At a Regular Meeting of the Town Board of the Town of Ithaca , Tompkins County, New York held at the Town Hall , 126 East Seneca Street , Ithaca , New York there were present : PRESENT : Catherine Valentino , Town Supervisor ; Carolyn Grigorov, Councilwoman ; David Klein , Councilman ; Ellen Harrison , Councilwoman ; Edward Conley, Councilman ; Mary Russell , Councilwoman ; John P . CALL TO ORDER : Supervisor Valentino called the meeting to order at 5 : 30 p . m . , and led the assemblage in the Pledge of Allegiance . Supervisor Valentino introduced three new employees to the Town Board . Judith Drake as the new Human Resource Specialist . Alfred Carvill as the Secretary to the Supervisor, who will be working with the Town Supervisor with the accounting and the budget processes . Dennis Ellsworth as the new Assistant Building and Zoning Officer , AGENDA ITEM NO. 3 - REPORTS OF TOWN OFFICIALS A. Town Engineer - See attached . Councilwoman Ellen Harrison - There have been questions regarding the Tire at EcoViilage and the water supply on West Hill . Some people from EcoViilage have mentioned concerns regarding the water issues. The Town Board needs to look at this and think about the implications . It has been the desire of this Board not to run additional water to West Hill because of the agricultural land usage . The Board should explore this to understand what has happened , and what the implications might be . Supervisor Valentino - The Town Engineer has mentioned this in his report including that the water pressure on West Hill will be an ongoing concern . TOWN BOARD MINUTES 2 DECEMBER 9, 1996 Director of Engineering Daniel Walker - A report was given to the Planning Board outlining how many difficulties the fire department had with the EcoVillage fire . This would be a typical problem in a rural setting . The Planning Board is concerned about access and availability of water for projects with a high density of buildings . Councilwoman Harrison - That should have been considered when the Planning Board approved the project. Some of the EcoVillage people mentioned it took the Fire Department twenty minutes to locate the dry hydrant . Mr. Walker - I arrived on the scene shortly after the Fire Department arrived . The location of the hydrant was changed and it is not on a hard road surface , that is a concern . Supervisor Valentino - The Town has had meetings with the Fire Department and there are ongoing discussions to resolve these concerns . Director of Building and Zoning Andrew Frost - Two meetings have been scheduled . One is for the water issues , the second meeting will be between the Fire Department , myself, and EcoVillage residents in regards to the fire . AGENDA ITEM NO. 6 - REPORT OF FIRE COMMISSIONER . Bob Romanowski , Board of Fire Commissioners - Highlights from last month's meeting were as follows: 1 . Approval of administration for an assistant for finance . 2 . There is a zero increase in the 1997 Budget . 3 . The Fire Commission has a newly appointed and final member on the Board , Paul Alexander . 4 . The Fire Commission received a $50 . 00 donation in the memory of the five children who died on Danby road . 5 . A hydraulic rescue tool was donated to the Fire Commission for Station 5. 6 . Statistics until the end of November for the Town of Ithaca and the City of Ithaca show that there have been 167 fires (6 % of the calls) ; total rescue/ EMS , 715 ( 26%) calls ; hazardous condition calls , 253 (9%) , service calls , 155 ( 5% ) ; and false alarms , 1 , 353 (49 . 5 %) . For the month of November the City of Ithaca had eight fire calls and the Town of Ithaca had 11 fire calls . Cornell University had one fire call and Ithaca College had two fire calls . Total property losses for the month of November were $ 1 , 915 . 00 of which approximately 95% was EcoVillage . Councilwoman Carolyn Grigorov - Were 6% of the calls actual fires? Mr. Romanowski - Six percent were structure fires . There were 167 fires until the end of November for the Town of Ithaca and the City of Ithaca . The false alarms consist of 135 malicious false alarms , four bomb threats with no bombs , 478 system malfunctions , and 736 unintentional false alarms . Mr . Frost - Is there is a comfortable degree of confidence separating the malfunctions from good intentions ? Mr. Romanowski - Yes. In the reorganization plan the Fire Chief produced Cornell University only had TOWN BOARD MINUTES 3 DECEMBER 9, 1996 one call because they have a quick response from Cornell Safety . Cornell Safety let the Fire Department know whether to rush to the call or slow their response . The hydrant at EcoVillage was to far from the scene to hook up to , and that is why they did not hook up to that hydrant . The ground conditions would not support the heavy truck so the Fire Department started to fight the fire without connecting to a hydrant. They started fighting the fire , and then as other equipment arrived they made a hydrant . Ithaca Fire Chief Brian Wilbur' s letter was read aloud to the Town Board , see attached . Councilman David Klein - What does Chief Wilbur mean by the Town needing a fully staffed code department? I thought the Town already had one . Mr. Romanowski - That question would need to be answered by Chief Wilbur. There are concerns about some of the building that goes on in the Town of Ithaca and the City of Ithaca that should be addressed . Chief Wilbur will be setting up a meeting with the Town to discuss those issues . Chief Wilbur also wanted to express this request has nothing to do with Mr. Frost' s work ability. Councilwoman Grigorov - Has any official recognition been made to the Fire Department for their efforts at EcoVillage ? It would be nice to do a letter to expressing the great job they did . Mr. Romanowsk i - Supervisor Valentino has copies of all the letters that have been sent to the different departments that participated in the EcoVillage fire . There was approximately a million dollars worth of damage done to EcoVillage. It was an amazing stop by the departments , it could have been worse . Supervisor Valentino - I went to the fire station the next day to personally thank the Chief and the Department for saving EcoVillage . AGENDA ITEM NO. 6 - REPORT OF TOMPKINS COUNTY BOARD OF REPRESENTATIVES . Tim Joseph - The County has finished their Budget . There are youth related items that the Town would be interested in . The County passed a resolution to continue another three years on the Youth Partnership Pilot Program . There are considerable concerns the County Board has about whether it is a pilot or if this is just three years towards permanency. Most of the members on the County Board think that this was a request for three years then the funding will go away. Now there is talk about more years . There is misinformation about the youth development programs at the City Youth Bureau . It started when the Mayor mentioned that 60% of the children are from outside of the City and the County is only paying 40 % of the bill . That is an over simplification of the situation and the history . The County has an obligation when it provides programs to youths in the County , and there is no reason to expect the City to independently pay for youth in the City. If 40% of the children came from the City then they, should pay 40% of the bill . Several years ago , the County proposed paying 100°x6 for the services they wanted to provide because the County could not afford all the services that the City was providing . The City told them not to do it that way , but to give them a certain amount of money to spread among all the programs . Ina real sense , the County was paying for more than the Citys share, but they did it in a good faith attempt to provide more services . NEW YORK 14850 OFFICE OF TEL (607) 272-1234 FIRE CHIEF FAX (607) 272-2793 MEMORANDUM To: Bob Romanowski , F' e Commissioner From : FC Brian Wilbur Re: December Town Bo d meeting Date: 09 DEC 96 Some items that I think the Town Board could benefit from knowing are : 1 ) The Ecovillage fire pointed out several concerns for the fire department, including , but not limited to : the need for upgraded and expanded municipal water supplies on West Hill ; the need for improved communication on code enforcement issues ( I believe this requires more people , one in the fire department , and a fully staffed code office in the Town - this is not a reflection on Andy Frost or the quality of his work) . As a note to this : Many Ithaca career, volunteer, and bunker fire fighters worked very hard to contain this fire . Ecovillage , and the Town of Ithaca in general truly benefitted from the expertise and dedication our fire fighters bring with them to the service they provide . The Town can be very proud of its fire fighters . During the Ecovillage fire , many area fire departments provided mutual aid ; some to the fire , others to standby. As the Ecovillage fire raged , another house fire on East King Road was extinguished by personnel and equipment from Ithaca , Cayuga Heights , Dryden , and Brooktondale . Intermunicipal cooperation at its best! 2 ) Fire Department budget status : As of this writing , the Fire Department is approved for a zero increase budget , which means that only contractual ( labor agreement) raises are included and most other lines are held at 1996 levels . Although our full budget submittal requested ten additional fire fighters , one assistant chief for code enforcement , and one administrative assistant- financial , it appears the department will be approved only for an additional position in the administrative office , which is the "administrative assistant - financial" position . n 'An Equal Opportunity Employer with an Allirmalive Action Program' taRecycled Paper Bob Romanowski 09 DEC 96 page 2 As you know, the contract between the City and Town requires the Town to agree to any new positions , or they don' t contribute to the cost of the position (s) . I have talked with Kathy Valentino and Dominick Cafferillo on this . It looks like the best way to proceed is to plan on having specific budget details and an addendum to the contract ready for the Town Board to authorize at their December 31 , 1996 meeting . This would be in their hands prior to the meeting . Another budget highlight comes from the capital budget which authorizes four automatic external defibrillators (AED ' s ) for purchase in 1997 . If , as you advocate , the Town decided to purchase one , we could equip all in-service engines , including both town stations , with these life saving devices . 