TOWN OF ITHACA
REGULAR TOWN BOARD M ET1NG
JUNE 10. 1996
5:30 P.M.
At a regular meeting of the Town Board of the Town of Ithaca, Tompkins County, New York
held at the Town Hall , 126 East Seneca Street, Ithaca, New York there were present:
PRESENT: Catherine Valentino, Town Supervisor, Carolyn Grigorov, Councilwoman ; David Klein,
Councilman; Edward Conley, Councilman; Mary Russell , Councilwoman; John P . Wolff, Councilman.

CALL TO ORDER, Supervisor Valentino called the meeting to order at 5: 30 p . m. , and led the
assemblage in the Pledge of Allegiance.
AGENDA REVf NO 4 - APPOINTMENT OF PUBUC SAFETY COMM17TEE CHAIR.
Supervisor Valentino - Introduced Henry DeVries, who she has asked to chair the Public Safety
Committee. Mr. DeVries is charged with revitalizing some of the neighborhood groups, and the
neighborhood watch programs. The Committee will work with the City Police Department. The Town
Board appreciates Mr. and Mrs. DeVries willingness to work together to help the Town get this started.
Mr. DeVries - Neighborhoods need to have a sense of security and safety. The last time the Eastern
Heights neighborhood got together we evaluated the Town in terms of the parks, and Park Lane.
These were issues that brought the people in the community together. The neighborhoods got
together to talk, they got to know each other, and that was a good thing. Some recent incidents in
some neighborhoods , such as the incident on Honness Lane where someone was attacked in their
own home brought out the questions from my wife and children, as to what they should do if they need
help ? The answer should be to go to your neighbors . I have talked to Supervisor Valentino about
this, and we both think that the neighborhood watch concept is a good idea. Neighbors should know
who lives next door or around the neighborhood . As my children deliver newspapers they know who
live in a number of houses. Neighbors need to bring together a sense of securi ty and friendship
among families and family units . I grew up in a farm community and everyone up and down the street
could go to each other if something were to happen . I would like for my children to have this same
sense of security. There are things that could be done to make this to happen , such as school
activities or park activities . Opportunities that bring people together can only improve the quality of

life and safety. These are just some ideas for starting points of things that the Town could do to
inform neighborhoods about a problem or issue, or where they go or call . ' Giving people this
information and understanding of what their rights as citizens are, how public service employees and
the police agencies could help them, l read in the paper last night about the D .A. R. E, program in
Lansing, which three out of four of my children have attended at the Caroline School . This is a
wonderful program for the children who stereo type law enforcement officers and public safety people.
The children have had a positive experience with this program, and those positive experiences could
be translated into neighborhood watch programs so there is a familiarity and comfort with the kind of
resources that tax dollars are used for. The Committee will be working with the Town to evaluate what
everyone needs or wants to improve the quality of life and safety in our Town. Supervisor Valentino
and I have talked about the possibilities and the best place to start. There is a lot to address such
as, where are the neighborhoods in the Town, and how do they identify themselves?
Supervisor Valentino - Town Clerk, Joan Lent Noteboom has a list of the contact person in each
neighborhood. The Police Officer who conducts the D.A. R. E, program also helps with the
neighborhood watch programs . He has offered to help us set up and revitalize this program.
Mr. DeVries - People could be encouraged and notified of the . available resources. When our
neighborhood had an incident, people pulled together because they saw something in it for
themselves. I believe people want good for others around them as well .
AGENDA ITEM NO. 3 - REPORTS OF TOWN OFFICIALS,
D. Director of Planning - See attached report.
Mr. Kanter - Introduction of the new Planner, Geri Tierney, to the Town Board: Ms.
Tiemey has been working part-time in the Planning Department for over a year. She
graduated from Cornell University in 1995 with a Masters of Science and Natural
Resources. She has been working on the Environmental Atlas, and she has been
helping with the Geographic Information System (GIS). Ms. Tierney' s duties will be
focused on the GIS to get the system up and running. She also has started on some
other planning projects .
The Planning Department just found out from the New York State Department of
Transportation ( NYSDOT) , that the ISTEA Grant did not make it through the priority
listing of State projects. This project was going to be for the extension of the East
Ithaca Recreationway (the Hannah and William Pew Bikeway) ,
The Planning Board gave Final Site Plan Approval to the Ithacare Senior Living Center.
Ithacare will now be going through the building permit process.
Councilwoman Grigorov - Do you have to start over again on the ISTEA Grant?

Mr. !Canter - The staff is not sure if there is going to be any additional funding available.
There were many projects listed with a higher priority, including some were proposed
by the City. The only Tompkins County project that was funded was the Dryden Trail
which would connect into the East Ithaca Recreationway. There was very limited
funding and high competition of the projects.
Be Town Engineer - See attached report.
Supervisor Valentino - Is the Town ready to deliver the revised water and sewer benefits
assessments to the County?
Mr. Walker - Staff is still working on them. We are reviewing every parcel and checking
them before we send them over to the County. We are planning a lot of variations on
how the map assessment formula was applied.
Supervisor Valentino - Is there going to be a problem because of the deadline the
County gave us?
Mr. Walker - No, we need to get the roil to this Board for approval in October. The
biggest concern we have is that if the Town makes major changes we are not sure the
County will make them properly .
Supervisor Valentino - What time frame is the Town looking at?
Mrs. Noteboom - The County said they would need to receive the revisions by June 15
to place them on the tentative assessment roll . We have told them we would send over
on that date because the Town would want to have the changes on the tentative
assessment roll and the final assessment roll. If the Town needs to change the
deadline date, we would need to call the County to let them know we are not going to
have them for the tentative assessment roll .
Mr. Walker - I do not think we will have all of them received for changes, we could get
the bulk of them done.
Mrs. Noteboom - Could we send what we have done at this point to the County?
Mr. Walker - We could send the ones which are done.
Supervisor Valentino - Have the engineering drawings for the Dewitt Pond been
completed?
Mr. Walker - 1 will have everything for the Public Works Committee next week.

Ce Highway Superintendent - See attached report.
Mr. Noteboom - We may have to execute another agreement with the Federal Highway
System for Stone Quarry Road, that work needs to be done by July 19, 1996. We found
one of the big pipes crossing the road kept settling, and we thought it was a water line
because the hole washed out when we filled it in. We need to dig this pipe out to repair
it, and it will cost additional money beyond what we had agreed to with the Federal
Highway System.
Attorney for the Town Barney - Would this be an agreement between the Highway
Department and the Town, or an agreement between Town and the Federal Highway
System?
Mr. Noteboom - This would be an agreement between the Town and the Federal
Highway System . They pay for the whole thing.
Attorney for the Town Barney - They will pay for this too?
Mr. Noteboom - "Yes. "
Supervisor Valentino - We need to sign this agreement so they could keep the work
going.
Mr. Noteboom - We might be able to pay for this with the funds we have, but that is not
a certainty.
Attorney for the Town Barney - Maybe the Board could consider authorizing the
Supervisor to sign an agreement for supplemental funds if it becomes necessary before
the next Board meeting.
RESOLUTION NO, 101 : Motion made by Councilwoman Grigorov, seconded by Councilman Klein
authorizing the Town Supervisor to execute a supplemental agreement with the FHWA for emergency
relief funds for Stone Quart' Road.
A vote on the resolution resulted as follows:
Supervisor Valentino, aye, Councilwoman Grigorov, aye; Councilman Klein, aye; Councilman Conley,
aye; Councilwoman Russell , aye; Councilman Wolff, aye. Carried unanimously.
Councilwoman Russell - Was an upgrade of Sand Bank Road included in this repair
project? If it was , it would help to prevent similar problems from arising.
Mr. Noteboom - Yes, to a degree, we put in large pipes across the road in some places.

The road itself was not really upgraded.
Councilwoman Russell - Do you expect similar problems with the road in the future?
Is this going to be a continual issue?
Mr. Noteboom - It should not be. We put in new pipes so they should be able to handle
more water, and even if the stones wash away they should pass through the new pipes.
Supervisor Valentino - The only way the Town was able to get the funding was to put
the road back the way it was?
Councilwoman Russell - Did the Town lose more trees and shrubbery in the parks than
normal this year because of the drought last summer?
Mr. Noteboom - I do not believe so .
Councilman Kein - What drainage efforts are under way, and what is the schedule for
the Dewitt Pond and Brandywine improvements?
Mr. Noteboom - We were hoping to have that done sometime in June or July.
E. Director of Building and Zoning - See attached report.
Mr. Frost - Supervisor Valentino and 1 have met with a small group of people from the
Home Builders Association , the Landlords Association in the area, and others to talk
about the Sprinkler Law. We are undergoing some initial negotiations with them
involving what they would like to see as far as a Sprinkler Ordinance. Supervisor
Valentino and I will be meeting with Steve Lucente later this month to look at some of
his apartment complex properties . Mr. Lucente claims they are in a state of disrepair
and he wishes to know what repairs he needs to do to the building without installing
sprinklers.
1 am also in the process of giving people notice regarding changing street numbers for
the 911 emergency Response System will be instituted sometime in the near future.
The Town Board will probably be getting feed back from some people who will not want
to change their numbers . The Town has several streets , Judd Falls Road , East Kng
Road, and Campbell Avenue, where numbers are out of sequence with other numbers.
They need to be changed .
Councilwoman Grigorov - I heard the fire at one of the fraternity houses at Camel[ last
night was put out by a sprinkler system .

Supervisor Valentino - I also heard that one of the fraternity houses at Ithaca College
was put out by the sprinkler system before the Fire Department got there.
Mr. Frost - Ithaca College has made a commitment to having sprinklers in all their
buildings . In the May listing of the building permits issued, five permits to the Ithaca
College terraces are going through renovations on sprinkler installation.
A. Town Supervisor " No report.
Supervisor Valentino - The Town will be having an exit audit meeting with the
Independent Auditors on June 19, 1996 , at 1 : 30 p. m . , any Town Board Member
interested in attending is welcomed. The meeting is to review the 1995 Financial Audit
Report,
F. Town Clerk/Director of Administrative Services - See attached report.
Mrs. Noteboom. - I attended a testimony day sponsored by the United Way of Tompkins.
There were two significant issues that bothered me. One is, that there is only one
psychiatristipsycholcgist in Tompkins County in private practice who will treat children.
1 think there is a definite need for this type of care, and I would like the Town of Ithaca
to ask the County to try and attract other professionals to the area. This doctor has a
waiting list of up to five or six weeks. When a child has mental health needs, they need
to be seen earlier than five to six weeks in order to help the child significantly . Every
representative from the agencies that deals with a mental illness of children in this
County , said that they had at least a three to four week waiting list for children to be
seen, and this especially so in the Town of Ithaca. I think there is a great deal of need
here that the Town of Ithaca is not meeting, and I think this Board should try to talk to
our County representatives once the final report is prepared to review if there is some
way that the Town could help. Examples were given such as when there is a fire in the
home , a parent is arrested , or if a parent was taken away in an emergency vehicle,
children need to be seen right then by someone who could help them understand why
their parent is going away and what is going to happen. They have a lot of cases where
both parents are taken from the home and these children are taken to foster care, and
they are not seen by somebody for up to four to five weeks later to help them
understand why the parents were taken away . The schools cannot take care of all
these problems , and there are not enough professionals to help them.
Councilwoman Russell - Can some of the cases be taken up by psychiatric social
workers or clinical psychologists ?
Mrs. Noteboom - Tompkins County' s representative explained their social workers are
also over loaded with cases . Their waiting lists are also five or six weeks long . That
is the main problem. The County needs to hire more people such as social workers and

