TOWN BOARD MEETING
FEBRUARY 10 , 1997

At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County , New York held
at the Town Hall , 126 East Seneca Street , Ithaca , New York , there were present ,

CALL TO ORDER : Supervisor Valentino called the meeting to order at 5 : 32 p . m . , and led the
assemblage in the Pledge of Allegiance .

Councilwoman Harrison we When the Deer Run subdivision was constructed , did they devote land for
a park?
Mr . Kanter - "Yes . "
Councilwoman Harrison - What is the status of that park?
Mr . Kanter - There is a four acre park located within that subdivision .
Councilwoman Russell - The Transportation Committee ' s report mentions what is being proposed for
the closing of Judd Falls Road . Has this been analyzed as to whether it will put more traffic onto
Caldwell Road ?

Councilwoman Harrison - "Yes . " The Committee wondered whether there was a reason to close that
segment of the road . The Committee said there were reasons that make sense . However , it would
only make sense if the Town did significant traffic counts at critical locations including Caldwell Road
and other roads to see what the impact would be . Would the Town be willing to consider the closing
of this section of Judd . Falls Road ?
Councilman Conley - What section of Judd Falls Road would be closed ?
Councilwoman Harrison - Route 366 west to east , and Judd Falls Road from Forest Home going
south. The Department of Transportation suggested they would like the Town to consider closing the
section that goes north from Route 366 to Tower Road because of safety at the intersection . The four-
way stop was analyzed for the number of traffic accidents . They have decreased , the numbers are
still high enough that the Department of Transportation is concerned . The Department of
Transportation feels they cannot put a traffic light at the Judd Falls Road intersection unless that
segment was closed. Cornell is proposing to reconstruct Tower Road for a bike lane and bus pull out
with the curve being softened with new pavement . They also mentioned a road connecting Caldwell
Road and Tower Road through the parking lot .
Councilwoman Russell - Would these things be dependent upon closing that section ?
Councilwoman Harrison - " No . " Cornell owns Tower Road , so they will be doing the reconstruction .
They are planning to start this spring or summer . The Committee suggested testing the closing afte
the reconstruction is done . The stream bridge in Forest Home is due for reconstruction . It is unclear
if they will be closing this section during reconstruction or whether traffic will continue . The Committee
asked the Department of Transportation to look at Caldwell Road . They agreed to put more signs on
Route 366 to indicate Caldwell Road is there . There have been bicycle accidents on Caldwell Road ,
so the Department of Transportation will put signs in the area . If and when a test is done , there may
be a need to install traffic lights where they might be needed .
Councilwoman Russell - Are you also gathering accident data for Caldwell Road , as opposed to the
intersection ?
Councilwoman Harrison - " No . "
Mr . Noteboom - There have been a few accidents on Caldwell Road . We were going to rebuild
Caldwell Road this year , but now only maintenance work will be done . We will be doing Caldwell
Road in conjunction with Cornell ' s working on their parking lot next year .
Councilwoman Harrison - There is no reason why the committee could not request that information
as well . The committee discussed doing a coordinated traffic count with the Department of
Transportation and Cornell University while the road is closed .
Mr . Kanter - The Town has access to that data from the Highway Department .

Supervisor Valentino - The Transportation Committee has been looking into all the issues and
gathering information . When things are in place this Board will get a report on what the traffic flows
are and what the impacts would be in that area .
Councilwoman Russell - It would be valuable to have the information , but I am concerned that the
short term will create a bad situation on Caldwell Road .
Councilwoman Harrison - That is the information the committee will be gathering . The Committee
discussed the need to develop objective criteria for whether or not the pilot is successful . It would
need to be decided, after testing , if this would increase traffic on Caldwell Road or not . The Committee
would need to see what the numbers are .
Councilwoman Grigorov - Would this include Cornell ?
Councilwoman Harrison - "Yes . " The Transportation Committee includes people from Cornell
University, Forest Home , Pine Tree Road , and the Town of Ithaca . The Department of Transportation
are the only people who have a strong point of view on this .
Supervisor Valentino - What is the pleasure of this Board in assisting the Transportation Committee?
Councilman Conley - Councilwoman Harrison is doing a great job with the Committee , and her
concerns are the concerns of the Town .
Councilwoman Russell - What is the main concern , to close this section with a traffic light ?
Mr. Noteboom - The main concern is the intersection at the base of the hill . Coming down Route 366
cars are stopping to make the turn , but they cannot make the turn with cars coming in the opposite
direction .
Supervisor Valentino - If closing this section on a trial basis turns out to be a disaster , would there be
something that could terminate the closing .
Councilwoman Harrison - When further information is available I will bring it back to the Town Board
for further review.
Mr. Kanter - A newsletter will be completed soon announcing some of the spring projects that will be
going on . The Town Board should be thinking about possible articles and announcements for the
newsletter. The due date for articles is February 28 , 1997 . We would like to mail the newsletters to
residents in time to announce the spring brush and leaf pick up that is scheduled for April 14 , 1997 ,

Mr. Frost - AmeetingwithJack Melba (Tompkins County Fire Coordinator) and Bill Mobbs (Tompkins
County Highway Superintendent ) , determined in the Town is free to change road names even though
Judd Falls Road is a County road . There is nothing they are aware of legally in regards to changing
the name of a road .
Jack Miller would like the Town Board to make a resolution regarding the 911 System because he
needs to update the telephone company .
Supervisor Valentino - The Town received letters from the owners of Coyote Loco and the Courtside
Racquet Club about their concerns about renaming the road .
Mr. Frost - Their suggestions were to change Pine Tree Road to Judd Falls Road . They made a point
that they were taxpayers , but so are the residential property taxpayers .
Supervisor Valentino - When do they expect to have 911 in place ?
Mr. Frost - This summer . The NYNEX update is the only thing remaining in the Town .
Supervisor Valentino - The 911 System and renaming of the roads ( Judd Falls Road/ Pine Tree Road)
will be added to the Agenda for March . This Board will be supplied with a copy of the letters prior to
the discussion .
A. Director of Engineering - See attached .
Mr. Walker - The Joint Water Planning Committee has submitted a pre-application to the Department
of Health for consideration of funding under the New York State Environmental Bond Act . The entire
application packet was not detailed by the consultants . There is a map and a list of projects showing
the different locations . There has been no formal commitment of the governing bodies to proceed with
these projects . These projects are possible through the Regional Water Study.
Supervisor Valentino - The Town asked them to consider one or several of these projects for funding .
Mr . Walker - Letters were sent to Assemblyman Luster and Senator Seward signed by various
municipal leaders expressing their desire to have their support in pushing this through the State
legislature .

Councilwoman Russell - What does the zero , under the "total warrant balance due" mean on your
monthly report?
Mrs . Noteboom - It means the full amount of the warrant for the Town has been collected .

Councilwoman Russell - Does that mean everyone paid on time?
Mrs . Noteboom - " No . "
Attorney Barney - The warrant permits the Town to collect Town and County taxes . The law states that
the money that comes in first can be applied to the Town taxes . The Town ' s warrant is paid first , and
whatever bills that are unpaid get turned over to the County with a record of what has been paid .
Mrs. Noteboom - There is a typographical error on the Town Clerk's Monthly Report , The Total Town
Revenues to Supervisor should read $493 . 11 instead of $428 . 02 , ( amount for SPCA Contract ) . Staff
collected 4,429 tax bills as of January 31 , 1997 , which is about 86 percent of the total tax bills mailed .
The Town collected $618 . 52 in interest on the Receiver' s checking account for January .
AGENDA ITEM NO . 9 - PERSONS TO BE HEARD :
Doria Higgins , Citizens to Save the Parks - At the last meeting someone mentioned studying the Final
Master Plan regarding the Festival Lands to decide whether the transfer would take a lot of work and
time . I would like to remind this Board that we are not asking you to comment on the Final Master
Plan, but to urge the City not to transfer the Festival Lands for a new road that is not necessary. I have
been sick and instead of walling in the park , I drove and cruised the park . That is what the State Park
Officials want to stop people from doing .
Mr. Kanter researched and gathered comments from Tays VanCourt which stated , "The City' s Director
of Planning did confirm that both the State and the City are interested in a future transfer of the Festival
Lands to the State. A mutually acceptable agreement can be worked out . " (AMENDMENT CHANGE
- TB MTG. 3/10/97 - RESOL. NO. 57 (A) : Mrs . Higgins indicated that Mr. Kanter researched and
gathered comments from Thys VanCourt which stated, " The City' s Director of Planning did
confirm that both the State and the City are interested in a future transfer of the Festival Lands
to the State, if a mutually acceptable agreement can be worked out". ) This is not the most
decidedly accurate statement , but it is one that many people have made . (AMENDMENT CHANGE
- TB MTG . 3/10/97 - RESOL . NO . 57 (A) : Mrs. Higgins indicated that this is not the most
decidedly accurate statement, but it is one that many people have made . ) On January 2 , 1990 ,
Common Council unanimously wrote in a resolution , " resolved , that the Common Council confirms
that they have not made a prior commitment to transfer the Festival Lands to the State of New York . "
Mr . VanCourt to imply otherwise is not accurate .
Mr. Kanter also stated "that the City is not an involved agency . " The lawyer at Albany DEC who deals
with SEQR procedures and whose job it is to decide who is an involved agency (AMENDMENT
CHANGE - TB MTG . 3/10/97 - RESOL . NO . 57 (A) : Ms. Higgins referred to Mr. Kanter' s
statement in the Planning Department' s report, which indicated that Mr. VanCourt had stated,
"that the City is not an involved agency" . Ms . Higgins mentioned that the layover at Albany
DEC who deals with SEAR procedures and whose job it is to decide who is an involved
agency . ) stated , "that the City is an involved agency by virtue of the 1967 Memorandum of

Understanding . " Clause 16 states "any future deviations from these plans ( 1967 plan ) shall be subject
to written agreement by the parties hereto . " That means even if the Festival Lands were not involved ,
the City would still be an involved agency . They gave the land under these conditions and any
changes have to be agreed upon by them . To say that the City is not an involved agency does not
make sense .
The SEQR states, "if an agency will make a discretionary decision to fund or approve or undertake an
action then it is an involved agency . Notwithstanding , that it is not received in application for funding
or approval at the time that SEQR process is commenced . " Even though they did not know about it
when this was started they would be an involved agency at that time .
Common Council ' s comments made on August 6 , 1993 about the new entrance road which could
involve the possible transfer of the City lands , stated , "They express their concerns about the lack of
justification for an impact of the proposed expanded parking lots and the relocated entrance road . "
(AMENDMENT CHANGE - TB METG. 3110197 - RESOL. NO. 57 (A) : Mrs . Higgins referred to
Common Council ' s comments made on August 6 , 1993 about the new entrance road which
could involve the possible transfer of the City lands which states, "They express their
concerns about the lack of justification for an impact of the proposed expanded parking lots
and the relocated entrance road " . ) A resolution in January 6 , 1993 states , " If the City decides to
transfer the Festival Lands to State Parks and no such commitment has been or is now being made . "
Common Council is the entity that makes these decisions , not Mr . VanCourt . (AMENDMEN
CHANGE - TB MTG. 3110197 - RESOL . NO . 57 (A) : Mrs . Higgins stated that Common Council is
the entity that makes these decisions , not Mr. VanCourt . ) Another resolution from January 6 ,
1993 states , " Common Council hopes to improve neutral understanding between the City and State
Parks through this resolution . Nevertheless no part of this resolution constitutes a commitment or a
legally binding agreement between the City and the State Parks nor does it offer recommendations
contained here and necessarily imply endorsement by the City . "
This is irrelevant to the Water Front Project . (AMENDMENT CHANGE - TB MTG . 3110197 - RESOL
NO. 57 (A) : Mrs. Higgins stated that this is irrelevant to the Water Front Project . ) This concerns
City Festival Lands and the road coming in from Route 89 . Thank you .
Councilwoman Harrison - I talked with Pam Mackvey to better understand what actions Common
Council might take . (AMENDMENT CHANGE - TB MTG . 3110197 - RESOL NO. 57 (A) :
Councilwoman Harrison - I talked with Pam Mackesey to better understand what actions
Common Council might take . ) A mutual interest of communication between the City and the Town
regarding the land use issues were discussed . We agreed that a meeting should be arranged with
the Finger Lakes State Parks and the City . It would be interesting to see what the status of the Black
Diamond Trail is because it crosses between the City and the Town .
Supervisor Valentino - A meeting could be arranged to talk with the Commissioner and Commo
Council for further information .

