Agenda Item No . 3 - Executive Session :
Motion made by Councilwoman Valentino , seconded by Councilwoman
Grigorov to move into Executive Session to discuss possible land
acquisition . Carried Unanimously . The Board began the Executive
session at 5 : 31 p . m .
Motion made by Councilwoman Grigorov , seconded by Councilman Conley
to resume regular session . Carried Unanimously , The Board resumed
regular session at 6 : 00 p . m .
As a result of the Executive Session , the following resolution was
made :
Resolution Nc_ V 80 : Motion made by Councilman Niklas , seconded by
Councilwoman Valentino authorizing the Town Supervisor to retain
the services of Northeast Appraisals , Inc . to appraise two
properties referred to in Executive Session as possible Town Hall
acquisitions .
A vote on the resolution resulted as follows :

Agenda Item No , 4 : Report of Town Officials :
a . Town Supervisor - See attached . The Town received a letter
from Historic Ithaca acknowledging the Town of Ithaca for it ' s
involvement in the Inlet Valley Archeological Survey project for
excellence in planning . George Frantz will receive an award on
behalf of the Town of Ithaca at Historic Ithaca ' s Annual Meeting on
May 18 , 1995 at the Clinton House . ( A copy of the letter is
attached for the record )
b . Town Engineer - See attached .
C , Highway/ Parks Superintendent - See attached . There will be
some small regrading at the East Ithaca Recreation Way . There are
areas which have soft spots and they are starting to dip with
areas along the trail not draining properly .
d . Town Planner - See attached . Within the next couple of days
Ithacare should be informally submitting the Environmental Impact
Statement ( EIS ) for staff review . It should go to the Planning
Board soon after for a decision .

finished and the exit conference will be conducted on May 5 , 1995

Agenda Item No . 11 - Persons To Be Heard :
Jerry Weisburd , House Craft Builders , P . O . Box 640 , Ithaca , NY ,
regarding Agenda Item No . 19 - At the last meeting one of the
things asked was if the current plan and current fee schedule was
appropriate and if not what would be . I reference the
Comprehensive Plan which I have reviewed . The plan is interesting .
An assessment: was made of the amount of open space the Town has now
and according to national standards , falls within those guidelines .
We could safely say if we have enough now , we are looking at , in
terms of new development , and since new development means an
increase in population , new developments should share the burden in
creating new open space . What is the cost of creating the open
space ?

Next I reviewed the section of open space and set aside inventory .
There is a list of major open spaces and a summary of the smaller
open spaces . I am very familiar with the major open spaces . Of
the six that are listed , four came from developments that we
planned and built . Out of the eighteen or so that are on the map ,
we created six . What is wrong with the fee structure you have is
you accurately based it on the improved site costs . As stated last
time , for a :Large project , the amount of cash set aside could be as
high as $ 500 , 000 . I would propose instead you look at the amount
of land that has been set aside in the Town to date and say since
that is adequate , what was the cost to set aside ? In the case I
have been involved with you look at the set aside land , not land
you are going to bring power , water and sewer in to . Those are big
expensive items , especially in the Town . We are dealing with the
raw land cost . The way I would do it would be to say what is the
raw land cost , if that gives you enough open space now , you could
then determine how much was spent per person in the Town for open
space . When someone comes along with a new project and proposes an
increase of 300 people , you could say based on our past experience ,
per head , this is what it will cost to set aside new open space and
possibly put in a slight increase in value since land costs go up .
That would be a fair way to do it . The way it is now , up to $ 2800
is way out of line for what it costs . I did a rough calculation
and working backwards , means the amount of open space that has been
provided so far would have cost in the neighborhood of $ 8 . 5 million
dollars . We know that is not the case . I would strongly suggest
you base it on something down to earth in terms of actual costs to
set aside open space .
Supervisor Whitcomb : Did you make the calculation in terms of the
land you had set aside for open space ? How much did you spend ?
Mr . Weisburd - Yes , I did . Essentially , Commonland was in 1980 and
the entire parcel was $ 75 , 000 . Today , for instance , Ivar Jonson ' s
land , is probably in the neighborhood of $ 200 , 000 . If you are
talking about 10 % that is $ 20 , 000 whereas the maximum that could be
charged to him is $ 435 , 000 . This is where the disparity is . If it
is tied in to land costs , it would be more realistic and less
likely to be challenged by people who are looking at that kind of
bill when they go to develop .
Councilwoman Grigorov - Are you suggesting we base it on the
number of persons , 10 % of the actual cost of the raw land or
divided by the number of households ?
Mr . Weisburd - If you make an assessment of the land now and try
to get at what the land is worth to set aside . That would not be
hard to do . Then we have this many people in the Town and is
serving this many people , let ' s divide the cost by the number of
people and have a per head tax on new development equal to that ,

with some increase . Obviously , land increases every year . For
example , if you have a small subdivider who will be dividing 5 or
10 lots , it would not be practical for him/ her to set aside land .
You do not want 10 - of land set aside on a three lot subdivision .
What you are looking for is money instead of set aside . I don ' t
think many developers would have a problem with that . What is it
going to cost to buy raw land you are eventually going to set
aside.? What: is the proportion of the increase ? If the developer
is increasing the population of the Town by 12 or 15 people , that
should be the proportion of what they are paying and I believe that
is what the Supreme Court said is a fair way to assess that .
Councilman Klein - I still do not see how you get to the cost per
person .
Mr . Weisburd - Take an average family size and use 2 . 5 per
dwelling unit . If you are creating 10 dwelling units you are
creating a population increase of 25 as an average . Then say 25
represents the percentage of this figure we are going on .
Supervisor Whitcomb - The total acreage of the park land which has
been set aside in the Town already , establish a value of what it
would cost to buy that land today , and divide it by the number of
people that it serves .
Councilwoman Harrison - What confuses me about that is when you
count the amount of " parkland " are you counting Buttermilk Falls ,
etc . . ?
Mr . Weisburd - No . I would not count State or Cornell because the
Town is not involved in that .
Councilwoman Harrison - But that is necessary open space . If we
say we have sufficient open space in the Town to satisfy peoples ,
needs , it is certainly important open space .
Mr . Weisburd - Any amount of money that a developer puts in to the
Town is not going to go towards acquiring state land or Cornell
land .
Councilwoman Harrison - What I am saying is the calculation is how
many people or how much land and what is it worth today for
existing open space . How can we not count it in ?
Mr . Weisburd - What the Comprehensive Plan does is it assesses what
the Town s holdings are . That is where we are coming from and I
assume what you are collecting money for is for Town improvements .
k Supervisor Whitcomb - If we did not have Buttermilk Falls State
Park and some of the others , would we have an adequate amount of

park space to serve our residents ?
Councilwoman Grigorov - We can not really include them on an equal
basis as they are used by other municipalities .
Bruno Schickel , Dryden , NY , regarding Agenda Item No . 19 - I was
confused by something Jerry said as it was something that we had
not talked about before . I think what he is saying is the Town has
a very accurate basis to determine what it costs per acre of set
aside open space . Take the developments that have been done to
date , over the past 15 years , Deer Run for instance . He bought the
land for so many dollars per acre , set aside so many acres of land ,
servicing a number of people of the subdivision . Then take the
number of acres , times the number of dollars per acre he spent for
the land , divide it by the number of units it is serving , and you
have a calculation that is going to be pretty accurate . If you do
that in all of these 18 sites that have been done and set aside
around the Town and average it , you have created a very solid basis
on which to base what it actually costs . You are not theoretical
you are in to a reality situation . At that point , I would suggest
a flat fee and level across the board . The argument made last time
and would make again is it is unrealistic to say someone who lives
in a multi - family dwelling is going to have less need for park land
than one who lives in an R - 30 zone . To have a scale between $ 2800
down to $ 200 per unit , there is a built in inequity there . It is
not based on the reality of need .
Mr . Weisburd - The Comprehensive Plan states that the Town is
within range of the National Park and Recreation Association
standards for close - to - home space , the classification for Town -
owned parks .
Councilwoman Harrison - I thought the calculations included the
state parks , etc . . , that was my recollection .
Mr . Weisburd - It seems to be talking about Town - owned parks .
Councilwoman Harrison - I would certainly dispute the fact that if
we just looked at the Town - owned open space we would have enough
recreational space .
Supervisor Whitcomb - If you take the amount of park land set
aside within the last 15 years , divide it by the population served
by those parks , assuming they are neighborhood parks , to come up
with a per head figure .
Mr . Schickel - You would create a " payment in lieu of " for the
requirement .

Attorney Barney - What do you do for value though ? Obviously , as

Jerry pointed out , he paid x thousand dollars which is quite a bit
less than he would have to pay today to develop that same piece of
land . Some how or other there has got to be a mechanism for
reflecting what today Is value is not what the value was at the time
of purchase .
Mr . Schickel - My impression is that certainly within the last 5
or 6 years 1,rou have had some pretty dramatic drops in value of
property .
Councilman Niklas - Suppose we look at average sale value of
undeveloped land in a variety of districts currently zoned for the
last 10 years .
Mr . Schickel - I think you could arrive at that basis . Raw land
does not escalate that fast in value . The thing you have to be
careful of is if you include a small piece of land , say a farmer ,
in the Comprehensive Plan , they have farm land in the agriculture
districts at $ 10 , 000 per acre . I can guarantee you there is no way
a farmer is cooing to spend $ 10 , 000 per acre of land . That is the
place for a lot where the farmer that has some road frontage says
I ' ll carve off one lot and put a well and a septic on it . You can
not use the small pieces of property to create that value per acre .
Councilman N:iklas - In addition to saying we should take the
average sale price , for the last 10 years of undeveloped land in a
variety of districts , you are also suggesting they be of a certain
minimum size .
Mr . Schickel - I would keep 10 acres or something like that . What
will happen by doing that is in essence you will find there haven ' t
been that mar.Ly transactions to get a good estimate and probably
would be better to go back and use the past 15 years of open space
and use some sort of realistic inflation factor or something along
that line to get to your value . I think otherwise the " pool " would
be too small .- When you get in to the bigger lots , you get a truer
reflection , however when you get down to the small lots , it goes
out the window .
Acrenda Item NO . 12 - Town Justice Appointment :
Supervisor Whitcomb - Two applications were received for the
position . I would like to say that both candidates seem very well
qualified and we are fortunate to have that kind of interest . I
recall times when we ' ve had to go out and beat the bushes to get
someone with these qualifications . I am pleased that we are
attracting people of this caliber .
Councilman Conley - I know both of the people very well . One is a
lifelong friend and relative and the other is a friend I have had

