Loucks , 116 Crest Lane , Ithaca , CALL TO ORDER : Supervisor Valentino called the meeting to order at 5 : 30 p . m . , and led the assemblage in the Pledge of Allegiance . AGENDA ITEM NO. 3 = OBSERVANCE OF MOMENT OF SILENCE IN MEMORY OF WARREN BLYE, TOWN JUSTICE RETIRED. The Supervisor asked for all to conduct a moment of silence in honor of Warren Blye , Town Justice retired who recently passed away. AGENDA ITEM NO 4 - RESOLUTION OF APPRECIATION FOR DISTINGUISHED SERVICE TO TOWN OF ITHACA BY TOWN JUSTICE WARREN BLYE RESOLUTION NO, 134: Motion made by Supervisor Valentino , seconded by Councilman Conley that the Town Board of the Town of Ithaca, on behalf of the Town , its citizens , and the many persons whose lives have been touched by his actions , regrets greatly the death of the Honorable Justice Wanes A. Blye and hereby wishes to express its heartfelt condolences to the family of Justice Blye in recognition of the passing of a fine Judge and human being . A vote on the resolution resulted as follows : Supervisor Valentino , aye ; Councilman Klein , aye ; Councilwoman Harrison , aye ; Councilman Conley, aye ; Councilwoman Russell , aye ; Councilman Wolff, aye . Motion carried unanimously. TOWN BOARD MINUTES 2 AUGUST 12, 1996 AGEND A ITEM NO b " PRESENTATION BY HERBERT J. ENGMAN, G HAIR : FRAM ORKFJ1 LONG RANGE ENVIRONMENTAL PLANNING IN TOMPKINS COUNTY COMMITTEE. Herbert Engman - The Town Board should have a copy of the Tompkins County Environmental Directory of 1996 . This is the first attempt to have an environmental directory that lists all the organizations which n4t be of interest County wide or any organization that may effect us in the Town of Ithaca . Another document to discuss with the Town Board is called Framework for Long Range Environmental Planning in Tompkins County. The Committee is pointing out to the municipalities that this would be used as a resource document . The County knows there has not been any environmental perspective on a County basis . They know that the Town of Ithaca has done more sophisticated work on Long Range Planning than what this document represents . The County is moving ahead with Long Range Planning , Economic Planning, and Transportation Planning . The County would like to have something available on the environment so it could be integrated with other planning going on . The Committee started with the thought of doing an Environmental Long Range Plan for Tompkins County. It did not take long for the Committee to realize that it was an over ambitious endeavor for a group of volunteers . The Committee realized the best thing they could do was to create a frame work, but the Committee thinks that they created an interesting document that could be of use to other people . The Committee did a Tompkins County Environmental Vision Statement , which the Board of Representatives has adopted in a modified version . The Committee has not asked the Board of Representatives to adopt the rest of the document because they are hoping to start conversatio and discussions around the County on the issues they are raising . There are some items describ in the document , such as The Natural Resource Inventory, that the Committee would like the Cou ve useful to man municipalities , especially the smaller ones who do n to do . It would be an inventory y p p I}t have the planning capabilities that the Town of Ithaca has . The Committee did a background paper on some of these issues , like The Natural Resource Inventory. The Committee has an intern who started on this project this summer to gather information that could go into an environmental assessment. The Committee is also proposing a biological corridor for Tompkins County which would involve a combination of private landowners and public landowners to provide the biological protection for species in the County. There is also a section on transportation options on citizen participation . The Committee is hoping to stimulate people to start talking about what creates the environment we like so much in this area. Part of this is in recognition of fact that our predecessors set aside some spectacular territory for us. The State Parks are second to none in the State , and the State Forests are an incredible resource. The Committee realizes the only thing they would be able to do as citizens for the future , is to plan well, to keep what we have , and to keep much of the wonderful things in the County from being destroyed . The planning process is what we can contribute to the next generation . The Committee hopes that people will look at this resource when they write about the economics in the Town or certain things about the en*onmental perspective issues . The Committee realizes land use power in the State resides with local municipalities . The County itself has virtually no land use abilities to control , so the Committee is hoping municipalities will start thinking on scale beyond their own borders to help protect the environment . Councilwoman Ellen Harrison - What items are on the Committee's agenda for the next six months a year? _ 4. " Zi41 kl4rilt TOWN BOARD MINUTES 3 AUGUST 12, 19N Mr. Engman - The Committee will be following the Cornell Incinerator Project , and they have tried to refocus some efforts to more long range elements . The Committee will be trying to promote this plan and gather information . The Committee would like to see the GIS system become more useful for Environmental Planning . One of things that the Committee points out in the document is that the County wants the Committee to identify where development should take place . The Committee will be gathering a lot of Information and setting up focus groups to talk with citizens about the environment of Tompkins County, The Committee does not know if they have the manpower with just volunteers . AGENDA ITEM NO. 6 - REPORT OF TOWN OFFICIALS. A. Torn Engineer - Daniel Walker - The budget has been getting a high priority. The Master Meter Program is under way with the contractor has started to dig . The City is about to sign the contract for the Joint Water System Study. The Dewitt Pond is getting bigger. We have excavated at least two feet. We will be leaving the upper end of it as rock. The Town will be raising the structure on the inWt to keep at least two feet of standing water at the lower end as requested by the School District . There will be some weathering of that rock as time goes on . We are planning to leave it open, so it does weather. Councilman David Klein - The discharge unit will rise? Mr. Walker - Approximately one and one half feet . The lower end was excavated below the pipe that is there now. We will be flattening the. outer slopes so it can be mowed easier, and replacing the fencing along the inside edge of the embankment , so it would accessible only when the school wants people there . The two rain storms did not cause any real damage , although we had over two or two and a half inches of rain . B. Highway Superintendent - See attached . Fred Noteboom - The only addition to the attached report is that the Badger caught on fire last week. Supervisor Valentino - This is the new piece of equipment that the Town purchased in January. There have been nothing but problems with that machine since it was purchased. Councilman Wolff - How much did the equipment cost? Mr. Noteboom - It was $ 148 , 600 . 00 . Councilman Klein - Was the equipment covered by the " Lemon Law"? TOWN BOARD MINUTES 4 AUGUST 12, INS Mr. Noteboom on I do not think equipment is covered by the Lemon Law. The Badger Company brought a loan machine , they have taken the machine we purchased back to the factory for a thorough inspection . I am pushing to try and have them give us a new machine . Councilwoman Mary Russell as Was the machine covered under warranty? Mr. Noteboom - So far it is covered by warranty. I received a paper from them stating everything they are telling me . They will extend the warranty when the Town gets the machine bads. It will be covered another year, another 1500 hours . I am real concerned about this machine . Supervisor Valentino - What was the original warranty? Mr. Noteboom on One year 1500 hours . I have been in touch with Attorney John Barney about this machine because we have had a lot of problems with . Attorney Barney said that as long as they are fulfilling the warranty there is nothing that could be done at this point . The Town purchased the machine through Tracy Road Equipment , and they concur with us to have Badger replace the machine with another one . C. Director of Planning - See attached . Councilwoman Harrison - If Codes and Ordinances Committee is looking at the Zoning Ordinance , would it make sense for them to look at Comell's flood zone in precinct 7? The Committee has done it with the idea that there might be an institutional zone . Mr. Kanter on In earlier discussion , it was suggested that they would look into that . Councilwoman Harrison - Would the Conservation Zone be on their agenda? Mr. Kanter on Yes , because it is a law. The Planning Committee is trying to think about other areas for Conservation Zones . Councilwoman Russell - What was the Soreng subdivision on Burns Road about? Mr . Kanter - It was to transfer a small triangular piece from one property to the neighboring property for more room for a driveway turn around area . It was just a lot line change . D. Director of Building and Zoning - See attached . Andrew Frost - Supervisor Valentino and I will be meeting with Steve Lucente who represents the Homebuilders and Landlord Association about the Sprinkler Law on TOWN BOARD MINUTES 6 AUGUST 12, 19M Thursday. The Town Board will have something to review in a few weeks . E. Town Clerk/Director of Administrative Services - See attached . Joan Noteboom - Deputy Town Clerk Betty Poole and I went to the Town Clerk meeting last Wednesday. The Clerk's discussed the new charges the County may be imposing for printing the tax bps. In essence , the County needs to buy a new software program for a new law that went into effect regarding properties sold for back taxes . Also , because the County added the Solid Waste Fee to the tax bill they can not put it in the same box with the normal Town and County taxes . If the Government Operations Committee says they can absorb the extra $8 , 000 . 00 for printing the bills this year in their budgets they would. The County charges the Village of Lansing $ 1 . 30 per parcel to print their school bps, yet they are telling the Town it will only cost 25 cents per parcel . If they charge us 25 cents this year, I think in 1998 they will probably charge the Town more . Councilwoman Russell - Are there any other options open to the Town for printing the bills? Mrs.I Noteboom - There has always been options . The Town does not have to collect the County's taxes for them after March . As of April 1 st , the Town Supervisor signs a paper saying that she agrees to allow the Town Tax Collector to collect for the County from April 1 st to June 30th . The reason the Town has always done this is because we make the interest of 1 % on those taxes However, it is not cost effective because it costs more administratively for the collection and the personnel than we are making on the interest . I do not recommend telling the County that the Town will stop collecting taxes after April 1 st , but it could be a good bargaining chip if they continue to put these costs onto the individual Towns during the tax collection process . Councilwoman Russell - Doesn't the Town have to collect our own taxes? Mrs. Noteboom - Yes , we do , but we only have to collect those to March 31 . After that date , the Town could choose not to extend the warrant , and then the Town would turn them over to the County. Supervisor Valentino - I have asked Mrs . Noteboom to look into the cost for the Town to do our own taxes , but we do not know what that number is yet . The Town Clerk's software package that the Town will receive from the County will need to be updated , and that will be another considerable expense the Town would have to pay . Mrs. Noteboom - The Town does not have any option for that . The County chooses the program that the Town uses and then they may send us the bill . Councilwoman Harrison - Would the County be sending a bill to each municipality? TOWN BOARD MINUTES 6 AUGUST 12, 1996 Mrs. Noteboom - Yes . A few years ago , the County said they would buy computers for the Towns who do not have computers. They bought the software package because they iced the package and warted the Towns to use it . The County told the Towns they would maintain the software for us. Now, they are talking about getting a different system . More than likely they would be going asking the Towns to pay for it because they do not have the money . The County did the same thing about printing the tax bills . They always prated the tax bps fior us free of charge , then last year they started to charge for the bills . The Town pays for their own postage , envelopes , and supplies . F. Supervisor Report - SurperAsor Valentino - We have been spending the bulk of our time getting ready for the budget. There is a meeting set up Tuesday morning with the Fire Commissioners , Fire Chief, and any Town Board Member who wishes to come . I gave the Fire Department action for a 30 day evaluation time to implement the Chiefs proposal to close the West Hill Fire Station during the day, and having it staffed with more people in the evening . They will be giving us a report on how effective that is . They are aware that there are contract implications the Town could invoke or talk about . One of things that will help would be , cutting down on the number of vehicles that they send in responses to places like Ithaca College and Cornell University, Councilman Conley - There was a time when they would send a vehicle to respond and call for additional vehicles if needed . Then there was another decision made that they should send all the vehicles at once , They do this because of lack of manpower, they have one driver in each vehicle without the volunteers , Supervisor Valentino - I have told the Fire Chief that the Town really wants to look at the Cb/s budget because we are under contract with them for a certain percentage . If the City cuts or changes their budget , it would also impact the Town's contract . AGENDA ITEM NO. 7 - REPORT OF TOWN COMMITTEES. Councilman Wolff - The ADP Committee is approaching a cross road , and they need serious feed back from the rest of the Board. In the past , I have noted that the Committee was making progress towards networking , and now is the time to consider whether the Committee wants to continue that progress given the cost of networking . I have handed out a brief outline of what the ADP Committee has done . The ADP Committee is considering budget issues and other questions . The Committee is talking about how to achieve the goals of networking and solving a host of informational technology problems . The Committee is talking about $ 150 , 000 . 