psychologists , and they need to attract private doctors to come to this area.
Councilwoman Grigorov -This is based on a County wide basis?
Mrs. Noteboom - Correct, Cayuga Medical Center/Hospital does not have any children
facilities, so in a crisis situation, the child is sent out of the County which is not always
in the best interest of the child, but there is no where else to send them. These are not
children that are diagnosed with major mental illnesses, these are children that are in
a crisis situation who need someone to intervene for two or three sessions that the
problem doesn't lead to a life long problem . The Town is not meeting that need, so we
are finding out that these children have to be in service much longer in the end because
they do not get the help up front
Councilman Wolff - What steps are available to the Town and County?
Mrs . Noteboom - I think probably getting the County to agree to hiring more social
workers and more doctors that are on call and available for emergency situations. The
major problem is that there is not enough crisis intervention and personnel at the
present time. Also the County, many of the ancillary providers are private and these
people have not been trained in the mental health area the way they should be. There
should be more training for the emergency personnel such as fireman and ambulance
personnel , to understand an how to handle a child' s reaction in a crisis.
Supervisor Valentino - Maybe there is something the Town could work out to help
participate with this situation .
Mrs. Noteboom - The report will be coming out in early September.
AGENDA ITEM NO. 8 - PERSQMS TO BE HEARD.
Nell Mondy, 126 Honness Lane - I have written three letters and have been before the Town Board
asking what action the Board is taking concerning security in the Town. I have a petition with a
number of signatures, but I am not ready to turn it into the Town Clerk yet because there are others
who have indicated their interest in signing it. I would like to ask at this time, what has been done
concerning this? The last time Supervisor Valentino mentioned a committee, would it be possible to
have it in writing?
Supervisor Valentino - The Town Board has appointed a Public Safety Committee Chair, Henry
DeVries and his wife , they are going to start working with neighborhoods. Mr. DeVries gave a
presentation earlier in this meeting , and we can provide a copy of the minutes to you to review that
presentation .

ITEM NOv 6 - REPORT OF TOMPKINS COUNTY REPRESENTATIVES
Mr. Joseph - Bev Livesay is in Poughkeepsie receiving an award from the New York State Association
of Counties as the State's outstanding local legislator. Ms. Livesay wanted me to mention to the Town
Board that she has made inquiries to the County Planning Department and the EMC about the
proposed Cornell incinerator. She has not received response as of yet
In regards to the Mental Health Services , it is important to not just focus on psychiatrists or many of
the things that people need. There are other professionals who can provide the service who in many
cases might be a better choice than a psychiatrist, but they are all in short supply and there are long
waiting lists for any kind of mental health services. The County has a mental health department Who
is the provider for a lot of those services, then funding is mostly from the State, and that funding has
been cut by about a third. - It will be unlikely for Tompkins County to see the expansion of the
availability of services . I share all of the Town' s concerns, but the State - just keeps cutting the
funding.
Supervisor Valentino - I do not think the State sees it the same way we do. If people could get a little
help for their children now, often there is a big savings for the community in the future.
Mr. Joseph - I think the County is going to be finding itself this year and in the next couple years,
faced with a lot of choices about are their services that the State has cut funding for that we think ar
so important that we need to pick it up, and I think we will do that with some of them. I think you coui
also count on there being a decline in some services.
Councilman Wolff - The County Budget process, what problems do they face if the State does not
pass the budget?
Mr. Joseph - Uncertainty, I am sure that this Board knows the County has a good fund balance right
now, but without a State Budget in place , we simply do not know what will happen . There is history
that indicates when the State is in a tough position, they balance their budget on the backs of local
government. The County has some hope, and the basic reason the County's fund balance is so good
is that social service case loads have been going down. That has been helping the State, too, and
although they are not saying much about it, their fund balances are also good. That might mean they
are under a little less pressure to pass cuts down to the local level . In Washington they are talking
about cutting .,Medicaid cost by cutting their contribution and the State' s contribution without cutting
any of the mndates . There is about $27 million in State and Federal Medicaid money that comes
into Tompkins County every year. A small shift in what percentage of that needs to be covered
locally could wipe out any fund balance the County has. In one sense the County is in good financial
shape, but there is a lot of uncertainty .
AGENDA ITEM MOO 5 - REPORTS OF TOWN COMMITTEES.

Councilman Wolff - The ADP Committee is looking forward to planning a networked office.
Standardizing future computer hardware and software pruchases. The downstairs area will be
networked sooner than anticipated for networking. The upstairs area is already proceeding with the
review process.
Councilman Klein - The Public Worms Committee met on May 23, 1996 , this Board Will be getting the
minutes by the end of the week The Forest Home Bridge should be starting soon. The Town will be
negotiating with the contractor to do a piece of work on Forest Home Drive. There is an agenda item
to add two laborers, and Mr. Noteboom made the case that he has the room in the budget and that .
he is short staffed to perform anticipated repair of the flooding. The Public Works Committee agreed
the positions were needed. The Public Works Committee will be discussing policies on culvert pipe
replacements in future meetings. 1 did receive a copy of a letter from Mr. and Mrs. Moyd who live on
Christopher Circle commending the Town for improving the Christopher Circle water tank and pump
house.
Councilwoman Russell - I have had a few phone calls from residents asking how the scheduling for
the ballfield at the Coddington Road Community Center is done? Who handles that?
Supervisor Valentino - Anne Morrisette of the Coddington Road Community Center does the
scheduling.
Mr. Notebcom - I believe that will become an issue for the Town in the future, the scheduling of
ballfields.
Supervisor Valentino - This community does not have enough ball fields.

Councilwoman Russell - Most people I talked to are not aware that the Town has any functions there
because no other public things go on there other than the use of the ball field. These people were
not aware that the Town is paying for use of the balifleld.
Supervisor Valentino - We get a report from them each year at the time of the budget to review the
financing.
Councilman. Conley - Do they have a formal association , and do they provide services other than just
day care?
Supervisor Valentino - Yes, they have a Board of Directors.
Councilman Kein - Has there been a response from the Post Office regarding their requirements for
space if their building becomes our new Town Hall ?
Mr. Walker - " No, °

Supervisor Valentino - There is a meeting set up with some people from Comell and several
members of the Town Hall Committee to explore some sites on east hill. The Town Hall Committee
feels the Town needs to keep moving forward if the Post Office does not come through.
Councilman Conley - What is the status of the negotiations with the Post Office?
Supervisor Valentino - Mr. Walker drew up a floor plan of the space showing exactly what the Town's
minimal needs were. Then we had a meeting with Ed Gatch, and he said that the Post Office needed
more space than what the plans showed. We told him that the Town could not get along with less _
space , so negotiations with the Post Office have unraveled at this point. Mr. Walker and I got
together and drafted a letter to Mr. Brickley who is in charge of Post Office Real Estate. Mr. Brickley
stated he. was willing to give the Town the space they needed. We sent the letter to him about the
break down in negotiations. At this point, we are waiting for a response from Mr. Brickley,
Councilman Wolff - Members of the community have concern that the Post Office would close up and
leave downtown, but Mr. Gatch is saying that they Wii not be leaving.
Supervisor Valentino - The Town of Ithaca has said at the beginning that we would not want the Post
Office to leave, and the Town would only be interested in sharing the space with them ..
AGENDA ITEM NO. 7 = REWEW OF CORRESPONDENCE.
Supervisor Valentino - Additional Agenda Item No. 3 is a request for appointment to the Conservation
Board, Agenda Item No. 7a is a resignation from the board.
Mrs. Noteboom - There is one vacancy for a term of office through December 31 , 1996. That would
give us eight members, we are allowed to have up nine members. JoAnn Cornish , Planner, has
recommended that the Town Board appoint another additional member so there would be an odd
number and there would be a better chance for a quorum at the meetings. Ms. Cornish has stated
there is a gentleman who has been attending those meetings who will be sending in his letter of
interest to the Town Board.
Supervisor Valentino - There would be two vacancies .
Mrs. Noteboom - Correct, and I am not sure if this Board would like the Interviewing Committee to do
the interviews.
Councilman Klein - The interviews should be done by the Conservation Board because the
Interviewing Committee only interviews candidates for the Planning Board and Zoning Board:

Supervisor Valentino suggested the Town Board Members review the applications of the candidates.
There will be a discussion at July' s Town Board meeting on the matter.
AGENDA ITEM NO. 24 - SETTING PUBLIC HEARING DATE TO CONSIDER ENACTMENT OF A
LOCAL LAW AMENDING THE TOWN OF ITHACA SUBDMS/ON REGULATIONS MODIF)ING THE
CHECKUST REQUIREMENTS FOR SUBDIVISION APPROVAL.
RESOLUTION NO. 909: Motion made by Councilman Wolff, seconded by Councilwoman Grigorov
that the Town Clerk is hereby authorized and directed to advertise for a Public Hearing to be held at
the next regular meeting of the Town Board on Monday, July 15 , 1996 at 6: 15 p. m. , in order that the
Town Board may consider a, " Local Law Amending the Town of Ithaca Subdivision Regulations
Modifying the Checklist Requirements for Subdivision Approvals" .
A vote on the resolution resulted as follows:
Supervisor Valentino, aye; Councilwoman Grigorov, aye; Councilman Klein, aye; Councilman Conley,
aye; Councilwoman Russell, aye; Councilman Wolff, aye. Carried unanimously.
AGENDA ITEM NO. 26 - SETTTNG PUBLIC HEARING DATE TO CONSIDER AN AMENDMENT TO
THE ZONING ORDINANCE TO REZONE LANDS FOR THE SADOLEWOOD FABMS APARTA9ENT.
1310 MECKLENBURG ROAD.
RESOLUTION NO. 111 : Motion made by Supervisor Valentino, seconded by Councilman Conley
that the Town Clerk is hereby authorized and directed to advertise for a Public Hearing to be held at
the next regular meeting of the Town Board on Monday, July 15 , 1996 at 8: 30 p . m. , in order that the
Town Board may consider an amendment to the Zoning Ordinance to rezone lands for the
Saddlewood Farms Apartments; and it is further
RESOLVED , that the Town Supervisor is authorized to withdraw the notice of public hearing if the
applicant fails to provide all required information on a timely basis to permit the holding of the public
hearing on the above date.
A vote on the resolution resulted as follows :
Supervisor Valentino, aye; Councilwoman Grigorov, aye; Councilman Klein, aye; Councilman Conley,
aye; Councilwoman Russell , aye; Councilman Wolff, aye. Carried unanimously.
AGENDA ITEM NO. 9 - PUBLIC HEARING: TO AMEND THE TRAFFIC ORDINANCE TO
PROHIBIT PARKING ON CREST LANE.
Supervisor Valentino opened the public hearing at 6 : 30 p . m . The Town Cleric had proof of postings
and publications .

