TOWN BOARD MEETING MINUTES Q .s
January 8 , 1996
5 : 30 p . m .
At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County,
New York, held at the Town Hall , 126 East Seneca Street, Ithaca , New York, there
were:
PRESENT: Catherine Valentino , Supervisor; Carolyn Grigorov, Councilwoman ; David
Klein , Councilman ; Ellen . Harrison , Councilwoman ; Edward Conley, Councilman ; Mary
Russell , Councilwoman ; John P . Wolff, Councilman .

Call to Order: The Supervisor called the meeting to order at 5 : 30 p . m . , and led the
assemblage in the Pledge of Allegiance .
Agenda Item Nod . 3 - 1995 Year End Reports of Town Officials :
Supervisor Valentino - Former Supervisor Whitcomb submitted his annual report at the
close out meeting of the Town Board on December 29 , 1995 ,
The Town Clerk 's Annual Report was provided in the mail out packet , the other officials
with the exception of the Director of Engineering have presented their's this evening .
Does the board wish to approve these reports , or review them and approve them at the
February meeting ?
Mrs . Noteboom - I would like the Town Clerk's report be approved , because by law it is
to be accepted by the Town Board by January 20 ,
Councilwoman Harrison - We can accept the Town Clerk' s since it was provided in the
mail out packet.

Resolution No ,.1 - Approval and Acceptance of Town Clerk's 1995 Annual Report:
Motion made by Supervisor Valentino , seconded by Councilwoman Harrison accepting
and approving for permanent filing the 1995 Annual Report of the Town of Ithaca Town
Clerk.
Supervisor Valentino , aye ; Councilwoman Grigorov, aye ; Councilman Klein , aye ;
Councilwoman Harrison , aye ; Councilman Conley, aye; Councilwoman Harrison , aye ;
Councilman Wolff, aye. Motion carried unanimously.
Councilwoman Harrison - How did the anticipated license revenues for the dog
enumeration compare with what was actually realized?
Mrs . Noteboom - The actual was lower than the estimated by about 750 licenses .
Councilwoman Harrison - What is the comparison of what was spent to the revenues
realized?
Mrs . Noteboom - That is not known yet because of the SPCA contract being somewhat
different due to the enumeration . The enumeration final totals have not been received
from the SPCA. A future report will include the totals related to the enumeration .
Supervisor Valentino - The year end reports from the other officials will be approved at
the February meeting . Are there any verbal reports not related to the year end report?
Mr. Frost - My monthly report lists the daily totals , that is put together for the annual
report. Quarterly, a financial report is completed for revenues in each of the different
categories .
Councilman Conley - The Building/Zoning Officer at the beginning of the year had an
estimate of what the total revenue would be for 1995 . Did the revenues for that
department meet those estimates ?
Mr. Frost - The department' s revenues were within $ 1 , 000 of what was anticipated . In
November 1995 , there were a great deal of revenues from operating permits . The
estimate was conservative for 1995 , in 1994 the revenues were approximately $2 , 000
over the estimates .
Construction numbers have been fairly consistent the last few years . The monthly
report for December 1995 shows a few more permits issued than for the month of
December 1994 , the difference is the value of construction . Ithaca College did not do a
major project in 1995 , as they did in 1993- 1994 . They do have a large project planned

for 1996 .
Supervisor Valentino - Next month , staff will be presenting their priority work for the
year 1996 .
Mr. Frost - The new Town Board members are invited to contact me if they have any
questions as they review the reports , or if they wish to have a sense of the operations
from my department .
Agenda Item No 4 - Accp,�otance 1995 Town Justice Annual Reports :
Supervisor Valentino - Does anyone have any questions about the reports ?
Councilman Klein - Does the Town Board still have to review and sign the Justice
Dockets ?
Mrs . Noteboom - I asked the Justice' s when they would be able to present the dockets .
They said the problem is they can only print 400 pages at a time from their computers .
Judge Larkin ' s dockets are at the book binders . He will present those as soon as they
are finished . They will probably not be able to present dockets that include the full year
of 1995 because of the printing limit of the computer. The Justice' s have no problem
with presenting the dockets each time they have the 400 pages .
Supervisor Valentino - The computer program requires 400 dockets before printing .
Councilwoman Russell - Is the computer program something that is mandated by the '
State?
Mrs . Noteboom - No , the Town purchased the computer program . You may wish to
speak to the Justice' s directly regarding this .
Supervisor Valentino - At present , there are only a few computer programs available for
the courts . Instead of the Town Board traditionally receiving the dockets on an annual
basis , they will be presented through the year as 400 pages are finished . I understand
it is legal to receive the dockets in that manner.
Attorney Barney .- As long as the Town Board is approving the dockets at least once a
year. The last time they were approved was this time last year . If it takes the Justice' s
several more months to print 400 cases it will be pushing the requirements of the law.
Supervisor Valentino - What about the dockets from the whole year , where do they go?

Mrs . Noteboom - They are at the printer' s being bound, Judge Larkin will present them
soon . Judge Bordoni has not generated 400 cases since taking office .
Attorney Barney - They do not bind the dockets until the case has been closed .
Councilman Klein - The reports indicate Judge Bordoni has 334 cases closed , but
Judge Larkin has 2 , 000 cases closed .
Mrs . Noteboom - Closed cases mean any which have been finished whether it is a two
year old case or two week old case .
Councilwoman Harrison - Does the report showing those closed , mean that many
finished in 1995 ?
Mrs . Noteboom - Yes .
Attorney Barney - Judge Larkin inherited a great deal of cases when Judge Wallenbeck
passed away. He also has the added burden of dealing with those cases .
Supervisor Valentino - There will be a period of sorting this out . Judge Wallenbeck' s
books will soon be turned over to the State for final resolution .

Motion made by Councilman Klein , seconded by Councilwoman Harrison accepting for
filing by the Town Clerk the Annual Reports of Town Justice Clarence Larkin , and Town
Justice Raymond Bordoni for the year 1995 .

Agenda Item No . 5 - PERSONS TO BE HEARD :
Mrs . Theusen - Thank you for accepting the referendum petition related to the
purchase of the new Town Hall . When getting the petitions we thought it would be a
war between the old and the young , as it seemed most people involved in carrying the
petitions were older , but it did not turn out that way.
People in the community are really upset about the taxes in general , and they do add
them together, the school taxes and town taxes , and yet the Town Board is talking
about building a new Town Hall . We went down and looked at the Highway barns and
there are 10 plus acres the Town owns , that is 34 , 000 square feet per acre . It doesn 't

make sense to the average person when you look at that land , and say a new building
will be. built with 13 , 000 to 14 , 000 square feet . You are trying to build a new facility
when some residents are just trying to save our homes .
Supervisor Valentino - Mrs . Theusen was one of the individuals who initiated the
petition asking for the referendum . The petition was received today with about 494
signatures . We have set a meeting for January 10 , at 3 : 00 p . m . , at Town Hall to speak
with residents who signed the petition and who are interested in expressing their
concerns . All board members are encouraged to attend .
Securing the signatures on the petitions was a lot of hard work by a large group of
volunteers . They went out in very cold weather over the holiday season . It was a very
good example of how democracy works . The Town Board will definitely pay attention to
the petitions .
Councilwoman Harrison - The Board discussed a desire to better understand why
people will vote as they do . A yes or no does not tell us what was on peoples mind , is
that why the meeting will be held ?
Supervisor Valentino - Yes , people have called me and expressed why they signed the
petitions , the meeting is a way to have us understand resident concerns about the new
Town Hall .
Agenda Item Na 6 - Presentation . Sprague Insurance :
Jeff Farmer, Representative Sprague Insurance - I would like to review the insurance
policy the town has with our company, as the policies are subject to be renewed in
January. I met with Sherwin DiSanto , Human Services Specialist this week to go over
all the insurance coverage . He provided you copies of everything I left with him .
I deal with Mr. DiSanto , I spend time with Mr . Noteboom at the Highway Department ,
and occasionally , with Attorney Barney about legal issues . Work may be done over the
phone , but I like to spend at least one time with the Board on a yearly basis . I can
come more often if needed . The policy premiums did go up this year. I can answer any
questions related to that , and any others that may be needed .
Supervisor Valentino - This is the beginning of the second year of a three year contract
for insurance . The increase in premium was anticipated during the budget process and
are included in the budget for 1996 . Councilman Klein and I were part of the group that
reviewed all the policies two years ago .
Councilman Conley - Is this our liability , auto , building , all our insurance ?

Mr. Farmer - This is everything except the health , workers compensation , and the
disability insurance . The Sprague Agency currently writes the insurance for 35 to 40
Towns and Villages , and we represent many companies who write this type of
insurance . This is a three year policy term , but it does not stop the Town from making
changes . Next: year, even though it is only the end of the second year, I will internally
market the insurance again for different companies . Hopefully I can bring back to you
at that time some other alternatives .
Councilman Klein - They policy shows a reserve amount related to a list of claims.
Have you settlEld any of these claims against the town ?
Mr. Farmer - I provided those to show one of the reasons the insurance increased this
year. These were all claims that were prior ( 1994) to Sprague Insurance writing the
insurance . Those claims do have an effect on the policy because of the general
liability experience rating . Last year the 1994 losses were not included in the
experience rating because they skip the prior year and effect the next three years . This
year they do not include 1995/ 1996 , but it will pick up 1994 to 1995 . For the first time
there is $ 18 , 000 of losses showing on the general liability. When the company rates
that you pay, under this policy, $ 17 , 000 a year for the liability insurance . For that one
year there was $ 18 , 000 in claims resulting in a rate increase .
Councilman KIE.1in - Do these claims get removed from the rating at some point ?
Mr. Farmer - After three years , this is the first year, they will be on for 1996 and 1997
and then removed .
Councilman KIElin - Do we have claims for 1995 ?
Mrs . Noteboom - We do have some , but many were paid from the Risk Retention Fund
if they were lower than the deductible .
Mr. Farmer - Those might have been property losses . I am not sure there were any
liability losses , unless there was some water damage to one house . Last year was a
good year but that will not count until next year. When the liability goes up the
umbrella policy automatically goes up . It is unfortunate that those losses were figured
in , but any insurance company has to include those in the loss rating . You should be
experienced rated by each company not just ours .
Councilman Klein- They are only claims now, they are not settled ?
Mr. Farmer - The insurance company used the figures from the reserves for these
shown .