3 ) New Rescue Tool purchase A grant has been received for the purchase of a hydraulic rescue tool (Jaws of Life) for South Hill Station . The donor wishes not to be identified publicly. This tool will enhance our ability to provide rapid and effective rescue services on South Hill . In light of the many motor vehicles accidents in that area recently , the timing is particularly useful to us . - 4 ) Hazardous Materials Team The Ithaca and Cortland Fire Departments are working on entering into a cooperative agreement to support a joint hazardous materials response team . Once formed , the improved capability this venture will develop will be available to either community , including the Town of Ithaca . This is still in the formative stage and so additional information will be forthcoming as it becomes available . Ultimately , to insure that we are doing all that can be for the safety and well being of or town residents and our fire fighters , a meeting to review the Ecovillage issues and to look ahead would be very helpful . TOWN BOARD MINUTES 4 DECEMBER 9, 1996 youth. The County has agreed to put enough money towards the programs they want to fund for the next six months . There are some programs the County wants to provide that the City does not want to provide . The question is how much could the County provide , and how could the City operate for less money . Councilwoman Grigorov - What kind of programs would the County want that the City would not want ? Supervisor Valentino - When funding was getting tighter and there were some programs that seemed marginally effective , the County mentioned they needed to set priorities because they cannot fund everything. The hope was that the City would feel the same way, and they would set some priorities . There might be some programs that could be stopped because there are few youths engaging in these programs . Priorities are difficult to set , everyone needs to decide what is an effective program meeting the needs of certain children . Mr. Joseph - A program that turns two or three children away from a path leading to jail can be worth a lot of money but it has to be shown . There are some people in the County who think that the City never did, or was never willing to do a thorough evaluation of their programs . There are people in the City that disagree with that . Supervisor Valentino - It seems the six-month evaluation would be the best approach . Councilwoman Harrison - What has happened with the Warren Road rebuilding project ? Mr . Joseph - It was taken out of the budget capital program for this year. The people who had questions about it did not get their questions answered . The people who think it is really important need to go ahead . They did not say they were not going ahead this year, but they are putting it off a year . It is not on this year's agenda . It is planned for next year. Councilwoman Mary Russell - What was the funding level the County approved for the Recreation Partnership? Mr. Joseph - It was $35 , 000 . 00 a year for three years . AGENDA ITEM NO 8 - PERSONS TO BE HEARD • Dora Higgins , Citizens to Save Our Parks - The Board was provided with a proposed resolution , a map , fact sheets , and copies of pages from Tompkins County . The proposed resolution urges Common Council of the City of Ithaca not to transfer city land (the festival land and parcel B) to the Finger Lakes State Park so a new entrance road could be built to the Allen H . Treman State Marine Park. The proposal to build a new entrance road is part of the 1996 Final Master Plan and the Final Environmental Impact Statement for the redesign of Allen H . Treman State Park . It has been mentioned that the Town prefers not to interfere with the City of Ithaca's decisions . This decision would affect the Town ' s constituents as users of Allen H . Treman State Park and as taxpayers of the TOWN BOARD MINUTES 6 DECEMBER 9, 1996 State of New York. The Citizens think it would be appropriate for the Town to speak out on this matter. The Finger Lakes State Park representatives gave two reasons for needing the new entrance road , for safety reasons and to stop cruising cars for security reasons . The safety factor could be easily taken care of without a new road by placing no parking signs along the entrance road from Route 89 to the first intersection of the park . This was the solution suggested by the State Park representatives themselves in the 1992 and 1993 drafts . This could be done with minor expense and no environmental damage to the wet lands . The proposed road would be less safe than the present road that exits from the park going south . Stopping cruising cars for security purposes could be done on the land that is now part of Allen H . Treman State Park . They do not need to acquire City land to build a new road to stop cars cruising . The proposed road is on isolated areas away from Cass Park and the Hanger Theater activities . It would be less safe in those terms . They do not need to build a new road at the taxpayers expense . They could put in a contact station on the land they own now . As one of the many constituents using Allen H . Treman State Park with much enjoyment for the past 30 years , I urge the Town Board to urge the City not to give away ownership of city lands . Doing so would adversely affect not only the Town' s constituents , but the constituents of Common Council . The 1966 Memorandum of Understanding written when the City gave the State Park the acreage specifically states , " that the parties hereto will have common use of all roads constructed by any of the said parties ." For the State to violate their agreement is something that this Board should protest . Others who have spoken out against this new road , include the Tompkins County Environmental Management Council , the League of Women Voters , the City of Ithaca Conservation Advisory Council , and the Citizens to Save Our Parks . In addition , New York Parks and Conservation Associations have felt it would be inappropriate to spend large sums of capital funds on expanding facilities that would only help the patrons of the park . This Board does not have to vote on this issue tonight , but you should think about this information to make a decision later on . The Common Council will be absorbing the information before making a decision . Supervisor Valentino - When will the City Common Council be considering this ? Ms . Higgins - The State Park people usually make a finding statement the day after the comment period is over , that was August 30 , 1996 . Once the State Park people make their finding , the City needs to make a finding . The City can adopt the findings of the State Park , which would make it very quick , or the City could take their time to write their own findings . Councilwoman Harrison - Did you provide these comments to the State Park representatives so it would be part of their findings? Ms . Higgins - "Yes . " Councilwoman Harrison - The agreement with the three parties talked about shared uae of all the roadways . The drawing shows the new roadway going into the marine , and being exclusive ? Ms . Higgins - They are saying they want to curtail traffic , which means to stop people that go in to cruise around and exit again . TOWN BOARD MINUTES 6 DECEMBER 9, 1996 Councilwoman Harrison no Are they proposing to have someone at a gate to keep people out? Ms. Higgins - Earner plans has contact stations at certain locations . There have been a lot of changes in these plans . The Memorandum of Understanding stated that there would be no charge for picnicking or parking , but in the 1992 plan it states that they would start to charge once the 1957 Memorandum of Understanding expires . Councilwoman Harrison - Who are the three parties to the Memorandum of Understanding? Ms . Higgins - The Hanger Theater , the State Park, and the City of Ithaca . Director of Planning , Jonathan Kanter we There is a Final Master Plan for the Allen H . Treman State Park which includes the Environmental Impact Statement dated 1996 . All of the contents Ms . Higgins has mentioned are in this document , plus more . Stan Seltzer , President Forest Home Improvement Association - The Association supports the proposal of the transfer title for the Forest Home Walkway to the Town of Ithaca . The Association wanted to thank the Town for their efforts in maintaining the walkway . Attorney for the Town , John Barney - I do not have any additional information since the last meeting . AGENDA ITEM NO . 3 on REPORTS OF TOWN OFFICIALS ( CONTINUED ). Be Highway Superintendent on See attached . C . Director of Planning on See attached . Mr. Kanter - People have been asking about the Saddlewood Farms proposal . Saddlewood Farms submitted a letter approximately two weeks ago officially requesting that their application be withdrawn . That was the proposal on Mecklenburg Road directly opposite EcoVillage . The Cornell Lake Source Cooling Project is nearing completion of the Environmental Impact Statement . When completed it will be circulated for public comment . The Town of Ithaca Planning and Engineering staff have met with Cornell's engineers to discuss some details of the water line route through the Town of Ithaca . The route passes through the school district properties and along East Shore Drive to Lake Street. Cornell has had discussions with different school district parties and some of the residents of the area to inform them they are prepared to incorporate into their plans some sidewalk improvements in that area . People have made comments indicating a need for sidewalks in that area . D . Director of Building and Zoning - See attached . Councilwoman Russell on Mr. Kanter' s report mentioned a request for a variance from the sprinkler local law for the Longhouse Cooperative . In light of the EcoVillage fire , what happened to this request? TOWN BOARD MINUTES 7 DECEMBER 9, 1996 Mr. Frost - The case was heard by the Zoning Board of Appeals on November 13 , and was denied by the Board . The applicant will be coming back to the Zoning Board of Appeals with new information . The Town has eight fire or emergency occurrences during the month of November. The EcoVillage fire destroyed four buildings . Three of the four buildings were two family homes . There were two instances