TOWN BOARD MEETING
MAY 12. 1997
5 : 30 P. M .
At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County, New York
held at the Town Hall , 126 East Seneca Street, Ithaca , New York, there were present:

CALL TO ORDER : Supervisor Valentino called the meeting to order at 5 : 36 p . m . , and led the
assemblage in the Pledge of Allegiance .
AGENDA ITEM NO. 7 - REPORT OF FIRE COMMISSIONERS :
Robert Romanowski - The school district election is coming up . The School Board wants to raise
taxes in general 3 . 4 percent, but the Town of Ithaca increase would be 5 . 5 percent. It would mean
a $ 17 . 00 plus raise for the City of Ithaca residents, per $ 100 , 000 . 00 household ; and a $91 . 00 raise
per household for the Town of Ithaca . The Town may receive complaints about the increase .
A proposal is being developed by Lieutenant Tracy of the Ithaca Fire Department for special service
fees to be charged to users for technical services , such as rope rescues , hazardous material
incidences , and emergency medical services ( EMS ) . Fees would be charged under certain
circumstances where the fire department arrives first on a scene . The fee would never be charged
for fire suppression activities .
Councilwoman Carolyn Grigorov - Does this also include repeated malfunctions of alarm systems?
Mr. Romanowski- Yes . The proposal is only being discussed and researched at this point. There

are many changes coming to the fire department because fire suppression is only five percent of
the total activity of a fire department. Costs seem to be going up all the time . There needs to be
other ways to pay for these services besides taking money from taxpayers .
Councilwoman Grigorov - People might not call the Fire Department for hazardous conditions
because they do not want to be charged for it.
Mr. Romanowski - That possibility is part of the ongoing discussions , which will need to be worked
out.
A draft Hazardous Materials Joint Operating Agreement would be considered between the City of
Ithaca and the City of Cortland . A proposal between the Cities would include a joint response
agreement to provide, protection while reducing cost to the respective Cities . Discussion include
mutual aid requests, personnel , training , organizations , physical examinations (for the people
required to handle hazardous materials) , equipment, and cost sharing . In addition , other
departments or agencies who wish to participate in the future would be included in these
discussions .
The Board of Fire Commissioners made a request to the City of Ithaca Common Council to
reinstate , by referendum , the 77 elections . This would transfer responsibility from the Board of
Public Works to the Fire Department the maintenance of fire department buildings and properties .
This would include the South Hill and West Hill stations . A few years ago , the transfer was made
from the Fire Department to the Board of Public Works and it is not working well . The Fire
Department has budgeted all the items used . They want to be responsible for it. This is important
for the Town of Ithaca because it directly impacts the cost the Town pays . The Town should have
a more direct say in this issue .
Supervisor Valentino - Would a letter from the Town supporting that those responsibilities not be
transferred help?
Mr. Romanowski - Yes . The letter could be addressed to Common Council , with the Fire Chief
receiving a copy .
The Fire Department has discussed training center improvements near the municipal golf course .
This program would � be available for training both new volunteers and career fire fighters. There
has been an ambitious proposal put forward to implement upgrades for hazardous material
removal , new and improved fire fighting buildings, and training space ; but insufficient funding is the
problem . There have been problems completing current phases and the options are to obtain
additional financial resources by going from a local to a regional program , extend the phase work
into 1998 , or cut back on the program . This is going to be an ongoing discussion that will impact
the Town of Ithaca because any money spent on the Fire Department would impact the Town' s
budget .

On Saturday June 7 , 1997 , the Career Fire Fighter Test will be available for anyone to take from
the City of Ithaca or the Town of Ithaca . Anyone interested in taking this test should contact the
City Personnel Office or the Fire Station .
Councilman Edward Conley - Mr. Romanowski is an active member of the Veteran Volunteer Fire
Fighters Association . The Town Board has a resolution to discuss whether to permit gambling in
the Town of Ithaca , such as games of chance , bell jars , etc. What are the types of things the
Veteran' s Association uses their funds for?
Mr. Romanowski - Some of the money goes for a direct donation to the Ithaca Fire Department for
equipment that fire fighters cannot buy such as safety blockers at the end of ladders on the trucks.
Some money has been used for medical equipment for the Fire Department.
AGENDA ITEM NO. 6 - REPORT OF TOMPKINS COUNTY BOARD OF REPRESENTATIVES :
Tim Joseph - The Ithaca Journal has addressed the issue of removing sales tax from clothes items
with the cost estimates for doing that. There has been a drastic change in the estimates . The New
York State Association of Counties did a study which revealed that sales tax money gets divided
into categories such as apparel , hardware, car sales, and general merchandise . When the County
did their estimates for apparel it looked as if the County would lose revenue .
AGENDA ITEM NO. 9 - PUBLIC HEARING : TO CONSIDER AN APPLICATION TO CONDUCT
AN EVENT ABOVE THE NOISE LEVEL PERMITTED UNDER THE TOWN OF ITHACA NOISE
ORDINANCE :
Supervisor Valentino opened the public hearing at 5 : 45 p . m . . The Town Clerk had proof of
postings and publications .
Aafke Steenhuis, 224 Bostwick Road - A wedding has been planned to be held in my back yard on
June 21 , 1997 . The noise ordinance allows 60 decibels and it might be a little louder than that.
The band would be informed to keep the noise level toned down . When my sister-in -law arrives
from Sweden on May 28 , 1997 she would be speaking to the neighbors to invite them over after
the ceremony. We want to be incompliance with the Town' s ordinance . Have the neighbors been
notified of this meeting ?
Joan Lent Noteboom - The Town notified every resident within 1 , 400 feet of the event site .
Andrew Frost - Someone contacted the Building and Zoning Department from Culver Road behind
the property in question. They had some concerns about the noise, and I suggested that they write
a letter to the Town Board .
Ms. Steenhuis - This is only going to be a wedding with a band , and it would not get out of control .

Attorney for the Town , John Barney - How late would the band play?
Ms . Steenhuis - The band should be done by approximately 11 : 00 p . m . or midnight.
Attorney Barney - If the permit stated that the band could only play until midnight, would there be
any problems with that?
Ms . Steenhuis - " No . "
Supervisor Valentino closed the public hearing at 5 : 51 p . m . , and brought the matter back to the
Board .
RESOLUTION NO. 75: Motion made by Councilwoman Grigorov, seconded by Councilwoman
Russell that the Town Board of the Town of Ithaca does hereby approve the issuance of a permit
to Aafke Steenhuis, 224 Bostwick Road to conduct an event (wedding reception) on June 21 , 1997,
that will have a noise' level above that which is permitted under the Town of Ithaca Noise Ordinance.
A vote on the resolution resulted as follows :
Supervisor Valentino , aye ; Councilwoman Grigorov, aye ; Councilman Klein , aye ; Councilwoman
Harrison , aye ; Councilman Conley , aye ; Councilwoman Russell , aye ; Councilman Wolff, aye .
Motion carried unanimously .

AGENDA ITEM NO 6 - REPORT OF TOMPKINS COUNTY BOARD OF REPRESENTATIVES
( CONTINUEI :
Mr . Joseph - The County based their sales tax revenue estimates looking only at apparel . A
consultant mentioned that a substantial part of the tax under general merchandise that could be
exempt under this State Law of 40 percent. Another part of the consultant' s study revealed that
people not paying sales tax on clothing would have more disposable income which could be spent
on other taxable items resulting in a certain amount of recovery. The recovery they were projecting
seemed unrealistic. It seemed to look like all the money people received would be spent on taxable
items . The result of the consultant' s study was that the impact would be three times what the
County had projected . The County projected $ 1 . 2 million instead of their $400 , 000. 1 am not sure
what that means for the Town .
Supervisor Valentino - The Town' s biggest revenue resource is sales tax money , not property
taxes .
Councilman John Wolff - Is this being considered by the County Board?

Mr. Joseph - Yes , but it is important to realize it is not in the County' s hands . It is in the State
Legislature' s hands . Personally , it would not be going anywhere because it is too expensive for
places like Westchester County and Monroe County. I do not think the State will do it statewide
because they would not get support from those localities . I do not think it would be allowed by
individual County's. At the last County Board meeting , I was asked to develop a resolution taking
a position on this matter. I have no specifications so I have prepared three different resolutions.
One saying do it, one saying do not do it, and one saying if you are going to do it, do it statewide.
The Town Board agreed removal of sales tax on apparel items should be done throughout the
whole State.
AGENDA ITEM NO. 8 - REVIEW OF CORRESPONDENCE :
A. NYS Department of Environmental Conservation ( NYSDEC) - See attached letter
to Michael Barylski , Deputy Regional Permit Administrator for NYSDEC .
Jonathan Kanter - This was a copy of a letter sent to NYSDEC on behalf of the Town Board and
Planning Board in regards to the Cornell University Lake Source Cooling Project DEIS . The review
was to determine whether the DEIS was adequate for acceptance by NYSDEC , and it was
circulated for public comment. The DEIS looked adequately complete .
AGENDA ITEM NO. 4 - PUBLIC ANNOUNCEMENT: ETHICS DISCLOSURE STATEMENTS :
Supervisor Valentino - The Ethics Disclosure Statements are on file in the Town Clerk' s office.
Some statements by some officials and employees have not been received .
AGENDA ITEM NO. 10 - PERSONS TO BE HEARD :
A. Nancy Goody, Six Mile Creek -
Nancy Goody - I am not a single voice in this issue , since I am the Democratic Committee person
for this area . It is appropriate for me to bring forth this issue for my neighborhood . I am talking
about the Six Mile Creek gorge area . Residents living in the area of Commonland Crescent which
extends to Penny Lane have a problem with kids entering the gorge at night. These young people
light fires and scream as if they are literally being killed or raped . The noise is vicious , loud , and
goes on at all hours of the night . There is drunkenness and drug usage happening in the gorge.
They park on our lawns . They are drunk driving away from the scene . They are usually young
people who come during the spring and summer when it is nice weather.
Depending on where houses are individually sited some hear this noise more than others . Some
residents have people parking cars on front lawns , or walking behind houses or between houses.
It depends on how the houses are located , but we are all effected by it.

