At a Special Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York held at the Town Hall , 126 East Seneca Street , Ithaca , New York there were present : PRESENT : John G . Call to Order_ The Supervisor called the meeting to order at 5 : 31 p . m . , and led the assemblage in the Pledge of Allegiance . Agenda Item No 3 - EXECUTIVE SESSION : Supervisor Whitcomb - The plan of action for this evening is to move into Executive Session and then tour the OBGYN Building . We will return to Town Hall at which point Mr . Douglas Look , Holt Architects , will brief the board on some of the strengths and weaknesses of the building . Motion made by Councilman Niklas , seconded by Councilman Klein to move in to Executive Session to discuss property acquisition . Carried unanimously . The Board began Executive Session at 5 : 32 p . m . Motion made by Councilman Niklas , seconded by Councilwoman Valentino to resume regular session . Carried unanimously . The Board resumed regular session at 6 : 50 p . m . Agenda Item No 4 - Consider Judd Falls Road Reconstruction Change Order : Supervisor Whitcomb - I received a call from Bruce Brittain last week informing me of a problem with the reconstruction of Judd Falls Road . His concern was regarding the curbing between the new construction and the jug handle . Councilwoman Harrison was excused at 7 : 00 p . m . STB MTG . 7 / 24 / 95 Mr . Noteboom - We received a call and it was indicated that we had talked about and promptly agreed to changing the curbing up to the jug handle . As we discussed it and with the realignment of the curbing , it appeared we could work out a compromise to readjust the curbing about: 138 ft . on the east side of Judd Falls Road and reset the granite curbing , moving it in approximate 1 ft . at the Forest Home end . They talked about possibly resetting some of the granite curb and putting concrete curbing in for the rest of it from the catch basin on down . Councilman Niklas - What is the cost ? Mr . Noteboom - We are talking about a cost of approximately $ 15 . 00 per linear foot to rest the granite curbing . At 138 ft . , it would be approximately $ 2 , 070 . 00 to reset the granite curbing . Councilwoman Grigorov - What is the problem with it now ? Mr . Noteboom - We agreed to narrow the alignment of that curbing . The affect of the old concrete curbing was narrower than the granite curbing is . It widens as one goes towards Cornell . Councilman Klein - Could Dan explain what is in the contract now ? Mr . Walker - What is in the contract now is to set the granite curbing where it is . The original road alignment was staying exactly as it. was with new concrete curbing in the other sections and the areas that had concrete curbing done and the granite curbing remaining where the existing granite curbing was . Supervisor Whitcomb - What is your recollection from the discussion we had , David ? Councilman Klein - My recollection was that if we were going to extend the concrete curbing gutter not as far as the jug handle but up to approximately the Forest Home side to a green sign . Mr . Walker - That is where the granite curb ends . Councilwoman Harrison - Could those in attendance tell us what the problem is ? Nancy Brcak , President of Forest Home Improvement Association The members here today affiliated with the Judd Falls Road Work Group members from Forest Home ; Bruce Brittain , William Goldsmith and Virginia Lance . Bruce and Bill would like to talk about the issue of certain specifics of the Judd Falls Road program . Councilman Niklas - But are you going to answer the question as to 2 STB MTG . 7 / 24 / 95 why you want the change ? Ms . Brcak - Yes . William Goldsmith - Since I live on Judd Falls Road I would like to say the day to day work has been fantastic . It has been friendly , communicatiorL has been clear , extremely accommodating and safe . Fred , as well as Chuck and Wayne have been tremendous . It has really been an exemplary project . Bruce Brittain - I suppose I am to discuss the problems . The problems are there have been several deviations from the agreement we originally agreed to . I would like to start with the curbing type . The workgroup had agreed to replace the curbing with new curbing that would match the original which is in the agreement memo . As indicated in the Town Board Minutes of the March 13 , 1995 , Dan told the Board the new curbing would be identical to the old . As it turns out , as I understand it: , the plans call for a much cheaper version of the concrete curbing . It would not have the turn ins at driveways , which we were expecting . It sort of the quick and dirty suburban strip development type of curbing rather than the quaint historic turn of the century type curbing . The second deviation Fred already discussed is the curbing between the jug handle and Forest Home . We had agreed we would run the concrete part way and then as Dan stated in the minutes it would be narrowed all the way to the jug handle . I