Attorney Barney - Those claims may not necessarily be paid , but it is the best estimate
of what would be paid if the claims were . paid .
Mr. Farmer - Next year if losses from the previous company show as zero being paid it
will fix some off the rating .
Attorney Barney - Three of the claims are from one incident and their status is not
known because they were handed over to the insurance company to argue . We should
find out the status of those claims since they will effect future ratings .
Mr. Farmer - The easiest way to find out is to determine their status is to contact your
previous insurance agent and ask for the updated loss list for the time frame they were
on the risk .
Supervisor Valentino - I would like some information on flood and earthquake
insurance . I thought it was decided the Town would include that insurance .
Mr. Farmer -You have those , the coverage on the first and second page shows the
flood and earthquake insurance . The premium is $ 1 , 000 .
Councilwoman Russell - What is the flood coverage , exactly?
Mr. Farmer - It is for sudden and accidental flooding , rather than having water fill
basements over a longer period of time . It has a value of $ 1 million to pay a claim for
buildings and contents . The most that could be paid for any one building is $500 , 000 .
It does not cover contents in a basement it is for first floor and above .
Councilwoman Russell - Would the coverage include damage to a road because of
flooding ?
Mr. Farmer - No , it is structures only.
Mr. Frost - If a water pipe broke it would not be considered flooding ?
Mr. Farmer - No , that is water damage covered elsewhere in the policy. A year ago the
Town did not have this coverage . A consultant worked on the specifications for
insurance and when they were prepared it asked for a million dollars of insurance with
a $ 5 , 000 deductible . All the insurance agents which were offering quotes were offering
this deductible . When I made the quote to the Town , I included the .$5 , 000 deductible
because I react the quote from the company wrong . In fact , it is a $ 50 , 000 deductible
instead of a $ 5 , 000 deductible . I had informed your former Personnel Manager,
Patricia Punger of this very early on last year. I sent her a letter telling her 1 had made
a mistake in the amount of the deductible and asked her to let me know what the Town

wanted me to do about this . I was never contacted by Ms. Punger regarding this issue .
Mr. DiSanto was informed and told we did not take the Town from something it had to
something worse , at that time you did not have flood or earthquake insurance so the
Town never had the $ 5 , 000 deductible . The coverage included was something brand
new that happened to have a $50 , 000 deductible instead of the $5 , 000 deductible .
tried to resolve this issue with Mrs . Punger continually during the time she was here .
do not know if this is a large issue to the Town because it is a coverage that you have
not had before .
Attorney Barney = What is the increment of cost to reduce the deductible?
Mr. Farmer - The $50 , 000 deductible can not be reduced , the company I was dealing
with will not accept a lesser deductible , that is why I did not do anything at the time .
You now have $ 1 million dollars worth of flood and earthquake coverage with a
$50 , 000 deductible .
Mr. DiSanto has said the Town Board would have to decide if they needed that
coverage . Up until this year you did not have that insurance. As far as we know the
town is not in a flood plain . Mr. DiSanto suggested you may not wish to pay $ 1 , 000 for
that coverage with a $50 , 000 deductible . I can pursue other alternatives with other
companies who offer a lower deductible . The $ 1 , 000 premium is very good for a million
dollars of flood coverage .
Attorney Barney = The loss the Town would be likely to have would probably be for
more than $50 , 000 .
Mr. Farmer = If you could find a company that would insure for a lesser deductible the
premium would definitely go up .
Attorney Barney = That may be the case , but it would be worth looking at if you could
lower the premium by $500 increments to get the proper coverage .
Mr. Farmer - The increment would probably not be $500 . 00 . 1 did a quote for another
Town for $ 500 , 000 of coverage and it had a premium of $2200 just for the flood
insurance with a deductible of $250 or $500 .
Councilwoman Harrison = It doesn 't seem the Town Hall would have a problem with
flooding . Would the highway barns have a problem ?
Mr. Noteboom •• 1 do not think the barns would flood , the only problem might be the
intermittent stream near the barns that runs all year.

Councilman Klein - Would the policy cover the flooding- of the town buildings , the
highway barns , and the town hall ?
Mr. Farmer - I would have to check, maybe the basement level would not be .
Mr. Walker - Are the pump stations covered ?
Mr. Farmer - The pump stations would be covered under the boiler and machinery
policy. They are very comprehensive as to what they cover. When we submitted the
quote last year we endeavored to meet a set of bid specifications . I made a mistake by
putting in the wrong deductible . Again , it is a coverage the town has not had until this
year. Your consultant suggested getting a quote for the flood and earthquake
coverage , it was put in place . The Town Board has to decided if the coverage is really
needed .
Councilman Conley - It seems that spending money on a flood policy when the highway
barns main building would only be covered after the first $50 , 000 of damage is not
feasible .
Councilman Klein - It would be more likely there would be an earthquake . There has
been discussion that upstate New York does have earthquake potential .
Mr. Frost - The State Building Code reports show Tompkins and Schuyler County's are
the least likely in New York State to have an earthquake .
Councilwoman Russell - Would the premium be effected if the Town just wanted
earthquake insurance?
Mr. Farmer - I would have to research whether it is possible to get the earthquake
insurance without the flood insurance as it is set up differently than regular flood
insurance . The two combined have a $ 1 , 000 premium . If they were separated it would
probably cost more than less , but I would be happy to investigate that issue .
Councilman Conley - With the earthquake history in this area , it does not seem to be
something that we should spend a great. deal of time worrying about or spending money
on . Even a flood with a $50 , 000 deductible does not sound reasonable .
Attorney Barney - When you say the insurance does not protect the basement, do you
mean the contents or the structure itself.
Mr. Farmer - The contents .
Attorney Barney - If you had loss as a result of a flood to the walls of the basement ,

would it be covered ?
Mr. Farmer - I will research exactly your policy does cover and report back to you .
Supervisor Valentino - Years ago , in the 1930' s , Ithaca had floods that went half way up
buildings to the second story in the downtown area .
Mr. Kanter - Since then the water has been channeled away.
Councilman Klein - Ice flows have created problems in recent years .
Supervisor Valentino - Mr. Farmer, please research these areas of concern and report
back to us through Mrs . Noteboom ,
Attorney Barney - How did you reach the property values stated on the policy? The
values do not seem to be right .
Mr. Farmer - The values are on replacement cost basis , not on a blanket limit. They
take all the buildings values , add them together and determine one dollar value . The
Town has to sign off on these values every year. Mr. DiSanto last week attested to
those figures being the replacement costs .
Attorney Barney - I would suggest that the Highway Superintendent and the Town
Engineer look at these values to see if they need modification .
Mr. Farmer - You do have to be careful of changes , because a lot of this information
comes from the bid specifications that were put out last year. The bid specifications
said you wanted blanket insurance with a replacement cost value , here is the value .
The Town provided the values .
Councilwoman Russell - Do those values change yearly?
Mr. Farmer - You can add an inflation guard to a policy of 4% or 8% so that they
automatically go up by that amount . Many people today do not add the inflation guard
because building values are not going up .
Attorney Barney - Can these values be changed if it is determined the market value of
properties is different?
Mr. Farmer - I would prefer that the values are changed .
Councilman Klein - Under commercial insurance don 't we have to have these buildings
insured for the actual value?

Mr. Farmer - You don 't have to because the agreed endorsement is on the policy. You
and the insurance company are agreeing those values are correct.
Councilman Klein - It would cover us under a partial loss even if the building actually
cost more to replace ?
Mr. Farmer - Supposedly, you have the blanket limit of insurance available to you for
any one loss , related to that there is a statement of values that says how much each
building is worth . They will look at the statement of values and what the building is
worth . If the building is insured for $500 , 000 and it is really worth a million , they will
still follow the statement of value . The blanket limit is a little misleading .
I have computer models of buildings that can be compared , but I do not attest to their
accuracy. The best way to determine building values is to have a local contractor give
a cost per square foot quote .
Councilwoman Russell - Are the equipment values lowered each year for depreciation ?
Mr. Noteboom - We have been reviewing this for the last few years to make the listing
more accurate . There are some things on this insurance listing that we do not even
own .
Mr. Conley - Does the County Assessment Office assess our buildings when they do a
reevaluation ?
Mr. Walker - Yes , but I do not believe that the town reviews them .
Councilman Conley - Someone should , it could give us some idea of the market value
of town properties . We should compare the buildings ourselves with like buildings
instead of trusting the assessment numbers . Cornell University buildings are on the tax
assessments much lower than they are really worth .
Mr. Farmer - You need a clear distinction between market costs and replacement costs .
What you can sell a building for means nothing compared to what it would cost to
rebuild it .
The Inland Marine coverage , the contractor's equipment coverages , shows the values
for replacement cost . This again , is incumbent upon Mr. Noteboom and I to make sure
the values being used for the equipment reflects 100% replacement cost , if you want to
get new for old .
Replacement cost is deceiving because the only way you get replacement cost is if you
are carrying replacement cost . It is set up to be on a replacement cost basis , but you

have to have the right values before you are going to get new for old , or the ability to do
that.
Mr. Noteboom - If we do that on everything , property included , what does that do to the
cost ?
Mr. Farmer - You have $ 1 . 6 million dollars for all your buildings and contents , the
premium shows only $4 , 000 out of a total insurance bill of $60 , 000 . It is almost
ridiculous not to carry the right amount of property insurance for the cost . You could
double the limits of insurance now for just $4 , 000 more . The rate on the Inland Marine
equipment is about $ . 40 per $ 100 , adding $ 100 , 000 worth of coverage would cost
$400 .
Supervisor Valentino - The Highway Supervisor and the Town Engineer are to review
the values for the town properties and equipment to make sure the insurance quotes for
replacement are adequate . They will report back to the board as soon as possible , and
work with Mr. DiSanto and Mr. Farmer as needed . Mr. Farmer will work with Mr.
DiSanto and make sure this review is completed .
Mr. Farmer - It is hard for an insurance agent to validate the values on a policy.
You may want to consider eliminating the flood insurance and using that $ 1 , 000 to up
the coverage of the buildings and contents , for fire damage , etcetera .
Supervisor Valentino - How much more does it cost for the indemnity insurance for
certain town officials .
Mr. Farmer - The crime coverage of $ 1 , 908 has a large portion towards the indemnity

nsurance . The $25 , 000 blanket on all employees .
Supervisor Valentino - We have three people who are covered for $ 1 million .
Mr. Farmer - The blanket $25 , 000 gives a limit for each of the Board members and all
the other employees , then you have the additional million . There is also the forgery
coverage . The monies and security coverage , plus the blanket bond , equals the
premium of $ 1 , 9081 Probably, $ 1 , 000 of that is for the additional million for each
person .
Attorney Barney - That coverage is really light because the Supervisor and Receiver of
Taxes have control over more money than that . The million is the absolute minimum .
Supervisor Valentino - Then we should review those figures and consider increased
coverage for those .

Councilman Klein - How about the cash , when taxes are collected is more than $5 , 000
at one time collected ?
Mrs . Noteboom - Yes , we do sometimes collect more than that in one day.
Mr. Farmer - If you are talking about an employee taking the money, that is employee
dishonesty, the one million in coverage . If you are talking about someone walking in
the door and robbing her, then you have $5 , 000 of coverage for someone else stealing
it .
Councilman Klein - During tax time there is more money than that , we need more
coverage.
Mr. Farmer - If you want insurance for that much , you have to tell me how much .
Supervisor Valentino - We will review them , a great deal of progress was made two
years ago , but there is still more to do .
Mr. Farmer - This is an ongoing process between the Town and I , especially with Mr.
DiSanto , to keep track of the insurance policies , values , and coverage . It can be tricky
to bid , because asking for quotes without questioning the limits can be unusual .
Attorney Barney, I don 't see anything insuring the County for the indemnity under our
contracts .
Mr. Farmer - That is under the contractors liability, it costs $250 and is a New York
States policy. You may wish to check , because when Ms . Punger was here there were
several of those policies . One of them might have been for the county and the other
with the state . I think we only have one policy in place with the state . I can look at that
and see what you have .
Attorney Barney I think the one you are talking about is for the State having to with the
highway.
Supervisor Valentino - Let's take care of this as part of the whole review. Does any
board member have anything else they would liked reviewed?
Councilwoman Russell - I would like to have the single coverage for earthquakes
looked at .
Mr. Farmer - Would you like to have me report back to do Mr. DiSanto on these issues?
Supervisor Valentino - Mr. DiSanto will be involved , but you should report back to Mrs .

