At a special meeting of the Town Board of the To%:Dm of Ithaca , Tompkins County, New York held at the Town Hall , 126 East Seneca Street , Ithaca , f Jevgv York , there were present : PRESENT : Catherine Valentino , Town Supervisor ; Carolyn Grigorov , Councilwoman ; Ellen Harrison , Councilwoman ; Edward Conley , Councilman ; Mary Russell , Councilwoman ; John P . CALL TO ORDER : Supervisor Valentino called the meeting to order at 5 : 25 p . m . , and led the assemblage in the Pledge of Allegiance . AGENDA ITEM NO . 3 - CONSIDER DEPARTMENT HEADS PRIORITY WORK PLANS FOR 1997 Andrew Frost , Director of Building and Zoning - The priority report shows what the Building and Zoning Department does every day such as fire safety inspections , issuing building permits , and responding to Town complaints . In keeping with these priorities the beginning paragraph states , " Given the current workload and staging of the Building and Zoning Department , the following list of priorities has been established . The priorities consider Tirst and foremost , the Town ' s liabilities incurred by the office' s lack of action or neglect to take reasonable precautions with respect to life safety issues resulting in injury or death or incidents where there is the loss of property . " I see this as a priority of the Building and Zoning Department . Anything the department does not do may result in injury or loss of properties . The first priority is to continue to issue operating permits and conduct fire safety inspections according to the monthly fire safety schedule set up in the department with their operating expiration dates . Operating permits are issued for all areas of public assembly and apartment complexes . They are on a schedule of every three years to get a nevii operating permit . The inspections are spread throughout the year to come due when the Tire safety inspection is done . When the building is declared safe the Buildirg and Zoning Department can remove the operating permit . All other facilities have fire safety inspections even though they do not have operating permits , and the department is trying to keep track TOWN BOARD MINUTES 2 FEBRUARY 3 , 1997 of those . The Town has approximately two dozen fires a year , and the department does not want a situation to occur where there is a fire at a facility where we did not do our job . The Axiohm Business Complex and Therm are two business complexes that take a fair amount of time and are overdue for their inspections . With the staff changes in the Building and Zoning Department , these inspections have not been done . Those will be the first priority on that list . The second priority is to continue to review the building permits as the department does them . They are done in a comprehensive manner . A site Inspection Is conducted to bring those buildings through the process to a conclusion , the issuance of a Certificate of Occupancy . There are a number of building permits that get concluded with final inspection , but no Certificate of Occupancy was issued , and then it ends up being occupied . These are room additions that people have on an existing building that had a building permit due , such as for a wood stove . They do the work , complete it , and then they start to occupy the space by using it without a Certificate of Occupancy . Every month the department reviews these permits that would be expiring for that month to try to get things concluded . The Department maintains documentation of what was done , the problems found , and works with the architects and contractors . Through the process Of issuing building permits the Planning Board and the Zoning Board of Appeals review the conditions for approvals , such as the conditions satisfied prior to the issuance of a Certificate of Occupancy . The third priority is the response to all requests and complaints in a timely fashion by bringing the complaints to a legal conclusion , maintaining proper documentation , and processing the necessary citations . The Department receives a lot of complaints that are life safety issues . Bringing those to a reasonable conclusion is an important legal aspect . The Building and Zoning Department is trying to take a more active role by bringing people into Town Court . A serious violation exists where the Department issued a court appearance ticket for a person who pleaded not guilty to occupying a space without the proper certificates . The Department is also trying to appoint more people to the Zoning Board of Appeals . There are a lot of things that the department wants to do that are lesser of a life safety nature . Councilman Edward Conley - A problem that other municipalities are seeing , especially in college towns where there has been down sizing of the amount of students , is unoccupied student housing . In Ithaca there must be some student housing that is not occupied . Is this a problem ? Mr . Frost - I am not aware of that problem existing . Councilman Conley - This is starting to surface in the City and in the Town around the Coddington Road area . The colleges are pulling ' their students back into dorms if they can , so there are vacancies opening up . Mr. Frost - The Town serves places such as Hudson Heights where there are old buildings that Ithaca ed but does not want anything more to do with them . Some of the apartments College maintain yt 9 by age are less desirable . I am not a %:�yare of this problem occurring in places such as Warren R oac' Apartments or Candle%Pryck Apartments , but they may nat just cater to students . TOWN BOARD MINUTES 3 FEBRUARY 3, 1997 i Councilman Conley - When a landlords cash flow drops their maintenance and up keep appears to drop off as well . That gets to be a problem . Supervisor Valentino - The newspapers mentioned Cornell University is planning to house all their freshmen students . Landlords are beginning to get concerned about that . I do not know how many people that would involve . Councilman Conley - I did not realize there were many students who want to live in campus housing . Mr . Frost - The parking is always an issue in the college areas . Ithaca College plans to build new buildings , yet their enrollment is going down . That is a contradiction that has raised some questions . Councilman Conley - There was a newspaper article about how Ithaca College had downed sized their staff, but then they come back to build these new buildings . Supervisor Valentino - Cornell University did the same thing when they expanded the Veterinary School . Jonathan Kanter , Director of Planning - Ithaca College is not a contradiction , they are making up for inadequate space they had for some programs , such as the music building , Ford Hall , Councilwoman Mary Russell - In item number one , the fire safety inspections are done annually to certain buildings within the Town of Ithaca ? Mr. Frost - State Law mandates all areas of public assembly , which is a space that has 50 or more occupants , would require an annual inspection . There is a long list every year for inspections . The list is