do not really know where we left that issue . I know we discussed it some last week however Fred , Dan and' myself went out of town and I am not sure what the status is . Mr . Walker - I believe the discussion as I recall was we were talking about. running granite curb all the way down to the jug handle and then tapering the granite curb to a 20 ft . road width before we got to the concrete curb and gutter section . Mr . Brittain - The memo of understanding from the Judd Falls Road meeting does not . . . . Mr . Walker - we will do what ever you want as long as the board gives us the money . Mr . Brittain - The third deviation is the curbing on Forest Home Drive is different than the curbing on Judd Falls . The work group was to discuss the possibility of extending the new curbing on Forest Home Drive further down to toward the downstream bridge . There is maybe a 50 to 100 ft , section just to help delineate 3 STB MTG . 7 / 24 / 95 vehicle traffic from pedestrian traffic . The work group was going to discuss that further but have not . I assume everyone in the work group is at fault for not taking that further . We of the FHIA would like to see that continue another 150 to 200 ft . Councilman Ni. klas - But that is not a violation of the agreement . Mr . Brittain - It is not a violation but if it is going to be done this would be the easiest time to do it and this is the time to bring it up . William Gold :Dmith - I think it is in violation . The plans were given to the contractors and agreed upon without ever having discussed thaat . We were actually implored to stay involved in the plan making process and maybe we did not see the plans and check for particulars of this sort . Councilman Niklas - To say an agreement has been violated suggests an agreement has been reached and if you did not participate there was obviousl;ip no agreement . It would not be a violation of an agreement it is something you did not know about and now after the fact , you area not happy with it . Mr . Brittain - The next deviation is the utility pole at the foot of Judd Falls . The work group agreed to move the pole provided it could be done without damaging trees . As it turns out NYSEG ' s plans , which apparently town staff agreed to , were to remove 1 / 3 to 1 / 4 of the crown of one of the large maples on the corner . We did meet on site to discuss this and it looks as though there is no easy way around it . I am bothered that by removing 1 / 3 to 1 / 4 of the crown it was a violation of the " no significant damage clause . And the last deviation is the detour signage . We anticipated the County would take the lead on this as the bridge was to be closed and they were going to be the lead agency . As it turns out the bridge did not close ; the work group discussed and agreed to have the detour signs start out far enough to actually have meaningful detours . What we ended up with is people getting to Judd Falls Road only to find out it is closed and then stay within Forest Home . There is a tremendous amount of traffic which has shifted from one side of the community to the other . I do not think it is too late to revise the detour signs . Next week we will have a significant increase in people with the Empire State Games and I understand the project will not be completed by the time the students come back and again we will have an influx of people . What I would like to ask for is a renewed direction to the staff to keep the agreements we previously reached and to continue to pursue the unresolved issues such as the extension of the curbing . 4 STB MTG . 7 / 24 / 95 Councilman Niklas - Are we talking about 1 thru 5 , the entire contract or the reconstruction change order which is the agenda item ? Supervisor Whitcomb - We have two things to consider . One is if changes are to be made we need to approve a change order and amount and also we need to determine whether or not the agreement has been violated . If it has then we need to decide what to do about it . Ms . Brcak - I live on Forest Home Drive and have a sense of the increased traffic situation particularly by the upstream bridge . I did an informal traffic count and found the period from 6 : 00 a . m . to midnight there were approximately 11 , 000 cars that went through the area . It was the work group ' s impression detour signs and signage suggesting alternate routes at various places near Forest Home would be placed possibly in Cayuga Heights , at the intersection of Warren Road and Route 13 and on Cornell campus . It was our impression that signage would help to relieve some of the traffic in the Forest Home area . In fact the only signage which went up was signage directing traffic in to Forest Home . One is on the Cornell Campus near Judd Falls Road directing traffic to the right funneling the traffic through the Vet School area and down Caldwell Road . Another issue is the detour signage actually on Forest Home Drive points the traffic in to Forest Home rather than out