for over 25 years .
Resolution No . 83 : Motion made by Councilman Conley , seconded by
Councilman Niklas appointing Raymond Bordoni to fill the vacancy
existing in the Office of Town Justice to become effective upon
said individual filing the required certificate from the Chief
Administrator of the Court . Term of office will expire on December
31 , 1995 .
A vote on the resolution resulted as follows :
Supervisor Whitcomb , aye ; Councilwoman Valentino , aye ; Councilman
Niklas , aye ; Councilwoman Grigorov , aye ; Councilwoman Harrison ,
aye ; Councilman Conley , aye ; Councilman Klein , aye . Motion carried
unanimously .
Mr . Bordoni I would like to extend my appreciation for your show
of confidence . I have been in and out of public service for the
last 20 or 30 years it seems like . I have enjoyed every bit of it .
Most recently I had been serving Governor Cuomo thus I was not
allowed to Nerve in any sort of elected or appointed position
because of conflict of interest laws . Some of you may remember I
used to be on the Town Board , but that was a short lived experience
as Governor Cuomo hired me and I had to relinquish my position on
the Town Board . This gives me an opportunity to reenter service to
my community and I am looking forward to it . I think it is going
to be exciting and challenging and I hope I can serve all of you
very well . Thank you .
Agenda Item No_ . 18 - Conservation Advisory Council Bylaws :
Supervisor Whitcomb - What prompted this item was a discussion at
a previous meeting about associate membership on boards and
committees . Janet Hawkes , Conservation Board Chair is here this
evening to make a statement .
Janet Hawkes - It came to my attention that there was a question
regarding associate members . It has not come up as an issue in my
short tenure as chair however I guess we have had associate members
before when it was the Conservation Advisory Council and with the
Conservation Board . I have had good experiences with associate
members as they were able to do some of the work we were not able
to do as members and bring additional expertise to our board . In
our initial bylaws , which in Local Law # 4 , allows the Conservation
Board to have its own bylaws , states the membership shall consist
of a minimum of three and a maximum of nine members and talks about
the terms of the members . The last statement being , " associate
members may be approved by a quorum of the Conservation Board but
do not have voting rights . " We have used them on committees ,
special projects , to help write reports , etc . . . This same

structure works very well elsewhere . Tompkins County Environmental
Management Council at this time has six or seven associate members .
This allows students and others who reside in the area who have an
interest but: do not have the time to commit , to work with the
board . The short history I do know is it was in the approved
bylaws as of: the 20th of February 1992 and re - approved when the
name changed to the Conservation Board on April 7 , 1994 . In both ,
there is a record of the bylaws of having associate members and
also we have had them with much success . Thank you .
Councilman Niklas - This has to do with Candace Cornell applying
for associate status . Our discussions focused on the Conservation
Board having access to her expertise regardless of what her status
was . We have no control if it is in your bylaws . You only need a
quorum to appoint an associate member .
Attorney Barney - I was not aware of these bylaws and I am not
sure the bylaws which the Conservation Board adopted were ever sent
to the Town Board for approval . Had I seen them , I would have
raised the :issue that there is no authority of law for the
appointment of associate members to any town body . The issue came
up when Candace was nominated and my position was where is the
authority ? So the fact the law was passed does not make any
reference to associate members .
Councilwoman Harrison - We are not being asked to officially
sanction this in any way .
Councilman Niklas - I am trying to get away from the issue of
Candace Cornell in particular . What I hear John Barney saying is
even though it is your prerogative to enact and enable your own
bylaws , they cant be in violation of the stated law . It would seem
appropriate then , to have the bylaws , as we currently understand
them to be , reviewed by the Town Attorney to make sure they are not
in conflict with the State Law . It would seem to me if they were ,
the bylaws would have to be changed .
Councilman Conley - This is informal . They are not asking us to
make any formal appointment .
Attorney Barney - State law spells out how members are to be
appointed and such members are appointed by this board . If some
one is being appointed as an associate member , what ever that is ,
it is this Board that must make the appointment . I do not have a
problem with someone attending meetings , ad hoc , giving you their
expertise or whatever they can . To denominate them as an
" associate member " is something that is not contemplated by state
laws for this body or any other municipal body .
Councilman Niklas - My point is not that we are aware of the fact

there is at least one case where the bylaws need to be modified , it
seems to me appropriate to review them all to ensure consistency .
Motion made by Councilman Niklas that the Town Attorney review the
bylaws to look for consistency with state law . Motion failed for
lack of a second .
Supervisor Whitcomb - I suggested to Janet perhaps they could find
some other designation for people of this status , i . e . friend of
the board , consultant , etc . . , rather than associate member .
Janet Hawkes - The reason they had associate members in the past
was because the Board was full . They met all of the requirements
for a full Board member however there were no vacancies .
Councilwoman Grigorov - In that case you are circumventing the law
by having more members than you are supposed to .
Councilman Klein - Is a non - voting member actually a member ? I
think you could argue that . If you don ' t have a vote then you are
not a member .
Councilwoman Klein - On page 4 , Section 6 of the Local Law it
specifically states that this Town Board should approve the bylaws
before they become effective . So we should certainly approve the
bylaws beforE! they become effective .
Supervisor Whitcomb - I don ' t believe the Town Board ever approved
the bylaws as they were internal proceedings . There was a big
debate as to whether they should be bylaws , procedures or whatever .
Those of us who thought they should be procedures lost and the
bylaws won . I don ' t think they were ever presented to the Town
Board for approval . I would suggest the Conservation Board revise
the bylaws to reflect a change regarding the " associate member "
status and provide me with a copy to be presented to the Town Board
at some future date .
Agenda Item No 5 - Ethics Disclosure Statements :
Supervisor Whitcomb - The Ethics Disclosure Statements are
available for public scrutiny in the Town Clerk ' s Office .
Agenda Item No 6 - Proclamation of Ithaca - Tompkins Trail Week :
Resolution No . 81 : Motion made by Councilwoman Valentino , seconded
by Councilman Niklas proclaiming the week of June 3 through June
10 , 1995 be celebrated as Ithaca - Tompkins County Trail Week .
Supervisor Whitcomb , aye ; Councilwoman Valentino , aye ; Councilman

Resolution No . 82 : Motion made by Councilman Niklas , seconded by

Agenda Item No . 8 - Report of Town Committees :
Councilwoman Harrison - We hopefully are coming to closure on the
GEIS . Cornell has been looking at parking requirements and have
been working on height issues as well . We have come to a pretty
good agreement . Hopefully it will be coming before this board
soon .
Supervisor Whitcomb - Will this be a public hearing type meeting
or have we already held the public hearing ?
Attorney Barney - If we are revising the SLUR , which I think we
are , then it will be a public hearing with the Planning Board ,
Councilman Klein - You all have a copy of the April 27 , 1995
Public Works Committee minutes and I would like to touch on a few
items . We do have a consent agenda item tonight to designate the
highway garage as an inspection station for Town vehicles . This
should save us time and eventually money . The Town mechanic does
an inspection before the vehicles go to be inspected regardless .
This procedure would eliminate the loss of time for two men to take
the vehicle to be inspected .
The Judd Falls project bids were reviewed and are on the agenda for
this evening to award the bid . It is hoped that the Judd Falls
Road Reconstruction will be finished before we begin the Forest
Home Bridge . This should help with the circulation in that area .
Mr . Walker - I had a meeting last friday with the newest string of
consultants that the County has hired . They are doing the final
design again . . Apparently one of the consultants did not want to
finish the job so they sub contracted out to another consultant .
This consultant decided to take a look at it before he finalized
his design . The consultant said he could have the final design done
within 2 1 / 2 weeks of having final determination regarding the
abutments , which should take approximately one to two weeks . This

means a June 1st final design and the County process would take
about one month . They might have a construction start date as
early as August .
Councilman Klein - The Highway Department has a manual on
maintenance of Town vehicles . The Highway Superintendent , Fred
Noteboom , has updated that manual and will be reviewed by the
Public Works Committee and ultimately to the personnel committee .
This is to ensure that Town employees , who have use of Town
vehicles , understand their responsibilities as far as preventive
maintenance on the vehicles .
Councilman Niklas - Codes and Ordinances Committee has been very
busy . We have accomplished a couple of the high priority items
this board had set for us , the Sunset Provision for subdivision
approval and fees in lieu of park land . We have also taken the
board ' s reconunendation regarding building heights and have a draft
piece of legislation which has been distributed to the Planning
Board and the Zoning Board of Appeals increasing building heights
as requested by the ZBA . We are in the process of making
suggestions to the Town Board about rezoning properties that were
zoned for specific site plan approvals which never came to
fruition . You will be getting those recommendations for your
suggestions and comments .
We are also reviewing the Zoning Ordinance and looking at the
possibility of some revisions to bring them in compliance with the
contents of planning documents . The Planning Committee will be
involved in the discussions and COC will be communicating with the
Town Board , soliciting your comments and suggestions .
Councilwoman 'Valentino - Jane Finlay of the City Cable Commission ,
sent a letter concerning the access archives . The resolution
passed by the Tompkins County Intermunicipal Cable Commission was
passed while I was on vacation . I would like to ask for some
direction regarding this if it should come up again . I thought it
unfortunate they took this on as their first issue . My real
interest was working on the joint franchises , That would have been
the appropriate thing for this commission to do to launch itself .
To pass this kind of a resolution , when it clearly has been the
City doing the research and background and it is the city cable
subscribers that pay for access , the rest of us are not . I was
hopeful we would be more in a mode of being cooperative and
supportive of their committee and their research and listening ,
instead of passing the resolution so soon . I don ' t feel it was
appropriate .
The County Cable Commission passed a resolution in favor of the
archives . The City is saying their research shows it is a
violation of the first amendment . At this point , the City is still