Noteboom as Director of Administrative Services .
Mr. Farmer - Anything on the policies can be changed at anytime .
Report of Tompkins County Board of Representatives :
Beverly Livesay - ' I would to welcome those Town Board members who were reelected ,
and those elected for the first time , congratulations . I hope that we can start the year
on a better note with the Town and Tompkins County working together. In the past
there have been some bad feelings , misunderstandings , and people not knowing what
the problems are . Sometimes things have been resolved at the county level and the
town has been unaware of it . The town has three representatives on the County Board
who want to hear when there are problems with the county.
The insurance presentation was very interesting , is the Town doing anything about risk
management? The County became self insured several years ago when the insurance
rates became so high . When umbrella policies became available , the County insured
themselves for major losses in that way. Risk management is a method to look at
various losses to determine how they can be avoided . The County has an individual
who checks issues which may cause claims . Maybe the county should think about
expanding the risk management as a service to all the municipalities .
Supervisor Valentino - Would the county let the town come in under their umbrella?
Attorney Barney - The risk management is a problem for some of the attorney's who
represent the municipalities because the county has made provisions in contracts with
municipalities saying the County must be indemnified and the County will be held
harmless .
Beverly Livesa.y - There has been a problem with that , risk management to me is not
" risk shifting " . This issue was fought internally by the C and it needs to be addressed
again . With very small contracts it would cost more to have insurance than to do the
job intended within the contract .
Mr. Noteboom two Sprague Insurance had risk managers come to the town and visit the
Town Hall and the Highway Department . They produced a report telling us things
which would have a potential for a claim .
Mrs . Noteboom - A another problem with the County was found with the tax collection
process . The Town received a letter from the County on May 24, 1995 instructing us to
collect an In Lieu of Tax for the Tompkins Medical Office Building Association . We
budgeted the amount of $ 12 , 130 . 45 for that In Lieu of Tax, today it was discovered we
should not have billed them as an In Lieu of Tax because they had met their obligation

to the Tompkins County Industrial Development Agency. Tompkins County added a
billing to the warrant for them also . The Tompkins Medical Office Building Association
called and told us they received two bills . The warrant bill from the County and the In
Lieu Of bill from the Town . The Town of Ithaca will not be able to do collect the amount
budgeted because the warrant bill has to be paid . To compound the issue , the Town
billed this entity correctly in 1995 , but their contract was fulfilled as of June 28 , 19944
So we would have billed In Lieu Of in 1995 and not in 1996 .
Ms . Livesay - I will investigate this .
Mrs . Noteboom It The main concern is that a portion of this the In Lieu Of bill includes
about $8 , 500 in fire tax that will not be received .
Councilman Klein - We would normally receive $ 12 , 000 , of which $8500 is fire
protection and the rest is town tax?
Mrs . Noteboom = Yes .
Councilman Klein - It seems to me the County has a $ 12 , 000 problem . Mr. Walker has
conferred that there is a lot of problems with the County Assessment office .
Ms . Livesay - PlElase let me know of any problems , they will be looked into and
addressed .
Mrs . Noteboom - Ms . Livesay, could you check with Dean Eckstrom , County Data
Processing as to when we will receive the mailing labels ? The bill inadvertently did not
have the property owners address printed on the back of the tax receipt . Mr. Eckstrom
has kindly offered to print address labels in bill order number so we would not have to
type the envelopes for mailing the receipts back .
Supervisor Valentino - We should make sure the receipts have the address next year
because we use envelopes with windows which is much easier. It is an extra cost when
we have to use envelopes without windows .
Ms . Noteboom - We will have the additional cost of regular envelopes this year
because the labels will not work on the window envelopes we purchased for returning
receipts . There will also be additional staff time for preparing the envelopes .
Ms . Livesay - WEB need to do hear about these problems when they occur so the people
involved can resolve them quickly.

enact a resolution in support of their grant application to develop the Dryden Trail .
Councilwoman Harrison - Is this grant application competitive with other grants and
proposals the Town of Ithaca has submitted?
Mr. Kanter - It iS competing with all other ISTEA grant applications . There are about 25
to 30 in the County which this grant will compete with . It is a policy question as to
whether the Town Board wishes to support the efforts of other town grants when we
have our own projects .
Councilwoman crigorov - This application does continue a trail the Town of Ithaca has ,
it is very desirable .
Councilwoman Harrison - There will be many proposals , and if our support helps , it will
be beneficial to our town .

application was submitted before that contact .
Supervisor Valentino - Some of the things in the proposal are very good . They would
like to develop a subdivision with low and middle income levels co- mingled .

Instead of an appointee from the Planning Board and Zoning Board of Appeals we have
appointed two employees . One from Town Hall , and one from the Highway
Department . The employees are the ones most effected by the items adopted by the
committee and they should have a voice .

Agenda Item Na . 7 - Presentation Northeast Community Watch to _do Tompkins County
Sheriff' s Department :
Jack Writer, 110 Salem Drive - It is important that the Town Board know residents
within the town have developed the Northeast Community Watch , The Highway
Department helped put up the signs in the community. The residents in the northeast
have been concerned over the last several years about crime , and there have been
problems getting the crime dealt with . The Sheriff's Department suggested we look into
crime watch . Flyers were sent , and arrangements were made for the Sheriff's
Department to talk to the residents . A meeting was held at BOCES , and when the
officers arrived they were expecting 7 to do 8 people , there were 58 families in
attendance . As a result of that meeting , ten crime watch areas have been set up in the
northeast , each with its own coordinator .
It was determined at the meeting a need existed for finger printing equipment and
training of officers . The money to pay for this was not in the County budget . The
residents wished to help by raising money for signs in the crime watch area . The
residents raised enough money to contribute $300 . 00 to the Sheriff' s Department for
the equipment and training needed .
I would like to present the check for $300 . 00 from the Northeast Community Watch to
Emery Guest , Tompkins County Sheriff to do defer the cost of training and the cost of
the camera for finger printing . We have since discovered the Tompkins County
Sheriff 's Department is already doing the finger printing , but the residents made the
commitment at the meeting to do this .
Emery Guest , Tompkins County Sheriff: Thank you to the Northeast Community Watch
for their interest and commitment .
Supervisor Valentino - This is wonderful , it is so nice to see residents coming together

Agenda Item No 12 - Appointment Attorney for the Town :
Councilwoman Harrison - What was the annual bill from the attorney last year?
Attorney Barney - About , $80 , 000 for all personnel in the office and litigation .
Supervisor Valentino - The Town Board has reviewed the agreement from Mr. Barney
regarding the arrangements .
Councilman Klein - I was curious as to why the information was marked " confidential" ,
there was nothing in the papers that should be considered so .
Attorney Barney - These were sent with the billing for the quarter, and itemization of the
bill may contain details about personnel or litigation matters which would be
confidential . But no , the agreement was really not confidential , it is a public record .

Councilman Klein - I think Mr. Barney 's firm is doing a very fine job , and all board
members are in support . I have occasionally heard there is sometimes a matter of
timeliness of service . There are certain things that could perhaps be delegated to other
people in the firm .
Attorney Barney - There are two elements to this issue . We operate on a time basis
and as a result we prioritize items . If there is something the town needs immediately it
is done immediately. We can devote as much personnel to the town as you want , but
there is the consequence of having to charge more to the town .
Councilwoman Harrison - I am not follow that reasoning , it is work that will be done at
some point , why would it take more time if it were done more quickly'?

Attorney Barney - It depends on the nature of what has to do be done , sometimes it
does not ever get done because the issue may resolve itself if there is a wait . The
problem that generated it , or the inquiry may be taken care of and the issue no longer
needs our review . Some of the items are taken care of through the course of finishing
something else . It may be more efficient if items are .taken care of jointly. Some of the
things do not get done in a timely basis . When the issue is to a point that it should go
to a priority level it gets done and billed .
We get inquiries from Board members , the Supervisor and staff. Sometimes the issue
causes the to be concerned at that moment but it later resolves itself. Sometimes I
have to make a judgement as to what the item of priority should be .
Councilman Klein - Mr. Walker has mentioned there are some property transfers and
deeds which need addressing . Sometimes the real estate issues seem to languish ,
maybe they are not a high priority.
Attorney Barney - The firm can accomplish all those things "today" , but I will have to
hire more attorney's to do it and that will cost more money . We look. at an annual
budget and try to fit the work within that budget for the town .
Councilman Klein - Would it help if things when presented were given a time limit and a
priority ? .
Supervisor Valentino - I intend to discuss this with staff and Attorney Barney to see
what is left that needs legal attention . We will prioritize them and review them . The
Town Board should let me know of any items they have for the Attorney .
Attorney Barney - There are fairly frequent inquiries from the Department Heads , the
Supervisor and Town Board . This past year has been busy , there are a series of
things , like the work on the new Town Hall that have to do be addressed right away.
Councilman Klein - We appreciate the fact that the Attorney works within the budget .
Attorney Barney - I do not wish to be embarrassed and ask for a sum more than what
was budgeted . If some people look at the yearly bill they may think it is fairly high , but
in comparison it is not that much different than other municipalities , especially when
you take into account that my firm does all the litigation . If someone feels that the work
is not getting done , we want to hear about it .
Supervisor Valentino - Much of the work by the Attorney for attending the Planning
Board and Zoning Board of Appeals meetings is cost effective because those issues
are done correctly from the beginning .

Agenda Item No 13 = Water and Sewer Benefit Assessment :
Mr. Walker - When we sent the County a correction to a tax parcel there was a
typographical error. The actual tax parcel to be charged was 28- 2-7 , instead of 28- . 1 -
7 . The incorrect charge was significant to the' homeowner, and I recommend that the
refund be paid upon full payment of the tax bill .
Resolution No . 13 - Benefit Assessment Refund :
Motion made by Councilman Klein , seconded by Councilwoman Harrison authorizing a
total refund of benefit charge in the amount of $356 . 40 ($ 176 . 00 for water and $ 180 . 40
for sewer) to be paid to Robert Shaw , 1415 Mecklenburg Road , after payment in full of
the entire tax bill or payment of the first installment amount on the tax bill .

Councilman Klein = What happened to the other parcel , did we collect the correct

Mr. Walker - This was strange , this was a back lot parcel that was subdivided without
our knowledge not all of the charge is being lost. It was consolidating the parcel and
increasing it 2 . 8 units when there were already four . We did lose some of the benefit
charge . It will be corrected next year .
Agenda Item No 14 = Chase Lane Lighting District :
Resolution No . 9 - Authorization for Engineer to Prepare Report on Chase Farm
Lighting Districl;;
Motion made by Councilman Klein , seconded by Councilman Conley subject to a
permissive referendum , that the sum of One Hundred Dollars ( $ 100) is appropriated to
pay the cost of preparing a general map , plan and report for providing the lighting
services in that portion of the town encompassing all of Chase Lake and LeGrande
Court as described on Schedule A annexed hereto . The Town Engineer is authorized
and directed to prepare such map , plan and report within the limits of the amount
appropriated , upon completed to file the same in the Office of the Town Clerk, The
Town Board authorizes the Town Supervisor, Town Engineer, Town Planner, and
Attorney for the Town , to take such steps to execute such documents as may be
necessary in order to prepare such map , plan , and report. The Town Clerk within ten
days of the adoption of this resolution shall post and publish a notice and abstract or a
copy of this resolution in the manner required by Town Law, Section 90 , specifying this

resolution was adopted subject to a permissive referendum .