broken down to do a certain number each month . Areas of public assembly are done annually . Dooley Kiefer, Tompkins County Board of Representatives - With respect to 911 and the local law for street addresses and numbering , wouldn 't this be one of the high priorities? Mr. Frost - The 911 system is an on going priority , and the system is almost completed . SuperifisorValentino - The Town is working with the Fire Coordinator to comply with the 911 system for street addresses and numbering . Councilman John Wolff - What happened to the Judd Falls area with the numbering of houses ? Mr. Frost - There was a letter received stating Pine Tree Road to Judd Falls Road should be renamed . The Tovm proposed to change the section of Judd Falls Road to a solid road to Pine Tree Road . Scott Hamiitcn has not talked to the individual tenants at the Ide ' s Plaza as of yet . They would be effected the most . TOWN BOARD MINUTES 4 FEBRUARY 3, 1997 Councilman Conley - I thought they wanted to take Judd Falls Road all the way out to Route 79 ? Mr. Frost - No . The only change so/as to eliminate a section of Pine Tree Road , where Judd Falls Road and it connect as one . Supervisor Valentino - The Fire Coordinator and the Police Chief have agreed with the Town's proposal . The Town needs to check with the County . (qtr. Frost = I will check with the County Highway Department to ask how to rename a section of county road. During a meeting with Fire Department Officials , it was felt that the Town could rename it , but I would need to look into that further . Supervisor Valentino - The Fire Coordinator thought it would be the Town' s responsibility, but the Town is not sure . We need to look into changing the name of the road . Joan Lent Noteboom , Town Clerk! Director of Administrative Services - The last few years it has been busy in the Administrative Departments . Due to being so busy the Records Management Program has fallen behind . Records Management will be a major priority for 1997 , along %with the Personnel Department Items that need to be done . The Reccrds Management plan adopted several years ago is not being utilized by all staff. Some of the records that were placed in the basement are either n longer there or others have been added without my knowledge . The basement and the archival vau need to be reinventoried before indexing . This vyill take coordination with other departments , especially the Planning Department in regards to the GIS system . . Planner Geri Tierney mentioned the GIS system has some of the capabilities of the Records Management Program shows . All departments will need to work together to be ready for networking computers at the new Town Hall . The indexing system in the new Town Hall will be standardized for not only the GIS system , Planning , Engineering , and Highway , but it will also accommodate the Records Management Program . The goal is to establish a standard index system prior to moving to a new Town Hall . Hopefully , the archival records can be sent out for preservation , restoration , and microfilming before the move . Then the Town would not have to pay the expense of moving those to the new Town Hall . We may need to microfilm things such as the original maps in the Planning and Engineering Departments , The GIS system would help with the maps used on a daily basis . This is a team effort . If one part of the team does not work, the plan will not work. Without a cooperative system there would be paper records that do not coincide with the computerized papers . Part of the problem is that there is not enough staff time . Idly staff is worked right to the limit now just doing their daily functions . I hope to reorganize things within the next month to have one person out front ro wait on customers , but that is sometimes very difficult because of the amount of customers that come to Town Hall . I am not sure how far we can get with the indexing because the Information Technology Committee is recommending a switch to Microsoft Office Suite Soft%-vare . We would need to wait and see how that program fits in with the indexing system that vejas planned a fe,dv years ago . Indexing will bqAmL approArnately a three to free year component to integrate the computer technology we are working o TOWN BOARD MINUTES 5 FEBRUARY 3, 1997 r My other priority is to develop better communications with Tompkins County Assessment and Budget and Finance to eliminate some of the on going problems with the tax collection process . There were more problems this year than the Town has ever had before . The County was quick to get back to the Town to resolve these problems to our satisfaction . Meetings will be set up to discuss these issues . The biggest problem with the County has to do with closings of property that do not get recorded on a time basis . Therefore people could go almost two years before their name is changed on the tax bills . There were several people this year that mentioned their spouses have passed away , and the name has not been changed . This is the second or third year they asked to have their spouses name removed even though they filed the proper papers . Councilwoman Russell - When the property is sold , is that updated more quickly than when someone passes away? John Barney , Attorney for the Town - When the property owner changes the deed is recorded , that goes to the Assessment Office . They change those quickly. When someone dies , they do not necessarily get notification of that because there is no deed being recorded . Councilman Conley - The Tompkins County Trust Company holds my mortgage , and when my wife died there was no way of getting her name off the mortgage . They say they do not have a program for that . Mrs . Noteboom - When the Deputy Town Clerks receive tax bills with a name change or an address change , they put the changes in a feOlder to send to the Assessment Office . They also inform the property owner that they need to go to Tompkins County Assessment Office to fill out the proper forms . Councilman Conley - Are there forms to fill out ? Mrs . Noteboom - Some of the things require a form being completed , some do not . Most of the changes have to do with closings , many had not been made before the bills were printed , so they were mailed to the previous owners . There are several things that need to be discussed with the County Assessment and Budget and Finance Office . Supervisor Valentino - I think communication with the County is much better now than it used to be . Councilwoman Harrison - How is the Town planning to make use of the Tompkins County Historical Society , and how does that fit in with Administrative Ser!ices ? Mrs . Noteboom - The Town will use the Historical Society for genealogy researches and to help the Town %ooh some historical preservation of documents . They will help the Town coordinate the archival documents , and possibly house some of the Town ' s historical documents for display . 