in the process of researching information . I would like some
direction in. the event this issue is raised again .
Attorney Barney - If it is a violation of the first amendment , to
have a tape recording made of what you say and then keep it for 30
days then but then there are some policy implications .
Councilman Klein - They mentioned keeping the archives to give to
the police department or whom ever .
Councilwoman Valentino - The District Attorney is monitoring them
at this point . For the County Cable Commission to pass a
resolution like this without having a committee to study or
research the issue , especially when it is in conflict with the City
Commission , IS inappropriate .
Supervisor Whitcomb - We concur with your opinion .
Agenda Item No 9 - Report of Tompkins County Board of
Representatives :
No report .
Supervisor Whitcomb - Often the representatives are not prepared
to speak about issues we address and many times it is just
perfunctory . They have asked that their agenda be included in your
board packets . If after your review there are issues or concerns
to be addressed , our representative would be notified to attend .
After some discussion , the Town Board requested a representative be
in attendance at every meeting . Councilman Klein stated that there
are three representatives , they could rotate , once every three
months . Supervisor Whitcomb will notify the representatives and
inform them we wish their attendance at every meeting .
Agenda Item No 10 - Review of Correspondence :
a . Ronald Anderson , Mayor Village of Cayuga Heights - Announcing
the appointment of the Cayuga Heights Representative to the Joint
Youth Commission .
b . New York State Town Clerks Association - Joan Noteboom was
nominated for Town Clerk of the Year . She was one of seventeen
nominees in the state . There are nine hundred Town Clerks in the
state and she was one of seventeen nominated . Unfortunately she
did not come in first however the Town is very proud she was
nominated .
Councilwoman Harrison - I was at an MPO meeting several months ago .
Having seen Cornell has put up signs in the roads saying

pedestrians have the right of way at crosswalks , which is state
law , I thought it interesting and was not aware it was a state law .
I had the opportunity to ask the regional director of DOT and
various other staff about the law . Cornell signs are a great first
step and I sent a note to Cornell suggesting they start enforcement
of the signs . I thought it might make sense for the municipalities
to put up some signs , especially in the Community Corners area of
Cayuga Heights . If the road is striped , it is a crosswalk , even
without the sign .
Mr . Noteboom - All of our crosswalks presently have signs posted
in conjunction with the road marking .
Councilman Niklas - Could one paint in the crosswalk " Pedestrians
have right of way " .
Councilwoman Harrison - Could you , for the next meeting , help us by
telling us what a crosswalk is , how does it have to be marked , and
any other requirements .
Mr . Noteboom - We will put this item on the Public Works agenda for
discussion and report back to this Board .
Councilwoman Harrison - I would also like us to consider whether
there are any other designated crosswalks in the Town we think
should be marked . I assume there is no way we can provide
enforcement of these as enforcement in the Town would be done by
the Tompkins; County Sheriff ' s Department . I would like the Town to
consider putting up some signs .
Councilman ]Viklas - The Cornell Safety Division is reluctant to
enforce this issue . We have checked into to this a number of times
in Forest Home with traffic , speed , and noise violations the case
is not whether they want to enforce it or not , it is in their
purview to enforce , period .
Mrs . Noteboom - Pictures will be taken at the June 12 , 1995 Town
Board Meeting . This will be for a portrait of the entire board .
We will be doing this as an annual project .

Councilwoman Valentino - My thought for your consideration would
be in the first paragraph : The Town of Ithaca is required to fill
positions in accordance with Tompkins County Civil Service .
Positions classified as competitive require testing and are filled
from a list: provided by the County . All other positions are
recruited directly by the Town . There is no testing but applicants
must meet the required skills as approved by Civil Service and the
Town . " That: spells out the one group which . requires testing and

status of their employees and whether they fall under some of our
rules and regulations regarding personnel .
Supervisor Whitcomb - That is a good question and perhaps we should
ask the auditors in the exit interview on Wednesday exactly what
component unit means in terms of their employment status .

Agenda Item No . 19 - Discuss Fee Schedule Related To " LOCAL LAW
AMENDING LOCAL LAW NO 10 / 1994f ESTABLISHING AMOUNTS TO BE PAID IN
LIEU OF OPEN SPACE RESERVATIONS IN ALL RESIDENTIAL DISTRICTS " •
Supervisor Whitcomb - Jon Kanter has reviewed the methodology
involved in arriving at the earlier numbers which were considered
at the last meeting .
Mr . Kanter - We tried to give a further breakdown of what the
original study included and tried to clarify what kinds of parcels
were being looked at . Previously , it was always a combination of
raw land anti improved land . We are defining raw land as over five
acres which doesn ' t have houses and no on site improvements , such
as water anti sewer . Improved land is defined as subdivided lots ,
sometimes with further subdivision potential which usually includes
roads and other infrastructures . There is a middle ground which is
a parcel that has accessibility to roads , water and sewer but not
on site . The mixing of the data which was in the original study
was caused by the data source which came from the County Assessment
Office . There was a fairly small sample of sales data for what was
being determined " raw " land . Most of those " raw " land parcels were
in the R - 30 district which is to be expected . Most of the
properties in the R - 15 and R - 9 districts have already become
accessible to sewer and water .
We also came across a number of corrections which I think the memo
clearly outlines . In some cases there were parcels which included
houses after we looked back in detail going through the assessment
roll . The way County Assessment clarifies their sales data
included parcels where houses were on the property and sold and
later removed or demolished . In other cases it was incorrect data .
There were some problems with some of the original data from the
County Assessment Office . There were a few cases where some
parcels were double counted in the study . We tried to eliminate
some of those errors in the data base . The " raw " land data , 13
parcels could be isolated as " raw " land within the R - 30 District .

It will be difficult to look at raw land values to get town wide
indications of value . There is not enough information in other
districts to do that . Looking at the 13 parcels in the R - 30 ,
average size! was about 43 acres , average value of $ 4 , 500 per acre
with most having potential to water and sewer hook - up .
Councilwoman Harrison - Does that include Eco - Village ?
Mr . Kanter - Eco - Village was one of the raw data parcels .
Councilwoman Grigorov - Did it include Auble ' s properties ?
Mr . Kanter - No .
Councilwoman. Harrison - Mr . Schickel ' s example was Commonland . If
they paid $ 1 , 000 per acre and it serves so many people and so many
acres were :yet aside , the math was calculated that way , based on
this particular development . Mr . Weisburd was trying to do
something with a more town wide look . I had a problem with that .
Supervisor Whitcomb - Mr . Schickel ' s made more sense , however I am
not sure from a practical stand point exactly how it works . The
difficulty would be in determining how many people are served by
the park . TY:Leoretically neighborhood parks serve neighborhoods but
that does not mean that people from outside the neighborhood do not
use them .
Councilman Niklas - It does not take in to accountgetting money in
to a fund to buy targeted lands to comply with the Town ' s
Comprehensive Plan for it ' s green space , parkland and open space .
The formula doe not take in to account the fact that some of these
properties are going to be very expensive to acquire .
Councilwoman Grigorov - That ' s not our aim though . The aim of
having fees in lieu of was not to acquire large amounts of money .
What we want to do is do something fair . One thing Jerry seemed to
be trying to get at was to base the value on what we take in the
future on what was taken in the past to be equal .
Attorney Barney - Each one of those subdivisions was treated
uniquely . For example when the dedication was set aside for
Commonland , I am sure the Planning Board considered it adjacent to
a fairly sizeable piece of land which is open space . They then
said we don ' t: need the 10 % , we only need 3o or 50 . I know that has
happened with a number of others .
Councilwoman Harrison - From a fairness point of view the issue
was taking fees that are equivalent to taking 10 % of the land as
the law says . The issue is how do you determine the value of that
land . At what level of improvement is it determined " raw land ?

My recommendation is to discuss at what level of improvement should
we be looking at when we try and value the land ? We need to come
up with a fee which is equivalent to 100 of the land . I believe
that is what John has done . He has not made a recommendation
considering R - 30 . You have made calculations and observations and
presented it to this Board for a policy call . What level of
improvement do we want to be looking at ?
Councilman Niklas - Why did the number go up for R - 30 . It went
from $ 1300 to $ 1500 ? If you remove the cost of the developed lots
from that average , why would it not go down . The new value is
higher than the old value .
Councilwoman. Harrison - The price per acre has gone down
dramatically . The new value is higher only if you take the house
lot . That is for an R - 30 as a " house lot " . That does not include
any raw land. .
Supervisor Whitcomb - The price per acre is higher in R - 15 but the
density is lower .
Mr . Kanter - The average value for R - 30 actually increased with the
new figure as the corrected figures eliminated some lots which had
houses on them which should not have been included . The values
would have been inflated per acre for those .
Supervisor Whitcomb - That should have made it go down .
Councilman Niklas - On the original fee schedule it had if projects
located on :resident district R - 30 the amount payable should be
$ 1300 per proposed dwelling unit . If you read the corrected fee it
is now $ 1500 . It would seem to me no matter what you do with those
numbers , the numbers should never go up , they should go down .
Councilwoman Harrison - I thought the $ 1300 figure included some
raw land and the $ 1500 does not .
Attorney Barney - The $ 1500 is the raw land . It doesn ' t mean they
were sold individually as lots .
Councilwoman Harrison - I thought " sold as house lot " meant there
were streets , water , sewer , a totally improved lot . Is that what
that means .
Supervisor Whitcomb - Perhaps there was an error in the earlier
calculation ?
Mr . Kanter - I think also it lumped together other parcels which
did not consider raw land and which may have had lower values .