Councilman Klein - At the last meeting there were estimates from NYSEG as to what it
might cost , including using existing poles . The estimates didn 't make sense .
Mr. Walker - There are no poles existing everything is underground . Part of agreement
for the costs last month included that the home owner association would buy some of
the poles . We will provide the options available . The owners wish to have decorative
poles which would cost more .
Mrs . Noteboom - Mr. Walker needs to get in touch with Mr. Alan because he
researched the cost and is very interested in this .
Agenda Item No 15 - Custodial Agreement . M &T Bank :
Supervisor Valentino - Postponed until the February meeting .
, - Agenda Item No 16 - Transmission Master Meter Agreement With SC', LIWC :
Mr. Walker - The concept when SCLIWC was created was to have a transmission
system where the water is sent to the town and then each point is metered so the total
amount of water to each municipality is measured . Due to high costs and overruns
during the original construction , the meters were installed but they were not adequate
and they broke clown . Some worked and some didn 't , therefore we do not have the
meters that were specified in the original agreement . '
This project will provide a safe work environment at each of the take off points as they
will be automated electronically controlled valves so that water can be turned on and
off. They are presently in underground pits and under OSHA standards are confined
hazardous areas to work . They get flooded frequently which causes problems for the
machinery.
The project will place the meters above ground in precast concrete structures that are
not confined spaces and are in a dry environment . As part of the agreement each
municipality is responsible for constructing the site , the plumbing , structure , and the
setting . Bolton Point will provide the meter and maintain the appurtenances that go to
the meter .
The Town Engineering Department has been doing the engineering and design on

these structures . Each municipality has some cost . The Town of Ithaca Is cost is
estimated at $82 , 935 which is greater than the other municipalities because we have
five different metering sites . Most of the other municipalities only have one site . The
Town of Lansing has a very small cost because their main connection point already has
a meter in place . Spruce Lane and Sheldon Road meter pits are in Cayuga Heights .
The cost is split between the two municipalities because each gets some water from
both the pits . The formula was developed on the percentages from the municipalities .
To keep the cost lower, all the meter pits have been put together into one project .
Bolton Point can act as the construction administrator and coordinate all the work in the
different municipalities . Attorney Barney is reviewing the agreement to determine if
Bolton Point can actually act as an agent for each municipality and sign a contract for
the work .
Attorney Barney - I have some difficulty with that, Bolton Point was a devise that was
created many years ago , and as an entity Bolton Point does not exist . It is a
commission who supervises this water system . When the original project was built 20
years ago the original water treatment plant was done by the Town of Ithaca signing
the documents on behalf of the three municipalities . Since that time , whenever we
have done a major capital improvement of any sort it has been handled that way. The
Town of Ithaca has been the contracting agency for itself and the other municipalities . I
am going to suggest to the SCLIWC that the agreement be rewritten to provide for the
town to so act. Under the law it does not appear that an entity such as Bolton Point
commission is authorized to sign contractual documents .
Councilman Klein - Even when they did the zebra mussel contract ?
Attorney Barney - The zebra mussel contract was signed by all five municipalities .
Mr. Walker - That was very awkward , the Bolton Point staff administered the contract
and when they had minor change orders they had to ask all five municipalities do
authorize it . Staff at Bolton Point has suggested that one contracting agency able to
execute and administer the contract would be more efficient . I agree with that .
Attorney Barney - It should be one of the municipalities , it does not have to be the
Town of Ithaca . However we have the largest interest in the project .
Councilman Klein - You are saying this agreement should be changed ?
Attorney Barney - I would suggest a resolution which allows the Supervisor to agree to
an altered version . There are also a couple of provisions in the agreement that bother
me. It has a provision where the commission can automatically increase the cost by
10 0 . This is a problem as the Town Board has to authorize the maximum that can be

spent , you can not delegate that right to another entity .
Tonight , you can approve the concept and authorize the Supervisor to enter into an
agreement with such modifications as the Town Engineer and Attorney for the Town
advise or feel might be appropriate .
Resolution No . 11) - Contract With SCLIWC Relating to do the Installation of Master
Meters :
Motion made by Councilman Conley, seconded by Councilman Wolff that the Town of
Ithaca hereby agrees to the terms of the " Transmission Main Master Meter Agreement"
dated 12/7/95 with such changes or modifications therein as the Town Supervisor, with
the advice of the Town Engineer and the Attorney for the Town , may approve (including
a change by which the Town of Ithaca rather than SCLIWC becomes the contracting
party on behalf of all the member municipalities of SCLIWC ) and grants authority to the
Town to enter into a contract to construct the Town ' s share of site improvements
( including structures) to the existing transmission main connection to the Christopher
Circle and Sheldon Park tank distribution systems , and the entire site improvements
(including structures ) to the existing transmission main connections to the Sapsucker
Woods Road , Pine Tree Road , and Danby Road tank distribution systems including the
installation of master meters with the lowest responsible bidder for an amount not to
exceed $82 , 935 . 00 .
Attorney Barney -, This issue will come back to the Town Board because you will have
to % schedule a public hearing when the exact cost is known .
Councilwoman Harrison - Is the $82 , 935 . 00 the towns share or the total cost?
Mr. Walker - The estimated cost of the town 's portion . The agreement as drafted still
has acceptance of an actual bid to come before this board .
Councilwoman Harrison - If that is an estimated amount , would it be feasible to have a
not to exceed " amount?
Attorney Barney - The agreement requires the Engineer' s estimate to be made , at that
point the Town will hold a public hearing to show an exact expenditure . You could
change the amount at that time if the amount is larger or lower.
Councilwoman Harrison - So why is the amount mentioned in the resolution at all?
Mr. Walker - This was the amount in the budget for the project . During the budget
process we pulled all the capital water projects out of the budget for 1996 ($ 100 , 000) .
We did not actually have a line item in the budget for this specifically . This expenditure

will require a budget amendment for this project . It was former Supervisor Whitcomb's
request .
Supervisor Valentino - I thought at budget time we said we would be grouping many of
these projects , including this one into a capital improvement bond ?
Mr. Walker - Those projects will be discussed at the Public Works Committee meeting .
Mrs . Noteboom - The budget includes $50 , 000 in contingency to be moved into a line
item to pay the principle and interest for the bonding of these grouped projects .
Councilman Klein - There is nothing on the spread sheet that talks about Christopher
Circle .
Mr. Walker - In the agreement it talks about the Christopher Circle grid that comes off
of Sheldon Road and pumps into Spruce Lane . The primary feed will be the Spruce
Lane to the Christopher Circle tank .
Councilman Klein - There is no structure at Christopher Circle . ?
Mr. Walker - There will be no work done at Christopher Circle , it will not be changed
-� again . The Spruce Lane site , off Triphammer will have an easement from the
landowner next door to build an extension on the roof and make a covering for the bus
shelter.
Councilman Klein - Since the structures will be above ground and in residential
neighborhoods will they be attractive ?
Mr. Walker - Bolton Point has done a SEQR on this project which was a Class 2 .
Attorney Barney - The town will have to do a SEQR also , as we are clearly the involved
agency.
Mr. Walker - The structures will be about 10'x12 'x9 ' and made of precast concrete , they
will be surrounded by shrubbery. The most visible will be on Cornell property, one by
the tennis facility which will be banked with spruce trees and evergreens . It will be
approximately 9' high , precast concrete with a flat roof. The other by the Cornell Life
Safety Building will have a standing seam pitched metal red roof to match the adjacent
buildings .
Councilwoman Harrison - What will the ones that are in the residential areas look like ?
Mr. Walker - Oakcrest will be in the Village of Lansing , Sheldon Road will have a

peaked roof with plantings around it , the Apple Orchard is Cornell ' s , the Pine Tree
Road structure will be across from the tennis facility . Pearsall Place and Burdick Hill
have existing pump stations .
Councilwoman Russell - What will the one look like on Pine Tree Road?
Mr. Walker - It will be built into the bank towards the East Hill Plaza area .
Councilwoman Russell - Is part of this $82 , 935 . 00 based on a percentage formula as a
way of allocating costs between the participating municipalities ?
Mr. Walker - The town takes 65 % of the water out of Spruce Lane , the Village of
Cayuga Heights uses 25 % , and 10% goes to do Dryden . Actually, 75% of the water
comes through thEl Town and then into Dryden .
Councilwoman Russell - The point of this metering is to do tighten up the percentage,
so that the Town has actual figures of how to allocate costs ?
Attorney Barney - There is some confusion , for the purposes of setting this allocation
you have to set an arbitrary number. An estimate of what is reasonable .
Mr. Walker - These are meters off the transmission main so we know how much water
is coming from Bolton Point , it then goes to the distribution system . Our distribution
system is a network grid that doesn 't follow political boundaries . There are some
connections wherEl the water is in the village and the water main crosses over a town
road , and feeds more than one municipality . We keep track by the household meter
readings , the portion of water that goes to each municipality . These meters will provide
a better means of allocating costs because we will be able to know how much water
comes from the transmission main and how much water is metered into the houses .
Then we can determine if there are areas of leakage .

Additional Agenda Item No 1 - Agreement for the Expenditures of Highway Monies :
Mr. Noteboom - The Public Works Committee has reviewed this . In order for the town
to spend any highway funds an agreement has to be signed by the Town Board and the
Highway Superintendent .
Councilman Klein - Fred , you may wish to discuss why the paving this year is largely
concentrated in the northeast.
Mr. Noteboom - We try to keep areas grouped in a given area when paving because it
is more cost efficient .
Councilwoman Harrison - How are priorities set for the roads that are chosen for
paving ?
Mr. Noteboom - The Town has a paving plan . Judgments are made from year to year,
based on the condition of roads and that plan . Any given year a road may start to
deteriorate faster , so we would make a determination based on those conditions .
Councilwoman Harrison - Who would be responsible for dealing with Triphammer Road
from Community Corners to the line with Lansing ?
Mr. Noteboom - I do not know who is responsible for that portion of road .
Mr. Walker - I believe , the Villages they are responsible for County roads .
Mr. Noteboom - I cannot believe the Village is responsible for County roads because
we plow some of the county roads in the village . The Village is starting to have trouble
keeping up with some things and they might be entertaining the idea of the Town and
Village sharing some services . It may be time for the Town Board to have discussions
with the Village to see where the interest may be . There are future possibilities got
cooperation .
Councilman Conley - That is a village road but it is a major traffic artery for the Town ,
Cornell University, and the County. More than one entity should share the
responsibility for that road .

Mr. Noteboom - Some of our roads were former State roads which became county
roads and then our roads .
Councilman Conley - Maybe the Metropolitan Planning Organization should look at
these issues . That road needs to do be fixed , who' s responsibility is it? It would not be
smart for us to say it was ours when the road is a main artery to the mall and so many
others use it.
Mr. Noteboom - I will find out whose responsibility that road is and report back.