00 , which includes $50 , 000 . 00 for a proposed new position , called a Network Adnrator. That is probably the most important item there . This does not include the cost of various activities that could be reimbursed under a grant the Town might be a good candidate to receive . Half of the $ 150 , 000 . 00 would be an upfront cost for purchasing the software equipment. There would probably be $75 , 000 . 00 annually that would continue for maintenance and for the new TOWN BOARD MINUTES 7 AUGUST 12, INS position's salary. The ADP Commttee will be providing a report by the first week of September of what was outlined in the memo . Mr. Walker and Mrs . Noteboom have been very involved in these discussions , and a couple of people on the Committee put a lot of work into this . The Town is not necessarily saving money by not going forward with networking . Coffin Harrison - I think networking everyone is a great way to communicate , share files , work on the same documents , etc . This seems like a lot of money . Who is on this Committee? Mrs . Noteboom - Besides myself, Pat Keller from Building and Zoning , Geri Tiemey from Planning, Mice Ocello from Engineering , Gail Kroll from Highway, John Wolff is the Chair, and Larry Parlett from Bolton Point . Councilman Wolff - There are preliminary steps of doing an inventory to see what the Town has and what the Town's uses are . It is safe to assume the work is very thorough , and that the benefits of networldtg are clear. The real question is , do the benefits add up to the price tag? There are certain requiramwis of how reports from the Town need to be filed electronically, so it seems the Town would be maims expos for the information technology anyway. The whole idea of networking is sound, instead of having separate expenditures that are going to leave the Town unable to communicate . There will always be new requirements . The ADP Committee feels it is better to be comprehensive and systematic in addressing those areas . Networking at the same time gives the Town benefits . Councilman Klein - Assuming that the Town will be moving into a new Town Hall , I am a little concerned about making that kind of expenditure while the Town is in the old facility. Knowing the physical limitation of upstairs and downstairs there would be a lot of wires being strung throughout the Town Hal. To overcome the physical obstacles of this building in order to network, and then to dismantle part of it for the new Town Hall would not be beneficial at this point . Councilman Wolff - That does present some problems , but there are two points why the Town should do this now. Frst is the need . There are a lot of problems and other needs networking would address now. If the Town does network in this Town Hall it would not prohibit anything . We would have to physically move equipment , and assuming we are building a new Town Hall or remodeling a new Town Hall , we could easily do it in a fashion that would utilize existing equipment . The second issue is , it is feasible to network in this Town Hall . Thorn would be now wires and it would need some electrical upgrades , but it would be a minor expense within the figure of $ 150 , 000 . 00 . The Town Board should be driven by the needs of the Town and what we are losing or gaining by holding off. If the Town Board makes the fundamental decision for the expenditure , the draw backs of building a network in this building are not enough to slow us down . The Town could easily overcome these obstacles . Supervisor Valentino - The Town should move in that direction , but at this point it is to early to decide whether to hire a full time person or not . Some of that could be accomplished by consulting to meet needs. I would look into hiring a consultant to identify more clearly exactly what staff needs are . In the process the Town needs to think about the data entry , because the whole program does not do us any good if the Town does not have the information they need in the computers . The Committee needs to TOWN BOARD MINUTES 8 AUGUST 12, 1996 go back and evaluate how the Town could move into this . The Staff would also need to feel comfortable with what the Tovm Board is doing , including getting training they need . If the Town hires a consultant , we would be able to got that training , and than review the issues to see if the Town noods to hire a now person for the network administration . Councilwoman Harrison - Would the Town need a full-time person more than one year? Hiring someone produces the expectation that they are here forever, but it seems that after a year the Town would not need a full time person . Councilman Wolff - That would be possible . Assuming everyone gets trained and assuming the Town gets everything implemented . The third thing that would need to be continued would be the . maintenance, and that does not need a full time person . There would be some Idnd of expenditure for services whether it were just a local vender that providing them . In terms of training and implementation , the Town would be better off having a full time person . Councilman Conley - What are the possibilities of the Town getting a grant? Councilman Wolff - The Town is far ahead of other Towns in regard to informational technology, especially in Records Management . There is an opportunity to standardize the Town's file directories and standarcke the systems and process by maintaining electronic records . SARA has created a grant to give to municipalities who would develop this and act as a model for others . Councilman Conley - What is SARA? Mrs . Noteboom - State Archive Records Administration through the New York State Education Department in Albany . Supervisor Valentino - The Town has had those grants before . The Town is in very good shape , and they are willing to work with the Town on these . Mrs . Noteboom - The State Education Department is telling the Town they would like to use us as a model, and they would be willing to consider a grant for $50 , 000 . 00 to create a directory of electronic files that would be standardized across the State . This would be called an Active Records Grant because they would consider the Town's electronic files as being active records that need to be to stored . Coun cdwoman Harrison - How would the $50 , 000 . 00 be used to meet the needs of networking here? Mrs. Noteboom - The grant could pay for a consultant to evaluate what the Town's needs are , and help the Town to develop the directory . Councilwoman Harrison - The directory has to do with our records? TOWN BOARD MINUTES 9 AUGUST 12, 1N6 Mrs. Noteboom - The directory has to do with how someone would standardize the information to put on the directory , so when the Town Hall is networked someone else could pull up the information to review it at another computer. The consultant would be someone who has helped us with the grants in the past. The computers would work with what is already created from previous grants . Mr. Waker - This is not just a directory, it is a document management system to maintain the integrity of ditent documents , to set up security, and relate the networking . Right now, the Town has single PC computers with everyone's directory structure filing system different . Now there are difficulties going onto someone else's computer system to look for a document when they are not there . The scary part is if it gets destroyed or lost with another name it would be ruined or lost . Councilman Wolff - These are activities with or without the grant that the Town would need to undertake anyway. Councilwoman Russell - Is there a time limit on the grants? Mrs . Noteboom - The grant needs to be filed by February 1 st . The grant cycle starts July 1 , 1997 through June 30, 1998, so this Town Board would have to be willing to upfront the money anyway. The Town would not know if they got the grant until May of next year, and the Town would not receive the full funding . Reimbursement would come as the Town finishes a certain stage . In 1997 , the Town might receive a quarter of the money within that fiscal year, half may come in January 1998 , and the final funding will be received after an audit in July when the project is completed . In order for the sequence of evens to happen , the Town would have to be willing to upfront some of the money. If the Town did not get the grant , then this Board would have to be willing to budget the money anyway. Councilwoman Russell - Would this need to go into the 1997 budget? Mrs . Noteboom - If the Town is going for a $50 , 000 . 00 grant , the Town would want to budget for revenue of $25 , 000 . 00 in 1997 , and in 1998 expect to receive rest of the grant money. Mr. Kanter - Can the grant money be used for equipment? Mrs . Noteboom - The grant money could be used for several things . The money could be used for equipment, contractual expenses , and also for 10 percent of the personnel time and employee benefits . The Town Supervisor would be the one who has to sign the application , but the Record Management Officer is the person who is legally responsible to make sure the funds are expended the way they were intended to be . AGENDA ITEM NO. 12 - PUBLIC HEARING : CONSIDER AN AMENDMENT TO THE TRAFFIC ORDINANCE TO PROHIBIT PARKING ON PORTIONS OF CREST LANE. Supervisor Valentino opened the Public Hearing at 6 : 30 p . m . The Town Clerk had proof of posting and publication . TOWN BOARD MINUTES 10 AUGUST 12, 1N6 D . P . Loucks of Crest Lane - "As a resident of Crest Lane , I am sympathetic with the residents o Warren Road who do not have a place to park. There are two issues that I can see , and one has to do wkh safety. As people go in and out of Crest Lane there is not a lot of visibility getting onto Crest Lane or getting onto Warren Road . People really have to go to the end of the two roads to see where they are going, and if there are two cars (one coming in and one going out) , that would be all they would see at that time, If there are cars parked very close to that intersection , then there is a problem . I think that is a hazard when people park close to the intersection. The other factor is fire trucks. Crest Lane is Ord in regard to fire truck accessibility , There is not a lot of space for them . If there were a fire , it would be great to have the trucks be able to make it without pushing cars out of the way. " Supervisor Valentino - Are you aware of what the resolution reads? This proposal is to restrict parking on both sides of Crest Lane from the intersection of Crest Lane with Warren Road to a point of 150 feet east of the centerline of Warren Road . Mr. Loucks - That would be great for a resident that does not have parties . When residents have a lot of people over there is no other place to park except on Crest Lane . I do feel sorry for people on Warren Road who have guests and they need to park some place . Personally, I do not have a problem with cars parking on Crest Lane, so far it does not create a safety problem at the intersection . If this proposal is passed and enforced that would be the big question . Councilman Conley - The Town does not enforce , the Sheriffs Department has to enforce the law. Councilwoman Harrison - This proposal was actually brought to the Town Board as a request by a resident on Crest Lane? Mr. Noteboom - Correct , there was a petition from residents on Crest Lane . Councilwoman Harrison - Why were the residents petitioning this proposal? Mr. Noteboom - A lot of the same points mentioned , such as sight distance , cars being parked out near the intersection , the narrowness of the road , etc . Supervisor Valentino - This also creates some problems for the Town equipment like the snow plows . Councilwoman Harrison - Did the Town hear from any residents on Warren Road? Mr. Noteboom - Yes , 120 Warren Road . Councilwoman Harrison - Did that resident