Marjorie Loucks, 116 Crest Lane - I would like to see the parking restricted for the first 200 feet to the
end of the John Swan driveway on the south side of the street, and to the Acedes driveway on the
north side of the street. This part is a blind intersection, and people driving north up Warren Road
making a right-hand turn onto Crest Lane would not be able to see cars parked on the south side of
the street. In addition, when the snow truck plows around the car it makes an even smaller space at
the intersection , and it is very dangerous. School children stand on the north side, so that people
driving up the hill cannot see what they would be-turning into. This needs to be taken care of through
restrictive parking. However, the upper area of the street is not a problem at all, and I do not see any
reason for having the whole street restricted. I would like to see the first 200 feet restricted. I do not
think that the residents of Crest Lane would object if people parked on part of the street, it is just the
area to close the intersection which we feel is extremely dangerous.
Mr. Noteboom stated he has received letters from people in regards to the Traffic Ordinance, (see
attached) .
Supervisor Valentino closed the public hearing at ?? p . m.
Councilman Klein - What do the Town Engineer and Highway Superintendent suggest?
Mr. Noteboom - The road is only 500 feet long. The worst part of the problem is what the people are

Councilman Klein - This could be solved with parking restricted for 100 feet or 200 feet?
Mr. Noteboom - 150 feet would be about right.
Supervisor Valentino - If that is where cars park and others decided to park farther up the hill, would
that be a problem?
Mr. Noteboom - It probably would only create a problem for the snow plows.
Supervisor Valentino - If the Town says no parking here, the cars are going to move somewhere.
Mr. Noteboom - It will be less of a problem.
Supervisor Valentino - Even with the snow plows?
Mr. Noteboom - Not as much as at the intersection, but it would be a partial problem for the snow
plows .
Attorney for the Town Barney - How far up the hill is the crest on Crest Lane?

Mr. Noteboom - There was student housing there at one time, but that property has been sold.
Ms . Loucks - Parking on Crest Lane is by people who are not guests of people who live on Crest
Lane. They are guests of people who live on Warren Road.
Councilman Wolff - The available parking is generally taken up by cars, so by having no parking on
Crest Lane, the Town would be pushing those paricing hazards onto someone else. Would a 100-foot
restriction be sufficient?
Mr. Noteboom - I would rather see it a little longer, but limit it to 200 feet.
Supervisor Valentino - Do you think the top of the crest of that hill is approximately 150 feet?
Mr. Noteboom - "Yes. "
Councilman Klein - The amended Traffic Ordinance suggested 500 feet, if the Town changes this to
200 feet could we take action on it now?
Attorney for the Town Barney - I recommend that this be republished and reheard at another public
hearing.
Supervisor Valentino - This way the members could take a look at this view first. We will put this on
for the July agenda meeting to set a public hearing for August. J
AGENDA ITEM NO. 20 - EASEMENT WITH CORNELL UNIVERSITY BELATED TO THE FOREST
HOME WALKWAY.
Attorney for the Town Barney - The agreement is for a walkway which involves a strip of land that
maybe ten feet wide and forty feet long at the end of the walkway next to Warren Road. There was
an agreement from Comell giving the Town the right to build the walkway. They put in a provision
where the Town was asked to indemnify Cornell for anything that could happen. I responded to
Comeil that the land was adjacent to their golf course, and they should be responsible if someone got
injured on the walkway from a golf ball : I have talked to the insurance carrier to determine what the
Town could insure for. They stated that if the Town wanted to name Cornell as an additional insurer
on the policy they could probably insure for anything that would happen there. Someone should be
calling back tomorrow with further information . We are moving closer to an agreement, and I hope
to have the agreement to present to this Board at the next meeting.

ADOMONAL AGENDA ITE,R NO 4 WATER AND SEINER BE -EFIT ASSESSMENT REFUND
Mr. Walker - A request has been made for a benefit assessment refund. This was not a change or
error. There is a landlocked parcel off of Elm Street, Taylor Boulevard, and West Haven Road which
is 6 . 54 acres . This is one of the interesting parcels that we found had a benefit assessment of 1 . 1
units based on past tax rolls. When , computing this benefit assessment based on the acreage,
proximity to water even though it is not a project lot, it is still an illegal non-conforming lot. This lot
may still be buildable for a single family home. After recomputing the units , the actual acreage that
is required of 4. 29, but since it is landlocked, it will require crossing someone else' s parcel. The
benefit formula says that the Town cuts everything by 50% if they need to cross another parcel that
they do not currently have an easement for. Applying that benefit assessment formula to that lot, we
come up with 2. 15 units.
Supervisor Valentino - The Town' s approach should be to make everything comply with the code as
it is now so the Town can get the assessments all cleaned up. Then if the Town needs to look at the
code and make some changes because there seems to be an equity then the Town should do that
Mr. Walker - After reviewing approximately 1 , 000 parcels , there are approximately 10% that were
under assessed. Most of these cases are on large lots that were not developed. I do not think there
is any documentation that the Town Board placed restrictions to development on that parcel for some
reason .
Attorney for the Town Bamey - This Board does have the authority to determine the formula. The
question is the benefit that is conferred on the property based on a particular improvement. The

formula is a mechanism for attempting to establish what the benefit is, but there are circumstances
where the formula will result in unfair assessment because the benefit does not equal what the
formula says.
Mr. Frost - From time to time, the Town comes across subdivided lots that are illegally subdivided.
Just because something is not conforming does not mean that it is legally nonmconforming.
Mrs. Noteboom - This person was requesting the refund because the land is locked, there are no
easements to cross another parcel .
Councilman Klein - Is that true?
Mr. Walker - That's true. This particular lot is below West Haven above Taylor Boulevard. There are
four large lots that are approximately five- +/- acres on the east side of West Haven Road which these
lots are all landlocked to. This particular lot is a 60400t side lot that goes out to a right-of-way that
runs parallel to Haller Boulevard. These lots were part of the big farm which could have a sewer
easement through the adjoining properties.
Attorney for the Town Barney - If these properties are landlocked, how are people suppose to get to
these parcels?
Mr. Walker - There is a driveway . This particular parcel has an improvement on it

Mr. Walker - This land is assessed for 1 . 1 units.
Attorney for the Town Barney - This property could not be developed for more than one unit.
Supervisor Valentino - Could the Town notify these people until we decide to whether or not to
increase the benefit assessment?
Mr. Walker - Yes, there is a lot to look at and go through.
Councilman Klein - Do the tax maps indicate right-of-ways?
Attorney for the Town Barney - Not normally .
Councilman Klein - An owner could be mistaken when they claim they have a landlocked parcel, but
in fact they have an easement over the adjacent parcel .

Attorney for the Town Barney - The Town would pay additional funds into the retirement fund. This
is drawn up allow the Town benefit in five years.
Councilman Klein - This gives the employees a little higher retirement?
Attorney for the Town Barney - The law provides for one month of additional service credit for each
year that an employee was working for the Town of Ithaca. Example: if someone has been working
for 24 years, they would have two extra years credited to them.
Councilman Klein - How does the Town define eligibility?
Attorney for the Town Barney - That would be defined by the State Retirement system.
Mrs. Noteboom - They would have to be 55 years of age by the December 31 , and have a minimum
of ten years vested.

AGENDA ITEM NO 27 - ACCEPTANCE OF LOCATION FOR ROADS PARK AND PUBLIC
unLmES IN THE BUTTERMILK VALLEY ESTATES SUSDMSION.
Mr. Walker - The Buttermilk Valley Estates received preliminary approval from the Planning Board
on June 4, 1996. There is a long cul -de-sac, 40, 000 linear feet of road including the entrance (3/4
mile from the entrance to go around the loop). We are asking the Town Board to accept this location
for the road and, an approve sewer easement to connect to the existing sewer. This has been
designed to be a single entrance road , there was not a good way to put a second entrance into this
property. There is a gully in the northwest comer of this parcel. What the Planning Board has given
preliminary approval to, is 67 residential lots . There wiil be a less than one acre: park located on the
north side of the cukde-sac for the residents. A dedication of 18 +/. acres will be made for open
space and will be given to the Buttermilk Falls State Park There is a small lot at the- northeast comer
with a long narrow right-of-way that was preserved at some point. That parcel would be transferred
to the adjacent parcel . By making this a long loop road, there would not be a dead end street.-
Councilwoman Grigorov - Is this the first phase?
Mr. Walker - The first phase will be less than a 1 , 000 feet to the end of the cul -de-sac, and it is no
technically a dead end cukde-sac because there will be a right-o way with a gravel surface so it cowl

be traveled by emergency vehicles if needed. The Town Park, under the first phase, would be
subdivided off as a landlocked parcel, but it will be deeded to the Town as part of the condition of the
Final Subdivision Approval.
Supervisor Valentino - How wide is the main road?
Mr. Walker - The road right-of-way is 100 feet wide. There have been provisions made in the plan
that the road would have a standard paved road section (22 feet wide) with a gutter section and
underground drainage. There will be a 15400t strip on the north side of the entrance that would be
built like the South Hill trail, so it will provide emergency access if the main entrance is blocked. This
subdivision has a 30400t buffer all the way around the parcel to maintain a wooded condition.
Supervisor Valentino - Does this . come to the Town Board with a recommendation from the Planning
Board?
Mr. Walker - Yes. One of the conditions of that preliminary subdivision is that the Town Board accept
the locations of these proposed improvements.
Councilwoman Russell - Were there any discussions during this process about a connection being
made for a right-of-way through the Leonardo lands?
Mr. Walker - The Leonardo land is north of this parcel . In early sketch plan stages we looked at
different options on how we can make this. This would be a clustered subdivision. The conventional
subdivision had the same number of lots fully developed across it which would put a road to the north
east side of the property. This proposal puts a ridge along the edge of the large lots for the
residential lots back yards.
Mr. Kanter - The entrance road design went through interesting redesign revisions that were first
conceived to be a planted island in the middle of two separated lanes coming in and out of
subdivision. The State did not like that idea. Then it was conceived as the same idea but without a
planted separation with more colored textured paving, but the State did not like that kind of wide
separated entrance. Bill Albem had a number of questions to answerfrom the State and the Planning
Department, and this is the entrance configuration that the State preferred seeing.
Mr. Walker - The road configuration has the center line of the road lined up with the center line of
Schickel Road, which is directly across from Danby Road .
Councilwoman Grigorov - Is the buffer a minimum requirement for a cluster?
Mr. Kanter - It is the required buffer. The cluster provision requires a 30400t buffer.
Councilwoman Grigorov - Even to a park?