Councilman Niklas - In every other case , the recalculated number
went down . I was merely questioning why in this one case it went
up .
Supervisor Whitcomb - Are we comfortable with the methodology the
Planning Department is using .
Councilwoman Grigorov - I am not exactly sure that it comes out to
something that seems logical . One could probably do it all
different ways .
Councilman [Viklas - I would like to ask a question regarding
Agricultural. Districts . The old and the new are still the same .
One of the people tonight did raise the issue that if you carve out
a piece of land that is out on a road it will sell higher ,
developed or undeveloped . I am not saying it isn ' t fair however we
should consider that as well . If I am looking at the Agricultural
District which has the lowest density per acre and we are scaling
R - 51 R - 9 , F' - 151 R - 301 I see a large difference in the Zoning
Districts and then the distribution of money . Here it is $ 700 for
agricultural district , then drops to $ 200 for R - 5 , then up to $ 600 ,
with the proposed change $ 646 for R - 9 .
Supervisor Whitcomb - Does that include agricultural land that was
sold as both operating farmland and as house lots or just
agricultural. land sold for housing purposes ?
Mr . Kanter - In actuality the agricultural , R - 5 and MR was based on
the assessed values as those had no sales information available .
Supervisor Whitcomb - Were the assessed values as agricultural
districts or true assessed values ?
Councilwoman Grigorov - If we use the assessed values in all of the
districts . . .
Councilwoman Harrison - How does the assessed value of the raw land
tend to compare with the sales figures ?
Mr . Kanter - They are generally based on the most recent sales
however that could have been a number of years ago .
Councilwoman Harrison - If one were to use the assessed value in
the R - 30 would it be different than the numbers based on the sales
value ?
Mr . Kanter - It would be different but hard to say whether it would
be higher or lower . It would depend .
Councilwoman Harrison - In terms of the calculations for the R - 30 ,

we have some numbers on the bottom of the first page , average price
per acre with water and sewer was $ 3398 per acre , average price per
acre of parcels without water and sewer was $ 2450 , those being raw
land parcels . What is the meaning on the second page where the
average price range for the R - 30 district is $ 2200 . Is that based
on more than one place , is it an average based on a single
development ?
Mr . Kanter - Are you talking about numbers 1 , 2 , and 3 ?
Councilwoman Harrison - Number 3 .
Mr , Kanter That is not looking at the raw land but the other
parcels which we had as a data base . Those are combinations of
individual lots , some with some further subdivision potential ,
others without any further subdivision potential , corrected to drop
those that did have a house which should not have been included in
the first place .
Councilwoman Harrison - Why is there an order of magnitude
difference in price between those sold as house lots versus two
parcels without water and sewer that were $ 2400 . That seems very
different . I had assumed that house lots meant they were improved
however you are saying that is not necessarily the case .
Mr . Kanter - They are either improved or accessible to water and
sewer .
Councilwoman Harrison - Even though on page 1 , with water and sewer
they were only $ 3400 , right ?
George Frantz - On page 2 , # 3 , that $ 22 , 400 per acre is the price
of the lot after the developer has spent $ 15 , 000 to $ 20 , 000 to
build the public road , public water and sewer .
Councilwoman Harrison - So that is not raw land but improved land .
Councilman Niklas - So that explains why all of the R - 30 ' s went up
instead of down .
Councilwoman Harrison - What the gentlemen were saying earlier was
that kind of a number leads you to the $ 1500 .
Councilman N_Lklas - That does not make any sense . At least in
terms of # 3 and # 4 , where we use the undeveloped numbers , we are
mixing apples, and oranges .
Supervisor Whitcomb - May I suggest then we concentrate on the
policy issue here as a board and refer it back to either the
Planning Committee or Codes and Ordinances to work on the details

and bring it. back to us .
Councilman Niklas - The numbers can be dealt with by staff ,
whether it is the Planning Committee or the COC . The policy issue
is , what formula do we use ?
Supervisor Whitcomb - Do you want to include any type of a plan , do
you want to include a cost per head ? What kind of instructions do
you want to give Planning in arriving at a formula ?
Councilwoman Valentino - What are we really trying to achieve ? We
are trying to look at a fair price to assess a developer so we can
take the money and buy land for parks . I see a 20 lot subdivision
and we want 100 . Is the amount we are asking them to pay realistic
for what thE! cost of land would be if there were a park there and
they gave us the land ? Some of these seem high . It seems that what
ever formula we look at we should think about the bottom line of
what we are trying to achieve . We want to be fair . Do we ever ask
anyone in agricultural districts to have a set aside ?
Councilwoman Harrison - If someone came in and sold their farm and
wanted to subdivide then yes .
Supervisor Whitcomb - But then it would probably be rezoned as
well .
Councilwoman Valentino - It would be rezoned a different zone . Then
you would have either an R - 30 or and R - 15 . We would asked for a
loo set aside based on the development not on the agricultural
land .
Attorney Barney - You could have a subdivision in an agricultural
zone . I do not recall it ever happening but it is possible .
Councilman Niklas - Why don ' t we ask for 10a of the purchase price
of the property ?
Councilwoman Harrison - Ism not sure that is right either .
Councilman Niklas - In the past we have said we want 100 of this
land . That would amount to approximately 10 % of what they paid to
buy that land .
Councilwoman. Harrison - That is not all we ask for is that correct ?
If we do ask for 10 % on the subdivision , you would have a road that
accesses that park , which does no good for the town , it does no
good to have a land locked parcel that has no access to people . It
does not seem to me legitimate to simply say you bought 100 acres ,
you bought it for an amount of money so now you owe us 100 of that
amount .

Councilman Niklas - The formula I would like to see is some
percentage of whatever the purchase price of that land is .
Councilman Klein - I think that makes sense . It will float in
fairness to where the land values are . I think what we have proven
tonight is it is very hard to draw averages .
Attorney Barney - What if someone were to come in and say I have
inherited some property from my grandmother or bought it for $ 100
per acre at the turn of the century , do I now have to pay my 100 ?
Councilman Gsrigorov - No . If it is inherited , it would be
inherited at: the current value of the land and would need to be
appraised . There should be a time limit on that .
Councilman x:lein - If you inherit property and you have an estate
tax your only going to sell it or develop it to pay the taxes . If
the land transaction is more than five or ten years old one would
need to get an appraisal .
Councilman Niklas - We could say X percentage of appraised value of
property .
Councilwoman. Harrison - Why not say on assessed value ?
Councilman Niklas - I bought my property for more than it is
assessed and. it would never sell for what it is assessed for .
Supervisor Whitcomb - Is the consensus then we send it back to the
Codes and Ordinance Committee to develop the language .
Councilman Niklas - Codes and Ordinances can develop the language
but we are talking policy .
Councilwoman. Harrison - It seems to me that there is general
agreement that it needs to be based on the value of the land in
some way . The term " value " of the land needs to be discussed
further . We could use appraised values , assessed values , the value
when the land was acquired , but that has to be adjusted to current
value . I think it should be at the current value of` the land , not
the value you purchased it at 10 years ago .
Councilman Niklas - Would 10 years be outrageous to be the cut off
point ?
Councilwoman Harrison - Yes . I think it should be current value .
Councilman Klein - In today ' s market , the value could be less ,
1 than it was 10 years ago .

Councilman Niklas - There is assessed , appraised , and sale price .
Councilwoman. Harrison - Are there any kind of adjustment figures
that exist for real estate ?
Supervisor Whitcomb - The factor is the equalization rate if you
are using assessed value .
Attorney Barney - At some point someone is going to have to make a
determination of the value . It is going to be this board , by law ,
that makes that determination . The purpose of this legislation was
eliminate the ad hoc basis of the determination for each
subdivision that is requested . We are trying to set up a semi -
uniform mechanism for proceeding . We might as well discard this all
together and simply say each time they come in we will present it
and allow you to make a determination .
Mr . Kanter - There is a real benefit to be able to use a set figure
per lot or a. way of gauging it . You know what the developer is
proposing and having a way of determining the dollar amount without
delay .
Councilman Niklas - So we say 100 of the assessed value of the
property , period .
Councilwoman Harrison - I am not happy with that from the point of
view that the assessed value has no improvements .
Councilman Niklas - So then say 120W or 15 The percentage can
correct it . The issue is " assessed value , sale price or present
value " . I would opt for assessed . It is a little higher than what
you buy it for .
Councilwoman Harrison - I would opt for assessed as it is there and
gets readjusted periodically .
Supervisor Whitcomb - What about the situation where a parcel is
partially developed and then changes hands . Then the new owner
brings it in for subdivision . How do you deduct the cost of the

mprovements ?
Mr . Frantz - One possible way of approaching this is the assessment
department keeps a record of land sales dating back three years .
That is where the data in the last paragraph of the first page ,
" actual sale prices " came from . Perhaps the Town Board could set
up the local law where by the Town Board could set the fee every
three years based on review of the sales for the previous three
years . At thELt point an average would be arrived at for parcels
over five acres . So every three years the fee could be adjusted but
would be set at an amount per lot for that three year period . That

would make it a lot easier .
Councilwoman Grigorov - Why would that be better than going with
the assessment ?
Supervisor Whitcomb - That way we would not consider every one
individually .
Mr . Frantz - Exactly . They are predictable fees .
Councilman Niklas - On the other hand the assessed value is very
easy to look up . My feeling at this point is we could gain or lose
a few dollars but in the long run would average out . I would like
to see something unequivocal , 121W to 150 of the assessed value and
that is it .
Councilwoman Harrison - How would you deal with the improvements ?
The assessed value would depend on the status of the improvements
of that particular parcel .
Councilman Niklas - Another policy issue .
Mrs . Noteboom - Your assessment is the value of the land and the
improvements .
Mr . Frantz - By using the assessment of an individual parcel each
time , values vary widely . I feel more comfortable using an average
of actual sales of 20 or 30 lots and apply it town wide .
Councilman Niklas - Why not use the sale price of the property , a
percentage of the sale price ?
Mr . Frantz - As John was saying , the property may have been in
someone ' s hands for 20 or 30 years .
Councilwoman Valentino - We could have the problem in the reverse
as well . If the value had changed over time and by using this
formula we went to buy the land , the reverse would affect us in the
value of that particular piece of property .
Mr . Frantz - If the Town Board adjusted or reviewed the rates on a
three year basis , we could avoid that scenario . If we set it now
and didn ' t look at it for another 10 years then what you are saying
could be a problem .
Councilman Niklas - This fee schedule would have to be re - evaluated
every so often to keep pace with however we calculate the fee
unless we build it in as the case with an assessed value .
.Councilwoman HarrIgon - One of the suggestions of the gentlemen who

spoke this evening was to apply a flat amount per dwelling unit
regardless of where it is located in the town . Is there anything
in the law that would drive up one or the other ?
Councilwoman. Grigorov - That would base it not on the land but the
number of people using the park .
Mr . Kanter - That is the more common method rather than breaking
it down by each zone . One would typically see a certain amount per
lot or dwelling unit . Usually when you see that they have not
based it on substantial numbers .
Councilman Nlklas - What if you took a weighted average of the data
you have ? You know the number of lots sold , their average price in
each of the zones , you weigh them against the surface of the Town
in those districts and arrive at an average number .
Mr . Kanter - Or the way Ellen has suggested . Some weighted
percentage to adjust for improvements which would be necessary .
Councilman Klein - Jerry talked about doing that and about the per
person cost of open space . If the average Town dwelling unit has ,
for instance , 2 . 5 persons per dwelling unit or what ever , then
maybe that is the fairest way of calculating , per dwelling unit .
Mrs . Noteboom - The Town parks are open to anybody , not just the
neighborhood people .
Councilwoman Grigorov - we are trying to get at what people paid
in the past by donating land . Did we used to waive the donation of
open space at times ?
Councilman Klein - On the smaller subdivisions right ? It has
basically been waived .
Attorney Barney - There are times it has either been waived or
minimized . There was one we recently looked at that has a fairly
small trail running through it but a good size subdivision .
Councilwoman Grigorov - At Chase Farm the developer built a trail
which met with the Towns approval . He did the improvement so
everyone was please with the outcome . That was not 100 of the
either .
Supervisor Whitcomb - Could we come to some kind of consensus to
give direction to the COC ?
Councilwoman Harrison - Do we think that it should be the same
amount of money per dwelling unit regardless of the location or
zone ? Do we think it should be as stipulated in the proposed