What to do? The logical thing would be to call the police , but there is not a Town police force , so
the Sheriff' s Department or the State Police need to be called . For the past three years , several
of the residents have 'called these law enforcement agencies at different times , but it does not get
us very far.
Councilwoman Grigorov - Do the police come?
Ms. Goody - No , they did not come one time , I was told there was a big party in Lansing and that
took priority. This is a problem , why doesn 't the Town have their own police? I understand that
the State Police actually showed up last Thursday and staked out the area because they knew it
was going to be an issue tonight.
Supervisor Valentino - I have talked to the State Police .
Ms . Goody - This is the first time, in three years, that the police showed up and got a sense of what
happens on this road,. We know some fires have burned all night because after a party a neighbor
found a fire at 6 : 00 a, m . . This is really a problem . We all chose to live there because it is a very
beautiful natural area and it affords certain green space benefits .
Councilwoman Grigorov - What is the ownership of the land?
Ms. Goody - It is a City reservoir, so if people look at the sign they assume they should call the City
Police , but that is not the way it works . The City Police does not have jurisdiction . Part of the
gorge is really in the Town of Ithaca . There is lack of cooperation and coordination for law
enforcement.
In 1996 , the City of Ithaca Department of Public Works ( DPW) passed a resolution stating that it
was illegal to park or trespass there from 10: 00 p. m. to 4: 00 a . m . as a request of the Six Mile Creek
Commission . Based on that resolution , that is what should be done . The City has an ordinance
stating that it is illegal to be there , and there is a sign .
I am not sure if the Town of Ithaca needs to pass a resolution . It seems that there are two issues . .
One is , if it is not illegal to be there, it should be . If it is a natural area there is no reason why
someone needs to be there after 10 : 00 p . m . There is no reason to encourage this . State Parks
close at 10 : 00 p. m . , then this natural area should be closed . If it is illegal , then it should be
enforced .
Enforcement could be done several ways , such as stake outs in the area . Police should not ignore
calls from the neighborhoods , and road blocks could be set up for drunk drivers .
The neighbors have signed a petition to encourage the Town Board to act on these ideas . One of
them would be to make it illegal to park on Penny Lane . We do not want to suggest that because
then there would be no parking for the visitors . The people partying would just move to the next

portion of Penny Lane or Route 79 , to park if the Town makes it illegal to park on Penny Lane. A
check point could be set up at the entrance of Commonland to check everyone driving into the
neighborhood after 10: 00 p. m . . Unless there is some enforcement on this issue we will be coming
back again .
Councilwoman Grigorov - I did not realize this problem was going on . Is this area where the fights
were happening ?
Ms . Goody - Yes . That is one time I was gone from my home . Anytime I have called the police
about the noise, I was lucky if approximately an hour later they would patrol the neighborhood . The
police do not get out of their cars or walk the paths . There needs to be a better solution for
enforcement because right now it is not working .
Councilman David Klein - How many cars usually park in this area? Is there a culAe-sac or turn
around at the end of Penny Lane?
Ms. Goody - No . There is a place for cars to park and they walk down into the gorge.
Councilman Klein - What time do cars start parking there?
Ms . Goody - Approximately 10 : 00 p . m .
Councilman Conley - Are the cars only parked there on Saturday nights?
Ms . Goody - Fridays and Saturdays mostly , and sometimes on Sunday in the summertime .
Councilwoman Mary Russell - Are these cars constantly there if the weather is good? Can you
count on them showing up?
Ms. Goody - Yes, especially on the warm days . The neighborhood residents have to clean up after
them as they leave garbage on the ground . The neighbors need to keep the area clean and safe
for the children to play outside .
Supervisor Valentino - Discussions with Captain Foley of the State Police revealed that he was
willing to work with the Town . Captain Foley is aware there is a problem . The State Police are
willing to try and resolve this problem . Captain Foley stated that when they receive a call and there
is not a higher priority, they would respond . It is their responsibility to respond to all calls . I have
not talked to the Sheriffs Department yet. This seems to be an ongoing problem . The property is
owned by the City of Ithaca , but it is in the Town of Ithaca . The City does have an ordinance
stating there is to be no trespassing after 10 : 00 p . m .
Councilman Conley - Is there anything keeping the Town from declaring this a park?

Supervisor Valentino , - This is a water shed area . If there is an ordinance , and if it is posted , the
State Police could enforce it?
Attorney Barney - I am not sure if the State Police could enforce an ordinance that was adopted by
the City just becauseithe Town owns the property .
Councilwoman Russell - In past discussions with the State Police, if an area was posted , they could
enforce no trespassing?
Councilwoman Grigorov - At that time, discussions were focused on vandalism on the trails .
Councilman Klein - If the area is properly posted , the police could arrest people .
Attorney Barney - The police could enforce the Noise Ordinance .
Councilman Klein - If the Town Board were to consider a partial ban on parking after a certain time
cars could be towed . Then people would realize they cannot enter this area . But if residents of
Penny Lane have guests after the specified time they could be at risk of having their cars towed .
Ms. Goody - Parking signs in the area are not beautiful things to look at, but if they need to be there
then they should be : installed . This is really an enforcement issue.
Councilman Wolff - I think there needs to be a stake out in this area . I do not know how the State
Police and Sheriffs Department feel about this residential area as a priority . They have other
things that they need to work on. A well planned stake out would show the offenders that we mean
business . Why is this discussion not talking about using the City Police force?
Supervisor Valentino - Because they do not have any jurisdiction .
Male in Audience - With Memorial weekend and the Fourth of July coming soon , there would be
partying and camping going on in this area all night long .
Councilwoman Ellen Harrison - That would be the best time to get the attention of the police .
Councilwoman Russell - If the police knew about the Town' s concerns , and that was a targeted
weekend they might want to have extra personnel to deal with it.
Councilman Wolff Is there a way to deputize City Police Officers and Sheriff Officers for these
purposes? It seems the City Police Force would be the appropriate people to handle this area.
Ms . Goody - There is a Gorge Ranger whose responsibility it is to catch people who are swimming
or who drive motorized vehicles in the area . Last year, an ex-State Police Officer did that. I was
told that the Ranger was the person who was supposed to be catching these people , but it has not

been followed up on .
Councilwoman Harrison - Was that officer deputized?
Ms . Goody - He worked for the City Police Department.
Councilwoman Russell - Does this officer have the authority to issue tickets?
Councilman Klein - Yes , appearance tickets .
Ms . Goody - The Sheriffs Department told me last year that they were responsible for issuing
tickets for motorized vehicles and appearance tickets for other things .
Attorney Barney - The Sheriff' s Department is under some stress financially, but they could
authorize someone to patrol the area. The Town could ask the Sheriff' s Department to authorize
a person to patrol the area for a few nights with the Town underwriting the cost for the overtime for
the Sheriffs deputies .
Supervisor Valentino - I could explore these things further with the State Police and the Sheriff' s
Department to see what could be done .
Mrs . Noteboom - There are New York State Department of Environmental Conservation Officers
who can write tickets .
Attorney Barney - They can only write tickets for the environmental laws .
Ms . Goody - It is not a camping ground , but people have used it as one . Fires are prohibited
according to the Six Mile Creek literature , as well as camping , dumping , drinking alcoholic
beverages, and noise control . Another issue that everyone is concerned about is that kids throw
firecrackers . It is hard to distinguish those from the sounds a firearm makes .
Supervisor Valentino - I will discuss this matter further with the State Police and the Sheriffs
Department.
Ms. Goody - The neighborhood would appreciate any assistance the Town could give . We have
several petitions signed by residents of the neighborhood to present.
Gregg Bell - The petitions represent eight home owners who are not here tonight, and four home
owners who are represented . There are 12 households being represented in this area , so there
is a high percentage of people in this area who are letting the Town know their concerns .
One of the neighbors who signed the petition is involved in the Commonlands Condo Association .
The Association is meeting tonight , and they want to know what the Town Board has to say about

this issue . The Association members would be happy to come and express their concerns. One
of the Association members , witnessed fires still burning in the gorge in the early morning .
Newspapers were used as torches to illuminate the pathways . As the torches burned down to a
point where they could not be held they were dropped at various points along the trail . The idea
of forest fires burning down our houses is not a small issue. There are fires occurring in the woods
on the trail approximately 200 feet from the houses . We have all seen pictures of houses burning
down from forest fires , and I do not see it as a remote possibility here.
This same person also mentioned that some mornings there are people sleeping in the' gorge.
Recently, they noticed a young man walking around incredibly dazed . They were convinced he had
used drugs all night. Not only could he be dangerous to other people, but certainly to himself. This
area is dangerous to walk in at certain places because of the cliffs . This kid could have easily
fallen over the dam or one of the other steep spots and seriously injured himself.
Supervisor Valentino - I will contact Ms . Goody after I gather more information on this issue .
AGENDA ITEM NO. 10 - PERSONS TO BE HEARD (CONTINUED ) :
Ira Goldstein - Tessa Goldstein and I own land on East Compton Road and East King Road . This
morning I delivered a letter to Mr. Walker and Ms . Valentino about the sewer benefit taxes paid on
our land on East King Road .
Mr. Goldstein read a prepared statement to the Town Board - See attached letter.
Councilwoman Grigorov - The sewer in that area does not go down both sides of the road .
Mr. Goldstein - I am not sure about that, but in terms of the sewer being considered available, it
does not benefit us .
Mr. Walker - This was a single lot that was subdivided last June . Lots # 1 , #2 , and #3 were small
individual lots subdivided from lot #4 . Sewers are generally built on one side of the road or the
other. In some cases, the Town does have the sewer lines on both sides of the road depending on
the topography of the road . In this4particular area , the sewer has been extended along King Road
by the developers in short sections. When the Town builds a new sewer the Town would provide,
as part of the construction , one service at that time for each existing property. Normally , at the time
of construction we provide services to lots on both sides of the road . In this particular case , since
the developer built1the sewer, the Town did not put the sewer across .
The benefit assessment formula assumes a sewer along a public right-of-way is accessible to
properties on both sides of the road . Generally, the Town has allowed people with new subdivision
lots to make a connection , at their cost, to the existing sewer. In some cases , the Board has
considered extending the sewer across the road for existing lots . This particular lot has such a high
benefit assessment because it is large . If access does not require crossing another private

property which requires an easement, there is no reduction in the benefit assessment formula. We
are looking at the formula for large lots and the impact on open space .
Councilman Klein - Does this lot have approximately 13 units?
Mr. Goldstein - It has 13 . 23 units .
Supervisor Valentino - This has not been looked at by the Benefit Assessment Committee yet. The
committee will be reviewing this complaint and contacting Mr. Goldstein and Ms . Flores ,
Mr. Goldstein - Even if the sewer is considered available it would be a great expense to look into
it. We are not planning to have a large number of units on that land . There are three lots in front
that are R-30, and the rest of the land would have a conservation easement so there would be no
development .
The tax rate is uniform throughout the County . The sewer line is on the other side of the road, yet
the rate we are being charged is the same as for the people on the other side of the street who do
not have to pay $ 101000 to get the sewer across the road . This seems unfair. I also question the
definition of availability being used in this instance .
Supervisor Valentino - The Town is looking at the whole benefit assessment formula as to how it
has traditionally been done . It is under review with a special committee at this time . The
Committee is aware that there are things that do not seem fair. I will let you know what happens
after the committee finishes their findings .
AGENDA ITEM NO. 10 --PERSONS TO BE HEARD - SIX MILE CREEK PETITION (CONTINUED) :
State Police officers have arrived . The Town Board appreciates their coming tonight. They are
aware of what has been happening on Penny Lane , and in the gorge . They are willing to help
resolve these issues .
Ms . Goody - The residents of Commonland Crescent have concerns about the parties that go on
late at night in the gorge . There are concerns such as fire , drunkenness, drug use, parking on
property, and destroying property. There are questions of who should be enforcing the law in this
area because it is the City' s property in the Town of Ithaca watershed district. This will be the
fourth summer that this has happened , and we would like to take care of it right now. People have
already had one party in the gorge this year. We expressed our concerns , and when we call for
help someone should respond . We would like to know if the ordinance making it illegal will be
enforced .
Captain Foley, New York State Police - It is a difficult situation in this area . There are some things
that could be done, one is to call us . This is not an easy situation for us to rectify. Stake outs are
all very good , but I only have a limited number of officers . I was thinking that we could be