or both ways . There is no signage where Pleasant Grove Road comes together with the other roads in the Village of Cayuga Heights . There is no signage on Warren Road and I thought Route 13 was to be a road which directs traffic north and south ; in and out of Ithaca . Route 13 would be a logical choice for a partial detour . Another possibility would be to get traffic in to Cornell , a detour sign taking you down Triphammer Road . When the Triphammer Road bridge was closed our bridges absorbed a great deal of that traffic . Thy children can ' t even play anymore and it is even difficult to pick up our mail . Councilwoman Valentino - How much longer are we going to be there ? Mr . Noteboom - The end of August . Supervisor Whitcomb - I would like to have Fred and Dan respond to each of the items and then the Board can reach a consensus on each of the items and make a decision and to direct staff . Mr . Noteboom - If my understanding is right on I am not sure what you want to do on curbing and was there some consensus on what you want to do with that particular change order ? Mr . Brittain - I am not sure where that stands at this point and what the options are that are available . 5 STB MTG , 7 / 24 / 95 Mr . Goldsmith - Let me explain what the physical options are . As it now stands the road is 21 ft , down below and 22 ft . above and wide to the first house then narrows . We had talked about narrowing to the jug handle . We discovered the contractors were beginning to lay back the base layer without having moved the curb . We called Fred , he came out , looked at the plans and said it was not in the plans to narrow the road in the upper portion . We said we wanted it narrowed and Fred ' s response was he would look and I had not heard what the resolution was on this as there were various costs . On the turn ins for the driveways , someone happened to say what the design is for the turn ins for the driveways and it is not the authentic historic design , just a dip . The third was an uncertainty about how the road is to go between Pete ' s house and the bridge , which was never resolved . These three things are not in the plans the way we had understood they would be . Councilwoman Grigorov - You want it narrowed so there would be a better walkway ? Mr . Goldsmith. - No . So it would slow the traffic . Mr . Brittain - It also provides more room for the walkway . It is a very narrow right of way , approximately 30 feet . Councilwoman Valentino - You would like it narrower than what it was originally ? Supervisor Whitcomb - My recollection from the work group was that we agreed to narrow it starting at the Forest Home line . Councilman Klein - That is what we had talked about . Mr . Walker - We can shift the granite curb from the Forest Home sign down to the concrete curb . Supervisor Whitcomb - I thought Fred had agreed to that last week . Mr . Noteboom - That is why I was asking what it was they really wanted so we could make a decision based on where we are at now . Mr . Walker - The side where it transitions in is on the east side . Councilman Niklas - I am still trying to understand 1 and 2 . Mr . Walker - The detail we have of the curb and gutter section , the contractor has presented a slip form proposal for the curb and gutter section . The primary curb and gutter section will be 6 STB MTG . 7 / 24 / 95 identical to what is there now , a 1611 gutter coming up to the curb . The DOT standards now for driveways is instead of making a gutter section , which was there in the past and approximately 2411 to 30 " wide , is to cut the curb off , leaving a small 111 reveal of curb across the gutter and then asphalt the driveway portion . Councilman Niklas - And this is what you are not happy with ? Ms . Brcak - What bothers me is that as a taxpayer , only about 15 % of the curbing was bad . Councilman Klein - We were going to replace it all . We were not going to reuse any of it . Ms . Brcak - I know that and I know that was the agreement however . . . Councilman Niklas - It would be good to focus on what is presented tonight . If the envelope expands then we are back to square one . Mr . Walker - The driveway treatment is the issue . Councilman Niklas - Is that a requirement by DOT or is it optional ? Mr . Walker - It is not a requirement . Councilman Klein - What is on the contract drawings ? Mr . Walker - The contract drawing showed a driveway gutter section on it with the concrete . We may have to cast that separately . Councilman Klein - If that is what the contract drawings show . . Mr . Walker - The contractor presented shop drawings and asked for a recommendation of slip forming all the way through for continued continuity on the curb with the standard detail driveway section . We would have the contractor put the gutter section in . Councilman Klein - I think that is what we should stick to . Councilman Niklas - The agreement regarding the transition would be at the catch basin or near the Forest Home sign . Is that still the case ? Mr . Goldsmith - There are two questions , one is the road width . We apparently agree it will be 21 ft . not 22 ft . , which is a change . Councilman Klein - Coming off the jug handle you have the granite and then as you get in to Judd Falls you have concrete curb . 