legislation we have tonight , a different amount of money depending
on what zone you are in ?
Supervisor Whitcomb - I think it should be uniform .
Councilwoman Harrison - Are we going to put a number in based on
the research which has been conducted by the Planning Department ?
Councilman Niklas - We could do a weighted average so it is a
uniform amount of money per dwelling unit . That is one approach .
If that is what you want the COC to do with Jon ' s numbers and some
math , we can arrive at something uniform . However , that is policy .
Is that what. you want ?
Councilwoman Valentino - That comes out fair .
Councilman Niklas - If that ' s what you want then that is what COC
will address; .
Supervisor Whitcomb - It seems as though it would. be less of a
problem rather than try and calculate the fee every time someone
comes in for a subdivision .
Councilwoman Harrison - So we are going to try to get a number that
is based on sales over the previous three years .
Councilman Niklas - Right . But it will be weighted for the surface
area .
Councilwoman Harrison - For instance if 50 % of the Town is R - 30 and
the average price of an R - 30 is x number of dollars then we would
weight the total average for the 50 % of the land coverage . It is
a simple equation to do provided I get the numbers from Jon . It is
just a weighted average .
Mr . Kanter - Are we using the raw land values or the overall
Councilwoman Harrison - Raw values . Then it needs to be adjusted in
some way .
Mr . Kanter - The raw value data we have is primarily from R - 30 and
does not get in to other zones and coverage .
Councilman Niklas - I will help out and say I believe you have
given the CO(. sufficient guidance .
Councilwoman Harrison - We would like you to come up with a number
if we take what Jon has to say there is no raw land to look at
except in R - 30 . What we will be looking at for value is somewhere
between $ 2500 and $ 3500 per acre , which in an R - 30 depends on

whether you do or do not have water and sewer . So we are looking
on the order of $ 500 or so per dwelling unit .
Councilwoman Grigorov - A year ago when the Planning Committee was
discussing the issue we thought it would be somewhere between $ 500
and $ 1500 per dwelling unit .
Councilman Niklas - If COC with staff after due deliberation came
up with a number somewhere between $ 500 , $ 600 somewhere within this
magnitude per dwelling unit then no one would be shocked or
surprised .
Councilman Klein - One other wrinkle . When a subdivider divides a
parcel of land , he does not know if there will be one or two
dwelling units on each building lot because of the Town ' s Zoning
Ordinance .
Supervisor Whitcomb - The fee is payable when the building permit
is secured and at that time will know the number of dwelling units
there will be .
Agenda Item No 22 - Awarding Bid for Reconstruction of Judd Falls
Road in Forest Home :
Mr . Walker - I would like to make two additions to the resolution .
On the first WHEREAS , the following should be added : As budgeted
for this prc)j ect in account DB5112 453 and the RESOLVED should
state that the project will be paid for from DB5112 . 453 and
DB5112 . 454 .
Mr . Walker - At the last meeting when the bidding was authorized we
also passed a resolution authorizing the Town to enter in to an
agreement with Cornell for them to pay their share . The agreement
has not been finalized to date as we were waiting for award of the
bid . The Supervisor will execute an agreement for them to pay
their share of the reconstruction before the contract is let .
Councilman Klein - Should there be a caveat in this resolution
stating as such .
Attorney Barney - There should be a further RESOLVED stating that
the contract shall not be let until the agreement with Cornell
University has been executed .
Ms . Alario - I understand this is going to come out of regular
improvements and it is over budget . Would you please join me in
finding money ?
Mr . Walker - Some of the money used will be CHIPS . All of the
CHIPS money will be used first .

Acrenda Item No . 24 - Consider the Location of Sanitary Sewer on
Foote Property to Serve The Town Of Dryden , Snyder Hill Sewer
District :
Mr . Walker - The Planning Board approved a two lot sub - division to
allow the Peregrine Partners to develop the project mostly in the
Town of Dryden but a small portion will eventually be located in
the Town of Ithaca . The Town of Dryden passed a resolution
approving the formation of a sewer district to cover the lands held
by Peregrine Partners only . The only parcel in that particular
sewer district is the largest which is being sub - divided . If lots
were developed in the Town of Ithaca the developer would complete
the infrastructure which would serve the individual lots . At this
point there are no individual lots , no infrastructure , particularly
the served lots in the Town of Ithaca although the alignment of the
sewer is such that it would be consistent with the potential sketch
plans the Planning Board reviewed . The Town has an agreement
drafted with the Town of Dryden , which has not been executed ,
stating they will pay the transportation costs to the Town of
Ithaca to cover a fair share of the operation and maintenance for
the transmission of sewage through our sewers . The Town of Dryden
is in the process of purchasing capacity from the Ithaca Area
Wastewater Treatment Plant to dispose of the sewage .

Ms . Alario - Is that going to be based on a per unit ?
Mr . Walker - It will be based on gallons . There will be a flow
meter . Initially , it may be installed here when there is no sewage
flowing in the Town of Ithaca sewer lines as it is easier to access
and monitor the flow . Every gallon of sewage that flows out of
Dryden will be measured and charged to the Town of Dryden .
Councilwoman Grigorov - What about when it goes through the City ?
Mr . Walker - Dryden is in the process of drafting their own
agreement with the City for transportation of sewage through the
City lines . The Town of Ithaca already has an agreement with the
City .

Attorney Barney - It would be appropriate to include in the
resolution that this be subject to the execution of the agreement
between the Town of Dryden and the City of Ithaca prior to any
sewerage being permitted to flow into the Town of Ithaca .
Councilwoman Valentino - Will there be any problem with the Town of
Ithaca losing any of it ' s capacity if this is approved ?
Mr . Walker - No . The agreement with Dryden does have clauses which
stipulate that if improvements are needed for future use they would
be allowed to discharge that sewerage in to the Town of Ithaca . If
the Peregrine Hollow Sewer District disbanded , it would require an
upgrade to a 10 " line . Dryden would have to make a decision as to
whether they would want to absorb the cost of the improvement . The
sewer district was created strictly to serve the Peregrine Hollow
Sub - Division . The load from that sub - division , based on the
Engineering report , will not exceed our capacity in our sewer
lines . If they expand their sewer district they could very well
put more through there than our lines could handle and at that time
they would be obligated make the necessary improvements .
Attorney Barney - Suppose someone develops something in the Town of
Ithaca , what effect would this have on any future developments in
that area ?
Mr . Walker - The Town of Ithaca still has enough capacity for the
units we have potentially in the Town of Ithaca unless a large
multiple residence was developed . If we took the general purpose
land and converted it to a high density retirement center . .
Councilman Ni. klas - That is not a trivial " if " though . In a sense

they are eating up our safety factor . There is a limited capacity
the line can run and they will be using up a certain percentage .
Suppose that did not exist . If the Town were to develop that area
would there :be enough capacity there for the Town ?
Mr . Walker - If the Town fully developed with the zoning which is
there now we would be using only about 500 of the capacity of that
line , Peregine Hollow would use approximately 100s to 1501 of the
capacity .
Attorney Barney - That is a problem we have the other way . We go
through the City . What do we try to incorporate in to the
agreement ? We have an arrangement with the City where we try and
factor in whiz) is causing the problem and who absorbs the cost of
the upgrade ?
Mr . Walker - The minimum size we build are 8 " lines , which is good
engineering practice . With that size it is easy to get in with
cleaning equipment and keep the flows open .
Supervisor Whitcomb - Under the current zoning it is more than
adequate but if it were upgraded to a multiple residence district
it would need to be considered during the approval process of the
particular project .
Councilwoman Harrison - At what point can we discuss the park issue
and Peregrine! Hollow using Ithaca facilities issue ?
Councilwoman Valentino - I think Ellen has raised a legitimate
point . Once live negotiate the water and sewer they will not care at
all about in lieu of or a park .
Councilwoman Grigorov - They did say something about helping with
the park .
Councilman Niklas - What do we want ?
Councilwoman Valentino What are the options we could ask for ?
They are not developing park land and there comment was they could
use Eastern Heights Park , which is a good size park . I don ' t have
a problem with the children using the park . The Town of Ithaca
however is paying the entire cost of maintaining the park . If they
want to use part of the park it seems there should be some
agreement with them providing for some of the cost of maintenance .
Supervisor Whitcomb - Mr . Varn , have there been any agreements
discussed with regard to the park ?
Ralph Varn - I don ' t think there have been any agreements but there
had been talk; that you and Jim Schug , Dryden Supervisor would

discuss it and there could be some charge levied on the Town of
Dryden to benefit the Town of Ithaca . There were thoughts when
Susan Beene3^ s was here that we would put in a back stop or
something however those thoughts have disintegrated . Now the
conversation has been on how much should the Town of Ithaca get
from the Town of Dryden as a fee ,
Councilwoman Grigorov - I don ' t think we are going to get anything
from the Town of Dryden .
Councilman Niklas - Do you want to add to the resolution that it is
contingent upon satisfactory negotiations with the Supervisor ' s of
the respective towns for park services ?
Councilwoman Harrison - I would not approve this resolution until
this is filled out .
Supervisor Whitcomb - The purpose of this resolution is to allow
the process to proceed to the next step which would be to get some
approvals from the County .
Mr . Varn - We! need this signature in order to get Jon Anderson to
sign off as the Health Department official . We are planning
construction in the next 2 or 3 weeks . We have two customers
signed and only doing the first 16 lots of the first 44 that are
approved .
Councilman Niklas - This is the last time the Town Board has any
leverage in these negotiations .
Councilwoman Harrison - I don ' t think we should pass the resolution
until this particular issue has been resolved . I want to deal with
the park issue . Our problem is to ensure the Town of Ithaca
citizens don ' t become burdened with providing services for the
residents of the Town of Dryden . There are ways where we can
accommodate sewage flows , agreements can get written and the same
thing should be true with the park . I don ' t believe it would be
wise of this :board to pass this resolution at this time without a
resolution of this issue .
Supervisor Whitcomb - Are there any other approvals required from
the Town in the future which would be a stopping point for this ?
Mr . Walker - This resolution is approving the location and the
construction . This is preliminary in that you are approving the
location . They have to build it to our specifications . When it is
completed I will make a recommendation to the Town Board to accept
this as a public utility .
isCouncilman Niklas - I am still hoping to compromise and I am