Mr. Kanter - The buffer is adjacent to residential lots. The buffer shown on the proposed subdivision
map was an additional thing that was worked out for this particular proposal.
Councilwoman Russell - Between lots 24 and 25, is that going to be a Town right-of-way?
Mr. Walker - There would be a drainage easement and there is a location for a sewer pump station.
During the first phase we will pull the gravity to the existing sewer. During the second phase we will
require a pumping. station.
Councilwoman Russell - So this would not be a public or Town right-of--way?
Mr. Walker - This will be a Town right�cfmway, and I believe this would be opened to the public for park
access. There will be access to this through the park land. I do not believe there is any use
restrictions, but the Town could work with State Parks to have an additional trail. These options are
all available depending on how State Parks wants to open that area.
Mr. Kanter - The State Parks would have the option to determine if and where a path would go if they
accept the property.
Mr. Walker - State Parks gave the indication that they would consider this more of a passive route t
the park rather than a real active trail system. The subdivision design was for the internal circulatic

AGENDA ITEM NOw 18 - RETIREE'S HEALTH BENEFITS PLAN
Supervisor Valentino - This has been something that the Town has been working on because the
retirees health and dental policies were inconsistent on the ways it had been applied to people. The
Personnel Committee worked together to come up with a policy that bring everyone under the same
policy .
Councilman Klein - I do not have a problem with the resolution, but I do have a problem with the
policy. The dental is straight forward. I am very concerned about the cost to the Town for picking up
coverage for retired employees as well as for retired elected officials. Today' s scenario, what kind
of exposure is the Board opening the Town to?
Supervisor Valentino - The rationale was that the Town did not want to pay 100% of the policies after
employees used up their sick time. Retirees would need to pay a part of it Example: we found one
retiree that was only on the plan because it was free, he had access to another plan. In order to keep
that consistent, the Town needed to work out something. The rationale was to look at the full-time
employees. If they retire with less than five years of service they would have to pay 100% of the
premium.
Councilman Klein - I do not have a problem with them using their accumulated sick time, and using
the sick time towards any retiring employees benefit, but once the sick time has been exhausted they
have the benefit of the State Retirement Plan as well as Social Security. Even if they were on
Medicare, they could elect to continue on the Town's health care, but the Town should not be saddled
with picking up that benefit.
Supervisor Valentino - I have found out that if the Town encourages the retirees to stay on our health
plan that it makes the group bigger, it would actually save the Town money.
Councilman Wolff - Councilman Mein is talking primarily a lot those who were permanent employees
and the Town picking up a significant portion of the premiums. For example: if someone has been
working for five years and over and elects to stay with the Town' s insurance, the Town would be
paying for half the premiums?
Councilman Klein - Correct.
Councilman Wolff - In other words , those who work less than 5 % and less than 8% , they are paying
100% of their own premiums, do you have a problem with that?
Councilman Klein - No, as long as they pay their own premium. I do not think that PHP gave a retiree
quote, but it is significant, because Medicare would be 'he primary benefit for retirees .
Supervisor Valentino - The Town looked at the wrap around with the medi gap , using that scenario
it sent the cost sky rocketing because the people in the medi gap are not considered in the other pool .

retiree and then included the retirees in the pool, the check the Town would write for everybody,

Councilman Klein - If the Town goes with PHP we need to see how much this would cost us.
Mrs. Noteboom - As I understand correctly, the premium for present employees and retirees wou
be the same. PHP stated that if a retiree has a family policy, they must stay with that family poll
and they would not be able to go to two individual policies.
Councilman Klein - What happens when the dependents are over 19 or 25?
Mrs. Noteboom - If they have the1amily plan, they have a dependent child or a spouse.
Councilman Klein - A couple is considered a family plan.
Mrs. Noteboom - "Yes. "
Councilman Klein - When reading the minutes of the last meeting, and PHP said they could get two
individual policies.
Supervisor Valentino - Only if someone is just signing up for PHP .
Councilman Klein - Assuming the Town had this plan and the employee no longer has children, but
a couple is considered a family plan , they would stay on that plan until they retire. Is there a
differential when they go on Medicare? Medicare should be the primary carrier.
Mrs. Noteboom - Yes, they would get credit for that.

Supervisor Valentino - I do not have a problem with the Town Board approving PHP . This is what we
presented to the Town employees to encourage them to stay in the pool as it related to cost.
Councilman Klein - I understand the Blue Cross, but there is no documentation with PHP .
Supervisor Valentino - The Town would not know what to expect to pay until we have been in the
program and know which employees switch to PHP . This would be for a six-month trial period:
Councilman Mein - They would have to quote prices after that I would like to see the retirees on the
plan to save the Town money, but it does not sound logical to me.
Supervisor Valentino - The rate for every employee if you take the retirees out of the pool, more than
doubles the premium under Blue Cross. The Town is giving the employees the option of the PHP or
the Blue Cross policy.
Councilman Klein - At some point, the Town would need to discontinue Blue Cross.
Supervisor Valentino - The Town might not be able to because there will be some people that would
not be able to get PHP.
Attorney for the Town Barney - Once employees go from Blue Cross to PHP , would the remaining
Blue Cross people have to pay more?
Supervisor Valentino - Blue Cross will go up. If we get 50% of the people on PHP in .January, with
those employees gone the rates would go up. At that point, the Town might have to make a choice
that only the people that cannot qualify for PHP could be on Blue Cross. I would like to encourage
as many people as possible to join PHP right away. How does the Board feel about this proposal?
Councilman Wolff - I like the proposal like it is written.
Councilwoman Russell - I do not have any problems with this.
Councilman Conley - I do not have any problems with this.
Councilman Klein - Under the scenario that someone could retire at the age of 65, this is a
tremendous cost for the Town to pay.
Supervisor Valentino - The proposal will be significantly less of an obligation for the Town than -what
we are paying now.
Councilwoman Grigorov - Would this be a hardship for the retirees?
Supervisor Valentino - Some of them will have rates going up.

Attorney for the Town Barney - Have the retirees been notified?
Mrs. Noteboom - No. They will be open to the Town Boards approval of this proposal.
Attorney for the Town Barney - Has anyone looked to make sure that the Town is not obligated to
provide something different?
Mrs. Noteboom - Yes, we have. We have not found anything in the minutes going back as far as 15
years ago, saying anything about benefits the retirees were given upon being eligible for retirement
I went back for each one of the retirees we have, and looked at the minutes within 18 months when
they left, and could not find any agreements with the Town. Each retiree is paying something different
on the plan.
Supervisor Valentino - This is a good time for us to do this. If the Town was only with Blue Cross and
switched these people, it would be very hurtful for them to pick up that cost. By giving the option now
to switch to PHP the amount will be significantly less, it makes it less of a burden for them.
Councilman Klein - Do the part-time employees get a pro-rated benefit on anything?
Mrs . . Noteboom - 50%7 if they were paid for 18 hours a week. The Town pays 50% of the Hea
Policy,
Councilman Klein - Are elected officials classified in terms of the percentage?
Mrs. Noteboom - They are considered part-time according to the New York State Retirement System.
They are classified as part-time based on their standard work day that this Board established.
Councilman Klein - Does this vary for the different elected officials?
Mrs. Noteboom - This Town Board enacted a resolution that says a standard working day is six hours,
each elected official must work at least 36 hours or six days per month to be eligible for the employee
retirement benefits and any other benefits. Each elected official , upon being elected, is supposed to
keep a calendar for the first 90 days of their term to establish how many hours a week they are
working based on a six-hour vvorking day.
Councilman Klein - The benefits do not improve until when?
Mrs. Noteboom - They have to work at least 36 hours a month to be considered a part-time employee
for the retirement system.
Councilman Klein - That would be for the Supervisor and the Justices?
Mrs . Noteboom - Correct.

RESOLUTION NO. 106: Motion made by Councilman Wolff, seconded by Councilman Conley that
the Town Board of the Town of Ithaca does hereby approve the attached retiree Health/Dental Policy
effective immediately; and be it further
RESOLVED , that the Human Resource Specialist shall immediately notify the present retirees of this
policy by certified letter, indicating how it will affect them, if they wish to retain the present coverage
under this policy and to reply within 30 days; and be it further
RESOLVED , that if the retiree wished to change their health insurance coverage to PHP, they must
have this request to the Personnel Department no later than June 24, 1996 as June 28, 1996 is the
deadline to notify PHP and Blue Cross/Blue Shield; and be it further
RESOLVED, if the retiree has not responded within 30 days a second certified letter shall be mailed;
and be it further
RESOLVED , if the retiree has not responded to the second certified notice or has taken no action,
his/her participation in the Health/Dental Policy will be discontinued and a third certified letter mailed
to state this action.

AGENDA ITEM NO. 19 - DISCUSS ITHACA AREA WASTEWATER TREATMENT PLANT
UPGRADE AND PROPOSED FINANCING.
Supervisor Valentino - The understanding is that is the Town of Ithaca share of $272, 300. 00 is to help
pay for the upgrade. The City is proposing to take a little bit out of contingency, about $42, 000. 00
for the Town of Ithaca and bond the rest. There is ample money in the Capital Reserve Fund the
Town has at the City to pay the total cost of this project. The City is saying the Town should bond this
because the bonding rates are favorable right now. The numbers that the Town could earn is about
6%, but for how long? The bond rate is somewhere around 3%, so that looks favorable. Since the
Town has reserves being held by the City , I would recommend that the Town's share be paid out of
that reserve. How does the Board feel about that proposal?
All the Town Board Members were in agreement with the recommendation of the Supervisor.
Supervisor Valentino - The Town is in the process of asking the City for a monthly financial report to
show where the money has gone , and how is invested .
Mr. Walker - There is an issue of corrugation of the plan . The Town has meters at the Town entry
points into the sewer system. We use the City sewer system to transport our sewerage from the Town

sewers into the City's. The last three months , based on the total flow going into the plant, shows the
City has been utilizing more than 100% of their capacity. In other words, they have a master meter
at the end flow so they can meter all the water that goes into the plant. Then they would know what
comes in from the Towns, they subtract that, and that is what is being contributed to the City's sewer
system. Another issue is, does the City own any excess capacity at this point? Does the Town need
to buy more capacity? These two questions are something that this Board should look at it Basically,
what the Town is buying is approximately 40% of 3 million gallons. Currently, the Town is utilizing
about 60% of the capacity even with the present wet conditions. If the Town clears up some of the
inflow problems in the sewers, the Town would be using a smaller amount of capacity. There are
some bigger issues here.
Supervisor Valentino - Where does the Town stand about getting commitment from the City about
these funds?
Mr. Walker - I am assuming the City wanted to get into a design this summer, so they could start
building in the spring. Board of Public Works has actually committed the funds for this year.
Councilman Conley - Doesn't it make sense to complete some of that now while they are working on
some of the major highway projects?
Mr. Walker - That is separate from the collection system. The Town would be getting a bill from th
City for some of that work, but we do not know how much yet. The sewers will carry sewerage from
the South Hill area which is part of the Town's interceptor sewer system. The City has been doing
a lot work with the DOT. and they are getting a good opportunity to be building the sewer while the
road is tom up.
Councilman Conley - The City has an advantage also because the construction would open up some
things for them.
Mr. Walker - They have been building the sewer ahead of the other work because the sewer trenches
are significantly deeper than the others. The State has agreed to replace some of the sewers
because their road base destruction is actually destroying some of the existing systems there. There
is also the issue of the joint sewer agreement that is in the process of being updated. Right now it
is at City Hall . They keep promising to send a draft to the Town, but we have not seen it for over a
year. This maybe an opportunity to tell the City that the Town does not want to have an additional
3 million gallons a day capacity, and would we want to sell some of that back to the City, that would
reduce the costs.
Councilman Conley - The Town has had that capacity and has been paying on that capacity for some
time, to sell it back to the City and then renegotiate it later sounds silly.
Mr. Walker - No , I am not saying sell back. Right now the Town has 80% of the 20% exces
capacity . The Town has over a million gallons a day rapacity that belongs to us .