1997 was supposed to be a transition year with them to see what type of services they could provide , and to help develop some historical functions . TOWN BOARD MINUTES 6 FEBRUARY 3 , 1997 Councilwoman Harrison - The Historical Society' s contract with us does not provide services to ' include any records at this time ? Mrs. Noteboom - The Historical Society will provide genealogy research . That is why indexing is so important, we would be able to find this information much easier. When the new Town Hall becomes networked by computer we might be able to have an Internet connected to the Historical Society . Mr. Kanter - The Historical Society mentioned they would work on trying to organize a plan for archival storage for future years , but right now they do not have the storage space . SuperrisorValentino " Last year Mrs . Noteboom had very little time to spend on Records Management with all the other things going on . In 1997 we should be able to get back on track . Councilman Wolff - What are the specific requirements from the State Education Department for the Records Management System ? For example , microfilming might not be difficult to do , but expensive to maintain , where scanning could electronically maintain imagines more cheaply once the Town purchases the scanner . Mrs . Ncteboom - It would be allowable , but there are se many different records and ages of records . Scanning needs to have a clean page to work well according to SARA . So many of the old documents have tears and flaws it may not give the image they expect . Microfilming is an idea for the older records . I am willing to look at any type of technology that will bring the Town Hall up to date . SARA has not changed their standards to consider the paper archival document as the official archive . SARA still does not recognize any kind of computer technology or microfilm as the original document . Councilwoman Harrison - This would be worth looking into . Mrs . Noteboom - Any paperwork that is generated now should be thought of as history for tomorrow and 100 years from now . Supervisor Valentino - The Human Resources 1991' Priority list includes . usable time cards for employees , the Personnel Manual upgrade , and DataRite payroll modem completion . Evaluation forms were completed last year . Alfred Cargill , Secretary to the Supervisor - The Accounting Department 1997 Work Priorities are to develop accounting needs for Consolidated Disbursements . Consolidation of expenditures through the checking and saving accounts would eliminate multiple accounts . The Town has approximately 11 diferent checking accounts . The Accounting Department will be eliminating the checking accounts to Nvo . A Debt Service Fund should be established this year . Efforts will be made to get a handle on water and sewer billings . Billing , customer collections , and cash accounting can be controlled by having a direct on- line access to the billing system at Belton Point . Ccuncil:vroman Harrison - What is the issue here ? TOWN BOARD MINUTES 7 FEBRUARY 3 , 1997 Mr. Car ill - The Water and Sewer Funds are being collected as one fund through the billing process . The complication is that all the money is being deposited into a checking account . That process could be eliminated by having direct on- line access from the Town' s Accounting Department to Bolton Point's billing office . The Water Fund should be accounted as accommodating a multi collection fund for two funds . Bar coding the bills identifies what is water and what is sewer. When the bill comes into the Accounting Department , the bar code could be scanned to access Bolton Point' s on-line printouts which are already allocated for the Town . Presently there is a four to seven day delay between the Town and Bolton Point updating the remittances . Supervisor Valentino - The Water and Sewer Funds have not reconciled in many years , and even the auditors needed to make some adjustments to have these funds reconcile . Mr. Walker - If someone pays a partial payment of their bill it would automatically get credited to sewer first , then there would be no credit to water . For example , if a person pays $ 90 . 00 on a $ 160 . 00 water and sewer bill where $60 . 00 was for sewer, that sewer would be credited first leaving water short . The water would be generating finance charges for non- payment of water funds . Supervisor Valentino - The next step is to upgrade the computers . Mr . Car./ill - The accounting computer hardware and software need to be updated to better reflect standards of the NYS Comptroller' s Office . Councilman Wolff - These issues have been discussed in the Information Technology Committee , The Committee was hoping not to buy the accounting softA,vare this year , so it was not accounted for in the budget . A full report will be provided to the Town Board on specific details , including by line item what money is in the budget versus what has been spent in 1996 . The report will let this Board know what has been spent for computers . Supervisor Valentino - At the February 10th , Town Board monthly meeting there will be time set aside for the Information Technology Committee ' s proposal . If any Town Board Member has questions , feel free to contact Councilman Wolff so he can research for the most accurate information on computer programs and networking . Ms . Kiefer - Does the Town participate in the electronic features of any of the County offices? Councilman Wolff - That discussion is an item for the ne\� meeting of the Information Technology Committee . Ms . Kiefer - It would make sense to have a Town official involved on the County Committee . Supervisor Valentino - Do we know who the contact person would be at the County? Ms . Kiefer - It would be Charles Adams . TOWN BOARD MINUTES 8 FEBRUARY3 , 1997 Mr. Carvill - Is networking being introduced as one network that serves all the departments or woul each department be given mini networks ? Councilman Wolff - No , there would be a single network for everyone . The Town Hall is not networked yet because of the physical limitations of the facility. Mr . Carvill - When staff moves into the new Town Hall , under the Capital Projects , would that be expended before the move ? Councilman Wolff - That would be up to this Board to decide , but that is the idea , having staff move to a computer networked building . Mr . Carvill - Would the building be cabled for networking everyone? Councilman Wolff - Networking is easy . The expense would be the cables to connect the computers together. Mr . Cargill - Would the Town be paying for a separate licensing or multiple licensing ? Councilman Wolff - Yes , separate for the software . Mr . Carvill - Why can 't the Town buy one license for Microsoft ? Mr. Waiker - The network server license costs as much per work station as the individual licenses do . Councilman Wolff - The Town needs to decide on a software before moving into the new Town Hall . Councilwoman Harrison - Is this decision different than what this Board made through the budget? Supervisor Valentino - This Board budgeted for doing the networking and upgrading of some computers . There was not a final decision