liability to the Town of Ithaca would be minimal . During previous
discussions , the Board did not see any real problems with this change to the restrictive
covenants .
RESOLUTION NO. 105 : Motion made by Councilman Conley, seconded by Councilwoman
Grigorov that
1) . The Town Board hereby approves the amendments to the Declaration of Restrictive
Covenants governing the Eastwood Commons Sunnyhill Homeowners Association, submitted to
the Town Board for consideration at this meeting, which requested revisions, among other
matters, altered the Declaration provisions relating to insurance and the circumstances under
which future amendments to the Declaration will need approval of the Town Board of the Town of
Ithaca; and
2) . The Town Supervisor be and she is hereby authorized and requested to execute a copy of
such amendments evidencing the approval of same by the Town Board.
A roll call vote on the resolution resulted as follows :

AGENDA ITEM NO , 4 - REPORT OF TOMPKINS COUNTY BOARD OF REPRESENTATIVES :
Tim Joseph , Tompkins County Board of Representatives - The Chamber of Commerce
completed a survey of retailers in the area . The survey revealed that the retailers were evenly
split on whether sales tax should be removed from the sale of clothing . The retailers were
overwhelmingly against increasing property taxes to make up for any loss of revenues .
Councilwoman Russell - What kind of retailers were surveyed ?
Mr. Joseph - I am not sure because the Chamber of Commerce did the survey . They probably
included people who sell clothing . This showed a fairly sophisticated awareness . The
immediate reaction from retailers would be to remove the tax, although half of the retailers
thought enough to say differently . The County Budget Committee decided to leave this issue

alone for now. Since the study was done to show how closely this would effect local
governments support for doing anything has dropped considerably . Beverly Livesay , County
Board Representative , will be drafting a resolution urging the State to stop giving local
municipalities options that serve no purpose other than to cause problems and controversy
between counties .
Councilwoman Harrison - I received a call about the dumping into Coy Glen .
Supervisor Valentino - The Town has been working with the County on this issue .
Councilwoman Harrison - What is the status of the Warren Road reconstruction project?
Mr. Joseph - The project was eliminated from the capital program last year. It is expected to be
proposed again this year. There is some resistance of support because it is not clear if
upgrading roads is a high enough priority. Is it worth that much money when other things could
also use that money. There is some feeling that we should be focusing on public transportation
efforts rather than building more roads . The existing roads should be maintained , but expanding
the network would take some convincing .
Councilwoman Harrison - This project would not expand the road network .
Mr. Joseph - It would be making the road bigger. It is not just maintaining it as it is .
Councilwoman Harrison - By paving shoulders?
Mr. Joseph - Yes , and by putting in sidewalks and new drainage .
Councilwoman Harrison - As a bicyclist , the idea of putting in shoulders would be a great benefit .
The Town would appreciate the County keeping us informed about the progress of this issue .
Mr. Joseph - There was an objection raised last year because no one asked the neighborhood
residents if they wanted the reconstruction . The County was concerned about doing a big capital
project for the neighborhood only to find out they did not want the reconstruction .
Supervisor Valentino - Those issues were discussed in the Public Works Meeting .
Mr. Noteboom - Those discussions revealed suggestions of handling the project like the Mitchell
Street construction . The Engineering Department did the actual engineering work to balance
some of the work the County did for the Town .
Supervisor Valentino - I have heard from a few neighbors in that area about the excessive speed
of cars passing in front of the schools . They suggested that the County make the road have " no
passing zone" through the school zones . There are some people who live there who are really
concerned about the traffic flows . The Public Works Committee has not moved forward on this
issue yet .

Mr. Joseph - When this was discussed in a Capital Committee meeting last year, the County' s
Engineering Department said they would do a survey .
Supervisor Valentino - Warren Road reconstruction needs to be discussed further with the
County .
AGENDA ITEM NO. 3 as REPORT OF TOWN OFFICIALS .
A. Director of Engineering - See attached .
Councilwoman Grigorov - Where is the company who is doing the Ithacare project from ?
Andrew Frost - They are from Binghamton .
Councilwoman Russell - Do the student interns go out into the field to do surveys without staff
supervisor?
Erik Whitney - No , I do not let them go out alone for three weeks . Right now there are five
Cornell University Engineering Interns in the field with me . There are two crews formed . One
group is working independently , and the other group is working with me . Interns have been used
since 1987 to do most of the Town ' s summer work with good results .
Councilwoman Russell - Could the earth fill coming from the flood control channel be used by the
Town as top soil ?
Mr. Noteboom - Yes . It is very difficult for the Town to handle that large a quantity. The State
Parks employees have taken some for certain sites .
Councilwoman Russell - Is that part of the State requirements ?
Mr. Noteboom - Yes , it would be part of the contracting .
Councilwoman Russell - Could some of this fill be sold to other municipalities?
Mr. Noteboom - "Yes . "

Councilwoman Harrison - Could a report be produced to show the cost of labor time and road
salt for this past winter compared to the past few years?
Mr. Noteboom - "Yes . "

Councilwoman Russell - Where would the Russo Garden Center be located on 1059 Danby
Road?
Jonathan Kanter - The center would be located at the northeast corner of Danby Road and East
King Road . Right at the intersection owned by Evan Monkemeyer.
Councilwoman Russell - Tomorrow night is the first public information meeting of the Draft Park ,
Recreation , and Open Space Plan . It will be held at the South Hill Elementary School . I have
not heard any advertisements for these meetings . Could a notice be sent home with the
students at school about the meeting?
Mr. Kanter - The School District was sent a notice of the meeting , and there was a notice in the
Ithaca Journal last week about the meetings . There should be an advertisement on the Channel
7 tonight, and an announcement on the radio tomorrow.
Attorney Barney - I do not think schools would hand out notices to the students . Some schools
have policies against handing out notices other than for school functions .
Mr. Kanter - The notices have been mailed to all the neighborhood association groups in the
Town .
D. Director of Building and Zoning on See attached .
Mr. Frost - The $8 . 2 million project under multiple residence permits was for Ithacare . They have
their building permit and are in the process of site work.
There was one fire at Therm created by a spark from a machine . The sprinkler system
extinguished the fire .
The Sprinkler Committee met to discuss the sprinkler issues . The Committee is proposing some
modifications that would clarify the guidelines for variances . The Town Board will be receiving a
report when the final analysis is completed .
Keith Christoffersen was hired as the new Building and Zoning Assistant . The Building and
Zoning Department is back to full staff again .
A meeting will be scheduled to discuss open burning in the Town of Ithaca with Attorney Barney ,
Councilman Wolff, Councilwoman Russell , and myself.
I am a member of the Lead Poisoning Prevention Network of Tompkins County which is
compromised of the Health Department , City of Ithaca , and Department of Social Services .
There are two issues this Committee is looking into . One is for the Town to support State
Legislation to provide or require certification for lead inspectors , risk assessors , and contractors
in New York State dealing with paint . A letter was submitted to. Supervisor Valentino that was
prepared by John Anderson , Director of Environmental Health for the County , requesting the

State provide legislation for this type of certification . Secondly , the Committee is looking to have
other municipalities provide these regulations .
Supervisor Valentino has the approval of the Town Board to send a letter in support of the Lead
Poisoning Prevention Network to the State .
Mr. Frost - A magazine identified 320 children from New York State during 1993 to 1994 ,
excluding New York City , of having lead blood levels that were o high due to residential
renovation and remodeling .
Councilman Conley - Are there any time frames on the Ithacare project?
Mr. Frost - The building permits were issued for one year. The architectural firm for Ithacare has
been changed which has slowed down their progress .
Councilman Conley - Ithacare is doing site work right now?
Mr. Frost - "Yes . "
Councilman Conley - Would construction be started this year?
Mr. Frost - There may be some construction started this year.
AGENDA ITEM NO. 9 - PUBLIC HEARING : TO CONSIDER A, " LOCAL LAW AUTHORIZING
CONDUCT OF BELL JAR GAMES BY AUTHORIZED ORGANIZATIONS WITHIN THE TOWN
OF ITHACA
Supervisor Valentino opened the public hearing at 6 : 15 p . m . . The Town Clerk had proof of
posting and publication .
Gary Teeter, Veteran Volunteer Fireman ' s Association - At the time the Association requested
the Bingo licensing we understood that bingo and bell jar games were combined in one local law.
They were not. The Association is requesting that bell jar games be included in a local law.
Councilman Conley - What does the Association do with the money raised?
Mr. Teeter - The Association contributes money to help support the firemen ' s home on the
Hudson . A retirement home for people who were in the fire service for the State of New York.
The Association has not been able to give money to other charities because the crowds for
Bingo games have been small . Hopefully , the bell jar games would help the Association raise
more money.
Harold Perry , President of the Veteran Volunteer Firemen ' s Association - Mr. Teeter mentioned
everything that I was going to say . Whatever the Town Board decides is your privilege .

Gary Oliver, past Governor of the Ithaca Moose - The Ithaca Moose Club has sold their current
building and are now looking to relocate . The Moose Club is already authorized to sell bell jar
tickets in the City. The club would not survive without them . A portion of the bell jar money
would be donated to charities , mostly youth organizations . The club does a lot of suppers and
breakfasts by donating the food and the facility. The club cannot move into the Town of Ithaca
with the anticipation that bell jar games would not be allowed . The club cannot find a location in
the City of Ithaca to meet our needs , that is reasonable in price , and centralized for people to
come to for functions . The Moose Club is not a social drinking club . The club' s function is to
service the public and fellow members as well as the Veteran Volunteer Firemen ' s Association
does . The Moose Club is interested in the outcome of this issue because they would like to
relocate in the Town of Ithaca . There are a number of different locations that the club has
looked at. Our new location is not definite yet because we need to know the outcome of this
issue .
Councilman Conley - The Elks Club is in a similar situation .
Mr. Oliver - Yes . There have been discussions to have the Moose Club and the Elks Club enter
into an agreement to purchase a building or a lot together to keep costs down . Most of the bell
jar receipts now go to the State rather than the municipality .
Supervisor Valentino closed the public hearing at 6 : 20 p . m . , and brought the matter back to the
Board for consideration .
Councilman Conley - Both the Elks Club and the Eagles contribute a lot to local charities such as
the small fry football , Babe Ruth Baseball , etc. The Eagles contribute a sizable amount to
charities and activities of the club . If the Moose and the Elks cannot relocate in the Town of
Ithaca or relatively close to the city , they would be less effective . People should not complain
about gambling because lottery tickets sold in grocery stores are basically the same thing .
Councilman Wolff - I am opposed to gambling and any form of policies to promote gambling .
There are certain aspects of gambling that would be looked upon negatively . However, what is
being proposed here is not one of the negative qualities of gambling . The organizations provide
community services , as well as promote their own activities .
AGENDA ITEM NO. 10 - CONSIDER SEAR RELATED TO A, " LOCAL LAW AUTHORIZING
CONDUCT OF BELL JAR GAMES AUTHORIZED ORGANIZATIONS WITHIN THE TOWN OF
ITHACA
RESOLUTION NO. 88: Motion made by Councilwoman Grigorov, seconded by Councilman
Conley that the Town of Ithaca Town Board hereby makes a negative determination of
environmental significance in accordance with the New York State Environmental Quality Review
Act for the above referenced action as proposed and, therefore, neither a Full Environmental
Assessment Form, nor an Environmental Impact Statement will be required.

AGENDA ITEM NO . 11 - CONSIDER ENACTMENT OF A. " LOCAL LAW AUTHORIZING
CONDUCT OF BELL JAR GAMES BY AUTHORIZED ORGANIZATIONS WITHIN THE TOWN
OF ITHACA
Councilwoman Harrison - Under Section 4 of the Local Law, Sunday Games refers to the State
Law. Could something be added instead of the three days setforth , such as " as may be
amended" . If the State amends their law, would the Town need to adopt another law or could the
Town reference any future amendments of the State Law ?
Attorney Barney - I do not want to enumerate the days because they were religious holidays . I
do not think the Board needs to readopt this if the State Law changed .
RESOLUTION NO. 89: Motion made by Councilman Conley, seconded by Councilwoman
Harrison that the Town Board of the Town of Ithaca hereby adopts the Local Law entitled
"LOCAL LAW AUTHORIZING CONDUCT OF BELL JAR GAMES BY AUTHORIZED
ORGANIZATIONS WITHIN THE TOWN OF ITHACA "; a copy of which has been submitted to
and included with the minutes of the meeting of which this resolution is a part, and be it further
RESOLVED, that such Local Law be submitted to a mandatory referendum pursuant to Section 7
of said Local Law and Section 188 (2) of the General Municipal Law and Section 23 ( 1) of the
Municipal Home Rule Law, and be it further
RESOLVED, that if the electors of the Town of Ithaca voting upon the proposition related to such
Local Law approve the adoption of such Local Law, the Town Clerk is directed to enter said Local
Law in the Local Law .book of the Town of Ithaca and to give the notice of adoption of the Local
Law to the Secretary of State of New York.