at Ithaca College one destroyed a dorm room , and the other fire was confined to a balcony. There was an electrical situation at Cornell where a ceiling fixture was smoking . There were two house fires. One of the fires damaged a living room when a candle tipped over and started the couch on fire . The second fire was on Troy Road and was started when refinishing oil ignited a wood stove . One of the four unit apartments on Sapsucker Woods Road caught fire from an electrical fire that started in the mechanical room . It destroyed all the utilities in the mechanical room and a portion of the garage . The building is now unoccupied . There was a heating oil spill at Broome Development on Trumansburg Road is under investigation with DEC . Councilwoman Russell - When a wood stove goes into a house and it is not part of a renovation , does the Town automatically inspect it? Mr. Frost - Only if the Town is called . The State Building Code requires that any solid fuel burning appliance needs a building permit . Wood stoves are added to the requirements . Any time a wood stove is installed , a building permit is supposed to be issued . This is not always the case . Several years ago , the Town sent a mass mailing to all the installers notifying them of the code requirement . Many contractors in the area are not used to getting a building permit to install wood stoves as many municipalities do not push the issue . A local dealer was upset because a suggestion was made for him to get a building permit in the Town of Ithaca . He does not get one any where else . Councilwoman Harrison - Is that a State Law? Mr. Frost - "Yes . " Councilwoman Russell - Does the City get compliance ? Mr. Frost - I am not sure how much compliance the City has . It is the State Law and it is required for a coal stove as well as a wood stove . The Building and Zoning Department has issued two permits for these appliances during November . Councilwoman Russell - Are you getting more cooperation from certain businesses than from others? Mr. Frost - Not at all . There are two primary wood stove installers in the area , and they cooperate sometimes . Councilwoman Grigorov - Who is responsible for notifying the Town about these installations ? Mr . Frost - The homeowner should notify the Town because it is their stove and contract . TOWN BOARD MINUTES 8 DECEMBER 9, 1995 Councilman Klein - The next Newsletter from the Town should include this topic . Mr . Frost - Some of the past Newsletters have included this topic as a reminder that the heating season was approaching . Councilman Edward Conley - If a contractor installs a wood stove , does the contractor have to get the permits? Mr. Frost - The permits are always issued to the homeowners . In many cases , the contractor files the application with the Building and Zoning Department in the homeowner's name . Councilwoman Grigorov - How much is the cost of the permit ? Mr. Frost - The cost of the permit is approximately $25 . 00 . Councilman Klein - What is the deadline for compliance for the Sprinkler Law? Mr . Frost - July 1998 . E . Town Clerk/Director of Administrative Services - See attached . Joan Lent Noteboom - The State of New York Legislature has changed the requirements for getting a handicapped parking permit . Previously, a Town Clerk could issue a handicapped parking permit to anyone in the State as long as they provided the documentation from their doctor. Now, the State is stating that the handicapped parking permits can only be issued to our own residents in the Town of Ithaca . The State is doing this because they have had a lot of problems with enforcement and people using the permits inappropriately. The State wants to cut down on misuse of the parking permits . Supervisor Valentino - At the last meeting , there was a couple who spoke about the equalization rates . There has been some correspondence with the County about the county wide _ equalization rates . The resolution and law have been approved for Tompkins County to have one rate . The Town will see some variations next year because it is a two-year plan, with the State to get everyone at the 100% rate that the County assessment uses . Then each Township would have the same equalization rate . The County has sent a letter to the State on behalf of the Town to review the equalization rate , which was too high this year. AGENDA ITEM NO. 4 - REPORT OF TOWN COMMITTEES. Councilman Wolff - The ADP Committee has begun the process of developing a training and orientation plan . It looks like March will be a good time to begin implementing the training plan . The plan would consist of training in the use of windows and a common software package . All the Town employees would be familiar with the protocols , file standards , and the use of their software . This IN TOWN BOARD MINUTES 9 DECEMBER 9 , 1996 would help productivity . Councilwoman Russell - According to the minutes of the last Recreation Partnership meeting , the voting ratios will remain at their current levels . Mrs . Noteboom - The points the Town Board made were mentioned at the Recreation Partnership meeting. It was decided to leave the current levels as they are . The members did mention that they wanted to try to write new bylaws for the Recreation Partnership . Councilwoman Russell - At the last meeting of the Citizens Advisory Committee the ground rules for the group were ratified by the Committee . (AMENDMENT ADDED - TB MTG. 12131196 - RESOL. NO . 212(x) - Councilwoman Russell - At the last meeting of the Citizens Advisory Committee (Come/1 Incinerator) the ground rules for the group were ratified by the Committee.) Linda Finley from CDRC emphasized how extremely important it was for the representatives on that committee to keep their constituenices informed as this process goes on . What are the Town Board's thoughts on howto do that? Perhaps articles in the Newsletter would be important so people can be advised of the process as it moves along . Supervisor Valentino - The Town needs to keep track of the newspaper articles in the Ithaca Journal to make sure that the residents are informed correctly . Councilwoman Russell - The representatives on the committee went through an interest identification and expressed their important interests . These comments are being compiled to send to the representatives on the Board for discussion . (AMENDMENT ADDED - TB MTG. 12/31/96 - RESOL_ NO. 212(a) - These comments are being compiled to send to the grroyM who are represented on the Board for discussion. ) Councilwoman Harrison - When is the next meeting of the Citizens Advisory Committee? Supervisor Valentino - December 16 , 1996 at 6 : 45 p . m . in the Hagen Road at Cornell University. Councilwoman Harrison - The Cornell and Town Transportation Committee discussed having engineering students look into the potential link between Summer Hill Lane across Cascadilla Creek to the Library Annex on the Precinct 7 property , the bicycle/ pedestrian link . One issue John Gutenberger raised was that there should be discussions between the Town and Cornell University in regards to who would build and maintain the link . The Committee is only looking at this as an option, and Mr. Guttenberger wants to set up a clearer policy to see if the Town is interested . Through discussions with the DOT regarding the traffic light on Judd Falls Road an agreement was made to get further information on updated accident reports to see what has happened since the signal light at Judd Falls Road was installed . Councilman Klein - When the Codes and Ordinances Committee finishes the zones on the Zoning Map it will be handed out for general review . The Public Works Committee has discussed the TOWN BOARD MINUTES 10 DECEMBER 9, 1996 Highway Work Plan for 1997 . Under the phasing plan the Highway Superintendent mentioned Bluegrass Lane was on the ten-year repavement plan costing $45 , 000 . 00 , 1 asked the Highway Superintendent why the Town would be paving Bluegrass Lane for Cornell University? The Highway Superintendent , in 1988 , wrote a declarative statement stating that Bluegrass Lane is a Town road . It is listed under the State Highway Inventory as a Town road . The Public Works Committee wanted to know how to remove Bluegrass Lane as a Town road? The easiest way to do so is to ask Cornell if they are willing to give it up . Mr. Noteboom - The Town has been maintaining this road since the 1970 's . We have been plowing and repairing the road constantly. The Board , in 1980 , was requested to name an old town road between Warren Road and Hanshaw Road . A doctor from Cornell University requested that the road be named Bluegrass Lane . This is the only documentation related to this that we can find . Supervisor Valentino - Did you call the County to find out anything? Mr. Noteboom - There was nothing found in the files from 1931 to 1980 at the County office . The only ownership that was found for this tax parcel was that Cornell University owns the property. The County Clerk suggested that the Town tell Cornell University to prove that the Town owns the road . Attorney Barney - Supervisor Valentino should call John Gutenberger about Bluegrass Lane , an discussions with Cornell University should be set up . Councilman Klein - The Public Works Committee also discussed the drainage in the Town of Ithaca . The good news is that the DeWitt Pond supported the heavy rain fall in November. There have been some complaints from people on Maplewood Drive about drainage problems . The Highway Superintendent has talked to the owners about ditch maintenance . A neighborhood meeting is scheduled for January , either at the Northeast School or the DeWitt Middle School , to bring the residents in the northeast area up to date on the drainage study. JoAnn Cornish addressed the Committee in regards to including some dog parks in the parks plan . Mr. Noteboom - Ms . Cornish also mentioned a Dog Ordinance for people to control the dog's waste . The Town Board should talk about this . Supervisor Valentino - The Town ' s Dog Ordinance has a leash ordinance , but no ordinance on picking up a dogs waste . Attorney Barney - I will look into including that in the Town 's Dog Ordinance . CounciMroman Russell - The sign at the South Hill Trail for dogs to be on a leash has been removed . Is there a reason for that? Mr . Noteboom - I will check into that . TOWN BOARD MINUTES 11 DECEMBER 9 , 1996 Councilwoman Harrison - In the past , there was a discussion on setting up a committee looking at the benefit assessments . Not to review inaccuracies , but to look into the policy issues and formulas . Where is the committee at this point ? Mr. Walker - A committee has been set up , but has not met yet . Hopefully, after the first of the year they could get together . Supervisor Valentino - The word is , the County had a hard time meeting the Town's roll , and it became more work for everyone . It is balanced out now. . AGENDA ITEM NO. 7 - REVIEW OF CORRESPONDENCE . Councilman Klein - What is the letter from LouAnne Bangs in reference to? Mr. Frost - She must be confusing the Town Board for the Zoning Board . The landowner was issued a court appearance ticket . He was brought into Town Court and fined $250 . 