AGENDA ITEM NO . 7 - REPORT OF FIRE COMMISSIONERS :
Lyman Baker, Fire Commissioner - The Resource Relocation Project is under evaluation by an
ongoing committee . They are looking into the alarm assignments , and when more information is
available it will be passed on to the Town Board . There will be four vacancies in April for Firefighters
due to others leaving for retirement and disability . Could you please add an article to your newsletter
for the hiring of firefighters?
Councilman Conley - Are there exams involved for these positions?
Mr. Baker - "Yes . "
Councilman Conley - Would the exam be held in time for those interested to receive the results by the
time people would be considered for hiring ?
Mr . Baker - "Yes . " Valerie Saul at City Hall is working on the exam with Albany and the City Civil
Service . When the date of the exam is available , I will pass it along to the Town for the newsletter.
The Americorp Program continues to consume much of Volunteer Coordinator Marcia Lynch's time .
AGENDA ITEM NO. 5 - REPORT OF TOWN COMMITTEES :
Councilman Wolff - At the last meeting , I handed out a brief report about the work of the Information
Technology Committee . After reading through it again , the Committee might need to have a large
discussion about everything that has happened with an over view of where things are . Some of the
decisions presented to the Board do not provide enough background information to make an informed
decision .
Supervisor Valentino - This is an issue that the Board should talk about when all the information is
available . This is a very expensive item for the Town . We want to make sure the money is spent
usefully , and that staff would be able to use it to their best abilities .
Councilman Wolff - I would like input from this Board on the purchase of three new computers and
purchase of upgrades in memory and hardware . These are not inexpensive , but it would achieve the
goals outlined in the Information Technology Report of October 3rd . It would be difficult to get
feedback on the small issues without having a discussion with the Town Board as to whether or not
the Committee's recommendations are the best way .
AGENDA ITEM NO. 10 - PUBLIC HEARING : TO CONSIDER AMENDING LOCAL LAW NO. 1 -
1996 A " LOCAL LAW INCREASING THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY
OWNED BY PERSONS WITH LIMITED INCOMES WHO ARE 65 YEARS OR AGE OR OVER " :
Supervisor Valentino opened the public hearing at 6 : 15 p . m . The Town Clerk had proof of postings

and publications . The public hearing will be postponed until the current discussion is completed .
AGENDA ITEM NO . 3 - REPORT OF TOWN COMMITTEES ( CONTINUED) :
Councilman Conley - A lot of information that would be supplied to this Board are things that I am not
familiar with . I would like a presentation at one of the staff meetings to find out what the Committee
has been working on . I would not know all the information that would be presented that the staff is
already aware of.
Councilman Wolff - The Committee is at a point now of determining whether to move in a particular
direction , or to make a decision on purchasing and training the staff. The Town Board needs to
become informed . The staff is responsible to make sure their department is accurately represented
on the Committee .
The Committee has a training program in mind . The biggest issue is to make sure there will be
adequate training for everyone . The Committee would be providing information on what the training
would consist of to make sure the Town Board understands the training program . The training
program could not be implemented until there are specific upgrades to various computers as
mentioned . There are a few new computers needed , but they have not been purchased yet .
There needs to be a policy developed for ongoing purchases . In the past , if someone needed
something it was purchased dependent upon department funds . It is not so much of a decision tha
needs to be made from the Town Board , but rather a desire to give a full review of every step that has
happened . I would like to present a report , and this might be the appropriate way .
Supervisor Valentino - Each Board Member should receive a copy of the report before the March
meeting . There will be an agenda item for discussion on this issue .
Councilman Wolff - I would also like to have a resolution for the Town Board requesting approval for
the purchase of the new computers and upgrades .
Councilman Conley - I would like the report to include the fact that we are trying to find a new Town
Hall . This should be factored in as to any monies being spent prior to moving into the new Town Hall ,
Councilman Wofff - The Committee will not be purchasing anything that cannot be moved into the new
Town Hall. I would like to show the Town Board that their concerns are being adequately addressed .
AGENDA ITEM NO . 8 - REVIEW OF CORRESPONDENCES :
A. Coddington Road Community Center Pavilion Construction Project - See attached letter .
The Town Board Members were supplied with a copy of a letter from the Town Clerk to th

Coddington Road Community Center with a project expense list attached to be forward to the
anonymous donor for the pavilion at the Community Center . Also , a letter from the Parks Manager
thanking the anonymous donor for the generous donation for the project .
Be Time Warner Cable - See attached letter .
Councilman Wolff - I am not sure how the Commission itself knows how to deal with some of the more
interesting public issues that have developed . Most of the funding that comes for those types of
programs are put in preview of this Commission . It is not clear what recourse of action is available to
the Tompkins County Intermunicipal Cable Commission in regards to promoting specific standards .
The Tompkins County Intermunicipal Cable Commission has been concerned about the franchise
agreement . For over a year they have been trying to create a multi franchise agreement for the
municipalities to present to Time Warner Cable that is redone based on a position of strength . We
presented Time Warner with a draft , and their comments were not very congenial . They took the draft
and rewrote it the way they wanted . We are going to resubmit a draft .
Supervisor Valentino - The draft has not been sent back to any of the other municipalities for review
to make sure they are comfortable with what is being negotiated . Before the draft is sent back to Time
Warner , the Town Board should review it .
AGENDA ITEM NO . 10 we PUBLIC HEARING : TO CONSIDER AMENDING LOCAL LAW NOA -
1996 , A " LOCAL LAW INCREASING THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY
OWNED BY PERSONS WITH LIMITED INCOMES WHO ARE 65 YEARS OR AGE OR OVER " :
The public hearing was reopened at 6 : 25 p . m . As no one from the public came forward wishing to be
heard . Supervisor Valentino closed the public hearing at 6 : 26 p . m .
AGENDA ITEM N0. 11 - SEQR RELATED TO A. " LOCAL LAW INCREASING THE PARTIAL TAX
EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH LIMITED INCOMES WHO
ARE 65 YEARS OR AGE OR OVER " :
RESOLUTION NO. 22: Motion made by Councilwoman Grigorov, seconded by Councilwoman
Harrison that the Town of Ithaca Town Board hereby makes a negative determination of
environmental significance in accordance with the New York State Environmental Quality Review
Act for the above referenced action as proposed and, therefore, neither a Full Environmental
Assessment Form, nor an Environmental Impact Statement will be required.
A vote on the resolution resulted as follows :

Conley , aye ; Councilwoman Russell , aye ; Councilman Wolff, aye . Motion carried unanimously .

AGENDA ITEM NOO 12 - CONSIDER ENACTMENT OF A. " LOCAL LAW INCREASING THE
PARTIAL TAX EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH LIMITED
INCOMES WHO ARE 66 YEARS OR AGE OR OVER
RESOLUTION NO. 23: Motion made by Councilwoman Harrison, seconded by Councilman
Conley that the Town Board of the Town of Ithaca does hereby enact Local Law No . 119997 a,
"LOCAL LAW INCREASING THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY OWNED BY
PERSONS WITH LIMITED INCOMES WHO ARE 65 YEARS OF AGE OR OVER": and be it further
RESOLVED, the Town Clerk is hereby directed to advertise and file the said local law as required
by Town Law.
A vote on the resolution resulted as follows :
Supervisor Valentino , aye ; Councilwoman Grigorov , aye ; Councilwoman Harrison , aye ; Councilman
Conley , aye ; Councilwoman Russell , aye ; Councilman Wolff, aye . Motion carried unanimously .

AGENDA ITEM NO 6 - REPORT OF TOWN COMMITTEES ( CONTINUED ) :
Councilwoman Russell - The Recreation Partnership agreement that was passed in January was
actually a draft form . There were a few minor changes made in the agreement . Should the Town
Board pass a new resolution on the final draft , or is the resolution that was already passed adequate?
Attorney Barney - I do not think there needs to be another resolution . The resolution authorizes the
Town Supervisor to make minor changes in the agreement .
Supervisor Valentino - I have received the final agreement and directed the Town Clerk to remove the
draft agreement from the files and replace it with the new final agreement . At the next Municipal
Officer' s meeting the agreement will be signed .
Councilwoman Harrison - The Benefit Assessment Committee was mentioned in Mr . Walker' s report .
Mr . Walker - The Benefit Assessment Committee has reviewed most of the complaints contesting
assessments . At the March meeting we can discuss the possible refunds .
Councilwoman Harrison - What about policy orientation ?
Mr. Walker - The Committee looked at some of the questions people have had and is still working o
those . This will be discussed more fully the next meeting .

Councilwoman Harrison - There have been preliminary discussions about trying to make a connection
road from the end of Summerhill Lane across Cascadilia Creek to join the East Ithaca Recreation Way
to the Library Annex property . There will be questions about what the Town ' s interests are but , there
does not need to be a commitment at this point . The Transportation Committee does not want the
partners thinking about this unless this Board is interested . The Cornell Engineering Club has been
approached and they have shown interest in this as a possible project . The first phase would be an
assessment of the cost . If the cost looks favorable they would be moving towards construction through
a cooperative effort . John Gutenberger from Cornell University suggested scheduling a meeting with
Town officials and Cornell to discuss the responsibilities of maintenance and liability . There were
some issues mentioned , such as licensing to use the East Ithaca Recreation Way . I wanted to find
out whether the Town is interested in developing a bicycle and pedestrian connection to East Hill
Plaza . The Transportation Committee decided this might be the only feasible connection at this time .
Mr. Kanter - It would be a very direct connection , and it would be desirable to have a direct link to East
Hill Plaza to create a broader trail system .
Councilwoman Harrison - The Committee is also looking at a way to better connect the East Ithaca
Recreation Way to the Cornell Campus .
The Town Board was in agreement to have the Transportation Committee pursue this further .
AGENDA ITEM NO. 13 - PRESENTATION : REPORT INLET VALLEY ARCHEOLOGICAL STUDY:
Sherene Baugher, Cornell University - I have copies of the two reports that were finished last summer
on the Inlet Valley Project . We are now working on the final report on the Town ' s park parcel . We
were looking for the village of Coreorgonel . Materials from Indians from 700 A . D . were found . Parcels
such as the Eddy Hill industrial parcel had nothing of significance . The Town's Planning Department
was notified and given information that there was no reason to postpone rezoning or permits of
development .
There was also a parcel of Tom Tomlinson Is that does not have anything of significance to the indian
or the euro-American history of the Town .
The Town park parcel did have American indian material and material relating to an early farm family
of the Town , the Fisher family and later the Pearson family . The Pearson family was very involved in
Town of Ithaca politics after the Civil War . The Town park parcel was part of what was regarded as
the best farm in the Town of Ithaca based on historical research done after the Civil War.
We have been studying all the artifacts we found connected with that , and we have just received a
grant from the Cornell University Faculty Fellows Service Program to put together the artifacts with a
report . They will be presented in a way that the Town could put them in the DeWitt Historical Society
or any museum . All the artifacts will be able to be exhibited .