asking Supervisor Whitcomb if he would feel comfortable trying to
negotiate some kind of agreement between Dryden and the Town of
Ithaca in terms of subsidizing some of the park costs .
Supervisor Whitcomb - I would be happy to take on that task . I am
not sure what the outcome would be .
Councilman Niklas - We have in the past , authorized the Town
Supervisor to bring to a satisfactory closure these kinds of
discussions . If the Town Supervisor is not satisfied then the
agreement dojes not proceed . Subject to compliance by the developer
with all conditions and requirements that have been made or imposed
by the Town of Ithaca Planning Board and subject to the approval of
construction plans by the Town Engineer and John Barney has
added . . . .
Attorney Barney - And subject to the execution of agreements
acceptable to the Town Supervisor , Town Engineer and Town Attorney
providing for the payment of transmission of sewerage through the
Town sewer lines , such agreement to be executed prior to
construction of the lines . . .
Councilman N:iklas - And adding to that a portion of the operating
costs of this park .
Attorney Barney - What other parameters do you want in terms of
that agreement ?
Councilman N_Lklas - What percentage of the operating costs for the
park would be reasonable ?
Councilwoman Harrison - It is maintenance , upkeep , and the land
costs . It would seem that a one time payment equivalent to what I
am not sure. I would like to ask John Barney if the Town of Dryden
is not willing to support open space and recreational services for
their residents and not willing to enter in to such an agreement or
not one satisfactory to us , what happens ?
Attorney Barney - Is it required they get a permit from the Town
of Ithaca , in terms of construction , to put the line in the ground ?
Mr . Walker - They would possibly need a fill permit for the sewer .
We must keep in mind we presently have an agreement with the Town
of Dryden to transport sewerage . The Engineers report for this
agreement I speak of enclosed a copy of the resolution that Dryden
passed in the 70 ' s in the Sapsucker Woods area stating they would
pay a per unit charge of approximately $ 15 . 00 per unit . So the
precedent fox- the Town of Dryden sewer districts to be using the
Town of Ithaca sewers has been set . The Town of Dryden is a
partner with the Town of Ithaca and the City of Ithaca and the

Ithaca Area Wastewater Treatment Plant . The process of
intermunicipal cooperation regarding transmission of sewerage
through partner sewers has been set .
Attorney Barney - Once this resolution is adopted and if it was
stipulated with an expressed prohibition against construction until
the agreements are in place , we could perhaps get an injunction
preventing construction .
Councilman Klein - The last paragraph of the resolution refers to
the conditions and requirements that have been or may be imposed by
the Planning Board . I know this has been under review for some
time and the park issue was a concern with the Planning Board . How
did they resolve this ? It does seem late to ask the developer to
meet certain conditions we are just addressing tonight . I am not
comfortable with that . I am looking for justification for us to do
this if the Planning Board left it open .
Mr . Walker - The Planning Board approved a two lot sub - division
within the Town of Ithaca , on the Town line . There was concern
about creating a land locked parcel and a great deal of discussion .
Before any permits are issued for this area a road needs to be
completed which is acceptable to the Town of Ithaca . There is a
strip of land adjacent to the park which on the sub - division plat
shows as reserved for future parks , not dedicated to the Town at
this point . That met the requirements for this sub - division .
Councilman Klein - How did the Planning Board leave this issue ?
Clearly there! was discussion about transportation of sewerage and
there was a linkage .
Supervisor Whitcomb - Is it fair to hold the developer hostage ?
Councilwoman Harrison - Is it fair to burden the citizen ' s of the
Town of Ithaca with paying the maintenance costs on a park that is
being used by other residents . That is outrageous :
Mr . Kanter - The Environmental Impact Statement Review was
definitely the place where that occurred and transmitted to the
Town of Dryden with no real response to it .
Councilman Klein - If we raised the issue and it was ignored then
that is a different story . Our raising this tonight then is
justified . Our comments regarding the EIS should be referenced in
the amended re= solution .
. Councilman Conley - This resolution needs to be passed this
evening in order for the developer to begin construction . We have
authorized John to enter into negotiations . The Town Supervisor of
Dryden is on the other end of these negotiations . He will need to

go back to his board . What will it do to this resolution if
passed ?
Supervisor Whitcomb - We have a number of things we are negotiating
with the Supervisor of Dryden including the next item on the
agenda . It should all be part of the same discussion .
Councilman Conley - I just don ' t know if I want to be part of
something that is going to hold everything up . I am concerned
about the timing and due process of this .
Supervisor Whitcomb - If we were to approve this resolution this
evening as written , what would be your next step Ralph ?
Mr . Varn - I would need to go to the County for their approvals .
Jon Anderson has reviewed everything and he will approve the
drawing tomorrow if the application is signed by the Town Engineer .
I would like to suggest the Town Board make it contingent upon
reaching an agreement with the Town of Dryden in your sewage
transmission costs as well as the use of the park not based on
construction but on the sewer flowing . Then I can begin my
construction and help you to have these agreements signed by
putting pressure on the Town of Dryden .
Supervisor Whitcomb - That would also give us a bit more time to
work out the agreements .
Councilwoman Harrison - What is the reality that the valve would
not be opened ? I think that is totally unrealistic .
Councilman Conley - That is holding the Dryden Town Board members
hostage . If we approve the construction start - up and then we say
well you have built it but can ' t use it . . .
Attorney Barney - When the sewer moratorium was in effect in the
Village of Cayuga Heights subdivisions could be built with dry
sewers and they actually put the sewer in the ground . There was a
valve and you could not turn the sewer on allowing the sewerage to
flow . People were putting in septic tanks and Jon Anderson of the
Health Department , mandated there be public sewer available . It is
not unheard of and I assume we would control the valves on the Town
of Ithaca side of the line so it can be done . It is really this
board ' s call .
Supervisor Whitcomb - I would vote for the amended version Mr . Varn
suggested otherwise I would vote against it . He suggested that
this board instruct the Supervisor ' s of both Towns to enter into
negotiations however this town board reserves the right to approve
the operation of the sewers pending the outcome of the
negotiations .

Attorney Barney - You approve it conditional on reaching agreements
before any sewerage is allowed to flow .

RESOLVED , that the Town of Ithaca Town Board hereby accepts the
location of the proposed sanitary sewer , subject to compliance by
the developer with all conditions and requirements that have been
or may be imposed by the Planning Board , and subject to approval of
construction plans by the Town Engineer , and subject to the
execution of agreements acceptable to the Town Supervisor , Town
Engineer , and Town Attorney providing ( 1 ) for payment of
transmission _ of sewerage throughout the Towns lines . ( 2 )
satisfactory reimbursement to the Town for the ownership and
maintenance of the Eastern Heights Park , and ( 3 ) that such
agreements to be executed prior to any sewerage being permitted to

Mr . Walker - This agreement is modeled after the one we have with
the City of Ithaca . It covers operation , maintenance , cost and the
amount to be paid . We will monitor relative costs for maintenance
in that area and if we feel there is a problem there will be
provisions for annual or bi - annual reviews , although this is not in
the draft you have before you .

sewer use agreement with the Town of Dryden , after consultation
with and recommendation of the Town Engineer , and after review of

Agenda Item No . 26 - Town Board Site Visit to Eastern Heights
General Pur(:) se Land :
Supervisor Whitcomb - When we walked that particular area , it was
agreed it would be appropriate to add to the Eastern Heights Park
with the exception of the lower corner which was felt might be
needed to reserve a road for the future .
Councilwoman Valentino - We need to set a public hearing in order
to change thE� designation from general purpose to park land .
Attorney Barney - It may be done by resolution and subject to
permissive referendum . When you adopt it you have to notify the
adoption of it . We can tentatively set a public hearing and if it
is needed we can hold it at the next meeting . It may be a good
idea to hold one regardless to notify the public . I will draft the
proposed resolution and in particular we need a careful description
of the land which is to be converted . I would like to do that for
the next meeting to allow you to look at it and then set the public
hearing for the following meeting . There has been some talk that
rather than cooing with the circular turn around , which is fairly
large , it would be possible to do something else .
Supervisor Whitcomb - Attorney Barney will prepare a draft
resolution for the June meeting and then set the public hearing for
the July meeting . We do not need to take action on this at this
time .
Agenda Item No 27 - Park and Ride Lots Related to the State Route
96 Project :
Mr . Kanter - We have been participating with the Ithaca - Tompkins
Transportation Council on Route 96 / Octopus mitigation measures .
One of the things which has been discussed is the possibility of
park and ride lots to reduce traffic volumes through the Octopus
during construction . Discussions have also focused on the long term
benefits of park and ride lots in terms of the overall
transportation system . You have received a summary of the
Council ' s suggestions which were endorsed at the last
Transportation Council ' s Planning Committee meeting . Specific
sites located in the Town of Ithaca were suggested as possibilities
with some ball park cost estimates developed . I would like to
focus on what type of commitment the board would make in
participating in a park and ride lot . Funding is key and I spoke
with the Town of Ithaca Planning Committee and got some initial
feed back . Funds were not included for any park and ride lots as
a specific Route 96 mitigation measure by NYSDOT . We have also

found that transit funds to enhance transit routes needed to serve
these park and ride facilities is minimal in terms of state and
federal funding . We were provided with some basic estimates for
enhancing transit to serve several basic lots . That figure came to
approximately $ 57 , 000 per year just as a supplement to the existing
transit system . This is just for operational purposes and has
nothing to with the lots themselves .
What it all comes down to is the localities funding the operational
aspects in addition to the cost of acquiring and improving any
actual park and ride lots which might be added .
Supervisor Whitcomb - Has there been any suggestion of what the
split might be between the municipalities that are involved , the
City of Ithaca , Town of Ithaca and the County .
Mr . Kanter - The only conceptual support for funding voiced has
been from the City . This was expressed at the last transportation
council meeting . As to whether the County would be willing to
participate in the funding remains to be seen . While it has not
officially been addressed at the County Board level , indications
are it is not. likely there would be any significant County funding
forthcoming .
Councilwoman Harrison - The Planning Committee discussed a couple
of things one of which was that the buses are going to be delayed
just as much as anyone else . The only advantage to being on a bus
is less traffic .
Councilman Niklas - My experience has been you have a lot of people
leaving the City to go to the hospital area , people from west hill
bringing their children in to school , or going to Cornell as
employees .
Mr . Kanter - There are a fair number of commuters coming from
outlying areas as well .
Mrs . Noteboom - Why should we pay for them to be able to park then ?
Supervisor Whitcomb - Is there any kind of origin and destination
data available as to where people come from or are going ?
Councilwoman Harrison - One of the questions Steve Smith raised was
all of the park and ride lots on the map seem close together . By
the time you are that close you are not going to get out of your
car there .
Mr . Kanter - One thing we initially discussed was looking at the
possibility of other facilities further out existing park and