Supervisor Valentino - At this point, this Board is just looking at the funding for the upgrade to take
place.
Mr. Walker - The Capital Reserve Fund, 40% was generated by Town revenue. The City has
committed to a resolution for this year.
Councilman Conley - What Supervisor Valentino is suggesting that this Board make a decision as to
whether the Town wants to bond our portion or use the reserve funds?
Mr. Walker - I do not believe the City thinks there is an opportunity for the Town to take it out of the
reserve capacity because the City has not broken up the reserve fund into individual Towns.
Mrs. Noteboom - Is this a Reserved Fund or a Capital Project?
Mr. Walker - It is a Capital Reserve Fund for upgrading the plan. There are two options for the Town
to do; come up with the money ourselves or join with the City in the bonding program.
Attorney for the Town Barney - What Mr. Walker is saying that the capacity excess is required to meet
the City' s needs, why should the Town pay anything?
Mr. Walker - Correct.
Councilwoman Russell - Why does the City need more capacity? Isn' t the City built out?
Councilman Conley - That is not all the problem , some of the problem is the condition of the system.
Councilwoman Russell - Is the upgrade for improvements to the plant or for the whole system?
Mr. Walker - Just to the plant.
Supervisor Valentino - I thought it was for the meters?
Mr. Walker - The sewer flow meters are a separate project. The meters that were originally installed
in 1985 have some controls with electric failures. They are more expensive= to maintain than to
replace. We would be upgrading to the newer technology for the meter pits. This is a budgeted item
in the budget.
AGENDA ITEM NO 29 - LEAD AGENCY STATUS FOR ENVIRONMENTAL ELATED TO
THE SIX MILE CREEK CONSERVATION DISTRICT REZONING
RESOLUTION NO. 907: Motion made by Councilwoman Russell, seconded by Councilman Conley
that the Town of Ithaca Town Board hereby proposes to establish itself as lead agency for
environmental review of the proposed local law amending the Town of Ithaca Zoning Ordinance by

establishing the Six Mile Creek Valley Conservation District, as described above, and be it further
RESOLVED , that the Town of Ithaca Town Board hereby requests the concurrence of all involved
agencies on this proposed lead agency designation, said concurrence to be received by the Town
of Ithaca Planning Department within thirty days from the date of this resolution.

the Town Clerk is hereby authorized and directed to advertise for a Public Hearing to be held at the
next regular meeting of the Town Board on Monday, July 15 , 1996 at 7: 30 p. m. , in order that the Town
Board may consider an amendment to the Zoning Ordinance for the Six Mile Creek Conservation
District.

AGENDA ITEM N0. 23 - ADOPTING a RESOLUTION REGARDING THE COUNTY'S ASSESSMENT
OF REAL PROPERTY SUBJECT TO CONSERVATION OR AGRICULTURAL EASEMENTS. OR
IN CONSERVATION OR AGRICULTURAL ZONING DISTRICTS.
Councilman Klein - This resolution is addressing that there is a property evaluation by the zoning
action . Would this open the Town for liability between covered assessed valuation and future
assessment areas?
Attorney for the Town Barney - This is governed by State Law. Sending a resolution to the County
to have them assess this property , they are governed by what the State Law says that they have to
assess. There is some legislation in the past years which would change the requirement of the rules
relating to assessment. I do not know if the County Assessment Department has any authority to
take these items into account They are obligated to assess to the highest and best use.
Councilwoman Russell - When an assessor goes out to assess a property, do they look for things
such as improvements on the land , or do they have a list of things they should be looking for?

State has tried to go to a market value system, but I am not sure how that operates.

Attorney for the Town Barney - It is market value, but it is assessed to the highest market value and
the best use, they are not allowed to take into account the fact that a particular piece of property is
restricted because it is in a land trust The assessment is made based on land that is in the area that
is zoned for development in a particular way.
Mr. Kanter - What the resolution is saying is that the Town Board would like to work with the County
on figuring out if there are ways of adjusting assessments where development potential may be
effected. It is not saying that, in all cases , the land value would be affected, and in all cases, the _
County assessment should change. The resolution is saying that on a case-by-case basis there may
be some situation where a change in the zoning will affect the development potential , and if that is
the case, .then the question is the market value of the property effected. This resolution would be
asking the County to look at those situations where there may be an impact and see if there is way
to change the way the assessment system works on those. This means that the Town and the
County would have to work with the State legislature on requiring a change in the State legislation,
and this is what the resolution 'is looking at.
Attorney for the Town Barney - This is directed to the County, and I am not sure the County is the
place to start.
Mr. Kanter - The Town Board might want to write a letter to the State.
Supervisor Valentino • That would be the most effective thing to do .
Mr. Kanter - This resolution came out of the discussions of the Six Mile Creek Conservation District
and discussions of the Planning Committee. One letter from one Town in the State might not be too
effective, but if there were several letters from several Counties or Towns in the State there would be
a chance that something could happen in this area.
Attorney for the Town Barney - Even if the Town was doing the assessment, the Town could not say
which ones they would consider. How the Town or County does assessments is governed by the
State.
Councilman Klein - The Town could not create their criteria?
Attorney for the Town Barney e Correct, and that would be the same for the County.
Councilman Klein - People could donate their land to land trust, then they would remove that property
from the tax rolls, and that would reduce the property taxes. I understand the theory behind this
resolution and I am sympathetic to this, but the Town would be setting themselves up for real
problems.

Councilwoman Grigorov - One of the letters from a landowner in the proposed Conservation District
says , Please development a plan for evaluating any major negative economic impact on property
owners." This resolution is about the only thing the Town could do, if the Town could do it
Attorney for the Town Barney - Some of this is already done now. In a R�30 zone there is raw land,
it is assessed taking into account that someone could build on a 30, 000 square foot lot The one of
concern at this point is the conservation easements.
Supervisor Valentino - What is the urgency of this resolution?
Mr. Kanter - The only urgency is that the Town Board will be considering enacting the Six Mile Creek
Conservation District and consider the recommendation from the Planning Board along with that in
July.
Attorney for the Town Barney - The Conservation Zone is the genesis of this. If the Conservation
Zone is enacted, a reduction of density is required, from that the market value of the property is
reduced. This resolution will not change that, if it happens the assessment department would do so
anyway.
Councilwoman Grigorov - The Planning Committee has discussed this, and it was intended t
encourage people to put their land into Conservation easements. It was part of the idea that th
agriculturists help to save that special land. There is an incentive to taxpayers for a tax reductio
if they belong to the trust.
Councilman Klein - But they would have to give the deed to somebody.
Councilwoman Grigorov - They would need to give it to the land trust.
Councilman Klein - The incentive does not have any impact on the assessment based on the current
law?
Councilwoman Grigorov - Not the assessment, it is their income. The value of something has gone
down because they put their property under the restrictions of the land trust.
Attorney for the Town Barney - If someone gives a gift to the Land Trust, they would be eligible for
a tax benefit.
Councilman Klein - That would be a donation.
Councilwoman Grigorov - A side from the donation they- could put a deed restriction on the property.
Mr. Kanter - There are several municipalities that have gotten special State legislation to have speci
property tax abatement for Conservation easements. Those are individual municipalities where they

is not County wide assessment so they could do that by requesting State legislation . In the Town of
Ithaca' s case, we would have to have County wide concurrence. Have_ it channel through the County
to get to the State legislation .
Supervisor Valentino - What are the concerns of the Board members?
Councilman Klein - If the Board creates a Conservation Zone the Town should evaluate whether we
would be devaluing property as it might be opening the Town up to liability from those who are
opposed to being in this Conservation District. They may take action against the Town for loss of
property value. The Town should be looking into changing the laws for voluntary easements and
voluntary conservation restrictions to reduce the Towns assessment. If this is voluntary, it would be
self imposed by the landowners and they would know they would need to pay their property taxes.
Attorney for the Town Barney - This resolution says, "The County does not currently include an
effective tax abatement program to recognize diminished development . potential of lands in
conservation easements, conservation zones, or agricultural zonesn , which I do not think is accurate.
I think that the conservation zone and agricultural zcne is taken into account when they do the
assessment.
Mr. Kanter - The Town of Ithaca has an agricultural zone, but density wise it does not do anything
differently than an R-30 zone, so that would be difficult to tell if that would affect the evaluation.
Attomey for the Town Barney - The Six Mile Creek Conservation District would be a zoning change,
and a zoning change is something that is considered as part of the assessment process. This is
already done to the extent of what the Conservation Zone creates.
Mr. Kanter - The question now is, how will the County Assessment Office look at this resolution? This
would be the first Conservation Zone adopted of this type, and I think this resolution would be sending
a . signal to the County that this is something new and they need to address this.
Attorney for the Town Barney - The County is required to assess to market value. The zoning permits
only a certain level of development, that would have an impact on market value and should be
reflected in the . assessment. I suggest taking out the conservation and agricultural zones.
Supervisor Valentino - If the Town Board passes this resolution , and when the Board starts talking
about the Six Mile Creek in July,, the most that this Board could say would be that this Board passed
this resolution and sent it to the County for them to consider. People still would not have anything to
hold on to and if the Board does not pass this resolution , the Board could still say that they are very
interested in helping, working , and pursuing these kind of things for this zone. The Town Board
needs to work out some more details in this resolution. The Board will not be voting on this resolution
tonight, I think it would not impact the public hearing in any way without this resolution.

Councilman Klein - I agree with Supervisor Valentino that the Town Board could revise the resolution
by saying that we could take in references for the zones.
Mr. Kanter - The Town Board wants to take questions from property owners about how this
conservation district is going to affect land values.
Councilman Klein - In the mean time, the Town could get in touch with Marty Luster or Jim Seward
to see whether this is something that would get through the State legislature.
Supervisor Valentino - Does the Board want to pass the resolution?
The Town Board Members were in agreement not to pass this resolution until further discussions with
our State legislators about the legalities of tax abatement.

LABORER AND MOTOR EQUIPMENT OPERRATOR.
RESOLUTION NO. 113: Motion made by Councilwoman Grigorov, seconded by Councilman Klein
upon recommendation of the Public Works Committee, that the Town Board of the Town of Ithaca
hereby approves two additional positions for the Highway Department, one Laborer and one Mot
Equipment Operator.

the Town Supervisor is hereby authorized and directed to execute the said agreement and
subcontracts on behalf of the Town of Ithaca; and be it further
RESOLVED, the Attorney for the Town is hereby authorized and directed to continue negotiations with
the County Attorney to reach a mutually acceptable arrangement for the removal of the
indemnification provisions in all contracts and agreements with Tompkins County.

AGENDA ITEM NO. 32 - CONSENT ITEMS: RESOLUTION APPROVING ANDIOR AUTHORIZING
THE FOLLOWING:
Supervisor Valentino - Consent Item for Monthly Financial Reports has been taken out this time
because there was the continuous error of $464. 40, and another for $2, 000 . . This comes partly due
to the accounting package and the way that it gets registered into the system. Otherwise, the
financial report looks good. What we would like to ask the Board to think about with this would be to
move to a quarterly financial statement instead of a monthiy statement.
Mrs. Noteboom - a quarterly report would combine all the reports into one package instead of being
different items. Supervisor Valentino and I would still be reviewing them on a monthly basis.

seconded by Councilman Conley that the Town . Board of the Town of Ithaca does hereby approve

plan to the Town employees along with Blue Cross/Blue Shield ; and be it further
RESOLVED , that implementation of PHP would take effect July 1 , 1996 for a six month (trail ) period;

the proportion of the premium paid by the Town and the employees shall be determined at that time.