7 STB MTG . 7 / 24 / 95 Mr . Goldsmith - They started to refill it without having narrowed it because the plans did not call for it . Councilman Klein - How are we going to do the transition with the granite curb against the gutter ? Mr . Noteboom - With concrete . Councilman Klein - So the granite curb and the concrete curb are in line . Mr . Walker - The transition would have been in the first 15ft . to 20ft . Mr . Goldsmith - There is still an undecided matter here which is how far up the concrete curb runs . We had understood , however clearly not :specified . Councilman Klein - Mutually it was agreed that the concrete gutter was to go to the sign and apparently the drawings did not reflect that . Mr . Noteboom - Right . That is what it appears like . Somehow through the process it was overlooked in the drawings . When we were in discussions we were trying to work out some sort of agreement as obviously we both overlooked it . We certainly want to accommodate both sides and I do not have a clear understanding of what that is at this point . Mr . Goldsmith - I think I can speak for the group and say it is fine with us if you run the concrete curb up to the sign on one side only and. leaving the other side as is . Mr . Noteboom - The sign or the catch basin ? Mr . Goldsmith - Preferably the catch basin but we received various estimates of the cost . To the sign . Councilman Niklas - Do we understand what narrowed slightly means ? Mr . Goldsmith - Yes , 1 foot . Supervisor Whitcomb - So what would the cost be ? Mr . Noteboom - $ 3 . 00 more per linear foot or approximately $ 2500 . 00 . This would be to put the concrete at 138 ft . The granite was $ 2 , 070 . 00 to reset it in a realigned position . So the total adjustment would be approximately an increase of $ 4 , 500 . 00 . 8 STB MTG , 7 / 24 / 95 Mr . Goldsmith - Our understanding in the original agreement was that both sides would be concrete all of the way up . Councilman Klein - Are you proposing that the road is not equal .) In other words one side would have granite and the other side would be concrete ? Mr . Noteboom - That is essentially what they are proposing . Mr . Goldsmith. - We would like concrete on both sides however that seems an unnecessary expenditure at this point . Councilman Klein - It seems strange to have granite on one side and concrete on the other . It seems you would want to balance it . Mr . Walker - We will make it uniform as it would not be good to have separate curbing . Councilman Klein - As far as you extend the concrete curb you should extend it on both sides of the road . Supervisor Whitcomb - Then you are talking about doubling the price unless you only go half as far . Councilwoman 'Valentino - He is right . It would look much better if it were the same . We could save some by shortening the distance . Mr . Walker - Nothing has been removed to this point . No curb has been removed except approximately 15 ft , where a water valve needed replacing . There was 150 ft , of curb removed over corrugated metal pipe . That is totally out of the area in question . What we are talking about now is f rom the concrete curb about 1 / 3 of the way back up to the jug handle . Councilman Klein - The contract drawings show the granite to remain in place and not to be moved at all . Mr . Walker - Yes , We have a price from the contract to do something that is not in the contract which basically is remove and rest the curb . That was $ 15 . 00 per linear ft , to do that . Now I think in the contract documents indicate our curb price is $ 13 . 20 per foot . We have latitude within the contract to extend it about 150 feet on each side without a great deal of difficulty which is less than 250 of 2200 linear feet . Removing the curb is the element we need to get a new price on . It would be approximately $ 18 . 00 per foot to put concrete curb in as opposed to $ 15 . 00 per foot to move the granite curb . If we were to do it on both sides , it would be approximately 270 feet . We could probably do this within the contract limitations without a change order although it would 9 STB MTG . 7 / 24 / 95 increase the contract cost by about $ 4 , 800 . 00 . Mr . Noteboom - That would be $ 4 , 800 . 00 to do both sides with concrete . Resolution No . 133 : Motion made by Councilman Niklas , seconded by Councilwoman Valentino approving the design change for the Judd Falls Road Reconstruction in an amount not to exceed $ 5 , 000 . 