on what software is needed for the new Town Hall . The Information Technology Committee is trying to figure out what is needed , how much to spend , and how the training will work . Mr . Kanter - The top three priorities the Planning Department need to do in 1997 and 1998 were looked at as a two-year plan rather than a one year plan . Such as the completion and enactment of the Zoning Ordinance Revisions and Comprehensive Plan Recommendations . This would involve the Codes and Ordinances Committee and the Planning Committee as subgroups of the Town Board . The Committees would be updating and revising the Zoning Ordinance , which has not been done for a long time . The Codes and Ordinances Committee has made significant progress in the past year with the development of additional conservation zones . They are looking at the agricultural zone wit a new format that could strengthen the overall concept of preserving future agricultural opportunitie while assisting farmers . The Planning Committee is working on the Ithaca College education zone TOWN BOARD MINUTES . 9 FEBRUARY3 , 1997 Priority two is the adoption and implementation of the Parks , Recreation , and Open Space Plan . The Planning Department completed a draft which is in a revised stage after being worked on by the Conservation Board and the Planning Board . The plan is ready for the Town Board to look at with public information meetings for further revisions . The policy looks at aspects of land the Town wants for future park systems and those implementations . The kind of open space preservation and strategies the Town could adopt is the program for the proposed purchase of development rights . These things could cost large amounts of money , so the Town Board would need to decide these over the next few years . Priority number three is the Transportation Planning . This would include the Northeast Subarea Study the Town is involved with . The Town has been considering starting a Townwide Transportation Plan . I think the Town is at a point this year to start doing this . The update would include things like an official map amendment that has not been done since 1967 . The Transportation Committee would be looking at future road alignments , pedestrian , and bike trail connections . The Comprehensive Plan identmed potential problem areas , but did not identify details about congestion, safety problems , and inadequacies of roads . The process would start off with work programs to do the plan . The Planning Department would be working closely with Engineering , Highway , and a number of committees . I cannot put any less priority on development reviews of cr; gcing activities . The Planning Department does a lot of development reviews . The GIS system implementations were successful in 1996 . In 1997 and future years it needs to be integrated to keep it going with programs such as records management , and storm water management plans . Councilwoman Harrison - Why was the scenic viewsrvistas dropped from the planning list ? Mr . Kanter - The Conservation Board is taking that on with their own subcommittee . That is one of their priorities this year to advance the project along . Supervisor Valentino - The staff worked with the public so well during the year that the number of complaints in my office were not substantial . This speaks well for the people that are representing the Tol+m of Ithaca . The same is true for the Building and Zoning Department their zoning enforcement , and the unpleasant tasks they have to do to comply with the law . The number of complaints in my office as Town Supervisor for the . first year were few . Ninety-nine percent of the complaints received were worked out amicably with the people . Mr. Kanter = The items noted as being dropped on the 1997 Priority Work Plan are being handled on an individual basis such as the Coy Glen and the South Hill Swamp studies . The Conservation Board and the Planning Committee have prioritized those areas to be looked at . The idea of looking at all Unique Natural Areas as possible critical environmental areas involves a huge study . I am not sure ho%,v much mileage the Town would get by designating all Unique Natural Areas as critical em?ironmental areas . The Planning Department ' s recoOmmendation is to look specifically at any inch.idual Unique Natural Area that the Town feels needs additional preservation . It will take most of T0WN BOARD MINUTES 10 FEBRUARY3 , 1997 the year to do the Coy Glen and the South Hill Swamp studies . The Planning Department in the futur would continue to look at other areas . Ms . Kiefer - The critical environmental areas have been emphasized at the State level , but there . is nothing that says the Town does not have the authority to use that term . Conservation Board Chair, Philip Zarriello pointed out the Town ' s portion of the lake shore does not have special protection . It would make sense to consider this as a separate conservation zone . I do not see this listed as an Unique Natural Area . Mr. Frost - The lake shore area does have Flood Plain Protection Regulations with the Army Corp . of Engineers regulations . Councilwoman Russell - What is the end product of the transportation planning , a report or document? Mr . Kanter - Yes , probably in 1998 . In 1997 , the Planning Department would start to identify what needs to be done and get some data collected for the research . In 1998 , a report of recommendations would be handed to the Town Board for review : Councilwoman Russell - Is there an existing Transportation Plan ? Mr. Kanter - There is an existing official map needing an update from 1967 . The Planning Departme has a lot of maps showing different ideas for connector roads . The Park and Open Space Plan shove preliminary routes for bicycle and pedestrian connections , but not in a transportation sense . Mr . Walker - One of the three priorities for the Engineering Department is the new Town Hall . The second priority is the Town working with the City and Bolton Point on the Water System Master Plan . This is an important project to help formulate a more efficient way to manage water resources and provide water to the Town residents . Consultants have the inventory and evaluations for this plan . This year a critical decision will need to be made on how the Town will manage the water supply resource . The third priority is the Townwide Water Shed Evaluation which had been called for in the Storm Water Management Plan . The first thing the Town needs to do is identify - the water sheds and where the problems are . The Town has had flooding problems and there are a lot of individual incidences that are dealt with at the time of the occurrence . There is not an overall plan for the Town showing what to look for when doing the development review . The water and sewer systems in need of replacement, are part of the Water Shed Evaluation Plan . The Sanitary Sewer System Master Plan is progressing , but the water system would need to come first because of the many municipalities working on this plan . Councilwoman