The Faculty Fellows Service is doing a book that will be distributed to Universities all over the Country .
The book will describe partnerships between communities and colleges who have students working
in the community . The service flagged our project as a real example for municipal planners all over
the Country. We were one of eight people elected from Cornell University for this project . The book
chapter will be completed in September, and will be presented in composition in May .
This has been a wonderful experience for the students at Cornell University over the years . There
were over 400 students involved , including students from Ithaca College . There are usually at least
50 students at the project site at one time . We hope that over the years , this partnership will continue .
Mr. Frantz - Other partners involved in the project included Fred Noteboom , Highway Superintendent ,
and the Highway Department employees . The Highway Department crews were there many times
with their equipment and expertise to help move a lot of dirt . I would like to thank the Town Board for
all the support for this project . There are now two park sites that are historically cleared with respect
to the requirements of the State Historic Preservation Office ,
Ms . Baugher - Last April , I spoke to New York State Archeologists Associations , and there was a
professor from Bart College who was very interested in our partnership in the Town of Ithaca . He went
to his local town in the Hudson River Valley , to create a partnership with their college to save
endangered sites that might not come under the environmental review process . This fall they are
working on a project modeled after the work Mr . Frantz and I were doing . We are starting to see other
people create a cost-effective way to do pro active planning at a fraction of the cost it would be to hir
private consulting firms .
Mr. Frantz - There will be a copy of the reports in the Town Hall library and the Planning Department .
Copies will be sent to the DeWitt Historical Society and the Tompkins County Library ,

The Town Board was in agreement to Supervisor Valentino ' s suggestion of not receiving an annual
report of the investments since they were receiving them monthly .
Councilwoman Grigorov - Are we doing more than just getting interest on those investments ?
Supervisor Valentino - Previously , the money was in a saving account earning 3 . 7 percent , now we
are investing the money in Certificates of Deposits and earning more then 5 percent .
AGENDA ITEM NO . 14 - PUBLIC HEARING : TO CONSIDER RESOLUTION IN SUPPORT OF
REQUEST OF THE SOUTHERN CAYUGA LAKE INTERMUNICIPAL WATER COMMISSION FOR
SPECIAL LEGISLATION AUTHORIZING A JOINT CAPITAL RESERVE FUND :
Supervisor Valentino opened the public hearing at 6 : 45 p . m . The Town Clerk had proof of postings
and publications . As no one from the public came forward to be heard , Supervisor Valentino closed
the public hearing at 6 : 45 p . m .
Supervisor Valentino - Former Town Supervisor Shirley Raffensperger has done a lot of work with the
Attomey for the Town so the Town would be able to have a Capital Reserve Fund , The SCLIWC is
not able to have a Capital Reserve Fund . They are asking for special legislation so they can begin
to put money aside for Capital Projects .
Councilman Conley - Why is it so important that this be done?
Attorney Barney - The process takes an agreement of all five municipalities , and those municipalities
are required to enact a resolution approving the request . Then you have to wait 30 days to see
whether someone asks for a permissive referendum before continuing the process . Even if there is
a Capital Project for each municipality they need to share that project . The legislation authorizes by
agreement the establishment of a Joint Capital Reserve Fund which can be administered by the
Commission rather than coming back to each municipality . It authorizes a creation of that fund to
make expenditures out of that fund without the need for a permissive referendum . Those are the two
biggest items that the resolution accomplishes .
Councilman Conley - The function would be for each municipality to agree on different things at some
point?
Attorney Barney - "Yes . "
Councilwoman Harrison - In terms of approving expenditures , it would be approved by legislature and
then set up by the Commission and the Towns . Would it require unanimous approval of the
participants to expend the monies ?

Attorney Barney - That would be up to the municipalities on how they want to agree to do it . The Town
could require that all the expenditures go back to the Town Boards for approval , or the Town Board
could allocate money into this fund with delegation authority to spend the money without the Town
Board' s consent .
Councilwoman Harrison - How would this relate to the Capital Reserve Fund and the Sewer Fund?
Attorney Barney - The Capital Reserve Fund for sewer is established as a City fund . That is not a joint
fund . The SJS Committee would allow the Town to voice concerns on how those funds should be
used in terms of the agreement . That plant is a City owned plant .
Mr. Noteboom - How does this study impact the Town?
Attorney Barney - The study itself would not impact the Town , but if anything comes out of that study
it could impact the Town in a big way. If there is a merger of this system there would need to be a new
body created to take over all systems .
Mr . Noteboom - What would happen to the Capital Reserve Funds if that were to happen?
Attorney Barney - It would flow along with the system .
Supervisor Valentino - I support this resolution as the logical way for the Town to proceed .
Councilwoman Harrison - The resolution mentioned that they would be going to the State Legislature
for approval ?
Attorney Barney - The State Legislature will not approve any legislation involving specific
municipalities without a home rule resolution .
RESOLUTION NO. 24: Motion made by Councilwoman Grigorov, seconded by Supervisor
Valentino that the Town of Ithaca finds by reason of the foregoing that there exists a necessity for
the passage of the law annexed hereto entitled "An Act to Amend the General Municipal Law to
Authorize Certain Municipalities in Tompkins County to Jointly Establish a Capital Reserve Fund"
pursuant to which authority is given to the Commission and its member municipalities by Joint
agreement to establish a capital reserve fund for capital improvements as defined in the General
Municipal Law, such establishment to be authorized without the need for any referenda; and it is
further
RESOLVED, that the Town ofIdma hereby requests and urges the Governor and State Legislature
of the State of New York to enact the requested special legislation; and it is further
RESOLVED, that the Supervisor of the Town of Ithaca be, and she hereby is directed to
communicate the request of the 'Town of Ithaca for the adoption of such legislation to the Legislatur `

and Govemorof the State of New York in the manner required by Section 40 of the Municipal Home

AGENDA ITEM NO. 15 - STATUS REPORT SEWER JOINT SUBCOMMITTEE CAPITAL
IMPROVEMENT PLAN :
Supervisor Valentino - At the last meeting , the Committee agreed to move forward on the upgrade of
the Sewer Plant , and that the funding from all the partners will come from the Capital Reserve Fund .
It will be allocated out as Operations and Maintenance money , which is the same way it was collected .
The issue of the excess capacity will be resolved at a later date . It is clear that the City of Ithaca and
the Town of Dryden want more capacity , and the Town has decided that it has not been to our
advantage to own that excess capacity seeing that other partners can use it anytime they like . Looking
at the Town's future needs , we may as well have the partners buy the excess capacity , then we would
be in the position to use some of their capacity . I should be receiving a report on how the monies were
put into the Capital Reserve Fund , and what the break down is . It is not clear what monies the City
collected .
Councilwoman Russell - In the original agreement , there is a provision made for future modification?
Attorney Barney - The money agreement could be modified . There are provisions in the agreement
for use of excess capacity by other partners , but that is not clearly spelled out . There is an issue of
whether the Town could use the excess capacity outside of the service area or not .
Councilman Conley - At that time , some members of the Town foresaw a greater need for having
capacity . They thought there was going to be an expansion much greater than what actually
happened .
Councilwoman Russell - Who are the other partners with the City and the Town ?
Attorney Barney - The Town of Dryden .
Mr, Walker - Lary Fabbroni (City of Ithaca Assistant Supervisor of Public Works for Water and Sewer
Division } asked if the Town Board was going to have a resolution approving the contract . The last
resolution the Town Board passed had some conditions on it . This Board agreed to going ahead with
the modification that included some conditions , but all the conditions were not agreed to by all the

parties .
Attorney Barney - This Board should enact a resolution authorizing to proceed absent fulfillment of
those conditions .
Councilwoman Harrison - It was stated that this would be done pursuant to the agreement . The
partners said they were not interested in the agreement . I find it terribly frustrating because I feel that
there are some principals that are not being dealt with . I was hoping this would be leverage to get
them dealt with . The agreement at the last SJS Committee meeting was that we would fund it from
the Operations and Maintenance . The rate we pay Operations and Maintenance cost is different than
that because it has to do with actual usage as opposed to capital . The Capital Reserve Fund was
paid into at this usage rate , and that rate is better for us than that initial buy into the Capital Planning .
What does that mean in regards to purchase of shares in the capacity as proportions in the Capital
Reserve Fund?
Mr. Walker - That was not completely resolved at the last meeting . They wanted to take the money
out of the Capital Reserve Fund and allocate the capacity appropriately .
Supervisor Valentino - The original agreement says that the Town owns approximately 42 percent .
Attorney Barney - The Town of Dryden has already bought 1 percent . This needs to be resolved .
Mr . Walker - The SJS Committee resolution was worded to say the funding is directly from existing
reserve funds within the City' s control . They can contract without much difficulty and complete the
project . Putting contributions back into the reserve fund would be the basis for additional shares later .
If we wanted to buy a million gallons of capacity we would need to put that much money back into the
fund at some point in the future .
Councilwoman Harrison - Doing these improvements would result in the plant being re- rated , and
there is an additional three million gallons that will be allocated according to the percentage we paid
into the Operations and Maintenance Funds .
Mr. Walker - That is correct .
Attorney Barney - That should not be added until you know more about the present position .
Supervisor Valentino - The Town should stay with the original percentages .
Councilwoman Harrison - What does this Board need to enact ?
Attorney Barney - A resolution authorizing the Town Supervisor to convey to the SJS Committee the
approval of this Board for the expenditure of $ 600 , 000 . 00 from the Capital Reserve Fund for the
upgrading of the plant and that it not be tied to the requirement that there be an agreement as to th

allocation of any excess capacity that might be created . But that the issue of excess capacity be
continued to be discussed with the expectation that an agreement on all of the capacity allocations will
be reached as soon as possible .
Supervisor Valentino - The resolution should say that the monies are being expended from the Capital
Reserve Fund?
Attorney Barney - Yes , from the SJS Capital Reserve Fund .
RESOLUTION NO. 25: Motion made by Supervisor Valentino, seconded by Councilwoman
Harrison that the Town Board of the Town of Ithaca does hereby authorize and direct the Town
Supervisor to convey to the Sewer Joint Subcommittee the approval of this Town Board of the
expenditure of approximately $600, 000 . 00 for the upgrading of the sewer plant; and be it further
RESOLVED, the expenditure of the said monies shall not be connected to a requirement that there
be an agreement as to the allocation of any excess capacity that might be created, but that the issue
of excess capacAy shall continue to be discussed with the expectation that an agreement regarding
all of the capacity allocations will be reached as soon as possible; and be it further
RESOLVED, the monies to pay for this project shall be expended out of the Joint Sewer Capital
Reserve Fund.