Development Black Grant Application :
Mr. Kanter - The Town Board agreed to have Tompkins County go ahead with the
Small Cities Community Development Block Grant Application on our behalf. A letter
has been received from Jim Hanson indicating the County would administer the grant
application and the grant monies , the Town itself has to hold the public hearings . Mr.
Hanson has requested the Town Board schedule these . We are suggesting that the
first public hearing be set for the February meeting , and the second at a future date .
The County would like both the public hearings to be held at least one week before the
grant submission date of March 13 . There is a possibility there may -have to be a
special Town Board meeting to accommodate this requirement .
Resolution No . 12 - Public Hearing Date :
Motion made by Councilwoman Harrison , seconded by Councilwoman Russell that the
Town Board authorizes public hearings to be scheduled , the first on February 12 , 19961
at 6 : 45 p . m . at the Town Hall , and the second at a date to be determined . The Town
Clerk is authorized and directed to advertise these hearings in the official newspaper of
the Town .

Agenda Item Additional No 3 - Extension of Due Date for Water Billing
Supervisor Valentino - A request has been received from Ide' s Bowling Center for an
extension to pay their water bill because the billing was double the normal amount as a
result of a leak. They will pay the bill , but they are asking us to waive the penalty that
would be attributed to late amount .
Mrs . Noteboom - They have paid $ 1 , 300 of a $2 , 590 bill .
Councilwoman Russell - This was a leak at their location which was no fault of the
Town ' s ?
Supervisor Valentino - The leak was their responsibility. The penalty would be
approximately $ 121 . 00 . What is our policy for the general public , if this was a
residential water leak the homeowner would have to pay the interest and penalties .
Even though Larry Parlett of Bolton Point has recommended that the penalties and
interest be waived , I don 't feel inclined to do so .
Councilman Klein ,- There have been times where people have been away from home
and they have pipes break and they have to pay the what is due .
Mr. Walker - Ide' s is asking for a waiver of the late payment , and I think it would be a
poor precedent to set .
Mrs . Noteboom - Fie will pay the bill , he has argued that having such a large bill and
having to pay property taxes at the same time is a hardship .
Supervisor Valentino - Still $ 121 . 00 , is not an enormous amount.
Councilman Wolff - Do we have a policy to review something like this if there are
extenuating circumstances ?
Mrs . Noteboom - I believe the Town Board has to give authorization to waive any
interest and penalties , or to change the due date of a bill .
Supervisor Valentino - We have considered individual cases from time to time , but we
have never set a direct policy. They will be looked at as each case arises . It is hard to
believe that for a business like this that an additional $ 121 . 00 is a hardship .

Mr. Walker - Ide' s is not even behind in the payment at this point.
Motion made by Councilman Conley to extend the payment date for the water billing to
Ide' s Bowling Center, and waive the interest and penalties of approximately $ 121 . 00 .
The motion received no second , and died on the floor.
Agenda Item Additional No . 4 - Authorization To do Issue Corrected Tax Bill :
Mrs . Noteboom - Today when a resident was paying .their tax bill it was found that a tax
parcel was inadvE, rtently charged delinquent water and sewer charges as a result of a
typographical error when preparing the delinquent listing . I would like to request
authorization for the Town Board to issue a corrected bill to the two property owners
involved .

Attorney Barney - There are a couple of pages of the petition that should be looked at ,
they need signatures from 5 % of those registered voters from last gubernatorial
election .
Attorney Barney - Take the petitions over and have the Board of Elections quickly look

to see if they think there are enough qualified signatures .
Supervisor Valentino - Should we set a date for the special election now?
Councilman Conley - It should be done on a Tuesday , the normal election day , at the
three fire station polling places , from 12 : 00 p . m . until 9 : 00 p . m .
Supervisor Valentino - I suggest that we set the special election on Saturday, March
16 , here at the Town Hall , from 12 : 00 to do 9: 00 p . m .
Attorney Barney = 'The law says the special election can not go beyond 8 : 00 p . m .
Councilwoman Russell - How many machines can we have at this Town Hall , will only
one accommodate all the voters ?
Mrs . Noteboom - It would be very hard for the full electorate of the town to vote at one
machine . I would like to see it done at two of the fire stations and at one other central
location . The Board of Elections will be able to see which district voters would go
where .
Councilwoman Russell - You have no idea how many voters can be accommodated by
one machine ?
Mrs . Noteboom = About 400 , in a six hour period . We have to have two inspectors from
each party at each location .
Attorney Barney - What does this Town Board wish to do ? Is it the consensus to have
the special election on a Saturday?
Councilman Klein •o There also will be absentee ballots sent .
Attorney Barney - The statue says no person can vote unless they are a landowner in
the Town , however that particular section has been held unconstitutional .
Councilwoman Harrison - Let' s set it for Tuesday, March 12 at three locations , with
voting from 12 : 00 to do 8 : 00 p . m .
The Town Board made a consensus to have the special election as suggested by
Councilwoman Harrison . The Town Clerk and Attorney for the Town will begin making
arrangements with the Board of Elections , and the date will be formally set by
resolution at the next meeting .

WHEREAS , the Town of Dryden is applying for a grant to develop the Dryden Trail
which would begin at the end of the East Ithaca Recreation way in the Town of Ithaca
at Game Farm Road and follow the abandoned railroad bed to Route 13 in the Town of
Dryden near Hall Woods Road ; and
WHEREAS , the Dryden Trail is identified as part of a priority corridor in the draft
Transportation Trail/Corridor Study, prepared by the Ithaca-Tompkins County
Transportation Council , and as a proposed multi- use trail in Building Greenways for
Tompkins County , prepared by the Tompkins County Greenway Coalition , and
WHEREAS , thE: proposed Dryden Trail could be part of a countywide trail system
which could serve as a major route for residents in the northeastern part of the county,
and
WHEREAS , the Dryden Trail would be consistent with the Town of Ithaca' s
Comprehensive Plan ( September 1993 ) and Park and Open Space Plan ( 1984
Update) , now therefore be it
RESOLVED , that the Town of Ithaca Town Board does hereby support the efforts of
the Town of Dryden to develop the Dryden Trail .

Dear Cathy:
We are submitting this letter to you to outline the arrangements for legal services provided
by our office as attorney for the Town. The terms are substantially the same as m my . last few
letters to the Town Supervisor in prior years. The only change -is-. that the'. hourly rate for our
associate will be increased from $95.00 to $ 100.00. In summary, the . arrangements that we have
agreed to in the past and that we would propose to continue for 1996 are as follows.
1 . I agree to serve as Attorney for the Town for the year 1996 and such additional
periods as the Town Board may wish, subject to termination at any time as set forth below.
2. Services would be on an " as needed" basis and as requested or directed by the Town
from time to tune„ Until otherwise directed, the services would include , attendance at meetings
of the Town Board, Town Planning Board, Town Zoning Board of Appeals; Town Codes and
Ordinances Committee and Town Staff; advising Town governing.' bodies and individuals
including the Town Supervisor, Planning Board Chair, Zoning •Board Chair, . and Codes and
Ordinances Chair on legal matters; advising Town staff on - legal matters , . review of legal
documents; preparation of requested local laws, agreements, resolutions, and other legal materials;
representing the Town in litigated matters (when feasible, authorization for such representation

will usually be sought from the Town Board before appearing for the Town, although
occasionally emergency representation may occur after consultation with the Town Supervisor) ,
assisting Town bodies and staff in connection with legal matters relating to development
proposals, environmental matters, etc . ; responding when appropriate to legal issues or questions
posed by Town residents in relation to matters pending before ' a Town agency; and providing
such other duties as general counsel to the Town as may be requested or directed.
3 . Where appropriate, matters might be delegated to other lawyers in my office when the
expertise, economies, or time constraints make such delegation desirable from the Town's
perspective.
4. Generally, the fees for the services would be calculated on an hourly basis.
Occasionally, when we determine that perhaps more time was spent on a matter than might seem
appropriate for the result obtained, the fee may be reduced. On rare occasions, and after
consultation with the Town, when the time spent is not truly reflective of the value of the
benefits obtained by the Town, we might request an upward adjustment for that particular matter.
5. For 1996, the hourly rate will be $ 125.00 for partners and $ 100.00 for associates. This
represents approximately 15 % off of our normal hourly rates (for existing non-municipal clients
our basic rates in :1996 are $ 150.00 per hour for partners and $ 115.00 per hour for associates
new non-municipal clients may be charged higher rates) . If the Town chose to continue us for
ensuing years, it would be our intention to bill at a similar 15% discount from normal hourly
rates as then in effect,
6. The arrangements outlined in this letter may be ended at any time , by either party for
any reason, or for no reason at all. One of the essential elements of a successful client-attorney
relationship is mutual comfort with each other. If that does not . exist, the Town should. not have
to wait until the end of a year to seek other counsel. Obviously, if a . change were being
contemplated by either of us, we would hope that whoever is deciding , to: end the relationship
would provide as much lead time as possible to the other . so appropriate : adjustments and
transitions might occur, but lengthy advance notice is not a required precondition to severing the
relationship. In the event of such severance, we would cooperate ° fully; in; transferring files and
information to the counsel chosen by the Town and would, of course, expect ' to receive the
agreed compensation up through the completion of the transition.
If the arrangements stated above are consistent with the Town 's understanding, perhaps
it would be wise to execute duplicate copies of this letter for our respective - files. A space for
such action is provided below. If the arrangements do not represent your understanding, please
let me know what is incorrect, and I will try and redraft this letter so that it meets with your
approval.

WHEREAS , Robert Shaw was charged 2 . 2 units of sewer benefit and 2 . 2 units of
water benefit on his 1996 tax bill for Town of Ithaca Tax Parcel No . 28 . - 1 - 1 ; and
WHEREAS , water service and sewer service in not available to this parcel ; and
WHEREAS , the landowner has requested a refund and the benefit assessments
removed ; and
WHEREAS , the Town Engineer has confirmed that an adjustment in benefit
assessment for water and sewer be made ; now therefore be it
RESOLVED , the Town Board hereby authorized a total refund of benefit charge in
the amount of $3.56 . 40 , ($ 176 for water and $ 180 . 40 for sewer) to be paid to Robert
Shaw, 1415 Mecklenburg Road , Ithaca , New York 14850 , after payment in full of the
entire tax bill or payment of the first installment amount on the tax bill .

WHEREAS , the Town Board of the Town of Ithaca , Tompkins County, has received
a request from a number of the residents of Chase Lane and LeGrande Court seeking
to have street lighting installed ; and
WHEREAS , the Town Board of the Town of Ithaca believes that such a street
lighting district encompassing all of Chase Lane and LeGrande Court would be
appropriate , the proposed boundaries of the district being more particularly described
on Schedule A annexed hereto , . .
NOW , THEREFORE BE IT
RESOLVED , subject to permissive referendum , that the sum of One Hundred
Dollars ( $ 100 . 00 ) is hereby appropriated to pay the cost of preparing a general map ,
plan and report for providing the lighting services in the above described portion of the
Town of Ithaca , and be it further
RESOLVED , that the Town Engineer of the Town of Ithaca , is hereby authorized
and directed to prepare such map , plan and report within the limits of the amount
appropriated therefore, and upon completion thereof to file the same in the Office of the

RESOLVED , that the Town Board hereby authorizes the Town Supervisor , Town

Resolution Authorizing Execution of
Contract with the Southern Cayuga Lake Intermunicipal Water
Commission Relating to the Installation of Master Meters
Resolution No . 10
WHEREAS , a plan for the installation of master meters on the Southern Cayuga
Lake Intermunicipal Water Commission ( SCLIWC ) water system has been proposed ;
and
WHEREAS , the Town of Ithaca (Town ) has considered said plan and acknowledges
its cost responsibilities as described in the proposed "Transmission Main Master
Agreement" dated 12/7/95 ; and
WHEREAS , SCLIWC proposes to provide bidding and construction management
services for the Town of Ithaca and other municipalities in connection with this project ;
and
WHEREAS , the Town may authorize the Town to sign contracts on the Town ' s
behalf and on behalf of the other SCLIWC member municipalities particularly when , as
is the case in the Transmission Main Master Meter Project , time is of the essence and
further review of the project by the Town of Ithaca after bids are received and found to
be within the engineer' s estimate would add no value to the project ; now therefore be it
RESOLVED , that the Town of Ithaca hereby agrees to the terms of the
"Transmission Main Master Meter Agreement" dated 12/7/95 with such changes or
modifications therein as the Town Supervisor, with the advice of the Town Engineer
and Attorney for the Town , may approve (including a change by which the Town of
Ithaca rather than SCLIWC becomes the contracting party on behalf of all the member
municipalities of SCLIWC ) and grants authority to the Town to enter into a contract to
construct the Town ' s share of site improvements ( including structures) to the existing
transmission Main connections to the Christopher Circle and Sheldon Road tank
distribution systems , and the entire site improvements ( including structures) to the
existing transmission main connections to the Sapsucker Woods Road , Pine Tree
Road , and Danby Road tank distribution systems including the installation of master
meters with the lowest responsible bidder for an amount not to exceed $ 82 , 935 . 00 .