Harrison - Would this be done this year? Mr. VVaiker - Hopefully , this would be done this year . The northeast area mapping is being done ankh a public meeting will be held on February 25 , 199 at the DeWitt School . This would serve as informational meeting for the local residents , and to receive input of the problems in the area . i TOw1N BOARD MINUTES 11 FEBRUARY 3 , 1997 Councilwoman Harrison - The Town has talked a lot over the years about a Capital Improvement Plan . Where is that plan at this point ? Mr . Walker - The Engineering Department has a Capital Improvement Plan . Councilwoman Harrison - I have talked about this plan for years . I was not happy with it because it is misleading from a policy perspective . Mr . Walker - The Water Master Evaluation Plan needs to come first . A new water system would identify the problem areas and show what things need to be maintained on the existing service . The consultants are looking at the complete Water System Blaster Plan for the existing system and future needs . They are looking at it for the next 20 years as part of the Bolton Point System . Councilwoman Harrison - Would that be a policy issue on where the Town wants to extend water? Mr. Walker - Where the Town wants to extend water is a Town Board policy decision . The primary focus of this group plan is more a biometric need . Howe much water will be needed by each municipality at their production facilities . The City may need to produce five million gallons of water per day , but do they need to produce it at their plant or would it better to produce it from another location that would serve all the areas . An inner connect activity is definitely part of this . There would be a system wide model . For example , on the West Hiil , the Town has a very line holding the Cayuga Medical Center and Lakeside Nursing Home with a six- inch water main that is 60 years old on one pump station . They are two of the Town ' s biggest customers with the " tvio most critical life safety issues . If Ithaca College loses their �,,Yater supply , the students are sent home , but what happens to the people at Cayuga Medical Center and Lakeside Nursing Home if they lose water? Councilwoman Harrison - What is the completion date for the Water System Master Plan ? Mr. Walker - The consultants are supposed to have their draft plan to the Town by May 1997 . It will be coming to this Board and the Public Works Committee in March and April for discussion . Supervisor Valentino signed a letter stating that the Town is interested in funding these types of projects . There has been no commitment made . Councilwoman Harrison - Is the same true in terms of the Sanitary Sewer System ? The Town is not looking at major construction there . Mr. Walker - No , the Town is doing the Sanitary Sewer System ourselves in conjunction with the City , because the Town uses their system . Ceur6hrolrcman Harrison - How significant is the Sanitarf Se.Tier Blaster Plan in terms of a Capital Plan for the future ? When would this Board be putting together a Capital Plan ? iNlr. NJ!Ialker - The Capital Plan will be stared this year as of result of the reports coming in . Next year TOWN BOARD MINUTES 12 FEBRUARY 3 , 1997 we will be starting a Capital Plan for expenditures over the next ten years . Councilwoman Harrison - When the Water System Master Plan is finished the Town should talk seriously about the Capital Improvement Plan for water and sewer . The Water Shed and Storm Water Management would probably need to wait . Mr . Walker - That could be identified as they go through the planning . Supervisor Valentino - This year should be the year for the Town to start putting some Capital Plans together for water and sewer . Councilman Conley - This Board is talking about capital plans for water and sewer . Are there any other Capital Plans ? Mr . VValker - The Town has other Capital Plans . Superr4sorValentino - The Storm Water Management would cross over departments , so it is hard to be on one list. Several items might be on several Department Head' s priority list , and it Mould be my responsibility to make sure they are moving through the different departments in a timely manner . Mr. VValker - I do not think there are any major projects for capital improvements other than water an sever issues on the West Hill , and this would depend on what the land use plan is . Superiisor Valentino - As things fall into place the priorities need to be looked at again in a different way . Ms . Kiefer - Is Cayuga Heights being included in the VVater Shed Evaluation Plan ? Mr. Walker - Yes . The February 25 , meeting would be a joint meeting between the Village of Cayuga Heights and the Town of Ithaca . Councilwoman Russell - Would this Board be getting the specifics of that meeting ? Mr . Walker - Yes . There will be notices sent out and advertisements in the newspaper . Supervisor Valentino - A list will be generated of the residents in that area so they can receive notification of that meeting Councilman Conley - Has the Mayor of the Village of Cayuga Heights been involved in this process ? Mr . Walker - "Yes . " Councilwoman Carolyn Grigorov - What is the meaning of " Consider revision of Benefit Assessmen a TOWN BOARD MINUTES 13 FEBRUA ',Y3 , 1997 Formula ? " Mr . Walker - That would be a policy priority. Supervisor Valentino - The staff is looking at how the benefit assessment formula works and how it does not work . Mr . Walker - There have been some landowners with larger parcels that are interested in an explanation of what the formula has done to their assessment . There have been some interesting responses since the updates of the Benefit Assessment Formula that was done to be consistent with parcels that have not been assessed . Super/isor Valentino - The staff is looking at a formula that is not as complicated as the formula the Town has now . Fred Noteboom , Highway Superintendent - The Storm Water Management . Plan is the number one prior" to be completed this year . There are parts that have been ongoing for years . Another priority is how the Highway Department deals vajith the residents: customers when they have , problems . How should the Highway Department deal with them , and what should we be doing for them ? This is always a problem to know what to do . After listening to the discussions tonight it is clear that each department is interconnected . None of the departments would be able to function without another department . All the departments should work together to help each other out . Another priority that is important is data base and infrastructure development . There is a lot of data that is not available at the Highway Department and it makes planning our work difficult . The Town Hail is creating data that the Highvjay Department could utilize . The future holds opportunities for the Highway Department to be able to utilize them more effectively . Councilwoman Harrison - What would be an example ? Mr. Noteboom - The Highway Department needs to come to the Town Hall to get maps , and it is not easy