Supervisor Valentino - This would put the issue on the ballot in November , so there is one more
step to go through .

AGENDA ITEM NO. 31 - CONSIDER AUTHORIZATION FOR PAYMENT OF THE TOWN OF
ITHACA' S SHARE OF THE LOCAL WATERFRONT REVITALIZATION PLAN :
Mr. Kanter - The Town was notified by the State , along with Tompkins County , that we were the
recipients of a grant in the amount of $50 , 000 for the coordinated Local Waterfront Revitalization
Program . The County is interested in getting started on this project, there need to be some items
put in order first. The Town needs to authorize their share towards the grant.
James Hanson , Tompkins County Commissioner of Planning - I would like to thank the Town
Board for their endorsement of the Waterfront Study . This is a start to help other municipalities
in the County . The Chamber of Commerce should be passing their endorsement of this soon .
We are happy with the Waterfront Study. It put all the communities in a position to make
applications for the Small City' s Community Development Block Grant. There were several
projects on Inlet Island to put the City in a position to receive this grant. They included copies of
the study along with the application . The County also did Portland Point for the Town of
Lansing . The staff at HUD liked both projects very much . Tompkins County and Ithaca are on
the leading edge of those applications .
New York State and the Department of Coastal Resource Management submitted an amount of
money to match the grant to do the Local Waterfront Revitalization Plan . These are plans that
various jurisdictions would implement.
The State contributed $50 , 000 to match the local share , and the length of the study would be
approximately 18 months . A lot would depend on the progression of communities working on the
projects . There would be a regional plan for the community along the edge of the lake area , and
there would also be implementation aspects of that project . The local governments control the
land use laws . Comprehensive Planning is occurring for the six communities within Tompkins
County and the State of New York .
I would like to thank the Town staff and Town Board for supporting this plan .
Mr. Kanter - The Town had made an informal arrangement to participate in this study for an
amount not to exceed $ 10 , 000 . This amount is available in the 1997 Budget.
RESOLUTION NO. 106: Motion made by Councilwoman Harrison, seconded by Councilwoman
Russell that the Town Board of the Town of Ithaca does hereby approve an amount not to
exceed $ 10, 000 from Account #88020. 406 to be used for the preparation of a Local Waterfront
Revitalization Program .

Alfred Carvill - There is a voucher before the board of the General Part-Town Fund for the
payment of the $ 10 , 000 to be issued tonight .
AGENDA ITEM NO . 32 = CONSIDER APPOINTMENTS TO THE LOCAL WATERFRONT
REVITALIZATION PLANNING COMMITTEE .
RESOLUTION NO. 107: Motion made by Supervisor Valentino, seconded by Councilman
Conley that the Town Board of the Town of Ithaca hereby appoints Carolyn Grigorov to serve on
the Steering Subcommittee of the Local Waterfront Revitalization Program Oversight Committee;
and be it further
RESOLVED, that the Town Board of the Town of Ithaca hereby appoints Jonathan Kanter,
Director of Planning, to serve on the Planning Subcommittee of the Local Waterfront
Revitalization Program Oversight Committee.

Supervisor Valentino - The Town was able to reduce the expense of the Independent Auditors by
$4 , 000 this year. The expense would had been reduced more except a separate report was
needed to report the FEMA Grant Funds received for the 1996 flooding repairs .
Most of the funds look healthy . Our interest earnings are sixty percent of the budget at this
point . The interest summary shows approximately $ 178 , 000 , this has doubled from last year.
Mr. Carvill - Estimates have been prepared through the end of the year on interest earnings . It
appears the Town will be between 9 . 8 % to 10% in excess earnings as of July 30 . As of August
12 , interest earnings should be about $ 183 , 000 .

Councilman Wolff - Would that be for just the interest or total revenue?
Mr. Carvill - I estimated between $ 17 , 000 and $22 , 000 in excess interest. All revenues from
water and sewer collections are now being deposited directly into interest bearing accounts .
Money is being laddered and put into enrolled money market accounts for 30 to 90 day intervals .
By enrolling the money and rotating it into proper depository instruments , we are generating
income by doing nothing other than improving the collection process . We do not deposit money
into checking accounts because all the Town ' s receipts go directly into interest earning accounts .
The only time checking accounts receive money is when a check is written . All the checking
accounts are closed except for two operational checking accounts . We have consolidated all the
accounts for the bank to manage the accounts more quickly, and to be able to balance more
easily . The Town would be able to receive the money and know what the real figures are .
Supervisor Valentino - Mr. Carvill has convinced the bank to waive most of the fees that were
being paid for their services .
Mr. Carvill - The savings should be almost $3 , 000 a year.
Supervisor Valentino - Water and sewer accounts balanced with Bolton Point for the very first
time .
AGENDA ITEM NO. 4 - REPORT OF TOWN COMMITTEES :
Councilman Wolff - The Information Technology Committee ( ITC ) does not have an official report
for this month . Computer training for Town employees has been going well . There have been
some technical problems regarding the new software and new hardware . Those problems are
being worked out. The ITC determined it would be beneficial to maintain a connection to the
internet. The next step will be to provide a presence for the Town of Ithaca to pass information
through the internet. The Board needs to decide on what the name should be for the internet ,
such as TOWN . ITHACA. NY. US .
The Board agreed to Councilman Wolff' s suggestion to have TOWN . ITHACA. NY. US as the
Town name on the internet .
Councilwoman Russell - The Recreation Partnership Committee has not met since the last Town
Board meeting .
Supervisor Valentino - Holly Beermann , the representative for the Joint Youth Commission , has
received feed back from people wondering if the Town is receiving full value from the Recreation
Partnership . The Town has two more years with the contract. Ms . Beermann suggested that it
may be good for the Town to separate from the Recreation Partnership . We should be looking
ahead to see if the Town ' s youth needs are being served . People who have been volunteers

should be contacted to see what has been happening . A meeting should be scheduled to see
how the expense benefits the youth programs , and to see what improvements need to be done .
The Town Board was in agreement with Supervisor Valentino Is suggestion about looking into the
youth programs .

The Town Board briefly discussed the letter submitted from Walter Wiggins stating that an
application would be made for an on -premises liquor license for Turback' s Restaurant located at
919 Elmira Road . Turback' s Restaurant is being sold to Jekabs Pulsts . Mr. Pulsts' corporation
will be making the application for the license .
Supervisor Valentino - Does the Town Board need a resolution for the liquor license?
Mrs . Noteboom - The Town Board only needs a resolution if there are objections to the State
granting the license .

The Town Board briefly discussed the letter submitted from the Department of Public Service ,
John C . Carey , about a Temporary Operating Authority for Time Warner to continue providing
cable television service during negotiations of a renewal franchise agreement .

The Town Board briefly discussed the letter submitted from the District Manager of the Postal
Service , John A. Rapp , about transferring ownership of the Ithaca Downtown Post Office to the

The Town Board briefly discussed a letter from Supervisor Valentino addressed to the Director of
Tompkins County Division of Assessment , Stephen F . Whicher, along with payment for one ( 1 )
set of correct 1997 Town and County Tax Bills . Supervisor Valentino reiterated that an
agreement should be made and signed with Tompkins County to set the costs of the tax bills
before the yearly budget process .
E. Debra B. Gregg , Request for Appointment to Ethics Board - See attached letter.
The Town Board briefly discussed the letter submitted from Debra . B . Gregg stating that she
would like to be considered for an opening on the Ethics Board .

Councilwoman Harrison - Guy Gerard telephoned about the right-of-way across the South Hill
Trail . The understanding is that Therm received a right-of-way through the South Hill Trail
through an easement to buy a driveway across the trail . There were concerns of how this would
effect vehicles being in conflict with pedestrians .
Supervisor Valentino - The right-of-way is in the City of Ithaca . The area in question is not in the
Town of Ithaca . It should not effect the Town .
Councilwoman Harrison - Who has the easement for the trail in that area ?
Mr. Kanter - The Town has the easement with Therm . Therm owns the right-of-way .
Councilwoman Harrison - The Town has the easement even though it is in the City?
Mr. Kanter - "Yes . "
Councilwoman Harrison - The Town should be involved since it impacts the Town ' s easement in
some way . The Town should be concerned about that impact .
Supervisor Valentino - The land is owned by Therm . The Town only has an easement for the
trail . Therm received an easement for the driveway to the Raponis , which has been in place for
some time now.
Mr. Kanter - I am not sure when the Raponi ' s received the easement from Therm . There may be
legal questions as to whether the Town ' s easement has certain rights that could be violated by
granting another easement. The impression is that there is nothing in the Town' s easement that
precludes Therm granting the Raponi ' s the easement.
Councilwoman Harrison - It could impair the uses for which the Town granted it.
Attorney Barney - As long as the easement does not prevent the Town from using it for the
purpose it was granted for these shouldn ' t be a problem . I would need to review the easement
the Town has .
Supervisor Valentino - This issue should be added to next month ' s agenda for a discussion when
all the research has been done .
The Town Board agreed to add this issue on the July Town Board agenda .

Nancy Goody , 113 Penny Lane - I am speaking for a few neighbors and myself. I believe
enforcing the restrictive parking is a solution , but a better approach would be to have " no
trespassing" . It is a solution , but it is not a solution I am happy with . There should be
enforcement for no trespassing . Also a request should be made to the City of Ithaca to post their
" no trespassing signs" more visibly .
Supervisor Valentino - Because of discussions with the State Police , the City of Ithaca' s
Department of Public Works were going to post the signage that would be adequate for the State
Police to enforce the " no trespassing" . The Department of Public Works will be working with the
State Police so they are both communicating on the same level . The State Police researched
the area and mentioned it would be very hard to enforce " no trespassing" with the signs that are
in place now.
Councilwoman Harrison - The " no trespassing signs" would deal with the problem after 10 : 00
P . M . ?
Ms . Goody - "Yes . "
Councilwoman Harrison - Ms . Goody mentioned that the State Police would enforce after
the last meeting , it did not sound like they would .
Councilman Klein - The State Police do not want to chase people through the woods in the dark.
Ms . Goody - If the State Police were called they would enter the neighborhood and wait for
people to leave . Could the parking limitations be made seasonal ? The problem occurs from
May 1st to September 1st . There is no need to keep people out of the neighborhood in the
wintertime .
Councilwoman Grigorov - That would be a good idea . It could be inconvenient for the residents
to have restrictive parking during the entire year.
Attorney Barney - Should the " no trespassing sign " be worded from May 1 st to September 15th?
Ms . Goody - Yes , because that would cover the warm months and the Labor Day weekend .
What sections of Penny Lane and Penny Lane Extension would this cover?
Attorney Barney - It would be everything west of Abbey Lane .
Ms . Goody - Would this be for both sides of the street?
Attorney Barney - "Yes . "

Ms . Goody - If it were for both sides of the street , how far apart would the signs be posted ?
Supervisor Valentino - The State Law requires that the signs be a certain footage apart .
Attorney Barney - There is a Uniform Traffic Control Act that the Town would need to follow.
Mr. Noteboom - Would the signs be a large impact on the neighborhood?
Ms . Goody - Only if there were no parking for the whole neighborhood all year round . The first
choice would be for better enforcement . I am thinking of ways to make it more palatable . If this
is approved for Penny Lane and Penny Lane Extension west of Abbey Road , people could park
on the east side of Penny Lane and enter the gorge from that direction . If parking was
eliminated in this area they would find another place to park. Along the north side of Penny Lane
and Penny Lane Extension there is a drainage ditch that is important to the neighborhood . The
Town cuts around the drainage ditch during the summertime . I hope this will not prohibit getting
the machinery in to keep the ditch clear.
Mr. Noteboom - The Highway Department would be very careful .
Ms . Goody - The neighborhood is happy that the Town is taking an active role in relation to this
issue .
Councilwoman Grigorov - Could the " no parking" be done on a trial basis for one summer to see
how things go?
Attorney Barney - The Town should adopt the Local Law to help eliminate any future problems .
Nancy Gabriel , 53B Lois Lane - The previous speaker echoed a lot of my concerns . I did not
think about the seasonal limitation , but from May 1st to October 1st would be simple . I am in
favor of the ordinance restricting the parking . There has been a lot of work done to create an
access road for maintenance of the reservoir pipes . Would there be a way for the State Police
to have access to that road which is blocked to traffic? The City Department of Public Works
would need to discuss this with the State Police . The Town could consider permits for the
residents by issuing cards to them to put in the windshield , and for their guests . Then resident
cars and guest cars would not be ticketed . It seems to be a fairly simple procedure that would
solve the problem .
Councilwoman Grigorov - Would the issuance of permits be possible?
Councilwoman Harrison - What is the legality of this?
Attorney Barney - That could not be done because the Town is not permitting a road for private
use .
Ms . Gabriel - Does this exist any where else in the State of New York?