AGENDA ITEM NO 16 CONSIDER REQUEST FOR REIMBURSEMENT OF 1997 REAL
PROPERTY TAX BY THE MONTESSORI SCHOOL OF ITHACA:
Mrs . Noteboom - This Board needs to decide whether they want to forgive the taxes that are due on
this property .
Councilwoman Harrison - No . At the time the tax bill was determined it was not owned by these
people . The law reads that the taxes are determined at that time .
Councilwoman Grigorov - They do not have the option of getting anything .
Councilman Wolff - The School is exempt so they do not have to pay taxes for the following year?
Mrs . Noteboom - They would need to file an application for exempt statue with the Assessment Office

by March 1 , 1997 ,
Attorney Barney - A letter should be sent to the school saying that this Board considered this , and that
they should apply by March 1 , 1997 to the Assessment Office for an exemption .
Supervisor Valentino - Were they being charged water and sewer assessments on their tax bill for the
other parcel? They should not be exempt from water and sewer .
Mrs. Noteboom - There were no tax bills for the other parcel the school owns , so they are not being
charged water and sewer .
Supervisor Valentino - The next bill will not be until next January , so I will warn them in the letter of the
sewer and water assessment charges being added .
Attorney Barney - There is a provision given to some developers abating the water and sewer
assessment for five years . That parcel was subdivided by Evan Monkemeyer as part of a subdivision
of several parcels .
Supervisor Valentino - The staff has been looking over the exemptions to look to see if they are
accurate .
AGENDA ITEM NO . 17 - CONSIDER AUTHORIZING THE ATTORNEY FOR THE TOWN TO THE
EXTENT LEGALLY POSSIBLE TO PROSECUTE THE CASCIOLI BUILDING CODE VIOLATION :
Attorney Barney suggested referring this agenda item to Executive Session for further discussion .
AGENDA ITEM NO . 18 - DISCUSS TIME WARNER CABLE TAX CREDIT AND FRANCHISE FEE
ISSUES :
Attorney Barney - There is a provision in the law which states that if an entity pays a franchise fee that
amount can be deducted from the real property taxes on parcels owned within the municipality . The
franchise fee can be deducted unless the franchise agreement specifically says that the franchise fee
is in addition to all other taxes payable . Time Warner Cable stated that they wanted to deduct their
franchise fee from their entire bill . The law said they can deduct it from the real estate tax portion of
the bill . They cannot take it off of the fire tax or the water and sewer.
Councilwoman Harrison - How much is the franchise fee?
Mrs . Noteboom - The Town usually receives approximately $50 , 000 . 00 a year on franchise fees . The
franchise fee is a percentage portion of each cable hook up .
Attorney Barney - The Town has no franchise agreement with Time Warner Cable . It expired
approximately four years ago .

Supervisor Valentino - Even though the Town does not have a new contract with them we have to sign
each year to extend the original franchise . Both sides need to honor it . We are operating under a
franchise , the Town does not have a new contract yet . The Town needs to revisit the contract related
to the collection of franchise fees based on gross receipts . They have only been sending money on
basic services not the gross receipts . These issues need to be revisited by Time Warner Cable and
the Town while negotiating the contract .
Councilman Wolff - The provision is from New York State Law, or from the provisions in the actual
agreement?
Attorney Barney - New York State Law grants the exemption , unless the Town's agreement says that
they are not entitled to it based on specific language saying it is in effect on top of any other tax.
Councilman Wolff - During our efforts of renewing the franchise we want to revisit the issue of the
definition of what income and receipts are .

ADDITIONAL AGENDA ITEM NO . 1 - DISCUSS CLARIFICATION OF MAXIMUM VACATION
ACCUMULATION PERCENTAGE AS DEFINED IN THE PERSONNEL MANUAL :
Supervisor Valentino - Employees could carry over one and one half of what they accumulate for the
year according to the wording in the Personnel Manual .
Councilwoman Harrison - If an employee accumulates ten days a year they could carry over 15 days?
Supervisor Valentino - That is correct .
Councilwoman Harrison - This proposal is to change the rollover accumulation to half of thelr annual
allocation ?
Supervisor Valentino - The way it was written now must have been an error , because how could an

employee roll over more than what they earned ? The reason we gave the employees vacation is so
they could use it .
Councilman Conley - The employees deserve to take their vacation .
Supervisor Valentino - There are ways we could deal with ahead of time for someone with unusual
circumstances . Accommodations could probably be made for those instances . It was not the intent
of the Board for people to just accumulate vacation without ever taking it .
Councilman Conley - It should be up to the individual supervisor's whether accommodations are made
to rollover more than that .
Supervisor Valentino - It has always been based on that premise , but if there is some reason the
Supervisor or Department Head cannot let someone take their vacation , there would need to be an
accommodation for that .
Councilwoman Harrison - Would that be written into the manual?
Supervisor Valentino - "Yes . "
Councilwoman Grigorov - It would need to be worded so there is no question about how the vacation
time works .
Mr. Kanter - That is why the issue is here before the Board . There is a problem interpretating the way
it reads , especially the word "accumulation " . The word "carry over" is what needs to be said , then
everyone knows that they cannot carry over any more than the maximum allotment .
Councilwoman Harrison - Is vacation time accumulated over the year or in one lump sum?
Mr. Walker - As of January 1 st all employees would have ten days of vacation time , or up to 15 days
if they have been employed more than five years .
Supervisor Valentino - This is something that is being worked out with the Human Resource Specialist
and the new payroll system . We might be able to start doing the accumulations on a monthly basis
the way the sick time is done . We need to look at a plan .
Councilwoman Harrison - We would be giving the employees a year to use their vacation time instead
of carrying over?
Supervisor Valentino - Yes . We have sorted out the accumulation and backlog situation .
The Town Board was in agreement with Supervisor Valentino ' s suggestion in regards to the vacation
time accumulation for the Personnel Manual .

Supervisor Valentino - After looking at the work on the Personnel Manual from last year, it is clear
there are substantial changes in the way we operate . One of the main things is working out the
contract with the Dispute Resolution Center . This is going to impact on some of the things we do as
far as grievances and problem solving are concerned . The old wording brought the Town Board into
the loop of personnel issues more than we really needed to be . The on going day to day issues , the
contract and the new wording in the manual could keep the Town Board out of dealing with personnel
issues . What is this Board' s feeling on this?
Councilman Conley - It would be up to the Department Head's discretion , but the Supervisor would
be the main person to do that .
Supervisor Valentino - If there was a big personnel issue then it would come to the Town Board . Other
things need to be cleaned up in the Personnel Manual and are being worked on .
ADDITIONAL AGENDA ITEM NO . 2 - CONSIDER RULES AND REGULATIONS REGARDING
COMPUTER INTERNET ACCESS :
Supervisor Valentino - The staff is being very careful on how they handle the Internet . There is a
potential for problems if there are no specific written rules and regulations on the use .
Councilwoman Harrison - What should we be worried about ?
Supervisor Valentino - There are three people who have access and password to the Internet . I would
like to make sure that these are the only people who know that password .
Councilman Woff m I do not think this would be a permanent policy . The Town needs to be careful on
how to deal with the Internet , and we should have a comprehensive plan for implementing bills and
procedures for the use of it . There are things that would be a benefit to the Town and staff in using
the Internet , but there would also be things that would not be appropriate for the staff to use .
Councilwoman Harrison - The policy should read that the Internet should only be used at certain
times .
Councilman Conley - Rules and regulations should be established for Internet access . This is not to
restrict the use , but to know what the Internet access would be to the staff and how would they use the
Internet .
Mrs . Noteboom - The Town has Internet access through a grant at the Telecommunications Program
of the Hudson Valley Community College . The Town is receiving free service until July 1997 . 1 am
responsible for access to the Internet until the grant is finished in July , and for all the requirements for
the grant . They allowed the Town to add two other stations as long as certain procedures are followed .
Until July 1997 , there needs to be some standards to operate under the conditions of the grant .

Councilman Wofff - The regulations being proposed are components that are consistent with what the
grant requires?
Mrs . Noteboom - "Yes . "
Councilwoman Harrison - Does the grant require you to keep a log?
Mrs . Noteboom - "Yes . "
Councilwoman Harrison - I do not like this provision as a general policy . We should be encouraging
people to use the Internet. I want to be able to communicate with Mr . Kanter through E- Mail . It would
be burdensome to keep paper work every time there is use of the Internet . I use the Internet frequently
at work , and there is phenomenal information on it . I understand that this grant requires it ,. but after
that " no " .
Supervisor Valentino - How do we do E- Mail now?
Councilman Wolff - The Town has limited & Mail access .
Councilwoman Harrison - The terms of the grant make sense , but the proposed resolution sounds like
this is going to be our policy . Another "whereas" in the proposed resolution should read that there is
a grant and under the terms and conditions of that grant we need to do the following .
Councilman Conley - The Supervisor should take care of it until the appropriate time .
Councilman Wolff - It is good to have some kind of standing policy .
Councilwoman Harrison - Why make this a policy? Number four of the proposed resolution states ,
"Any and all Internet access must be related to Town of Ithaca business , . " that makes sense and
should be a policy .
Mrs . Noteboom - How could this be monitored unless a log is kept ?
Councilwoman Harrison - There are a lot of laws that are not enforced in that kind of way . I think the
Town Clerk has better things to do than look at their logs , and they have better things to do than to
keep logs. If people want to lie to you , they will lie to you anyway . If people want to use the Internet
to get 1 - 800 numbers , they would lie to get it . I do not like the policy of keeping a log of everything
that is done . We should be encouraging people to use the Internet . If we make it difficult for them to
use the Internet we will fail at moving people forward .
Councilwoman Grigorov - How long does it take to log on and log off?
Mrs . Noteboom - It depends . The computer in the Town Clerk' s office is a slow modem . So getting

into the Internet to gain access is a timely process . The Planning and Highway Department's are
having great success with the Internet .
Councilwoman Grigorov - What is the log book for?
Mrs . Noteboom - The log book is nothing more than saying the time they logged on and how long they
were on it . . The log needs to be done for the grant . There should be a log if someone is using the
Internet on the weekend or in the evenings other than normal hours so we know who has been using
the Internet and what station is being used .
Councilman Wolff - Is there a limited number of hours under the grant?
Mrs . Noteboom - The grant allows us to have 100 hours of free access to the Internet until July 1 ,
1997 . As of July 1 , the Town would need to start paying for the lines and the time .
Councilman Wolff - Is there a desire to regulate the amount of time on the Internet?
Mrs . Noteboom - "Yes . "
Councilwoman Harrison - When we are in the new Town Hall would we be networked in a fashion that
we would not need to go through a modem?
Mr. Walker - We will still be using a modem . A lot depends on what happens with the County' s fiber
optic network . It might be possible .
Supervisor Valentino - In the future we are going to encourage people to have a different system .
Councilwoman Harrison - I do not think we need to adopt this as a Town Board policy . The Supervisor
is in a good position to say we need to keep a log book .
Attorney Barney - I do not think it should be left up to the Supervisor to make these types of decisions
without the approval of the Town Board . The proposed resolution should have another "whereas"
stating this should be labeled the interim rules and regulations pending further studies relating to the
grant .
Supervisor Valentino - These regulations should be in effect to July 1 , 1997 , and then it could be
assessed after that to see how it is working .
RESOLUTION NO. 31 : Motion made Councilman Conley, seconded by Councilwoman Grigorov
that the Town Board of the Town of Ithaca does hereby adopt the following rules and regulations
regarding Internet access on the computers owned and operating within Town of Ithaca facilities .

COMPUTER INTERNET ACCESS
1 . AU computers having Internet access shall be identified according to location
with the name and position of the employee operating them identified.
2 . Employees with Internet access shall be responsible for the security of the
password necessary to connect to the Internet . The password shall not be
disclosed. Internet access shall be attained through the employee directly
responsible for the computer.
3 . A log book containing the date, time, and purpose of access to the Internet shall
be maintained on a monthly basis by the employee directly responsible for the
computer. The log shall be submitted to the Town Clerk at the end of each
month .
4 . Any and all Internet access must be related to Town of Ithaca business .
Councilman Wolff - The Information Technology Committee has been reviewing this issue , and the
guidelines were established by the Committee for those individuals using the Internet . Part of the
Committee's training process would be establishing a set of guidelines for the use of the Internet and
steps to help us achieve the vision of free Internet use .
Mrs . Noteboom - Once the grant is over there will be a cost involved , and it would depend on ho
many stations are set up .