for them to be generated . If the Highway Department wants to pave a road and change some of the underground drains , we need to come to the Town Hall for the information to go by. Through the Highway Department' s data base development we are trying to get a system in place for everything to become more routine . If this system needs changing it would be a place to start from . It is generated by the needs of the Town and the residents . The Parks and Open Space Plan is developing a capital need for parks and open space along with this system . Councilman Wolff - Are there programs that work for all the departments , or is there a specific mapping program such as the GIS system ? Mr . Noteboom - The Highway Department can use the GIS system . TOWN BOARD MINUTES 14 FEBRUARY 3 , 1997 Mr . Walker - There are two stations in Town Hall now, and a third is needed at the Highwa Department . Mr. Noteboom - The Highway Department has the capabilities of developing their own plans , then they would not need Engineering to draw plans . Councilwoman Harrison - m In the 1997 Highway/ Parks Work Plan it does not show trail construction , which 1 thought was budgeted for . Mr. Noteboom - The 1996 Work Plan has an annex attached to it for a variety of work that would be done. The annex lists the roads the Highway Department will be surface treating , and it would include the trails . Councilwoman Harrison - In this item , where would the trails be located? Mr. Noteboom - It is located in the major projects . The Highway Department plans their work ahead of time . The Highway Department is planning all the summer routes now. I feel some day the Town will be competing with private enterprises , and I want the Highway Department prepared to compete . For example , the City ended up bidding out their recycling , and they lost the bid . Mr . Kanter - Is the Evergreen Trail ready to work on this year? Mr. Noteboom M "Yes . " Mr. Kanter - If the Town works together on the South Hill Community Park it would become one of the highest priorities because that is where the greatest need is in comparison with the population . Councilwoman Harrison - Are there any Town policies in place regarding bicycle and pedestrian standards ? Mr . Noteboom - "No . " Councilwoman Harrison - This was discussed at the Transportation Committee to develop some consistent policy standards between Cornell University , the City , and the Town . I kings Like policies for accommodation for bicyclists while reconstructing roads , and what the accommodation would mean . The idea of having the crosswalks marked appropriately where they should be , or additional signage being done to inform people about pedestrian right-of--ways . Mr . Noteboom - The Village of Cayuga Heights has put up some of those signs . We have added Public Safety Improvements to the priority list this year . CeunciNveman Harrison - That is for infrastructure , but I am also talking about developing bicycle a pedsstrian policies . i TOVIN BOARD MINUTES 15 FEBRUARY 3, 1997 Mr . Kanter - The Transportation Plan will be able to articulate those type of policies . Supervisor Valentino - My three priorities for this year include a new Town Hall , working with Department Heads to move forward on the Storm Water Management Plan , and to begin developing a five -year Capital Plan for water , sewer, parks , and other different projects . During the budget process the Town Board decided to put money aside each year so we could work on a project and not have it impact us all in one year . I ' also have three alternative priorities for this year that include : continue working on finances of the Town ' s investment policies and procedures to maximize using money in a more efficient way , working with the City on a better analysis of the SJS Committee's ongoing sewer projects that the Town would eventually get billed for , and completion of the employee manual . AGENDA ITEM NO . 5 - ADDITIONAL BUSINESS , Councilman Conley - Is there a new time frame for the new Town Hall ? Mr. Walker - The Postal Service is expecting an appraisal on February 15 , 1997 . The Town is looking at reaching some accord with them at a meeting on February 27 , 1997 with their sales people . People who sell and lease postal facilities . Councilman Wolff - VVould this meeting be to discuss a purchase price ? Mr. Walker - Yes . The Town talked with the Postal Omcials about buying the building for a dollar, but they did not want that . The Town is looking to pay $ 250 , 000 . 00 to $490 , 000 . 00 for the building . That would put the Town ' s total project cost over $ 2 million . The Town Hall Committee will be meeting to discuss these options . Councilwoman Russell - Does the Town have estimates from the architect on how much the renovations will cost ? Mr . Walker - Yes , preliminary numbers are approximately $ 1 . 8 million . The Town is looking at approximately $2 million to $ 2 . 2 million for the project . Councilwoman Grigorov - The Town would be renting the building back to the Postal Service ? Mr . Walker - Yes . Whatever the Town pays for the Post Office we would need to recover in lease payments back to us . If we could come to an agreement with the Postal Service it will come back to the Town Board at the March meeting to consider a purchase offer . Then we would need to find out if this would be acceptable to the voters ? If the To,,n comes in with a project of $ 2 million , the residents of the Town would need to vote on it . Supervisor Valentino - The architect •: iill be meeting with staff to show how the space could be utilized . The Tm%/n Hall Committee will be meeting that afternoon to receive the information . ' If the Post Office TOWN BOARD MINUTES 16 FEBRUARY 3 , 1997 stays in the building , it will cost them a lot of money to fix the building . The pressure on the Posta Service to get rid of the building and to work out a lease is stronger than what they lead the Town to believe. The architect' s space analysis shows the first floor having only 8 , 800 square feet , and it was undetermined if the basement can be used for public space . In order to get the 10 , 000 square feet to meet the program we would need to enclose the loading dock area . Those costs were not included . The cost the architect gave are higher for the renovations than first thought . It was $ 124 , 000 . 