CALL TO ORDER : Deputy Supervisor Grigorov called the meeting to order' at 5 : 32 p . m . , and led the assemblage in the Pledge of Allegiance . AGENDA ITEM NO . 3 - REPORTS OF TOWN OFFICIALS : a . Town Supervisor - See attached . b . Director of Engineering - See attached . Daniel Walker - One area of. interest , included in the appendix in the report is the joint water supply distribution system evaluation . I included Appendix B . sent out with the request for proposal to consultants . I wanted the Board to get an idea of the wide range they would be looking at for their water supply issues . . There were 3 water supply systems ; the City , Cornell , and Bolton - Point , which interact together . There are some opportunities for economy , up scale , and Joint operation that may be beneficial for everyone . Councilman Klein - How are we doing with Forest Home Bridge ? Mr . Walker - I received a letter from the State indicating they approved the project and I have not received the plans from John Lampman . The project was supposed to be advertised for bid last Thursday . The schedule is still on course and we hope to have a contract in place by the end of May and to start the project this TOWN BOARD MINUTES , 2 APRIL 8 , 1996 summer . It is hoped the project will be completed by the end of summer before school starts . Councilman Klein - I thought the Board was going to be looking at some of the water and sewer benefit refunds at this meeting ? Mr . Walker - Yes , they are on the agenda as Item No . 20 . Councilwoman Harrison - What is the status on the assessment issues and the conservation zone ? Mr . Walker - Those issues are on the lists to go over . We have not had any discussions on how they can be modified . I am in the process of putting together some information of our benefit units and what impact the formula may have economically . The only area that would be impacted at this point would be Six Mile Creek . Water and sewer is located on ' both sides of the water shed area on Coddington Road and Slaterville Road . Areas on West Hill that do not have water and sewer would not have a significant impact . . Councilwoman Harrison - Will the Planning Board be having a hearing on the conservation zone in May ? Was the Town Board hoping to have anything at that meeting to discuss this issue ? Mr . Kanter - Only something indicating the Town is interested in pursuing it . There was discussion at the Public Works Committee meeting about this , however no details are available6at this point on how it will work . Mr . Walker - The biggest impact - is at Six Mile Creek . Councilwoman Russell - On Appendix B . Improvements in the City of Ithaca Water System Improvements , Number 2 ' , Rehabilitate or Reconstruct 5 - 6 MGD plant with alternative membranes etc . , are they currently not in compliance ? Mr . Walker - They were in compliance using a slow sand filtration system . The structure is 70 - 80 years old , the biggest ' problem being how quickly they can treat water when the turbidity becomes very high in the source . They would still produce water meeting .quality standards , but not when the turbidity is very high . Councilwoman Russell - What is SCADA ? Mr . Walker - Supervisory Control and - Data Acquisition . It is a computerized system that controls the different processes involved . Councilwoman Russell - In Appendix B , under Joint , allowing 0 . 5 MGD growth for City and Cornell systems , is that being planned for the upgraded system ? How was this determined ? TOWN BOARD MINUTES 3 APRIL 8 , 1996 Mr . Walker - The 0 . 5 MGD would not be growth in areas , but more redistricting and how water is distributed to the same people . Right now the Town buys a third of its water from the City for West Hill . Under an improved system , we would have a lot of capacity in Bolton Point , over 6 million gallons a day . If the Town stops buying water from the City , it would reduce the City ' s income . There would be areas that could be better served by the City . If the Town takes revenue away from the City by supplying Bolton Point water to the rest of the town , there would be some growth , and the City would be able to sell water to other areas , so they do not lose their revenue base . C . Highway Superintendent - See attached . d . Director of Planning - See attached . Deputy Supervisor Grigorov - Who was the County Representative for the Water Front Study ? Jonathan Kanter - I am on the Oversite Committee . The County Planning Department is the primary lead agency . Councilwoman Russell - In the memo to Supervisor Valentino regarding Cornell ' s Vet School incinerator , I noticed there were not any EPA or Clear Air Act permits . Were they not part of this process ? Mr . Kanter - The DEC permit follows the EPA regulations . There will be more involvement in terms of permits coming up . DEC indicated the EPA regulations on the Clear Air Act related to this facility were proposed for some changes , so this may effect the way DEC looks at their permitting process . It is very difficult for DEC , with pending EPA regulations , to know exactly what standard to follow . Councilwoman Harrison - .Which of these permits would be the Air Quality Permit ? Mr . Kanter - DEC says there are two sets of permits , Air Quality and Solid Waste , Councilwoman Harrison - The Solid Waste permit has already been . issued , and 3 additional permits ; operating , maintenance and monitoring and construction . Are those all air related ? Mr . Kanter - Yes . The follow up with DEC indicates what Cornell told us was not correct . None of the permits have been issued yet and DEC would only issue them all together . There will • be follow ups with DEC , so more information will be coming '. There will be time for public comment when DEC issues their draft permits . Councilman Wolff - In communications with Ruth Mahr , do you feel she thinks the Board is being responsive ? TOWN BOARD MINUTES 4 APRIL 8 , 1996 Mr . Kanter - In my discussions with DEC , they are willing to involve the public , the Town , Forest Home , and any other interested groups . DEC has indicated there will be the possibility of a public meeting when the draft permits become available . DEC will need to do their own SEQR and / or environmental finding . The State environmental assessment was done as an uncoordinated review . e . Director of Building and Zoning - See attached . Andrew Frost - The number of building permits issued for construction in the first 3 months of this year are higher than last year . We issued 15 building permits for EcoVillage to start 15 two family homes . Last month , we did a two day fire safety inspection at the hospital . Fire occurrences : One was a kitchen stove in a house and one at an Ithaca College Dorm . I spent three days in Rochester at a conference with State Building Officials , picking up 17 training credits . We are required by law to have 21 hours training credits per year . I have also included a financial report showing revenues from various categories for review . Councilman Conley - Does the Zoning Board issue logging permits in the Town ? Mr . Frost - No . DEC does . Councilman Conley - I had someone contact me regarding an individual cutting trees to open up a walkway to access a creek behind their property . I . referred him to Andy Frost . Mr . Kanter - The Town does not have any control over tree cutting . There might be some DEC regulation regarding land control , such as wetlands or protected forest lands . Councilwoman Russell - Would you need a clear cutting permit ? Mr . Kanter - If it is . a clear cutting situation yes , but if someone wants to log their own property there would not be anything the Town could do . Mr . Frost - We have received a complaint from a Board member regarding occupancy on Honness Lane . I will be presenting the issue to the Zoning Board and requesting to have the occupancy , which is illegal , run the term of the lease which expires in July 1996 . f . Town Clerk / Director of Administrative Services - See attached . AGENDA ITEM NO . 