00 , as stipulated in the attached resolution . A vote on thek resolution resulted as follows : Supervisor Whitcomb , aye ; Councilwoman Valentino , aye ; Councilman Niklas , aye ; Councilman Klein , aye ; Councilwoman Grigorov , aye . Carried unanimously . Supervisor Whitcomb - What is the possibility of extending the curb to the downstream bridge ? Mr . Walker - Under this contract , it would not be possible due to the time frame and I do not want to put any additional load on the contractor . We do not have plans yet for the Forest Home Bridge replacement :; o I would not want to do any more work until we do receive them . We also need to get some land rights issues cleared if we are going to do anything in that area . Our plans currently show new curbing and new pavement for approximately 50 feet to the driveway of the house at 140 . Mr . Goldsmith. - Before we go on if we are going to wait until the bridge is done to do the rest , we will withdraw the complaint . Mr . Walker - As part of this contract we are going to place curb in from of the house at 136 . We are shifting the road slightly towards the bank due to the new catch basin and push the curb in the maintain the 21 foot width . Mr . Goldsmith - When work is done on the bridge could we consider our other concerns ? Mr . Walker - We will meet with the workgroup through the Public Works Committee as soon as we receive the plans for the bridge replacement and address the other concerns . Councilman Klein - That is exactly what we had discussed as we did not have the County ' s design . Councilman Niklas - You concern regarding the tree . Is the tree still there or is it gone ? 10 STB MTG . 7 / 24 / 95 Mr . Noteboom - The tree is still there however a substantial portion of the top has been removed by NYSE &G . They claim they spoke with the property owner prior . Mr . Walker - NYSEG cleared an existing power line along Forest Home Drive to meet. their standards . They contacted the landowner prior to cutting some limbs , etc . . . The tree lost its top about 2 or three years ago . The Town did not do this , NYSEG did it and they were out there today deciding on what to do and make a decision . Councilwoman Valentino - What is it you want us to do ? Mr . Brittain - It was my understanding through the workgroup it was possible to move the pole off the walkway without doing damage to surrounding trees . The agreement called for moving it without damage to the trees . What happened is NYSEG started cutting branches . Town personnel who were on site I thought at that point should have triggered a red light . They apparently thought it was not a violation of this agreement . Councilman Ni.klas - Was NYSEG pruning the tree due to the movement of the pole ? Mr . Goldsmith - No . Councilwoman Grigorov - So this is a completely different issue . Mr . Walker - NYSEG is in a situation they are very uncomfortable with . They do not meet safety standards at this point due to the trees growing in to their primary lines . They have hesitated to clear anything because of the problems which could occur . When they go to install or modify a line they must clear to the standards and. that is why they cleared on Forest Home Drive . Ms . Brcak - If we go back to the March meeting , my understanding of the conversation was Town staff specifically stated they had found a way to move the pole without damage to the greenery in the area . The Board did not explain what it was and I suppose we should have asked what that way was . Maybe this would be the moment to make that change with the other construction which is going on . We all have different opinions on what happened to the trees and I think the damage is pretty severe and I know what it looked like before the cutting began . It seems to me that was a violation of the agreement in March . Councilman Niklas - And what would you like us to do about it now ? Ms . Brcak - Well we can ' t put the trees back but I think what we it STB MTG . 7 / 24 / 95 are concerned about right now is when the pole goes up , NYSEG will be working there again and they will not take directions from the community but they will negotiate with the towns . What we are saying is what is done is done , the damage cannot be corrected . We want to make sure there will not be more damage of the kind which occurred last month when the pole is relocated . Mr . Walker - At this point , the only thing the Town can do is withdraw our request from NYSEG to move the pole . Ms . Brcak - What did you have in mind in March ? Mr . Walker - What I was thinking in March was that NYSEG would be putting the :lines and changing the pole in the opposite corner slightly and then going over the center of the road where they would minimize the cutting of limbs . Supervisor Whitcomb - Do you want the pole moved out of its present location or do you want the tree left alone ? Mr . Brittain - I guess go ahead and do it as there is no easy way out of it without doing some damage . My concern was that it is a violation of this agreement which we had reluctantly agreed to but we were not approached in that light of we can not do it without damaging the trees . We were not asked if we would still be willing if we have to take