00 for the first floor. The mechanics will be very expensive to do . Can the Town get the square footage that is needed to run the program at a cost , including buying the building and working out a lease , that the people in the community will accept ? Former Supervisor Shirley Raffensperger said "yes " . One of things that needs to be considered is , would the cost get to a point where spending that is in the best interest of the Town . Councilman Conley - If the basement is not going to be a good useful area , the Town should bail out in a hurry . Supervisor Valentino - The basement could be used for different things . During discussions with the County and the City it was mentioned that the space might be used for archival storage. with them leasing from us . Councilman Conley - That does not solve the Town ' s problems . Supervisor Valentino - If the loading dock could be used to get 10 , 500 square feet on the first floor, it would meet the Town ' s program needs . Mr. Walker - The problem with the basement is the ceiling height and access . Access could always be added at cost. The ceiling height is limited because it is a solid concrete structure and the concrete Iraming was a waffle type with cross beams through it . It is approximately nine feet to the bottom of the concrete . All the mechanicals of the sprinkler system and the lights are hung below that , so it would drop the ceiling heights to approximately eight feet . The public access area would not be up to code . Mr . Frost - If the area is less than 100 people , it would only require an eight-foot ceiling height . , Mr . Kanter - Would that be combined with the court and board room ? Mr . Frost - The Town would need to decide . Councilwoman Harrison - The court and board room space does not need natural light . Mrs . Noteboom - The archival storage needs would include moisture control , humidity control , and special fire alarms . Mr. Frost - Habitable space would need to have natural light , but artificial light is all that is required I TOWN BOARD MINUTES 17 FEBRUARY 3 , 1997 Councilwoman Harrison - Why wouldn ' t the basement work? Mr . Walker - Because of the ceiling height situation , but this preliminary . Supervisor Valentino - At the meeting these issues will be discussed for clarification . Councilwoman Grigorov - The question of comparing the cost of enclosing the back with developing the basement should be clarified also . Mr. Walker - We could have it , but it would be more difficult to do because of the access limit . There are three stairways into the basement with one stairway not meeting legal codes . Councilwoman Harrison - How to get people in the building legally would be the issue ? Supervisor Valentino - "Yes . " Discussions at the meeting would need to include these issues for clarification . The Town Board Members decided they will tour the Post Office before the February 10 , 1997 meeting . Councilman Conley - Does the Federal Government know that they would be leasing the space from the To:Nm ? Mr . Waiker - Yes , they do . The Federal Government would rather lease than ovum the building . Depending on how the construction worked and what services are provided , they would pay fair market value to lease the space . Supervisor Valentino - At the last meeting with the Postal Service , they had not done their needs assessment , then George Welch showed up from the Postal Semite . Mr . Welch was asking the right questions , and I felt encouraged after talking with him . At the February 27 meeting , the Attorney for the Town and the Accountant will be present to help put together the cost and legal issues . Mrs . Noteboom - Did the Postal Service give a time frame of how long it will take to declare the building surplus property? Supervisor Valentino - They do not have to declare the building as a surplus property . Mr . Walker - If the Town gave them a purchase offer and they could accept , the process could be started within 30 days . Mrs . Ncteboom - Are there problems architecturally with remodeling because the building is historical? TOWN BOARD MINUTES 18 FEBRUARY 3 , 1997 Mr . Walker - They are particular on what we could do on the outside , and I do not think we will b changing the outside . The lobby is the most historic . part with the back just a warehouse . Mrs. Noteboom - Is there any restoration needing to be done that we do not know about . That would add to the cost . Supervisor Valentino - That is something that Doug is aware of. There will be a full report at the February meeting . Mr. Walker - If the Town gets the building signed over by March or April , there would be another six to nine months to get the design and construction underway . The earliest the Town would be able to occupy the building would be January 1 , 1998 , but March 1 , 1998 would be more realistic . AGENDA ITEM We 4 - 1997 TOWN OF ITHACA WORK PLANS : IDENTIFIED BY TOWN BOARD BASED UPON PRIORITY LISTING AND RECOMMENDATIONS OF THE DEPARTMENT HEADS. Supervisor Valentino - Does the Town Board agree with the Priority Plan lists that were presented? The Town Board was in agreement with Supervisor Valentino on the Priority Plan lists presented . Councilman Wolff - I am happy to see these lists fairly progressive with respect that none of the things are major disasters the Town needs to clean up . The Town is moving forward . I appreciate the work that was been put into these lists by the Department Heads . The Information Technolog Committee will not always solve the problems , but they will find a way to deal with things by recognizing an ongoing process . Councilwoman Russell - I was happy with the lists that came forth , especially from the Planning Department saying that the Comprehensive Plan and Zoning Ordinance revisions are top priorities , as well as the Park Recreation and Open Space Plan . Councilman Conley - I like the direction that everything is going in , but I would be happier when the Town gets to the point of putting away money for Capital Projects . The priority lists give the Town some idea of where these improvements are going . There is a lot of work involved in doing this . Councilwoman Harrison - I agree with everything that was said tonight . Councilwoman Grigorov - I also agree with everything that was said tonight . Mr . Frost - The Sprinkler Ordinance will be one of the hottest issues this year . Supervisor Valentino - This ordinance will be implemented in July 1998 . Mr. Frost - Supervsor Valentino and I will be working en modifications to the sprinkler law . A gro TOWN BOARD MINUTES 19 FEBRUARY 3 , 1997 from the Home Builders and Landlord Association was going to have Mr . Lucente put together a written document telling the Town what they do not like and want they vivant to see . This document has not been received yet . I am in the process of contacting George Guestine and Jean Chadrick who were on the Committee representing the Home Builders and Landlords , to say the list has not arrived from Mr . Lucente . Supervisor Valentino - We decided that since they were the ones pushing this the burden would be on their shoulders . They have not done the work they were supposed to do and they have admitted to that . In the meantime , when Longhouse , Incorporated came before the Zoning Board of Appeals asking for a variance from the Sprinkler Law we thought they had sound reasons , such as access to the building . This could not be an exemption for them . The Zoning Board of Appeals turned down the appeal. I mentioned to Mr. Frost that some of these exemptions make sense . If we think things are reasonable adjustments then we should move forward with them now . Mr . Frost - The concern is that it only takes one fire in one of those buildings , and the whole thing would be gone . Councilman