4 - ANNOUNCEMENT , AVAILABILITY OF ANNUAL ETHICS DISCLOSURE STATEMENTS AS PUBLIC RECORDS : TOWN BOARD MINUTES 5 APRIL S . 1996 Deputy Supervisor Grigorov - The annual ethics disclosure statements are available as public records in the Town Clerk ' s Office . This announcement is a requirement of our Ethics Local Law . AGENDA ITEM NO . 5 - SUPERVISOR ' S APPOINTMENT OF TOWN BOARD MEMBERS TO SERVE ON THE LOCAL ADVISORY BOARD OF ASSESSMENT : RESOLUTION NO . 54 : Motion made by Councilwoman Harrison , seconded by Councilman Klein . that the Town Supervisor hereby appoints Councilwoman Mary Russell and Councilman John P . Wolff as the Town of Ithaca representatives to the Tompkins County Board of Assessment Review on May 14 , 1996 ; and be it further resolved The Town Clerk is hereby authorized and directed to send a certified copy of this resolution to the Tompkins County Division of Assessment . A vote on the resolution resulted as follows : Deputy Supervisor Grigorov , aye ; Councilman Klein , aye ; Councilwoman Harrison , aye ; Councilman Conley , aye ; Councilwoman Russell , aye ; , Councilman Wolff , aye . AGENDA ITEM NO . 6 - REPORT OF TOMPKINS COUNTY BOARD OF REPRESENTATIVES : Beverly Livesay , Board of Representatives - The Tompkins County Board of Representatives are trusting the Forest Home Bridge is on schedule and will be done this summer . I would like to thank the Town Board for providing the back up information for the agenda . I would be happy to answer any questions regarding the memo from Marty Luster which you will be addressing under " Correspondence " on the agenda . AGENDA ITEM NO . 7 - REPORT OF TOWN COMMITTEES : Councilwoman Russell - The Recreation Partnership Committee has not met since the last Town Board meeting . Councilwoman Harrison - The Transportation Committee was to meet today to review the Master Plan for the Plantations , but they were not prepared to present anything at this time . Councilman Klein - Codes and Ordinance Committee met Wednesday April 3 , 1996 , and reviewed the revised Sign Ordinance legislation . We made comments , and asked Attorney Barney to incorporate them into the document . We have referred the document to the Planning Board and Town Board , with a Public Hearing to be scheduled in the near future . The Codes and Ordinance Committee is also working on some revisions to the Zoning Ordinance . They are referring some tasks to the Planning Committee in order to deal with some of the residential zones . Public Works met on Thursday , March 28 , 1996 , and discussed some upcoming projects . We also discussed the water service problem on the TOWN BOARD MINUTES 6 APRIL 8 , 1996 Cirschi property on West Hill . The Director of Engineering will be working on a proposed solution f. or this problem . Highway Superintendent Fred Noteboom has suggested revising the highway specifications . He and Mr . Walker will be working on these revisions . Councilwoman Harrison - Will Storm Water Management be part of the Public Works Committee agenda ? Mr . Walker - This is a major project and I will have a plan at the next Public Works meeting on how to address it . It will take several months to put things together . We have a draft model regulation from DEC , but to put an ordinance together without having the structure to implement it , does not help us . Councilman Klein - Some of our mapping was deficient in terms of the water sheds and drainage patterns within the Town and outside the Town . Councilwoman Harrison - Have you considered any summer interns for this project ? Mr . Walker - Yes . I would also like to inform the Board that the Town Hall Committee has a meeting scheduled Monday , April 15 , 1996 , 7 : 30 p . m . at the Town Hall board room . AGENDA ITEM NO . 9 - PERSONS TO BE HEARD . Nell Mondy , 126 Honness Lane - I was pleased to read in the Ithaca Journal on February 27 , 1996 , the statement which was written describing my assault . The incident reaffirmed Town Supervisor , Catherine Valentino ' s , determination to increase security in the Town which does not have it ' s own police force , and relies on the Sheriff ' s Department and State Police for protection . I am asking the Town to please inform me as to what actions the Town has taken since February 27 , 1996 . If the Town Board has not taken any action ; can we get this issue in the agenda ? Deputy Supervisor Grigorov - The Town Board had discussed this matter , but have not come up with any type of action yet . Jim Atsedes , 104 Crest Lane - I work with ReMax Real Estates and met with Supervisor Valentino a couple weeks ago about a proposal for the new Town Hall . I have a proposal which would put the Town of Ithaca staff in a new facility sometime this summer , operating in a 10 , 000 to 12 , 000 square feet area . The Town would still have $ 1 . 5 million in the bank . You would also make the City and some of the tax payers happy by putting this building back on the tax rolls . The proposal is nothing more than a lease , with elevators , security , parking , reasonable rent , which includes utilities , and no maintenance costs . The only real cost would be for janitorial services . TOWN BOARD MINUTES 7 APRIL S . 1996 Deputy Supervisor Grigorov - There is a committee studying all the possibilities , so it would not be presented to the Board until the committee reviews it . Does Supervisor Valentino have a copy of the proposal you are describing ? Mr . Atsedes - I went over the proposal with her , but the time is limited . If anyone is interested I would be glad to talk with them about it . Deputy Supervisor Grigorov - Mr . Atsedes , please write a proposal up , and send it to the Supervisor for her review . Councilman Klein - Is the location confidential ? Mr . Atsedes - The location is across the street , the M & T building . Councilman Klein - The bank building ? Mr . Atsedes - The bank building has handicap access with two elevators . * Councilwoman Harrison - What kind of lease duration are we talking about ? Mr . Atsedes - What ever you want . Councilman Klein - I suggest you formalize this proposal , so we can review it . The . Town was not interested in leasing space . Would the Town be allowed to draw on interest from Capital Reserve to subsidize lease payments ? Attorney David Dubow - I am not sure , however I believe a Capital Reserve Fund is setup for a certain purpose . In this case , it would be used for the purchase as opposed to an investment . There could be some problems , so you would have to reorganize the Capital Reserve Fund in some fashion . We would need to look into it further . Councilman Klein - This proposal would be worth looking into . Obviously , we do not have unlimited fund balances , and I think the State Controller ' s Office gives a parameter in terms of how much surplus there is . Mr . Atsedes - If the Town ' s interest were to build , then the interest on the funds would pay the rent toward their goals to build . Councilman Conley - Write the proposal up , and deliver it to the Town Clerk ' s Office to pass along to the committee . itMr . Walker - The committee meeting on Monday is primarily organizational to take a preliminary look at options to determine direction with no presentations at this point . There have been a lot of opportunities presented to us , so the committee would need time to TOWN BOARD MINUTES 8 APRIL 8 , 1996 review all of them . The bank site was brought up and there might be some possibilities there . I do not think the committee wants a lot of presentations from people at this point . Councilwoman Harrison — Will the meeting include discussions about the possibility of leasing ? Mr . Walker - Yes . Councilman Klein - I would like to have this information by April 15 . AGENDA ITEM NO . 