Councilman Conley - Is it possible for guests or residents with more than one car to expand their
driveways?
Ms . Gabriel - I am not. sure , but the houses are pretty close together on Penny Lane Extension .
Councilman Conley - If people could create a parking space that is not a Town road that could
be restricted to a guest lot.
Ms . Goody - The Penny Lane neighbors are very friendly . If someone needed a space to park a
guest' s car they could use a neighbor' s driveway .
Councilwoman Harrison - Philip Ackerman submitted a letter to the Town Board opposing the
restrictive parking on Penny Lane because of the need for guest parking .
Tom Bond , 110 Penny Lane - I am in favor of the restrictions outlined . The only concern would
be the guest parking . Who is responsible for patrolling the neighborhood and issuing the
tickets?
Supervisor Valentino - The State Police and the Sheriff' s Department .
Mr. Bond - The police would issue tickets after being summoned by a resident?
Supervisor Valentino - Not necessarily , the State Police have agreed to patrol the area on
weekends . They would also respond to the calls from the residents .
Mr. Bond - The residents could call the police and provide a license plate number of a guest' s
car so that car would not be ticketed ?
Councilwoman Harrison - For the reasons outlined previously the police could not do that. .
Mr. Bond - The residents of the neighborhood would like to thank the Town Board for their
prompt consideration and response to this issue . There are a lot of people entering Penny Lane
who do not see the dead end sign . The sign is still there , but not being seen . Would it be
possible to post a second sign further down the road ? There is a circle that belongs to no one
that would provide the opportunity to turn around .
Mr. Noteboom - The Highway Department could post another dead end sign further down the
road .
Councilman Conley - The biggest concern should be the fires that people set in the gorge area .

RESOLUTION NO. 93: Motion made by Councilman Conley, seconded by Councilman Klein
by formal resolution the Town Board of the Town of Ithaca, Tompkins County, New York as
follows:
Section 1 . It is hereby determined that it is in the public interest to establish said Town of
Ithaca Water System Benefited Area - 1997 - Buttermilk Falls Area and to make the water
improvement hereinafter described and such water improvement is hereby authorized. The
proposed area hereby determined to be benefited by said Town of Ithaca Water Improvement -
1997 - Buttermilk Falls Area is all of the Town of Ithaca outside of the Village of Cayuga Heights.
Section 2. The proposed improvement shall consist of construction and installation of new 8
inch water main extensions running east from the intersection of Route 13 and Buttermilk Falls
Road East along Buttermilk Falls Road East approximately 400 feet to the entrance of Buttermilk
Falls State Park, together with related facilities at an initially determined maximum estimated cost
to said benefited area of $25, 000. 00. 1 . The method of financing of said cost shall be by
assessments in the year of construction levied upon and collected from the several lots and
parcels of land deemed benefited from said improvement and located in said Town of Ithaca
Water System Benefited Area - 1997 - Buttermilk Falls Area, so much upon and from each as
shall be in just proportion to the amount of the benefit which the improvement shall confer upon
the same.
Section 3. It is hereby determined that the estimated expense of the aforesaid improvement
does not exceed 1/1 0th of I % of the full valuation of the taxable real property in the area of said
Town outside of Villages and, therefore, in accordance with the provisions of subdivision 13 of
Section 209-q of the Town Law, the permission of the State Comptroller is not required for such
improvement.

Section 4. Pursuant to subdivision 6 (d) of Section 209-q of the Town Law, the Town Clerk is
hereby directed and ordered to cause a certified copy of this resolution to be duly recorded within

so recorded, shall be presumptive evidence of the regularity of the proceedings and action taken
by the Town Board in relation to the aforesaid improvement.
Section 5. It is hereby further determined that all of the cost of the aforesaid improvement shall
be borne wholly by property within the Town of Ithaca Water System Benefited Area - 1997 -
Buttermilk Falls Area, being the entire area of the Town outside of the Village of Cayuga Heights.
Section 6. This order is adopted subject to permissive referendum .

Grigorov that the Town of Ithaca Town Board hereby makes a negative determination of
environmental significance in accordance with the New York State Environmental Quality Review
Act for the above-referenced action as proposed and, therefore, an Environmental Impact
Statement will not be required.

RESOLUTION: Motion made by Councilman Klein, seconded by Councilwoman Russell to
establish, "PROPOSED SEWER IMPROVEMENT AREA TO BE KNOWN AS THE TOWN OF
ITHACA SEWER SYSTEM BENEFITED AREA - 1997 - BUTTERMILK FALLS AREA IN THE
TOWN OF ITHACA, TOMPKINS COUNTY, NEW YORK PURSUANT TO ARTICLE 12- C OF
THE TOWN LAW'. .
Councilman Klein - The Town Engineer was asked to confirm the State' s participation in the
sewer project .
Mr. Whitney - The Town Engineer has not talked to the State yet . The State has to award the
money to do the improvements of the park.
Supervisor Valentino - Discussions with the Town Engineer revealed that the State is in favor of
giving money for the project . No amount has been decided upon at this point .

Councilman Klein - Should this be part of the public interest order, or be a part of the
authorization to accept bids? The State should be committed before the Town enters into a
contract .
Attorney Barney - If the State does not respond in a way the Board is comfortable with , would the
Board go ahead with the project?
Councilman Klein - I would not .
Attorney Barney - The Town ' s public interest order is a mechanism that establishes the district
and authorizes the project . If this Board is not prepared to authorize the project by not knowing
about the State Park participation , the Board may want to defer this .
Mr. Whitney - The State needs to rebuild the septic, and the Health Department would build it for
them . All the nutrient leakage from the septic is entering the Buttermilk Creek. It would be up to
the State to close the bath houses and any waste dumping stations for their recreational vehicle
trailers .
Councilwoman Russell - Would the Town loose their leverage if this is accepted ?
Councilman Klein - I think so . There is an existing water main near the proposed water project .
The main is very old and has had many repairs . The Town was obligated to do the water portion
regardless of repairing the main . This project is expensive just to take care of a septic field
problem which the State would be obligated to rebuild . The Town should be watching out for the
interest of the constituents .
Attorney Barney - The Town cannot stop a project by advertising for bids , but the problem is the
water and sewer bids are tied to together.
Councilwoman Harrison - Could the Town wait another month ?
Mr. Whitney - This job should only take 30 days to complete .

Mr. Noteboom - The Town Engineer wanted to bid both projects together because of the size .
Attorney Barney - Both projects are subject to permissive referendum . The Board could receive
bids , but an award should not be given until the 30 days called for if the referendum passed .
Supervisor Valentino - What does the Board do at this point?
Attorney Barney - The Board should rescind the water resolution authorizing the bid until such
time as the sewer is passed . Then the Board should propose a joint bid .

Councilman Klein - I will withdraw the motion for the public interest order to establish the
Buttermilk Falls on the sewer district.
Councilwoman Russell - I will also withdraw the motion for the public interest order on the sewer.
Supervisor Valentino - Could the water resolution be left as is?
Attorney Barney - The Board should rescind the authorization for bid on Agenda Item No . 18 .
The consent of the Board was to withdraw that motion .
Councilwoman Harrison - Rather than withdrawing the resolution for Agenda Item No . 18 , the
Board should amend it to say the advertisement would be concurrent with sewer.
Attorney Barney - The Board would be better off rescinding the resolution and starting fresh .
RESOLUTION NO. 95: Motion made by Councilwoman Russell, seconded by Councilman
Conley that the Resolution No. 94, previously adopted at this meeting approving the contract
specifications and authorizing the advertisement for bids for the construction of a WATER
IMPROVEMENT AREA TO BE KNOWN AS THE TOWN OF ITHACA WATER SYSTEM
BENEFITED AREA - 1997- BUTTERMILK FALLS AREA IN THE TOWN OF ITHACA,
TOMPKINS COUNTY, NEW YORK PURSUANT TO ARTICLE 12- C OF THE TOWN LAW, be
rescinded at this time.
Councilman Klein - The public hearing and the SEAR on the water would still stand ?

AGENDA ITEM NO. 25 - CONSIDER AMENDING THE CONTRACT WITH THE COMMUNITY
DISPUTE RESOLUTION CENTER TO INCREASE SERVICES AND COMPENSATION :
Councilwoman Harrison - Have the services they have been providing been done well ?
Supervisor Valentino - The Community Dispute Resolution Center has not provided services for
a lot of individual complaints at this point. More money than expected was used to start working
on the new Personnel Manual . The second half of the year should define how well it works for
the employees .
Councilman Conley - What is the resolution asking ?
Supervisor Valentino - I would like to increase the budget by $ 1 , 350 . 00 for this year.

Councilman Conley - Would this be increased only one time? The Board would be able to look
at this again during the next budget process?
Supervisor Valentino .- "Yes . "
Councilman Conley - Providing the service is a good idea if people use it , but if they are not it
needs to be adjusted .
RESOLUTION NO. 100: Motion made by Supervisor Valentino, seconded by Councilman
Conley that the governing Town Board does hereby approve and amend the agreement with the
Community Dispute Resolution Center, Inc. , to increase the total amount of compensation to be
paid to the CDRC from no more than $950. 00 per annum to no more than $ 1 , 950. 00 per annum;
and be it further
RESOLVED, the governing Town Board does hereby authorize and direct the Fiscal Officer to
record the above said budget amendment to cover the additional contract amount for the year
1997.

AGENDA ITEM NO. 26 = CONSIDER REQUEST BY HIGHWAY SUPERINTENDENT TO HIRE
ADDITIONAL EMPLOYEES :
Supervisor Valentino - The Highway Department has two laborers who are outstanding workers
who help complete the maintenance on the water and sewer. They make good decisions and get
the work done . By moving these two laborers up in classification the Highway Department needs
two additional laborers to help fill in the work gap . It was suggested by the Human Resource
Specialist to hire these new laborers under class " C " instead of class " B" .
Mr. Noteboom - The difference between class " B " and class " C " is that a class " B" laborer can
drive Town equipment and Town trucks with the appropriate license . Class " C" laborers would
not be able to drive the same equipment and trucks .
Councilwoman Grigorov - Would these workers be year round or seasonal ?
Mr. Noteboom - These laborers would be year round employees . When the Highway
Department does emergency repairs there are not enough employees to fulfill the safety
requirements of OSHA and PESH .

Councilwoman Russell - The proposed resolution states there would be no new positions
created through Civil Service . Are class " B " and class " C " Civil Service ?
Supervisor Valentino - The Human Resource Specialist would inform Civil Service that these
classifications were created .
Councilwoman Harrison - Would these be two new full -time positions ?
Supervisor Valentino - " Yes . "
Councilwoman Harrison - Water and sewer work is being charged to water and sewer accounts ,
not to the Highway accounts?
Mr. Noteboom - That is correct .
Supervisor Valentino - Mr. Carvill has been tracking these items appropriately .
Councilwoman Harrison - Why is the Highway Department hiring new laborers , and how does
this rate affect the budget?
Mr. Noteboom - Presently , all the emergency water repairs and some sewer repairs are
performed by an outside agency , Cortland Paving . A fairly substantial amount of money is
needed to contract with an outside company . Money would be saved by having the Highway
Department do these repairs .
Councilwoman Harrison - In the budget next year there should be a substantial decrease in the
account that covers outside repairs?
Mr. Noteboom - "Yes . "
Supervisor Valentino - The water system in the Town is getting old , and the maintenance needs
to be improved .
RESOLUTION NO. 101 : Motion made by Councilwoman Grigorov, seconded by Councilwoman
Russell that on the recommendation of the Highway Superintendent and the Public Works
Committee the governing Town Board of the Town of Ithaca does hereby approve the addition of
two laborer positions as (c) classification for the Highway Department.

Supervisor Valentino - The Southern Cayuga Lake Intermunicipal Water Commission ( SCLIWC )
has approved this . The bids received were $6 , 000 higher than anticipated , but the low bid was
considerably lower than the others .
RESOLUTION NO. 103: Motion made by Supervisor Valentino, seconded by Councilman Klein
that this governing Town Board approves, authorizes and directs the chief fiscal officer to record
said budget amendment to the Town accounting/financial records; and be it further
RESOLVED, that the Town Board of the Town of Ithaca hereby authorizes the award of the
contract for the Construction of transmission main repairs to Rasmussen Construction, Earlville,
New York, for the contract amount of $36, 000, subject to final approval of the contract
documents by the Town Engineer and the Attorney for the Town, and be it further
RESOLVED, that the Town Board of the Town of Ithaca hereby authorizes the expenditure of an
amount not to exceed $40, 000 from the Water Fund line item appropriation F8340. 489 for
contract costs incurred.