AGREEMENT FOR THE EXPENDITURE OF . HIGHWAY MONIES
AGREEMENT between the Town Highway Superintendent of the Town of Ithaca ,
Tompkins County , New York and the - undersigned members of the Town Board .
Pursuant to the provisions of Section 284 of the Highway Law , we agree
that moneys levied. and collected in the Town for the repair and improvement
of highways , and received from the State for State Aid for the repair and
improvement of highways , shall be expended as follows :
16 GENERAL REPAIRS . The sum of $ 88 , 000 shall be set aside to be expended
for primary work and general repairs upon 7 . 2 miles of town highways ,
including sluices , culverts and bridges having a span of less than five
feet and boardwalks or the renewals thereof .
2 . PERMANENT IMPROVEMENTS . The following sums of $ 226 , 000 shall be set
aside to be expended for the permanent improvement of town highways upon
1 . 48 miles of Town Highway , including paving , guide rails , etc .
( a ) On Simsbury Drive , commencing at Brandywine Drive and leading to
the Cayuga Heights Village line , a distance of . 25 miles , there
shall be expended not over the sum of $ 31 , 650 ;
( b ) On Brandywine Drive , commencing at Christopher Lane and leading to
Winthrop Drive , a distance of . 13 miles , there shall be expended
not over the sum of $ 116 , 500 ;
( c ) On Sandra Place , commencing at Winthrop Drive and leading . to
Burleigh Drive , a distance of . 07 miles , there shall be expended
not over the sum of $ 8 , 850 ;
( d ) On Winthrop Drive , commencing at Warren Road and leading to Cayuga
Heights Village line , a distance of . 66 miles , there shall be
expended not over the sum of $ 84 , 000 ,
( e ) On Chase Lane , commencing at E . King Road and leading to the end ,
a distance of . 37 miles , there shall be expended not over the sum
of $ 47 , 000 ;
( f ) On Judd Falls Road off from Route 366 and leading to Tower Road , a

Authorization to Hold Public Hearings
1996 Small Cities Community Development Block Grant Application

WHEREAS , the Town Board has expressed an interest in having Tompkins County
prepare a Small Cities Community Development Block Grant (CDBG ) application of
behalf of the Town of Ithaca , and
WHEREAS , while the County signs all relevant paperwork regarding the application ,
the Town is required to hold public hearings to meet the HUD public participation
process involved in applying for CDBG funds , now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes two
public hearings to be scheduled , the first on February 12 , 1996 , at 6 : 45 p . m . at the
Town Hall , 126 East Seneca Street , Ithaca , NY 14850 , and the second at a date to be
determined , and be it further
RESOLVED , that the Town Clerk is hereby authorized and directed to advertise

During December the Highway/ Parks crews continued , as time
permitted , 1E! af collection and storm clean up . This took 179 hours
of time . Due to the weather , this operation has pretty much come
to a halt for now . The regular leaf and brush pick - up in April
will get any remaining leaves and brush .
As I sit here writing this report the snow is falling again . We
have had a very busy winter season thus far - - and it doesn ' t look
like it ' s going to ease up much . We have spent 622 regular hours
and 486 . 5 overtime hours ( total 1 , 108 . 5 ) of time on snow removal .
We ' ve used at. least 475 tons of salt in December , also . The South
Hill and West Hill Fire Stations have been salted 10 times and
plowed 4 timE: s .
Along with all the snow removal , there have been a lot of repairs
to the trucks , among other repairs . We have worked 115 . 5 regular
hours of timEi and 8 . 5 hours of overtime on machinery repairs etc .
The crews did manage to complete a few road work projects , in
between snow removal operations . These projects include patching
roads , replacing / repairing signs , working on the Annex building ,
and replacing pipes at the intersection of Salem and Sycamore
Drives . These projects took 481 . 5 hours of time .

10 Snow re #:noval for bikeways , trails , and sidewalks required 97
hours in December . An additional 89 hours were worked by
Parks staff in Highway snow removal .
2 . Parks :staff worked 32 hours on curbside leaf and brush
collection getting whatever material was not buried by the
early snowfalls . We anticipate heavier than normal amounts of
yard waste to be collected during our spring pick - up in April .
3 . Clean uo from the damaging snowstorm in November required 52
hours . Every trail , bikeway , and park site had some tree
damage which had to be dealt with .
4 . Renovations to the new barn annex continued as time allowed .
Work was concentrated on framing out the heated woodshop area ,
installing windows and - doors and getting the space ready for
our contractor to blow in insulation . Parks staff spent 85
hours on the project during December .
5 . Various routine maintenance and repair tasks completed our
work effort , totalling 248 hours .

DEVELOPMENT REVIEW
The Engineering Staff has been reviewing ccmpliance on the
following projects that have receive : Planning Board approval and
are under construction :
Saponi Meadows Subdivision , Seven Mile Drive
No construction activity in December .
Sanctuary Woods Subdivision , Sapsucker Woods Road
Improvements have been completed and accepted by the Town
Board . Town will have maintenance and operation
responsi i lity when deed for road has been transferred to Town
and filed with County Clerk .
EARTH FILL PE ::NIITS
An earth fill permit for a site on Five Mile Drive with the
potential source of fill being the Rte . 96 Project has been
issued . Construction of the stabilized entrance has been
comp1etedl and approximately 500 cy of fill has been placed in
the first phase fill area . Sediment control fencing has been
installed around the fill area .
WATER PROJECTS:
The Town Engineering staff is continuing to work with the
Bolton Point staff to implement the master metering program
for connections to the water transmission main . The plans and
specifications have been completed and the contract documents
for all of the master metering locations are being assembled .
The Town :Board will be considering approval of the project at
the January 8 , 1996 Meeting . After approval , the Town
Engineering staff will assist the Bolton Point staff in
construction administration . The commission approved the
project and authorized advertisement for bids after approval
by the municipal boards .
The Town Engineer is working with the Bolton Point staff to
develop the design for a new transmission water storage tank
at Burdick Hill Road . This additional tank is an element of
the SCLIWC capital plan and will provide needed additional
storage which will allow for energy savings due to off peak
pumping , sufficient reserve storage , and maintenance on the
existing steel tank . The cost of the improvement will be
covered by existing fund balance and will not require
borrowing .

ASSISTANT BUDGET OFFICER REPORT
FOR THE MONTH OF DECEMBER 1995
During the month of December much of our time was spent
preparing for the year end process . We have been reviewing
accounts for accuracy , making sure contracts have been fulfilled ,
researching outstanding purchase orders , reviewing reports and
statistics and more . Jackie has been gathering information for
accruing receivables and liabilities . Time was spent with JoAnn
working on the refundable review fees spread sheets . Getting this
information up to date , accurate , and ship shape was an enormous
challenge . JoAnn and I have worked well together and made
remarkable progress .
The Mortgage Tax revenue for the second half of 1995 was
$ 69 , 643 . 54 . This leaves us under budget in that line item over
$ 28 , 000 . 00 .
The ADF, Committee did not meet in December . We will resume
meeting in 1996 to continue to upgrade our hardware and perfect our
back up program . During the year we hope to increase our knowledge
of windows and networking in order to make a recommendation to the
Board late in the year .

ASSISTANT BUDGET OFFICER
1995 ANNUAL REPORT
In 1995 revenues were down slightly due mainly to a drop in
the Mortgage Tax . I spent a great deal of time throughout the year
managing the budget and keeping a close eye ( and purse string ) on
Town funds . My efforts were successful ; we were able to target
our funds on necessary projects as well as day to day needs and
still have healthy fund balances at year end .
I have been working with Computel , a utilities auditing firm .
They have spent months researching our telephone , electric , water ,
and telemetering services and looking for ways to save us money .
They have recommended some changes to our electric service . They
have discovered errors in tariffs and rate charges . So far they
have saved the Town almost $ 40 , 000 . 00 . They hope to conclude their
study shortly and I will be presenting a more detailed report in
the months to come .
Our interest income on investments has risen significantly
this year . I: have been doing some wise investing of Town monies in
higher yielding Repurchase Agreements and working on a more
detailed cash flow analysis . There is still a need to watch our
investments and continually change our strategies to keep up with
the new banking laws and our changing economy .
Some research has been done into electronic banking services .
Electronic Funds Transfer ( EFT ) and electronic bill payment plans
would be very helpful to the Town . While no decisions have been
made it will be wise to keep in touch with the bank
representatives . Their programs are constantly improving and the
services they offer could greatly lighten work loads .
Working with our independent auditors , I have put into action
a plan for auditing our Justices . Our independent auditors have
audited Judge Wallenbeck ' s and Judge Larkin ' s records through June
of this year . They will return in early 1996 to complete the audit
through December 1995 , In 1996 I will audit the Justices ' records
annually with the independent auditors returning every third year
or when a Justice leaves office . I am hoping this is the first
step of an internal auditing plan .
Although they have not been put into action yet , a five - year
budget and five - year capital plan have been developed . These plans
will make it easier for us to see into the future to cultivate
budgets and projects with low impact on the taxpayers . I would
like to continue to work on these plans and hopefully have them up
and running by mid 1996 .
Jackie White completed the basic Municipal Accounting course
offered by NYS Audit and Control and attended classes on
networking . She has come a long way this year understanding

municipal accounting and how our funds function . Jackie has taken
on several additional tasks this year including bond payments ,
Cornell sewer billing , Forest Home water billing , lighting bills ,
etc . This will be Jackie ' s second year end closing with the Town
of Ithaca . Her growth in understanding accruals and encumbrances
will allow her to provide more assistance in closing the books for
the fiscal year .
In addition to his regular duties , George Eberhardt has been
working on our fixed assets throughout the year , He has
established a data base program with all the pertinent data which
is continually updated during the year . In 1996 we have budgeted
for a fixed asset software program . This will be an immense help
in providing information on inventory , depreciation , replacement
plans and much more . I am hoping that George ' s duties will be
expanding in this area . George and I have been working together to
improve his purchasing skills . He is getting familiar with our
stock of supplies on hand and the fluxuation of it usage . George
searches catalogs for best prices , best quality , and best deals on
our office supplies . He is improving his understanding of
technical terms such as those needed in ordering supplies for
Highway and Water and Sewer departments . In the future I would
like George to hone his purchasing skills and perhaps develop an
inventory of office supplies to help eliminate shrinkage .
The Automatic Data Processing ( ADP ) Committee has had a busy
year . We worked to replace as many of the old 236 computers as
possible . We researched , recommended , purchased and licensed
standardized word processing and spreadsheet software for all
computers . Elimination of unlicensed programs is in the works .
There was a virus that infected all our machines . Mike quickly
" cured " them with Norton Anti - virus programs . We have initiated a
backup program that will be uniform throughout the offices and help
eliminate lost data . The Committee has begun to educate ourselves
in windows and networking . Members went to Bolton Point to see
( and admire ) the Windows for Workgroups used there . Larry Parlett
is an expert in this field and graciously explained how to set up
a system and how it works . In 1996 the Committee would like to be
able to make an recommendation to the Board on our system needs .