Town Cleric to abolish the Petty Cash Fund of the Planning, Engineering, and Building/Zoning
Departments; and be it further
RESOLVED , the Fiscal Officer and Town Clerk are hereby authorized and directed to balance th
said fund and deposit the monies in the applicable cash account.

RESIDENTS.
Mrs . Noteboom - A petition has been submitted requesting that the Town Board suspend the
establishment of Chase Farm Lighting District.
Councilman Conley - Did a majority of people sign the petition?
Attomey for the Town Barney - They are requesting a point of the referendum .
Mrs. Noteboom - They were sent a copy of the public hearing notice.
Mr. Walker - They are concerned about the cost and the lighting patterns and they were wonderin
if there was another design that would assist the neighborhood. The neighborhood is split on th
process .

Attorney for the Town Barney - Are they looking for a referendum?
Mr. Walker - They do not like the Lighting District as it was approved.
Councilwoman Russell - They have reservations about the number of existing lumens not being
added into the calculation of the new lights that are going in. They did not realize by bringing this
petition they were bringing up their referendum and they thought they could stop the fighting district
for these issues to get discussed.
Attorney for the Town Barney - The Town could repeal the resolution establishing the district.
Councilwoman Grigorov - Does the Town have to repeal it because of the petition?
Attorney for the Town Barney - No . This petition is only an expression of several people about how
they feel about the matter.
Mr. Walker - They are having a community meeting. I offered to talk to them about the different
design options.
Supervisor Valentino - When we passed this district, did the Town Board pass this on a specific
design?
Mr. Walker - Yes , and the speck number of fixtures.
Councilman Conley - I think the reason the Town Board passed this lighting district was knowing that
they could have a referendum and vote on it.
Councilwoman Russell - They want some design changes, and I told them that there was some
flexibility still left within the design but I was not sure how much.
Mr. Walker - There is some flexibility with the exact locations of the poles, however there will not be
that much because they are going to be 18 foot high. There will be 12 different fixtures.
Councilwoman Grigorov - Could this petition stop the process of the fighting district?
Attomey for the Town Barney - This petition does not stop the process. The Town Board can react
to the petition by directing the Town Engineer, Attorney for the Town, and the Town Clerk from
conducting anything further on this until there has been an opportunity for people to meet and- make
a decision. If the decision was for the Town to design something different than has been established,
the Board could repeal the adoption of the original resolution and adopt a new resolution for the
district with the new design.
Supervisor Valentino - How many people are in this district?

Councilman Wofff - If that process gets turned down, could the Town refer to what has already been
passed?
Attorney for the Town Barney - Correct, but at that point, they would have waived their right for a
permissive referendum if they do not file a petition within the 30-day period.
Mrs. Noteboom - If the Town does approve this, the Town would have to create a budget for this
district so it could be funded. There is a short time frame for that because of the budget process.
Councilman Conley - Could the Town communicate to them and tell them if they want to protect their
options they should do a petition for a permissive referendum , but in the meantime, the Town should
see if they could work something out.
Attorney for the Town Barney - What is the Town Board going to do with the petition? . The Town
could either have the permissive referendum , which means setting up the vote, or the Town Board
could vote for a repeal of the motion for the order that established the district.
Councilman Conley - A lot of people fought for this district, but then a lot of people are against it.

cancel the referendum once they applied for it?
Attorney for the Town Barney - No , once a petition is filed, the Board holds the referendum because
they cannot repeal the petition .

Mr. Walker - I got the impression they want to work together in the community on a plan everyone
would be happy with.
Councilwoman Russell - The people that do want the district have done their work, and signed the
petition in favor of it, are concerned the existing lumens from the existing post lamps were not taken
into account in the calculation of how many lumens are in the district.
Councilman Klein - Each property owner has a post lamp.
Supervisor Valentino - Not everyone turns them on and this is one of the reasons they wanted this
district, because so many people were not turning their post lamps on . AM

Mrs. Noteboom - Could the Town Engineer develop two scenarios of where the lights would go for
this districf for the next Town Board Meeting . Then this Board could have a discussion and send a
copy to each of the people in the district stating that there has been a petition and there has been
questions about these various things. The letters could state this is what changes we are proposing,
this is what it will cost, then have another public hearing.
Attorney for the Town Barney - The Town could give everybody a chance to sit down and work this
out , but if the Town does that without submitting this properly, then they have lost the object for
permissive referendum . However, this does not stop the Board from repealing the decision for setting
up the district in the first place.
Mrs . Noteboom - The petition needs to signed by the majority of owners based on the assessment
value rather than the number of residents?
Mr. Walker - For the creation of the lighting district, 50% of the value of the properties for 50% of the
people in the area. The original petition met that.
Supervisor Valentino - Can we tell these people to have their meeting and see if they could come to
an agreement?
Mr. Walker - Yes , the Town could always repeal .
Supervisor Valentino - The Town could always repeal what we had and start the clock all over again,
so they could still have a chance for a referendum .
The Town Board agreed to have the Chase Farm residents hold a meeting to try and come to an
agreement.

Councilman Wolff - The ADP Committee discussed that, if the Town does go into a networked Town
Hall it would be very useful to create a . new position . Someone who would be responsible for
maintaining the networks and provide training of the software on each of the computers. How does
the Board feel about having this type of position?
Councilman Conley - What is a Town Hall network?

Councilman Wolff - All the computers would be able to talk to each other by sharing printers , files, and
other technology resources.
Attorney for the Town Barney - Would this be a full-time person?
Councilman Wolff - Yes, This person would be doing network administration and other roles. If the
Town were to consider it, maybe they would want to start out the position , on a trial basis to see how
things are running before a permanent position could be established. There is a lot of work to keep
networks running and operating.

WHEREAS , on February 12 , 1996 , Resolution No . 27/ 1996 the Town Board
approved the execution of an agreement between the Federal Highway Administration
( FHWA) Emergency Relief Program and the Town of Ithaca for emergency relief funds
to complete repairs to Stone Quarry Road created by severe water run off and flooding
in January 1996 ; and
WHEREAS , it is required by FHWA that the said repairs to Stone Quarry Road must
be completed by July 19 , 1996 ; and
WHEREAS , the Highway Superintendent has discovered there is more damage to
Stone Quarry Road than recently believed and that the cost of those repairs would also
be eligible for funding by the said FHWA Program upon the execution of a
supplemental agreement between the Town of Ithaca and FHWA; now therefore be it
RESOLVED , the Town Board of the Town of Ithaca does hereby authorize the Town
Supervisor to execute a supplemental agreement with the FHWA for emergency relief
funds for Stone Quarry Road .

Resolution Increasing the Amount Authorized for
Expenditure on the Installation of Master Meters

WHEREAS , the Town Board in January of 1996 and in March of 1996 authorized
the expenditure of up to $ 104, 033 . 00 by the Town for the purposes of installing master
water meters at several locations throughout the Town ; and
WHEREAS , the bids for such work came in at an amount in excess of the amount so
authorized ; and
WHEREAS , as a result of said bids the maximum proposed to be expended by the
Town of Ithaca for the aforesaid improvement is $ 150 , 000 . 00 ; and
WHEREAS , the installation of such meters has been determined to be a Type II
action pursuant to the regulations of the New York State Department of Environmental
Conservation promulgated pursuant to the State Environmental Quality Review Act and
the laws and regulations of the Town of Ithaca , as being construction of a primary or
accessory/appurtenant non - residential structure or facility having less than 4 , 000
square feet of gross floor and not involving a change in zoning or a use variance and
consistent with local land use control ; and
WHEREAS , said maximum estimated cost is not greater than 1 / 10th of 1 % of the full
valuation of taxable real property in the area of the Town of Ithaca outside of any
villages ; and
WHEREAS , it is proposed that the cost of the aforesaid improvement shall be borne
by the real property in said Town of Ithaca Water System Benefitted Area by assessing ,
levying upon , and collecting from the several lots and parcels of land within said
Benefitted Area , outside of any village , which the Town Board shall determine and
specify to be especially benefitted by the improvement , in amounts sufficient to pay the
costs of such improvement ; and
WHEREAS , the Town Board of the Town of Ithaca has held a public hearing upon
the plan , report , and map including an estimate of cost on the question of providing
such water improvements on the 1 0th day of June , 1996 at 6 : 45 p . m . ; and

WHEREAS , notice of said public hearing was duly posted and published as required
by law; and
WHEREAS , said public hearing was duly held at the place and at the time aforesaid
and all persons interested in the subject thereof were heard concerning the same ; and
WHEREAS , it is now desired to authorize the institution of the project and the
execution of agreements related to same ,
NOW, THEREFORE, BE IT RESOLVED , by the Town Board of the Town of Ithaca
as follows :
Section 1 . The Town of Ithaca authorizes the construction and installation of the
master meter and control valve improvements including the construction of a vault or
related building in five locations in the Town of Ithaca on Spruce Lane , Sheldon Road ,
the Apple Orchard , Pine Tree Road , and Pearsall Place , all as more particularly set
forth in said report of the Town Engineer.
Section 2 . The Town of Ithaca , acting on behalf of the Townwide Water
Benefitted Area of the Town , hereby authorizes the expenditure of up to $ 150 , 000 . 00
for such installation and construction .
Section 3 . That the cost of said project , $ 150 , 000 . 00 , shall be payable from
assessments levied upon and collected from the several lots and parcels of land
deemed benefitted from said improvement and located in the Town of Ithaca Water
System Benefitted Area , so much upon and from each as shall be in just proportion to
the amount of the benefit which the improvement shall confer upon the same .
Section 4 . It is hereby determined that the estimated expense of the aforesaid
improvement does not exceed 1 / 10th of 1 % of the full valuation of the taxable real
property of the area of said Town outside of villages and , therefore , in accordance with
the provisions of subdivision 13 of Section 209-Q of the Town Law, the permission of
the State Comptroller is not required for such improvement .
Section 5 . The Town Supervisor is authorized to enter into an amended master
meter agreement with the other members of the Southern Cayuga Lake Intermunicipal
Water Commission pursuant to which the authorized expenditures are increased to
reflect the increased bids and pursuant to which the installation of the master meters
both in and out of the Town of Ithaca are being installed , and pursuant to which the

Town of Ithaca will pay its pro- rata share of the cost of same as a participant of the
Southern Cayuga Lake Intermunicipal Water Commission ,