Attorney Barney - I would like to present an amendment to the Zoning Ordinance to make it
clearer that if someone was in a non-agricultural activity in an agricultural zone that the rules for
R-30 would apply .
Mr. Kanter - The Planning Board could comment on this recommendation at the July 1 , 1997
meeting .
RESOLUTION NO. 108: Motion made by Supervisor Valentino, seconded by Councilwoman
Harrison that the Town Clerk is hereby authorized and directed to advertise for a public hearing
to be held at the next regular meeting of the governing Town Board on July 7, 1997, at 6: 15 p. m. ,
in order that the Town Board may consider an amendment to the Zoning Ordinance clarifying the
applicability of R-30 regulations to non-agricultural activities in agricultural districts.

IMAGING PRACTICES WITH TOMPKINS COUNTY TRUST COMPANY .
Mr. Carvill - The Tompkins County Trust Company has developed a check imaging system which
would copy the front and the back of the checks . This would reduce paper. The checklist would
be attached to the reconciliation reports rather than having boxes of checks returned each
month . This would be a great product and very useful for the Accounting Department.
Councilwoman Grigorov - The bank would keep the checks?
Mr. Carvill - Yes . The Town would receive copies of the checks , the deposit slips and withdrawal
slips .
Attorney Barney - How long would the canceled checks be on record at the bank?
Mr. Carvill - I understand that the bank may keep checks on tape for three years . Subsequently ,
they will be destroyed .
Attorney Barney - The tape is destroyed or are the checks destroyed?
Mrs . Noteboom - The checks would be destroyed . There would still be the microfilm of the
checks .
Supervisor Valentino - The bank has a system to verify the canceled checks if the Town needed
a copy for legal reasons .

WHEREAS , this action is the enactment of a local law authorizing conduct of bell jar games

WHEREAS , this is an unlisted action for which the Town of Ithaca Town Board is legislatively
determined to act as Lead Agency in environmental review with respect to the enactment of
local laws ; and

WHEREAS , a resolution was duly adopted by the Town Board of the Town of Ithaca for a
public hearing to be held by said Town on June 9 , 1997 , at 6 : 15 p . m . at the Ithaca Town Hall ,
126 East Seneca Street, Ithaca, New York, to hear all interested parties on a proposed local
law entitled " LOCAL LAW AUTHORIZING CONDUCT OF BELL JAR GAMES BY
AUTHORIZED ORGANIZATIONS WITHIN THE TOWN OF ITHACA", and
WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal , the
official newspaper of the Town , and was duly posted on the bulletin board of the Town Hall ,
and
WHEREAS , said public hearing was duly held on said time and date at such location and
all parties in attendance were permitted an opportunity to speak on behalf of or in opposition
to the said proposed local law, or any part thereof, and
WHEREAS , pursuant to Part 617 of the implementing regulations pertaining to the State
Environmental Quality Review Act it has been determined by the Town Board that adoption of
said proposed local law would not have a significant effect upon the environment, and
WHEREAS , the Town Board of the Town of Ithaca , after due deliberation , finds it in the
best interests of the Town to adopt said local law, subject to submission of same to the public
for approval at the next general election ,
NOW, THEREFORE , be it
RESOLVED , that the Town Board of the Town of Ithaca hereby adopts the Local Law
entitled " LOCAL LAW AUTHORIZING CONDUCT OF BELL JAR GAMES BY AUTHORIZED
ORGANIZATIONS WITHIN THE TOWN OF ITHACA" , a copy of which has been submitted to
and included with the minutes of the meeting of which this resolution is a part, and be it further

pursuant to Section 7 of said Local Law and Section 188 (2 ) of the General
Municipal Law and Section 23 ( 1 ) of the Municipal Home Rule Law, and be it further

A LOCAL LAW AUTHORIZING CONDUCT OF BELL JAR GAMES BY AUTHORIZED
ORGANIZATIONS WITHIN THE TOWN OF ITHACA
Be it enacted. by the Town of Ithaca as follows:
Section 1 . Statutory Authority: Title
This Local Law is adopted pursuant to the authority granted by Section 188 of Article 9-A
of the General Municipal Law and shall be known as the "Town of Ithaca Bell Jar Local Law" .
Section 2. Definitions .
The words and terms used in this Local Law shall have the same meanings as such words
and terms are used in Article 9-A of the General Municipal Law, unless otherwise provided
herein or unless the context requires a different meaning. Without limiting the foregoing, the
definitions of " authorized organization" , " lawful purposes" , " bell jars" , as set forth in Section
186 of the General Municipal Law shall have the same definitions for the purposes of this Local
Law.
Section 3 . Conduct of Bell Jar Games Authorized: Restrictions.
Pursuant to, and in accordance with, the provisions of Section 188 ( 1) of the General
Municipal Law of the State of New York and other applicable provisions of law, it shall be
lawful for any authorized organization, upon obtaining a license therefor -as provided in Article
9-A of the General Municipal Law and other applicable statutes, to conduct the game of bell jars
within the territorial limits of the Town of Ithaca, subject to the provisions of this Local Law,
the provisions of Article 9-A of the General Municipal Law, and the rules and regulations set
forth by any applicable New York State or local agency relating thereto . The conduct of bell jar
games shall be subject to the restrictions imposed by Section 189 of the General Municipal Law.
Section 4. Sunday Games.
Pursuant to Section 195 of the General Municipal Law the conduct of bell jar games on
Sunday between the hours of noon and midnight is hereby authorized. Notwithstanding this
provision no authority is granted to conduct bell jar games on the three days set forth in Section
195 of the General Municipal Law on which days the State of New York prohibits the conduct
of such games.
Section 5 . Control and Supervision.
The powers and duties set forth in subdivision 1 of Section 194 of the General Municipal
Law shall be exercised on behalf of the Town of Ithaca by the Town Supervisor, the Town Clerk,
the Town Building and Zoning Enforcement Officer, and such other person or persons as the
Town may direct by resolution from time to time.

Section 6. Summary Application for License.
Pursuant to Section 190 of the General Municipal Law, applicants for a license who have
obtained an identification number from the New York State Racing and Wagering Board and
otherwise qualifying pursuant to said Section 190 may apply for a license on a summary
application as authorized in Section 190(3) rather than a full application required by Section
190( 1 ) of the General Municipal Law.
Section 7 . Mandatory Referendum.
In accordance with the provisions of Section 188 (2) of the General Municipal Law and
Section 23 ( 1 ) of the Municipal Home Rule Law, this Local Law shall not become operative or
effective unless and until it shall have been approved at the next general election held within the
Town of Ithaca by the affirmative vote of a majority of the qualified electors of the Town voting
upon the proposition.
Section 8 . Partial Invalidity.
If any part or provision of this Local Law or the application thereof to any person or
circumstance be judged invalid by any court of competent jurisdiction, such judgment shall be
confined in its operation to the part or provision or application directly involved in the
controversy in which such judgment shall have been rendered and shall not affect or impair the
validity of the remainder of this local law or the application thereof to other persons or
circumstances.
Section 9 . ]Effective Date .
This Local Law shall take effect, if approved as set forth above by the electors, on
November 15 , 19970

Lois Lane and Abbey Road ; and

ORDINANCE AMENDING THE ORDINANCE REGULATING
TRAFFIC AND PARKING IN THE TOWN OF ITHACA TO PROHIBIT
PARKING ON PORTIONS OF PENNY LANE AND ALL OF PENNY LANE EXTENSION
Pursuant to Section 130 of the Town Law of the State of New York, and Section 1660
of the Vehicle and Traffic Law of the State of New York, the Town Board of the Town of
Ithaca, Tompkins County, New York, does ordain and enact as follows:
Section 1 . Territory Affected. This ordinance shall be applicable to all territory within
the Town of Ithaca outside of the incorporated Village of Cayuga Heights.
Section 2. Amendin of Prior Ordinance. The Ordinance Amending and Restating
Ordinance Regulating Traffic and Parking in the Town of Ithaca, adopted by the Town Board
February 10, 1992, and amended by the Town Board April 13 , 1992, December 12, 1994, and
August 12, 1996, is hereby further amended as follows:
Section 3 entitled " Parking Vehicles" is amended by adding a new subparagraph (t)
reading as follows:
" (t) On both sides of Penny Lane Extension west of Penny Lane, and those
portions of Penny Lane west of the intersection of Penny Lane with the west line
of Lois Lane - Abby Road, during the period from 11 :00 p.m. to 6 :00 a.m. daily
from May 1 through September 30 of each year. "
Section 3 . Effective Date. This ordinance shall be effective 10 days after publication and
posting in accordance with Section 133 of the Town Law.

WHEREAS , this action is the consideration of, "THE MATTER OF THE PROVIDING OF A
PROPOSED WATER IMPROVEMENT AND THE ESTABLISHMENT OF A PROPOSED
WATER IMPROVEMENT AREA TO BE KNOW AS THE TOWN OF ITHACA WATER
SYSTEM BENEFITTED AREA - 1997 - BUTTERMILK FALLS AREA IN THE TOWN OF
ITHACA, TOMPKINS COUNTY, NEW YORK PURSUANT TO ARTICLE 12-C OF THE TOWN
LAW" , and
WHEREAS this is an Unlisted Action for which the Town of Ithaca Town Board is
legislatively determined to act as Lead Agency in environmental review; and
WHEREAS , the Town Board , at a Public Hearing held on June 9 , 1997 , has reviewed and
accepted as adequate a Short Environmental Assessment Part 1 and Part II submitted and
prepared by the Town Engineer, and plans and specifications for Buttermilk Falls Water and
Sewer Improvements , dated April 1997 , and other related materials ; and
WHEREAS , the Town Engineer has recommended a negative determination of
environmental significance with respect to the proposed action ;
NOW, THEREFORE , be it
RESOLVED , that the Town of Ithaca Town Board hereby makes a negative determination
of environmental significance in accordance with the New York State Environmental Quality
Review Act for the above-referenced action as proposed , and therefore , an Environmental
Impact Statement will not be required .

the Town Law to be known as the Town of Ithaca Water
System Benefitted Area - 1997 - Buttermilk Falls Area
WHEREAS , a plan , report and map has been duly prepared in such manner and in
such detail as heretofore has been determined by the Town Board of the Town of Ithaca ,
Tompkins County, New York, relating to the creation and construction , pursuant to Article 12-
C of the Town Law of water system improvements to be known and identified as the Town of
Ithaca Water Improvement - 1997 - Buttermilk Falls Area , and hereinafter also referred to as
"improvement", to provide such water improvement including extensions , to the present Town
water improvement, such water system improvement to be constructed and owned by the
Town of Ithaca , and

WHEREAS , said plan , report and map have been prepared by Daniel Walker, P . E . , the
Town Engineer, a competent engineer duly licensed by the State of New York and have been
filed in the office of the Town Clerk where they are available for public inspection , and
WHEREAS , the area of said Town determined to be benefitted by said Town of Ithaca
Water System Improvement - 1997 - Buttermilk Falls Area shall be known as the Town of
Ithaca Water System Benefitted Area - 1997 - Buttermilk Falls Area and consists of the entire
area of said Town excepting therefrom the area contained within the Village of Cayuga
Heights , and
WHEREAS , the proposed Town of Ithaca Water System Improvement - 1997 -
Buttermilk Falls Area consists of the water improvements set forth below, and in the areas of
the Town as set forth below, and as more particularly shown and described in said map, plan
and report presently on file in the Office of the Town Clerk:
Construction and installation of new 8" water main extensions running east from the
intersection of Route 13 and Buttermilk Falls Road East along Buttermilk Falls Road East
approximately 400 feet to the entrance to Buttermilk Falls State Park.
WHEREAS , the maximum proposed to be expended by the Town of Ithaca for the
aforesaid improvement is $25 , 000 . 00 ; and
WHEREAS , the proposed method of financing to be employed by said Town of Ithaca
consists of expenditure of current revenues and surplus funds from the Town of Ithaca Water
System Benefitted Area - 1997 - Buttermilk Falls Area derived from revenues assessed
against the properties which are deemed benefitted by said improvement; and
WHEREAS , said maximum estimated cost is not greater than 1 /1 0th of 1 % of the full
valuation of taxable real property in the area of the Town of Ithaca outside of any villages; and
WHEREAS , it is proposed that the cost of the aforesaid improvement shall be borne by
the real property in said Town of Ithaca Water System Benefitted Area - 1997 - Buttermilk
Falls Area by assessing , levying upon and collecting from the several lots and parcels of land
within said Benefitted Area , outside of any village , which the Town Board shall determine and
specify to be especially benefitted by the improvement, an amount sufficient to pay the costs
of such improvement in the year in which constructed ; and
WHEREAS , the aforesaid improvement has been determined to be an Unlisted Action
pursuant to the regulations of the New York State Department of Environmental Conservation
promulgated pursuant to the State Environmental Quality Review Act and the laws and