8 - REVIEW OF CORRESPONDENCE : a . Cisela Wildes - Saddlewood Farms . b . Martin A . Luster , Assemblyman - Solid Waste Fees on Tax Bills . Ms . Livesay - This was a specific County item , with a considerable amount of backup on this . This legislation would allow us to put the Solid Waste Fee on the tax bills and treat it as a tax . Mrs . Noteboom - I am very pleased that this was the direction the County chose to pursue . It would have been nice if it was the first option chosen rather than asking the Town ' s to collect the fee . Ms . Livesay - I cannot say whether this was or was not pursued in the beginning . One problem with State legislation is trying to get things passed through the legislature . The reason this is being handled as a bill for one County is because then one would not get into disagreements with anyone else who would have a ' problem with it . What the County has been working on has been district legislation to help us get the legislature to support the legislation , and the City has tried in prior years . Last fall , Senator Seward said he would do it as Tompkins County only , and Martin Luster said he would do it . More work was done to explore the district legislation , and it � turns out that would not help us in the way we thought it would . The Town will be responding to Mr . Luster . Councilman Wolff - This does not change the fee itself , but the way it is to be collected ? Ms . Livesay - Correct . Councilman Klein - Nancy Schuler , a Board Representative from the City , has been helpful and interested in the Town pursuing the old Post Office for a new Town Hall . Ms . Livesay - Yes , she Chairs the Planning Committee in that role . Councilman Klein - Yes , for the Post Office Committee . TOWN BOARD MINUTES 9 APRIL 8 , 1996 Ms . Livesay - That was a good idea for the use of the Post Office as a potential new Town Hall . c . NYS Department of Transportation - Speed Limit Reduction Request . Councilwoman Harrison - This was not just the speed limit , but also the posting issues ? Councilman Klein - Yes . Councilwoman Harrison - Has the Town Board passed the word on to the person who brought this to our attention ? Mr . Noteboom - Not yet , we will take care of that . Councilwoman Harrison - Should the correspondence come from Supervisor Valentino on behalf of the Town Board ? Mr . Noteboom - We could provide her with names if needed . . Councilwoman Russell - Was there a cross walk issue there ? Mr . Noteboom - This cleared up a lot of issues just by having the speed limit reduced . There was an issue about having a crossing guard , but we would have to budget some money for this before they would consider the issue , so we budgeted the money and went ahead with the speed limit reduction . Councilwoman Harrison - Should the Town be pursuing a cross walk there ? Mr . Noteboom - There is a cross walk there . The State would want to paint their own cross walk . AGENDA ITEM NO . 16 - CONSENT ITEMS : Mrs . Noteboom - On 16 ( e ) , I have presented the Town Board with a revised resolution for an amendment to cover the purchase of the computers for Planning and Building / Zoning . I would like to add the last resolved into the amendment . RESOLUTION NO . 59 ( b ) - 59 ( d ) , 59 ( f ) - 59 ( i ) : Motion made by Councilman Conley , seconded by Councilwoman Harrison that the Town Board of the Town of Ithaca does hereby approve and / or adopt the Consent Agenda Item resolutions No . 16 ( b ) thru 16 ( d ) , and 16 ( f ) thru 16 ( j ) as presented . Items 16 ( a ) and 16 ( e ) will be considered separately . Do we send out a bid for computer purchases , or are there any specific vendors we buy from ? Mrs . Noteboom - It is a public advertisement in the legal section of the newspaper . Anyone has the right to bid on the specifications . Mr . Walker - The Town called every computer company in Town , and said there was a bid . We only had 6 packages picked up and only received one bid . Mrs . Noteboom an If we purchased each of these computers separately at different times - during the year , it would have not have been necessary to use the bidding procedures , and we would have been under the limits mandated by Audit and Control . However , Audit and Control would look at that and say the Town budgeted a specific amount of money to buy computers , you knew you would be going over your $ 10 , 000 bidding limit . Our Attorney advised us , since we were going to buy so many computers to bid . Councilman Klein - This was under budget ? Mrs . Noteboom - Yes . Mr . Walker - Budget numbers were fair and conservative with $ 22 , 000 and the total bid price was $ 15 , 0006 TOWN BOARD MINUTES 11 APRIL 8 , 1996 Mrs . Noteboom - The $ 22 , 000 was not just for the computers , but included other equipment as well . Mr . Walker - The Computer Room is a small local company in Town . They signed the bid forms indicating they could meet all the requirements . Carried unanimously . AGENDA ITEM NO 10 - 6 : 30 P . M . PUBLIC HEARING : to consider a , " LOCAL LAW AMENDING THE TOWN OF ITHACA ZONING ORDINANCE REZONING LANDS ON EAST KING ROAD OWNED BY CORNELL UNIVERSITY ( TAX PARCEL 44 - 1 - 4 . 313 ) FROM MULTIPLE RESIDENCE TO RESIDENCE DISTRICT R - 30 . " Deputy Supervisor Grigorov opened the public hearing at 6 : 30 p . m . . The Town Clerk had proof of postings and publications . . As no one from the public came forward wishing to be heard , Deputy Supervisor Grigorov closed the public hearing at 6 : 31 p . m . . AGENDA ITEM NO 11 - Consider SEAR related to a , " LOCAL LAW AMENDING THE TOWN OF ITHACA ZONING ORDINANCE REZONING LANDS ON EAST KING ROAD OWNED BY CORNELL UNIVERSITY ( TAX PARCEL 44 - 1 - 4 . 313 ) FROM MULTIPLE RESIDENCE TO RESIDENCE DISTRICT R - 30 . " RESOLUTION NO . 55 : Motion made by Councilman Conley , seconded by Councilwoman Russell making a negative determination of environmental significance in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed and , therefore , neither a Full Environmental Assessment Form , nor an Environmental Impact Statement will be required . " RESOLUTION NO . 56 : Motion made by Councilman Klein , seconded by Councilwoman Harrison hereby enacting Local Law No . 3 , 1996 a , " LOCAL LAW AMENDING THE TOWN OF ITHACA ZONING ORDINANCE REZONING LANDS ON EAST KING ROAD OWNED BY CORNELL UNIVERSITY ( TAX PARCEL 44 - 1 - 4 . 313 ) FROM MULTIPLE RESIDENCE TO RESIDENCE DISTRICT R - 300 " ; and be it further I TOWN BOARD MINUTES 12 APRIL 8 , 1996 i resolved The Town Clerk is hereby authorized and directed to file the said Local Law No . 3 , 1996 as required by law . Carried unanimously . AGENDA ITEM NO . 16 - RESUMED - CONSENT ITEMS : a . Town Board Minutes - March 4 , 1996 and March 11 , 1996 Councilman Klein - On Page 13 , Paragraph S . I was quoted saying " How does this tie in with agreement that Attorney Barney and the Mayor signed • last year . . . " , Attorney Barney did not sign that . I think former Supervisor John Whitcomb signed the agreement with the Mayor . Also with the quote " and the city does not have much faith left . " , , should read " and the City does not have much space left . " Then on Page 13 still , Paragraph 10 , with quote " Eighty percent of the rental housing is owned by a few landowners . " I do not remember saying this , possibly someone else did . The Board agreed that several of their names were mixed up , so the Board agreed to write down changes , and the recording secretary and Mrs . Noteboom will go over them together . Councilwoman Harrison - For this particular meeting would it be necessary to do that since the meeting was only a discussion of internal priority settings rather than taking a lot actions where that might be particularly important . I thought I saw some places where someone was not actually at the meeting , and places where I had the feeling the " Planning Board " got typed and " Planning Committee " was meant . Councilwoman Russell - On the March 11 , 1996 minutes , Page 33 , I thought Councilman Wolff abstained ? Mrs . Noteboom - I prepared these minutes , and had talked to Supervisor Valentino after the meeting . She said she would talk to Councilman Wolff about his