part of the tree down . Yes , we had reluctantly agreed but the issue is it was a violation of this agreement . Councilman Niklas - At this point we can say the violation is duly noted but what can we do . Mr . Noteboom - The signage can be corrected . We can put signs up however the signs were designed for Forest Home Bridge to be closed . Forest Home Drive itself is indeed not closed so we need to let them know that all we are pre - warning them about is Judd Falls Road will be closed . Councilman Niklas - The use of the detour sign is not clear . I do not think it is fair to prevent people from using the road . Councilwoman Valentino - We can place signs which will direct people two ways . We can do that . Mr . Goldsmith - The detour now says go across the other bridge . You could just as easily say go the other way . Councilman Niklas - Is the road workgroup still active ? Mr . Goldsmith - We have been . 12 STB MTG . 7 / 24 / 95 Councilwoman Valentino - There are some signs which we can place . Councilman Niklas - The Town Board should not try to decide what these signs :should be . The workgroup and Town staff should work together to cSee what the best solution is . Councilman Klein - There is a Public Works Committee meeting Thursday morning which would give us time the review the options available . Mr . Goldsmith - One more technical issue . If there is any possibility of not having Saturday work the residents on Judd Falls Road would appreciate it . There was a gas line torn up on Friday and there was a construction crew there for about 12 hours . Councilman Niklas - Is that Town of Ithaca work again ? Mr . Goldsmith - The construction crew you hired . I am not complaining . Mr . Walker - Our contractor in excavating the road base caught a service line . NYSEG came to repair it and had a difficult time locating where it was connected to the main . When they repaired it they needed it to conform to their standards and it took more time than anticipated . Councilman Niklas - How many times had construction occurred on Saturday mornings ? Mr . Goldsmith - Only once . I asked them why and they said they had another job in Elmira and we need to finish as soon as possible . Councilman Niklas - Apparently there were extenuating circumstances . Agenda Item No . 5 - Consider Tompkins County Solid Waste Fee Being Added to the 1996 Tax Bill : Supervisor Whitcomb - I would like some authorization from the board for Joa.nie and I to use our best judgement at the upcoming July 27th meeting with the County regarding the solid waste fee . Resolution No 134 : Motion made by Councilman Niklas , seconded by Councilwoman Grigorov authorizing and directing the Town Supervisor to exercise his authority and use his best judgement in making a determination as to whether the Town of Ithaca should or should not agree to enter into an agreement with Tompkins County to collect the Solid Waste Fee as part of the Town and County Tax bill beginning January 1 , 1996 . 13 STB MTG , 7 / 24 / 95 A vote on the resolution resulted as follows : Supervisor Whitcomb , aye ; Councilwoman Valentino , aye ; Councilman Niklas , aye ; Councilman Klein , aye ; Councilwoman Grigorov , aye . Carried unanimously . Acrenda Item No . 3 - EXECUTIVE SESSION - Building . Acquisition : Resolution No . 135 : Motion made by Councilman Niklas , seconded by Councilman Klein authorizing Hoffman , O ' Brien , Look , Taube and Chiang , P . 0 Architects , Planners , and Interior Designers to prepare a cost analysis and study of the building and property discussed in Executive Session to determine if it would meet the criteria for a new Town Hall as outlined in the Facility Needs Evaluation and that the cost to prepare the study shall not exceed $ 4 , 000 . 00 . L� '�2c �crrn� Joan Lent Noteboom , Town Clerk Special Town Board Meeting 7 / 24 / 95 Agenda Item No , 5 Solid Waste Fee on 1996 Tax Bill Resolution No . 134 WHEREAS , Tompkins County has requested that the Town of Ithaca enter into an agreement with them for the purpose of having the Town of Ithaca Receiver of Taxes collect the Tompkins County Solid Waste Fee as part of the 1996 Town and County Tax Bill ; and WHEREAS , a number of legal and administration issues have been brought forth at several meetings involving Town and County officials ; and WHEREAS , Beverly Livesay , Chair , Tompkins County Governmental Affairs Committee has called a meeting for July 27 , 1995 at 7 : 00 p . m . , in order that these issues may again be discussed and possibly resolved ; and WHEREAS , the Town Supervisor and Town Clerk will be attending the said meeting ; now therefore be it RESOLVED , the Town Supervisor is hereby authorized and directed to exercise his authority and use his best judgment in making a determination as to whether the Town of Ithaca should or should not agree to enter into an agreement with Tompkins County to collect the Solid Waste Fee as part of the Town and County Tax Bill beginning January 1 , 1996 .