1995 ANNUAL REPORT
Town Clerk: Completion of the dog enumeration by the Tompkins County SPCA was
realized during the year. The final results of the enumeration are still pending , with
appearance tickets now being issued to those owners who have not licensed their
dogs . Preliminary findings indicate 837 unlicensed dogs have been counted . The
anticipated additional revenues from these new licenses will be approximately $5 , 022 .
The Town Clerk was a representative on the Cat Licensing Task Force formed by the
Tompkins County SPCA. The group was disbanded during the year when opposition to
the proposal of licensing cats became very strong . The SPCA still promotes the
licensing of cats as an approved method of deterring rabies .
A survey was conducted to determine the method of transportation used by residents
and customers when coming to the Town Hall . The results were as follows :

The Town Clerk attended many seminars during the year including the New York State
Association of Town Clerks annual meeting where she was honored to have been
nominated to receive the New York State Town Clerk of the Year Award . Mary Saxton ,
Deputy Town Clerk also attended the meeting and received her Notary Public license .
Attendance by the Town Clerk at two computer training sessions in Syracuse was
mandatory in order to receive a grant through the NYS Local Governments
Telecommunications Initiative Project . The Town Clerk' s computer is now linked to the
Internet and information can be received directly from many State agencies . The grant
provided $200 . 00 for the modem , upgrading of the computer, Internet software and 100
hours of free time on the Internet each month through June of 1996 .
Cornell University was the setting for the two day conference " Supervising and
Managing People", which was attended by the Town Clerk in September. The
conference was very helpful and provided many interesting concepts for dealing with
employees .
Two Newsletters were distributed to town residents in April and October . Articles were
submitted by town officials and all departments . A special thanks to Deputy Clerk ,
Betty Poole for her hard work editing and producing these newsletters .
_ Electors of the Town of Ithaca approved by referendum � a local law to allow not for profit
agencies to conduct bingo games in the town . The Town Clerk' s office has received
the licensing forms and will issue the bingo licenses upon application . No bingo
licenses were issued in 1995 .
A new election map was drawn in 1995 which included the Town Election Districts .
However, during the election process the map created confusion in two town districts
because the lines were drawn to accommodate the three districts needed for the
representatives on the Tompkins County Board . The Town Board may wish to review
the map with the Board of Elections before the next election to insure a clearly defined
map is available to voters .
The Historical Anniversary Celebration Committee met several times during 1995 .
They presented numerous ideas to the Town Board for the observance of the 175th
Anniversary. The suggestions included :
1 . Placement of permanent historical markers describing a specific person , place or
event throughout the town .
2 . Placement of permanent "welcome" signs at each entrance to the Town .
3 . Development of a pamphlet or brochure listing clues to historical areas so residents
may conduct self guided tours . The pamphlet would suggest ways of touring by
automobile , bicycle , or by hiking . Many educational and tourist pamphlets could be
developed throughout the year depicting different themes .
4. Conducting a contest , " How well do you know your town " ? Pictures from several
areas of the town would be taken and the place or object would be identified . .
5 . A time capsule containing several items of memorabilia could be placed at the
location of the new Town Hall , ( if the new building is a reality during 1996) .
During the budgE�t process , the Town Board unanimously decided to fund the historical
markers and "welcome" signs for 1996 . Money is also available to produce
informational pamphlets for distribution during the year.
Records Management : The town received its fourth grant of $5 , 371 from the NYS
Archives and Records Administration to conduct an archival indexing program .
Unfortunately, the program was not completed due to many technical computer
malfunctions during the year, including a computer virus
The Town Clerk worked with Suzanne Etherington , Certified Archivist throughout the
year transferring documents to her computer after correction of the technical problems .
Deputy Mary Saxton and the Town Clerk traveled to South Salina to review their
indexing system , and to learn methods which may be utilized in the towns program .
Ms . Etherington also provided training to the Town Clerk and Deputy Town Clerk , Mary
Saxton on the Word Perfect 6 . 0 for Windows . At present , the program is loaded on two
computers . Development and training continues with work progressing on the actual
index to be used . Deputy Mary Saxton is to be commended for her interest and
diligence in helping to develop and implement this program .
The Town Clerk had the pleasure of speaking at the annual conference of the NYS
Local Governments Records Association in June to explain our progress and problems
with the indexing program .
Funding to hire a transcriptionist in 1996 was approved during the budget process .
The person hired will be trained to transcribe the minutes of the Town Board , Planning
Board , Zoning Board of Appeals , and Conservation Board . After the minutes are
transcribed they will be indexed immediately for easy retrieval and reference .
In December, the Town Board considered a request by SARA asking that the Town
Clerk be allowed to provide records inventory training to staff at the Town of Caroline
staff during their inventory grant cycle . The Town Board unanimously enacted a
resolution allowing the Town Clerk to provide the training to promote Intermunicipal
cooperation .
Tax Collection : A total of $3 , 466 , 710 . 31 was collected on the Town of Ithaca Tax
Warrant in 1995 , (full financial report entered into the record June 1995 ) ,
The Receiver of Taxes , Deputy Receiver of Taxes , and the Town Supervisor attended
many meetings with representatives of Tompkins County during the year to negotiate
and discuss the Tompkins County Solid Waste Fee being added to the 1996 tax bills .
All towns within the County eventually banded together to dispute the addition of the
fee on the bills because of the questionable legality of doing so , and because it was
determined additional administrative expenses to town taxpayers would not be offset by
the benefits Tompkins County anticipated .
Tompkins County will more than likely address this issue in 1996 , and it will be
necessary for the Town Board and the Receiver of Taxes to investigate and negotiate
their proposal . It is hoped , that Tompkins County understands all towns expect to be
included in the decision making process early on , rather than after a determination has
been made .
Director of Administrative Services :
Accounting : Systems for more efficient recording of abstracts , vouchers and check
book registers have been implemented .
The independent auditors conducted an audit of the books of Town Justice , Merton
Wallenbeck and Town Justice , Clarence Larkin . Procedures have been put in place for
the Assistant Budget Officer to do an internal audit of these books on a yearly basis .
The independent auditors will perform this function every third year, or upon a change
in the office of the Town Justice .
Personnel : The -Mown of Ithaca officially reached certification under Civil Service on
August 8 , 1995 . An informational meeting was held with all employees to explain the
system and its effect on them . Unfortunately, several technical and professional
employees will , or have been required to take a civil service examination . The Town
Board presented many arguments to dispute this requirement , but were unsuccessful in
their attempt .
A new system was established to determine employee salaries and job classifications .
The system was developed by Personnel Committee Chair, Catherine Valentino to
more closely follow the salaries and classifications of Tompkins County.
The federally mandated Drug and Alcohol Testing Policy was reviewed and developed
for implementation in January 1996 . A Security and Safety Procedure Policy was
enacted for Town Hall , and new employee grievance procedures were put in place .
A review of the Blue Cross and Blue Shield policy determined double coverage was
being offered to retirees on the plan . The personnel office continues to review the
health policy to insure the best coverage possible for the fairest price possible .
I wish to thank the Town Board for their expression of faith in my abilities when they
approved the position of Town Clerk/Director of Administrative Services . The last six
months have very informative , interesting , and challenging . I have learned a great
deal .
I would like to offer a special thanks to my employees in the Town Clerk' s office ,
accounting office , and personnel office for their dedication and hard work during the
year. They strive each day to provide professional efficient service to all they deal with .

Hicrhway Superintendent ' s Report
It has been accomplished ! ! 1995 marks the year that Judd Falls
Road in Forest Home was rebuilt . ( Now we get to work on the
downstream Forest Home Bridge . ) This project has had years of
design and community debate before it was accomplished . The
lessons we learned from this process , and a few others we were
involved in , will help us in the future . It has already helped us
to better understand what we need to do to serve our taxpayers
better . It also helps us understand the hard choice we sometimes
need to make to keep our infrastructure in place and well
maintained .
The Highway/ Parks Department has need for more space for storing
equipment , MELintenance , and office space . In 1995 , we acquired a
building and land which helps to alleviate some of this problem .
There is still an ongoing need for space , and we will work toward
alleviating that need in the most cost effective manner possible .
The summer of 1995 was a good summer for us to get a lot of outside
work done . The lack of rain allowed us to plan work and accomplish
it without having to change plans . This year I tried to convince
our residents in our more residential areas that oil and stone
surface treatment was the way to go . Although , aesthetically it is
not as appealing as other surface treatments , it is the most
efficient and. cost effective way to provide preventive maintenance
to our road; . The outcome of this , however , is that in our
residential areas we will not use oil and stone in our pavement
preventive maintenance programs .
In 1995 we initiated some discussion with the Village of Cayuga
Heights on possible ways to consolidate some services . We think
there might be ways that we could work together to provide
efficient and more cost effective services to our taxpayers . We
hope to expand on these discussions in 1996 among ourselves and our
respective boards .
To continue our efforts to get a better focus on costs , etc . , the
Highway / Parks Department upgraded its computer capabilities in
several ways . In 1995 our Department purchased two new software
programs which allows us to " track " equipment maintenance , employee
times , complaints ( received from residents , etc . ) , sign
maintenance , road maintenance , and other programs that we have yet
to analyze . The names are Highwayman Helper and ZMap . To better
run ZMap , we upgraded our RAM capability from 4 MB to 12 MB . We
also purchased a laser print .
In 1995 , the Town has moved one step closer to having a
Comprehensive Traffic Plan in place . There will be more progress
in 1996 on this plan with the Town Planning Department , the
Highway/ Parks Department Annual Report Page 3
8 . Community Service Crews assisted parks on many occasions
collecting litter along bikeways and trails and trimming
brush .
9 . We put into service our new four wheel drive , one - ton dump
truck in August . Fitted with an eight foot plow and cinder
spreader , it will serve as the plow for quick response
situations , fire stations , and dead - ends .
10 . Parks mowed all water tanks and pump stations , and many sewer
line rights - of - way and water " T " main lines with the boom
mower . More frequent mowing and the removal of certain
obstacles will continue to improve the efficiency of this
task .
11 . Numerous landscape restorations were done as a result of water
and sewer line work and repairs .
12 . Some initial trail clearing and mowing at the
Tomlinson / Glendale Park site on Bostwick Road were done .