vote , but she could not reach him . Councilman Wolff came to me after the meeting was adjourned and asked that the vote be changed . I had a problem with that since the meeting had been adjourned . Councilman Wolff - I was trying to get your attention prior to the adjournment of the meeting , and then to ask the Board to change my vote . TOWN BOARD MINUTES 13 APRIL 8 , 1996 Mrs . Noteboom - I did not feel comfortable as Clerk knowing that it was not done in a proper manner of an open meeting to say it was an abstain vote . I talked to Supervisor Valentino , she agreed , and she wanted me to bring it up at this meeting . If you would like to bring that up as an issue that you would like to go into the record , and that you intended it to be an abstain vote , or if there was some way we could revote the issue . Deputy Supervisor Grigorov - I think it is out of the question to decide after a meeting to change your vote . The idea of Councilman Wolff making a statement would be good to know . Councilman Wolff - My intention was not to change the vote after the meeting . My intention was to change the vote as per what was brought up at the meeting . Councilman Conley brought up whether or not it was appropriate to abstain on that particular vote , and I agreed , but the opportunity never arose to change my vote . Deputy Supervisor Grigorov - Do you think it is a reasonable procedure to change a vote after the meeting ? Attorney Dubow - No , it sounds like some confusion . The easiest solution would be for the minutes of this meeting to reflect what his attention was and what he intends to do , so it could be clarified with the record and would be consistent with the previous meeting and this meeting . If it is an important issue , then I would suggest Councilman Wolff make his position clear on the record , and the record of this meeting reflect what actually your intention was , what happened , and why you voted in the fashion you did . At that point the record would reflect , even though in two separate meetings , what his intentions were , his feelings , and why he did what he did . That would be the simplest procedure . Councilman Wolff - I will state it now that after Councilman Conley ' s comments following the vote on Ithacare , my intention was to change my vote to " no " prior to the adjournment of the meeting . Councilwoman Harrison - Why is that ? Councilman Conley - I think Councilman Wolff expressed his fe.elings , but the Board had gone into Executive Session . I know Councilman Wolff ' s intention was to change his vote to " no " , and I think everyone else did too . Councilwoman Harrison - Would you like to explain for the record , why you would like to change your vote ? Attorney Dubow - Not really to change his vote , Councilman Wolff ' s position was to have his vote recorded as a " no " vote . TOWN . Noteboom - During John Whitcomb ' s term , around budget time , they thought they would have the Principle Account / Clerk audit the Justice books once a year , and then have the independent auditors do it every two or three years ? When the auditors finished up their audit this year , Attorney Barney suggested it would be a good idea to include them when we do our annual audit . There would be an additional expenditure of funds that would increase the cost of the audit a little bit each year . Attorney Dubow - The agreement Attorney John Barney prepared provided 41 was for the individual owner of the property to provide insurance TOWN BOARD MINUTES 17 APRIL 8 , 1996 naming the Town conditional insured . Apparently , the Board ' s agent has advised them the Town could obtain that insurance . My suggestion to the Board would be to obtain what is required by the agreement , and let that stand as the Town in essence would be the secondary insurer . My guess it will not be a difficult problem because they are the owner of the property . Attorney Barney and I agreed it would make sense for those individual property owners to maintain that insurance by naming the Town as an additional insured , and have that arranged and placed with your own insurance agency , then everybody would be adequately insured . State Parks is very happy and willing to do it , but it needs authorization from the State Education Department . TOWN BOARD MINUTES 19 APRIL 8 , 1996 Mr . Noteboom - I have a feeling that the Department of Transportation might have a problem putting it in their right - of - way as it is a very fixed object . They do not like to put too many fixed objects like that in their right - of - ways , but we should encourage them to do what they can . Deputy Supervisor Grigorov - At least the Board could authorize them to if they are willing . Councilman Klein - It will be within the bounds of the Park . Mr . Cramer , Tax Parcel 33 - 1 - 23 . 1 , 238 Enfield Falls Road , a refund for the original benefit assessment for sewer . There is no water benefit to that parcel other than pennies because it is above the pressure zone on Enfield Falls Road . The property boundary is 420 feet of frontage with some acreage - with it . I am requesting . th.e Board modify the benefit assessment in this case because there is a single family house on the property of the 420 foot frontage , the average depth goes from 50 - 150 feet , and the average slope on the land is between 10 - 30 % . It would not be practical to put a . second house on this property and would be limited to one parcel . I am recommending a refund of 1 . 25 sewer benefit units in the amount of $ 102 . 50 , leaving one benefit unit on that parcel . Councilwoman Harrison - In the past , when things like this came before the Board , I thought we said there needed to be something more clear than a restriction , whether it was something they said to us that TOWN BOARD MINUTES 20 APRIL 8 , 1996 basically said there shall not be more than one unit ever developed on this property , such as a deed restriction . Mr . Walker - Or physical features which precluded other development . Councilwoman Harrison - We had people come before us before , and basically argued physical barriers . Mr . Walker - We had an adjacent property come in , Mr . Hardy who owns another parcel on this road . The lot is very narrow and shallow because of the road right - of - way and there was a wavier granted at that point , too . Parcels that are open , other than cemetery lots on West Hill , were assessed a water benefit . At that point they presented a deed restriction for that parcel showing the parcel could not be used for anything other than for cemetery use . In this particular case , I do not believe there is any practical way to build more houses on this parcel . It would have to come before the Planning Board before another residence could be put on the lot . Deputy Supervisor Grigorov - At that time could they change the * assessment back ? Mr . Walker - I do not think they could get a subdivision approval because they can not get another legal lot out of this parcel the way it is configured . Deputy Supervisor Grigorov - But if they got a variance ? Mr . Walker - If they got a variance , then we would revisit the issue and charge for additional assessment . Deputy Supervisor Grigorov - Is it possible to take it off and put it back on if they get the variance ? Mr . Walker - Yes . Councilwoman Harrison - Is there a reason why there can not be another legal lot due to the depth ? Mr . Walker - The lot configuration is very shallow , and the road right - of - way is approximately 20 - 30 feet below the road grade . It is a very difficult site and a difficult situation to pump sewer out for . Councilman Klein - This house is not presently connected to the municipal sewer . In general , the Engineering Department has tried to review all the assessments to try and make corrections . Mr . Walker - We have been reviewing a lot of them . The ones we are dealing with tonight have all been requests for refunds or reductions . There are a lot more on the books . TOWN BOARD MINUTES 21 APRIL 8 , 1996 Councilwoman Russell - Isn ' t this more of a prospective thing . Why are we going back and giving her a refund ? Mr . Walker - The process we use to assign the original benefit unit is basically from the mapping information we have . The formula states if you have a certain amount of frontage you can charge a certain number of units . There is no staff to say this is not buildable , that is the Town Board ' s responsibility to make that determination .. To apply the formula , we apply it as if the whole thing is buildable from the tax map information . If the resident brings additional information forward and says they can not do anything else with the land , it is then referred to this Board for determination . Councilman Klein - In this case , Nancy Cramer is a friend of mine . She recently purchased the property last summer which had sat vacant for awhile . I assume the estate was paying for the maintenance . When Ms . Cramer brought this to my attention when she got her tax bill this year , she was not on the sewer , and was assessed 2 . 