say he was for or against this proposal? Mr. Noteboom - They have room for their vehicles , but there is not room for any extra vehicles . Mr. Loucks - The extra cars are usually people visiting the residents . Residents do not park on Crest TOWN BOARD MINUTES 11 AUGUST 12, ISM Lane . Councilwoman Russell - How many more feet is there to Crest Lane that would be available for parking? Mr. Noteboom - Approximately 400 feet . Supervisor Valentino - Is Crest Lane a dead end street? Mr. Loucks - Yes . Councilwoman Harrison - People would have to walk a Tittle further, but they could still park? Supervisor Valentino - Correct . The Town was going to restrict the whole street until we heard the concerns about the parking . Mr. Loucks - I do not think that the Town should have to restrict the whole street . Councilman Conley - The people have expressed the same concerns as Mr. Loucks . Mr. Noteboom - They also felt that the intersection needed to be protected , and the crest of the hill was the most important part . Supervisor Valentino - This proposed resolution is actually a modification the residents concerns , and the residents thought this resolution would work. As no one else from the public wished to speak, Supervisor Valentino closed the Public Hearing at 6 : 36 p . m . AGENDA ITEM NO 13 - CONSIDER SEQR RELATED TO AN AMENDMENT TO THE TRAFFIC ORDINANCE TO PROHIBIT PARKING ON PORTIONS OF CREST LANE, RESOLUTION NO. 136 : Motion made by Councilman Klein , seconded by Councilman Conley that the Town of Ithaca Town Board hereby makes a negative determination of environmental significance in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed and , therefore , neither a Full Environmental Assessment Form , nor an Environmental Impact Statement will be required . A vote on the resolution resulted as follows : Supervisor Valentino , aye ; Councilman Klein , aye ; Councilwoman Harrison , aye ; Councilman Conley, aye ; Councilwoman Russell , aye ; Councilman Wolff, aye . Motion carried unanimously. TOWN BOARD MINUTES 12 AUGUST 12, 1956 AGENDA ITEM NO. 14 - CONSIDER ADOPTION OF AN AMENDMENT TO THE TRAFFIC ORDINANCE TO PROHIBIT PARKING ON PORTIONS OF CREST LANE RESOLUTION NO. 136 : Motion made by Councilman Conley, seconded by Councilwoman Russell that the Town Board of the Town of Ithaca hereby adopts said ordinance entitled "ORDINANCE AMENDING THE ORDINANCE REGULATING TRAFFIC AND PARKING IN THE TOWN OF ITHACA TO PROHIBIT PARKING ON PORTIONS OF CREST LANE copy of which is attached hereto and made a part of this resolution ; and it is further RESOLVED , that , pursuant to Section 133 of the Town Law, the Town Clerk is directed to a . Enter such amendatory ordinance into the minutes of the Town Board ; b . Roll call vote was carried unanimously. AGENDA ITEM NO. 7 - REPORT OF TOWN COMMITTEES (CONTINUED). Councilman Wolff - The ADP Committee meets every Friday in the Town Hall board room , and members of the Town Board are welcome to come . Agenda for the ADP Committee is to discuss the gram, and to finalizing those details . I would be interested in feed back and concerns that would give some ideas of what issues the Committee should be addressing for the Board. Councilwoman Russell - In response to Councilman Klein's comment about the Committee not moving forward before the Town has a new Town Hall , does this mean that the Town would loose the opportunity for this grant? Councilman Wolff - Yes . Mrs. Noteboom - I am not sure . The Town would loose the opportunity for this year. For the first year of the grant , the one the Town applies for by February 1 st , the Town may not have to go as far as to request equipment . The Town could ask to develop the directory and complete the evaluation the first year of the grant. Then apply for another a second year. The Town has had four grants . Two of them had not been quite finished by the first year, so the Town had to apply again to finish it . TOWN BOARD MINUTES 13 AUGUST 12, 19W Councilwoman Harrison - I feel as though the physical wiring is a relatively small part . Supervisor Valentino - There is a problem with how much we can over load the system . We have computers that are turning off for no reason now, the fuse blows . We are losing documents when that happens . Mr. Walker - The electrical system is right to the edge now. The last failure in Town Hall was when we put two computers into an office where there had been one computer before . There was talk before about implementing this into phases . There is an immediate need, and we are moving ahead with the plan to network several of the engineering and planning machines , so that we can all access materials . This would be a component of the overall plan , so it is important to get the pre-plan done , and then start the implementation . Supervisor Valentino - The Planning and Engineering components would be easy to move . The other concern is to concentrate on getting the accounting package then three computers working together. I think this is a crucial need . There might be some budget restraints on how much could be done . Mrs. Notes - The ADP Committee should put together a very good detailed report showing all the components of what they are suggesting . That could be brought back to the Town Board for review. Councilman Wofff - The Town Board needs to understand how some of the pieces fit together, including some of the advantages . I will try to articulate this into the ADP Committee's report . Councilman Conley - What does ADP stand for? Mrs . Noteboom - Automated Data Processing Committee. AGENDA ITEM NO. 8 - REPORT OF TOMPKINS COUNTY BOARD OF REPRESENTATIVES. Beverly Livesay - There is no formal report to present as the County is entering into the budget season . The State owns the County money they have not paid in a number of areas . The Welfare Reform was just passed and the County needs to look into what it is going to mean both financially and programmatically. The County's Human Resources building is moving along . The buildings are down and the sites are clean . The work will begin in September. Municipalities are looking for a fee trash collection day as Mayor Cohen's letter requested . Since the County does not have any extra money, it is a matter of who gets the benefit and who pays , because the source of the money would be based on whatever the disposal fee is . Supervisor Valentino - I was surprised how high the price was for trash collection a few years back. Ms. Livesay - Then the County came up with an amount that was less than the disposal cost , and the Board decided to make it free . At that time , the County had a landfill that they were abandoning , and the County was heading to the point where they would be shipping trash out of Town . This would have TOWN BOARD MINUTES 14 AUGUST 12, 19N i cost money for the County, and it seemed like the thing to do for the community. The County did give an amnesty on paying after the flood because people had things ruined by the flood this winter. The main thing is that anything that gets disposed of costs the County money. CDux* ran Wolff - Is the County looking hard at figures related to their social services case load to try and make budget projections related to the Welfare Reform? Ms. Livesay - The 1996 budget was passed before the Welfare Reform happened, so there would need to be alterations in the budget as the County moves forward. If the County is going to get a grant instead of reimbursement, that would make a difference . Councilman Wolff - There is a constitutional department in the State to provide for the needy, who are given the requirements of placing recipients into work situations . Given the lack of adequate money from a federal level to cover those costs , how will the County be able to achieve those requirements? Alts . Livesay - That is something that would need to be looked into . Councilman Wolff - Could the Town expect a property tax increase ? Ms . Livesay - At the moment, the welfare case loads are down . I Councilman Conley - It is too early to indicated that at this point? Ms. Livesay - It has been indicated there are items the County knows will not be coming later, we are putting things into place so the County would not be hit hard with something unexpectedly. I do not think that there would be a tax increase for next year. AGENDA ITEM NO. 7 - REPORT OF TOWN COMMITTEES (CONTINUED). Councilwoman Harrison - The Planning Committee has met and will provide a report later this week. They are working on the Transportation Plan . Councilman Klein - I presented to the Board a set of the last three minutes from the Public Works Cee. The Committee has been talking about water and sewer benefit formulas . A few months ago Councilwoman Russel was at the meeting to talk about this . The Committee will provide a written r statement mating what they are trying to accomplish with the revised benefit formula . Then they will come back to the Town Board and ask to set up a working committee . That committee will work with Egg, Planning, and the Attorney to come up with a formula that is fair. The goal will be to finish the work by January 1 , 1997 . Mrs . Noteboom - I suggest that someone from the Accounting Department be on that committee . I Supervisor Valentino - Mary Bryant has been looking into the system to determine where the Town does TOWN BOARD MINUTES 16 AUGUST U, 1996 not a have a rationale for the number of units that people are paying for. There were some people who were not assessed anything, that will be corrected this year. Once the budget process is over the Town Board can establish the committee . Councilman Klein - Mr . Walker went through many of these assessments and realized people were being charged less than they should be , so their assessments would have to be raised . Mrs . Noteboom - Deputy Town Clerk Betty Poole has been doing a great deal of work on this also . Councilman Klein - There are two issues . One is to get the correct units per parcel , but the primary issue is to develop a formula that works and is fair. The purpose of the assessment is to cover the capital costs. There is a sum of money in water and sewer that needs to be recaptured every year and spread through the benefit area . That has to be portioned throughout by who benefits from water and sewer. That it has to be within reason and fair. Mr. Walker - The formula is set up for R- 15 zoning , one unit per 100 feet of frontage , that is consistent across the Town. Where this is complicated is with the large undeveloped parcels , if it is undeveloped the Town uses a certain frontage and assigns a certain number of units based on acreage . Some of the larger parcels have high unit numbers when computing them with the formula . What the Town staff found , when reviewing all these numbers , a parcel that had water available with three units being charged to them. Then there is a 25 acre parcel right next door with more frontage and they have two units , the staff does not know why . Staff is trying to find documentation to support this . The formula is based on the assumption that full development potential was going to be realized by those parcels . Mr. Noteboom - The Public Works Committee is scheduled for August 22 , we would like to reschedule to August 29 . Ithacare needs to be contacted regarding the change . Councilman Klein - Ithacare would like to present their case of the water connection to the Public Works Committee . They felt they should have not brought the issue directly to the Town Board without sufficient information being provided . Ithacare will state their case and I . will report back at the next meeting . On tonight's agenda , the Board will consider the agreement with O' Brien and Gere for studying the City's master plan for the water system . The Public Works Committee recommends the Town Board approve the agreement . Codes and Ordinances Committee is making progress reviewing the zones. Supervisor Valentino has asked me to look at some of the maintenance issues on the South Hill Trail , so I will try to set up a meeting with a few people to talk about these issues . Has the Town Board adopted a mowing policy? Mr. Noteboom - No . Councilman Klein - I have seen a policy written by Rich Schoch that said it is the policy for maintaining the trail , but I do not know that this Board had ever adopted one . Supervisor Valentino - The Town should look into that . TOWN BOARD MINUTES 16 AUGUST 12, 1996 Councilwoman Russell - When the Public Works Committee meets with Ithacare they should remin them that the Town has forgiven a large amount of expenses performed by the Planning Department . AGENDA ITEM NO. 9 - REPORT OF FIRE COMMISSIONER No one present to speak. AGENDA ITEM NO. 10 - REVIEW OF CORRESPONDENCE, Councilwoman Harrison - Where does the Town stand with the Cornell Incinerator? There is no committee at this time , and I have received some correspondence from Cornell . Supervisor Valentino - There has been some correspondence about setting up a Community Committee . Councilwoman Harrison - I asked Attorney Barney what was going on , and he indicated some strong concerns . I do not want the Town Board to be in the position of saying things are okay, and that we would senre on the advisory committee without really thinking this through . Attorney Barney stated that his assessment is that Cornell is proposing to go ahead and do a full build as they2were originally planning. Cornell will