proactive , and try tol keep people from going in at certain times of day . It means that everyone
would need to be flexible for it to work. We have learned that if you require people to spend money
for fines that usually the best cause .
We have installed signs for no parking in other areas . However, there are friends and relatives
visiting where there is already limited parking space . No parking signs could be made for after a
certain time of night. We could enforce no parking after certain hours . Those vehicles would be
ticketed first, and then the cars could be towed . A towing fee would be approximately $50 . 00 . If
we did that and we were proactive , every time there was a problem with someone parking , we
could patrol the area and ticket those cars. No parking signs do not need to be every 50 feet, they
could be placed at the entrance of the roadway.
Sergeant . Rudd is in charge of all the State Police Troopers in Tompkins County. I am his boss.
It is not an easy thing once people enter the gorge. It would be a hard decision to send any trooper
in for them in the middle of the night when it is like a maze . There is a limited group of troopers on
duty at night. If the neighbors called us when the people were coming out we would arrest them
for trespassing . If they are under 16 year of age they cannot be arrested , it would only be a
violation . It has to be a crime to arrest a juvenile .
We are willing to work with the residents on Penny Lane . Perhaps no parking signs would be the
best answer.
Councilman Wolff - Could a permit system be set up to enter that area? If not, then no parking
signs would be the best way. Whatever efforts the police make to show up in the area will help the
residents feel better. If the police do not show up the area will grow in reputation as a great place
to go in the summers . Having the police show up just one night would be a great deterrent to
people being there .
Captain Foley - Periodically , some troopers could be sent into the gorge . Who owns the gorge
area?
Supervisor Valentino - The gorge is in the Town of Ithaca, but is owned by the City of Ithaca .
Ms. Goody - The area is posted by the City , it is illegal to be in there after 10 : 00 p . m. . Technically
it is the Town' s responsibility.
Attorney Barney - 'The City Police do not have the authority to enforce the law in the Town of
Ithaca . Where does the parking occur? Is there an emergency access roadway?
Ms . Goody - Yes. It comes between two clumps of houses in Commonland off of Penny Lane . The
offenders park on Penny Lane .

Captain Foley - It appears that every sign says City of Ithaca. My opinion is that if the City owns
the property , then the City Police have jurisdiction there .
Sergeant Rudd - For example , the Syracuse Airport is by owned the City of Syracuse which is
patrolled by City Police .
Councilwoman Russell - Could the Town legislate the authority to the City officers to patrol and
enforce the law in this area?
Attorney Barney - The Town could try .
Councilman Wolff - The Gorge Ranger patrols in the daytime to discourages swimmers , but he
does not work at night.
Ms. Goody - If Penny Lane is marked no parking , the kids could park further up and walk through .
When the police respond they cruise the area , but they do not get out of their cars . I feel that the
police need to get out of their cars and walk through the area . I do not think the no parking signs
would work alone.
Captain Foley - What could my Troopers arrest them for?
Ms . Goody - It is illegal to be there after 10: 00 p . m . It is posted .
Captain Foley - I would like something from the City of Ithaca stating that, if that is the case. There
are rules for posting no trespassing signs .
Ms . Goody - It is also illegal to have fires in this area . Drinking and drugs are illegal , and these
things go on . Residents of Penny Lane have to deal with the noise, screaming , and fire crackers.
At what level is that illegal , what level would not need the State Trooper' s attention ?
Captain Foley - It is illegal at several levels , but I do not know how often this happens . How often
does this happen during the summer time?
Ms . Goody - Almost every weekend when the weather is good . Memorial Day and the Fourth of
July are coming , those are the worst times .
Supervisor Valentino - What about no parking from 11 : 00 p. m . to 7 : 00 a . m . ? Then people who live
there would know that if there is a party in the gorge the State Police would be there at 11 : 00 p. m .
to ticket cars . No parking signs could be installed to cover those hours . This would be a start to
the problem .
Councilman Wolff - Why can 't the Town do residential permit parking?

requirements of adoption . How long would it take the Town to get the enforcement of no parking

meeting .
Supervisor Valentino - I will discuss this with the City of Ithaca and contact Captain Foley and Ms .

AGENDA ITEM NA 20 - CONSIDER ADDITIONAL FUNDING AND BUDGET TRANSFER FOR
THE SOUTH HILL SWAMP PLANT STUDY:
Mr. Kanter - The original South Hill Swamp Plant Study was done last fall when there were not a
lot plants with leaves . The initial study was helpful to identify the overall area . The conservation
Board has recommended that a more in depth plant study be done in June and July when the plant
species are much amore apparent .
Supervisor Valentino - The map supplied to the Board shows a significant area to be concerned
about. The funds are available in the budget to pay for this project.
Phil Zarriello , Conservation Board Chair - Don Raoult, Director at the Cornell Plantations agreed
that this study is in the interest of Cornell University as well as the Town of Ithaca . He would be
willing to work with the Town on this study . A scenario may be worked out so that Cornell
University could pay for Ms . Ostman' s salary , and for her to do the study on Cornell ' s time . The
Town would have to contribute to Mr. Wesley' s salary.

Councilwoman Grigorov - Forty dollars per hour comes out to $83, 000 per year as a salary base,
is this a usual salary base?
Councilwoman Harrison - Usually when people are paid as a consultant, they charge for employee
benefits into the quarterly fees .
Councilwoman Grigorov - I think this is a big salary base.
Councilwoman Harrison - I worked as an independent consultant in 1983 . My salary was $50 , 000,
but the fringe benefit rate was not added in , that should have been 30 percent . You would be
paying for their office space. If they are writing a report they would need a computer. This is not
a straight salary, it is incorporated into other costs of doing business . When you are a consultant,
it is not right to equate it with salary costs because there are other hidden costs .
Mr. Zarriello - The Town may not have to pay that amount of money .
Councilman Wolff - How could the Town Board determine what the expenses were if the money
was not to exceed $3 , 500 from the Town' s accounts?
Councilwoman Harrison - There would be a contract that was made clear enough to show where
the funds would come from , and the amount it was not to exceed .
Councilman Klein - Why is the Town shouldering the whole cost when the land is owned by Ithaca
College and Cornell University?
Mr. Kanter - It is possible that Ithaca College could contribute to this, but not in time to get the study
going . It is important to start this project within the next week. The study is something that the
Planning Committee and Conservation Board initiated because of the Unique Natural Area
designation of the general South Hill Swamp which was targeted as a large wetland . The plant
study will be more specific as to where the boundaries are based on the actual frontage in the
communities. The unique natural area indicated the real reason the area is unique is because of
the rare and unique plant species in this area .
Councilwoman Harrison - The study would help delineate the boundaries of the UNA to justify the
Conservation Zone?
Mr. Kanter - "Yes . "
Councilman Klein - Would these people be properly insured? Would they have permission to go
onto private property?
Attorney Barney - This has been discussed with them and they were told the Town does not have
that type of insurance coverage so they need to have their own .

AGENDA ITEM NO. 12 - CONSIDER SETTING PUBLIC HEARING DATE TO CONSIDER AN
ORDINANCE TO ESTABLISH RULES AND REGULATIONS FOR THE ISSUANCE OF OPEN
BURN PERMITS IN THE TOWN OF ITHACA:
Attorney Bamey - Many people and agencies regulate open fires . Department of Environmental
Conservation Pollution Standards has a prohibition that prohibits air pollution . They have,
however, a second regulation which talks about trivial activities , which means they do not regulate
them , open fires are specifically listed . The County has as part of their sanitary code , air pollution
control responsibilities .
Mr. Frost - The County does not issue burn permits anymore , the DEC issues them now.
Attorney Barney - The legislation was originally enacted in 1953 , and amended in 1983.
Mr. Frost - The Health Department change occurred in 1993 or 1994, and I do not think they issue
burn permits any longer.
Attorney Barney - They do allow certain items to be burned without permits , but other items require
an open burn permit. There are two items the Town Board should discuss regarding a local law

on opening burning ., One is a prohibition against open burning in the Town of Ithaca . Burning
would not be allowed at all unless it were permitted under some other law or special permit to do
an open bum . That would mean no burning of such things as leaf burning and barrel burning . It
also covers a farmer who wants to burn a pile brush that they have on their property. The only
thing that was specifically excluded to be allowed was recreational burning such as BBQ' s, food
type activities , and camp fires for solely recreational purposes. The Board needs to define
recreational burning for the local law. The second item puts the Town in a regulating business.
This would authorize more than just recreational burning , but burning would be subject to getting
a permit from Mr. Frost, the Building and Zoning Officer.
Mr. Frost - My concern is two fold. I have talked to County Planning and to the State. Burn barrels
are for people whoi are burning household trash and rubbage of any kind . From time to time I
receive calls from the Fire Department who responded to a call where something is burning , such
as leaves or tree trimmings. When I arrive on the site, the property owner is asking me if they can
bum . The concern is if I say yes , particularly in a dense area, if the fire gets out of control the Town
could be liable for any damages . Legitimate concerns are things like air pollution and smoke
crossing the road anId interfering with traffic. Building code has a section describing when a person
needs to notify the Building and Zoning Department and the Fire Department about an open burn .
To bum they would need an area that is basically clear with water or extinguishing agents on site.
I dislike the dialogue where I have to tell someone they can burn . If there were a Town policy
specifically stating what the policy is , it would make it easier to enforce this issue to property
owners .
Councilwoman Harrison - What are potential legitimate burnings other than recreational ?
Mr. Frost - The Town would want to consider their agricultural zones. Densely populated areas are
typically residential zones . They are the ones that are of concern . I would rather have buildings
far apart if someone is burning brush .
Councilwoman Grigorov - Does the Fire Department provide service?
Mr. Frost - Burning is prohibited in the City because it is a City with a population greater than
20 , 000 people within an eighth of a mile . When people call the Building and Zoning office , I tell
them there is no open burning allowed in the Town of Ithaca .
Attorney Barney The State of New York Legislature has a proposed law before them . It has
passed the State ! Assembly a few times , but not the State Senate . The proposed law would
prohibit open burning with the exception for land clearing debris , agricultural material , and yard
waste . The State Board would permit all of those .
Councilwoman Grigorov - If there was some type of permit required , then Mr. Frost could make sure
that the fire would be in a safe area?

Supervisor Valentino - Yes . A time ago , the Town received a pamphlet for distribution , and the
Town Board decided not to distribute it because open bumings were allowed in the Town of Ithaca .
Up to that point , we were all under the assumption that burning was not allowed in the Town of
Ithaca .
Mr. Frost - The population requirements were the point in the pamphlet.
Supervisor Valentino - We did not distribute the pamphlet because most people were under the
same assumption we were. We thought it was illegal and the Town was comfortable with that. Mr.
Frost should work on some of the issues of concern before we advertise for a public hearing to be
held . The public hearing could be held after more information is gathered for the Board to consider.
Attorney Barney - Could a sub committee be set up to work with Mr. Frost on this issue?
Councilwoman Russell and Councilman Wolff volunteered to work with Mr. Frost on an open
burning policy in the Town of Ithaca .