WHEREAS , the Town of Ithaca has been authorized to be the Contracting
Municipality for the Construction of Master Meter and Control Valve Improvements
Project by the Transmission Main Master Meter Agreement executed by all members of
the Southern Cayuga Lake Intermunicipal Water Commission , (SCLIWC) ; and
WHEREAS , each member municipality has agreed to a proportionate contribution
for funding of the project as set forth in the Transmission Main Master Meter
Agreement; and
WHEREAS , the SCLIWC solicited for bids and received bids for the project on April
30 , 1996 ; and
WHEREAS , the SCLIWC and the Town Engineer have reviewed the bids and
qualifications of the bidders and has recommended that the low bid of $260 , 213 for the
total project made by Finger Lakes Construction ( FLC) of Ithaca, New York is a
qualified bid and that FLC is a qualified contractor; now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the
award of the contract for the Construction of Master Meter and Control Valve
Improvements Project , to Finger Lakes Construction (FLC) of Ithaca , New York, for the
amount of $260 , 21100 , subject to final approval of the contract documents by the
Town Engineer and the Attorney for the Town .

present retirees of this policy by certified letter , indicating how it will effect them , if they
wish to retain the present coverage under this policy and to reply within 30 days ; and

RESOLVED , that if the retiree wished to change their health insurance coverage to
PHP , they must have this request to the Personnel Department no later than June 24 ,
1996 as June 28 , 1996 is the deadline to notify PHP and Blue Cross/Blue Shield ; and

HEALTH / DENTAL BENEFIT PLAN FOR RETIREES
DENTAL
A retiree may wish to have dental coverage upon retirement from
the Town . However , the premium will be paid 100 % by the retiree .
This premium shall not be paid with any unused " sick time "
balance . If the retiree wishes dental coverage ( individual or
family ) , he / she shall pay the Town by check or cash . As the Town
pays the dental premium one month in advance , so shall the
retiree pay his / her monthly premium to the Town one month in
advance .
HEALTH
ELIGIBILITY : To be eligible for health insurance , the retiree
must be receiving retirement benefits such as from the State
Retirement System . To be eligible to use sick time accrual , a
retiree must be retiring from the Town and be receiving
retirement benefits such as from the State Retirement System . If
the retiree does not fulfill the previous qualifications ,_ but
wishes health coverage through the Town , he / she may do so at 100 %
of the premium .
The " sick time " balance is to be used ONLY for the individual
retiree premium . If a retiree has a " sick time " balance , and
wishes to continue health coverage , then he / she may do so under
the individual health plan ONLY . 100 % of the premium will be
deducted from the retirees ' " sick time " balance until it is used
up , at which time the retiree may elect to continue coverage ( see
page 2 ) . If the retiree is using " sick time " and wishes to
include his / her spouse , it may be cheaper to have two individual
plans ( retiree paying by check or cash to the Town 100 % of the
premium for the second ) rather than a family plan . See the
Personnel Department as to the possible savings . If the retiree
is using " sick time " towards his / her premium and wishes the
family plan , then he / she shall pay ( by check or cash ) to the Town
the premium difference between the single and family plan .
Upon the death of a retiree with a " sick time " balance , the
spouse may use up this balance at 100 % . Upon depletion of this
balance , the spouse may continue coverage , however , he / she shall
pay 100 % of the monthly premium to the Town one month in advance .

WHEREAS , the Town Board has proposed a local law amending the Town of Ithaca
Zoning Ordinance by establishing the Six Mile Creek Valley Conservation District , to be
located generally between Coddington and Slaterville Roads and the City of Ithaca and
Town of Danby and Town of Dryden boundaries ; generally following the established R-
30 Residence District boundaries and 200 feet west of the right-of-way of the South Hill
Recreation way and railroad grade , as shown on a map entitled "Six Mile Creek Valley
Proposed Conservation District" ( revised 4/18/96) , and
WHEREAS , the Town Board referred said proposed local law to the Town of Ithaca
Planning Board for their recommendation pursuant to Town of Ithaca Town Board
Resolution No . 40 , dated March 11 , 1996 , and
WHEREAS , the Planning Board , after holding a Public Hearing on May 7 , 1996 , and
a follow- up public meeting on May 21 , 1996 , and after reviewing the above= referenced
local law, a Full Environmental Assessment Forms Parts I and II prepared by the Town

1996 Youth Services Agreement With Tompkins County

WHEREAS , it is necessary for the Town of Ithaca to enter into an agreement with
Tompkins County in order to participate in the Tompkins County Youth Services
Program ; and
WHEREAS , the Town Supervisor and the Attorney for the Town have reviewed the
proposed agreement with Tompkins County for the Youth Services Program , the
subcontractor agreement for the Summer Employment Program sponsored by the
Ithaca Youth Bureau , and the subcontractor agreement with the Learning Web ; and
WHEREAS , the Town Supervisor and the Attorney for the Town agree with the
conditions and terms of payment in the said agreement and subcontracts with the
exception of the indemnifications provisions provided the same can be changed by the
Town Supervisor and Attorney for the Town ; now therefore be it
RESOLVED , the Town Supervisor is hereby authorized and directed to execute the
said agreement and subcontracts on behalf of the Town of Ithaca ; and be it further
RESOLVED , the Attorney for the Town is hereby authorized and directed to
continue negotiations with the County Attorney to reach a mutually acceptable
arrangement for the removal of the indemnification provisions in all contracts and
agreements with Tompkins County .

WHEREAS , the first bi- annual newsletter of the Town of Ithaca was sent to
residents during the month of May; and

determined that the costs of the said newsletter were inappropriately budgeted for

WHEREAS , it is required under the Federal Highway Administration Emergency
Relief Program , ( FHWA) that the expenditures of the flooding repairs to Stone Quarry
Road must be under a specific line item appropriation account; and
WHEREAS , the said appropriation account does not contain a sufficient budgeted
amount to purchase the materials needed for all the repairs on Stone Quarry Road ; and
WHEREAS , it is necessary that a budget amendment be made to appropriate the
needed funding to this said line item for the repairs to Stone Quarry Road ; now
therefore be it
RESOLVED , the Town Board of the Town of Ithaca does hereby authorize and

Administrative Services could perform the duties of Purchasing Agent under Town Law;

WHEREAS , Town Supervisor has determined that expanding the duties and
responsibilities of the Town Clerk/Director of Administrative Services by appointing her
Purchasing Agent would allow for the proper audit trail and efficiency of daily

contractor working for the homeowner found the Town portion of the lateral connection
was in poor condition . Town staff confirmed this and when discussing the work with the
contractor determined that the most cost effective way to effect the repair was to have
the contractor proceed with the work . The Town portion of the work including parts and
labor being $93 . 50 , and
WHEREAS , Chip Welch has paid the contractor for the work on the Town portion of
the lateral , now therefore be it

in the calculation of the weekly hours worked , and the hourly pay rate of StarrRae
Hays , Senior Typist from approximately 39 hours per week to 37 . 5 hours per week with
an hourly pay rate increase from $8 . 92 per hour to $9 . 21 per hour effective with the first
pay period of July.

WHEREAS , representatives from PHP ( Prepaid Health Plan ) have met with Town
employees to discuss their organization , rates , and benefits ; and
WHEREAS , the favorable response from these meetings have indicated that PHP
would be an acceptable alternative to offer Town employees along with Blue
Cross/Blue Shield ; and
WHEREAS , there will be a considerable dollar savings to the Town , depending on
the number of employees changing to PHP ; now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca does hereby approve
offering PHP as an alternative health care plan to the Town employees along with Blue
Cross/Blue Shield ; and be it further
RESOLVED , that implementation of PHP would take effect July 1 , 1996 for a six
month (trial) period ; and be it further
RESOLVED , that with the savings this brings to the Town , the Town Board of the
Town of Ithaca shall pay 100% of the PHP individual and family premiums ($ 135 . 38
and $361 . 76 per month respectively) during this six month period ; and be it ,further
RESOLVED , that if the Town Board elects to continue the PHP program after the six
month period , the proportion of the premium paid by the Town and the employees shall
be determined at that time .

Highway Superintendent ' s Monthly Board Report , May 1996
Town of Ithaca Town Board Meeting , June 10 , 1996
Attached is a summary of the Federal Emergency Management Assistance ( FEMA )
program and Federal Highway Administration ( FHWA ) which the Town of Ithaca is
currently receiving due to the flooding in January . We have two ways of
tracking the money that has been spent . One is on ' the computer , which listed
the accounts and what was allotted for each expenditure As we purchase
materials , etc , it is subtracted from the total . The other way is a bit more
complicated and has to be submitted to FEMA when the projects are finished .
This includes tracking each employee , piece of equipment , and materials used ,
along with check numbers and using codes ( FEMA provides ) .
We worked 676 . 25 hours this month on Sand Bank Road to get it open . Of those
hours , 26 . 75 were over time hours . As can be seen by the FEMA update , Sand
Bank Road is open , but there is still work to be done . This is part - of the
FEMA work .
Another FEMA project is Hackberry/ Coy Glen area . We worked 31 hours on this
project . Currently , there is only a small amount of ' ditching to be done and
chip sealing .
Stone Quarry Road was worked on this month too-; this is the FHWA project . We
orked 32 hours on this project . There is more to be done ' on ' this road .
Along with the FEMA and FHWA work , the Highway crews worked 455 . 75 hours on
General Repairs . This includes 27 . 25 hours of over time . Some of the
projects worked on include water damage repairs ( not included in FEMA ) ,
shoulder repairs , vehicle preventive maintenance , ditching , etc .
We worked 129 hours on Machinery repairs and maintenance .
In May , we worked on Winthrop Drive , Brandywine Drive , and Simsbury Drive to
repave them . Work included , shoulder work , manhole - work , ditching , and
recycling the shoulders and road pavement ( which was - mixed with new stone and
put back down ) . In June , a " top " coat of asphalt will be put on top of the
recycled pavement . These , along with a few other minor jobs , took 277 . 25
hours , of which 39 . 25 where overtime .

1 . Park and trail mowing was begun the first week in May for a total of 87
hours . Some sites were too wet to mow the first time around , but were
caught up later in the month .
2 . Due to the wet conditions , lawn restoration work on sewer and water
breaks which occurred since last fall had to wait until late in the
month . A total of 30 hours were spent so far grading , topsoiling , and
reseeding these areas .
30 Spring clean ups in the parks and trails were completed, . totalling
another 30 hours .
49 South Hill Trail received another top dressing of sand ( as was done last
May ) and was then rolled to help push down loose gravel . , This work took
44 hours .
58 Parks staff assisted Highway . crews at Sand Bank Road , contributing : 121
hours towards getting the road opened up again .
6 . Parks helped install a new culvert pipe at Pearsall Place to hel
alleviate a washout that affects South Hill Trail . New . sections
ditch along the road and trail were also dug . This took 21 hours
7 . The wheelchair accessible picnic tables were sealed and then placed at
all parks and several trail locations as part of our program of .. ADA
upgrades at our facilities . A total of 24 hours were , spent finishing
this project .
8 . Some additional work at the annex building was accomplished during . rain
days , for a total of 16 hours .
9 . Don TenKate attended a training program in Command Management . and
Leadership for one week .