assess whether or not to go ahead and bum the plastics as well as the carcasse but once they build a facility of that size to handle the full waste stream , what would be the logic outcome of these discussions be ? Councilwoman Grigorov - They could just do that temporarily. Councilwoman Harrison - The press release from Cornell did not say that in the article . Councilwoman Glgorov - I got the Impression that they were going to do the full build . They are going through the full build permit , and I do not see why they would do this if they did not intend to build fully. Councilwoman Harrison - What the Town Board should do is ask for some clarification . The Board should ask Cornell to come to one of our meetings to answer some of these questions . I was also interested in the press release that discussed the urban rural issue . What it has to do with is the wind flows and views of big buildings . I do not know enough about the whole process , and do not understand. This ought to be another question the Town Board would like to understand better. Sizing issues are important , and even the community would have problems going forward with an incinerator that is capable of dealing with large carcasses .. Councilman Wolff - There are those in the community who are against any form of incineration , but most of the people involved have been expressing their concerns with this particular proposal . They are concerned this is not taking an existing pathological waste incinerator that only bums carcasses and rebuilding it to meet code , it is actually an upgrade to a facility that would have the capability an the intended use to bum plastics and to dispose of full regulated medical waste stream . There is a TOWN BOARD MINUTES 17 AUGUST 12, IM group called "Citizens Concerned about Medical Waste Incineration" who have been meeting and looking at this proposal to decide what the good aspects of it are . The proposal is a creation of an advisory group to take a look at some studies that Cornell would undertake to determine whether or not the burning of medical waste is safe , and then it would take the report to determine whether or not they would bum regulated medical waste . The problem with that is a Citizen Advisory Group , although it may actually work in theory, would not be the equivalent to an EIS . This group would have no legal standing or authority. The other two points of this proposal are small . One is the wind modeling of the data , which looks at how safe this would be and how well it would disperse . There were issues involving the technical modeling where we have pointed out some flaws and Cornell agreed to redo the modeling in such a way that there is accurate data . For example , wind modeling data is used from Syracuse rather than using local data . The second thing is the urban rural concern . Rural assumptions were built into this wind modeling rather than urban assumptions , and Cornell is going to redo the model looking at both. People who are opposed to the incinerator have made clear the proposal Cornell has put forward does not address the concerns about burning other dioxides . Councilwoman Harrison - I thought Cornell was going to have a consultant look at this as well? Councilman Wolff - No , not to the extent that the concerns exist . The Town should look at this after it is built and then decide whether Cornell should bum regulated medical waste . A lot of people are very skeptical that this is the way to address community concerns . This is a much different design . If they want to bum pathologic waste they should build one type of incinerator. An incinerator design to burn regulated medical waste is much different than a design to burn pathologic waste . Councilman Klein - Could they bum both? Councilman Wolff - Yes , they can do both , but not in the most efficient way. Cost Is a big concern. Cornell spends $35 , 000 . 00 a year on waste disposal for all regulated medical waste . This incinerator will cost $3 million . It seems logical that they would spend $3 million on something that could create such hazards for public health and safety and that would have a possible adverse impact on the environment when they could avoid all of that by maintaining a cost of $35 , 000 . 00 a year to ship the regulated medical waste to Vermont . Mrs. Noteboom - What about the carcasses ? Where do they ship those if they do not have a place to incinerate them? Councilman Wolff - My personal opinion , they should start with a waste stream . Even those who are opposed to this particular proposal should understand that Cornell Veterinary School has a waste stream , and they have a waste stream problem at their current facility. They fail to look at any other alternatives adequately. They have failed to look at changes in the various technology of State regulations that might make dealing with their waste stream more efficient . Councilwoman Harrison - I think that we should invite Cornell to come and talk to the Town Board to answer these questions . TOWN BOARD MINUTES 18 AUGUST 12, 1996 Counciran Wolff - Franklin Lowe , who is the one who proposed this will be meeting with members o the community to work out a proposal . Supervisor Valentino - The Town will send an invitation to Cornell to come to answer some of the questions . The Board had a brief discussion about Beverly Livesay's statement earlier in the meeting in regards to Mayor Cohen's letter, on Trash Amnesty. Supervisor Valentino - I have received some correspondence from people who have written about problems associated with the winter flooding . My approach to them has been to have them check with Mr. Noteboom (Highway Superintendent) and Mr. Walker ( Director of Engineering) , to see what the problems are and what has been done about them . Then I send a letter back to that person explaining what has been done or what the process would be to get it done . I have not bothered the Town Board with all the letters , and I would like to ask the Board Members if this approach is fine with them? The Town Board Members were in agreement to allow the Supervisor to handle these matters as she indicated . AGENDA ITEM NO. 11 - PERSONS TO BE HEARD. No one present wished to speak. AGENDA ITEM NO. 15 - CONSIDER APPROVAL OF REVISIONS TO THE ZONING MAP. Mr. Kanter = Staff went through the revisions to the Zoning Map . The revisions have been more than just adding zoning changes which have occurred . It has also been a matter of seeing how correct the previous version of the map was . We found while looking at the 1994 Zoning Map that it was never officially adopted by this Board as the official map . There are some inaccuracies on the map that the staff needs to review. We have just received an updated Tax Parcel Map from the County that is going to be looked at for the purpose of becoming a base map for foxing zoning boundaries . The best approach to take may be to use the text base information to make some further refinements and adjustments in the zoning boundaries . Many of the zoning boundaries were intended to be done around tax parcel dries but that was not done accurately because the staff never had the tax base . Now that they have the G I S system , the staff could start looking at the tax parcel information and see if they could use that to make additional refinements to the Zoning Map . That will take a little more time , but it would be worth the effort . The Town does not have an official Zoning Map , and I am a little hesitant to continue giving out the 1994 Zoning Map as it is not an official map . When giving out that version we will make some kind of notation stating the Town is working on a revised map . Mr. Frost - A few years ago we made a map available with a disclaimer on it . Mr. Kanter - The revised map will be ready for the Board at the October meeting . TOWN BOARD MINUTES 19 AUGUST 12, 1996 AGENDA ITEM NO. 10 - REVIEW OF CORRESPONDENCE (CONTINUED). Councilwoman Russell - Is there anything the Town could do now to push the Department of Transportation (NYSDOT) to reduce the speed limit on Route 96B at King Road? Supervisor Valentino - Not at this point , they made their decision . Councilwoman Harrison - Has the NYSDOT ever made decisions to lower speed limits? Supervisor Valentino - Yes , they have reduced some speed limits the Town has asked for. Mr. Noteboom - There has been influence exerted before , but everyone needs to get together to exert that influence , the County and the Town . Supervisor Valentino - The neighborhood groups within the Chase Farm area have been putting a considerable amount of work into gathering information to present the case of lowering the speed limit . The Town should contact them again to see what information they have in regards to police reports , accident reports , and other documentation . Councilwoman Harrison - The Town should talk to the resident group , and see when they will be ready to make .a presentation to present information to the NYSDOT. Then we can invite the NYSDOT to the meeting so they can hear public comments . Mrs. Noteboom - The Town should start by asking the Tompkins County Board of Representatives to write a letter saying they would like to see the speed lowered and the reasons why. Councilwoman Russell - It is not just the Town residents that are concerned , the residents of the City of Ithaca on Aurora Street are also very concerned . The traffic comes down at a high rate of speed , because they do not slow down at the City border. Councilman Wolff - Does the Chase Farm group have a study that was performed , is that publicly available? Mr. Noteboom - It should be , but we have never received one . Mr. Kanter - The other part of the letter to the State again asked them to look at the issue of installing a pole traffic light , they did not say anything in their letter. Mrs . Noteboom - There is a three-way light installed near Sam Peter's Furniture Store last week: Mr . Walker - There are still stop signs on King Road . They need to program the stop light at the intersection . TOWN BOARD MINUTES 20 AUGUST 12, 1956 AGENDA ITEM NO. 16 - EASEMENT WITH CORNELL UNIVERSITY RELATED TO THE FOREST HOME WALKWAY. Supervisor Valentino - I have received a letter from Attorney Bamey stating that there were problems with the insurance company in be able to ensure the walkway the way Cornell has written the agreement . Attorney Randy Marcus - The issue goes back many years . The original easement provided for motion by the Town to any claims that might be made against Comell . Not only claims resulting from actions by the Town , but claims resulting from activities of anybody. Attomey Bamey was concerned about this and asked the insurance, carriers whether they would insure on that basis , or whether they would list Cornell as an additional insured under the policy . Comell is evaluating that . Attorney Barney has warden again to Shirley Egan at Cornell to inquire about the status on that proposal, there has been no response . Std Valentino - Attorney Barney will follow through , and the status will be reported to the Town Board at the September meeting . Mrs . Noteboom - Jack Farmer, the Town's insurance agent , called and said he has reviewed the document and they will not insure the Town or include Comell on the Town's policy with the language that is in the present contract . Supervisor Valentino - Attorney Barney will contact our insurance agent when he gets back. AGENDA ITEM NO. 17 - CONSIDER APPROVAL OF AMENDMENT TO AMENDED, SUPPLEMENTAL, RESTATED, AND CONSOLIDATED AGREEMENT OF MUNICIPAL COOPERATION FOR CONSTRUCTION FINANCING AND OPERATION OF AN INTER-MUNICIPAL WATER SUPPLY AND TRANSMISSION SYSTEM FOR THE TOWNS OF DRYDEN AND LANSING WATER DISTRICT. Supervisor Valentino - This item is deleted . At the last meeting of the SCLIWC , the sub-committee former Supervisor Shirley Raffensperger is on is talking about restructuring the issue dealing with excess capacity and Bolton Point becoming a water authority. We will wait until they finish their new report . AGENDA ITEM NO. 18 - APPROVAL OF ENGINEERING AGREEMENT WITH O' BRIEN & GERE FOR WATER SYSTEM MODELING. Mr. Walker - The City of Ithaca is at a significant decision making point due to their reservoir. The revision is half full of sediment . Their water treatment plant is close to 90 years old and needs to be replaced or rebuilt . The City is looking at spending a significant sum of money. They have decided to look at the whole water supply question for the City and the surrounding municipalities . Historically up to the 1970's , all of the Town 's water came out of the City , until Bolton Point was built in the Village of TOWN BOARD MINUTES 21 AUGUST 12, 19N Lansing . When the Town created Bolton Point , the Town went all the way around the City with their tanks . The plan was to continue around to the West Hill area at significant pumping costs . The City has the need for additional supply capacity, by rebuilding their own or buying water. Cornell has a source with a good continuous flow from a plant that was recently remodeled . The Town has a source from Bokon Point that uses approximately a third of its capacity . The City is commissioning a study by O'Brien & Gere Engineering , Inc . , to look at their whole system to see how it interconnects with Bolton Point and the Cornell University system . There is probably some benefits to opening up certain lines . The Town could probably get water more efficiently from the City or from Cornell . The City could get water by gravity from Bolton Point to feed the north end . The Town has an overall regional need of approxirrately sac to seven million gallons a day . We need to look at how it could be best supplied from the City's four and a half to five million gallon a day source , Cornell' s two million gallon a day source , and the Town' s potential nine million gallon a day source at Bolton Point . As part of the process , they are doing a hydraulic model of the whole water distribution system including the City , the surrounding Towns , and Cornell University. Each of the groups has a responsibility to complete their own water system hydraulic model. The City has completed theirs with T. G . Miller. Lansing and Dryden have had T. G. Mier do theirs. Bolton Point has modeled the transmission main , and the Town has been working on our model of the Inlet Valley , South Hill , East Hill , and the Northeast . The staff has been working on it , but not through an integrated manner. The Town has been providing some mapping services and model creation services to the Village of Cayuga Heights because they are part of the Town . To stay on schedule with the City' s regional plan , which will start this week, that they need the completed models of all the municipalities so they could join them into one large model . Our engineering staff, because of their work load cannot complete the model in the time frame that the City needs . O' Brien & Gere Engineering , Inc . , have provided an estimate to do the Town's model , and to do the model for the Village of Cayuga Heights. The reason for selecting O' Brien & Gere Engineering , Inc . , was that they were selected by the City, Bolton Point and Cornell University. They were the consultants that had the best approach in doing a good comprehensive study . They have proposed a cost of $22 , 000 . 