25 units . She is only a single family house on an irregular lot . I think it is a legitimate request as she would only gain one benefit out of this . Councilwoman Harrison - That is all we could potentially foresee ? Councilman Klein - We have done this before . Mr . Walker - I suppose they could convert the house to a two - family house . Councilwoman Harrison - That is true of any house . in the Town . Mr . Walker - Right , and I would recommend we adjust the benefit assessment accordingly . Councilwoman Russell - Do you always go back and adjust it retroactively like this ? Mr . Walker - Any member of the public has the right to contest their tax bill , and that is what they are doing here . Councilman Klein - Historically , we only go back one year . Mr . Walker - Right , this is 1995 role for 1996 taxes . Councilman Klein - So this was paid in January 1996 . Mr . Walker - Yes . The lot adjacent to it is 68 . 1 and I think at some point was probably a subdivision . The total frontage on the subdivision would have calculated out to a little over two units . Sometimes when there are subdivisions the units are carried over and assessed to one lot or the other lot . At some point we , assessed this lot a full two units when it only has 100 foot of frontage . It has a lot of space in the back , 2 . 5 acres , but only has 100 foot of frontage so it is limited to one house . I am recommending , based on our formula , it should be one unit . Councilman Klein - You suspect there might have been a subdivision . Did you check on the other homes in the area ? Mr . Walker - I checked the neighboring one , it was 2 . 21 units and 300 foot frontage , and that was correct for it ' s frontage . Tompkins County Assessment assigns when there is subdivision , if there is a special benefit districts , they do not split it up . They will assign everything to one or the other unit . I think that is what has happened here , and then we reassessed the other . I am not sure what happened . The units were calculated on that basis . Ms . Snyder brought in a survey map showing the corrected distance of 180 feet . This reduced . the units down to 1 . 4 units instead of 2 . 44 units . I am recommending a refund of 1 . 04 units . Councilwoman Harrison - Who owns the additional 110 feet of frontage ? Mr . Walker - This is on a curve at the corner of Bostwick Road and Five Mile Drive . The frontage that was on the assessment map was along the center line of the road as opposed to the street line frontage which is what we use to calculate the benefit assessments . Instead of showing a side yard and a front yard , it was all lumped into the front yard . Ms . Snyder owns it , but we only use the frontage for the benefit assessment . There is a 20 foot strip in the Town of Ithaca where the border lines goes through their front yard , which puts frontage on the Town road . In this particular case , Ms . Hudson pays water and sewer to the Village of Cayuga Heights , so it is not appropriate to charge a benefit * assessment . There are two other properties in the area we will need to correct . They have not asked for refunds at this point . If the Board wishes I could process them through next month , and offer them a refund . Councilman Conley - That is only fair . Councilman Klein - That is appropriate . Mr . Walker - We will be correcting their assessments for the future . Their primary tax assessment is Cayuga Heights because the house and everything is within that area . Mrs . Noteboom - It is not assessed by Cayuga Heights ? Councilwoman Harrison - No , it is not assessed by us , that is why they should receive a refund . Mrs . Noteboom - Is there a time limit that we have in our rules and regulations for being able to come forward with this information to ask for a refund ? Mr . Walker - Generally , we ask people to come forward with these by March 1 . Councilman Conley - In fairness to situations like this , I just wish we would approve them and wipe them out . There is no sense having them on there if there is no benefit . Mr . Walker - We are going to be correcting them . TOWN BOARD MINUTES 25 APRIL 8 , 1996 Deputy Supervisor Grigorov - I can give you a lot of them . Councilman Conley - I know there are a lot of them , but do we have to do them all one at a time or can we lump them together ? Mr . Walker - On the errors , that is not so much of a problem . Waivers or modifications based on site and buildability , the formula says the Board has the latitude to do that . Councilwoman Harrison - The question is , if Councilman Klein brings it to these peoples ' attention , it would not come to your attention until mid - April and would be a month and a half after the March 1 deadline . Councilman Klein - There are two other parcels on Lexington Drive . Deputy Supervisor Grigorov - Are the Hudson ' s paying Cayuga Heights for the 20 feet ? Mr . Walker - No , they are paying the Town . There is assessed value of $ 2 , 000 on the property . Councilwoman Harrison - They are paying the assessment even though the portion outside the Village of Cayuga Heights is clearly not a developable lot . It is only 20 feet wide . Deputy Supervisor Grigorov - But it is all one lot . Councilwoman Harrison - But we should not be assessing the whole parcel . Councilman Klein - They get dual tax bills . The bill from us says they have a 100 foot frontage and an 11 foot depth . That carries an assessment on the frontage . The road is in the Town , and the Village line is about 11 feet to the west of the right - of - way . Mr . Walker - It is something we should have addressed in the subdivision process to straighten out the boundaries . Councilman Klein - This parcel is served by the water and sewer system of the Village of Cayuga Heights . They pay Village taxes and get Village trash collections . They do not get their water through the Town , so they have no benefit . Councilwoman Harrison - Are you suggesting we not make this correction now but next year , and not go after those people to pursue for this year ? Mr . Walker - The new role will reflect the corrected assessment . They will be charged the pennies for that parcel instead of a full unit . On the Hudson property the assessed value for that parcel is $ 2 , 900 . Tompkins County , Fire Protection , and Town taxes are about $ 25 . 00 . TOWN BOARD MINUTES 26 APRIL 8 , 1996 Their total tax bill is $ 188 . 00 because of the benefit for water and sewer . Councilman Klein - I still think it is a good idea to refund the other two properties . Mr . Walker - I will bring them to the Board at the next meeting . We probably should write an article in the Newsletter telling people to look at their tax bills carefully to make sure they are in agreement with the assessment . Mrs . Noteboom - The right thing to do is to do what we are doing , which is to take every single piece of property on the tax role , and check every single water and sewer assessment to make sure people are being charged properly before it is put on the final assessment role for next year . Motion carried . Mr . Walker - Bob Miller , 823 Elmira Road . This is a large parcel with 388 feet of frontage and total acreage of 13 . 