Councilwoman Russell - Could you clarify the yard waste clean up and why there was a particular
large amount of brush ?
Fred Noteboom - We have had problems with people clearing large lots on King Road . In the
previous years, they have been clearing several acres of land . This year we made an effort to
come earlier to pick up brush , but it was not out to pick up , so we didn't pick it up . Supervisor
Valentino received i a call , and then the Highway Department picked up the brush . The Public
Works Committee discussed the issue of whether the Highway Department should accept large
amounts from acres of land being cleared during the yard waste and brush clean up for residential
areas .
Supervisor Valentino - Accepting large amounts is very costly for the Town because it takes the
Highway Department workers away from their other responsibilities . Yard waste pick up is
something that we do every year because people want us to do it. When we decided to do this we
were talking mainly ! about people' s yard waste, not people clearing acres and fields of land . If they
are going to clear that much land they should hire someone to clean up the waste. It needs to be
made clear next year that it is not acceptable , and that the Highway Department does not have to
pick up that much volume at one place .
Mr. Noteboom - The Highway Department transports the brush to the highway barns to make wood
chips and mulch . ,Residents are allowed to pick up wood chips or mulch at the Highway barns if
they want it.
Councilwoman Russell - Will the Town be installing a map display stand at the South Hill trail
entrances?
Mr. Noteboom - "Yes . "

Councilwoman Russell - Will the Town also be posting a sign about the Town ' s Dog Ordinance?
Councilwoman Grigorov - They are already posted at one end of the trail .
Mr. Noteboom - My understanding was that they were already posted .
Councilwoman Russell - I will check both entrances , and report back to the Board .
The Town Board had a brief discussion on the reconstruction of Warren Road and the sidewalks
in that area . The Public Works Committee will be discussing further what the Town should do in
this area .

Mr. Kanter - Planning Staff has received information from the State Department of Transportation
regarding the evaluation of the intersection at Route 366 and Caldwell Road . They determined a
traffic signal is warranted . They plan to install a full three colored traffic signal during the 1998
construction season . They also indicated that the State would not agree to a test closing of Judd
Falls Road . They do not want to install a temporary traffic signal to do a test like that.
There are two low income housing credit projects before the State that we just received notification
of. One is a project by Conifer Realities on Mecklenburg Road , and the other one is a project by
Landmark America on Danby Road . Housing credits from the State are pretty competitive .
The Planning Department dropped the item of submitting a grant application for a historic resources
survey . The survey may be done by interns this summer.
Councilman Klein - Has the final team been interviewed in relation to the Northeast Sub Area
project?
Mr. Kanter - We have interviewed several consultants , and a decision has not been formally made.
The preferred candidates were a mix and match of teams that did not originally submit an
application together for the public participation module and the technical module. The Interviewing
Committee asked staff to negotiate the possibility of combining the study team .
D. Director of Building and Zoning - See attached .
Mr. Frost - The Town had a meeting in the northeast in February to discuss drainage issues. At
the end of March the Town sent letters to approximately 35 property owners taken from the
attendance sheet from that meeting . There were several residents from Cayuga Heights at the
meeting . The Building Department was available to do site inspection dealing with issues that
might be relative to building code and drainage problems . We did receive responses from eight
people. We will follow up on those responses and keep the Board informed of the findings .

Brian Cutler, the new Assistant Building and Zoning Officer will be leaving his employment with the
Town of Ithaca for job with a local architectural firm .

Supervisor Valentino - It was unclear at the last meeting as to what the Board wanted for a financial
report. The Accounting Department will be providing the Supervisor with a notebook each month
that has different reports in detail . If there are things that the Board wants to see , the notebook
would be available ' at every meeting to look at. Mr. Carvill will be supplying the Board with a
summary report .
Councilman Klein - Does the Town have any legal requirements about filing the financial reports?
Alfred Carvill - The financial statements need to be done on a timely basis . The first quarter sales
tax revenue has arrived . That has been treated as an allocation based upon what each fund has
budgeted compared to each quarter revenue that is received . In the past, whatever fund needed
the money the most would received the money first. That is not how it is being handled now. The
money is being allocated and proportioned out to each respective fund it was budgeted for. At the
end of the year, all the funds will have earned all of their money, rather than depriving each fund
of an ongoing revenue .
Supervisor Valentino - This amount is right based on the budget numbers that were used . It was
seen in the newspaper that the County was concerned because their numbers were under what
was budgeted. The County projected a three percent increase. The Town took a five year average
of what had been received , and used that number. That is a safer way to budget.
Mr. Carvill - A summary of the allocations has been supplied to each member of the Board . The
1996 Independent Audit is completed . Supervisor Valentino and myself have had a financial exit
meeting with the Independent Auditors . There is nothing in the report that any of us did not
anticipate hearing about. Obviously, there is a great deal of room for improvement, but the financial
statements do indicate that some improvements have taken place .
During the audit it was learned that one quarter of Cornell University's sewer charges were missing .
Subsequent to that , we took a closer look at all of the sewer billings for Cornell University for the
year 1996. The disclosure was made that the fourth quarter of 1996 and the third quarter of 1996
were never invoiced to Cornell University . Mr. Walker and I discussed this , and the user charges
were gathered and Cornell University was quickly notified . Cornell University told us they were
holding onto the money . A bill was sent, and as of Friday the $315 , 000 was received .
The official statements were submitted to the auditing firm today . Those will be available for the
June Town Board meeting .

As of April 30 , 1997 , the Town of Ithaca has $5 . 8 million of invested funds . All invested funds are
equally collateralized per market value investments at an amount of $8 . 4 million . The Town of
Ithaca has total cash on deposit with Tompkins County Trust Company of $6 . 5 million . That
includes all of the Town' s Certificates of Deposits . The funds have been invested at timed
maturities to meet the payrolls , abstracts , and other contractual obligations . Funds have been
laddered at short term interest rates in anticipation of the Federal Reserve raising the short term
interest rate in the second half of 1997 . The increase in this rate should only be regarded as
temporary. However, in trying to place the Town in a healthy cash situation and to take advantage
of this opportunity, we stand capable of being able to layer our investments on a short term basis.
The Town' s present year to date 1997 interest income , is $ 130 , 900 . There may be an additional
$71 , 500 generated from invested Certificates of Deposit as of July 31 , 1997 . Then there will be five
more months of the year to eam additional earnings . Uninvested monies are all deposited in
interest bearing money market accounts . These funds have been tied into any unexpected
reasonable expenditures , so we do not have to cash any of the Certificate of Deposits .
The Town' s cash accounts, savings and checking accounts, except for the Trust and Agency Fund,
are balanced and reconciled on a monthly basis. Effective May 11 1997 , the Town has now initiated
the Consolidated Disbursements Account, and we will be operating a Consolidated Payroll
Account. These accounts operate independently and will be used exclusively for meeting the
expenditures or abstract needs of the Town with payroll used exclusively for payroll and other
human resource functions. This action reduces the Town to two checking accounts . By June 30,
1997 all other existing checking accounts that the Town has been maintaining will be closed .
Supervisor Valentino - When I realized there were several checking accounts , I made it a goal to
have only one or two checking accounts .
Councilman Klein - Mr. Carvill will be keeping track of the funds now?
Supervisor Valentino - Yes. When I took over and started to reinvest funds last year, earnings were
raised substantially. When Mr. Carvill took over the Accounting Department , he showed how
invested funds would be raised even more . Instead of having the funds in a checking account
earning 1 . 7 percent, it will all be invested in savings at a much higher rate .
Councilwoman Russell - Is the Town restricted as to how the funds are invested?
Supervisor Valentino - Yes , that is why they are collateralized . Previously , the Town was not
properly collateralized . We are over collateralized , which puts the Town in a very strong position .
Councilman Klein - The Town' s funds are fully insured by the bank?
Mr. Carvill - "Yes . "

Supervisor Valentino - This makes a big difference in the Town ' s financial outlook. It gives the
Board a much better' view on things . Next year, I think the Board will have a much better view of
where we spent our money to better budget for each department' s needs . We will have a clearer
view of what needs to be done in future years .
Mr. Carvill - The Town Board and the Department Head' s should be commended for pulling things
together.
Councilman Wolff - Have we completed the overview and adjusting of the Town' s finances yet?
Supervisor Valentino - We are getting closer. There are a few things that still need to be looked
into , such as the bonds . There are a few items that need to be worked on from the auditor' s
report. Those things are minimal for this type of organization .
Mr. Carvill - The water and sewer funds will not be straightened out completely until 1998 . There
are issues that still ! need to be worked on before the water and sewer funds are completed .
AGENDA ITEM NO, 5 - REPORT OF TOWN COMMITTEES :
Councilwoman Harrison - The Town and the Cornell Transportation Committee met, and invited Jon
Meigs from the City to attend . There needs to be coordinate plans with different municipalities .
The Village of Cayuga Heights and the Town of Lansing are planning to reconstruct North
Triphammer Road. The Town of Lansing appears to be reconstructing bike lanes along the edges
of pedestrian access . The Village of Cayuga Heights is ready to go with a plan that makes it
impossible for bike lanes. The plan has narrow lanes and curves . When asked why, the answer
was they do not want to see traffic move faster. The Committee stated that there needs to be a
better way of doing it . There is one sidewalk, but bikes are not allowed on them . When I called
Ron Anderson , he' said they were thinking of putting in separate bike lanes on the west side , but
they have not allocated money for it, and the path would be shared by elderly pedestrians and
bicycles. Mr. Anderson said he is trying to get some direction from the Village Board . They do not
really have a policy on these issues . He is trying to set up a meeting of their Public Works
Committee to discuss these issues . The Town should get involved in this because they are going
ahead with the design . The City of Ithaca' s bike plan also mentioned traffic concerns . I contacted
the Mayor and Mr. , Anderson to tell them we would like an opportunity to address their Board about
the reconstruction of the road .
Mr. Walker - They would maintain the four lanes down to two lanes .
Mr. Kanter - They have not addressed the issue of the Kendal turning lanes.
Supervisor Valentino - The Village of Lansing is concerned about how the whole thing comes
together.

Mr. Walker - The Village of Lansing is more worried about the end of the road by McDonald' s .
Councilwoman Harrison - One of the Village Board Members mentioned that generally the Board
is " bicycle friendly" , but that they are unaware of what is actually going on .
A few members from the Town will be attending the Village Board meeting on this issue . When
more information is available it will be supplied to the Town Board .
Councilwoman Harrison - Cornell Engineering Students were asked to look at the possibilities of
crossing Cascadilla Creek, near Summerhill Lane to get to East Hill Plaza and the East Ithaca
Recreation Way . The students stated that they were interested but it was going to be very
expensive to cross the creek and accommodate flood stages . They anticipated that a bridge of
about 100 feet long would be necessary . They did not want to spend time designing something,
if the Town was not seriously interested .
Mr. Walker - The creek is approximately 25 feet wide in the area where the Town' s transmission
main crosses . The flood stage is quite wide there , approximately 60 to 80 feet. There are some
back water areas in that area . It might be possible if it was designed properly to keep the creek
narrower in that area with the proper erosion control . There is an old dam there that is washed out.
It might be possible to fill both sides and have a bridge 50 to 60 feet long . The Engineer Club built
a bridge on the Waste Water Treatment Plant side for the running track. There is a new bridge
there that has a 15 foot high step up to it .
Councilwoman Harrison - Could you call the Engineering Club Advisor, Bill Philpot, and discuss
these issues that pertain to engineering ?
Mr. Walker - "Yes . "
Councilwoman Russell - The Finance Committee of the Recreation Partnership met, and the staff
is worried about the State Funding to Department of Social Services ( DSS ) , which pays for many
of the programs for the needy children . The Committee is trying to come up with possible strategies
for how to go forward if that funding is not approved through the State Budget, The Recreation
Partnership Board may come to the Board for additional funding for scholarships for children who
usually get their programs paid for by DSS .
Councilman Wolff - The State funding may not be available anymore?
Councilwoman Russell - Funding has been available in the past, but it might not be in the State
Budget for this year.
The Cornell Waste Management Committee has a proposal of withdrawing plastics from items
under consideration of incineration . There is a tour scheduled for the Small Animal and Large
Animal Bio-Safety Level Three at the Cornell University Veterinary School .