ADDITIONAL AGENDA ITEM NO . 3 - REQUEST FOR CORRECTED TAX BILL .
Mrs . Noteboom - A letter was received from the Division of Assessment asking us to issue a corrected
tax bill pursuant to Section 554 , of the Real Property Tax Law . The investigation determined that a
veteran's exemption was removed in error when the property was transferred to trust . The Attorney
for the Town was asked if a veteran ' s exemption is transferrable to a trust , and it was indicated to be
possible . Under Section 554 , there would need to be a resolution from the Town Board authorizing
the issuance of a corrected tax bill as it would change the amount of the Town 's levy .
Attorney Barney - The law requires that the beneficiary of the trust needs to be eligible for th
exemption . The law says this exemption shall not be affected by transfer to trust for the benefit o

assessment . This is an assessment decision , not the Town ' s .
RESOLUTION NO. 32: Motion made by Councilman Conley, seconded by Councilwoman
Harrison that the Receiver of Taxes is hereby authorized and directed to issue a revised tax bill for
the parcel, Tax Map Number61- 1 - 11 . 1, for an amount from $ 1, 793 . 21 to $ 1, 695. 12; and it is further
RESOLVED, the Receiver of Taxes shall follow the statutes outlined by Section 554 (Sub, 7a) of the
Real Property Tax Law when issuing and collecting the revised tax bill. .

OTHER BUSINESS :
Mr. Carvill - The fourth quarter sales tax for 1996 has been received and has already been allocated
to the General Fund and Highway Fund . The financial report recorded all the 1997 Real Property

Taxes that have been collected . Those will be distributed to the respective operating funds on March
3 , 1997. The fiscal accounting records for the year ending December 31 , 1996 are officially closed ,
and all January transactions have been posted . The monthly accounting records for January are
closed . The February accounting records are now open . All the cash accounts for the periods of
October, November, December, and half of January have been reviewed , reconciled , and balanced .
There were no significant or unusual cash findings in this disclosure . It does indicate that there needs
to be closer cash management control measures implemented . A separate fund has already been
established for the Trust and Agency guidelines to monitor and hold escrows and isolate the deposits
that the Planning Department receives for planning and review fees .
The remaining deadline the Accounting Department has is the completion of the State Controller's
Report that is due February 28 , 1997 . On March 5 , 1997 , there will be a meeting with the Accounting
Department and the independent accounting firm to begin discussions regarding auditing the 1996
books .
Supervisor Valentino - There have been concerns about the accounting software package . Mr . Carvill
has had some discussions with Williamson Law Book about upgrades . They are willing to provide the
software at no charge . The Town will be able to stay with this software package for a year or so
depending on the upgrades for the future .
While Williamson people were here they also gave a demonstration of their payroll package . We hav
had on going problems with DataRite , so we decided to look into this payroll package . The Mu ma
Resource Specialist talked with the Town of Lansing about the same payroll package Williamson it
offering . They were very pleased with it . The Human Resource Specialist will be doing the payroll
in house again with this package .
Attorney Barney - The law consistently changes in that area . Whatever package the Town gets , the
program needs to be updated for all the changes that occur .

RESOLUTION IN SUPPORT OF REQUEST OF
THE SOUTHERN CAYUGA LAKE INTERMUNICIPAL WATER COMMISSION
FOR SPECIAL LEGISLATION AUTHORIZING A JOINT CAPITAL RESERVE FUND
Resolution No . 24
WHEREAS , the Southern Cayuga Lake Intermunicipal Water Commission (the
"Commission ") is a body formed by Intermunicipal agreement among the Towns of
Dryden , Ithaca , and Lansing , and the Villages of Cayuga Heights and Lansing , all in
Tompkins County, New York , for the purposes (among others) of constructing ,
maintaining , and operating water supply and transmission facilities for the member
municipalities of the Commission ; and
WHEREAS , the Town of Ithaca is one of the parties to the agreement establishing
the Commission and is a member of the Commission ; and
WHEREAS , the Commission supervised the construction of such facilities some
twenty years ago ; and
WHEREAS , the age of such facilities , as well as the increased demand for water
and related services from the Commission ' s facilities , has resulted in needed capital
improvements to the systems of a cost in excess of $3, 000, 000; and
WHEREAS , the Commission and the Town of Ithaca believe it is prudent and
appropriate to establish a Capital Reserve Fund to permit accumulations of
moneys to fund some of the needed capital improvements; and
WHEREAS , there is some question as to the legal ability of the member
municipalities to create such a joint fund without special legislation authorizing such a
fund , and in particular for Towns to create such a fund without the necessity of a
permissive referendum ; and
WHEREAS , the inability to create a joint capital reserve fund will greatly handicap
the construction , replacement , and enlargement of the facilities which provide water to
residents in the five municipalities , as well as , on occasion , to residents in other
municipalities in Tompkins County ;

NOW, THEREFORE , BE IT RESOLVED , that the Town of Ithaca finds by reason of
the foregoing that there exists a necessity for the passage of the law annexed hereto
entitled "An Act to Amend the General Municipal Law to Authorize Certain
Municipalities in Tompkins County to Jointly Establish a Capital Reserve Fund "
pursuant to which authority is given to the Commission and its member municipalities
by joint agreement to establish a capital reserve fund for capital improvements as
defined in the General Municipal Law, such establishment to be authorized without the
need for any referenda ; and it is further
RESOLVED , that the Town of Ithaca hereby requests and urges the Governor and
State Legislature of the State of New York to enact the requested special legislation ;
and it is further
RESOLVED , . that the Supervisor of the Town of Ithaca be , and she hereby is
directed to communicate the request of the Town of Ithaca for the adoption of such
legislation to the Legislature and Governor of the State of New York in the manner
required by Section 40 of the Municipal Home Rule Law, and to take such further action
as she deems necessary or appropriate to effectuate the intention of these resolutions .

Rules and Regulations Computer Internet Access

WHEREAS , there are several computers within the Town of Ithaca which have
access to the Internet because of a grant received by the Town Clerk for a
Telecommunications Initiative Project administered by the Hudson Valley Community
College ; and
WHEREAS , the Town Board of the Town of Ithaca wishes to define certain rules
and regulations to be followed regarding this Internet access ; and
RESOLVED , the Town Board of the Town of Ithaca does hereby adopt the following
rules and regulations regarding Internet access on the computers owned and operating
within Town of Ithaca facilities .
RULES AND REGULATIONS - COMPUTER INTERNET ACCESS
1 . All computers having Internet access shall be identified according to location with
the name and position of the employee operating them identified .
2 . Employees with Internet access shall be responsible for the security of the
password necessary to connect to the Internet . The password shall not be disclosed .
Internet access shall be attained through the employee directly responsible for the
computer .
3 . A log book containing the date , time , and purpose of access to the Internet shall
be maintained on a monthly basis by the employee directly responsible for the
computer. The log shall be submitted to the Town Clerk at the end of each month .
4 . Any and all Internet access must be related to Town of Ithaca business .

WHEREAS , the Receiver of Taxes has received notification from Stephen F .
Whicher , Director of Assessment , Tompkins County that under Section 554 (Sub , 4a) of
the Real Property Tax Law, he has conducted an investigation of an error in essential
fact on the 1997 tax roll for the Town of Ithaca ; and
WHEREAS , the said investigation disclosed that the Veteran ' s exemption was
removed in error for the parcel , Tax Map Number 61 - 1 - 11 . 1 , when the property was
transferred to trust ; and
WHEREAS , the taxable value for the said parcel should be changed from $ 165 , 000
for Town and County purposes to $ 151 , 225 for County purposes , and $ 145 , 225 for
Town purposes resulting in a revised tax bill from $ 1 , 793 . 21 to $ 1 , 695 . 12 ; now
therefore be it
RESOLVED , the Receiver of Taxes is hereby authorized and directed to issue a
revised tax bill for the parcel , Tax Map Number 61 - 1 - 11 . 1 , for an amount from
$ 1 , 793 . 21 to $ 1 , 695 . 12 ; and it is further
RESOLVED , the Receiver of Taxes shall follow the statutes outlined by Section

EARTH FILL PERMITS
Five Mile Drive , Immaculate Conception
Filling at the site has been limited to stockpiling of material from
utility excavations . The contractor plans to remove stockpiled material
as fill is needed on the project , and final grading and site restoration
is expected to occur in 1997 . Sediment control fencing is being maintained
around the fill area . The contractor has been keeping the roadway clean .
Ithaca Vol . Vets , Elmira Road
The Association received site plan approval from the Planning Board
on October 29 , 1996 for an enlarged parking area on the property with
additional fill to be placed . The Town Engineer is monitoring the project .
Williams Glen Road
A fill permit for approximately 200 cubic yards of fill has been
issued for regrading a residential lot with imported material .
Final grading and seeding of the site will be completed when weather
permits .

WATER PROJECTS
The Town Engineering staff is continuing to work with the Bolton Point
staff to implement the master metering program for connections to the water
transmission main . Work is nearing substantial completion , with site
restoration work being the major element to complete .
The Town Engineer is continuing to work with the City Engineer and
SCLIWC member municipal engineers on the engineering evaluation to include
the entire water infrastructure for the area . Work is proceeding under the
contract with O ' Brien and Gere to complete the hydraulic model of the Town
of Ithaca distribution system , which is being combined with adjoining
municipalities to create a regional model .
The parties involved with the cooperative system evaluation study have
sent a joint letter to legislative leaders in support of a pre - application
for possible funding from the Environmental Bond Act . Projects listed in
the pre - application include possible joint projects that are being
considered during the development of the regional study . The timing of the
application requirements for bond act funding consideration resulted in
submission of the pre - application prior to the completion of t
engineering study . The pre - application and endorsements represent
willingness of the parties to consider cooperative projects , but there ha
been no final commitment to participation at this time .
The Town Engineering Staff is completing plans for a replacement of
the aging and inadequate water main that serves Buttermilk Falls State
Park . The replacement line will connect to the new watermain at the
intersection of Buttermilk Falls Road and Rte . 13 and will run to the City
line near Spencer Street , replacing a 6 " watermain that is over 70 years
old .
SEWER
Plans for the replacement of the controls for Forest Home pump
stations number 1 & 2 have been completed and the equipment has been
ordered . Town staff will install this equipment when it arrives .
Installation of the monitoring station on Hanshaw Road has been
completed except for some final site restoration which will be completed
in the spring . Installation of this monitoring station is part of the
Northeast Sewer rehabilitation plan which has been requested by the Village
of Cayuga Heights , The Town Engineering staff is proceeding with other
monitoring and infiltration control elements as part of this program .
The Town Engineering staff is completing plans for a short extension
of sewer on Buttermilk Falls Road to serve the Buttermilk Falls State Park .
This project has been requested by the Park as they plan to replace
septic tank system that serves the Bath House and Park Office . The curren
leach field is located adjacent to Buttermilk Creek .

STORMWATER
Development of the Town wide watershed evaluation has been started by
the Town Engineering Staff . The Northeast Ithaca Area including Cayuga
Heights is being addressed first due to the numerous requests for
assistance that have been received from residents in this area . An
informational meeting has been scheduled for February 25th at the Dewitt
Middle School auditorium . This meeting will provide an opportunity for the
Town to discuss concerns and plans with the residents of the area . Local
community leaders and residents that have expressed concerns are being
contacted to remind them of the meeting and a meeting notice will be
published in the Ithaca Journal .
BENEFIT ASSESSMENT
The Town wide water and sewer benefit assessment review is nearing
completion . The benefit assessment committee has been meeting to review
assessment questions and grievances and will be making recommendations to
the Town Board at the March board meeting .
The County digital tax parcel maps have been provided to the Town by
the county assessment office , and development of a database utilizing the
GIS is proceeding .
CAYUGA INLET REHABILITATION PROJECT BY US ARMY CORPS OF ENGINEERS
The Corps of Engineers is planning to repair Cayuga Inlet Flood
Control Channel from the State Street Bridge up to the drop structure and
fish ladder . Work is proposed to include removal of approximately 100 , 000
CY of sediment , placement of rock rip rap bank protection and removal of
gravel from the Coy Glen grade stabilization structures . NYSDEC as the
maintenance agency has been asked to provide spoil sites for the project .
The project was scheduled to be let in November with work completed by
December 31 , 1996 , but high bids have resulted in an . indefinite delay of
the project . A possible construction start may occur in late winter or
early spring .