00 . The residents of Eastern Heights are looking for the residents of that area to be owner occupied homes as a requirement for the Zoning Ordinance . Councilwoman Russell - It was not clear in the letter to what the offense was for . Mr. Frost - The gentleman bought a single family residence and started to convert the basement into an apartment without a building permit . After the Building and Zoning Department heard of this it was brought to the Zoning Board of Appeals to go through the permit process . Three or four months prior to the Town's involvement , the gentleman had signed a lease with some college students to rent this house. There was an occupancy violation of too many unrelated people in the house , as well as work being done without a building permit . These were two separate offenses , and the Town Court assessed one penalty for both offenses . Councilwoman Grigorov - Did the gentleman have to come to court because he did not comply on his own? Mr. Frost - No. During the Zoning Board of Appeals deliberations , with a good public turnout speaking against the whole issue , the Zoning Board as part of a condition to the approval , assessed a fine . By the time the Board were ready to make the resolution , they were so overwhelmed with the amount of people coming in that they over looked proposing a fine . After the fact , a court appearance ticket was issued to appear in Town Court . The owner was assessed a penalty. AGENDA ITEM NO . 9 - CONSIDER CORNELL UNIVERSITY' S TRANSFER OF TITLE FOR THE FOREST HOME WALKWAY TO THE TOWN OF ITHACA. Attorney Barney - I will be looking further into this . TOWN BOARD MINUTES 12 DECEMBER 9, 1996 AGENDA ITEM NO . 10 - CONSIDER DATE CHANGE OF CLOSE OUT MEETING. RESOLUTION NO. 195. Motion made by Councilman Wolff, seconded by Councilwoman Grigorov that the year end Town Board Meeting shall be rescheduled for Tuesday, December 31, 1996, at 10:00 a . m. in the Town Board Room, Town of Ithaca, 126 East Seneca Street, Ithaca, New York. Motion carried unanimously. AGENDA ITEM NO . 11 - CONSIDER BUDGET TRANSFER RELATED TO THE INLET VALLEY PARCEL, Mr . Kanter -This is a discussion item for the Board to think about . The Town is still waiting to hear from the County on a closing date for the acquisition of the parcel . Attorney Barney - There is not a definite decision on the offer. Mr. Kanter - The Town has identified a budget line where there are funds available for the acquisition . If the decision does go through , the closing would not happen until 1997 . The staff will try to have a resolution for the Town Board at the year end meeting to identify the budget line and encumber the funds from the 1996 budget to carry over into 1997 for the acquisition . It would be an amount not to exceed $ 12 , 500 . 00 , the amount the Town Board authorized in a resolution during July 1996 . There has been a contingency line identified in the Part Town Fund where there would be sufficient funds for this . Supervisor Valentino - The staff wanted to have the budget information in order to encumber for this from this year's budget . The Accounting Department has verified the accounts of where the money could come from . AGENDA ITEM NO. 12 - CONSIDER SUBSTITUTION OF PARK LAND FOR MONTESSORI PARK . Evan Monkemeyer, 123 East King Road - The Montessori School wants to expand their school , to include adding a seventh and eighth grade . They are looking for land to expand on . Herbert Monkemeyer ( Evan's deceased father) had originally proposed the Montessori Park space directly behind the school and behind the houses of the lots that front on East King Road as a park for the Town. This land would satisfy the needs of the subdivision requirements , and the school could access the park . Since that time during discussions with surveyors and engineers from other communities , it has been learned that little parks tucked behind lots or off the visual view from the highway wouldgk not be desirable . As the neighborhood expands , this park would become a problem area . The general public would be accessing this park next to an elementary school , which might not be a good TOWN BOARD MINUTES 13 DECEMBER 9, 1996 thing for the Montessori School . The proposed park land is approximately 1 . 8 acres that the school could use in their expansion program to meet the needs of building and parking . The Montessori School has a desire to purchase the parcel . The Town Planning staff have mentioned substituting another piece of land for this piece of land . There are other possible spots on South Hill for an active park space for play ground areas, ball fields , tennis courts , etc . Mr . Monkemeyer showed the Chase Pond Subdivision on a map . On both sides of the subdivision there are two very large parcels of land . One is owned by Cornell University . There are some environmental concerns about that parcel . If it was just a grass land that was mowed it would not be a bad use . The other side of the Chase Pond Subdivision is owned by Bill Mano . This would be a good place for a park . These parcels are the last flat levels of plateau on the South Hill area off of East King Road . The Town Board should also consider the need of having two parks in the area to meet the needs of the neighborhood . Children could walk or bicycle to reach the park . The land that is in the Herbert Monkemeyer Trust owned by Lenora Monkemeyer and I would comprise to approximately 100 acres of raw land . There is a need for a nice park on South Hill . The Planning staff will have a site visit to the land tomorrow. The item for consideration is for the Town to allow the Montessori School to purchase the proposed park land behind the school and substitute another piece of land for a trade off. There might be a larger park proposed later on to get a portion from all three Monkemeyer parcels for the Town of Ithaca . The larger park would consist of approximately 10 acres in size , and would fulfill the need to have some of the park space closer to the corner to meet the needs of the area . Mr . Kanter - The Planning Board has discussed this several times with Mr. Monkemeyer. At the December 3 , 1996 meeting they discussed this proposal in depth . The Planning Board came to an agreement that some kind of assemblage of a fairly large park facility in the area of South Hill would be very desirable . This is something that the proposed Park and Open Space Plan would be recommending . There are several things coming together here . One issue , which is the primary issue , is whether or not the specific Montessori proposed park site is appropriate as a Town park. Related to that there are opportunities in this general area of South Hill to create a larger community park that could have active recreational areas , such as basketball courts , tennis courts , ball fields , etc . The Park and Open Space Plan has identified this area as having a large need for this type of community park. There has been a lot of residential development going on in the area recently , such as Deer Run , the Chase Farm Subdivision , and the Monkemeyer Subdivision . There are very few active recreational facilities in the South Hill area . The Montessori Park substitution might be one piece of that finding . The new proposed subdivision on East King Road , which Mr . Monkemeyer is working on , is the answer to the park set aside . This could be combined with the current proposal . The Planning Board is recommending the Town Board pursue this as an opportunity for park land . Councilman Conley - Is this an immediate thing , for the Montessori School to purchase the property? Mr. Monkemeyer - The Montessori School has given a purchase offer to purchase the property. Councilman Conley - Does that include the playground area for the school ? Mr. Monkemeyer - They want raw land to purchase for the expansion of the building . TOWN BOARD MINUTES 14 DECEMBER 9, 1996 Councilman Conley - This land would not be for recreational use? Mr. Monkemeyer - I am not sure . The school has not given or made any plans yet for the design . Councilman Conley - There was mention of parks being on major roads and streets , would that be for law enforcement and security? Mr. Monkemeyer - Yes . Mr . Kanter pointed out on the map where the current proposed town park land is and where the Planning Board suggested to move the park land to . Mr. Kanter also pointed out the roads surrounding the lands and where a possible access road would go to the new proposed park site . Mr. Kanter mentioned to the Board that Mr. Walker, Mr. Noteboom , and himself would be visiting the site tomorrow to look over the land and drainage issues . Councilwoman Russell - Ithaca College was considering putting a road through their parcel . Should this be considered while the Town is thinking about the road plan of this subdivision and park proposal? Mr. Kanter " Yes , that was an idea Ithaca College had talked about . Ithaca College owns the piece ne)d to the Monkemeyer subdivision . A road through the Ithaca College parcel to front on East King Road would be in a wetland area . Ithaca College is looking to the future for some kind of access to East King Road . Mr. Monkemeyer - Katie Hadrovic is in the audience tonight , she was a former tenant of mine . There was a petition produced by the neighborhood residents of South Hill from Danby Road , Coddington Road , Troy Road , and East King Road . There are a number of signatures from people who are in favor of some type of park in the South Hill area . Katie Hadrovic - I have been a resident of the South Hill area for approximately two years . I am a full- time mother to a