Councilman Wolff - Training classes will be starting for Town employees on the new computer
software system .
Councilman Klein - The Codes and Ordinances Committee reviewed the zones , and Attorney
Barney' s office will Ibe making these adjustments. They will be ready soon to distribute for
comments .
The Committee reviewing the Sprinkler Law will be meeting this Friday.
The Benefit Assessment Committee will be meeting Thursday , and will be starting to review
numbers .
AGENDA ITEM NO 13 - DISCUSS PRIORITY LIST FOR THE WATER AND SEWER CAPITAL
PLAN .
Mr. Walker - The priority list has not changed much since 1995. A question was raised as to where
the Buttermilk Falls ;p roposal would fit in for the replacement of the water line and the linkage back
to the Elmira Road connection . This was not put on the priority list originally. Basically , the request
from State Parks and the opportunity that the reconstruction of Route 13 allowed the linkage for the
Town to cross the road .
Most of these priority projects have a cost over $250 , 000 with the exception of a short section of
the Danby Road sewer that was requested by a resident. They are all large projects .
As far as water projects, we are waiting on the completion of the joint water study with the City and
other municipalities that are partners with Bolton Point. We expect a preliminary plan from that
study to be formulated some time this summer. This study might point out to two additional
improvements that may benefit several parties to be cost shared . The East Shore Drive Water
Main Replacement and Lower Level Project of the East Shore Drive Transmission Main totals
approximately $3 million. These projects could get done in conjunction with the additional storage
project at Bolton Point, and the work with the City of Ithaca depending on what they decide to with
their water main . In discussions with Supervisor Valentino it was decided , the Town should not
spend a lot of time on capital planning at this point, until other things are taken care of.
Councilwoman Harrison - Why is the Coddington Road Sewer Extension on the priority list? Is this
a priority for the Town ?
Mr. Walker - This was an earlier version of the priority list . The spreadsheet was based on the
input from the Board Members during Former Supervisor John Whitcomb' s term . The actual
priorities stand as they were from the spreadsheet . The other sheets describe what the cost
amount is for the project.
Councilwoman Harrison - There should not be anything on the list as a priority that we do not have

in mind to do . The priority list stacks up , but it does not say it would be done .
Councilwoman Grigorov - People would expect it to be done if it is on the list.
Councilwoman Harrison - The list needs to be modified , and things need to be eliminated unless
they are done. What is happening with the West Hill Phase I ?
Mr. Walker - That is to reenforce the existing water main , not to extend service .
Councilwoman Harrison - Would the increase of pressure capacity allow potential extensions to
development areas further into an agricultural area?
Mr. Walker - This upgrade would not extend pressure appropriately. It might raise it slightly in the
West Haven Road area where there is substandard pressure now. It will provide a second source
of water up the hill , and this may be one of those projects that the City wants to improve their
circulation on the Elm Street tank, or to improve one of their other tanks just over the City line there
is a redundant. Right now the hospital and everything in that area is supplied by one very old water
main . We have a severe fire flow deficiency at the Elm Street end of the Town' s water main . The
water tank that supplies it is two miles away , and that pipe reduces the fire flows . Fires like those
at EcoVillage and Hub' s place were hampered by the lack of sufficient water flow.
Councilwoman Harrison - Would that project change the development potential of adjacent areas?
Mr. Walker - No , it would bring the Town up to a safe standard .
Councilwoman Harrison - This would not change the development potential areas that might be
served by public water?
Mr. Walker - It depends on how it is done. If the Town provides a tank to balance the Trumansburg
Road tank it would not change the service area at all .
Councilwoman Harrison - Would it change the potential service area if pressure is the issue of
keeping the area serviced?
Mr. Walker - No, this tank would not and the second pump station would not. If someone came in
with a proposal like Saddlewood to build another pump station , and they wanted to pump water to
a higher zone a new tank would need to be built . This reenforced system would allow that to
happen with a higher level of safety. They could not have done the Saddlewood project with what
is available now.
Councilwoman Harrison - Except that we could say it is not safe , and we do not want to extend
service anymore .

Supervisor Valentino - I do not think things should be removed from the list without further
discussion of it.
Councilwoman Harrison - Projects were put on the list without being examined . They were put on
the list because people requested them . That is not the criteria for putting something on a priority
list:
Mr. Walker - The list could be modified at any time. Things could be added or deleted from the list.
The Codes and Ordinances Committee could review the priority list for modification . I would like
to recommend eliminating improvements to the north end of Town on Trumansburg Road where
there is a substandard system . The middle level on West Hill is still important .
Councilwoman Russell - Could the Town improve the hospital zone service without improving the
mid zone service?
Mr. Walker - The Town put in a stop gap hydraulic tank and a small pump station to serve
Trumansburg Road from the Woolf Lane area. All the areas shown on the Capital Plan are of high
density . There is not a sufficient flow for fire protection in that area .
Supervisor Valentino - Does the Board feel comfortable with taking Coddington Road Sewer
Extension off the priority list?
The Town Board was in agreement to take the Coddington Road Sewer Extension off the priority
list at this point. The Town Board had a brief discussion on the West Hill water service. The Town
Board decided to make a list of other, not so important projects , which includes projects which are
only on the list because they were requests by residents .

residents would be potentially closed out as soon as they fill the slots with people from other
Towns?
Mrs . Noteboom - No , they would fill the slots with Town residents first.

AGENDA ITEM NO. 24 - PRESENTATION 1996 INDEPENDENT AUDIT REPORT .

ADDITIONAL AGENDA ITEM NO. 1 = BOLTON POINT TRANSFER OF FUNDS :
Supervisor Valentino - The SCLIWC voted on the transfer of funds for Bolton Point. These were
not done in an appropriate way. There should have been a separate resolution outlining exactly
why they needed the funds transferred . I also raised the question at the commission meeting that
1 think it is not appropriate to be transferring funds from contingency so early in the year. When the
SCLIWC sets aside $ 100 , 000 for the contingency line it is an invitation to spend it. In the
meantime , the Town needs to transfer $30 , 000 from the contingency line for the Slaterville Main
Transmission Repair Project. The SCLIWC needs to transfer $850 for unemployment insurance
for an employee that does not work there anymore. A large advertisement in the Ithaca Journal
cost $ 1 , 000. The advertisement is mandated by law. The SCLIWC shared the cost with the City
of Ithaca to reduce the cost. The SCLIWC did not have enough budgeted in their advertising line
to pay for the notice .
Mr. Walker - That is questionable, because they had $ 1 , 500 in the line . Even a big advertisement
would not have brought the funds down to a negative number yet, and they are anticipating future
advertisement costs .

Town Hall . No more than two members from each can be of the same political party.

WHEREAS , the properly advertised public hearing has been held to consider a
permit application by Aafke Steenhuis , 224 Bostwick Road to conduct an event
(wedding reception ) on June 21 , 1997 , that will have a noise level above that which is
permitted under the Town of Ithaca Noise Ordinance ; and
WHEREAS , the Town Board has reviewed the said permit application and
determined that the level of noise above that permitted under the said Noise Ordinance
would not create an unreasonable disturbance for residents within 1400 feet of the
event ; and
WHEREAS , Mrs . Steenhuis has assured the Town Board that if the noise were to
reach a level of disturbing others it would be adjusted downward ; now therefore be it

WHEREAS , the proposed Town of Ithaca Water System Improvement - 1997 at

Construction and installation of new 8" water main extensions running east from
the intersection of Route 13 and Buttermilk Falls Road East along Buttermilk Falls

WHEREAS , the maximum proposed to be expended by the Town of Ithaca for
the aforesaid improvement is $25 , 000. 00 . The proposed method of financing to be
employed by said Town of Ithaca consists of expenditure of current revenues and
surplus funds from the Town of Ithaca Water System Benefitted Area - 1997 -
Buttermilk Falls Area derived from revenues assessed against the properties which are
deemed benefitted by said improvement ; and
WHEREAS , it is now desired to call a public hearing for the purpose of
considering said plan , report and map and the establishment of said Town of Ithaca
Water System Benefitted Area - 1997 - Buttermilk Falls Area , and the providing of said

FOCUSING ON BOTANICAL RESOURCES

WHEREAS , the South Hill Swamp area within the Town of Ithaca has been
recognized for the last one hundred years to be an important botanical site harboring
rare plants ; and
WHEREAS , Tompkins County has designated the South Hill Swamp area a Unique
Natural Area , a status which carries no regulatory protection but serves to identify
areas with outstanding environmental qualities worthy of special attention for
preservation ; and
WHEREAS , the Town of Ithaca Planning Committee and Town of Ithaca
Conservation Board are considering appropriate protective measures for this area ; and
WHEREAS , the Town contracted with Nancy Ostman , Ph . D . and F. Robert Wesley,
Botanist to produce the December 1996 study entitled " Inventory South Hill Unique
Natural Area" , which describes the natural features and plant communities in this
special area ; and
WHEREAS , the aforementioned study has provided a strong foundation of
information about the natural features and plant communities in this special area which
will be extremely useful for determining appropriate land- use protection there , but
which , because the Town contracted this study in the late fall , could not adequately
survey populations of scarce plants , which would provide additional useful information
for the Town ; and
WHEREAS , Ms . Ostman and Mr. Wesley have, at the request of the Conservation
Board , submitted a proposal to complete a follow- up botanical study at a cost of
approximately $4 , 500 . 00 ; and
WHEREAS , the Town of Ithaca Conservation Board has voted to recommend
allocation of $ 1 , 000 from the 1997 Conservation Board Fund (Account # B8020 . 407)
towards the completion of this study, and has recommended that the Town Board
allocate an additional $3 , 500 from the 1997 Town of Ithaca Budget to complete this
study; and

amount not to exceed $4 , 500 in total to compensate Nancy Ostman and Robert Wesley

RESOLVED , the Town Board does hereby direct the Supervisor/Fiscal Officer to

WHEREAS , the Coddington Road Community Center, Inc . , (the "CRCC") and the
Town of Ithaca (the "Town ") have an agreement whereby CRCC will provide a summer
program for the general public at the CRCC facilities located at 920 Coddington Road ,
Ithaca , New York ; and
WHEREAS , the agreement provides for a stated level of compensation unless the
parties agree to differing amounts ; and
WHEREAS , the parties wish to set the amount for the 1997 CRCC 13th Annual
Summer Playground and Recreation Program ; now therefore be it
RESOLVED , that the governing Town Board of the Town of Ithaca does hereby
authorize the payment of $4 , 891 . 00 to the CRCC for the 1997 CRCC 13th Annual
Summer Playground and Recreation Program to be held July 7 , 1997 through August

necessary for appointment to this temporary intern position ; now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca authorizes the Director of
Planning to hire Benjamin Helber as a temporary summer Planning Intern , at an hourly
wage of $8. 00 based on a 37 1/2 hour work week , for a twelve ( 12 ) week period . The

for the acquisition of lands located in Inlet Valley from Tompkins County at a price not

Town Board Meeting
DEVELOPMENT REVIEW
Sanctuary Drive
Continued to monitor drainage and construction activity by the
developer to ensure compliance with the subdivision approval .
Ithaca College
Reviewed preliminary site plan submission for the proposed Ford Hall
additions and related parking lot improvements .
EARTH FILL PERMITS
Five Mile Drive , Immaculate Conception
Filling at the site has been limited to stockpiling of material from
utility excavations . The contractor plans to remove stockpiled material
as fill is needed on the project . Contractor has proposed to use fill site
for material removed from the Flood Control Channel as part of the
emergency rehabilitation project . Site may be used as a temporary storage
and dewatering site for dredged material . If proposed fill volumes exceed
original permit limits the contractor will apply for a permit modification .
The Town Engineer has been reviewing sediment and erosion control. plans
with the contractor . Final grading and site restoration is expected to
occur in the Fall of 1997 . Sediment control fencing is being maintained
around the fill area . The contractor has been keeping the roadway clean .
Ithaca Vol . Vets , Elmira Road
The Association received site plan approval from the Planning Board
on October 29 , 1996 for an enlarged parking area on the property with
additional fill to be placed . The Town Engineer is monitoring the project .
Had meeting with Contractor to review rough grades . Bulk of fill is in
place with more select fill to be placed for final top and grading .
Williams Glen Road
A fill permit for approximately 200 cubic yards of fill has been
issued for regrading a residential lot with imported material .
Final grading and seeding of the site will be completed when weather
permits .