regulations of the Town of Ithaca , the implementation of which as proposed , the Town
Board has determined will not result in any significant environmental effects; and
WHEREAS , the Town Board of the Town of Ithaca duly adopted an order on May 12 ,
1997 calling a public hearing upon said plan , report and map including an estimate of cost
and the question of providing water improvements to be known as the Town of Ithaca Water
Improvement - 1997 - Buttermilk Falls Area , on the 9th day of June, 1997 , at 7 : 25 o'clock p. m . ,
Prevailing Time , at the Town Hall , 126 East Seneca Street, in the City of Ithaca , New York;
and
WHEREAS , notice of said public hearing was duly posted and published as required by
law; and
WHEREAS , said public hearing was duly held at the place and at the time aforesaid
and all persons interested in the subject thereof were heard concerning the same ; and
WHEREAS , it is now desired to authorize the improvement to be known as the Town of
Ithaca Water Improvement - 1997 - Buttermilk Falls Area ;
NOW, THEREFORE , BE IT
RESOLVED , by the Town Board of the Town of Ithaca , Tompkins County , New York,
as follows:
Section 1 . It is hereby determined that it is in the public interest to establish said Town
of Ithaca Water System Benefitted Area - 1997 - Buttermilk Falls Area and to make the
water improvement hereinafter described and such water improvement is hereby
authorized . The proposed area hereby determined to be benefitted by said Town of
Ithaca Water Improvement - 1997 - Buttermilk Falls Area is all of the Town of Ithaca
outside of the Village of Cayuga Heights .
Section 2 . The proposed improvement shall consist of construction and installation of
new 8" water main extensions running east from the intersection of Route 13 and
Buttermilk Falls Road East along Buttermilk Falls Road East approximately 400 feet to
the entrance to Buttermilk Falls State Park, together with related facilities at an initially
determined maximum estimated cost to said benefitted area of $25 , 000 . 00. The
method of financing of said cost shall be by assessments in the year of construction
levied upon and collected from the several lots and parcels of land deemed benefitted

from said improvement and located in said Town of Ithaca Water System Benefitted
Area - 1997 - Buttermilk Falls Area , so much upon and from each as shall be in just
proportion to the amount of the benefit which the improvement shall confer upon the
same .
Section 3. It is hereby determined that the estimated expense of the aforesaid
improvement does not exceed 1 / 10th of 1 % of the full valuation of the taxable real
property in the area of said Town outside of Villages and , therefore , in accordance with
the provisions of subdivision 13 of Section 209-q of the Town Law, the permission of
the State Comptroller is not required for such improvement.
Section 4. Pursuant to subdivision 6( d) of Section 209-q of the Town Law, the Town
Clerk is hereby directed and ordered to cause a certified copy of this resolution to be
duly recorded within 10 days of the date of adoption in the Office of the Clerk of the
County of Tompkins , which when so recorded , shall be presumptive evidence of the
regularity of the proceedings and action taken by the Town Board in relation to the
aforesaid improvement.
Section 5 . It is hereby further determined that all of the cost of the aforesaid
improvement shall be borne wholly by property within the Town of Ithaca Water System
Benefitted Area - 1997 - Buttermilk Falls Area , being the entire area of the Town
outside of the Village of Cayuga Heights .
Section 6 . This order is adopted subject to permissive referendum .
The question of adoption of the foregoing resolution was , upon motion made by
Councilperson Conley , and seconded by Councilperson Klein , duly put to a vote on a roll call ,
which resulted as follows:

WHEREAS: The Town Board has authorized the establishment of the proposed
construction of a WATER IMPROVEMENT AREA TO BE KNOWN AS
THE TOWN OF ITHACA WATER SYSTEM BENEFITTED AREA -
1997 - BUTTERMILK FALLS AREA IN THE TOWN OF ITHACA,
TOMPKINS COUNTY, NEW YORK PURSUANT TO ARTICLE 12-C

WHEREAS , the Town Supervisor upon authority of the governing Town Board
entered into an agreement with the Community Dispute Resolution Center, Inc. ,
(CDRC) on March 14, 1997 , for the CDRC to perform the services of External
Ombudsperson to the Town ; and
WHEREAS , the Town Supervisor has recommended that the CDRC extend some of
the services provided under the agreement during the year 1997 ; and
WHEREAS , the compensation amount in the said agreement may not be sufficient
to cover the additional services performed by the CDRC ; and

Hiring Additional Highway Employees

WHEREAS, the need has been identified for additional personnel in the
Highway Department to keep abreast of maintenance efforts, and
WHEREAS, the Highway Superintendent has determined adding two
additional laborer positions would help with the continuing maintenance needs of
the Highway Department, and

WHEREAS , the Town of Ithaca has been authorized to be the Contracting Municipality
for Construction of Transmission Main repairs near Slaterville Road by the S .C . L.I .W .C . ;
and
WHEREAS , funding for the repair will be provided for by the S .C . L . I .W .C . as a repair of
Commission facilities ; and
WHEREAS , the Town as agent for S .C . L. I .W .C . , the Town of Ithaca has solicited for and
received bids for the Slaterville Road repairs on May 23 , 1997 ; and
WHEREAS , the Town and S .C . L . I .W .C . have reviewed all bids and qualifications of the
bidders and recommends that the low bid of $36 , 000 for the total project made by
Rasmussen Gravel Products of Eadville , N .Y . is a qualified contractor; and
WHEREAS , the S .C . L . I .W .C . has approved the expenditure of an amount not to exceed
$40 .000 from the S .C . L . I .W .C . budget account SW8340 .221 , Maintenance B . P .
Systems , to be paid to the Town of Ithaca for contract costs incurred for the repair of the
Transmission Main at Slaterville Road ; and
WHEREAS , the Town of Ithaca `1Vater Fund" accounting and budget records need to
properly reflect the following 1997 budget amendment.

WHEREAS , Fleet Morse, President of the Lakeview Cemetery Co. , Inc. , has
requested a review of water and sewer benefit charges for the Lakeview
Cemetery to reduce benefit units assessed because of limited development
potential and therefore limited benefit from the availability of water and sewer,
and;
WHEREAS , the Special Benefit Assessment Committee and the Town Engineer
have reviewed the request for a reduction of water and sewer benefit units and
have determined that the correct number of units for the parcel is 1 unit for water
and 1 unit for sewer, and that the assessment for 1997 was for 7 .22 units for
water and 7.22 units for sewer and has recommended that a refund is due for
6.22 water units in the amount of $497. 60, and that a refund is due for 6.22
sewer benefit units in the amount of $510 . 04, and
WHEREAS, taxes have been paid in full for the affected tax parcel ,
now therefore be it
RESOLVED, the Town Board hereby authorizes refunds of $497, 60 for water
to be paid from Account F1032 and $510. 04 for sewer to be paid from Account

EASTWOOD COMMONS SUNNYHILL HOMEOWNERS ASSOCIATION

WHEREAS , the Eastwood Commons Sunnyhill Homeowners Association has requested
the Town of Ithaca approve certain amendments to the restrictive covenants governing the
residential units in said development located off of Honness Lane , in the Town of Ithaca ,
Tompkins County, New York; and
WHEREAS , copies of the proposed amendments have been provided to the Town Board
and the Town Board has reviewed the requested amendments ; and
WHEREAS , the Town Board is of the opinion that the proposed amendments are justified
and consistent with the needs of the Homeowners Association and the Town of Ithaca ;
NOW, THEREFORE, be it
RESOLVED , that
1 . The Town Board hereby approves the amendments to the Declaration of Restrictive
Covenants governing the Eastwood Commons Sunnyhill Homeowners Association , submitted
to the Town Board for consideration at this meeting , which requested revisions , among other
matters, alter the Declaration provisions relating to insurance and the circumstances under
which future amendments to the Declaration will need approval of the Town Board of the
Town of Ithaca; and

AMENDMENT OF DECLARATION
OF COVENANTS AND RESTRICTIONS
RELATING TO EASTWOOD COMMONS PHASE III SUNNYHILL SUBDIVISION
TOWN OF ITHACA , TOMPKINS COUNTY , NEW YORK
The undersigned hereby certify that they are , collectively ,
the owners of not less than 900 of the lots contained in the
Eastwood Commons Phase III Sunnyhill Subdivision described in a
Declaration of Covenants and Restrictions dated October 6 , 1988 ,
and recorded October 21 , 1988 in the Tompkins County Clerk ' s Office
in Liber 32 of Miscellaneous Records at page 1099 .
Therefore , in accordance with Article X . Section 3 of the
aforesaid Declaration , the undersigned hereby amend the Declaration
as follows .
1 . Article II is amended to add Section 6 as follows :
" Section 6 . Rental of Residential Units . No person or
entity owning more than one residential unit may rent out
more than one residential unit and garage ( if any ) at a
time . This Amendment shall not apply to multiple
residential units acquired by owners prior to June 1 ,
1997 . "
2 . Article IV , Sect _ on 14 is amended to read as follows :
" Section 14 . Insurance Coverage and Insurance
Assessments . The Board of Directors , or its duly
authorized agent , shall have the authority to and shall
obtain a blanket policy of insurance for all the
buildings including all single family residential units
and garages , and for all common area improvements
including without limitation the mailbox gazebo ,
landscaping and driveway . The cost of such insurance
shall be treated as an expense of the Association and
included as part o = the annual maintenance assessment .
The blanket policy will provide all risk insurance in the
broadest coverage available on all the buildings and
structures within. the Properties , excluding the contents
thereof , insuring against loss or damage by fire or
other hazards in the amount sufficient to cover the full
replacement cost of any repair or reconstruction work in
the event of damage or destruction from any hazard .
At some time in the future , the Board of Directors
of the Association may decide , in its sole discretion , by
a vote of seventy- five ( 75 ) percent of the Board of
Directors to require the individual owners to provide
homeowner ' s policies on their own lot and improvements
thereon ( in place of the blanket policy coverage
described above for single family residential units and
garages ) at their own expense , with the coverage and
details of the policy being to the complete satisfaction
of the Board of Di rectors insuri n-�. against loss or damage
by fire or other azards in t e amount sufficient to
cover the full reclacement cost of any repair or

reconstruction work in the event of damage or destruction
from any hazard ; if the Board of Directors ' so requires
the individual owner to provide his or her own
homeowners ' s policy and if the individual owner does not
provide such policy then the Board of Directors , or its
duly authorized agent , shall have the authority to and
shall obtain insurance on such owner ' s lot and
improvements thereon .
Whether blanket or individual policies , such
policies shall specifically cover each unit owner ' s
garage . Such policies shall provide that insurance
proceeds paid on account of loss of , or damage to , the
real property shall be adjusted with the carrier ( s ) by
the Association and shall be payable solely to the home
owner ' s mortgagee , if any , and the Eastwood Commons
Sunnyhill Homeowners Association , Inc . , as Insurance
Trustee for the homeowner ( s ) . Such insurance proceeds
shall be applied to repair or restoration of the property
as hereinafter provided . All such insurance policies
shall provide that coverage may not be cancelled by the
carrier without first giving the Association and unit
mortgagee , if any , ten ( 10 ) days written notice of
cancellation . All such policies shall contain , if
obtainable , a waiver of the right of subrogation against
any unit owner , members of the unit owners family , the
Eastwood Commons Sunnyhill Association , Inc . its
directors , officers , agents , and employees , as well as
waiver of the " pro - rata " clause .
The Association shall also obtain a broad form
public liability policy covering all common areas and all
damage or injury caused by negligence of the Association
or any of its agents , directors , officers , or employees
in the amount of not less than one million dollars for
each occurrence and such policies shall contain a waiver
of the right of subrogation against members of the
Eastwood Commons Sunnyhill Homeowners Association , Inc . ,
its directors , officers and employees .
Premiums for insurance obtained by the Board of
Directors on any individual residence and garage ( other
than in the above blanket policy ) shall not be part of
the common expense or, annual maintenance assessment , but
shall be an expense of the owner ( s ) of the specific
residence or residences so covered and a debt owed by
such owners and shall be paid within twenty ( 20 ) days
after notice of such debt and shall be collectible by any
procedure permitted by the laws of the State of New York .
In addition , if such debt is not paid within twenty ( 20 )
days after notice of such debt , such amount shall
automatically become a lien upon such owner ' s residence
and shall continue to be - , such lien until fully paid .
This lien shall be subordinate to the lien of any first
mortgage and shall be enforceable in the same manner as
any lien created by failure to pay the maintenance
assessments .