Conley - 1 would like to wait and see what the Home Builders and Landlord Association comes up with . Councilwoman Grigorov - I think the Town should be reasonable to begin with . Councilwoman Russell - Is this a State Law? Mr . Frost = No . It is a local law that was established in 1986 when former Supervisor Noel Desch recognized it through contract talks with the Fire Department the desire to have a more restrictive town ordinance requiring sprinklers . At that time there were two municipalities in New York State that already had a local law in place that was accepted by New York State . In New York State , if there is a more restrictive building code required for sprinklers there would need to be a process of review with the New York State Code Council . If they say the To%Pjvn ' s law is fine , then it is a lave . If they do not agree with the Town ' s law , then there is no law . Since that time there are 22 municipalities in New York State with a more restrictive sprinkler regulation . The law did require a retrofit requirement that in ten years , which would be July 1998 , all existing apartments , public assemblies , restaurants , day care centers , hospitals , etcetera have sprinklers . The hospital and Lakeside Nursing Home have the sprinkler systems . The Ithaca Child Care Center has a sprinkler , but the Coddington Road Day Care Center does not . Almost all the apartment houses in the Town have sprinklers . Councilwoman Russell - The question for this Board is %whether we want to consider taking a certain number of exemptions ? Supervsor Valentino - Not exemptions at this point , some modifications in the law so they would not need to go to the Zoning Board of Appeals to ask for these exemptions . TOWN BOARD MINUTES 20 FEBRUARY 3 , 1997 Councilwoman . Russell - Then this would need to be re- approved by the State? Mr. Frost - No , I do not think vie would need to go back to the State to weaken the law , but to make the law more restrictive , `eyes " . The issue would be if this Board want to take the initiative without the Home Builders and Landlords bringing forth the list . Supervisor Valentino - This Board might not agree with their list . Mr. Frost - The initiative would be to soften the law so some of the buildings , such as a three-family wood frame structure of two stories , would not have to put a sprinkler system in . There are a lot of three unit buildings in the Town of Ithaca . The Zoning Board of Appeals was concerned about the Longhouses being off the path of Elm Street Extension . The driveways were long and made of dirt , and they were concerned about access to the building . Supervisor Valentino - If the Town Board looks at this and start reviewing modifications the Fire Department would be here begging the Board not to approve modifications because of safety reasons . There would also be pressure from other people who were already told that the Town would not approve their building without a sprinkler system being put in . If the Town Board stays focused there should not be to many problems . The modifications could be for reasonable adjustments for some smaller units that seem to be reasonably safe , but where the law might be too restrictive . Mr. Frost - My intent is to notify building owners in July to say that the clock is down to one year . I net think that this Board wants to wait that long before considering changes or exemptions to the loo Iaw . Supervisor Valentino - That is correct . Councilwoman Harrison - Could Mr . Frost make a presentation to the Town Board that would list the least risky type of units that might be exempt ? Mr . Frost - If money was not the issue , then the modifications would not need to be changed . Councilwoman Harrison - Money is the main issue ? Superrisor Valentino - Mr. Frost and I could put something together for the Town Board to review and discuss at a later date . Mr. Kanter - The Town does have an application into the State for a joint local water front revitalization plan with some of the other joining communities . If that program is funded by the State that would be another planning process the Town would be involved in . A consultant would be doing most of the wori<. I have also included a copy of the summary of "Major Accomplishments in 1996" and "Challenges for 1997" which was included with the Planning Department' s 1996 Annual Report. Each Department Head was asked by the Supervisor to highlight the top three 1997 priorities for each department. I anticipate the Planning Department' s highest priorities to be in the following areas: 1) Completion and Enactment of Zoning Ordinance Revisions and Comprehensive Plan Recommendations This involves continuation and completion of the work with the Planning Committee and Codes and Ordinances Committee on comprehensive zoning revisions, including establishment of additional Conservation zones, strengthening and expansion of the Agricultural zone, and consideration of a new Ithaca College Planned Development zone or Institutional zone, as part of the overall update and revision of the Zoning Ordinance. 2) Adoption & Implementation of Parks, Recreation & Open Space Plan This involves the official adoption of the draft plan, which was completed in 1996, including public information meetings and hearings, revisions and editing of the plan, prioritizing future park projects in a Capital Plan, and implementing a purchase of development rights program (PDR), among other measures . e —2- 3) Transportation Planning This includes participation with the MPO and involved municipalities in the Northeast Subarea Study, as well as the initiation of the town's own Transportation Plan, both of which will provide guidance to town officials on future transportation decisions, including updating the town' s official highway map, identifying possible future road alignments and pedestrian and bike routes, and recommending solutions -for congested or unsafe roads or intersections, extensions of existing transit routes, and other long range transportation demand management options, such as park-and-ride lots, etc. Both projects will involve work in 1997 and 1998. The Town of Ithaca-Cornell University Transportation Committee has already begun to look at some of these issues in and around the Precinct 7 area. I look forward to discussing these and other Planning Department priorities with Board members at the February 3rd Town Board meeting. Att. The priorities consider first and foremost , the Town ' s liabilities incurred by the office ' s lack of action or neglect to take reasonable precautions with respect to life safety issues resulting in injury or death or incidents where there is the loss of property . In this regard , documentation and type cord keeping is also imperative . A Type 1 priority takes precedent over Type 2 . 1 1 ) Continue to conduct fire safety inspections and issue operating permits according to the monthly fire safety schedules set up for the department and the operating permit expiration dates ( including the Axiohm Business Complex and Therm ) .