Metropolitan Planning Organization ( MPO ) , and many others working
towards this goal . The hoped - for outcome will be more efficient
movement of traffic ; cars , pedestrians , and bicycles , throughout
the Town , with as little impact as possible on our infrastructure
maintenance program and open spaces .
The Highway / Parks Department has continued to upgrade our operating
procedures . We continue to work on our training program which
include any updated training information . Team work is our end
goal , and we are working toward it . Gail Kroll , our Secretary ,
functions more as an Administrative Assistant . She has
consistently helped streamline the flow of information and deals
politely with the public . Gail always enhances the operation of
our Department and other departments that we work with .
Along with this , Gail and I have worked together with Tompkins
County , Sher-am DeSanto , and others to build a Drug and Alcohol
Testing program , which is mandated by the Federal Government .
Park and Open Space Manager ' s Report
Projects and Accomplishments :
16 South Hill Trail improvements : Installed six benches and
three map boxes . Over 1 , 000 maps have been distributed to
users of the trail thus far . Also , trail bed was topdressed
with sand to cover loose gravel in response to complaints .
2 . Christopher Circle Water Tank site was regraded , seeded , and
plantings added . More plantings will be added in 1996 .
3 . A major drainage improvement project at Northview Park was
completed . The entrance path was reworked to eliminate
flooding from an open ditch adjacent to the path .
4 . Our wildflower and bluebird nesting box programs were both
expanded .
S . All eight play structures were inspected . Minor repairs were
made , and all were sealed with preservative .
6 . East Ithaca Recreation Way from Maple Avenue to Game Farm Road
was resurfaced for the first time since it was originally
constructed in 1983 .
7 . Two summer youth workers were employed during July and August
through the job training program . They assisted parks staff
with regular grounds maintenance work .

ANNUAL REPORT FOR 1995
CORNELL SPECIAL LAND USE DISTRICT
A major accomplishment in 1995 was the adoption of the Cornell Special Land Use
District (SLUR) .for Precinct 7. Staff worked with a Town Board committee and
Cornell representatives in revising the draft SLUD legislation during 1995 . This work
also resulted in a side agreement with Cornell University regarding the development
of state and fedE!ral facilities in Precinct 7 and the establishment of the Town of
Ithaca / Cornell University Transportation Committee, which will study and make
recommendations on transportation issues related to Precinct 7 and surrounding
areas .
DEVELOPMENT REVIEW
A major portion of Planning Department time was spent in support of the activities
of the Planning Board in the review of subdivisions, site plans, special approvals,
recommendations to the Town Board, and other planning activities . A "Summary of
Town of Ithaca Planning Board Actions - 1995" is attached to this report. The
Planning Board approved a total of 49 actions during 1995, including 9 final
subdivision approvals, 14 final site plan approvals and 11 recommendations to the
Town Board ,
In 1995, the Planning Department received 43 development review applications
consisting of 25 site plan reviews, 12 subdivision reviews, 3 lot line modifications,
and 3 fill permits . A total of $3,843 . 00 was collected in non-refundable application
fees, and $16,516 .. 00 was collected in refundable review fees. No new escrow
accounts were established (an escrow account is set up when a review fee deposit for
a project excedes $1 ,000). Planning, engineering and legal time charged to these
projects totaled $16,344.50 (as of September 30, 1995) . There are 4 projects which
have outstanding balances. Payment has been requested from the applicants.
Significant Planning staff time was also spent on the following specific projects :
Ithacare DEIS and FEIS: The Ithacare Draft Environmental Impact Statement (DEIS)
was accepted by the Planning Board in June 1995 . Staff spent a significant amount of
time working with the appplicant on the preparation of the Final Environmental
Impact Statement (FEIS) . The FEIS was accepted as complete on December 19, 1995.
Staff is currently working on a draft of the Statement of Findings, which is expected
to be completed in January or February 1996,
EcoVillage SLUD : Staff worked with the Planning Board, Attorney for the Town and

First Residents' Group in completing the Special Land Use District (SLUR) for the
EcoVillage project on Mecklenburg Road . The SLUR was adopted by the Town
Board in January 1995 . Final subdivision and site plan approvals were granted by
the Planning Board at the June and July 1995 meetings.
PEZ Meetings : The Planning, Engineering, Zoning and Highway Departments
continued to meet in 1995 on a bi-weekly basis to coordinate development reviews
and compliance issues .
Zoning Board SEOR Reviews : The Planning Department staff prepared SEQR (State
Environmental Quality Review Act) reviews, including Environmental Assessment
Forms and staff recommendations on environmental impact) for the Zoning Board of
Appeals on area and use variances and special approvals.
Town Board SE )R Reviews : Staff prepared SEQR reviews for locals laws and other
Town Board actions .
CONSERVATION BOARD
The Planning Department provided staff regular support to the Conservation Board
during 1995 . ' Staff attended Conservation Board meetings and submitted quarterly
vouchers and reports to the State for reimbursement under the Local Environmental
Assistance Program (LEAP) . Funding for the LEAP has been discontinued for the
State' s 1995-96 fiscal year. Staff also provided support to the Environmental Review
Committee. In addition, progress was made on the following major initiatives in
cooperation with the Conservation Board.
Parks , Recreation. and Open Space Plan Update: Staff continued work with the Park
and Greenway Committee to update the 1977 and 1984 Park and Open Space Plans .
All draft chapter:; have been completed, includeing recommendations, cost estimates
and a 5 Year Capital Plan. A completed draft Plan is now being assembled, which
will be reviewed by the Park and Greenway Committee and the Public Works
Commitee, after which the Plan will be forwarded to the Town Board for
consideration.
Environmental Atlas : Staff continued efforts with the Environmental Atlas / GIS
Committee to advance the preparation of an Environmental Atlas for the Town of
Ithaca . The purpose is to assemble a single source of data on significant
environmental features in the town in digital format so that both maps and
information can be quickly accessed and overlaid for analysis . Preliminary base
maps for Unique Natural Areas and wetlands in the town were prepared. This will
be a continuing effort over the next several years, and will be integrated into a GIS
format as the Town develops a new GIS system.

PLANNING COMMITTEE
The Planning Department worked with the Planning Committee on a number of
initiatives which had been recommended as implementation measures in the Town of
Ithaca Comprehensive Plan (Sept. 12, 1993), including the following.
Six Mile Creek Conservation District: A proposed Conservation District for the Six
Mile Creek area has been drafted and revised several times during 1995 . A public
meeting was held with residents of the Six Mile Creek area to obtain input on the
proposed zoning district. A special joint meeting of the Planning Committee and
Codes and Ordinances Committee was held in December 1995 to work out details of
the proposed local law. Final revisions be made and public hearings will be held in
early 1996 .
Defining Buildable Land in Subdivisions : A draft amendment to the Subdivision
Regulations was prepared by the Planning Committee to clarify the procedure for
determining the location and number of dwelling units or lots in conventional and
clustered subdivisions. The proposal was forwarded to the Codes and Ordinances
Committee, and the Attorney for the Town is researching legal aspects of the
proposal.
Rural Residential District: The Planning Committee began an analysis of a possible
new 'Rural Residential" District. This would be comparable in format to the R-30
District, but would have a lower density and would be applied to areas not served
by or planned for public sewer or water. Work on this proposal will continue in
1996 .
CODES AND ORDINANCES COMMITTEE
The Planning Department assisted the Codes and Ordinances Committee with several
important initiatives in 1995 .
Fees in Lieu of Parkland : Staff worked with Codes and Ordinances on revising a
draft local law to establish fee amounts in lieu of parkland reservation for
subdivisions and multifamily developments. The Town Board adopted the new
local law in September 1995 .
Sunset Provisions, for Subdivision Approvals and Preliminary Site Plans : The Town
Board approved an amendment to the Subdivision Regulations to extinguish
abandoned subdivisions and a new local law to provide for expiration of preliminary
site plans if a final site plan is not submitted to the Planning Board within a certain
time limit.
Analysis of MR , Commercial , Industrial and Special Land Use Districts : At the
request of the Town Board, the Codes and Ordinances Committee undertook an
analysis of parcels where no development has occurred in the above-.referenced

zoning categories . Specific parcels were identified with relevant information on
ownership, acreage, development potential, surrounding zoning, etc.
Recommendations for rezoning certain of these parcels were made, and public
hearings are in the process of being scheduled at the Planning Board for
recommendations on the proposed rezonings .
Zoning Ordinance Revision: The Codes and Ordinances Committee initiated a
comprehensive review of the current Zoning Ordinance to determine where revisions
may be appropriate, especially in light of the Comprehensive Plan that was adopted
in 1993. This work will continue in 1996 and will include recommendations to the
Town Board for updates, clarifications, reorganization, and in some cases zoning
district changes . This work will be coordinated with the Planning Committee .
ITHACA-TOMPKINS COUNTY TRANSPORTATION COUNCIL (ITCTC)
The Town Planner serves on the ITCTC Planning Committee and attended bi-
monthly meetings in 1995 . The Town Planner served as liason to the Steering
Committee for the County Trail / Corridor Study, which was completed in draft in
December 1995 . Staff also participated in the Route 96 / Octopus Project Mitigation
Committee in the early part of 1995, which included discussions on detouring traffic
during construction, the need for dissemination of information to the public on the
status of construction, coordination between various agencies, and the role of public
transit and park- and-ride lots as possible mitigation measures .
OTHER PLANNING DEPARTMENT PROJECTS
The Planning Department worked on a number of other projects during 1995 .
Eastern Heights Park - Dedication of General Purpose Land as Parkland: The
Planning, Engineering and Parks Departments provided assistance to the Town Board
regarding the dedication of the General Purpose lands at Eastern Heights Park as
parkland . Research and maps were provided, and a site visit to the park was
conducted . The Town Board dedicated the General Purpose land as parkland in July
1995 .
Inlet Vallev Parkland: Staff assisted the Town Board with research and analysis of
several parcels in Inlet Valley that had been placed on the auction block by the
County. Research focused on the parcels' potential use as parkland. A Phase I
Environmental Site Assessment was conducted to determine whether there are any
known contamination problems with the parcels . Work will continue on this into
1996.
Affordable Housing Proposals: Staff spent considerable time during 1995 discussing
several proposed affordable housing proposals with the applicants regarding several
properties within the town. Two major project proposals may be forthcomimg
during 1996 .
Cayuga Lake Waterfront Planning: The Town has agreed to participate in a joint
program with the County, City of Ithaca, Chamber of Commerce and Cornell
University to enhance the Cayuga Lake waterfront. The County has successfully
obtained a grans: for this project. The project has been initiated and will continue in
1996.
Tompkins County Airport Master Plan U1date: The Town Planner served on the
Airport Land Use Committee and attended several meetings during 1995. Work
focused on an updated land use map of areas surrounding the Airport and an
analysis of anticipated / planned development in the area.
Geogjaphic Information System (GIS) : Staff conducted research and assembled
information of possible GIS software and hardware that could be obtained by the
Town. Funds were approved in the 1996 Budget to acquire and implement a GIS
system. This will probably begin in the 2nd Quarter of 1996 .
ISTEA Grant Api2lic� ations: Staff worked on two grant applications for ISTEA
enhancement funds for bicycle / pedestrian trails. One is a combined application with
the City of Ithaca for a trail linking the future Black Diamond Trail with Buttermilk
Falls State Park, with a bridge crossing Elmira Road on the new abutments. The
second invloves the William and Hannah Pew Trail in East Ithaca and a extension of
the East Ithaca Recreationway along Maple Avenue. Both projects have been
determined by the State to be eligible under ISTEA criteria. The applications will be
finalized in early 1996 .