68 acres . He was assessed 4 . 31 units for water and sewer which he feels is extremely high based on a large piece of his land is in the flood plain in the back lots , two ponds on the area , plus all his property is below the evaluation of the sewer lines we would be pumping out , so there is a practical difficulty . He does not have plans to subdivide or develop the property , and I recalculated the frontage , assuming none of the back land would be developed , and came up with 2 . 89 units . If he were to subdivide that lot it would be, taking some road frontage off the lot . Councilwoman Harrison - Let him come back and say , he will put a deed restriction on the back lot . Mr . Walker - That is why I am bringing this before the board . If a deed restriction says a certain portion of this land will not be developed , then that is what we will do . Mrs . Noteboom - In the resolution , you are saying the assessment units were incorrectly calculated . Is that the reason you want this resolution passed ? TOWN BOARD MINUTES 27 APRIL 8 , 1996 Mr . Walker - We do not want to pass this one . Mrs . Noteboom - You do not want to pass this because of the back lots ? Mr . Walker - It would be incorrectly calculated if the restrictions were based on the use of the land . Deputy Supervisor Grigorov - Do we want to make that a motion ? Mr . Walker - No . I will talk to Mr . Miller asking if he could put a deed restriction on the property to restrict development . This falls into how we want to deal with Conservation Districts and other issues like these . Councilwoman Harrison - I do not think it is quite the same as this is not an area we are particularly looking at for a conservation district . Mr . Kanter - It does relate in the sense we were thinking of conservation easements or other preservation areas . , Councilwoman Harrison - One of the things we talked about was to think hard about conservation easements in areas not in Conservation Zones . That brings up the issue of someone wanting to keep their acreage green and we have to decide whether it is in the interest of the Town . The _ fact that this in a flood plain , and the fact it is not potentially developable may not be pertinent . AGENDA ITEM NO . 21 - CONSIDER AUTHORIZATION TO EXPEND ANNUAL FUNDS RELATED TO AGREEMENT WITH CODDINGTON ROAD COMMUNITY CENTER : Deputy Supervisor Grigorov - This is to authorize a quarterly payment . Mrs . Noteboom - We technically do not have a contract with them . It expired December 21 , 1995 , and we have not yet negotiated a new contract for this year . They need the money ending March 31 , we can not pay them unless payment is authorized by the Town Board . Councilwoman Harrison - Why did the Board not deal with the contract before ? Councilman Klein - Probably the transition . If you noticed Attorney John Barney ' s memo to you when it was sent , Attorney Barney was aware it was in John Whitcomb ' s name . Tonight he would like you to just approve the quarterly payment and the supplemental agreement . We will visit the summer program agreement in May , as he is not sure of the amount of the payment . We looked into this and the budget amount will be short by $ 490 . 00 if we go with the same summer schedule we had last year . Last year they ran the program a week longer and came back to this Board after the summer and asked for more money so they could run it a week longer . This Board will need to decide whether you want to go back to the 1994 agreement , or use the 1995 numbers . Carried unanimously . AGENDA ITEM NO . 25 - CONSIDER AUDIT ADJUSTMENT FOR 1995 BAN PAYABLE IN CAPITAL PROJECTS FUND : Mrs . Noteboom - In February 1995 , we had to make a payment of $ 215 , 000 for the sewer BAN . At that time , it was incorrectly recorded in the books as a BAN receivable in the Capital Projects Fund . Therefore , when closing the books in December 1995 , we did not subtract out the $ 215 , 000 from the fund balance . So the Capital Projects Fund , where the money came from to pay the $ 215 , 000 , was showing a balance at year end of having $ 215 , 000 more than it actually did because you paid the BAN in February . The reason we are doing this resolution is because we will be correcting fund balance and the BAN ' s payable as of this date . If we were to go back and reopen December ' s books to correct it , we would also have to reopen all of January ' s and February ' s books because TOWN BOARD MINUTES 30 APRIL 8 , 1996 of our computer accounting program . This would have been an enormous amount of work and meant we would also have had to go back and re - approve all of the financial reports since that time . The auditors suggested we do it March and they will write a correction to the notes to the financial statement in our annual report for 1995 , explaining the fund balance ended showing more than it should have for Capital Projects . Debbie is assigned the duties of transcribing the minutes for several of the boards , as well as helping with records management , and indexing . Work on the indexing system will resume upon the delivery of the new computer and software for Debbie . With the creation of this position , the Deputy Town Clerk' s will finally have more time to concentrate on upgrading the deeds and easements files , and upkeep of the Records Management Program . Office space downstairs was again reorganized to allow room for the new Keyboard Specialist , and to provide the Human Resource Specialist better access to files in his office . Many boxes of frequently referenced records were not easily available to Mr. DiSanto before the move . 175th Anniversary Celebration : The first event to commerate the founding of the town will be held on Saturday, April 13 , from 1 : 00 p . m . to 4: 00 p . m . at the Veteran 's Volunteer Firemen ' s Association , 638 Elmira Road . The special day. will be called History and Fun Since 1821 . A tent will be erected on the site to guarantee adequate space for the crafts , games , and activities . The Veteran Firemen will be selling hot dogs , sodas , and other refreshments . The Town will be displaying some archival records ; and George Frantz will be showing the sketches ' of the Historical Markers . Publicity flyers are being sent to local schools , and the local radio and television, stations . It should be a fun day for all , come and join the fun . The bids for the Historical Markers have been received and will be considered on April 8 , by the Town Board . Cornell University has expressed an interest in paying for the three markers which will be located on their property. 