00 to complete the information we have now and work with us to complete our model . Approximately $7,000 . 00 is related to the Village of Cayuga Heights . That system is the oldest water system in the Town with srrral diameter pipes that would require a significant amount of field evaluation and analysis to create a good model . I am proposing the Town Board approve this study , and that the Town be the sole contracting agency with O' Brien & Gere Engineering , Inc . for this combined model . Before the Town completes the Village of Cayuga Heights portion , we have to have approval from the Village Board for payment of their share. The Town can do their model without modeling the whole Village of Cayuga Heights. I have explained to O'Brien & Gere Engineering , Inc . , the need to break this out so if the Town had to do their portion of it and leave Cayuga Heights out , the Town would have a cost of approximately $16,000.00 for their own model . I think this would give us a good solid handle on what the capabilities of the systems are and lead us to a cooperative arrangement with the City and the different municipalities for a less expensive water supply system . Councilwoman Harrison - What is in it for the Village of Cayuga Heights? Mr. Walker - The cost of water may go down . The Village water is currently from Bolton Point . There is some water that could be supplied from the City. Right now all the Village water is pumped up TOWN BOARD MINUTES 22 AUGUST 12, 1996, Burdick Hill and let down hill . The Town's biggest cost of this water is electricity for pumping . The Town's unit cost for water is relatively high at Bolton Point . The Town has the capacity of six million gallons a day right now with the capacity of producing nine million gallons a day. The Town currently sells approximately two million gallons of water a day. The staff time would not increase generally. Pumping costs would be up if they had to pump up the hill then down . The Town would not be doubling their costs because we would pump from the lake to the treatment plant , but we could pump from the treatment plant by gravity through the City to the West Hill area . The Town could pump by gravity from the plant all the way to Inlet Valley because the clear well elevation at Bolton Point is high enough to feed water to the Elm Street tank . That is on the City's gravity system which feeds the Inlet Valley system . The Town could eliminate 50% of the pumping costs that way. There would also be opportunities with less pumping , to take water from the City's plant that is located in the Six Mile Creek Water Shed. They could supply 65 % of their City customers by gravity. There is an old pump station on State Street and Siaterville Road that used to feed the West Hill . There is a pump station at Crispel's place that used to feed Coddington Road and South Hill . The Town is using 250 to 300 horse power pumps that nun 40 to 60 horse power pumps . There might be some savings , but we do not know what the benefits would be until the study is completed . Councilwoman Russell - When you are talking about feeding water over to West Hill through the City, are you talking about installing a new dedicated line or putting it through the existing lines? Mr. Walker - Putting them through the existing lines , by having a transmission agreement with them . The water that is produced at Bolton Point may not actually make it all the way down . The Town may have to put a meter in at East Shore Dive. If the need was there the Town could feed the water through to the north side of the City, which has a flow and pressure problem . The Town could take the water from the other side , from Bolton Point or Six Mile Creek by putting some water in and then letting so much out on the other side. The Town could sell some to the City and then the Town could use the rest . The City would avoid costs because they would not have to pay for a new plant , they could just rebuild . $30 , 000 . 00 is the Town's share for the joint modeling system , assuming we do the model together. Councilwoman Harrison - What is the quality of the water in the Cornell system? Mr. Walker - The quality of the water is generally good . They have a large water shed at Fall Creek that is much larger than the Six Mile Creek watershed . They have problems with high run off situations that cage sew activities . The biggest water quality problems that Cornell has , with the Chilled Water Storage Tank, is they do not have as much make up water as they used to . They cut their consumption in half because they used to dump a lot of water they were using . Now they store it in the big tank behind the steam plant. They reduced some of their consumption because they have to filter their water at a sower rate to get the same quality . They are meeting all the State standards , and they can tie into Bolton Point if needed . The joint system would utilize the efficiencies elevating the systems . When treatment costs get high at Cornell they may decide to shut their plant down during poor water situations, and take water from Bolton Point . The hills , the valleys , and the gravity do not always follow political boundaries. The Town is doing extraordinary things to keep the water flowing . The Town has 500 horse power pumps pumping from Bolton Point to the elevations in the East Hill right now. This TOWN BOARD MINUTES 23 AUGUST 12, 1956 is a professional services contract , and I am comfortable in recommending this as an extension to the existing contract . 1 do not think there is a requirement to put this out to bid . Councilman Klein - The City went through a process? Mr. Walker - The City went through a selection process . It is a professional services contract which does not require a bidding . This cost is very reasonable . The Town just added the transmission main model , which had been updated , and that conversion cost $6 , 500 . 00 . It is a long pipe line that has a number of connections on it . The Town's system is much more involved , doing this for $ 16 , 000 . 00 would be very reasonable . Councilman Conley - Do other municipalities have an interest in this? Mr. Walker - Yes. A9 the other municipalities have had their systems modeled already. The Town has been doing our model ourselves , but we are not able to complete the model to keep up with the time table . Attorney Marcus - The letter the proposal seems to make reference to states that the estimated fee for completing this service as outlined in the proposal is $22 , 000 . 00 . The work is proposed to be completed under the terms of the enclosed agreement . Mr. Walker - That would be reviewed by the Town Attorney. Councilman Wolff - How would the Town pay for this? Mr. Walker - The money is in Capital Projects . Supervisor Valentino - We will add to the resolution "that the Town Board hereby approves the agreement subject to the contract being reviewed by the Attorney for the Town" . Councilwoman Russell - If the Village of Cayuga Heights does not pay their portion , is the Town willing to absorb the cost? Supervisor Valentino - No , the cost would go down . Mr. Walker - We could model our system with the Town making estimates for the Village of Cayuga Heights . It would not be as good a model , the Village not approving this and not moving ahead could be violating some intermunicipal trust . Councilman Klein - Is the Mayor supportive of this? Mr. Walker - The Mayor is supportive of the concept . This expense would come out of their Water Fund . TOWN BOARD MINUTES 24 AUGUST 12, 1996 RESOLUTION NO. 137 : Motion made by Councilman Klein , seconded by Councilwoman Russel . that the Town Board hereby approves the proposal submitted by O' Brien & Gere Engineering , Inc . , by letter dated July 24, 1996, with a revised breakdown of the estimated fee dated July 29 , 1996 . Motion carried unanimously. AGENDA ITEM ADDITIONAL NO. 1 - RECREATION PARTNERSHIP. Councilwoman Russel - At a previous Town Board meeting I had mentioned the Recreation Partnership is going through their budgeting process , and there is a large short fall . The Partnership voted to ask the Tompkins County Board of Representatives to fund the Partnership the same amount they had funded last year ($35 , 000 . 00) to help make up the short fall . If the County funds this the Town taxpayers end up paying for a partnership cost , not only through their Town taxes , but through their County taxes as well . The Town is funding the Partnership at a level of $ 160 , 000 . 00 a year which represents $97.32 per each registrant in 1995 . The Town's portion is not slated to go up over the next three years in the Partnership 's budget plan . The other participating municipalities are participating at a much lower level . Others combined participation in the Partnership , not the dollar amount , but the children that participate is 26% with their percentage of dollar subsidies equal to 7% . The Town's percentage of the total subsidies is 39% , and the percentage of the Town's participation is 3196 . Councilwoman Harrison - What is the City's participation? Mrs . Noteboom - The City has a higher level of participation than the number indicates because they use their facilities . They say they have a lot of the cost associated with that , so they are not putting it in the Partnership . Supervisor Valentino - The new proposal says the Town has no debt service for the Cutia Building or the ice roc. The Partnership budget includes 55% of the cost for the maintenance and operation of the building . The other 45% is paid by the City. Revenues for the Cass Park rink are down over $25 , 000 . 00 this last year because of the new rink that opened up in Lansing . The City has also lost revenue because they could not use the City playgrounds for their programming since they were under construction . They also mentioned some of the problems could be related to the octopus traffic . Councilwoman Harrison - At one time the Town of Ithaca was willing to put up more than their share to subside , but now the Town is putting in more than their share . I think the Town should be looking at this . Mrs. Noteboom - I think that will have to continue . This Board has to decide if they want the Partnership to continue. We will probably always subsidize the program in one form or another. I do not think that we will ever see the smaller Townships offering funding that matches their participation levels . They will expect the City and the Town to subsidize them . TOWN BOARD MINUTES 26 AUGUST 12, 19M Councilwoman Harrison - Why should the Town do that? Supervisor Valentino - The City's subsidy is much higher than the Town's. Councilwoman Russell - The City numbers are $ 179 , 000 . 00 . The City's has 39% of the program use (children) , and 44% of the subsidies . Councilwoman Harrison - What part of the 44% of the subsidies is money? Supervisor Valentino - The 45% of operation and maintenance is not included in this number. Councilwoman Harrison - The Partnership uses those facilities, and pays for 55% of the OM for those facilities , even though they are City owned? _ Supervisor Valentino - Correct . Counalwoman Harrison - The Town does not pay 100% because they use other programs that the City has . Supervisor Valentino - Yes , and other things they receive money for such as the softball equipment. Councilwoman Harrison - It is not as though they are giving us the 45% . 