Any owner may , if he or she wishes , at his or her
own expense , carry any and all other insurance he or she
deems advisable beyond that included in policies acquired
or required by the Association .
i In the event of damage or destruction by fire or
other casualty to any property covered by insurance
payable to the Association as trustees for the homeowner
or under the blanket policy , the Board of Directors
shall , with the concurrence of mortgagees , if any , upon
receipt of insurance proceeds , contract to rebuild or
repair such damaged or destroyed portions of the property
to as good condition as formerly . All such insurance
proceeds shall be deposited in a bank or other financial
institution , the accounts of which bank or institution
are insured by a Federal governmental agency , with the
provision agreed to by said bank or institution that such
funds may be withdrawn only by signature of a least one -
third ( 1 / 3 ) of the members of the Board of Directors , or
by an agent duly authorized by the Board of Directors of
the Association . The Board of Directors shall obtain
bids from at least two reputable contractors , and then
may negotiate with any such con �� ractors who may be
required to provide a full performance and payment bond
for the repair or reconstruction_ or rebuilding of such
building or buildincs . With res , ect to any deductible
owing or in the event that =_ surance proceeds are
insufficient to pay all costs of repairing and / or
rebuilding to as good condition_ as fm
orerly , the Board of
Directors shall ! .= vv a special assessment , as provided in
Article IV , Section 1 , against all owners of the damaged
residences ( including garages ) in such proportions as the
Board of Directors deem fair and equitable in the light
of the damage sustained by suc:: residences to pay the
deductible or to make up any deficiency . To pay any
deductible or to make up anv deficiency for repair or
rebuilding of any improvements i the common area , the
special assessment shall be levied against all owners ,
in equal proportions or in proportion to the rate of
payment of annual maintenance and special assessments
whichever method of payment is de = ermined to be fairer
under the circumstances by the Board of Directors of the
Association . In the event such insurance proceeds exceed
the cost of repair and reconstruc _ _ on , such excess shall
be paid over to the respective mortgagees and owners in
such proportions as the Board of Directors deem fair and
equitable in light of the damage sustained by such
residences . Such payments shall be made to all such
owners and their mortgagees as their interests may
appear .
Notwithstanding the foregoing provisions of this
Section 14 , it is = urther provided that the requirement
for the maintenance of insurance cn_ a residence shall not

3 , Article X , Section 3 is amended to read as follows :
" Section 3 . Amendment . The covenants and restrictions
of this Declaration shall run with and bind the land , for
a term of twenty ( 20 ) years from the original recording
date of this Declaration , after which time they shall be
automatically extended for successive periods of ten ( 10 )
years . This Declaration may be amended during the first
twenty ( 20 ) year period by an instrument signed by the
owners of not less than ninety percent ( 90 % ) of the Lots ,
and thereinafter by instrument signed by the owners of
not less than seventy- five percent ( 75 % ) of the Lots .
Any amendment must be recorded . Any amendment to this
Declaration at a time when thirty percent ( 30 % ) or more
of the Lots are owned by the same owner , and any
amendment at any time to Article X . Section 3 , shall be
approved by the Town Board of the Town of Ithaca before
becoming effective and before being recorded . "

WHEREAS , the New York State Department of State Division of Coastal Resources and
Waterfront Revitalization has approved a grant in the amount of $50, 000 to Tompkins County
and the participating Cayuga Lake waterfront communities , including the Town of Ithaca , to
prepare a joint Local Waterfront Revitalization Program ( LWRP ) , and
WHEREAS , preparation of an LWRP will enable the participating communities to coordinate
their planning for revitalization of the waterfront, protection of the scenic, recreational , and
natural resources of Cayuga Lake and its waterfront, and the economic vitality of the area ;
and
WHEREAS , each participating community is responsible for contributing its local share toward
the preparation of the LWRP , and the Town of Ithaca has agreed in concept to fund up to
$ 10 , 000 as its local cash match ; and
WHEREAS , a local cash contribution is necessary to hire a consultant to assist with the
preparation of an LWRP ; and
WHEREAS , Account # B8020 . 406 ( Planning Study) in the 1997 Town of Ithaca Budget
includes sufficient funds for this purpose;
NOW, THEREFORE , BE IT RESOLVED , that the Town Board of the Town of Ithaca does
hereby approve an amount not to exceed $ 10 , 000 . 00 from Account # B8020 . 406 to be used
for the preparation of a Local Waterfront Revitalization Program .

WHEREAS , New York State has approved a grant to Tompkins County and the
participating Cayuga Lake waterfront communities, including the Town of Ithaca , to prepare a
joint Local Waterfront Revitalization Program ( LWRP ) ; and
WHEREAS , in order to oversee the work on the LWRP , Tompkins County has proposed
the establishment of a Local Waterfront Revitalization Program Oversight Committee (or
LWRP Oversight Committee) ; and
WHEREAS , the LWRP Oversight Committee is proposed to consist of ( 1 ) a Steering
Subcommittee , which would be responsible for executive level decisions , and members of
which would be responsible for keeping their respective boards informed of the LWRP
process , and (2 ) a Planning Subcommittee, which would be responsible for working with
program staff and a consultant to address technical-level issues ; and
WHEREAS , each participating municipality is being asked to identify two persons to serve
on the LWRP Oversight Committee ; and
WHEREAS , Tompkins County has requested that the Town Board of the Town of Ithaca
appoint two representatives from the Town of Ithaca to serve on the LWRP Oversight
Committee , one of which should be a member of the Town Board to be appointed to the
Steering Subcommittee , and one of which should be a staff person or member of the Town
Planning Board to be appointed to the Planning Subcommittee ;
NOW, THEREFORE , be it
RESOLVED , that the Town Board of the Town of Ithaca hereby appoints Carolyn Grigorov
to serve on the Steering Subcommittee of the Local Waterfront Revitalization Program
Oversight Committee ; and be it further

County Trust Company to discuss and review this imaging format and the monthly check list
that the Town of Ithaca would receive if the election to use such report for monthly
reconciliation purposes was made ; and

work, reconciliation functions , as well as minimizing file and document storage; and

Town Engineer ' s Retort for 619197
Town Board Meeting
DEVELOPMENT REVIEW
Sanctuary Drive
The developer has corrected surface drainage and has installed subsurface drains along back lot lines to
facilitate foundation drainage . Constriction activity has caused some filling of road ditches and the
Town Engineer will work with Highway Superintendent to ensure that the developer cleans the ditches
prior to completion of mass site earthwork. Monitoring of drainage and sediment control measures will
continue.
Ithaca College
Reviewed preliminary site plan submission for the proposed Ford Hall additions and final site plan
submittals related J and M parking lot improvements . Drainage plans for the improvements have been
reviewed and have been found adequate for the current projects .
The site plan for the temporary classrooms for the HHSP have been approved and construction has
been started on the foundation and utilities . The temporary buildings will be connected to the public
sewer and will have water service from the Ithaca College water system .
Ithacare
Court Street Companies the, .General Contractor, has started site construction. Phase I erosion and
sediment control improvements have been installed and mass earth work has been started . Relocation
of the sewer main is scheduled to start mid June and the water will be installed after the sewer. The
Contractor has been very cooperative and appears to be well qualified for the project.
EARTH FILL PERMITS
Five Mile Drive, Immaculate Conception
Filling at the site has been primarily stockpiling of material from road base excavations . The contractor
plans to remove stockpiled material as fill is needed on the project. The contractor is planning to use
the site for dewartering and storage of material removed from the Flood Control Channel as part of the
Corps of Engineer' s emergency rehabilitation project . After dewatering some of the silty sediments
will be transported to the Buttermilk Falls State Park Play fields and the Treman State Park play fields
to be used as a fine grading topsoil . The NYS Parks have submitted a site plan for each field that
includes adequate sediment and erosion control plans for the park sites .
Excess material will be disposed of on the Five Mile drive site . If the proposed fill volumes for the
Five Mile Drive site exceed the original permit limits, the contractor will apply for a permit
modification. The Town Engineer has been reviewing sediment and erosion control plans with the
contractor as the work has progressed . Final grading and site restoration is expected to occur in the fall
of 1997 . Sediment control fencing is being maintained around the fill area and The contractor has been
keeping the road way clean.

Ithaca Vol . Vets, Elmira Road
The Association received site plan approval from the planning board on October 29, 1996 for an
enlarged parking area on the property with additional fill to be placed . The Town Engineer is
monitoring the project. The bulk of fill is in place with more select fill to be placed for final top and
grading.
Williams Glen Road
A fill permit for approximately 200 cubic yards of fill has been issued for regrading a residential lot
with imported material . Final grading and seeding of the site will be completed when weather permits.
WATER PROJECTS
The Town Engineering staff is continuing to work with the Bolton Point staff to implement the master
metering program for connections to the water transmission main . Work has been substantially
completed, with remaining work itemized on a punch list, including site restoration work being the
major element to complete .
The Town Engineer is continuing to work with the City Engineer and SCLIWC member municipal
engineers on the engineering evaluation to include the entire water infrastructure for the area. Bench
marking of the system models has been completed by the consultant and is being reviewed by the
Town Engineering staff. The combined model is being used to develop an analysis of the system to
evaluate various alternatives for more efficient operations .
The Town Engineering Staff has prepared the plans for a replacement of the aging and inadequate
water main that serves Buttermilk Falls State Park. , which includes a short extension from Rte. 13 to
the Park along Buttermilk Falls Road. The replacement line will connect to the new watermain at the
intersection of Buttermilk Falls Road and Rte. 13 and will run to the City line near Spencer Street,
replacing a 6 " watermain that is over 70 years old .
The Bids for replacement of 300 feet of the Transmission main near Slaterville road have been received
and were opened May 23 . The low bid was $36,000, which is consistent with the Engineers estimate
and a recommendation of award is before this Board for approval at the June 9 Town Board meeting.
This is a S . C .L . I . W. C . project with the Town acting as the contracting agency for the Commission.

SEWER
Replacement of the controls for Forest Home pump stations number 1 & 2 was started on May 21 after
the delivery of the new control panels . Town staff is installing this equipment with the assistance of a
City maintenance technician and a local electrical contractor. Start up of the stations on the new
controls is scheduled for June 5 , and the staff is looking forward to a significant amount of reduced
maintenance time with the new controls .
Installation of the monitoring station on Hanshaw Road has been completed including final site
restoration and landscaping . Installation of this monitoring station is part of the North East Sewer
rehabilitation plan which has been requested by the Village of Cayuga l-leights . The "Town Engineering
staff has installed 3 portable flow monitors in mardioles on the Village line . Data collection has begun
and flows will be monitored over an extended period of time to develop a database to identify
infiltration problems in the Town system .
The Town Engineering staff has completed plans for a short extension of sewer on Buttermilk Falls
Road to serve the Buttermilk Falls State Park. This project has been requested by the Park as they plan
to replace a septic tank system that serves the Bath House and Park Office . The current leach field is
located adjacent to Buttermilk Creek.
STORMWATER
Development of the Town wide watershed evaluation is continuing . Base maps are being developed
utilizing the digital planimetric map, , and field survey work started on May 7 and two field crews made
up of the Assistant Town Engineer and five student interns started intensive work on May 23 . The
survey crews will be working along the roadways and drainage courses in the Northeast area
throughout the summer.
BENEFIT ASSESSMENT
The Benefit Assessment committee is evaluating the impact of the current benefit assessment on large
parcels and is considering options to modify the assessment formula bases on current development
potential .
The county digital tax parcel maps have been provided to the Town by the county assessment office,
and development of a database utilizing the GIS is proceeding .

CAYUGA INLET RLAHABILI " 'ATION PROJI-XT I3Y US ARMY CORPS OF ENGINEERS
The Corps of Engineers is planning to repair Cayuga Inlet Flood Control Channel from the State Street
Bridge up to the drop structure and fish ladder. Work is proposed to include removal of approximately
100,000 CY of sediment, placement of rock rip rap bank protection and removal of gravel from the
Coy Glen grade stabilization structures . A contractor has apparently been selected for the first phase of
channel stabilization and the project was scheduled to begin in March. No work has been started to
date.