young child and one of my biggest concerns is that there is no place to take a child in the South Hill area . The only park that is of easy access , is the small park on Troy Road . Trying to walk a stroller at Troy Park is almost impossible because it goes up such a steep hill . It is a very secluded area to be in. I would love to see a large area park close to my home that other children and mothers could enjoy. If there are some areas available within this neighborhood , it seems appropriate to consider placing a park there . The petition has 137 signatures from people who live in the East King Road area . They would like the Board to take the petition into consideration . AGENDA ITEM NO. 13 - CONSIDER RENEWAL OF AGREEMENT WITH TOMPKINS COUNTY RELATED TO THE DRUG AND ALCOHOL TESTING CONSORTIUM , RESOLUTION NO. 996: Motion made by Supervisor Valentino, seconded by Councilman Conley that the Town of Ithaca agrees to continue an Intermunicipal agreement with Tompkins County, the TOWN BOARD MINUTES 15 DECEMBER 9, 1996 Cly of fhaca, and the Towns and Villages of Tompkins County for the purpose of implementing the required drug and alcohol testing and in the furtherance thereof shall participate in the selection of a third party administrator to manage such drug and alcohol testing program, and be it further RESOLVED, that such agreement shall contain such terms and conditions as the Town Supervisor and Attomey for the Town shall deem appropriate to protect the Town's interests and shall provide forthe sharing of costs upon an equitable basis between the parties and shall be binding upon the Town upon the executive thereof and shall extend through December 31, 1997. Motion carried unanimously . AGENDA ITEM NO. 14 - CONSIDER AUTHORIZATION TO PARTICIPATE IN THE ITHACA AREA WASTE WATER TREATMENT FACILITY CAPITAL IMPROVEMENTS . Mr. Walker - The Joint Sewer Committee has been working on an upgrade to 13 million gallons per day capacity . They completed an engineering study and developed a cost estimate . The State mentioned that they would get the extra capacity . This capacity will be relatively inexpensive . A million gallons of capacity for $600 , 000 . 00 is inexpensive . Based on the Town' s capital investment in the facility the Town' s projected cost would be $ 272 , 000 . 00 . Part of the amount would be coming from the jointly owned capital reserve fund . The Town' s actual bonding cost would be approximately $2453000 . 00 . Mrs . Noteboom - Did the Town budget for this ? Mr. Walker - The Town did not have to budget for this , at this point . The Town has paid an annual amount of $ 100 , 000 . 00 which has gone into a reserve fund . The budget has been modified to eliminate the $ 100 , 000 . 00 contribution to the reserve fund . Each municipality would use the funds they would normally pay for their bonding costs over the next ten years . Mrs . Noteboom - The Town budgeted the $ 100 , 000 . 00 payment in 1997 towards this ? Supervisor Valentino - The amount the Town pays to the City quarterly, a portion of the payment has gone into the capital reserve to make the bond payment . There would not be any money going into the capital reserves . Another portion goes to run the facility . The bookkeeping work needs to be looked at with the City . Mr . Walker - The Town did not budget this annual payment figure , but the Town' s fund balance reflects the decrease in the payment so there would need to be a budget amendment to set up payments once the project is completed . i TOWN BOARD MINUTES 16 DECEMBER 9, 1996 Supervisor Valentino - The Town will need to have discussions with the City on how to set up these payments . This bond will be the Town' s bond . In some way this should reduce the amount that the Town sends the City for ongoing expenses . Mr. Walker - The SJS budget has been reduced by the $ 100 , 000 . 00 bond amount from the original proposed budget . The Town is not paying that amount this year. Attorney Barney - A bond like this needs to have a bonding resolution subject to a permissive referendum . The Board should modify the resolution by stating what the Town's intentions are . The Town Board should not lock into this until the permissive referendum has been done , which is 30 days after adoption of this resolution . Councilwoman Harrison - Why can 't the Town Board adopt this resolution tonight ? Attorney Barney - The Board could adopt this resolution , but it needs to have the appropriate language for provisions of local finance law . This resolution should be changed in the first resolved to read "That the Town Board authorizes participation subject to adoption of the appropriate bond resolution , and there being no request for permissive referendum in the IAWWTF Capital Improvements Project . " The Town should not lock into this until this has been looked into further . Supervisor Valentino - There will be further discussions on how the bonding will work . Councilman Klein - Is the City looking for the Town to pass this resolution tonight ? Mr . Walker - The SJS is looking for the Town Board's authorization to go ahead with this project because they want to start putting contracts together and move ahead . The City has submitted a copy of their resolution to the Town Board for review. The City has suggested that they carry the full serial bond if the Town could not afford it, and then the Town could make payments to the City to reduce that debt . Alfred Carvill - The Town Board should financially consider what the bond issue would be for the taxpayers including the rate increase that would affect the Town in the new year. Initially, there is going to be an impact that would affect the fund balance . The accounting books already show a $ 163 , 000 . 00 joint sewer assessment that has not been paid . Maybe $ 163 , 000 . 00 from this year should be withheld as a financial leverage for the benefit of the Town . The Town will be stuck with a 10 to 25 year period payment that would affect the Town' s tax rate . If a portion of that is not paid , and if the Town is running short , that would affect the Town and County tax rates . . Councilwoman Harrison - There have been discussions on what share people should pay. This is a portion according to the original capital investment plans . The Town is not using anywhere near the amount that was originally proposed . The new amount of capacity would enable the partners to sel excess capacity, to other municipalities who are going to be looking for it . It would be inexpensive to do this project . If new municipalities came to use the capacity there are no stipulations that the Town TOWN BOARD MINUTES 17 DECEMBER 9, 1996 could not charge them for what it would cost to build such a capacity. There is a potential profit to be made . What needs to be settled is how any such profits would get proportioned among the partners . Councilwoman Grigorov - There is no benefit to the Town because the Town does not need any more capacity. Would this help other people profit besides the Town? Councilwoman Harrison - That is correct . The Town does not need the capacity. Councilwoman Grigorov - What would the Town be doing this for? Mr. Walker - It would be an investment in maintaining the Town's capital investment in the plant . The plant was purchased for $ 15 on the dollar because of federal funding . The cost per million gallons is very low. This may be a way to balance other costs because the Town would have the capacity to seH to other municipalities . The Town could utilize any income that would be derived from any sales to pay for other costs of sewer infrastructure . Councilwoman Grigorov - There would not be any benefit to the Town users? Councilwoman Harrison - No , not directly . In the future , there might be some financial benefits for users . Mr . Walker - The Town has been re- rating the plant to have a higher capacity . There are potential fines that could be avoided by going through with this . As a joint owner, the plant is rated at 10 million gallons a day. The Town has not exceeded the State requirements to the point where there would be any violations of the permit. The potential for any violations are always there . If there was to be a fine , it would be shared jointly among the municipalities . Doing a minor retrofit to the plant and an upgrade , as part of the capital cost , would be an inexpensive way . There is a significant reserve fund built up . The City has suggested that this not be tapped into for this project because the amount of money put into the reserve fund was based on utilization and annual maintenance cost . That is a different formula and percentage . Also , the rate of return on investment for that money is higher than the cost of borrowing the money. Councilman Klein - Who benefits from the interest ? Mr. Walker - The joint owners of the plant . The interest is rolling back into the reserve fund . Supervisor Valentino - If the Town took all the money and used it , it would then take new money to rebuild the reserve fund . The Town would still need some reserve monies to take care of things that might go wrong in the plant . Mr. Walker - The capital cost of the plant is approximately $ 25 to $ 30 million . The City feels that this is not an excessive capital reserve based on potential emergency needs . Some of the pumps and motors cost approximately $ 200 , 000 . 00 each . A repair bill could easily be estimated at $ 15 , 000 . 00 TOWN BOARD MINUTES 18 DECEMBER 9, 1996 for one system needing repair . Councilman Klein - The capital reserve was to handle the emergency repairs ? Mr . Walker - Yes . The $ 163 , 000 . 