STORMWATER
Development of the Townwide watershed evaluation is continuing . Base
maps are being developed utilizing the digital planimetric map , and field
survey work will begin when weather permits and continue through the summer
with utilization of student aids .
BENEFIT ASSESSMENT
The Townwide water and sewer benefit assessment review has been
completed and a list of changes has been prepared and has been filed with
the Tentative Roll in the Town Clerk ' s office .
The Benefit Assessment committee is evaluating the impact of the
current benefit assessment on large parcels and is considering options to
modify the assessment formula bases on current development potential .
The County digital tax parcel maps have been provided to the Town by
the County Assessment Office , and development of a database utilizing the
GIS is proceeding .
CAYUGA INLET REHABILITATION PROJECT BY US ARMY CORPS OF ENGINEERS
The Corps of Engineers is planning to repair Cayuga Inlet Flood
Control Channel from the State Street Bridge up to the drop structure and
fish ladder . Work is proposed to include removal of approximately 100 , 000
CY of sediment , placement of rock rip rap bank protection and removal of
gravel from the Coy Glen grade stabilization structures . A contractor has
apparently been selected for the first phase of channel stabilization and
the project was scheduled to begin in March . No work has been started to
date .

Highwa�f Superintendent ' s Report
Since April was relatively warmer and dryer than usual, we were able to start work on our
summer projects .
The Highway crews worked simultaneously on Eastern Heights Drive and Pennsylvania
Avenue/Kendall Avenue.
On Eastern Heights Drive we put in a manhole and approximately 80 feet of culvert pipe. This
work was necessitated by the heavy rains last year, which eroded the shoulder area away. The
crews worked 321 hours of time on this project .
To start preparing for paving both Pennsylvania Avenue and Kendall Avenue, the crews need to
change road crossing pipes, catch basins , and clean the ditches. This month the crews worked
606 hours on replacing the pipes on Pennsylvania Avenue. We are hoping to be able to pave by
the end of May or early June.
In April both Highway and Parks crews completed our semi-annual yard waste clean-up . To
accomplish this , we worked 542. 5 hours of time. This year there was a particularly large
amount of brush (from cleared lots) . This was discussed at the Public Works Committee
meeting, and we will be reviewing our policy and the advertisements.
During April, we worked 340 hours of time on vehicle maintenance . Again, this total includes
two people ' s time. We continue to work on repainting one of our older trucks, preparing snow
plow equipment for storage, and preparing equipment for use this summer.
The crews worked 223 hours of time on General Repairs . This includes hauling materials for
stock piling, maintenance around the Highway facility, and training on Chain Saw Safety.
Some of the Permanent Improvement projects this month include road sign work and lawn
repairs . This took 107 hours of time
We did work 290 . 5 hours on snow removal . We used 128 tons of salt . We plowed the fire
stations six times each and salted them eight times .
The Highway crews worked briefly on repairs to a sewer pump station. We also worked on
lawn repairs (due to water breaks) . This took 56 hours .
Barbara Blanchard, Tompkins County Board of Representatives, has been in contact with Ellen
Harrison . They had a discussion about the Warren Road capital project. The County is going
to have Warren Road on there 1998 Capital Improvement Project List and will be budgetting for
it . The Town of Itahca needs to decide whether we are going to particiapte in this capitla
project . The questions we need to review are:
• Do we want to participate?
• How does the sidewalk fit in our Transportation Plan?
• Do we have neighborhood support for this ?
May Highway Projects
1 . Prepare for and pave roads .
2 . Prepare for surface treating roads .
3 . Cleaning ditches.
4. Water and Sewer Maintenance Work
Park and Open Space Manager Report
Final snow removal efforts early in the month required 56. 5 hours of time.
Spring cleanups at all park and trail sites were completed; 58 hours were spent. The annual play
structure safety and maintenance inspections were begun, taking 16 hours thus far. These will be
completed early in May and follow-up repairs made as noted.
Shop projects , including preparation to install two overhead doors at the annex building, took
an additional 43 hours in April.
Lawn restoration work for the winter's water and sewer breaks, cleanup of snow plow damage,
and re-seeding of several highway projects took 134 hours.
Several planting jobs were started, requiring 10 hours. Parks will be doing several jobs for
Engineering during May.
Mowing was begun late in April using our new John Deere Model 932 Front Mower. Only six
hours were spent thus far.
Various routine maintenance tasks , taking 230 hours, completed our work effort for April .
May Park Projects
1 . Continue park and trail mowing.
2. Install plantings at Pine Tree Road Master Meter Building, Hanshaw Road and Forest Home
Sewer monitoring stations, and several other sites .
3 . Finish lawn restoration.
4 . Install map display stands at South Hill Trail entrances .

Planning Director' s Report for May 12 , 1997 Town Board Meeting
DEVELOPMENT REVIEW
The following are actions that were considered by the Planning Board.
Montessori School Annex, 117 East King Road
The Planning Board granted Final Site Plan Approval at the April 15, 1997
meeting for the proposed conversion of a single-family house and garage into
a two-classroom school facility to accommodate up to 20 students, along with
the construction of a new driveway, bus unloading area, parking spaces, and
walkways, located at 117 East King Road, directly opposite the existing
Montessori School, Residence District R- 15 .
Tower Road Reconstruction, Cornell University
The Planning Board granted Preliminary and Final Site Plan Approval and
issued a recommendation regarding Special Approval to the Zoning Board of
Appeals at the April 15, 1997 meeting for the proposed reconstruction of 1 ,450
+ / - linear feet of Tower Road between Judd Falls Road and Campus Road on
the Cornell University campus, including the addition of bicycle lanes, two bus
pullouts, addition of new catch basins, reconfiguration of curb cuts, and new
landscape plantings, Residence District R-30 .
Temporary Classroom Building, Occupational Therapy, Ithaca College
The Planning Board granted Preliminary and Final Site Plan Approval and
issued a recommendation regarding Special Approval to the Zoning Board of
Appeals for the proposed placement of a 10, 170 + / - square foot temporary
classroom structure for the Occupational Therapy program on the Ithaca
College campus on an existing athletic field, Residence District R-151
Ford Hall Addition and Expansion of J and M Parking Lots, Ithaca College
The Planning Board began consideration of Preliminary Site Plan Approval
and a recommendation regarding Special Approval to the Zoning Board of
Appeals at the April 15, 1997 meeting for 1 ) a proposed 55, 000 + / - square foot
addition to Ford Hall to house additional classrooms, practice studios,
rehearsal rooms, a 250 + / - seat recital hall, and other facilities for the Ithaca
College School of Music; 2) a proposed expansion of the existing "J Lot"
parking lot from 160 spaces to 354 spaces; and 3) a proposed expansion of the
existing "M Lot" parking lot from 198 spaces to 230 spaces, located on the
Ithaca College campus, Residence District R-15. The public hearing was
postponed until the May 6, 1997 meeting in order to obtain additional
information and application materials .
CURRENT PLANNING DEPARTMENT PROJECTS
The following are significant accomplishments or issues that have been dealt with
over the past month .
SEAR Reviews for Zoning Board : Three SEQR reviews for the Zoning Board were
completed: (1 ) request for approval to build a 936 square foot addition onto an
existing nonconforming house, 210 DuBois Road, Residence District R-30 (Robert and
Leilani Wheeler); (2) request for a variance to maintain a 16 foot wide by 12 foot high
plywood wall in the front yard of a single-family residence, 327 Winthrop Drive,
Residence District R-15 (Norma Schwab); and (3) request for Special Approval to
convert an existing residence into a private school building, 117 East King Road,
Residence District R-15 (Montessori School) .
Codes and Ordinances Committee: The Committee is hoping to complete review of
the draft of the revised zoning districts at their May 7, 1997 meeting in order to get
the draft in shape to distribute to other boards and committees for review and
comment. An Executive Summary of the recommended zoning changes has also
been prepared.
Planning Committee: The Planning Committee met on April 14, 1997, and is
considering inviting farmers and agricultural interest groups to a public meeting to
obtain input on possible measures to preserve important farmland and encourage
farming within the Town. A date has not been determined . A first step will involve
inviting several experts in the local agricultural sector to a Planning Committee
meeting for a strategy session.
Park , Recreation and Open Space Plan Update : After the Town Board accepted the
draft of the Park, Recreation and Open Space Plan at the April 7, 1997 meeting for
public review, 230 copies of the draft plan were printed, a distribution list was
created, and copies of the Plan are in the process of being distributed to boards and
committees of the town, neighborhood groups, other interest groups, state, regional
and federal agencies, neighboring municipalities, etc. A schedule and arrangements
for public information meetings will soon be organized (as a start, one meeting on
each of South Hill, East Hill and West Hill) .
Town of Ithaca - Cornell University Transportation Committee: The Committee met
on April 14, 1997 to discuss the update of the Cornell Plantations Master Plan, the
temporary closing of the East Ithaca Recreationway this summer for construction, the

status of Northeast Subarea Study consultant selection, City /Town bike plan
coordination, and possible connections to the East Ithaca Recreationway. The
Committee met again on May 5, 1997 to hear a presentation of the City' s draft Bicycle
Plan by Jon Meigs, and had further discussion regarding possible connections to the
East Ithaca Recreationway. In addition, State DOT has responded to the Town's
inquiries regarding traffic signals on Route 366, and has determined that a three-color
traffic signal at the Rt. 366 / Caldwell Road / Palm Road intersection is warranted and
will be installed by the State in the 1998 construction season (see attached letter from
DOT dated 4/ 14/ 97) .
Northeast Subarea Study: The selection committee has interviewed four consultant
teams, and held a follow-up meeting to discuss selection. Two preferred consultants
have been agreed upon by the committee (a public participation module consultant
and a technical module consultant that did not submit their proposals as a team) .
The committee has authorized staff to negotiate with those consultants to see whether
this "new" team could revise their proposal scopes to fit within the project budget. A
report will be given to the MPO Policy Committee at the May 20th meeting.
Black Diamond Trail : The Supervisor and staff had a follow-up meeting with
representatives of State Parks and the City of Ithaca to discuss the planning of the
proposed Black Diamond Trail that would connect Taughannock Falls State Park in
Ulysses with Alan H. Treman State Marine Park in the City of Ithaca and Buttermilk
Falls and Robert H. Treman State Parks in the Town of Ithaca. A field trip will be
scheduled soon to look at specific alignments in the Inlet Valley area .
Representatives from the State may come to a future Town Board meeting to provide
an update on the status of the project.
Cornell-Community Waste Management Advisory Committee : Staff continues to
attend meetings as alternate and technical support to town representatives . Recent
meetings have focused on working group reports (e. g. , treatment and disposal
options, criteria for evaluation of options, information and education, etc. ), as well as
several presentations given by experts in the fields of waste management and
minimization.
Personnel: Starr Hays has resigned from her position as Senior Typist for Planning
and Engineering to take a new position. Interviews of potential candidates to fill that
position (from the civil service list) have been completed (refer to consent agenda
item no . 23h) .
GIS: Most staff and all department heads have received basic orientation and / or
training on the ArcView GIS program.
Development Review Accounting: Coordination between Planning and Accounting
regarding the development review accounts continues . Attached is the cumulative
list of 1997 projects with respective processing fees and review fees that have been
received by the town.