rides . The question would be are they at their capacity and could
they be added on to ? Also whether there are other types of
facilities that have some degree of excess parking that could be
temporarily used for park and rides .
Councilman Niklas - I was surprised that for the cost how few
parking spaces each of them would provide . Even if you built them
exactly where you wanted , they are not going to take the volume of
traffic with only 170 spaces . They become saturated .
Mr . Frantz - The traffic count through the Octopus is about 28 , 000
vehicles per day . If you look at it from the peak hours stand
point and take the rough rule of thumb of loo and the daily traffic
goes through at the peak hour then 2800 would be the number .
Mr . Kanter - We talked about this at the meetings and the consensus
was it would be a fairly low percentage reduction . The theory is
any reduction would be beneficial . Again you need a cost benefit
ratio of what. you are getting for what you are spending .
Councilman Niklas - Why don ' t we ask to be kept informed regarding
these discussions and with real numbers as to what the benefits
will be and actually know what percentage of traffic goes through
the Octopus at the critical hours .
Supervisor Whitcomb - A more effective way would be to keep one
person vehicles from going through the Octopus .
Councilwoman Valentino - One site they are looking at is by the
Hangar Theater . Are they aware of the conversations that have been
taking place with regard to moving some of the ball fields that are
in Cass Park in that area due to the light situation ?
Mr . Kanter - They actually received feed back from City Council on
certain portions of the parking in Cass Park which would be
untouchable as they are considered park areas . There is some
general purpose lands which could be used near there however . I
would like to see some conceptual support for the long range idea
of the park and ride as a regional transportation approach . There
needs to be a larger regional framework to establish this kind of
a system . Each municipality can not do this on its own . I tried
to get the Transportation Council to make a policy commitment other
than conceptual support for the idea and did not get any further
than the conceptual aspect .
Councilman Conley - Is the Town of Ulysses involved with this and
if so did they show enthusiasm enough to continue ?
Mr . Kanter - iVo . One County official was very enthusiastic and
supportive of the approach . Another County official who has a more

policy making position was very hesitant to be enthusiastic about
any funding coming from the County .
Councilman Conley - I think we should be willing to support
whatever other towns are willing to do . I can ' t see any reason for
us to be terribly enthusiastic without other towns participating .
I agree that alot of our people in the Town would use that mode of
transportation . A large part of it would be the Town of Ulysses and
beyond .
Mr . Frantz - The split at the hospital traffic light is
approximately 25 % to 30 % of the traffic on 96 between the City and
the hospital) turn off and go to the hospital and Biggs Complex .
The other 7090 to 7511 is City bound . One of the reasons this
discussion of park and ride started as part of the Octopus project
was to seize an opportunity to get people out of their cars and in
to buses in hopes those people would continue to do that even after
construction . One long term problem the Town of Ithaca will be
facing on Route 96 is continued increases in traffic . The traffic
on 96 right now is actually close to the 2010 design traffic volume
that was used to design the Octopus project . It is within 10 % to
15 % of that already .
Councilwoman Harrison - Conceptually it will promote getting people
out of their ears . It should be done in the context of county wide
involvement .
Supervisor Whitcomb - The consensus of the Board is to urge the MPO
to take a more regional approach . Conceptually we are in favor
however the cost sharing of the municipalities needs to be
addressed more .
Agenda Item No . 28 - Water and Sewer Benefit Reduction :
Item postponed at this time and will be addressed at a future
meeting .
Agenda Item No . 29 - Authorization to Negotiate the Proposed
Colle / Baldwin Bike Path on Pine Tree Road :
Mr . Frantz - What the Colles and Baldwins are proposing to offer
the Town is an easement that would run from either Snyder Hill Road
or Pine Tree and up along a boundary of their property and
behind the houses along Snyder Hill Road and then go south behind
the houses along Park Lane with access to Regency Lane . The Town ' s
road right - of -- way comes down to their property line at this time
with access to Park Lane via the existing Town owned right - of - way .
That is possible immediately upon acquisition of the easement . It
is possible to have the path go all the way to Tudor Park if we
could get easements from two property owners . Their houses are

located on Slaterville Road and we would need approximately 40 feet
of lots about 1000 feet deep .
Councilwoman Harrison - From there could the proposed bike path go
down to Route 79 by joining up to Park Lane ?
Mr . Frantz - Yes . A bicyclist who wants to get out of the
congested areas can come down Pine Tree Road and take the path
through Tudor Park . There is a proposed road as part of the
Frandsen Sub - division which is Edwin Drive . They are proposing
this as a park and open space dedication which would actually
provide a second entrance to Tudor Park . The path would come
through Tudor Park on to Edwin and then out to Route 79 .
Supervisor Whitcomb - How long is this trail ?
Mr . Frantz - Part of the section is approximately 1 / 2 mile to Tudor
Park . There are no cost estimates at this time to develop it .
Councilman Niklas - Is it walkable now just as a path or lane ?
Mr . Frantz - There is a different foot path that goes through . What
I would like to do is also look at the feasibility of extending or
including Honness Lane so that the path could connect to the East
Ithaca Recreation Way . Also there is a possibility of a path going
from Honness Lane across the Trinity Lutheran Church property to
Westview Lane which is the interior of the Grandview Subdivision .
That would provide access down to Grandview Park . The idea is to
create a network of paths with a walkway up to the existing Pine
Tree Road .
Councilwoman Harrison - What would need to be done on Honness Lane ?
Mr . Frantz - One of the ideas maybe simply to widen Honness Lane
to provide 4 ft , shoulders for bicyclists and add a sidewalk
perhaps along the north side . You would have bicyclists along the
shoulders of the road and the walkway for pedestrians .

TOWN BOARD . MEETING
DEVELOPMENT REVIEW
The Engineering Staff has been reviewing compliance on the
following projects that have received Planning Board approval and
are under construction :
Saponi Meadows Subdivision , Seven Mile Drive
The first: phase water and sewer mains have been installed and
receipt of test results and as - built drawings is pending .
NYSEG is completing installation of underground gas and
electric service . The developer is preparing to start work on
the road as soon as NYSEG completes utility installation .
Sanctuary Woods Subdivision , Sapsucker Woods Road
Record drawings and engineering certification by the
developers engineer of the water and sewer improvements have
not been delivered to the Town Engineer , and this information
is required prior to recommendation of acceptance of
utilities . A schedule for construction of the road has not
been received by the Town Engineer .
EARTH FILL PERMITS
Two inquiries regarding earth fill permits have been received
by the Town Engineer , initiated by contractors involved with
the two major state highway projects in the area . One request
involves a site at the intersection of Rte . 13 and Five Mile
Drive which is adjacent to the Rte . 13 bridge replacement
project . The second involves a site on Five Mile Drive with
the potential source of fill being the Rte . 96 Project . The
contractors have been given the site design requirements for
a fill permit and are in the process of preparing plans for
applications .
Cornell University is preparing an earth fill permit
application . for the restoration of the old land fill adjacent
to the Library Annex in the Orchards area . This site is above
the recreation way and Cascadilla Creek and may include some
work in wet land areas along with related stormwater
management improvements .
All three of the possible fill permit applications will
Probably exceed the threshold requiring Planning Board review
prior to Z13A approval .

WATER PROJECTS
The Troy Road and Coddington Road water extension project is
substantially complete . The Coddington Road Community Center
water service has been installed . Final restoration has been
started and should be complete by mid- May .
Three Town water storage tanks are scheduled for inspection
this month . The inspection includes draining the tank ,
entering the tank to inspect the internal coating system ,
operation of all valves and controls , inspection of the
cathodic protection system and inspection of the exterior
coating . The inspection reports will be the basis for
scheduled maintenance on the tanks . The current schedule
includes the Ridgecrest tank during the week of May 1 , the
Sapsucker- Woods tank the week of May 8 , and the Danby Road
tank the week of May 22 .
Survey work required for the evaluation of a proposed new
water tank on the East Hill will be completed this Spring and
early summer with the assistance of Cornell student interns .
The survey information will be utilized in developing a water
system model using the Cybernet computer program . A model for
the South Hill water system is currently being developed and
will be used to assist in system optimization and reviewing
the impacts of several development projects along Danby Road .
The Town Engineering staff is working with Bolton Point staff
to implement the master metering program for connections to
the water transmission main . The SCLIWC agreement includes a
provision that all connection points on the transmission main
to the member municipalities will be metered for the purposes
of monitoring water consumption . The Town has the
responsibility to construct the meter site and SCLIWC will
provide and maintain the meter . The Town Engineering staff is
preparing the plans and contract documents for all of the
master metering locations within the Bolton Point system , and
will assist the Bolton Point staff in construction
administration .
SEWER
The West Haven Road and Mecklenberg Road sewer extension is
substantially complete . The flow monitoring station has been
installed and is operational . The Contractor has started
final restoration and work should be completed by mid- May .
The Town Engineer is continuing to work with the City DPW on
a plan for improving the sewage transmission capacity that is
jointly used . One component of an improved sewer system is
being incorporated in the NYSDOT project for improvements on
the Meadow Street and Fulton Street . The city has begun
installation of sewer - improvements on the Inlet Island .