00 payment would be the Town's quarterly operations and maintenance payment . Mr. CaNII - This resolution does not read that this is for operations and maintenance . This is not just to meet those expenses , this is to build up the expenses for a new building station or new line . Councilwoman Harrison mentioned that this would create profit and be a good investment which would be great for municipalities as a business corporation . Those profits do not leave the Joint Activity Fund and they do not come back to the Town for general operating use in the General Operating Fund. They do not come back to Part Town to expand more parks , and to assist users with drainage problems. These would stay in the Joint Activity Fund forever. The Town would just be a contributing member over a governing Board or Committee to say these monies would be spent . Councilwoman Harrison - If the Town does not want to maintain their equity in the plant in this way, would other municipalities pick up the amount? If the Town changes their contribution to this new capital improvement , such as cutting the 40% capacity that would be available to other municipalities , would this money come back into the sewer capital fund? Councilman Klein - That is correct . Mr . Carvill - The Town could make an annual joint partner financial contribution , cooperative municipality, and lend service to other users to make money. This would be characterized as the City burdens the obligation for the 15 to 20 year on the serial bonding , and then tells the Town what the annual contribution is for the Town 's say in the matter for share of the profit . Attorney Barney - That still would be covered under a bonding resolution . There needs to be some documentation to what the Town agreed to do and why the Town is financing this purpose . Mr. Walker - Financial documents have been provided to the Committee members about this particular project. They have been working with the City for two years on the agreement that the joint owners drafted over ten years ago. They are trying to up date it . This could include the expansion in the same way the original agreement dealt with the construction of the plant . Suggestions from Common Council was that they did not want to act on that agreement until the results of the joint water system study were complete , so that they would have a better idea of future needs . Attorney Barney - The Town should have a written agreement indicating what the Town is buying , what the Town is getting for $ 270 , 000 . 00 , and what would the Town have in hand for spending $ 270 , 000 . 00 at the end of the process . The agreement should be agreed upon by all joint municipalities so there are not any problems . This Board should not adopt this resolution until there is a written agreement or an amendment to the SJS agreement to spell out what needs to be done and TOWN BOARD MINUTES 19 DECEMBER 9, 1996 why it is being done . Councilwoman Harrison - The agreement should also emphasize what happens if the excess capacity gets sold , and how it would be spread out among the partners . Attorney Barney - That type of language is already there because nothing could be sold without the unanimous consent of all the partners involved . There needs to be further negotiations with the City to come to an agreement . Councilwoman Harrison - If the City is using 90% of their capacity and the Town is using 40% of our capacity , then who owns the excess capacity? What is it based on? Mr. Walker - There were several months this year when the Town was using approximately 80% of their capacity and other municipalities were running over 100% of their capacities . The Town's excess capacity is helping to cover some of the other partners . Mr. Noteboom - The Town is paying for operation and maintenance during the year. Whatever is left goes into capital reserve , so if the Town bonds , the Town cannot use the capital reserve money for operation and maintenance? The Town would need to pay the bond payment plus an additional operation and maintenance fee? Mr . Walker - That was the City's argument . The Town should not use the OM from both capital reserves because it was paid at a different rate than the original plant ownership rate . The Town's consumption is lower than the City' s consumption so they are paying a higher percentage into this capital reserve fund . Councilwoman Harrison - Would this amount vary from year to year? Mr. Walker - It has been increasing steadily. Councilwoman Harrison - No , the amount each municipality paid in for OM would vary year to year based on water consumption . The capital reserve fund , that is $ 1 .4 million , is not the amount the Town paid into . This would vary year to year relative to the City's amount? Mr. Walker - Yes . Councilwoman Harrison - Does the Town know who owns how much of this ? Mr. Walker - The staff could track it down . There were a large contributions of money entered into this fund in the past few years , and over budgeted amounts were entered into this fund . Mr. Noteboom - If the Town pays a bond payment every year , where does the Town pay operation and maintenance every year? TOWN BOARD MINUTES 20 DECEMBER 9 , 1996 Mr. Walker - The Town still pays operation and maintenance every year based on consumption . Mr. Noteboom - Increasing what the Town is already paying? Mr. Walker - It would increase the payment the Town would pay for operation and maintenance . The operation and maintenance budget was reduced by $ 100 , 000 . 00 this year because the $ 100 , 000 . 00 on that line item was a payment into the capital reserve . That will not be made this year. Mrs . Noteboom - Which year, 1996 or 1997? Mr. Walker - In 1997. The $270,000 . 00 would pay to own 40 % of 1 . 2 million gallons of capacity which would probably cost $750 , 000 . 00 per rating gallons based on a new plant construction . This would be a good investment . Councilwoman Harrison - Suppose the agreement stated that the Town would get it? Attorney Barney - Then there would not be a problem . Councilwoman Harrison - Suppose the excess capacity is used up by the partners ? Would they pay the Town at cost for that capacity? Mr. Walker - The original agreement today does not talk about specific gallon capacity . It talks about percentage of ownership. If the plant has a million gallons of capacity where the Town owns 40°x , that means the Town owns four million gallons of capacity. That same formula would be applied to any increase in capacity of the plant based on the original agreement . If it was 13 million gallons of capacity, then the Town would own 40 % of that , which would be 5 . 3 million gallons of capacity. Councilwoman Harrison - During the wet months when the partners exceeded their capacities , does the Town not get reimbursed for that ? Mr. Walker - That is correct . Supervisor Valentino - In discussions with the City the same question always comes up , what is the benefit to the Town of Ithaca ? Attorney Barney - The benefit the City is suggesting is to protect the Town' s current equity in the plant . This would give the Board an opportunity to put a legal lever in the agreement now before the Town commits to spending another $ 270 , 000 . 00 . Supervisor Valentino - I am in favor of doing that . Mr. Walker - The actual engineering information is covered by the City' s staff. A suggestion for this Board would be to pass a resolution stating that the Town' s intent is to maintain a cooperative stance TOWN BOARD MINUTES 21 DECEMBER 9, 1996 with the partners in the SJS , but it would be appropriate to have an amendment or revised SJS operating agreement in place describing the activities that include this expansion prior to this Board authoriang their participation . This would be the mechanism because the three representatives from the Town could tell them that the Town Board will not pass this resolution authorizing reservation until they see the final agreement . Councilwoman Harrison - That would be good , but that agreement will take months to work out . Mr. Walker - The draft agreement will be worked out among the representatives . Councilwoman Harrison - Correct , but it does not address the selling of excess capacity which needs to be addressed in the agreement . Mr . Walker - It does identify the ownership issues , and how the owners work together. Councilwoman Harrison - Is there a big hurry for this? Mr . Walker - The City staff wants to move ahead with this . Councilman Klein - Does the City need the increased capacity? Mr. Walker - Based on four out of the last eight months , the City is close to maxing out . The only thing the Town is dealing with is the DEC process . This has been an ongoing process for over a year now. DEC is about to grant the capacity but they have to have proof that it will work . Mrs. Noteboom - That has already been proved during the wet months because some of the Towns were using over 100% . Mr. Walker - No , the Town needs to show proof. The Town of Ithaca 's permit is limited by volume . Mrs . Noteboom - How long does the City have before the DEC steps in? Mr. Walker - Any negotiations with a State Agency is somewhat sensitive . When they are about to agree to something , people should not interfere . Councilwoman Harrison - The Town should wait for the City to move the agreement . Supervisor Valentino - There are other issues about bonding which need to be in a separate agreement from the overall agreement . Mr. Walker - The amended agreement is another issue , because this agreement is attempting to deal with the OM of the system . TOWN BOARD MINUTES 22 DECEMBER 9 , 1996 Councilwoman Harrison - OM charges are based on water use on meters . In the meantime , there have been sewage meters installed at all points of entry into the City and it seems that it is time for the Town to use sewage flows . This would raise issues of who should pay the flow rates because the Town uses the lines that pass through the City to get to the sewage plant . There would need to be negotiations with the City to what percentages the Town should pay for those costs . Mr. Noteboom - The Town could measure what their inflow rate is . The Town would have a smaller percentage than the City . The Town Board decided to wait on passing this resolution until further information is provided on this agreement, and the information will be brought back to this Board for further consideration at a later date . AGENDA ITEM NO. 16 - CONSIDER RESOLUTION AUTHORIZING PAYMENT OF AUDIT OF CLAIMS PRIOR TO TOWN BOARD MEETINGS. RESOLUTION NO. 197: Motion made by Councilman Klein; seconded by Councilwoman Grigorov that the Town Board of the Town of Ithaca does hereby approve the payment in advance of the audit of claims for public utility services, postage, freight, and express charges as defined by Town Law, Section 198(2); and be it further RESOLVED, all such claims shall be presented at the next regular meeting of the Town Board for audit. Walker - A foundation drain was damaged on the Jack Little property at 3 Chase Lane due to activities of the Town Highway Department during the reconstruction of a ditch . The foundation drain was not well marked so the crew did not see it and covered it up . The heavy rain drained