Cornell University Lake Source Cooling Project - Draft EIS: Staff reviewed the Draft
Environmental Impact Statement (DEIS) for Comell' s proposed Lake Source Cooling
Project, and prepared and sent comments to the NYS Department of Environmental
Conservation regarding completeness of the DEIS (refer to Correspondence - Agenda
Item No. 8a) .
Chase Lane Walkway (Public Works Committee): At the request of the Public Works
Committee, staff conducted research and prepared a summary report (4/ 18 / 97)
regarding the maintenance responsibilities of the walkway in the Chase Lane right-of-
way. (The previous record of maintenance responsibilities was unclear. ) Research of
Planning Board and Town Board resolutions, declaration of restrictions, deeds of
adjacent lots, and the Town's Sidewalk Ordinance (8 /24 /92) indicates that it appears
to be the responsibility of each lot owner adjoining the walkway to maintain, repair,
and if necessary, replace the walkway.

Re : Route 366 at Judd Falls Road,
Tower Road. and Caldwell Road
Thank you for your March 3 follow-up letter regarding the subject section of Route 366 near
Cornell University .
After reviewing the data collected in our recent studies and the contents of your letter, we have
determined that we do need to install a three-color traffic signal at the Route 366/Caldw-ell
Road/Palm Road intersection. We will arrange to have this signal installed by a contractor in the
1998 construction season.
We have also determined that it would not be appropriate to install temporary or permanent
signals at Judd Falls Road south or Tower Road until Judd Falls Road north is closed off. Our
experience indicates that a three -color signal will not work at Judd Falls Road south, unless there
is a proper length left turn lane provided for the Route 366 westbound traffic and this is not
possible if Judd Falls Road north is left open. The current accident history at Tower Road does
not justify a traffic signal at this time. but we still would be willing to install one if Judd Falls
Road north could be closed off.
Our previous reviews of the speed limits on Route 366 in this area indicate that the current limits
are the most appropriate , but that could change after the signal is installed at Caldwell Road . We
will do new speed limit studies at that time .
We would be pleased to assist in any studies you want to conduct but we cannot install
temporary traffic signals just for the benefit of a srud%

Monthly Report - Presented May 12 , 1997
Town Clerk: Betty Poole and Mary Saxton , Deputy Town Clerk's attended a one day
seminar at the Chenango Town Hall hosted by the New York State Department of
Environmental Conservation . The seminar included information regarding license
sales and/or changes which will be occurring for the ensuing years .
Records Management : Staff has begun reorganizing and filing items found within the
accounting office for reference and quick retrieval . As records are sorted and
reclassified they are added to the archival vault for preparation of the annual inventory.
Records in the archival vault will be scrutinized , during the inventory process , to
choose those which are best suited for preservation and restoration by the Town .
Those which are of a valuable historical nature can be considered for donation to the
DeWitt Historical Society,
The Town Clerk met with the SARA Region 6 Representative , Suzanne Etherington to
discuss establishment of policies and procedures for electronic records, Internet usage ,
and microfilming . Drafts of the policies and procedures for these items will be written
�- and presented to the Information Technology Committee and the Records Management
Advisory Board within the next several weeks .
The Records Management Advisory Board will need to consider recommended
procedures of indexing as it relates to reference retrieval on computers . The Freedom
of Information Law will need to be reviewed to determine what can and cannot be
provided on a local government web page .

Human Resources Monthly Report for April 1997
Personnel :
Had exit interview with Starr Hays , Senior Typist , Planning
and Engineering . Received Eligible listing from Tompkins County .
Civil Service for a Senior Typist . Mailed out canvas letters to
all those eligible and followed up with phone calls . I have
scheduled interviews for May 1st and 2nd , with the 5 interested
candidates , Jonathan Kanter , Daniel Walker , Mary Bryant , and I .
Erik Whitney and I have been interviewing students for the summer
Engineering work study program .
All Town Hall employees attended the mandatory staff meeting
conducted by Supervisor Valentino , April 30 , 1997 .
Records Management :
Have been reviewing files in the file cabinets in the Human
Resources Office and in the Check Book Room . Any information
that requires disposing of , has been dated and box for proper
disposition .
Deferred Compensation :
Mailed out 7 packets of Proposal specifications to companies
that requested them . Have received back proposals from most of
the companies . Sealed proposals are dated to be opened May 1 ,
1997 .
Personnel Committee Meeting April 15 1997 •
Approved the March 18 , 1997 committee minutes ( see attached
copy . ) Continued discussion on dress code policy . Cathy and I
are to draft an " Appearance Policy " . Continued reviewing and
editing the General Information section of the manual . I .passed
out to the Committee members a new draft copy of the working copy
of the Personnel Manual . This updated copy has the date printed
at the end of each section , which corresponds to the date inwhich
the committee approved of that section . Hopefully , this will
help the committee keep on track with what they have approved and
what they still need to review and edit .
There have been some new sections added to the manual that
are not in the current personnel manual . Some of those new
sections include ; Appearance Policy , Employee Assistance and
Ombuds Service , Americans with Disability Act , Time Cards , Meal.
Periods , Break Periods , and Attendance at Town Sponsored
Functions . The committee also has decided to add an exhibit
section at the end of the manual with copies of different forms
mentioned in the body of the manual , i . e . , a time card ,
disability forms , time off request form
Sent the committee approved Vacation accrual and carryover
schedule to the April Town Board Meeting for approval . This
section will be effective immediately for new hires and will be
effective January 1 , 1998 for existing employees .
Payroll :
After consulting with Accounting , it has been decided to
accept the Williamson Law Book Company ' s Payroll program . I have
been working with John Polee and Sharon Stratakos in developing
the program to our specifications . I have manually input the
first quarter ' s payroll into the new system to compare the data
to DataRite of Central , NY . Will continue to input payroll
manually in both systems as we work out some of the details .
Al Carvill and I reviewed a demonstration by the Tompkins
County Trust Company , on a product called the Commercial Access
System . This system would allow us to offer direct deposit
through an automatic clearing house and would allow us to
electronically submit our Federal Withholding Taxes , ( which we
are required to do . ) This system would also be beneficial to
accounting in that they could check account balances and do
transfers from one account to another .
Human Resources Office :
Have contracted with the Healthy Heart Program to offer a
blood pressure screening clinic in May . Have contacted the
Wellness committee for the County , in hopes to work together on
some health and wellness programs for the Town employees . I
attended ` a luncheon seminar April 10 1997 , on NYS and Federal
Labor Laws , put on by the Human Resources Association of Tompkins
County . Sent memo out to employees detailing the difference
between ' Civil Service classifications and Fair Labor Standards
Act classifications , ( see attached memo . )
Completed daily functions of the office including ;
administering payroll , managing Insurance Policies , working with
Worker ' s Compensation claims , meeting all Civil Service
requirements and requests and all request by the Town of Ithaca
employees .

Call to Order . 8 : 10 a . m .
Agenda Item # 2 • Approval of February 25 , 1997 minutes .
Mrs . Poole asked for clarification on vacation allotment and when
those getting their 3rd week would get it . Supervisor Valentino
clarified that all allotments will be given January 1st of each
new year .
Mrs . Drake clarified that the vacation section was completed and
would be added to the April 7 , 1997 Town Board Agenda for their
final approval . Supervisor Valentino moved to have February
minutes approved and Mrs . Poole seconded .
Agenda Item # 3 : to be addressed later .
Agenda Item # 4 • Introduction of Camille Tischler from the
Community Dispute Resolution Center .
Supervisor Valentino introduced Camille Tischler , the
Ombudsperson for the Town of Ithaca , from the Community Dispute
Resolution Center ( CDRC ) . Ms . Tischler will be coming around to
meet with everyone and have a meeting with the Department Heads .
She would like to take this opportunity to get to know the
employees so that they will feel more comfortable when they wish
to meet with her . Supervisor Valentino suggested doing a write up
about the CDRC and Ms . Tischler to be provided to the staff .
Agenda Item # 3 : Staff to be . heard i
Mr . Whitney had concerns about the dress code policy that would
be gone into further in Item number 7 . He wished to go on the
record with a number of questions that the Town should answer
before deciding to have a dress code policy or not . Those
questions are :
1 ) The Town would need to evaluate what benefits we would
realize by insisting on an employee dress code and what
liabilities would be incurred by the • Town by having an
employee dress code .
2 ) Will a dress code ( sooner or later ) be abused by an over
zealous manager as a tool for harassment or intimidation ?
3 ) Will the dress code necessitate expensive legal action ?
4 ) Do the potential benefits out weigh the potential
liabilities ?
5 ) What elements of the dress code could be legally
enforced ?
6 ) Should only legally enforceable elements be incorporated
into a dress code ?
7 ) Can employees afford a new wardrobe required by a dress
Code ?
8 ) Will the dress code simply boil down to a listing of
someone ' s personal preferences ?
9 ) Who should the dress code apply to ?
All employees ? Elected and appointed officials ?
Vendors ? Contractors ? Consultants ? Town Residents ?
Constituents ?
Mr . Whitney described a time when a person in his office
mentioned another person ' s inappropriate dress .
Supervisor Valentino can ' t answer all the questions Mr . Whitney
addressed except that the dress code would only apply to those
people hired by the Town of Ithaca , if the Town chooses to have
one . Mr . Whitney mentioned that the only dress code he is aware
of is the one enforced by OSHA , i . e . , boots , gloves , long pants .
Then there is the informal rumor of a no jeans policy . Supervisor
Valentino mentioned that there isn ' t a written policy on that at
this time . Mr . Whitney would be willing to provide the committee
with a written copy of his proposed questions .
Supervisor Valentino stated that there has been comments from the
public that have come in from time to time but that ' s not really
the major issue on a dress code . There are extenuating
circumstances that have happened that is causing us to consider a
dress code . Mr . Whitney is concerned about the dress code causing
more internal quarrels .
Supervisor Valentino summarized the discussion in that the Town
is interested in establishing a minimal standard that goes beyond
the norm limits of what would be appropriate in the work place .
It would not be getting down to a uniform , but a policy to deal
with the extremes . And again the extremes are a personal
preference , but maybe there are some minimal standards that can
be established .