1 do not believe the Partnership is using 55% of those facilities . Supervisor Valentino - It is probably close . Councilwoman Harrison - The 45% of the funding the City is putting in , is that money? Mrs. Noteboom - No , some of it is "soft costs" like a portion of their personnel fees , they pay the full 100% , but they allow them to use time towards the Recreation Partnership . Councilwoman Harrison - The City and the Town are subsidizing everyone else? Mrs. Noteboom - I think that the Town is closer to the 39% 0 Councilman Conley - Does Lansing participate? Councilwoman Russell - The Village of Lansing is actually closer in their subsidy than the smaller outlying partners . Councilwoman Harrison - What is the Village of Lansing's percentage? Councilwoman Russell - The Village's percentage of program use was 4% in 1995 , and their total TOWN BOARD MINUTES 27 AUGUST 12, 1996 subsidies were 3 . 1 % . Councilwoman Conley - What about the Town of Lansing? Councilwoman Russell - The Town of Lansing is not a member of the Partnership . Supervisor Valentino - One of the reasons for the pilot was to see what these numbers would be in the second year with the full realization that there might be some very hard decisions to make based on the numbers . If the County does not put in the money there would be approximately a $46 , 000 . 00 short fail. The Town will not be picking up any more of that because the Town is not going to pay more than $160,000.00, which we already pay. The alternative would be major program cuts . If the County does not put in the $35 , 000 . 00 , the Partnership would be dissolved . Councilwoman Harrison - Would it make sense for the City and the Town to do something jointly? Supervisor Valentino - That is what we used to do . The children from outlying municipalities paid the full cost of the programs because their municipality subsidize with taxes . Councilwoman Harrison - How do the other Towns feel about the Partnership? Councilwoman Russell - People did not like the idea because they did not want to have to tell their Townships that they would have to pay a large amount to the Partnership . Mrs. Noteboom - The Partnership thought they would be able to distribute the amount among the other municipalties , except the City and the Town . If the County does not pay the $35 , 000 . 00 , they are not willing to distribute the shortfall without the City and the Town paying more . Some of the arguments given for the Town putting in more money was to try to improve the Recreation Programs in the rural areas of the County. They feel we should be thinking of the County as a whole , and bringing these type of programs to the children in other Townships who are unable to afford it as well as the City and the Town because we have the highest assessments and are the "hub" of the County. Supervisor Valentino - Others have increased their contribution this year over last's year, but not to the level that they should . Councilwoman Harrison - Would that bring them up to equity? Councilwoman Russell - No . Councilwoman Harrison - Should the Town try to do something to cover this year's deficit without throwing it all back to the County? It seems that the Town would be subsidizing the other Towns . Is this the right thing to do ? Mrs. Noteboom - Our participation levels did go up through the pilot . The Town got their money's worth TOWN BOARD MINUTES 28 AUGUST 12, 1996 for the $160, 000 . 00 . We expanded the programs and we were able to provide more opportunities f children . Councilwoman Harrison - Could the programs be subsidized between the City and the Town? Mrs. Noteboom - Yes , but it would take a while to put it into order. The Board needs to decide if they want to ask the County whether or not they are going to fund the $35 , 000 . 00 , and whether or not we want the Partnership to continue . Counclwoman Harrison - What happens if the Town does not ask the County, or the County says no? How does that money get made up? Mrs . Noteboom - It would need to be made up with the Partners . Supervisor Valentino - In reality the Partnership would be gone: Councilwoman Harrison - How does someone cover the $35 , 000 . 00? Councilwoman Russell - If the Town Board does not pass this resolution asking the County to pay the $35 , 000 . 00 , it is not appropriate for the Town to make up the difference . The outlying municipaliti should be making the argument to the County as to why they can not make up that money. Mrs . Noteboom . , The $ 11 , 000 . 00 should be included , the Partnership really has a short fall o $46 , 000 . 00 . The Partnership needs $35 , 000 . 00 from the County to make it workable so the other Partners are willing to make up the $ 11 , 000 . 00 . Councilwoman Harrison - Would that be to cover last year's bills? Mrs . Noteboom - No , this is the short fall of the Partnership budget projection for 1997 . Supervisor Valentino - If the County does not put in the $35 , 000 . 00 , then the Partnership has to go back to the other municipalities and ask them to make it up . The Partnership has to go back and look at the programing they are offering. They need to consider making some serious cuts in the programs offered . Councilwoman Russell - It is hard for the Partnership to do that . There are only three votes from this Town on the Partnership . Mr. Kanter - Are there similar resolutions from other participants to send to the County? Mrs . Noteboom - Mayor Cohen sent this resolution to everyone asking them to pass it so they can present it to the County and ask for the $35 , 000 . 00 . Councilman Wolff - Based on the assessment of the programs , are they cost effective in terms TOWN BOARD MINUTES 29 AUGUST 12, 19W benefits to the community? Mrs . Noteboom - Yes . Councilman Wolff - The Town does not have representation that speaks to our financial contribution to the Partnership? Supervisor Valentino - Between the City and the Town there are sic votes within the Partnership . Mrs. Noteboom - Part of the reason the other Townships are saying their Boards will not contribute more money is because they have their own programs . They only joined the Partnership to see if there was some way they can expand on the programs they already have . They say since they are already making contributions to the County Youth Bureau programs , they are not going to fund the Partnership any more because they think they are subsidizing the Town and City. Councilman Conley - At one time the City of Ithaca had it all . They never minded because they also had the economy. Mrs. Noteboom - The City of Ithaca has the benefit of the Partnership . using their facilities . If they did not have the Partnership their profits would be much lower. The City does make money from the Partnership by offsetting the total costs of their facilities . Councl1woman Harrison - The question before this Board is , does the Town of Ithaca Town Board make a request to the County to make up the difference? Councilman Wolff - Yes . Councilwoman Harrison - What long term vision does the Town see? Councilman Klein - The Town would revisit this next year. Councilman Conley - The County made it last year. The Town is asking them to do it again this year? Mrs. Noteboom - They made it for two years , and the County says that they already subsidized youth programs through the County Youth Bureau . Councilman Conley - Who does the County Youth Bureau serve? Mrs . Noteboom - All the youths in the County. Councilwoman Harrison - Why does this exist as a separate thing? Councilman Conley - What do they do ? How do they spend money on youth programs if they do not TOWN BOARD MINUTES 30 AUGUST 12, 19N have any facilities? Mrs. Noteboom - They have some of the programs operating within the smaller Townships themselves. Supervisor Valentino - A lot of the Town's costs are off set by money from the State Division for Youth . The money is distributed to the communities through the County with the County matching fonds . They do a lot of the administration by helping setting up programs and giving assistance . They are an important part of the City and the Town's coordinating programing . One of the things that Stu Stein , Chair Tompkins County Board of Representatives asked what can the County fund that does the most good for the community. What are some of the things that the County should be doing ; and what are some of the things should they not be doing? Where can the Town be more effective in what we are doing for the community? The County should try to evaluate whether they can still help to fund the Recreation Partnership . The County was willing to fund the Partnership for two years, now they are thiidng whether their money should fund something else . Programs for youth are hard to identify for what the real costs are , and what the real savings are and still think about youths that are at risk. Councilwoman Harrison - Are those youths in these programs? Supervisor Valentino - Yes . There are a lot of children at risk in these programs . Boundaries are not recognized when a youth does something wrong in one Town , but he lives in another. It seems to be important , in light of some things that the Town has seen in the last couple years , is to try and break down some of those boundaries . This would be the rationale where the County should at least put in $35 , 000 . 00 for at least one more year. Councilwoman Harrison - Can the Town expect the Partnership would become self supporting in the following year? If not , what are we asking of the County? Supervisor Valentino - The people in the Partnership need to look at things like the new rink opening last year to find creative ways to overcome some of those problems . Councilwoman Harrison - Do you believe that this would become self supporting the following year? Supervisor Valentino - I think it could . Councilwoman Harrison - So you believe that the other Towns will end up putting in a share of the funding equal to their share of participation? Supervisor Valentino - I have no way of assessing that information . During former Town Supervisor Noel Desch's term they had a dispute with the City on how much the Town should pay. The Town withdrew fiids for the City's programs and participants had to pay the triple fees . People in the Town showed up at the Town Hall very angry that this was happening . The Town went back to funding the following year. TOWN BOARD MINUTES 31 AUGUST 12, 1996 Councilman Klein - The Town went on a voucher system for one year. Town residents had to pay the triple fees , but then they could submit a request for a reimbursement from the Town . Attomey Marais - The Village of Lansing at that time were confronted with the same issues . One of the things the Village and the Town looked -at them even though you may be paying a distorted amount under the current system if you withdrew you would have to provide those same services to your Town youth . Could the Town do it at a cost less than what is paid now, into the Partnership , to provide the same level of activity? Councilwoman Harrison - The Town is not talking about pulling out , we are talking about cutting off the Towns that are not willing to fund it at their level of participation . Attorney Marcus - The Town risks that the disportionate reduction in cost , might involve a greater contribution by the Town and City on their own . Councilwoman Harrison - That is not what I am following , because If the other Towns only provide 7% of the funding and use 26% of the programming . Cutting this off, would increase the Town's cost? Supervisor Valentino - It would not . If the Town did the two year pilot with the outlying municipalities to see what their participation level is , the people would be used to participating at the Partnership rates Ike the City and the Town . If that was suddenly gone , the elected officials who are not willing to put that money might be faced with a lot of people in the community that would say this is a program that they value . Counci woman Harrison - I am not adverse to going to the County for one more year, but I am adverse to going that route unless the Town decides what our own policy should be in regards to subsidizing other Towns . If the Town is unwilling to do that in the long run , then the Town needs to do something to turn it back to the Partnership for a decision . The $46 , 000 . 00 is a pretty large shortfall . One would need to look at a realistic budget for next year to see what is an equitable breakdown based on last year's usage . Then ask those Towns for a commitment . Councilwoman Russell - The representatives on the Recreation Partnership Board are unwilling to go to their own Boards and ask for funds according to participation levels . Mrs . Noteboom - They say their Boards will never do it , they might give us another $500 . 