FEMA UPDATE
The following is an overview of the Federal Emergency Management
Assistance program . We received a letter from FEMA that $ 42 , 627
has been approved for relief funding . We received a check for
$ 38 , 578 which included an ' administrative cost of $ 1 , 279 . We also
received a letter from FEMA that $ 61 , 156 has been approved for
relief funding for Sand Bank Road .
Sand Bank Road
Repairs included in the DSR are : Ditch cleaning and
shaping/ grading ; base coat ; top coat of asphalt ; slope protection - -
rip rap dumped ; saw cut pavement , replace guide rails ; reseed and
fertilize .
Sand Bank Road is now open . All the work has not been completed
yet , but enough to open the road . We will , from time to time , have
to close the road for a day while finishing the . work . The base and
top coat of asphalt were applied this week . Some things to be
finished are putting shoulders on , guide rails in , seeding , and
clean up .
To date , we have regraded the road , cleaned up the ball field below
road ( helped by Probation Community Service workers ) , put in new
culvert pipes , put in gabions , applied asphalt , etc .
Hackberr Co Glen
Things included in the DSR : Replace two culvert end : sections ,
repair shoulders on Coy Glen and Hackberry Lane'', chip and seal , and
ditching .
To date , all work included in this DSR has been completed except
the chip sealing and some ditching , which will be ' done in July or
August .
We have worked 92 . 5 hours on the project . Basically , the work done
here was to clean out the ditches and replace , shoulders with gravel
( which had washed down to Coy Glen ) . Then we replaced the culvert
ends ( aprons ) .
West Haven Road
The project calls for ditching/ grading and " putting in . gravel . We
have already replaced a culvert pipe and filled in washouts and
repaired shoulders . This work was done o' n 1 / 20 ' and took 25 . 75
hours of time . There is some minor ditching and changing of a pipe
to be completed .
Elm Street

On Elm Street , the DSR calls for us to remove debris , restore ditch
line and replace aggregate sub - base . None of this project has been
worked on yet .
Park Lane / Sharlene Drive
This DSR says that the ditch line needs to be re - established . We
have worked 102 . 5 hours on this project although there is more to
be done . There is still a lot of ditching and shoulder work to be
done . We hauled in 180 . 46 tons of Crushed Bank Run for this
project .
Flood Retention System
Project DSR calls to have ditches , ( along Winthrop and Brandywine )
cleaned , along with culvert pipe , putting in rip rap and . re -
establishing ditch line . This work will be completed : in
conjunction with the Dewitt Retention Pond System .
The only work done on this project was done on 1 / 19 and 1 / 20 .
Ithaca Hiking Trail ( East Ithaca Recreation Way )
Project calls for rip rap4to protect slope and repair to pre -
disaster condition . No work has been completed on this project .
Bolton Point
Grading and sloping road and shoulder and cleaning and shaping
ditches was completed on this project .
This project is already done . It was - done: by Paolangeli
Contraction and cost the Town $ 2 , 243 , of whi,ch , FEMA . will reimburse
$ 1 , 682 .
All together , we have spent about $ 60 , 000 on FEMA projects .

The following is an overview of the Federal Highway Administration
Emergency Relief program .
Stone Quarry Road
The FHWA granted the Town of Ithaca $ 30 , 000 to repair Stone Quarry
Road . To date , we have incurred $ 18 , 484 . 31 in expenses repairing
the road . We have worked 297 . 5 hours on reshaping / cleaning
ditches , etc . This includes the day of the flood .
We anticipate finishing Stone Quarry in June .
As can be seen , we have a really tight schedule for the summer
months . There is much work to be done , with our regular work
along with these extra projects . We are fortunate to have very
motivated individuals with a desire to help the Town achieve our
goals .

Planning Director' s Report for Tune 10, 1996 Town Board Meeting
(Due to limited time, this is an abbreviated report, highlighting only the major items
during the past month. )
DEVELOPMENT REVIEW
The following are the major actions that were approved.
Ithacare Center Senior Living Community, Danby Road
Final Site Plan was approved at June 4, 1996 Planning Board meeting.
Buttermilk Valley Estates Subdivision DEIS, Danby Road
The Findings Statement was approved and Preliminary Subdivision Approval
was granted at the June 4, 1996 Planning Board meeting.
Saddlewood Farms Apartments, Mecklenburg Road
After the Town Board referred the rezoning request to the Planning Board for
a recommendation, the Planning Board approved a resolution indicating that
they intend to serve as lead agency in the environmental review. A special
work session to discuss the sketch plan has been scheduled by the Planning
Board for June 11 , 1996. Staff has met several times with the applicant to
discuss specifics of the project design and the review process.
CURRENT PLANNING DEPARTMENT PROTECTS
The following. are significant accomplishments or issues that have been dealt with
over the past month.
Conservation District: The Planning Board recommended at their May 21, 1996
meeting that the Town Board enact the proposed Six Mile Creek Valley Conservation
District. The Planning Board recommended that the Town Board consider the 200
foot boundary from the South Hill Recreationway and also recommended excluding
four parcels along Burns Road from the District to avoid non-conforming Jots.
County Waterfront Study: A focus group meeting was held on Saturday, May 18,
1996, to obtain input from a range of interest groups, including water users,
commercial and economic interests and public land / open space/ cultural and historic
interests . The program was well-attended, attracting about 100 people. The project
consultants and Oversight Committee will be preparing a focus group summary, and
use the information assembled to establish priorities of the waterfront plan.
Cornell Vet School Incinerator: As a follow up to discussions with the Town Board, a
letter was prepared and sent to the N.Y.S. Department of Environmental
Conservation, indicating that the Town has concerns regarding the proposed
incinerator, urging DEC to open the review process up for public input (see attached
letter dated May 17, 1996).
Town /Gown Conference: The Supervisor and Director of Planning attended the
Town/Gown Conference in Amherst, Massachusetts, on May 31 - June 1, 1996. It
was a very worthwhile gathering, featuring many examples of how communities
have partnered with colleges and universities to address common problems. The
group from the Ithaca area, which included representatives from the Town of Ithaca,
City of Ithaca, Tompkins County and Cornell University, was recognized with a
special award that was presented on the last day of the conference for best
demonstrating the intent and goals of the Conference (i. e., assembling .a large group
of varied interests from the same community, travelling to the conference together,
also possibly travelling the farthest distance to get to the conference).

Re: Cornell University Veterinary College Incinerator
Dear Mr. Nolan.
I am writing to express the Town of Ithaca's concern regarding the potential
environmental impacts and planning implications of the proposed Cornell University
Veterinary College Incinerator. Over the past several weeks, thanks in large part to
the research and legwork of Ruth Mahr, President of the Forest Home Improvement
Association (FHIA), a number of potential issues and concerns have been identified
which I believe require very close attention by your department, and should involve
full public involvement and participation. I understand that DEC is now reviewing
the proposed Incinerator project in conjunction with air quality and solid waste
permits that would be required, and that DEC will have to conduct its own
environmental review under the State Environmental Quality Review Act (SEQR) and
make a determination regarding the significance of any environmental imp acts.
The Town of Ithaca had indicated concerns when the State Construction Fund
conducted its own environmental review in 1993. Although a process of public
participation and input was initiated at that time, for some reason, that process was
never adequately advanced, and I believe that opportunities for public input by the
Town of Ithaca government, the Forest Home community, and other interested
groups were cut short.
One of the Town' s concerns is that the location of the facility is very close to an
established residential neighborhood, and in the midst of a growing part of the
Cornell University campus. The area certainly should not be characterized as a rural
one. In fact, Precinct 7 (containing the Cornell Orchards), directly to the south of the
proposed Incinerator, was recently rezoned by the Town as a Special Land Use
District in recognition of the future campus expansion anticipated by Cornell
University. The original environmental assessment conducted by the State
Construction Fund should have investigated alternative sites for this project. I

believe that it is not too late for DEC to require such an investigation as part of its
environmental review.
Air quality, and accompanying public health, are really the central concerns
associated with this project. I am very glad to hear that DEC, as part of the permit
review process, has initiated a new air quality modeling study. The Town looks
forward to seeing the results of that study. The concern remains, however, that the
modeling study should be very specifically focused on the local conditions within
which the facility will be operating. That includes the use of local climatological
data, local topographic and microclimate conditions, and most importantly, the
recognition of the location of an urbanized area and population concentration in the
vicinity of the project.
Related to both of the above concerns is stack height. If the facility is located at the
proposed site, it is imperative that the stack is high enough to properly disperse
emissions away from developed areas. At the same time, it must be recognized that
the higher the stack, the larger the visual impact on surrounding areas will be. A
preliminary photographic analysis done by Town of Ithaca staff in 1993 clearly
demonstrates that even the currently proposed stack height of 177 +/- feet would be
highly visible from a number of surrounding vantage points, and that the visual
impact could be significant.
The information Ruth Mahr has unveiled regarding the conversion of the current
facility, which is a characterized as a pathological incinerator, to a medical waste
incinerator, is alarming to say the least, and certainly warrants the closest possible
scrutiny. Such a change was obviously downplayed during the State Construction
Fund's environmental review in 1993, and should trigger a closer look at the potential
environmental impacts by DEC, as well as full public participation by the
community. Not only does the change to a medical waste incinerator involve the
obvious air quality considerations that Ruth Mahr has raised, but also, as aptly put
by Ruth, should be a public policy issue, and could have long-term implications
about how medical wastes are disposed of county-wide. This is a solid waste
planning and policy issue that requires full public involvement.
I understand that you have indicated that DEC will be distributing the draft permits
and its own Environmental Assessment Form to the Town of Ithaca, Forest Home
Improvement Association, and other interested groups for public comment. I would
urge you at this point, prior to the issuance of the draft permits, to take the above
concerns into consideration, and open up the environmental review process for full
public involvement. This is a project that has important implications for the
community, and should receive the hard look that SEQR requires and that appears to

Many issues were discussed and explained by the presenters .and : each one described
the services and areas they felt were. lacking within TompkinsCounty. Some of these
included : respite services , group homes, psychiatric services , mentor-,programs ,
transportation , individuals to work with adolescents, understanding of substance
misuse , issues of the lesbian/gay mentally ill , education for parents , review of the
Cayuga Medical Center Mental Health Clinic, more effective treatment planning at the
schools , emergency care , single parent families counseling , and the need for satellite
clinics .
The testimony was very interesting and enlightening as to the needs that are not being
met within Tompkins County and the town . The overall conclusions of the presenters
will be published by the Task Force within the next few weeks and copies will be
available for distribution to the Town Board .

Records Management: Deputy Clerk, Mary Saxton and I attended the education and
training conference of the New York Association of Local Government Records Officers
in Albany, June 34. 1 was very happy to have been * invited to act : as one of the .training
presenters at the session entitled , "Making Plans - Getting Results" because of the.-.'
progress and efforts that have been made by the Town of Ithaca related to our Records
Management Program .
The Association is developing a regional information system so that municipalities
within the same regions can "network" several times a year to exchange ideas and help
one another. with their programs. The first regional meeting for our district will be held
in late September in Tioga County. t
The conference included many training sessions ' that ' were very beneficial and related
to our program , We attended sessions on ` indexing , microfilming , = retention and
disposition , solving problems, managing micrographics, imaging technologies , and
information on the Internet.
A special thanks to Betty Poole for doing a "super" job in covering the ' front office during
Mary's and my absence.
Accounting : We have had preliminary information sessions with two vendors who
produce computer accounting packages . During the month of. June . these vendors will
demonstrate their products so we can see how the programs- work and whether. they
would meet the needs of the Town .