into the basement of Mr. Little Is house and submerged his furnace . The Town' s Highway Department actions were unintentional , and there were some damages caused to Mr. Little 's property. Attomey Bamey - If the Board chooses to adopt this resolution there should be a release stating that this is the total payment due . The resolution should state this is conditional upon the receipt of a general release . Mrs. Noteboom - The resolution should also mention which account the money would be coming from . TOWN BOARD MINUTES 23 DECEMBER 9 , 1996 The Highway Fund or the Risk Retention Fund . Councilwoman Russell - Why is the Town paying for a new sump pump? Mr. Walker - The Town did not pay for the sump pump . The Town only paid for the labor to install the sump pump . Councilwoman Russell - Was there a sump pump installed in this house already? Mr. Walker - No , the plumber installed one at this time . The drainage has been repaired and entered into the improved drainage system along the road . Attorney Barney - Why is the Town paying for anything that has to deal with the sump pump? Mr. Noteboom - The Highway Department did block the drainage pipes . The Fire Department had to pump the basement out . Mr . Walker - Mr . Little said that he had to replace insulation and other materials that he was not charging the Town for. The only claim Mr. Little is making is for the labor bill from the plumber. The plumber had to put the sump pump in to pump the basement down as part of the process . Councilwoman Harrison - The drain Mr . Little had would drain from gravity? Mr. Walker - Yes . The footage drain has been repaired and tied into the storm drain that runs along the road system. Mr. Little decided to put the sump pump in for a redundant level of protection . If the drain was adequately marked the Highway Department could have seen it . There is no standard for outlet structures into Town ditches . The staff will prepare some specifications , such as metal outlet pipes and standard the drains . Since then Fred Wilcox has unofficially replaced Ms . Cornell because she resigned . The Planning Board recommended that Mr . Wilcox take Ms . As a note to this : Many Ithaca career , volunteer , and bunker fire fighters worked very hard to contain this fire . Ecovillage , and the Town of Ithaca in general truly benefitted from the expertise and dedication our fire fighters bring with them to the, service they provide . The Town can be very proud of its fire fighters . During the Ecovillage fire , many area fire departments provided mutual aid ; some to the fire , others to standby . As the Ecovillage fire raged , another house fire on East King Road was extinguished by personnel and equipment from Ithaca , Cayuga Heights , Dryden , and Brooktondale . Intermunicipal cooperation at its best ! 2 ) Fire Department budget status : As of this writing , the Fire Department is approved for a zero increase budget , which means that only contractual ( labor agreement) raises are included and most other lines are held at 1996 levels . Sediment and erosion control measures will continue to be maintained until final landscaping and vegetative treatment I s completed , probably in the Spring of 1997 . The fire which occurred November 16 was a reminder about the importance of adequate access and water supply . The location of the pond away from access roads caused some difficulty and resulted in at least one fire truck being stuck in soft ground . The location of a dry hydrant was changed from the original plan , i . e . , adjacent to the emergency access roadway , to a point between the buildings and the pond . This location was apparently reviewed and accepted by the Fire Department . Fortunately , the fire trucks were able to access this standpipe over ground that had been stabilized for the use of construction traffic . The Fire Department also accessed a hydrant at the intersection of West Haven Road and Mecklenburg Road to fill tankers . The low pressure at this hydrant caused some difficulty in obtaining water at an acceptable rate of flow . This event is the second major fire on this portion of the West Hill where fire fighting efforts were hampered by a poor water supply . EARTH FILL PERMITS Five Mile Drive , Immaculate Conception Filling at the site has been moderate in November due to a decrease in the construction activity and by the use of other sites by the contractor . Sediment control fencing is being maintained around the fill area . The contractor has been keeping the roadway clean . Ithaca Vol . Vets , Elmira Road The Association received site plan approval from the Planning Board on October 29 , 1996 for an enlarged parking area on the property with additional fill to be placed . The Town Engineer is monitoring the project . Williams Glen Road A fill permit for approximately 200 cubic yards of fill has been issued for regrading a residential lot with imported material . Town Engineer ' s Report 12 / 9 / 96 WATER PROJECTS The Town Engineering staff is continuing to work with the Bolton Point staff to implement the master metering program for connections to the water transmission main . Work to - date includes placement of the piping and enclosures for most of the metering sites . The Town Engineer is continuing to work with the City Engineer and SCLIWC member municipal engineers on the engineering evaluation to include the entire water infrastructure for the area . This evaluation is being done in conjunction with the City of Ithaca water supply study . A contract to O ' Brien and Gere Engineers , Inc . has been finalized by the City of Ithaca . work is proceeding under the contract with O ' Brien and Gere to complete the hydraulic model of the Town of Ithaca distribution system . Progress on the project includes development of the combined model geometry and field flow tests to determine pipe friction loss conditions . SEWER Rebuilding of the pumps for Forest Home Pump Station 1 has been completed by Town staff with assistance from the City pump mechanic . Plans for the replacement of the controls for Forest Home pump stations number 1 & 2 have been completed and Town staff with assistance of the City Sewer Department will be replacing these items . Installation of the monitoring station on Hanshaw Road is scheduled for mid - December . The Town has purchased the monitoring station and has contracted the installation to a local contractor . Installation of this monitoring station is part of the Northeast Sewer Rehabilitation Plan which has been requested by the Village of Cayuga Heights . Three small pumping stations on East Shore Drive that were originally installed by the Town have been upgraded with larger pump chambers and new pumps to eliminate problems that were encountered due to small diameter pump stations and effluent lines . This work was completed by Town forces after prices solicited from local contractors were excessive . HIGHWAY AND PARKS The Forest Home Bridge Project has moved ahead with the placement of the main bridge structure . The placement of the refurbished trusses has been delayed due to rejection of the repaired truss delivered to the site and subsequent need for the contractor to re - work the repairs . Replacement of the water main under the bridge and approach work has been completed . Town Engineer ' s Report 12 / 9 / 96 3 STORMWATER The Dewitt Pond improvements were completed in time to be effective during the November 8 storm . The structure performed well with no damage to the inlet channel . During the storm the pond filled to about half of the design depth , retaining sufficient water to reduce flows downstream . The developer of the Sanctuary Drive Subdivision encountered difficulty in providing adequate drainage for his proposed buildings , and proceeded to excavate drainage ditches which were not on the approved subdivision plan . The ditches were constructed partially on Town highway ROW and Town utility easements . The contractor has been instructed to fill the ditches because of a significant alteration of the drainage patterns in the area . To provide adequate drainage for the building foundations the developer has proposed an underground drainage system which will cross other lands controlled by the developer requiring easements to ensure the building owner ' s ability to maintain the drainage system . BENEFIT ASSESSMENT Benefit Assessment questions and Townwide assessment review is continuing . The County Digital Tax Parcel Maps have been provided to the Town by the County Assessment Office , and development of a database utilizing the GIS is proceeding . CAYUGA INLET REHABILITATION PROJECT BY US ARMY CORPS OF ENGINEERS The Corps of Engineers is planning to repair Cayuga Inlet Flood Control Channel from the State Street Bridge up to the drop structure and fish ladder . Work is proposed to include removal of approximately 100 , 000 CY of sediment , placement of rock rip rap bank protection and removal of gravel from the Coy Glen grade stabilization structures . NYSDEC as the maintenance agency has been asked to provide spoil sites for the project . The project was scheduled to be let in November with work completed by December 31 , 1996 , but high bids have resulted in an indefinite delay of the project . C : \MZM0S\ ERPT9611 . Beeler Subdivision, 1207 Hanshaw Road The Planning Board granted Preliminary and Final Subdivision Approval at the November 19, 1996 meeting for the subdivision of a strip of land, 16 feet by 190 feet, from an existing parcel to be consolidated with an adjacent parcel, R45 Residence District. Site Plan Modification of Courtside Racquet and Fitness Club, 16 Judd Falls Road The Planning Board granted Preliminary and Final Site Plan Approval for the proposed site plan modification of Courtside Racquet and Fitness Club for changes in the configuration of parking and landscaping at the northeast corner of the existing facility, Business District "C' . In addition to the above actions, the Planning Board discussed the following items at the November 19, 1996 meeting: Park and Open Space Plan Update Staff presented the drafts of the introduction and inventory chapters of the 1996 Park and Open Space Plan. Discussion on plan recommendations will continue at the December 3, 1996 meeting. CURRENT PLANNING DEPARTMENT PROTECTS The following are significant accomplishments or issues that have been dealt with over the past month . Tompkins County Economic