'A letter has also been sent to Ithaca College asking permission for placement of a marker on their property, and to ask them to consider making a contribution towards that marker. The Montessori School responded positively to our request for area children to be involved in designing and writing the brochure describing the markers . Sherm is awaiting information from the Underwriters Association regarding the difference between the premiums for Blue Cross/Blue Shield and PHP . Also , through information provided by Councilman Klein we are in contact with Thomas Branigan , RMSCO who is researching and comparing health plans and worker' s compensation plans for the town . Costs and methods for computer software training are being compiled for presentation to the Automated Data Processing Committee at their next meeting . Proposals will include tutorial training through videos , as well as personal training at a computer training site . The Personnel Committee began reviewing and revising the Personnel Manual at their March meeting . Employees were asked to submit any revision suggestions to the committee . It is hoped , Data Rite will begin producing the bi-weekly payroll by mid April . Simultaneous payrolls have been created during March to compare information and insure accuracy. Accounting;. The firm of Ciaschi Dietershagen Little and Mickelson have finished the annual audit on March 28 . Some adjustments to the 1995 Annual Financial Report will be made and reported through the Notes to Financial Statements , including an adjustment for the posting of the $215 , 000 BAN to the Capital Projects Fund . The final auditor's report will be provided in a few weeks , at which time an exit meeting will be scheduled with the Town Board . As the audit related to the year 1995 , former Supervisor John Whitcomb will be attending the audit exit meeting . The Annual Financial Report to the State Comptroller will be completed within the next few weeks . The individual tabulation pages have been completed with only the Notes to Financial Statements left to be done . Accounting staff has been compiling a list of their daily work and procedures to begin development of the policies and procedures manual . Tentatively, the draft manual will be completed by July so that the independent auditor' s may review it and offer their recommendations . This number differed greatly from what we actually found . Dogs Licensed as a result of the dog enumeration : New Dog Licenses Purchased : 253 Renewals : 135 COMMENT: There have actually been 316 renewals since the start of the enumeration glut we allowed for 181 to be a result of normal monthly renewals. Continuing Follow-Up : Tickets to issue as a result of failure to license , 88 COMMENT: In our follow- up work for the enumeration , 384 letters were sent to dog owners requiring them to license . We are now in the process of ticketing those who did not comply which will result in 88 tickets . Ruth Mahr representing the Forest Home Improvement Association expressed concerns . . regarding the proposed Cornell Vet School Incinerator project, I spoke with Gregg Travis, Director of the Statutory. Office for . Capital Facilities at , Cornell, to, find out . the status of the project. First, a little background information from the project files: The Town was notified 'in July 1992 of the State University . Construction Fund's intent to rehabilitate the existing incinerator. at the Veterinary, College, along with a Full Environmental Assessment Form ,(EAF); A public information meeting was held at the October 20, 1992 Planning Board meeting on the incinerator rehabilitation project; An Executive Summary of an Air Quality Modeling Study was provided to the Town by the State Construction Fund in November 1992; The Town received a copy of the Negative Declaration of Environmental Significance issued by the State University Construction Fund on September 16, 1993. According to Gregg Travis, the State University Construction Fund is still in the process of obtaining the required permits from NYS Dept. of Environmental Conservation (DEC). One permit (solid waste permit for ash handling and disposal) apparently has already been issued. Three additional permits are pending: 1 ) operating plan for the facility; 2) maintenance and monitoring permit; and 3) construction permit (the other two permits have to be approved before the construction permit is issued) . The plans are basically the same as previously proposed and presented to the Town. The stack is still proposed to be +/ - 177 feet in height (same as described in EAR -2- There would not be any additional types of materials burned beyond what is burned now. Gregg Travis reiterated that this project would be a replacement of the existing incinerator, which no longer can meet air quality standards. Mr. Travis stated that DEC and Cornell engineers have been studying the air quality issues; closely, and are considering designing the facility to a higher air quality emissions standard than is required under the permits. It is possible that the remaining permits may be issued within the next couple of months. The State Construction Fund is hoping to begin construction of the replacement facility before the end of 1996. I requested of Mr. Travis that the Construction Fund send us final plans before the construction permit is issued so that the Town would have a chance to review them and provide any additional feedback that may be necssary. Saddlewood Farms Mecklenburg Road:_ After receiving an. incomplete application for rezoning the Mecklenburg Road site, staff sent a letter to Landmark. America requesting additional basic information; and a completed. Environmental, Assessment Form Part 1 . (A copy of that letter is attached for the Board's information.) Pending the receipt of the additional information . requested,' the request- for rezoning will be placed on the Town Board agenda for , consideration and a determination as to , whether the matter should be referred to ' the Planning Board, Conservation Board, m Agriculture Committee, or other,. appropriate bodies for recommendation. Cornell - Lake Source Cooling Project: ;Both' the Town of Ithaca Planning Board and Town Board have consented to the N.Y.S. Dept. of Environmental Conservation to act as lead agency for the environmental review of the Lake Source Cooling Pr oject. Staff has attended three scopmg sessions on the DEIS, and provided input into the scoping process, especially regarding potential visual impact of the proposed facility at Noah's Boat Club and public access to the Cayuga Lake waterfront. GIS: Specifications for GIS hardware (along with other personal computers) have been prepared and bid packages were sent out. One bid was received, and is being checked to confirm whether it matches up with the specifications . A recommendation on accepting and awarding of bids will be made to the Town Board at the April 8th meeting. - A GIS software demonstration was held in the Planning . Department, and phone quotes on software packages have been conducted. Ordering will be initiated in the near future. (The software combination chosen is ArcView and Data Automation Kit (DAK), both ESRI products.) Rural Residence District: The Planning Committee has resumed discussion on a possible new Rural Residence District, which could be mappe& in'.'areas'� currently zoned R-30 or Agricultural and not served by public water or sewer. This will also '�- be discussed with Codes & Ordinances at the April 3, 1996 meeting. 3 F, Sign Law Revisions: Codes & Ordinances has discussed possible revisions to the Town' s Sign Law, which was enacted in 1980. Proposed revisions include clarifications, updates and some minor changes. A draft revised Sign Law has been prepared. Town Hall Committee: The Planning Department has assisted in the work of the new , Town Hall Committee, established subsequent to the March referendum. Cornell Vet School Incinerator: As a follow-up to the March 11th Town ` Board i . meeting, staff reviewed the files on the proposed Incinerator and contacted the Statutory Office for Capital Facilities at Cornell University to get an update on the status of the project. A summary was provided to Supervisor Valentino in a memo dated 3 / 18/ 96 (a copy of which is attached) . Staff is also assisting the Forest Home Improvement Association in finding out additional information about the project, such as whether any permits or approvals other than those currently being processed by NYS DEC will be necessary. Tompkins County - Biggs "A" Building: The County has asked for the Town's input and assistance in identifying potential uses ' for the Biggs "A" Building at the Hospital complex. Planning staff met with County representatives to provide information on permitted uses under current zoning (SLUR No. 3) and ' recommendations of the Comprehensive Plan. Town staff has been ' invited to accompany County representatives on a tour of the Biggs "A" Building on April 4, 1996. The Highway/ Parks crews worked 629 hours on snow removal . Of this time , 3.06 hours were overtime . We plowed the West Hill and South Hill Fire Stations five times , and salted them seven time . We used 240 tons of salt during these storms . 