Highway Department' s Monthly Board Report, May 1997

Highwa y Sp Superintendent
Fred Noteboom, Gail Kroll, and Rich Schoch attended all the computer traimig classes
offered on Windows and Microsoft Office Suite for a total of 18 hours of class time for
each.
The Highway Department worked for months putting underground . drainage on
Brandywine Drive. During May, we finished this project by planting grass seed. Between
Highway and Parks crews, we spent 128 hours of time and used 60 pounds of grass seed.
Along with this lawn restoration, we worked on lawn repairs at Chase Lane and Eastern
Heights Drive spending 32 and 18 hours respectively.
The Highway crews continue to prepare Pennsylvania Avenue for paving. During May we
worked 882 hours putting in approximately 220 feet of pipe, ditching, replacing catch
basins, etc. The project is near completion, and we expect to pave both Pennsylvania
Avenue and Kendall Avenue in June.
The Highway crews started drainage improvements and driveway repairs at the Highway
Facility this month This took a total of 80 hours this month. Along with this, we spent
860. 5 hours of time on General Repair work. This included hauling materials, fixing the
swale at Dewitt Pond (so children cannot access the pond in this area), coordinating with
Paul Cowles, Tompkins County Solid Waste, and Les Goehner, Tompkins County
Probation efforts to dispose of garbage on Elm Street, assisting DEC 's Coy Glen Flood
Protection Project by hauling creek gravel from the site, etc.
We continue to utilize two employees to handle vehicle maintenance and repairs. This took
352 hours of time this month.
Highway June Protects
1 . Start rebuilding Burns Way.
2. Pave Kendall Avenue and Pennsylvania Avenue.
3 . Prepare list of areas that need underground drainage.
4. Repave and ditch King Road West.
5 . Continue cleaning ditches.
Lawn restorations and reseedings took 80 hours. These jobs included all water breaks
from last fall and winter, Brandywine Drive drainage project, Chase Lane drainage project,
and several sewer related sites.
Park and trail mowing began in earnest. A total of 126 hours were required in May. Many
Kiwanis baseball teams and youth soccer league teams are continuing to use Coddington
Road play fields, Eastern Heights Park ball field, and Tareyton Park ball field We also
installed new regulation-sized soccer goals and nets at the Tareyton field.
Numerous tree and shrub planting projects were planned and started, requiring 82 hours.
Sites included West Haven Road sewer line, Pine Tree road master meter building, Sandra
Place Walkway, and Mumhaw Road sewer maniteruig station
The exercise track at Dewitt Middle School was repaired with base gravel and the entire
one half mile was resurfaced with fine gravel. This took 39 hours and included some lawn
repair where work on the storm water retention pond fence tore up the lawn and trail edge.
Regular maintenance tasks required 221 hours.
June Parks Projects
1 . Begin roadside and right-of--way mowing program with boom mower (Tim Eighmey
will be operator).
2. Continue regular park and trail mowing.
3. Finish up lawn jobs prior to the typical June 15, 1997, cut-off date for spring
reseeding.
4. Continue tree and shrub plantings for Engineering and Highway projects.
5. Install (4) map and information display stands at the entrances to South Hill Trail.
6. Prepare for summer youth workers under (3) programs: Job Training Partnership Act
(JTPA), Youth Employment Service (YES), and Youth Conservation Corps. (YCC).

DEVELOPMENT REVIEW
The following are actions that were considered by the Planning Board .
Ford Hall Addition and Expansion of J and M Parking Lots, Ithaca College
The Planning Board granted Preliminary Site Plan Approval and approved a
recommendation regarding Special Approval to the Zoning Board of Appeals
at the May 6th, 1997 meeting for 1 ) a proposed 55,000 + / - square foot addition
to Ford Hall to house additional classrooms, practice studios, rehearsal rooms,
a 250 + / - seat recital hall, and other facilities for the Ithaca College School of
Music; 2) a proposed expansion of the existing j Lot" parking lot from 160
spaces to 354 spaces; and 3) a proposed expansion of the existing "M Lot"
parking lot from 198 spaces to 230 spaces, located on the Ithaca College
campus, Residence District R-15 .
Montessori School Addition, 120 East King Road
The Planning Board granted Preliminary Site Plan Approval and approved a
recommendation regarding Special Approval to the Zoning Board of Appeals
at the May 6th, 1997 meeting for the proposed construction of a 1 , 180 + / -
square foot classroom addition to the Montessori School, located at 120 East
King Road, Residence District R-30.
Russo Garden Center, 1059 Danby Road
The Planning Board considered a Sketch Plan at the May 6th, 1997 meeting for
the proposed construction of a retail garden center, to consist of a 4,320 + / -
square foot store, 4,550 + / - square feet of greenhouses, outside nursery storage
and display areas, parking and other appurtenances, to be located at 1059
Danby Road, Business District "C ".
Suwinski /Nazer Subdivision, 1380 Mecklenburg Road
The Planning Board granted Preliminary and Final Subdivision Approval at
the May 20, 1997 meeting for the proposed subdivision of 0. 14 + / - acres from
Tax Parcel No . 27- 1 46. 2 for sale to the owners of and consolidation with Tax
Parcel No . 27446 . 1 , located at 1380 Mecklenburg Road, AG Agricultural
District.
Grigorov Subdivision, Coddington Road
The Planning Board granted Preliminary and Final Subdivision Approval at
the May 20, 1997 meeting for the proposed subdivision of 35 . 65 + / - acres from
Tax Parcel No . 51 -1 -3 . 2, 72 . 1 + / - acres total, located on the northeast side of
Coddington Road, for conveyance to the City of Ithaca for use as public park
land, Residence District R-30 and CD Conservation District. This is part of the
City' s Inlet Island Park substitution program, which has been approved by the
State Legislature .
Recommendation on Sign Variance, Evergreen Nursery School, 105 Dubois Road
The Planning Board approved a recommendation at the May 20, 1997 meeting
regarding a requested sign variance to permit an off-premises sign to advertise
the Evergreen Nursery School, said sign to be located on the private property
of another owner, located at 105 Dubois Road at the corner of NYS Route 96,
Residence District R-30 .
Recommendation to Town Board, South Hill Park Parcels
The Planning Board approved a recommendation at the May 20, 1997 meeting
regarding ( 1 ) the possible release of a parcel that was intended to be dedicated
as a Town park in exchange for another parcel on owner' s land, and (2)
location of a possible community park in the South Hill area . The original
proposed Town park parcel, consisting of 1 .8 + / - acres, is located on East King
Road adjacent to the Montessori School . The owner / agent for all of the
parcels involved, has offered to dedicate 12.5 + / - acres of land, up front, for a
Town-owned community park site. The tentative schedule to advance this
proposal is as follows :
June 17, 1997: Planning Board to consider Preliminary Subdivision
Approval for three 2-lot subdivisions to split off the
proposed park parcels for conveyance to the Town.
July 7, 1997: Town Board to consider acceptance of
location / concept of South Hill Park, and acceptance
of the park parcels subject to contingencies / legal
details, etc.
July 15, 1997: Planning Board to consider Final Subdivision
Approval for the proposed park parcels, subject to
approval of legal and technical details by Town
Attorney, Town Engineer, Town Highway
Superintendent.

CURRENT PLANNING DEPARTMENT PROTECTS
The following are significant accomplishments or issues that have been dealt with
over the past month .
SEOR Reviews for Zoning Board : Four SEQR reviews for the Zoning Board were
completed: (1 ) request for special approval to reconstruct portions of Tower Road on
the Cornell University campus, Residence District R-30 (Cornell University); (2)
request for special approval and variances for exceeding maximum permitted lot
coverage and to allow a 22 foot side yard setback (40 feet required) to enlarge the
existing Montessori School, located at 120 East King Road, Residence District R-30
(Montessori School); (3) request for special approval to construct a 55,000 sq. ft.
addition at Ford Hall (height variance also requested ) and expansion of Parking Lots
"J" and "M", located on the Ithaca College campus, Danby Road, Residence District R-
15 (Ithaca College); and (4) request for special approval for placement of a 10,000 + / -
sq. ft. temporary structure to be used for classrooms, located on the Ithaca College
campus, Danby Road, Residence District R- 15 (Ithaca College) .
Codes and Ordinances Committee : The Committee completed review of the draft of
the revised zoning districts at their May 7, 1997 meeting. The draft is in the process
of being distributed to other boards and committees for review and comment. An
Executive Summary of the recommended zoning changes is also being revised to be
sent with the draft. The Committee is moving ahead with reviewing remaining
sections of the Zoning Ordinance . Sections on 'Procedures for Creation of New
Zones" and "Site Plan Review and Approval Procedures " have undergone initial
review. Sections on Special Approvals and Non-conforming Uses are tentatively
scheduled for review at the June 18th meeting. COC meetings for the remainder of
the year have been rescheduled from the 1st Wednesday of each month to the 3rd
Wednesday of each month.
Planning Committee: The Planning Committee is tentatively scheduled to meet on
Monday, June 16, 1997. Several experts in the local agricultural sector are being
invited to that meeting for a strategy session to discuss agricultural and farmland
protection issues. The Committee is considering inviting farmers and agricultural
interest groups to a public meeting to obtain input on possible measures to preserve
important farmland and encourage farming within the Town. A date has not been
determined .
Park, Recreation and Open Space Plan Update : Three public information meetings
have been tentatively scheduled for the following dates and locations.
Tues ., June 10th, 7: 00 p. m. . South Hill Elementary School
Weds ., June 18th, 7:00 p .m. : Northeast Elementary School
Thurs ., June 26th, 7: 00 p . m. : Alternative Community School
Notifications have been sent to the press, neighborhood associations, and numerous

organizations in an attempt to get good turnouts at these meetings . It is anticipated
that some members of the Town Board, Planning Board and Conservation Board will
attend and participate in each of the three meetings. An Executive Summary of the
draft Plan has been prepared and will be available to those attending the public
information meetings . Large size presentation maps have been prepared to illustrate
elements of the Plan. Numerous slides of parks and open space areas in the town
have been taken, and will be assembled in a short slide presentation for the public
meetings .
Town of Ithaca - Cornell Universi Transportation Committee : The Committee met
on May 5th, 1997 to discuss the draft City of Ithaca Bicycle Plan, coordination of
bicycle planning with Cayuga Heights, and follow-up discussions on possible East
Ithaca Recreationway connections (including the possibility of a pedestrian / bicycle
bridge over Cascadilla Creek) . A significant item of discussion was the Village of
Cayuga Heights' proposed Triphammer Road improvement project. Brent Cross,
Village Engineer indicated that the Village is in the process of designing a narrower
road with curbing and sidewalk, but no accommodation for bicyclists . Based on Mr.
Cross' s description, the Committee determined that there should be additional
correspondence with Cayuga Heights officials regarding the need for bike lanes or
other bicycle facilities . As a follow-up, the Chair of the Town' s Public Works
Committee, the Director of Engineering, and the Director of Planning attended the
May 19th meeting of the Cayuga Heights Board of Trustees to communicate the
Town' s interest in coordinating bicycle route planning, in particular in relation to the
Village' s planned Triphammer Road project. Several Village residents also spoke at
the meeting and sent in letters in favor of including bike lanes . As a result, it
appears that the Village Board is willing to consider including accommodations for
bicyclists in some form, pending a closer look at the actual road project design. We
hope to hear more from the Village in the near future .
Northeast Subarea Study: The selection committee has narrowed the list of preferred
consultants to a team of two (a public participation module consultant and a
technical module consultant that did not submit their proposals as a team) . MPO
staff has negotiated with those consultants to see whether this "new" team could
revise their proposal scopes to fit within the project budget. MPO staff reported at
the MPO Policy Committee on May , 20, 1997, that negotiations with the consultants
lowered the estimated project cost to just $3,000 in excess of the original project
amount ($100,000) . The MPO Policy Committee agreed that the $3,000 shortfall could
be made up from funds in the MPO' s Budget. MPO staff will prepare a revised
Scope of Services to send to the preferred consultants . It is anticipated that a July
start date for the project is possible, although public forums and traffic counts would
not begin until schools are back in session in September.
Black Diamond Trail : Planning staff accompanied State Parks staff on a field trip on
May 27, 1997 to look at possible trail alignments in the Inlet Valley area .
Personnel: Karen McGuire has been hired as the new Senior Typist for Planning and

Engineering. Two Planning Interns have been hired for the summer - Ben Helber as
a full- time intern, and Taber Sweet as a federal work study intern .
Historic Preservation Conference , Albany, NY : The Director of Planning attended a
conference in Albany, N .Y . on May 13, 1997, entitled "Government as Champion of
Historic Preservation. " The conference was sponsored by the Preservation League of
New York State. Speakers covered a range of subjects, including federal legislative
priorities (ISTEA reauthorization and the Historic Homeownership Assistance Act),
examples of local preservation efforts in Massachusetts, and examples of public-
private preservation partnerships in New York State . Commissioner Bernadette
Castro, NYS Office of Parks, Recreation and Historic Preservation, and Commissioner
Alexander Treadwell, NYS Department of State, attended the conference, and
participated in awards presentations and the panel on public-private partnerships . It
was a very well attended and worthwhile conference . Conference materials are
available in the Planning Department for anyone interested.
South Hill Swamp Plant Study Follow-up : As a result of the Town Board' s approval
at the May 12th meeting, the contract for the plant study follow-up has been signed,
and Wesley and Ostman have completed the May site visits . Additional visits will be
completed in June / July and August / September, and the final report will be
presented later in September 1997.
Inlet Valley Park Parcels : The County Board of Representatives has agreed to sell the
two parcels in Inlet Valley off of Five Mile Drive to the Town (that were offered at
auction several years ago ) at the originally agreed upon cost. Closing date and
details remain to be worked out. The City has been informed of this, and has been
asked to review the draft Agreement between the Town and City regarding the
possibility of a future transfer of those parcels to the City.
Ithacare - Trails : Planning staff accompanied Ithacare representatives on a walk of the
site on May 30, 1997, to determine specific locations of public trails that were
included in the approved site plan for the Ithacare project on Danby Road.