HIGHWAY/PARKS DEPARTMENT MONTHLY REPORT, JANUARY 1997
TOWN OF ITHACA TOWN BOARD . FEBRUARY 10, 1997
Highway Superintendent
This January has been relatively snowless . There have been occasions, though, which have
warranted 747 hours of time in snow removal . Of that time , 386 were over time hours . We used
257 tons of salt in January . We salted both City fire stations (within the Town of Ithaca) ten
times . In addition, we plowed them three times .
We spent 698 hours of time working on General Repair work. This includes working at the
High«-av/Parks facility, ditching, hauling materials, thawing culvert pipes, and patching roads .
Preparing to rebuild Pennsylvania and Kendall Avenues started in January. We worked 119 . 5.
hours changing fire hydrants on Kendall Avenue . Along with this, we have measured the roads
and ordered road crossing pipes . This took 32 hours of time . There is more work to be done,

and as time permits, we will continue to work on this project.
Due to the weather, we were only able to work 175 hours on Brandywine Drive. This project has
been put on hold until warmer weather. This project is almost done . Sixty feet of pipe was
installed in January.
During January we conducted our annual Christmas tree pick. This , along with several other tree
trimming projects , consumed 2 ') 3 hours of time .
The mechanic and one other staff member continued to maintain equipment and vehicles this
month. It took 214 hours of time for this endeavor.

Park and Open Space Manager
Parks staff worked a total of 197 hours (regular and overtime) for snow removal during January.
Christmas tree pick up took longer this year as more residents participated. Parks staff spent 31
hours chipping trees . Along with the tree pick up, tree removals at various park sites took 20
hours of time .
We began reapplying wood chips on the nature trails at Eastern Heights Park during frozen
ground conditions . This hasn' t been done for several years . A total of 100 hours, including help
from Highway staff, was spent.
A four bay shed addition was constructed attached to our salt shed . This is to store equipment
out of the weather. Parks staff contributed 76 hours of time to this project.
Workshop projects included four (4) map display cases for South Hill Trail, workbenches for our
new radial arm saw, and the completion of railings on the loft stairs . A total of 110 hours were
spent on these projects .
Routine maintenance tasks totaled 193 hours in January .
FEBRUARY PARKS PROJECTS

DEVELOPMENT REVIEW
The following are actions - that were considered by the Planning Board,
Montessori Park Site, East King Road
The Planning Board recommended at the December 3, 1996 meeting that the
Town Board consider substitution of a parcel that was intended to be
dedicated as a town park adjacent to the Montessori School for another parcel
on owner' s land.
Renovation of Space in Axiohm I.P.B. facility for Alex Computers, 950 Danby Road
The Planning Board granted Preliminary and Final Site Plan Approval at the
December 17, 1996 meeting for the renovation of 6,000 +/- square feet of
interior space at the Axiohm I.P.B. facility for use by Alex Computer Systems,
Inc., "I" Industrial District.
Oxley Parking Lot, Cornell University, Dryden Road
The Planning Board recommended at . the December 17, 1996 meeting that the
Zoning Board of Appeals grant approval for the extension of the time limit on
the use of the former Oxley Polo Arena site for a 134 space temporary parking
lot, including parking for construction workers and temporary construction
storage trailers, until December 31 , 2001 . Said parking lot was granted special
approval by the ZBA on April 10, 1991 . The site is located off NYS Route
366 / Dryden Road, Residence District R-30.
Ithaca College Projects, Sketch Plan Review
The Planning Board considered a sketch plan presented by Ithaca College at
the December 17, 1996 meeting for planned construction projects at the Danby
Road Campus, including a 55,700 + / - sq. ft addition to Ford Hall, and
construction of a new 83,000 + /- sq.ft. Health Sciences and Human
Performance Center, a new 40,000 + / - sq. ft. Fitness Center, and an expansion
of Parking Lot "J", Residence District R-151
Teeter Subdivision, Gray Road
The Planning Board granted Preliminary and Final Subdivision Approval at
the January 7, 1997 meeting for the proposed subdivision of a 3. 0 + / - acre
parcel from a 53 .3 + / - acre parcel, AG Agricultural District.
Paleontological Research Institution Addition, 1259 Trumansburg Road .
The Planning Board granted Preliminary Site Plan Approval at the January 21 ,
1997 meeting for a 6,000 + / - sq. ft addition to the existing PRI building at 1259
Trumansburg Road, and recommended that the ZBA grant special approval for
the proposed addition, Residence District R-301
Balcom /Pearson Subdivision, Modification of Condition, 1035 Hanshaw Road
The Planning Board approved a modification at the January 21 , 1997 meeting
of a condition that had been imposed on a two-lot subdivision. The original
resolution of approval required conveyance of Lot B (0.41 + / - acres) to the
owners of an adjacent parcel and submission of the deed and copy of the
consolidation request to the town within six months of the date of approval.
The approved modification extended the period of that condition for an
additional six months. Residence District R-15 .
CURRENT PLANNING DEPARTMENT PROTECTS -
The following are significant accomplishments or issues that have been dealt with
over the past two months.
SE OR Reviews for Zoning Board: Two SEQR reviews for the Zoning Board were
completed: (1 ) a request for special approval to permit the construction of an addition
to a dental office at 1018 Ellis Hollow Road (Dr. Purdy), and (2) a request to extend
special approval for an additional five years for the temporary parking lot at the
former Oxley Polo Arena site, Dryden Road (Cornell University) .
Tompkins County Economic Alliance: The Supervisor and Director of Planning
attended what will probably be the last of the official meetings of the Economic
Alliance on December 12, 1997. As a result of the work of the Alliance, Tompkins
County Area Development (TCAD) has restructured its organization to include a
broader, countywide economic development function. Their Board of Directors will
now include an additional seat representing the commercial/ retail sector and two
new seats representing the rural public sector. A new economic development
coordinator will be hired by TCAD . Several representatives of the Economic Alliance
agreed to put together a summary of goals, issues and recommendations, which can
be used by TCAD and municipalities and organizations involved in economic
development.

Codes and Ordinances Committee: Work continued on Zoning Ordinance revisions at
the January 15 and February 5, 1997 meetings, including review of the Industrial,
Planned Development (formerly SLUD), Agricultural, and Conservation zones. This
completes initial review of all of the actual zoning districts in the ordinance. In order
to begin obtaining feedback on the preliminary zoning revisions, all of the revised
districts will be compiled and distributed to various boards and committees, as well
as the public, and public information meetings could be set up at this point. Codes
and Ordinances will continue review of remaining sections of the Zoning Ordinance,
including site plan review, non-conforming uses, general provisions, and
administration.
Planning Committee: The Planning Committee met on January 6 and January 23,
1997. At the request of the Codes and Ordinances Committee, the Planning
Committee put together recommendations regarding revisions to the Agricultural
zone (see attached Summary of Key Points Discussed . . . ). The Planning Committee
also discussed the possibility of a Planned Development or Educational zone for
Ithaca College. The Supervisor and Director of Planning are scheduled to meet with
one of the Vice-presidents of Ithaca College on February 6th to discuss this further.
Work on the South Hill Swamp area is progressing. Staff presented the results of the
South Hill Swamp plant study that was recently completed by Robert Wesley and
Nancy Ostman, indicating significant plant communities. This will be valuable
information in helping to determine possible boundaries of a new Conservation zone.
Staff is in the process of digitizing this information on GIS, along with other natural
features and land use and ownership information.
Staff presented the park and recreation sections of the draft Park, Recreation and
Open Space Plan to the Planning Committee. A discussion of the open space and
Purchase of Development Rights (PDR) sections is scheduled for the February 24th
meeting.
1997 priorities will include recommending boundaries for the proposed South Hill
Swamp and Coy Glen Conservation zones and the revised Agricultural zone, along
with the development of a possible Ithaca College Planned Development zone. The
Planning Committee also agreed to be involved in a townwide Transportation Plan as
one of its priorities for the next two years.
Park, Recreation and Open Space Plan Update: The draft Park, Recreation and Open
Space Plan Update has been completed and is currently being discussed with the
Conservation Board, Planning Committee and Planning Board, providing an
opportunity for preliminary review and input. After further revisions based on those
comments received, the Plan will be ready for distribution to the Town Board for
consideration, and a process for public participation and input will be determined.
Town of Ithaca - Cornell University Transportation Committee: The Committee met
on December 5, 1996 and February 3, 1997 (a copy of the December 5th meeting

summary is attached) . There were further discussions of possible pedestrian and bike
trail connections around the Precinct 7 and Plantations areas. There was also an
update of the Plantations Master Plan and discussion of how that may provide
opportunities for circulation improvements in the Precinct 7 area and surrounding
residential areas.
Discussions continued on Route 366 intersections. NYSDOT has provided updated
accident data for the Judd Falls Road, Tower Road and Caldwell Road intersections,
and has also responded to a request to look into signage and lighting at the Caldwell
Road intersection on Route 366 (see attached correspondence with NYSDOT).
NYSDOT is still interested in closing the north leg of Judd Falls Road between Route
366 and Campus Road, and has indicated that they would install full 3 color traffic
signals at all three intersections if that could be accomplished. NYSDOT would,
however, be willing to do an independent analysis of the need for a traffic signal at
the Caldwell Road intersection. The Committee will send a response to NYSDOT
indicating that there is interest in the possible closing of the north leg of Judd Falls
Road, pending further documentation of the effects of such dosing, that updated
traffic counts will need to be done, and that an independent analysis of Caldwell
Road would be desirable. The Committee will ask that the analysis also include the
possibility of a traffic signal at Tower Road even if Judd Falls Road is not closed. It
was agreed that one way to judge the possible effects of closing the north leg of Judd
Falls Road is for the State to install temporary traffic signals at each of the
intersections, while temporarily closing Judd Falls Rd., and conducting traffic counts
during this simulated dosing. At any rate, a traffic count study, coordinated with the
State would be a desirable step to get a better idea of the current traffic situation.
The Committee is also seeking a legal opinion from the Attorney for the Town on the
question of whether there are any constraints on dosing a portion of a town road
thereby creating a "dead end" road (i. e., one that only connects with private, in this
case, Cornell roads) .
Northeast Subarea Study: The Director of Planning attended a meeting of the
Northeast Subarea Study client committee held on January 6, 1997, to finalize the
Request for Proposals (RFP), which has now been advertised and distributed. The
client committee consists of the chief elected officials of each of the participating
municipalities (refer to attached Client Committee Charge and Designation). A
deadline of February 14th was set to receive study proposals, with March 18th set as
a tentative deadline to present recommendations for consultant selection to the MPO
Policy Committee, which is overseeing the study. The consultant contract will be
administered by the County. Invoices will be sent to the participating municipalities
indicating the local shares due ($2857. 15 per municipality) to fund the study. A
meeting has been requested by representatives of Forest Home to discuss the RFP
with the Supervisor and Director of Planning, and has been been scheduled for
February 5th.
Cornell Veterinarian School Incinerator: As indicated in the Annual Report,
representatives of the Town Board, Conservation Board, the Director of Planning, and