2 . In March the Highway/ Parks Department started cleaning up and getting Sand Bank Road ready to reopen . We have completed 216 . 5 hours on regrading and clearing brush . We still have work putting in gabions , etc . 3 . The Highway/ Parks Department also worked on Stone Quarry Road to ready that for paving . We worked 81 . 5 hours on this project . There is still work to be done there . Both of the above projects partially funded by the Federal and State government , due to the January flooding . 4 . During March , we worked 631 . 5 hours on General Repairs . Some of the projects include : Maintenance of trucks , patching roads , placing voting machines , etc . We used 12 tons of cold patch . 50 We worked 47 hours on street sign maintenance , including replacement some . 6 . We spent four hours on Water Maintenance , twelve hours on cutting brush , and 43 . 75 hours on Sewer Maintenance /Breaks . Five of those hours were overtime . Snow removal for roads took an additional 84 hours during March . This total is also included in the Highway Superintendent ' s report . 29 Annual maintenance of our bluebird nesting boxes and the installation of newly constructed boxes required 73 hours . Eighteen new boxes designed to attract small owls and hawks were put up along wooded sections of our popular trails . 3 . Finish work at the Annex building workshop , including spackling , painting : and installing trim , took 96 hours . Bathroom fixtures remain to be installed before we move the woodworking equipment out to the Annex . 41 Some early lawn clean - ups and repairs were accomplished during good weather , totalling 23 hours . I We need to keep moving towards a new building . Each day spend in Town Hall points out the dire need for us to move on as quickly as possible, but continue planning in a well thought out' manner. The cost of the referendum , if we take into account the time spent by the Attorney for the Town , was over $10 , 000 . 00 . It was quite a learning experience getting the job done , and I don 't think any of us wish to go through the process again . I have appointed , what I call a " Blue Ribbon Committee", to help us review what the community will accept and what will also fill our needs . I hope to have a recommendation from the committee by mid May. The Post Office building is again a possibility , and I believe our last good chance for a location in the center of the- city. The proposed development of Saddlewood Farms on the West Hill continues . We anticipate providing more information at the May meeting . There is nothing to report or discuss regarding the issue presently. Finance and Budget: Our auditors have finished the annual audit of the 1995 finances . They discovered some problems with our bookkeeping methods and suggested ways of improvement , many of which have already been implemented . We will be receiving a letter and report from them within the next few weeks . The Town Board will be seeing a different monthly financial report by May which will be much shorter and contain more useful information . I will be looking forward to your comments and input . We will begin reconciling the finances month to month , and comparing cash to budget . This will help me track cash flow and help make the budget process go more smoothly. I have also started a Financial Officer' s notebook to track the many aspects of this very important part of my job . This notebook should also be a useful tool for future Supervisor's . Supervisor Monthly Report March 1996 Page 2 . It may be necessary to purchase different accounting software as the current program does not seem to work well for our needs . Efforts continue to adjust the present software to fit our needs , but it may not be worth the trouble . Costs of software might be shared with Bolton Point because we are working with them to coordinate our needs . A more detailed report will be made in May. Health insurance is still being reviewed and details , of different plans and options will be available for the Board ' s consideration shortly. A meeting with staff will be scheduled to receive their input on a managed care health plan . I met with Mayor Cohen during the month to discuss areas of mutual . concern . Also , Andy Frost and l met with the Fire ; Chief and some of his staff to talk about the sprinkler law and other fire safety issues . Access and utility improvements have progressed sufficiently to allow the Planning Board to waive limitation on the number of units allowed for building permits . EARTH FILL PERMITS Five Mile Drive , Immaculate Conception Cemetery Approximately 1500 cy of fill has been added to site during March with the source of material being foundation excavations from the Rte 13 bridge project . Sediment control fencing is being maintained around the fill area and no problems have occurred .. . TOWN HALL The Town Engineer has been working with the ' Town Supervisor and the Town Hall Committee to continue the development of a plan to replace . the existing facility . The committee met on March 21 1996 and reviewed the results of the referendum and established guidelines for the process . Several members of the committee were not able to meet at that - time and the first full committee meeting is scheduled for , April 15 , 1996 . At that meeting the committee will review the needs assessment and begin a site selection process . Several members of the committee had a brief tour of the Tioga Street Post Office building. on " March.% 27 , and viability of that . site will be determined soon . WATER PROJECTS The Town Engineering staff is continuing , to , work with the Bolton Point staff to implement the master metering programe .for connections to the water transmission main . The Town Engineering staff is assisting the Bolton Point staff in construction administration . Town Engineer ' s Report 4 / 8 / 96 2 The Town Engineer is working with the Bolton Point staff to develop an engineering evaluation and implementation program for . the SCLIWC capital plan . The Town Engineer has been meeting with the City Engineer and SCLIWC member municipal engineers to develop a proposal, for an engineering evaluation to include the entire water infrastructure for . the area . This . evaluation is being done in conjunction with the City of Ithaca water supply study . A Request For Proposals has been issued and a pre - proposal briefing was held March 21 , 1996 , which was attended by representatives from 17 consultants . The project schedule requires initial submission from the consultants by April 10 , 1996 , development of a short list of Engineers by April 26 , and final selection of a consultant by the middle of June . Included with this report is Appendix B from the RFP which lists the issues under consideration for the study . The potential for mutual gains through intermunicipal cooperation in development and operation of the area water systems should be of major . interest to the Town of Ithaca . SEWER The Forest . Home pump stations continue to be a major maintenance issue , and as the stations are over 20 years old , a recommendation for replacement / upgrade of the controls and pumps will probably be included in the Water and Sewer capital plan . PEREGRINE HOLLOW SEWER DISTRICT The Town of Dryden request to purchase IAWWTP capacity for the extension of service to the Snyder Hill Sewer District is under consideration by the SJS . Construction of sewer improvements by the developer is substantially complete . Authorization to - use the sewer has been granted with the completion of ' the ' sewer use agreement with the Town of Dryden . HIGHWAY AND PARKS The Forest Home Bridge Project is continuing to progress . NYSDOT has completed review of the final design , and the county project manager is preparing contract documents to ` advertise for bid on April 4 , 1996 . This schedule includes a bid opening .