Human Resources Monthly Report for May 1997
Personnel :
Jonathan Kanter, Mary Bryant, Daniel Walker and I interviewed 5
candidates from the Senior Typist eligible list acquired from the County Civil
Service . As a selection committee we chose Karen McGuire as our first choice .
Ms . McGuire started as of May 19 , 1997 , as the Senior Typist for Planning and
Engineering .
May 23 , 1997 , was Brian Cutler's last day as the Assistant Zoning Officer
and Building Inspector. I received from the County the listing of applicants that
had signed up to take the Assistant Zoning Officer and Building Inspector exam
being offered in June . From the three applicants , Andy Frost interviewed Keith
Christoffersen , and offered him the provisional appointment. Mr. Christoffersen
will be starting as of June 2 , 19970
Supervisor Valentino , Alfred Carvill and I have been working together to
create. a job title and job description for Mr. Carvill . The reason for this is because
the title of "Secretary to the Supervisor ' does not fit the description of the job he is
performing . As we are trying to stay in the realms of Civil Service we needed to
establish a more specific job title and description that closely describes what Mr.
Carvill does .
The Engineering and Planning work study students have started their 8- 12
week summer position and workload . The summer Planning Intern , Benjamin
Helber has also started his 12 week internship .
Deferred Compensation :
May 1 , 1997 , Joan Lent Noteboom , Town Clerk, opened the four deferred
compensation proposals we received . I reviewed each proposal and made notes
about the costs to the employees and the security of the investments . I quickly
narrowed down the selection to two proposals ; The Copeland Company (state
plan) and PEBSCO . We currently have the Copeland Plan . I set up an
appointment for May 16 , 1997 , for the PEBSCO representative Suzanne
Slimbaugh to come and do a presentation on PEBSCO . I invited all the
employees who presently participate with Copeland to come to the presentation . I
received a positive response from those present about Ms . Slimbaugh 's
presentation . Mr. Carvill and I are doing a comparison sheet on Copeland versus
PEBSCO , to outline their differences . 1 have also sent out a questionnaire to
those present at the presentation for feedback on their feelings of one company
versus the other if they got to choose which company to have .
Personnel Committee Meeting May 20 , 1997 :
The committee approved the April 15 , 1997 , minutes (see attached copy
of minutes) . At the May meeting the committee considered the edited drafts of the
"Appearance Policy" , "Employee Assistance and Ombuds Service Policy" ,
"Grievance Procedure" , and "Attendance at Town Sponsored Functions Policy" .
All the above mentioned policies and procedures , except the Grievance
Procedure , were approved by the committee . After a long detailed discussion the
committee suggested some additional changes to the Grievance Procedure . This
procedure will be edited and reviewed at the June Meeting .
The committee also discussed the procedure of approving the Manual after
they have reviewed all the sections . I gave a copy of the drafted working copy of
the manual to the Department Head 's , Mr . Carvill and Kevin Kauffman , Executive
Director of S .C . L . I .W .C . for their review. After the committee has a working copy
they approve of they will send it on to the Town Board for comments and editing .
At that point the working copy manual will be given to all the employees for review.
Supervisor Valentino and the committee will host at least 2 open sessions for
employees to comment on the manual . After the open sessions the committee will
make their final changes and send the final draft of the Personnel Manual to the
Town Board for final approval and an implementation date .
Payroll :
Supervisor Valentino notified DataRite Payroll Service of Central New York
that their service would no longer be needed after May 30 . 1997 . Our first payroll
with the in-house Williamson Law Book Company will be pay period 12 , pay date
June 13 , 1997 . At the present time I have manually inputted payrolls' 1 - 11 into
the in - house system . As I have been comparing reports from the two companies I
have found more mistakes by DataRite than originally thought. I will be happy
when we get the new system running and have accurate quarterly reports .
Workers ' Compensation Premium :
We have received our premium notice from the State Insurance Fund for
the period of July 1 , 1997 through June 30 , 1998 . Our experience modification
level has increased 27 points , however , we have received a discount on the
Manual Rate , which equals an increase in the estimated annual State Insurance
Fund Premium amounting to about $2370 .
1 have requested a quote from the Comp Alliance Group . The quote came
in at $ 44 ,000. Even though this amount is less than the State Insurance Fund we
will not receive a dividend from this company . In addition Comp Alliance quoted
us based on a 2 % experience modification level that is 27 points less than our
actual with the State Insurance Fund . At this point we have elected to reserve the
right to terminate our coverage with the State Insurance Fund , but have not
chosen to do so as of yet. The decision will be determined by Supervisor
Valentino and I after reviewing both companies more thoroughly .
Training/Seminars :
I attended a luncheon put on by PrePaid Health Plan on their plans for the
rest of 1997 and the beginning of 1998 . 1 also attended the Human Resource
Association of Tompkins County's May luncheon on Workers' Compensation . NY
State and Local Retirement System had a free short seminar on reporting that I
also attended . Joy and I along with other employees of the Town started our
computer training seminars at the TC3 extension center . These classes have
been informative and greatly appreciated as we now have Microsoft Office
installed on our computers and know how to us it.
Human Resources Office :
May sixth and seventh the Town sponsored a free blood pressure
screening for any employee who wished to participate . We had a great turn out
for this .
Completed daily functions of the office including ; administering payroll ,
managing Insurance needs , working with Workers ' Compensation and meeting all
requirements of Civil Service . Also performed requests of the staff and
Department Heads .

At a regular meeting of the Personnel Committee for the Town of
Ithaca , Tompkins County , New York held at the Town Hall Board
Room there were present :
Members Present : Supervisor Valentino ; Donald Tenkate , Working
Supervisor and Betty Poole , Deputy Town Clerk ,
Members Excused : Councilman Conley and Councilman Wolff .
Support Staff Present : Judith Drake , Human Resources Manager .

Called to order : 8 : 25 a . m .
Agenda Item # 2 : Approval of March 18 , 1997 Minutes :
Minutes were approved with no corrections or additions .
Agenda Item # 3 : Staff to be heard . None
. Agenda Item # 4 : Finish discussion of Dress Code Policy .
Mrs . Drake read the appearance policy from the Personnel
Manual of Rockingham County , Virginia . She questioned changing
the title from Dress Code Policy to Appearance Policy since it
was a softer title . Supervisor Valentino summarized that she is
not looking for a rigid dress code for the Town . The only reason
this policy was brought up , is because of Civil Service
compliance . If the need came up to speak to an employee or
discipline them for an on going appearance problem , the Town
needs a policy in the manual that could be referred to as a basis
for the discipline . Supervisor Valentino felt that the biggest
issues brought up at the March meeting was :
1 ) who makes the decision of what is proper attire and
2 ) who enforces a dress code .
A Dress Code , unfortunately , is subject to one persons perception
of what it should be . Supervisor Valentino suggested she do a
memo describing what her general feeling are , so that people will
know what she expects as Supervisor . This memo would not be
subject to any discipline , but used by employees as a basic
guideline . However , if the Town is going to have a dress code ,
then the Personnel Manual should state how to address it . The
manual should state the discipline that will apply . Supervisor
Valentino , in regards to , one person ' s opinion versus another ' s ,
suggested having 2 to 3 Department Heads agree whether a clothing
item is appropriate or not before anything is said to an
employee . Mrs . Poole suggested having a dress down day . She also
stated that jeans are not as offensive as some other clothing
items . Mrs . Poole also questioned having the Department Heads
confer with an employee about another employee ' s dress .
Supervisor Valentino was not in favor of this . She thought it
might cause ill will between employees . Supervisor Valentino
asked Mr . Kauffman how a dress code is applied at S . C . L . I . W . C . He
stated that they have no policy , however , the subject is on the
performance evaluation form . Mrs . Drake stated she was looking to
have the policy be more of a guidance of what will happen if an
employee is told they have inappropriately dressed . Supervisor
Valentino suggested the following process : 2 - 3 Department Heads
meet and agree that an employee is inappropriately dressed .
First offense : An oral warning is given with a warning
notification form filled out as a record of occurrence .
Employee is sent home to change without loss of pay .
Second offense : The employee is sent home to change with
loss of pay and an official written disciplinary warning
signed by the employee and Department Head is filed in the
employee ' s personnel file .
Third offense : Employee is subject to the discipline and
discharge policy .
Mrs . Poole liked the wording of the Rockingham County , Virginia ' s
appearance policy . The Committee decided to change title from
" Dress Code Policy " to " Appearance Policy " . Supervisor Valentino
and Mrs . Drake will draft an Appearance Policy for the next
meeting .
Agenda Item # 5 • Review of Working Copy of Personnel Manuale.
Ombuds Service Section : Supervisor Valentino suggested putting
the telephone number and address for the Service in a larger font
and bold . Mr . Tenkate asked if Ms . Tischler will be coming out to
meet with employees . Supervisor Valentino expressed that Ms .
Tischler will be meeting with the Department Heads first . Mr .
Tenkate suggested putting in the wording that there is no cost
for this service to the employees .
Employee Assistance Program :
Mrs Drake asked whether the wording is correct since the Town
doesn ' t pay for this service . Mr . Tenkate and Mr . Kauffman
suggested combining Ombuds Service with the Employee Assistance
Program as the title of " Employee Assistance and Ombuds Service " .
This newly combined section will be drafted and brought to the
May meeting for approval .
Americans with Disabilities Act : Approved by committee .
Pay Periods : Mr . Tenkate brought up the subject that some of the
employees have requested to be paid every week . Supervisor
Valentino said she doesn ' t want to sign pay checks every week .
Supervisor Valentino likes to review pay checks and invoices so
she has the knowledge of what is going on . She feels right now
the Town is too small . Supervisor Valentino stated that this is
not something the Town is looking at presently .
Mrs . Poole stated the problems that have been occurring with
payroll . There was some discussion of DataRite versus the
Williamson Law Book Company ' s in house program . Mrs . Drake stated
that this new program will allow reports to be printed before
paychecks .
Mrs . Poole asked to have the employee warned about changes in a
pay check before pay date , if applicable , as a courtesy . Mrs .
Drake stated that we are attempting to switch to an in house
payroll by the end of May or the first pay period of June .
Disciplinary Policy :
Mrs . Drake is developing a discipline warning form to be used by
Department Heads , Supervisor Valentino stressed that any
disciplinary action is subject to the Grievance Procedure .
Committee approved policy as written .
Grievance Procedure :
Changed wording in Exception paragraph .
The wording of Step 2 was questioned . An employee can have the
Ombudsperson or the Human Resources Specialist assist in writing
the complaint .
Supervisor Valentino stressed that she wanted the Personnel
Committee taken out of Grievance Procedure . Supervisor Valentino
did a scenario to figure out the best steps to follow . Wording
for Step 2 and Step 3 edited . Mrs . Drake will draft procedure for
reviewal at next meeting . Add a Grievance Form to exhibits .
Termination of Employment : Committee approved .
Time Cards : Mrs . Drake stated this is an added topic to the
Personnel Manual . Committee approved the policy .
Meal Period :
Mrs . Drake stated this is an added policy to the Personnel
Manual . Mrs . Drake stated by law a minimum of thirty minute lunch
is required . Mr . Tenkate asked about emergencies , and stopping
for lunch . Possibly quote law if any wording about emergencies
and meal period .
Break Periods :
Mrs . Drake explained that this is a new policy for the Personnel
Manual . Mr . Tenkate asked to have the word paid added . Wording
approved by the Committee after adding " paid break period " .
Attendance at Town Sponsored Functions : Mrs . Drake explained that
this topic in the past has been a " hot topic " , so she suggests
putting it as a policy in the Personnel Manual .
Supervisor Valentino questioned wording about required time to
stay at work . Mrs . Drake clarified why that issue was addressed ,
i . e . end of year party . Changed to " . . . they are required to stay
on the job until the time the function is expected to end or the
end of their regular shift ; which ever comes first " .
All sponsored functions should have a specified start and finish
time .
Supervisor Valentino , thanked all present for the work being done
to complete the review of the manual .
Next meeting will begin with Employee Benefits section . Mrs .
Drake will also bring back drafted sections worked on for final
Committee approval .