numerous other community and University interest groups have participated in the
Community Advisory Committee to evaluate options for Cornell' s medical and
pathological waste disposal and management. The Committee's work plan has been
set, and work groups have been formed to compile data and make recommendations
to the overall committee.
Town Hall Committee: Work continues on evaluating options for a new Town Hall,
with most recent focus on the Tioga Street Post Office. Negotiations with Postal
Service officials have commenced.
1996 Annual Report: The Planning Department' s 1996 Annual Report was prepared
and presented to the Town Board at the January 13, 1997 meeting, where it was
accepted by the Board.
1997 Priority Work Plan: The Planning Department' s proposed 1997 Priority Work
Plan was prepared and presented to the Town Board at the February 3, 1997 meeting,
where it was accepted by the Board. The top three priorities of the Planning
Department will focus on (1 ) completion and enactment of Zoning Ordinance
revisions, incorporating Comprehensive Plan recommendations; (2) adoption and
implementation of the Parks, Recreation and Open Space Plan; and (3) Transportation
Planning.
South Hill Communityy Park Site: As a follow up to the discussion at the December 9,
1996 Town Board meeting regarding the possible substitution of a proposed park site
adjacent to the Montessori School on East King Road, staff has initiated an analysis of
potential parkland on the South Hill with the hope of identifying at least 10 acres of
contiguous land that could be assembled as a community park, including an
equivalent amount of land in exchange for the "Montessori" park site . Staff from
Engineering, Planning, and Highways and Parks conducted a field visit to potential
park sites on the South Hill. Planning staff is working on concept plan alternatives
evaluating the feasibility of potential park sites and will be meeting with the other
involved departments and landowners) soon to discuss options. If a mutually
agreeable park site is identified, a formal proposal will be presented to the Town
Board at a future meeting.
Chase Pond /Hospice Trail: Planning staff is evaluating the possibility of acquiring a
vacant lot (approx, one-half acre) in the Deer Run Subdivision to connect the right-of-
way for the proposed Chase Pond /Hospice trail directly with Marcy Court and
Whitetail Drive. If feasible, this would be a shorter, more direct alignment for the
pedestrian and bicycle trail and could be combined with additional drainage
improvements. A preliminary trail design and alignment has been prepared by staff.
Because of the slope of the lot and federal and state guidelines regarding maximum
grades and horizontal curves for trails of the type proposed, it appears that the entire
lot would be needed to accommodate the proposed trail . If the proposal appears to
be feasible and cost-effective, a proposal will be formalized, along with a presentation
to the Public Works Committee, and then the Town Board.

Growth Projections - Ithaca Area Wastewater Treatment Facility: In conjunction with
the discussions between the City and Town of Ithaca and Town of Dryden regarding
the possible expansion and improvement of the wastewater treatment plant, the
Planning and Engineering departments conducted an analysis of potential residential
and non-residential growth in the town over the next 20 + / - years, and provided
projections for the corresponding wastewater treatment facility capacity needs of the
town to accommodate that growth. Based on those projections and further
discussions with the Town Board, a proposed agreement with the participating
municipalities was drafted by the Attorney for the Town.
Possible Grant Programs: The Director of Planning attended a workshop held by the
County Planning Department regarding several pending state and federal grant
programs, the most promising of which appears to be the state' s Environmental Bond
Act, which was recently approved in statewide referendum by the voters. Funds will
be available for a number of project categories, including "Clean Water Projects,"
which includes funds for local parks, open space and farmland protection projects.
Letters of interest from municipalities and organizations with potential projects have
been requested from state legislators. Planning staff is in the process of considering
potential projects . Foremost among those might be a request for funding to begin
implementation of the Purchase of Development Rights (PDR) program being
proposed as part of the Parks, Recreation and Open Space Plan. If this appears to be
to be a qualifying project, and timing of the PDR proposal would work out, a letter
of interest will be prepared for the Supervisor' s signature.
GIS: Planning staff is in the process of training other town hall and highway staff in
ArcView, which is the "user-friendly" component of the GIS system. This training
program introduces potential ArcView users to the GIS system, and provides staff
with the capability to look up information which is already digitized, do comparative
analysis on the computer, and produce maps. Each department will have staff
capable of using basic ArcView functions by the time the training sessions are
complete, which will be in about one to two months from now.
Festival Lands, Treman State Marine Park: Staff has followed up on recent Town
Board discussions regarding the proposed resolution submitted by Citizens to Save
Our Parks, in which it is requested that the Town Board urge the Common Council
of the City of Ithaca not to transfer the Festival Lands to State Parks. According to
the City' s Director of Planning, the City is not currently in the process of transferring
the Festival Lands to the State . There is no action currently before the Common
Council regarding this transfer. The City' s position is that they are not an Involved
Agency under SEQR regarding the State's adoption of the Treman State Marine Park
Master Plan, and, therefore, the City will not be preparing a Statement of Findings on
the State's Final Environmental Impact Statement. The City would not become an
Involved Ageny until some official City action relating to the Master Plan is actively
pursued by the State (such as transfer of the Festival Lands) . As of now, no actions
have been requested by the State. The City' s Director of Planning did confirm that
both the State and City are interested in a future transfer of the Festival Lands to the

State if a mutually acceptable agreement can be worked out.
Meetings /.Discussions on Pending Development Proposals: Staff has spent
considerable time during this report period on meetings and phone conversations
relating to pending development proposals. Some of the more significant proposals
include Conifer Realty's proposed low income rental apartment proposal on
Mecklenburg Road, a potential senior housing proposal off Honness Lane (appears
not to be moving forward), Cornell Lake Source Cooling Project (pending
Environmental Impact Statement and zoning request), and EcoVillage future phases
of development at Mecklenburg Road property.

SUMMARY OF KEY POINTS DISCUSSED AT
TANUARY 6 , 1997 PLANNING COMMITTEE . MEETING
1 . Agricultural Zone: Summary of Recommendations
The Planning Committee agreed that the following should be reported to the
Codes and Ordinances Committee for further action.
a. Reduce allowable density in AG Zone to 1 dwelliniunit per 7 or 8
acres, with the additional requirement that there should be ' a maximum
lot size specified for new building lots not exceding say 2 acres (unless
the Department of Health required a larger lot size for a specific
building lot and septic system) . The low density in the AG zone would
keep the overall level of future development to a minimum, thus
precluding the need to extend public sewer and water into agricultural
areas (unless there was a public health need), and helping to preserve
the rural character of agricultural areas. The maximum lot size of 2
acres for building purposes, together with mandatory clustering
guidelines, would help to ensure that prime farming areas and large
areas of contiguous open space could be preserved (i.e. , that numerous
7 - 8 acre lots would not result) . (Refer to attached article from "Zoning
News," August 1993, for further descriptions of agricultural zoning
practices in other areas of the country.) It was suggested that staff call
Lancaster County, Pennsylvania to find out how some of their
agricultural zoning provisions have worked out.
The low density suggested above would be best implemented if
supplemented by a Purchase of Development Rights (PDR) program
(see below) .
b. Strengthen Agric. Zone by:
Adding a right-to-farm provision, which would make farming the
primary land use in areas zoned for agriculture, and help protect
farmers from complaints about noise, odors, etc., associated with
farming operations . This could be done as a separate local law or
as part of the revised Zoning Ordinance. (Refer to attached
sample law from Town of Dryden, as well as section of attached
"Zoning News " article on Zoning and the Right to Farm. )
Adding other farm-related or compatible uses to the AG Zone,
such as agriculture-related commercial enterprises, wholesale and
retail nursery operations, wholesale and retail distribution of
agricultural products, and research facilities dedicated to research
in agriculture and animal husbandry. These could be allowed as
special approval uses .
Allowing roadside farm stands for the sale of agricultural
products and items produced on the premises through a
customary home occupation.
Providing for alternative uses of the land that are compatible
with the agricultural and rural character of the zone and would
not preclude future agricultural use, including acctivities such as
golf courses and driving ranges, public and private campgrounds,
clubhouses or lodges, private hunting preserves and lodges, and
logging operations (following accepted practices of forest
management).
c. Add guidelines for development on agricultural lands . (see attached
page 3 from "Preserving Rural Character" for examples) .
d. The current Ag Zone contains provisions which restrict the location of
establishments for the raising of fur-bearing animals, as well as animal
hospitals, kennels, or places for the boarding of animals (not permitted
nearer than 1 ,000 feet from any Residence District (Sections 51 (1 ) and
510). This was cited as an example of how the current Ag Zone is
more protective of residential use than agriculture, and it was suggested
that this approach should be switched around to focus on protection of
agricultural use .
e. It is recommended that the AG zone should also be extended to other
appropriate areas of the town (e.g., the Sandbank Road area and any
other active farming areas in the town). Specific areas can be studied
further by the Planning Committee .
f. Enact a voluntary PDR program as recommended in the draft Park,
Recreation and Open Space Plan, which is currently being reviewed by
the Planning Board, Conservation Board and Planning Committee. Such
a program could be set up to compensate farmers who agree to preserve
their land as permanent open space and / or keep the land in active
farming.
2. Ithaca College Planned Development Zone: The Planning Director reported
that Codes and Ordinances discussed the possibility of a Planned Development
Zone for Ithaca College, and referred the concept to the Planning Committee
for discussion. The Planning Committee agreed that the concept of a Planned
Development Zone for Ithaca College was a good one, and that the Precinct 7
Special Land Use District (SLUD) and GEIS process that had been coordinated
with Cornell might serve as a model to initiate further discussion with Ithaca

College officials. It was agreed that this matter be discussed with Supervisor
Valentino, and that a meeting with officials from the Town and Ithaca College
be scheduled to pursue the idea .
3. Parks, Recreation and Open Space Plan: The Planning Director reported that a
draft of the Parks, Recreation and Open Space Plan has been completed, and is
in the process of being presented to the Conservation and Planning Boards. It
was agreed that the Plan would be sent to Planning Committee members prior
to the next meeting, and placed on the agenda for the next meeting for
discussion. After comments are received from these three boards / committees,
A revised draft will be assembled, and sent to the Town Board to begin the
public input process .
4. Planning Committee Membership: After a brief discussion, it was
recommended that the Chair of the Planning Board for 1997 also be appointed
by the Supervisor to serve on the Planning Committee in 1997. This
recommendation will be forwarded to the Supervisor. It was also suggested
that Planning Committee meeting agendas be sent to all Planning Board and
Town Board members because of potential interest in issues / subjects under
discussion at Planning Committee meetings.
5. Change of 1997 Meeting Schedule: Because of a conflict with a Town Board
meeting, it was agreed that the April 7, 1997 Planning Committee meeting
would be rescheduled for Monday, April 14, 1997 at 7:30 p.m .