Agenda Item # 5 : Discussion of Personnel manual with Ms . Tischler ,
Supervisor Valentino asked Ms . Tischler for her comments about
our policies such as Sexual Harassment Policy , Discipline and
Discharge Policy and our Grievance Procedure .
Ms . Tischler mentioned that she thought the procedures weren ' t
specific enough . It seems that the steps a person needs to go
through in order to complete a grievance should be spelled out
more specifically .
Ms . Tischler made some suggestions in wording changes in the
following sections :
Employee Assistance Program . The need to add a contact person and
telephone number after CDRC or contact the Human Resource office .
Supervisor Valentino stated that basically it is just a referral
program , not a funding assistance program . The possibility of
changing name since we don ' t provide funding . A possible name
would be " Employee Referral Program " since that is what the Human
Resources office would be doing .
Drug and Alcohol Testing Policy and Procedures . Add an exhibit at
the end of the Manual listing drugs defined on Schedule I so
employees know exactly what the policy is referring to .
Under the Appeal Procedure :
Clarify what the actions are that the Town is required to take
under federal law or regulation when it pertains to a
disciplinary action .
Supervisor Valentino suggested putting this Drug and Alcohol
Testing Policy and Procedures as an exhibit at the end of the
Manual since it is not specifically our policy but is a policy
required by the U . S . Department of Transportation .
Grievance Procedure
Supervisor Valentino explained that this procedure is used
when an employee feels that they are not being treated fairly or
in compliance with the Manual . Our understanding is that we need
to have a procedure in effect that works in conjunction with
Section 75 of Civil Service laws . Section 75 regulates how
municipalities can deal with an employee , so that they don ' t fire
an employee without cause or opportunity for . a hearing .
Ms . Tischler suggested putting in examples when an employee would
go to the Ombudsperson , instead of the Town Supervisor . Or leave
the determination of where an employee goes first up to the
employee .
Supervisor Valentino suggested that step 3 should be arbitration
and not taken to the Personnel Committee , since we are such a
small organization .
We realize this section needs to be reworked taking into
consideration Civil Service laws and who is covered by that .
Supervisor Valentino would like to do some workshops for
employees . An example workshop would be on Sexual Harassment .
Disciplinary Policy
Ms . Tischler suggested explaining how this works with the
Grievance Procedure .
Mrs . Drake suggested putting this section in front of the
Grievance Procedure section .
Agenda Item 6 : Review corrected draft copies
This was the final discussion of the following topics before
encompassing them into the Working Copy ,
Sexual Harassment Policy :
Ms . Tischler stated that we need to add some wording that
describes what the Community Dispute Resolution Center is .
Therefore employees will know what they are being referred to .
Mrs . Poole suggested using descriptions given in the Human
Service Resource Directory . Mrs . Drake suggested doing one
section on the CDRC since it will be referred to in the Manual in
many places . If we put in a section in the beginning of the
Manual , i . e . after the Fair Employment Practices " section , that
described the Ombuds program . Then in the pertinent sections in
the Manual , we could refer employees back to that page for the
description , name , telephone number etc .
Ms . Tischler also suggested wording for two policies .
1 ) One for the offended . 2 ) One for the offender . She will send
Mrs . Drake some examples of such policies .
Employee Assistance Program - discussed changes earlier -
approved .
Drua and Alcohol Program - discussed , added a few new lines -
approved .
Hours of Work - discussed what we changed - approved .
Probationary Period - added wording for promotional employees -
approved .
Driving Record - Mrs . Drake discussed what Jeff Farmer from
Sprague Insurance told her about employee ' s driving records . She
explained it doesn ' t effect our policy premiums , but is checked
so that the Town Board know whether they have an employee driving
a Town vehicle that ( do to their past driving record ) could be a
liability to the Town . It is an awareness procedure only , not a
premium reducing procedure .
Mr . Tenkate wanted to clarify how strict the Town would be on the
" any history of a moving violation " line . He expressed concern
that if he gets a speeding ticket now , will he be dismissed ?
Decision was made to add a new paragraph with the wording " Or any
moving violations that could result in the loss of the required
N . Y . S . drivers license " .
Mr . Kauffman asked about a yearly check of Drivers License . Mrs .
Lent - Noteboom stated we should trust our employees . Mrs . Drake
will check with Sprague Insurance if they will charge us if we
ask for a yearly report on all of our drivers . Mrs . Drake
suggested checking licenses with the June evaluation process .
That would give the Department Head the chance to completely
review the employee .
Part - time Employees - take out " jury duty " because we have to let
them go by law , but we have discretion to pay them while they are
on jury duty . We will discuss more when we discuss the Jury Duty
section . The intention isn ' t to have people get an advantaged or
disadvantaged by serving jury duty .

since everyone will have their own opinion . That is why there
usually is no dress code or a very stringent dress code .
Ms . Tischler asked to get to what everyone ' s real concern is .
Mr . Whitney expressed his concern is that the dress code policy
will become a management harassment tool and will be applied
unevenly . Also concerned about employees pointing fingers at each
other which will create poor employee morale .
Supervisor Valentino wants employees to look presentable , but
also appropriate for the position . She would expect employees to
use their common sense . As far as the no jeans policy , there is
no written policy in effect . Supervisor Valentino does like the
people out in the field i . e . highway employees , wearing uniforms
that specify who they are and that they work for the Town of
Ithaca .
Mr . Kanter asked about identification cards for employees so
that , when out in the field , they have identification with them
that states they are a Town of Ithaca employee . Building and
Zoning employees have these , but are issued by the Tompkins
County Sheriffs Department .
Mrs . Lent - Noteboom gave the suggestion for a dress down day and
the rest of the days , dress in a professional manner .
Mr . Kanter responded that the Town does need some type of policy
saying this is how we expect employees to present themselves and (.
to give some standards .
Mrs . Drake expressed that the Town needs to have some standards
or there is no grounds for a discipline procedure .
Supervisor Valentino would like some guidelines in the Manual for
all Town employees to use that would take into consideration the
kinds of jobs they do . She explained that image is important
because we are in the public eye , but also that doing a good job
is very important too !

Re : Differences between Civil Service and FLSA
During discussion at the personnel committee meeting in February , .
there was a request for a memo detailing the difference between a
person whom is exempt from Civil Service Law and a person whom is
exempt from the Fair Labor Standards Act of 1938 . These are two
different governing factors that regulate the public sector .
CIVIL SERVICE LAW :
Civil Service regulates all positions who receive pay for
services from the state or a municipal government . This law is
to provide regulations against municipalities terminating a
protected employee without a Notice of Intention to Dismiss .
Section 41 under Civil Service Law defines the Exempt Class .
This class is in the Classified service section of Civil Service ,
which also includes non - competitive , competitive and the labor
class . The Exempt class describes positions which it has been
deemed impracticable to fill by a test of any kind . Exempt
appointments are " at will " of the appointing authority and the
incumbent has no Civil Service status or protection under Civil
Service Law section 75 .
Section 75 doesn ` t allow a person to be removed or subjected
to any disciplinary penalty provided in this section except for
incompetency or misconduct shown after a hearing upon stated
charges pursuant to this section .
Please refer to the attached Town. of Ithaca Civil Service
Classification Listing , for placement of titles in the Civil
Service catagories .
FAIR LABOR STANDARDS ACT OF 1938 :
The Fair Labor Standards Act ( FLSA ) provides protection to
employees on such topics as minimum wage , maximum hours ( over
time and compensatory time ) and child labor . However , not all
employees of state and local government are affected by the FLSA .
There are some employees who are simply not covered ( i . e . , non -
covered ) and then there are those covered by the FLSA , but are
exempted by specific provisions of the act ( i . e . , exempt ) . The
only difference between non - covered employees and exempt
employees is that exempt employees are still covered by the FLSA
record keeping requirements but both are not eligible for minimum
wage and maximum hours regulations .
" Section 3 ( e ) ( 2 ) ( C ) of the Act excludes from the definition
of " employee " , and thus from coverage , certain individuals
employed by public agencies . This exclusion applies to elected
public officials , their immediate advisors , and certain
individuals when they appoint or select to serve in various
capacities . "

1 . All elected officials ( i . e . , Town Supervisor and Town
Board )
2 . Political Appointees ( i . e . , Town Clerk and Highway
Superintendent )
3 . Legal Advisors ( i . e . , Town Attorney )
In the Town of Ithaca the following titles are under the
EXEMPT listing .
1 . Salaried employees who meet standards of Administrative ,
Professional or Executive ( i . e . , Director of Planning , Director
of Engineering , Director of Building and Zoning and Al Carvill -
Accounting )
All hourly employees of the Town would be categorized under
nonexempt and would have full rights and protection under the
FLSA . Please see Figure 120 - A for examples of the FLSA .
I am in hopes that this will clarify some of the confusion about
the difference of these two laws . Both the Civil Service Laws
and the Fair Labor Standards Act are very complicated policies
that can be interpreted differently . If you wish to reference
any of the described material please do not hesitate to contact

FINANCIAL REPORT
Presented : Town Board Meeting 5/ 12/97
SALES TAX REVENUE :
First quarter 1997 sales tax revenue monies have been received in the amount of
$464 , 809 . 39 , (see attached) .
AUDIT FINDING :
During the 1996 Audit of Financial Records it was uncovered that approximately
$ 113 , 000 of the third quarter 1996 sewer use charges for Cornell University were not
billed . Accounting personnel investigated all other sewer billings for 1996 . This review
disclosed that Cornell University was not charged for the third quarter 1996 , and the
first quarter 1997 sewer charges . Total charges were approximately $315 , 000 . As of
May 9 , 1997 , all prior and current quarterly charges have been billed and received .
1996 AUDITED FINANCIAL :
The 1996 Audit of Financial Records is complete . The Supervisor and Accountant
have had a final exit meeting with the independent auditors . The audit was conducted
in a timely and efficient manner. The findings disclosed nothing which was not
anticipated . The financial footnotes are directed towards improvements . The official
statements will be available before the Town Board meeting in June .
INVESTED FUNDS :
As of April 30 , 1997 the Town of Ithaca has approximately $5 . 8 million invested in
Certificates of Deposit . All invested and uninvested funds are adequately collateralized
($ 8 . 4 million) . Total cash is approximately $ 6 . 5 million , (including certificates) .
Idle funds have been invested at timed maturities to meet payrolls , abstracts , and other
contracted obligations . Funds have been laddered at short term interest rates in
anticipation of the Federal Reserve raising short term interest rates in the second half
of 1997 . The increase in interest rates should be regarded as temporary. Should this
increase occur the Town will be able to take advantage of the rates . Year to date
interest income for 1997 totals approximately S103 , 900 , with an additional $71 , 500
generated from current outstanding certificates . Uninvested monies are on deposit in
interest bearing money market accounts . These liquid funds are deemed to be
adequate to meet a reasonable unexpected expenditure .
CASH ACCOUNTS •
All savings and checking accounts , except the Trust & Agency Fund , are balanced and
reconciled monthly. Effective May 1 , 1997, the Town will begin using a single
consolidated disbursements checking account. This account will be maintained to
handle the disbursements for all expenditures. A consolidated payroll checking
account is maintained exclusively for payroll disbursing purposes . The existing multiple
checking accounts , about ten of them , are targeted to be closed by the end of June, if
not sooner. Segregated money market savings accounts are being maintained in each
operating fund . The practice of co-mingling cash has been discontinued .
The Town Board and Department Heads are to be commended. Great strides in
budgetary oversight , coupled with effective spending , continue to improve the town' s
fiscal management.