00 . Supervisor Valentino - The Recreation Partnership should be sending a letter directly to those elected officials . The people that are representatives on the Board have an obligation to take it back to their Boards . Councilwoman Harrison - Who are they? It is the six of the nine representatives . Supervisor Valentino - Correct , but they still should make a point to come and talk to us . TOWN BOARD MINUTES 32 AUGUST 12, IN6 Councilwoman Harrison - Does the Partnership have a voting Board? Mrs . Noteboom - Yes . Councilwoman Harrison - Does the City and the Town represent a majority of that Board , sic of the nine? Mrs. Noteboom - No . Councilwoman Russel - If we do not like the way it is set up , then we would have to withdraw from the Partnership and contract with the City separately? Mrs . Noteboom - If we did that we may loose good programs and pay more . Councilman Conley - The Town should ask the County for the money. Councilwoman Russell - County staff are going to characterize the County contribution as their share being municipal planning coordination by providing a Service Coordinator position . Councilwoman Harrison - Why as a Town should the we pay for it? Mrs . Noteboom - Because the Town is a member of the Partnership . Councilwoman Harrison - Why aren't the other outside Towns pushing this? Mrs . Noteboom - They have received this resolution. Councilwoman Harrison - Then let's see what they do . Supervisor Valentino - The representatives from those communities should be asking County Board for that money, not the Town or the City. Attorney Marcus - There is no reason why this Board cannot modify this resolution to include a provision that requests the Cotty Board to seek some input or committment from each of the other participating municipalities . Councilwoman Harrison - I would like to add to the resolution a 'WHEREAS" to include the break down of the fux5ng and participation so the .County Board is aware of it. There should be a notation saying that if this is not funded the Partnership is endanger of dissolution . The resolution should be clear that this request is coming out to benefit the outlying Towns . I read that the outlying Towns would not support the Business Improvement District downtown . They do not have a sense of committment at times , if the Partnership is trying to build that , it won't be done . TOWN BOARD MINUTES 33 AUGUST 12, 19W Supervisor Valentino - I do not think that the pilot failed because it showed us where the participation is from and where the contributions should be coming from . The pilot did it's job and now it is up to the outlying municipalities to go to the County asking for this funding . Councilwoman Harrison - Are the Boards of these other Towns aware of the benefits? Supervisor Valentino - They might be if they do not have the Partnership next year. Mrs . Noteboom - Another thing that is being approved at the Recreation Partnership meeting on Thursday is a letter to go out to every Township explaining the goals and objections of the pilot and - what they have accomplished . In this letter the participation and funding would not be broken down as Cou x woman Russell has presented it because of the vote on how the numbers would be presented. Supervisor Valentino - The Partnership Board needs to go back and look at the resolution creating the pilot partnership because that is not the way the partnership has written . The whole idea of the Partnership is for people to know and understand what their participation . level is . That defeats the whole purpose of the pilot . Mrs. Noteboorn - We put three sets of numbers together for statistics for actual participation level to see how much municipalities should pay. They showed that everyone on the Partnership , and the other Towns voted not to use those numbers . Councilman Wolff - What is the rationale behind not using the numbers? Mrs. Noteboom - The rationale is that if they take those numbers back to their Townships it would be too much money. They wanted to agree upon a number that could be put forth and divided between other municipalities . Councilman Wolff - Isn't that two separate issues? Presenting information is one issue , versus creating a decision on a funding formula that is fair and equitable . Mrs . Noteboom - No . Supervisor Valentino - The pilot is over, it is time to evaluate the success of the pilot . The whole idea of the Recreation Partnership was to evaluate the success of the two year pilot and determine whether a joint plan approach to recreation is desirable for the long term including what recommendation the Recreation Partnership Board should make to their perspective municipal governments and Tompkins County. The whole idea of the pilot was for them to evaluate the real participation , the real cost , and the real number. I can not see how anybody can vote not to follow the directions of an agreement. Mrs. Noteboom - The first sheet is the participation level based upon funding . The second sheet of the handout is what they are asking each Town to contribute towards it . TOWN BOARD MINUTES 34 AUGUST 12, INS Supervisor Valentino - I do not see where the Partnership has the right not to take the real numbers back to the municipalities . Councilwoman Harrison - Why don't we pass a resolution saying that the Town would be willing to forward the request for funding from the County when there is a real evaluation based on the costs of the program and the participation . Every municipality should be informed about those numbers . Councilman Klein - It appears on the second sheet that the other Townships are Increasing their payments . Mrs . Noteboom - Yes , they are . Councilwoman Russell - That is what is being requested . They are willing take these numbers back to their Boards . Councilwoman Harrison - This also projects the County continuing $35 , 000 . 00 a year? Mrs . Noteboom - Yes . Councilman Wolff - Where is the deficit in this? Mrs . Noteboom - There is a $46 , 000 . 00 budget deficit Supervisor Valentino - If they ask the County for this money they should at least show the real numbers . We should reserve making any decision on asking the County to fund the Partnership until we hear about an evaluation of the pilot , and after the other municipalities see the real numbers . Then the Town could ask the County for the money. CoLrx woman Russel - If we say to the other Towns , the more they participate the more they are going to have to pay, why should they recruit children into the program? Mrs . Noteboom - This is the only recreation program the City and the Town have . Others each have their own separate funds with the County Youth Bureau developing their programs . This Partnership only supplements their programs . They are saying we get the full benefits because it is the only program we have . Supervisor Valentino - In Caroline they have some programs at the school , that keep going because children from the Town of Ithaca participate in those summer programs . The same thing is true for some of the programs that are in the City. Programs that they do not have in Caroline , the children come into the City to participate in . We all benefit each other from what is in place . Councilwoman Harrison - Isn't that what the evaluation is for? TOWN BOARD MINUTES 36 AUGUST 12, 1996 Supervisor Valentino - Yes . RESOLUTION NO. 140 : Motion made by Councilwoman Harrison , seconded by Supervisor Valentino that the Town Board of the Town of Ithaca will consider asking the Tompkins County Board of Representatives to continue funding the Recreation Partnership for the year 1997 after the Town/City/Village Board's and/or Council's of each participating municipality has seen a detailed survey of the program as required under Section 6= K of the Terms of Agreement for the Recreation Partnership Pilot Project , including an assessment of the value of the program to the participating municipalities , and an assessment of the number of participants within each municipality compared to the subsidies provided by each municipality , and be it further RESOLVED, the Town Board hereby requests that each of the other participating municipalities , after evaluating the said formation provided by the Recreation Partnership Board , make a recommendation as to what they believe would be an equitable means of funding the Recreation Partnership for the year 1997 , and beyond . Hydraulic Model of the Town of Ithaca Water System Resolution No . 137 WHEREAS, the Town of Ithaca has set development of a hydraulic model of the Town water system as a priority for the Town Engineer, and ; WHEREAS , the Town of Ithaca through the SCLIWC is participating in a regional water system evaluation with the City of Ithaca , and ; WHEREAS, the City of Ithaca has selected O' Brien and Gere Engineering , Inc . as the engineering consultant for the water evaluation , based on the engineer' s qualifications , and ; WHEREAS , the agreement between the City and SCLIWC for the cooperative study was based in part on the individual municipalities delivering a completed distribution system hydraulic model to the consultant at the beginning of the study, and ; WHEREAS, the Town of Ithaca model is partially complete and the Town has received a proposal to complete the modeling by O' Brien and Gere , which will allow timely completion of the overall system evaluation , and ; WHEREAS , a portion of the model is within the Village of Cayuga Heights , and the Town Engineer has been assisting the Village by providing mapping of the water system , and the Village is considering participating in the modeling project , now therefore be it ; RESOLVED , the Town Board hereby approves the proposal submitted by O' Brien and Gere Engineering , Inc . by letter dated July 24 , 1996 , with a revised breakdown of the estimated fee dated July 29 , 1996 . Town Engineer ' s Report for 8 / 12 / 96 Town Board Meetinct DEVELOPMENT REVIEW Eco - Village Construction activity has included water system installation , building construction , sewer lateral installation , drainage installation and maintenance activities related to sediment and erosion control systems . Erosion and sediment control facilities are being maintained adequately . Final inspections on water and sewer installations have not been completed to date . EARTH FILL PERMITS Five Mile Drive , Immaculate Conception Filling at the site has continued at a slower pace in July due to the use of other sites by the contractor . Sediment control fencing is being maintained around the fill area . The contractor has been keeping the road - way clean . WATER PROJECTS The Town Engineering staff is continuing to work with the Bolton Point staff to implement the Master Metering Program for connections to the water transmission main . The project has been approved and the Notice To Proceed issued . Construction started the last week of July . The Town Engineering staff is assisting the Bolton Point staff in construction administration . The Town Engineer is continuing to meet with the City Engineer and SCLIWC member municipal engineers to develop a proposal for an engineering evaluation to include the entire water infrastructure for the area . This evaluation is being done in conjunction with the City of Ithaca water , supply study . A contract to O ' Brien and Gere Engineers , Inc . is being finalized by the City of Ithaca . O ' Brien and Gere has prepared a proposal to complete the hydraulic model of the Town of Ithaca which is being recommended to the Town Board at this meeting . SEWER Plans for the replacement of the controls and rebuilding of the pumps for Forest Home pump stations number 1 & 2 are being completed with cost estimates . Replacement of these items may be possible within the current operating budget for 1996 . A plan has been prepared for the installation of a monitoring station on Hanshaw Road which will measure the sewer flow into Cayuga Heights system from approximately 800 of the Town properties served by the Village wastewater treatment plant . Installation of this monitoring station is part of the Northeast Sewer Rehabilitation Plan which has been requested by the Village . of Cayuga Heights . Town Engineer ' s Report 8 / 12 / 96 HIGHWAY AND PARKS The Forest Home Bridge Project Contract has been awarded and construction has started with the removal of the existing bridge and trusses . The trusses have been transferred to the restoration sub - contractor ' s shop for repair . STORMWATER Development of a stormwater management plan has made a top priority by the Town Board and the work plan is being ' developed . The development of a plan for the Northeast Drainage System which includes the Dewitt detention pond is being completed along with improvements for Brandywine Drive . Construction of the Dewitt Pond improvements has been started by Town crews with excavation of the pond to increase storage volume and construction of the new inlet channel . BENEFIT ASSESSMENT Benefit Assessment questions and townwide assessment review is continuing . REP Agenda Item #6c Planning Director' s Report for August 12, 1996 Town Board Meeting DEVELOPMENT REVIEW The following are actions that were considered by the Planning Board. Saddlewood Farms Apartments, Mecklenburg Road Landmark America cancelled their appearance at the July 16, 1996 Planning Board meeting. Subsequently, Landmark America submitted a letter (7/24/ 96) to the Planning Board indicating that they would not be asking to schedule an appearance before the Board in August, and that at this time, they are not pursuing approvals for Saddlewood Farms. Cornell University Lake Source Cooling Project, 1000 East Shore Drive Sketch plan for the proposed lake pumping facility and heat exchanger on East Shore Drive, along with the proposed alignment of the chilled water pipe route, was reviewed by the Planning Board at the July 16, 1996 meeting. Meanwhile, Cornell is in the process of preparing the Draft Environmental Impact Statement for the Lake Source Cooling Project, and expects to complete the DEIS by the end of this year. EcoVillage, 1323 Mecklenburg Road Pursuant to the provisions of Special Land Use District No. 8, the Planning Board granted special approval at the July 16, 1996 meeting for the construction of a 54 + /- foot high tower on the Common House, which would excede the maximum height of 40 feet for accessory towers. Soreng Subdivision, 275 Burns Road The Planning Board granted Preliminary and Final Subdivision Approval at the July 16, 1996 meeting for the subdivision of 0.09 +/ - acres from a 2.3 + /- acre parcel, to be consolidated with the neighboring parcel to the northeast P & C Food Market Expansion, East Hill Plaza, Judd Falls & Ellis Hollow Roads The Planning Board granted Final Site Plan Approval for the expansion of the P & C Food Market in East Hill Plaza, to consist of a 8970 + / - square foot addition facing Judd Falls Road, the elimination of a 29 space parking lot, and various landscaping and parking lot improvements. [Note : Due to postponements requested by several applicants and summer vacation schedules, the Planning Board is considering cancelling the August 20, 1996 and September 3, 1996 meetings . ] CURRENT PLANNING DEPARTMENT PROTECTS The following are significant accomplishments or issues that have been dealt with over the past month. Conservation District: After holding a public hearing at the July 15, 1996 meeting, the Town Board enacted the Six Mile Creek Conservation District. County Waterfront Study: The second of three public meetings was held on July 27, 1996, at the City of Ithaca Youth Bureau. The meeting was well attended (approx. 