1 . Bicycle and Pedestrian Plans
TOWN : Jon Kanter presented information and a map depicting the draft Town of Ithaca
parks, open space and trail plan . Town is planning in relatively near future to hook Eastern
Heights Park to Pine Tree Road (with goal of connecting to E. Ithaca Recreation way via
Honness Lane which will require bike lane along Honness Lane) . A connection of
segments of Recreation way by constructing bike lane on or adjacent to Maple Ave is
needed. A more long term concept is to tie NE area to Warren Road with bike/ped trail
through Cornell lands in vicinity of equine research park .
CORNELL: Eric Dicke presented information and maps on Cornell plans based on 1992
Cornell Cycles report. It shows current routes and problem intersections . As roads are
rebuilt at Cornell bike lanes are being introduced. Current plans include rebuilding of
Tower Road. the B Lot and lot near synchrotron need work and there is an opportunity to
consolidate entrances from parking lot into roadways and to make bike lanes . The idea of
more "bike friendly" curbing was raised. An updated map that shows shared bike/ped
paths will be provided to the committee and a look at how the latest version of the City bike
plan may have changed from the version that was included in Cornell Cycles is needed.
Discussion with the current Cornell Bike/Ped committee (Lois Chaplin and others) is
needed. Bill Wendt will convene a group including Ellen, himself, Lois and David .
MPO: David Boyd talked about the Trails and Corridors work of the MPO. MPO role is to
compile info and plans of participating entities, encourage/enable grant applications by
providing info . The County and NYS DOT have bike policies to provide paved shoulders .
2. Possible Pedestrial and Bicycle Trail Connections in and around Precinct 7
The work of the subcommittee was presented as well as a map showing the possible
connection across Cascadilla Creek in the vicinity of Somerhill Road and the extension of
the Recreationway to the N to cross 366 and enter campus at the synchrotron and continue
with a new path up the hill to Riley Robb . Plantations has also considered a walking path
along the creek on the N side of 366 . Cornell has not yet planned the use of the Oxley area
along Rt 366, so the time to consider paths there is good . A couple of issues to consider
are cost-effectiveness of these options , especially off-road paths . Will bike commuters use
them? Should we consider signage to guide bikes along Mitchell St. to the recreation way ?
Nancy Ostman will contact CEE about possible student design project. The county (and
maybe the city) may have some old bridges available . Cornell and• the Town need to
discuss commitments both to possibly build and maintain any such paths . Gutie will
convene a group including Eric , Ellen , Jon and himself.
3 . Route 366 Intersections
The meeting with Moynihan was discussed. A .letter will be sent to Moynihan confirming
his willingness to provide more recent accident data, suggesting a sign on 366 informing of
the Caldwell Rd intersection and suggesting better lighting at that intersection. The Town
(and MPO ) will see about getting traffic counters in place ASAP to investigate traffic
counts now while Judd Falls bridge is closed (and students are still here) . A group
including. Bill, David and Jon will look at a plan for traffic counts beyond that. It may be
difficult to assess ultimate impact of any changes in JF Rd (one way , closed) while Tower
Road is closed.
4. Other
Plantation Master Plan is proceeding. The consultants have done the needs assessment and
will be presenting 3 alternative concepts on January 13 . Committee members will make
every effort to attend that presentation.

Re: Route 366 at Judd Falls Road,
Tower Road, and Caldwell Road
In response to your request, we have enclosed updated accident histories for the intersections of
Route 366 with Judd Falls Road South, Judd Falls Road North, Tower Road, and Caldwell Road.
The intersection with the highest accident rate of 0 . 70 accidents per million entering vehicles
(ACC/NMV) was Judd Falls Road South which had eleven accidents in the two year-four month
period of 9/01/93 to 12/31195 . As you know, an all way stop was installed at this site on 8/24/93 .
While the current average of 4. 72 accidents per year is a concern, it is still better than the 5 . 67
annual average we had before the all way stop .
Eight of the eleven recent accidents involved vehicles coming down the hill on Route 366
westbound. Four of these eight involved vehicles attempting to turn left into Judd Falls Road
South. A three-color signal with a standard length left turn lane would likely resolve this
problem, but this could not be properly designed as long as Judd Falls Road North is Ieft open.
The second highest accident rate of 0 . 68 ACC/N4EV occurred at Caldwell Road which had ten
accidents in three years. This location had three bicycle accidents between 5/04/95 and 8/09/95
which is highly unusual. As you can imagine, the bicyclist was injured in each instance. In view
of this situation, we will be considering additional bicycle warning signs for this location, as well
as the Caldwell Road signs discussed in our December 2') letter to Jonathan Kanter. We expect
to have specific signing recommendations ready within two weeks.
Judd Falls Road North had five accidents in three years, and only two of those occurred after the
all way stop was implemented at Judd Falls Road South on 8/24/93 . During athree-year period
prior to the all way stop at Judd Falls Road South, the Judd Falls Road North intersection had
seventeen accidents. While the new all way stop at the south may not have been solely or even
partly responsible for improving the situation at the north, the overall picture does look much
better from our perspective.

Tower Road had only two accidents in three years, neither of which involved any injuries.
We continue to feel that the closure of Judd Falls Road North would go a long ways toward
finther improving the traffic conditions in this area and would be willing to install traffic signals at
Caldwell Road, Tower Road, and Judd Falls Road South if this could be accomplished.
Please advise if you car. support this overall concept for the subject area. If not, we will proceed
with an isolated review of Caldwell Road to determine if a signal is now needed at that site.

As you mention , it is very important to gather up - to - date
accident information . In this regard , we will be updating our
information based upon records from the Department of Motor
Vehicles . At this time , their record base is current only
through December of 1995 , so please bear with us as it may take a
while to obtain sufficiently updated material .
In your letter , you identified two additional concerns regarding
the visibility of the Caldwell Road intersection with Route 366 .
Your concerns are related to signing and lighting . For signing ,
we will investigate the desirability of additional signing and
write you directly once we have made a determination .
For improved lighting at the intersection , we recommend that you
express your interest to NYSEG . Our policy precludes us from
lighting intersections , so the placement of any street lights and
all subsequent maintenance and energy costs would be the
responsibility of the Town . In this regard , you would have to
deal directly with NYSEG . We would be very willing to issue a
Highway Work Permit for the installation of street lighting at
the intersection should you decide to pursue this need .

Thank you for taking the time to meet with Ellen Harrison and me on November 19,
1996 regarding the above-referenced intersections . It is our understanding that, as a
follow-up to that meeting, NYSDOT will provide us with up- to-date accident data at
these intersections . It was agreed that it is especially important to get current
accident data for the Judd Falls Road intersection (north and south legs), since the
earlier analysis was done prior to the installation of the all-way stop signals in 1993 .

At the December 5, 1996 meeting of the Town of Ithaca-Cornell University
Transportation Committee, two potential safety issues concerning the visibility of the
Caldwell Road intersection on Route 366 were raised: (1 ) the lack of signage on Route
366 informing motorists of the approaching Caldwell Road intersection, and (2) poor
night- time lighting at the intersection. It was indicated that particularly at night- time,
it is difficult for motorists to see the Caldwell Road intersection from a distance, and
vehicles intending to turn onto Caldwell have inadequate time to prepare for the turn
with this limited visibility and with vehicles travelling at or about 45 miles per hour
(the current speed limit in this area) . The Committee asked that I forward their
concern to you, along with their request that NYSDOT look into the possibility of
installing appropriate signage and lighting at this intersection.

Northeast Subarea Studv
Client Committee Charge and Designation

The Northeast Subarea Study (NESS) represents a multi jurisdictional , collaborative transportation
planning project . As such, a " Client Committee " comprised of lead officials representing the affected
jurisdictions shall be established. The mission of the " Client Committee " shall be to provide general
project oversight and to ensure inter-jurisdictional cooperation and coordination.
Charge
At a minimum, the Northeast Connector Subarea Study " Client Committee " shall review , consider, and
make recommendations to the Transportation Policy Committee of the Ithaca - Tompkins County
Transportation Council (ITCTC) and its " Host Agency " (Tompkins County) regarding the following :
1 ) Establish a Request for Proposals: The Client Committee shall be responsible for reviewing and
approving a Request for Proposals for professional services to conduct the consultant aspects of
the Northeast Subarea Study,
2) Make Recommendations for the Hiring of a Consultant Team: The Client Committee shall be
responsible for establishing a criteria-based process by which to make a recommendation to the
Ithaca- Tompkins County Transportation Council and its " Host Agency " regarding the hiring of
a Consultant Team for the Northeast Subarea Study.
Appoint the Members of a "Working Group ": It shall be the responsibility of the Client
Committee to appoint the individual members of a "Working Group " . The Working Group will
include the "primary stakeholders " (including lead technical staff from the affected parties ) , and
thus will provide vital linkages to the community .
4) Establish the Mission and Charge of the "Working Group ": The Client Committee shall establish
the " mission and charge " of the Working Group, noting that one 6f the primary functions of this
group will be to assist in the development and evaluation of goals and objectives for the
evaluation of alternative scenarios . It is expected that the Consultant charged with developing
the study ' s " process design " will provide significant input and recommendations regarding the
role and membership of the Working Group .
5) Facilitate and Provide Community Input into the Northeast Subarea Study: The Client Committee
shall work, in conjunction with the Working Group, the Consultant and Staff, to facilitate public
involvement and input at appropriate points in the progression of the Northeast Subarea Study.
6) Provide Recommendations for the Final Approval and Adoption of the Northeast Subarea Study:
The Client Committee will provide a final recommendation for approval of the Northeast Subarea
Study to the Transportation Policy Committee of the Ithaca-Tompkins County Transportation
Council. Furthermore , it is anticipated that the Client Committee will work towards formal local
government adoption and implementation of the final and approved Northeast Subarea Study and
its findings .

Powers
1 ) Communications: The individual members of the Client Committee shall provide a
primary conduit of communication to their respective organizations . No member of the
Client Committee shall publicly represent the Ithaca- Tompkins County Transportation
Council or its Committees and subcommittees on the topic of the Northeast Connector
Subarea Study without explicit prior approval from the Policy Committee Chair.
2) Meetings: The Client Committee shall establish its own schedule of meetings as necessary
to accomplish its mission. These meetings will be open and accessible to members of the
public and will be in accordance with the approved Public Involvement Procedures of the
Ithaca- Tompkins County Transportation Council.
3 ) Officers and Subcommittees: The Client Committee is empowered to elect its own Chair
to preside over the meetings and activities of the Client Committee . The Client
Committee Chair shall be responsible for reporting all recommendations and findings to
the Transportation Policy Committee of the Ithaca - Tompkins County Transportation
Council and its Host Agency .
4) Decision Making: Actions taken by the Client Committee require a consensus of the members .
Consensus means no negative vote is cast by a member present at the meeting . An abstention
is not counted as a negative vote .
Membership
The membership of the Client Committee shall consist of the following individuals (or their designee)
representing the affected jurisdictions :
1 ) Tompkins County - Chair, Board of Representatives
2) New York State Department of Transportation - Director, Region 3
3 ) Cornell University - Vice President, University Relations
4) Village of Cayuga Heights - Mayor
5) Village of Lansing = Mayor
6) Town of Dryden - Town Supervisor
7) Town of Ithaca - Town Supervisor
8) Town of Lansing - Town Supervisor
Length of Term
The Client Committee has a limited charge and will be considered expired once its recommendation on
the overall Northeast Subarea Study has been finalized and considered by the Transportation Policy
Committee of the Ithaca- Tompkins County Transportation Council.
The charge and designation of membership for the Client Committee was accomplished on December
17, 1996 by the action of the Chairman of the ITCTC Policy Committee with the concurrence of the 41
Policy Committee membership.

Abolished Assistant Building Inspector position .
Created the Assistant Zoning Officer and Building Inspector

Welcomed Brian Cutler as the provisional Assistant Zoning Officer
and Building Inspector .
File Reorganization and Record Management
Gone through . old material , dated and boxed information for
disposition . Reviewing each Personnel file and completing a
Personnel Information Report , which makes the information easier
to find at a moments notice .
Civil Service Requirements
Certification of December 21 , 1996 payroll has been completed and
approved by Tompkins County Civil Service . Processing of
Certification for January 17 , 1997 payroll with Tompkins County
Civil Service .
Internal Controls
Human Resources and Accounting Departments are coordinating
efforts to bring all payroll related expenses into accounting
compliance .
Personnel Committee Meeting
Reviewed what items have been discussed and altered ; those items
have been put into draft form for the Supervisor to edit for next
Personnel Committee Meeting .