Alliance: Supervisor and staff continue to attend meetings of the County sponsored Economic Alliance to discuss possible economic development initiatives. As a result of these discussions, Tompkins County Area Development (TCAD) is evaluating the possibility of expanding their functions to include countywide economic development planning, advocacy and technical support, using increased county funding to accomplish this purpose. i SEOR Reviews for Zoning Board :oard : Two SEQR reviews for the Zoning Board were completed: ( 1 ) a request for a height variance to permit the construction of an accessory building with a height of 21 + / - feet in an R-30 zone, where a maximum height of 15 feet is permitted for accessory buildings, and special approval to allow an addition on a non-conforming residence, 313 Warren Road (Richard Marin), and (2) a request for a variance from Town of Ithaca Local Law No. 7, 1988 "Requiring Sprinkler Systems to be Installed in Buiildings . . . ", in two existing multiple residence buildings at Longhouse Cooperative, Residence District R-30, 766 and 770 Elm Street - Extension (Martha Armstrong) . Codes and Ordinances Committee: Work continued on Zoning Ordinance revisions at the November 20 and December 4, 1996 meetings, including (1 ) review of the MR Multiple Residence zone, (2) review of the LI Light Industrial zone and I Industrial zone, and (3) discussion of possible guidelines for siting structures and determining buildable land in conjunction with site plan and subdivision review. In addition, COC will be discussing the possibility of developing a new Institutional or Educational zone. Planning Committee: The Planning Committee continued discussion of the Coy Glen and South Hill Swamp areas as possible conservation zones at the December 2, 1996 meeting. Upon authorization by the Town Board, Robert Wesley and Nancy Ostman were hired to conduct a plant study of the South Hill Swamp area to identify valuable plant habitats on the outer portions of the Unique Natural Area (UNA) . The study is being supervised by the Conservation Board, and will be completed on or about December 15th. The Planning Committee also continued the discussion of siting and buildable land guidelines (refer to COC above) and possible agricultural protection measures. Park and Open Space Plan Update : The draft Park and Open Space Plan Update has been completed and is currently being discussed with the Conservation Board and Planning Board, providing an opportunity for preliminary review and input. The draft Plan will also be provided to the Planning Committee and Public Works Committee for review and input. Zoning Map Revisions : The Town Board approved the updated Zoning Map at the November 7th meeting. The revised map is being printed for public availability. Town of Ithaca - Cornell Universitv Transportation Committee : The Pedestrian /Bicycle Trail Subcommittee met on November 4, 1996 to discuss possible trail connections in and around the Plantations Natural area. The subcommittee also conducted a field trip to check the feasibility of some of the suggested trails . The following appear to be feasible trail connections and will be discussed with the full Committee at the December 5th meeting: (1 ) a crossing over Cascadilla Creek to connect the East Hill Plaza area with the East Ithaca Recreationway and Precinct 7, (2) a connection along Maple Avenue to link the two separate segments of the East Ithaca Recreationway, and (3) an extension of the East Ithaca Recreationway crossing 2 the Judd Falls Road intersection at Route 366 leading to Tower Road and the Plantations Overlook. Ellen Harrison and Jon Kanter also met with Charles Moynihan, Regional DOT Director on November 19, 1996 to discuss Route 366 intersections (signalization, possible closing of north leg of Judd Falls Road, etc.). It was agreed that more up-to- date accident data should be obtained by DOT (a follow up letter will be sent to Mr. Moynihan confirming this) . It was also agreed that DOT, the town, Cornell, and the MPO should collaborate on gathering more traffic information, and study the impact of closing Judd Falls Road on other nearby streets, perhaps as part of the Northeast Subarea Study that will be initiated by the MPO in 1997. Farm Tour: A tour of active farms and agri-businesses in the Town of Ithaca was held on Saturday, November 16th. The tour included stops at Genex (formerly E.A.I.C. ) on Sheffield Road, the EcoVillage community supported farm on Mecklenburg Road, the Baker dairy farm on Bostwick Road, Sheldrake Farms vegetable and greenhouse operations off Elmira Road, and Six Mile Creek winery and vineyard. Sixteen town officials participated, including members of the Town Board, Planning Board, Zoning Board, Conservation Board and staff. Information about each farm operation and other farms in the town was provided in a tour packet. The purpose of the tour was to provide town officials with an up-to-date picture of what kind of active farming is taking place within the town and an opportunity to discuss ways of preserving farming in the town. Several town officials attended a workshop held by the Tompkins County Agriculture and Farmland Protection Board and Cornell Cooperative Extension on the following Saturday, November 23rd, regarding the future of agriculture in Tompkins County. The workshop included a panel of local farmers dicussing issues impacting the future of farming in the county. Northeast Subarea Study: The Supervisor and Director of Planning attended a meeting held on November 7, 1996 by the Ithaca-Tompkins County Transportation Council to discuss the Northeast Subarea Study. A draft Request for Proposals (RFP) had been prepared, and comments from the participating municipalities were made. A revised RFP will be sent out to consultants during December. The study will include an inventory and analysis of existing land use and transportation systems, a travel demand model for the area, development and evaluation of alternative transportation solutions, and recommendations for short and long-term transportation improvements . The study will also include a collaborative process for public participation throughout the study. It is anticipated that the consultant selection process will be completed by February 1997 and that the project will last between 12 and 18 months . Filename: 1 files\ townbd\ tpre1296.mem 3 7 Agenda Item 3b Highway/Parks Department Monthly Board Report, November 1996 Town of Ithaca Town Board Meeting, December 9 , 1996 HIGHWAY SUPERINTENDENT I want to report , briefly, on the November 8 , 1996 , heavy. rain falls . The Town of Ithaca's Rights-of-Way had very little water damage . FEMA representatives came and assessed any damages . Because there are so few damages and they have already been fixed, we will probably not be reimbursed from FEMA . Attached is a breakdown of the equipment, labor, and material costs for these repairs . The above work was entered with the,General Repairs time . For the month of November, the Highway crews spent 765 . 25 hours of time , 30 . 75 of it was overtime on November 8 . We worked on ditching, stock piling materials , patching roads , along with other general maintenance . Our semiannual leaf collection was completed in November, this took 280 hours of Highway/Parks crews time . Winter has returned and the Highway/Parks crews spent 276 . 75 hours of time on snow removal (of roads) . Of that time, 110 . 25 here overtime . We used approximately 167 tons of salt . The West Hill and South Hill Fire Stations were plowed twice and salted once . Officially, we have completed our work on our FEMA projects . To finish this out , it took 80 hours of time. The Highway crews were able to work 74 . 5 hours , 10. 5 of it overtime, on Water maintenance, fixing valve boxes. They spent 128 . 5 hours of time, 10 . 5 of it overtime, on Sewer maintenance, cleaning sewer lines arid connecting to a main line on East Shore Drive. To round out the month, the Highway crews spent 32 hours on sign maintenance and building a grate, and 80 hours on machinery maintenance . PARK AND OPEN SPACE MANAGER Parks staff worked a total of 72 hours during leaf collection, which is inclused above. Snow removal required 52 hours for the month . Community service crews will again be helping us do hand shoveling of walks starting in December. Agenda Item No , 3(e) Town Clerk's Monthly Report Presented to Town Board - December 9 , 1996 Town Clerk: Deputy Betty Poole and Deputy Mary Saxton attended a regional meeting of the New York State Town Clerks Association on November 25 . The program included information regarding dog licensing , identification , electronic transfers , and the Control of Dogs and Animal Population Control Program , Tax Collection : Preparations continue for the 1997 tax season . Coordination and review of the water and sewer units to be included on the tax roll continues with Tompkins County. Tompkins County has received the worksheet reporting the tax levy information to be used in preparation of the 1997 Town and County tax bills . Accounting : The majority of time has been spent in the accounting office taking care of daily operations. An audit trail was prepared to insure accurate detail of daily transactions . The accounting software program will be updated after the last entry date can be determined . A great deal of time has been spent reviewing invoices and billings to discover payment dates and/or those outstanding . The checking account registers for all funds , with the exception of the Trust and Agency Fund , have been brought up to date and balanced . Mark Cass , Bookkeeper to the Supervisor is to be commended for his diligence and hard work performing many of the necessary accounting functions over the last few weeks . Human Resources : Interviews were conducted with three individuals for the position left vacant due to the resignation of the Human Resource Specialist . Ms . Judy Drake will begin her tenure with the Town in this position on December 4. Employees and retirees were notified of the deadline for making changes to their health insurance for 1997 . Retirees were notified of any changes in their premiums for the upcoming year. Calculation of the accrued sick , vacation , and personal time through the computer system continues to be a problem . Data Rite continues to work on it and they have assured us it will be corrected by the next payroll .