70 people), and much support was given for enhancing the waterfront, especially for establishing a linked waterfront trail system for bicyclists and pedestrians. There was also strong support for the concept of a regional Scenic Byways system that would include the Cayuga Lake area. Tompkins County Economic Alliance: Director of Planning continues to attend meetings held by the Chair of the Tompkins County Board of Representatives concerning economic issues of countywide interest. Current efforts are focused on preparing a draft statement of county-wide economic development goals . Coddington Road Community Center Pavilion: Planning staff provided design and technical assistance to the Coddington Road Community Center (CRCC) in preparing plans for a new picnic pavilion, and are now assisting with supervision of the YCC crew in construction of the facility. SEOR Reviews for Town Board and Zoning Board oard: Several SEQR reviews for the Town Board and Zoning Board were completed, including Crest Lane parking ordinance, special approval for Coddington Road Community Center Pavilion, and variance from sprinkler requirements for EcoVillage Common House. Codes and Ordinances Committee: Has been meeting regularly, and is making . progress on the Comprehensive Zoning Ordinance revisions. Draft revisions have been completed for the following sections: new Table of Contents, Title, Purpose, and Interpretations and Definitions, Establishment of Zones, Low Density, Medium Density, and High Density Residential Zones (i. e., R-30, R-15 and R-9), and Mobile Home Park Zones. Discussions have started on the Business Zones. Key issues discussed during the revision process that will require policy decisions include (1 ) whether there should be some controls or standards established for second units in residential zones (currently allowed automatically), and perhaps regulate by special approval; (2) changing the density/ lot size requirement in the 2 Low Density Residential Zone so that the 30,000 sq. ft. lot size would remain for areas served by public sewer, but the lot size for areas not served by sewer would be higher (the Planning Committee has recommended 3 acre minimum lots for unserved areas; COC suggests 2 acre minimum lots); and (3) whether building siting guidelines might be appropriate for Low Density Residential Zones (e. g., locate buildings below ridgelines or at edge of open fields or in wooded areas where possible, don' t locate buildings in areas that would block a significant scenic view, etc. ), and if appropriate, whether the Subdivision Regulations might be the better place for such guidelines. Other areas of discussion have included the possible addition of an office park or office campus zone; strengthening the Agricultural Zone to provide stronger controls over residential development, allow more agriculture-related businesses, and include a right- to farm provision; and simplifying the special approval process so that actions that currently require site plan approval and recommendation on special approval by the Planning Board and then special approval by the Zoning Board would only have to go to the Planning Board for special approval and site plan approval (other special approvals that don' t require site plan review, such as home occupations, elder cottages, etc. would stay with the Zoning Board) . Planning Committee: The Planning Committee has been studying options for the Low Density Residential and Agricultural Zones and has provided Codes & Ordinances with recommendations . A "farm tour" will be scheduled (probably in September) for any interested Board or Committee member to see what kind of farm operations are in the town, what problems farmers are experiencing, and possibly also including a couple of stops at innovative or alternative farm uses in nearby areas. The Planning Committee is beginning the process of looking at establishing other Conservation Zones now that the Six Mile Creek Valley district has been enacted. Possibilities include Coy Glen, Fall Creek, Cascadilla Creek, and Claussen (South Hill) Swamp. The Conservation Board is being asked to provide input and perhaps prioritize which of these areas would be the most important to look at next. The Planning Committee also has discussed the need to go back to the Comprehensive Plan to see how the current Zoning Map matches up with Comp Plan recommendations, and whether any additional zoning changes may be necessary. As an example, the Plan recommends providing opportunities for affordable housing, but does the current ' Zoning Map provide adequate and appropriately located areas for such housing (which typically would involve higher densities)? In addition, are there sufficient areas in the town zoned for business, office, or industrial growth without competing with the City' s downtown commercial center and without impacting residential areas? Inlet Valley Parcels: At a meeting between Town and City officials, it was agreed that the Town would be the appropriate entity to purchase the two parcels in Inlet Valley from the County. The Town Board, at the special meeting on July 29, 1996, then authorized the Supervisor to begin negotiations with the County on acquisition of the 3 parcels. A Memorandum of Understanding between the Town and City will also be prepared by the Attorney for the Town which will include provisions for future passive park uses of the site, contingencies regarding any environmental problems that may be discovered, and possibilities for the City to acquire the parcels from the Town at a later date as park substitution land for the possible alienation of Southwest Park. Town Hall Committee : Work on possible Town Hall sites continues. The Engineering and Planning Departments are providing staff support in this process. 1997 Budget Proposal: Preliminary Budget proposal was prepared and discussed with Town Board at the special July 29th meeting. Discussion will continue at the special meeting scheduled for August 14, 1996 . Zoning Map Update : The Zoning Map has been updated, and will be presented to the Town Board for acceptance at the August 12, 1996 meeting. The update includes the addition of zoning changes that have occurred since the March 1995 version of the Map and several corrections that were incorporated during the review of the Map. A letter is attached outlining the reasons and proposals for such costs from Tompkins County Division of Assessment . Accounting : The forms for budget estimates and planning were distributed to the Department Heads . The Department Heads presented their estimates to the Town Board at a special meeting held July 29 . Another special meeting to hold a budget work session will be held on August 14, from 5 : 00 p . m . to 7 : 00 p . m . We have hired an individual to help with the accounting functions from a temporary agency until the evaluation of the staff needs of the department can be completed . Daily operations , along with special accounting projects will need to be looked at to determine the level of expertise needed in the department . During August we hope to see demonstrations of the various available accounting computer software packages that are available in order to determine what will best serve our needs . Whicher Director July 29, 1996 Joan Lent Noteboom -Town Clerk 126 East Seneca St, Ithaca, NY 14850 Dear Joan : I am writing to follow up on our meeting of July 25 , 1996 at which I advised you that unless the County Board of Representatives allocates funds to cover the municipal share of roll and bill processing costs, there will be an increase in charges to each municipality from $ . 08/ parcel to $ .25/ parcel . The $ .25/bill charge reflects only the cost of paper, toner, binders and estimated maintenance on the printers . No charges for staff time or initial equipment expense are included in the charge. It should be noted that the cost for a private sector vendor to provide the same service would be approximately $ 1 . 00 per parcel and that the Lansing and Newfield School districts have contracted with the Assessment Department to produce their rolls and bill at a charge of $ 1 .30 per parcel . This increase in cost is being brought about because the rolls and bills will no longer be produced by a heavily subsidized county mainframe processor . Instead, all future rolls and bills will be processed by the County Assessment Department on our local area PC network . While this will result in an increase in directly attributable costs, it will also allow for rolls and bills which are easier for the taxpayer to understand, more efficient for the collector to process, and will accommodate installment payments . In addition, this move should reduce the future cost and provide more flexibility for changes which may be required by legislation or simply desired by the taxpayers or municipalities . As I mentioned at our meeting, I have included a request for increased funding to cover the municipal portion. This request will be reviewed by the Board ' s Government Operations and Administration (GOA) Committee . Since you mentioned your concern regarding the inadequacy of the municipal collection package I should note that it is my understanding that Mr. Squires has requested funding to cover an update of the municipal collection software and would like to address your group in the near future . His request will also be presented to the GOA committee . We have made significant progress and are approaching the stage where it is necessary to seek guidance from the Town Board. In summary, we have conducted a thorough review of our present use of information technology and, we have identified several needs and issues that need to be addressed. These findings will be summarized in a report to be presented to the Town Board by the first week of September. However, given the immediate need to plan for a fiscal year 1997 budget, it is necessary to make Board members aware of the general recommendations prior to the completion of the report. This report will update Town Board members on progress with regards to standardization of computer files and records management. Due to the Town ' s progress in this area, the Town is a strong candidate to receive a SARA grant for the purposes of developing a model system for other municipalities. If approved, the grant would be $50,000 over two years. However, it is still be necessary to budget for this amount due to the possibility that the grant may not be received. This report will recommend that the Town of Ithaca implement a server-based local-area- network (LAN) in order to address current and anticipated information technology needs, current technical problems, and in order to ensure maximum efficiency of Town functions. Networking would allow multiple users to share software, files, and peripheral equipment, and could allow for a user to access "open" files of another station while maintaining privacy of "closed" files. This report will contain an action plan (with options) to outline in full detail the steps necessary to achieve networking. Such steps include the .standardization of all software packages to ensure file compatibility among all townwide computers. Many steps are already being implemented. This report will present the recommendation that the Town consider hiring a network administrator. This persons duties will be threefold: ( 1 ) to help implement a town-wide network; (2) to operate and maintain the network; and, (3) to implement a program of ongoing employee training to ensure the resulting facilities are utilized to their fullest capacity. Finally, the report will answer the questions "what do we accomplish by networking and what does it cost?" Clearly, there are costs associated with these recommendations. There are also significant costs that would be incurred if the Town fails to address its information technology needs in a systematic, comprehensive manner. I look forward to presenting this report and to obtaining feedback from the Board.