The Town and City have an agreement for transportation of Town
sewage through the City sewer system with a provision that the
Town pay a fair share of operations , maintenance and
improvement costs . The current agreement was established as
a two year agreement , and negotiations are underway for a long
term agreement . A major component of this agreement will be
the cost sharing basis for improvements to the jointly used
system .
The Northeast sewer system , which is served by the Village of
Cayuga Heights WWTP , is the subject of a significant
maintenance inventory program . The workplan includes clearing
rights - of - way , cleaning sewers and inspection with a
television camera that is being purchased by the SJS . The
inspection will result in a workplan for reducing infiltration
problems on the Town system to help relieve the wet weather
hydraulic load on the Cayuga Heights treatment plant .
The Town took delivery on the new Jet Rod in early april and
it was put to good use on a major grease blockage in the East
Hill Plaza area . The accumulation of grease which caused
sewers to back up in the commercial and office facilities on
Judd Falls Road was very extensive and took two days to
thoroughly clean up . The source of the grease apparently was
restaurants in the East Hill Plaza and the facility owner is
being billed for the cleanup .
PEREGRINE HOLLOW SEWER DISTRICT
The Town .Engineer has evaluated the Slaterville Road sewer
system and. has determined that available capacity is adequate
for the initial phase of the proposed Dryden Snyder Hill sewer
district . The Town Engineer has prepared a draft agreement to
allow the Town of Dryden to transport sewage through Town of
Ithaca sewer lines . My recommendation is to have the costs of
improvements required for the Dryden usage paid for by Dryden
and a maintenance surcharge to Dryden will also be set up . At
the present time the Dryden request to purchase IAWWTP
capacity for the extension of service is under consideration
by the SJS and the Dryden Town Board has passed a resolution
creating the Snyder Hill sewer district . This sewer district
consists only of property that is the Peregrine Hollow
subdivision . The developer is preparing construction drawings
for the connection to the Town Sewer . A part of the sewer
improvements will be in the Town of Ithaca and will be
dedicated to the Town upon completion . All flows will be
metered through a sewer monitoring station at or near the Town
line .

HIGHWAY AND PARKS
The Judd: Falls Road reconstruction project bids have been
received and the apparent low bidder is DeNinnis construction
of Binghamton . The Contractor ' s references have been checked
and the '.Town Engineer is making the recommendation for award
to this contractor .
The tentative construction schedule includes a start of work
date on or about May 30 , with a 4 to 6 week construction
period to substantial completion . Finalization of the
agreement. with Cornell for work on the Plantations Road
crossing is underway and should be signed by May 9 .
The Forest Home bridge project is behind schedule . Final
construction drawings were not available as of May 1 , 1995 and
a firm construction schedule has not been provided by the
County . It appears that a contract for construction may be
possible for June which would allow construction this Summer .
The Town Engineering staff has surveyed the road drainage at
the north end of Sapsucker woods Road after a request from a
landowner and the lab of Ornithology . A proposed ditch
profile and culvert replacement may serve to reduce drainage
problems that have affected several residents in the area .
Implementation of remedial measures will be a cooperative
effort between the Town of Ithaca Highway Department and the
Town of Dryden .
A topographic survey of the Maple Avenue Road right - of -way has
been completed by the Engineering Staff at the request of the
Highway and Parks Department and a plan map is being prepared .
The information will be the basis for safety improvements to
Maple Avenue and access improvements for the recreation way
which are in the planning stage . Cornell University is
preparing plans for improvements to the Maple Avenue parking
lot and provisions for a walkway along Maple Avenue are
included in their plans .
The portion of Elm Street Extension at the crossing of the Coy
Glen has been an area of concern for several years due to
unstable road banks and a sharp curve at the bottom of a steep
grade . The Engineering and Highway Departments are in the
process of developing an improvement plan for this area and
will be completing a topographic survey and plan map during
May . This information will be used to develop construction
plans and cost estimates for the safety improvements .

FACILITIES
The Town Engineer has continued to work with the Town Clerk ,
the Highway Superintendent and the Parks Manager on a
facilities improvement plan , which includes the Town Hall
facilities and the Highway and Parks Department needs .
The Engineering staff has been working with the Parks
Department and Building Department to develop a plan for the
parks shop and storage facility on Seven Mile Drive .
Construction of the renovations to the existing building will
be completed by Town staff this summer .
The Town Hall space analysis has been completed and a final
site selection process is underway .

Councilperson. Klein raised the question at a Public Works Committee
meeting about the feasibility of inspecting our , own vehicles . As
we looked into the matter , we found several good reasons to have
our own inspection station .
We presently have 30 vehicles and trailers that have to be
inspected once a year . The large trucks cost $ 20 each , one ton
trucks cost $ 15 each , and vehicle and trailers cost $ 10 each to
inspect . Last year these inspections cost the Town $ 385 . With the
growing fleet , it will cost more in the future .
Another factor that costs the Town is when we transport these
vehicles to the inspection stations . We need two people and a
second vehicle to drop off the vehicle to be inspected and the same
when we retrieve it .
The Town Mechanic , John Williams , is a certified mechanic as well
as r? e1•7 St = te certified inspector . He presently does a pre -
inspection on all our vehicles so that we don ' t have
any extra
charges when we send our vehicles to be inspected . The inspection
time is already invested in our pre - inspection so no extra time or
person power will be involved . We would , however , need some extra
equipment to accomplish the inspection . This equipment would cost
us about $ 400 .
The Town of Ithaca Highway / Parks Department will have to apply to
New York State for the inspection station license . They waive the
fee for this license and also _provide the inspection stickers at no
charge .

Highway Crew Supervisor ' s Monthly Report , April 1995
Town of Ithaca Town Board Meeting , May 8 , 1995
1 , During April , the Highway crews worked 249 . 5 hours on brush
and leaf pick - up , with 5 . 5 of those as overtime . This year it
took only three days to complete the town - wide pick - up .
2 . We had only one weekend that the crews had to plow snow from
the roads , This took 116 . 75 hours with 71 . 75 of those hours
as overtime . We used 33 tons of salt and 8 tons of sand . The
West and South Hill Fire Stations had to be salted two times
a piece .
For the 1. 994 - 95 Winter season , we plowed the South Hill Fire
Station 4 times and salted it 27 times . We plowed the West
Hill Fire Station 4 times and salted it 26 times .
3 . During April , the Highway crews worked 282 . 5 hours on

Permanent Improvement projects . Most of these hours were
spent putting in culvert pipes across Sandbank Road and re -
vel i rr� c 7 C � nnc rliinrry Road .
4 , The Highway crews helped clear a sewage blockage during April ,
which used 33 . 5 hours , of which 9 where overtime hours .
5 . Machinery maintenance consumed 200 . 5 hours of the crews time .
Several vehicles were repaired along with regular servicing of
vehicles . One truck had the " box " removed , sanded down , and
repainted as a preventive maintenance measure . This type of
work seems to allow for longer life of the box .
6 . The remainder of the crews time was spent on General Repairs .
This took 708 . 5 hours of time . Some of the General Repairs
projects include : continue cleaning out of ditches , continue
rebuilding shoulder machine , putting out voting machines , and
checking job sites .

Town of Ithaca Board Meeting , May 8 , 1995
1 . Lawn restorations at twenty - nine separate sites were
completed , requiring 164 hours .
2 . Parks staff contributed 86 hours to the Town ' s :Leaf and brush
pick - up which was completed in three days .
3 . Brush was cut along the Game Farm section of East Ithaca
Recreation Way in preparation for reconstruction of the trail
starting this July . A total of 16 hours was spent completing
the vegetation control .
4 . Six parr: benches were installed along South Hill Trail at
various scenic vantage points on the upper grade , totalling 32
hours .
5 . Miscellaneous workshop projects , totalling 42 hours , were
worked on during rainy weather .
6 . Routine maintenance tasks , totalling 254 hours , took up the
balance of April .

Town. Planner' s Report for May 8 1995 Town Board Meeting
DEVELOPMENT REVIEW
Planning staff has been working on the following projects under Planning Board
review jurisdiction.:
First Residents Group at EcoVillage, Mecklenburg Road
The Planning Board granted preliminary site plan approval for the proposed
EcoVillage CoHousing Cooperative at the April 18th meeting.
Candlelight Park Subdivision, Mecklenburg Road
Staff has been working with applicant on suggestions for cluster layout with
objective of preserving stream corridors, wetlands, and other open space on
site. After conducting a site visit with Planning Board, a second site visit was
organized for Conservation Board. A revised sketch plan should be submitted
to the Planning Board soon.
Ithacare Senior Living Center, Danby Road
Ithacare is in the final stages of completing the Draft Environmental Impact
Statement (DEIS) . Staff has had several discussions with Ithacare on the
preparation of the EIS. It should be ready soon for submittal to Town and
consideration. by Planning Board.
Cornell Campus Store, Precinct 7
Site plan approval (preliminary and final) was granted at 5 / 2 / 95 Planning
Board meeting, along with recommendation to ZBA on Special Approval for

mezzanine area, along with 700 sq. ft. addition to building.
Westwood Hills II Subdivision, Woolf Lane
Sketch plan for proposed 20 lot subdivision in R-15 District was considered by
Planning Board at the 5 / 2 / 95 meeting. This is a follow-up to the original
Westwood Hills subdivision that was approved in 1987.
Sunset Provision for Preliminary Site Plans: The Town Board enacted this local law at
the 4 / 10 / 95 meeting.
Analysis of MR , Commercial , Industrial and Special Land Use Districts: At the
request of the Town Board, the Codes and Ordinances Committee continues an
analysis of the above-referenced zoning districts where no development has occurred.
Specific parcels are! in the process of being identified with relevant information on
ownership, acreage, development potential, surrounding zoning, etc. The purpose of
the analysis is to identify whether rezonings of any of those properties would be
appropriate. The COC will continue consideration of this matter at their 5 / 3
meeting.
Ithaca-Tompkins County Transportation Council (ITCTC ): Staff has been attending
meetings dealing with Route 96 / Octopus Project mitigation. The option of park-and-
ride lots along Route 96, Route 89 and Route 13 are being considered to reduce the
number of vehicles at the Octopus during peak hours. The Town Board will be
asked to consider park-and-ride options at the 5 / 8 meeting (refer to material included
in packet) .
Parks , Recreation and Open Space Plan Update: Staff is in process of completing draft
Recommendations chapter. Final chapter on financial considerations and proposed
capital improvement plan should be underway soon. Also working on revisions to
earlier chapters. It is anticipated that a full draft will be presented to the
Conservation Board: at their late May or early June meeting, after which a citizen
group would be set up to review and provide individual comments on the draft plan.
At that point, it would also be sent to the Planning Board, Planning Committee and
Public Works Committee for recommendations .
Cornell GEIS / SLUD : Committee continues to discuss proposed Special Land Use
District (SLUR) and GEIS Findings and has prepared further revisions to the SLUD
and Supplemental Findings. Cornell is revising a proposed agreement on
establishing a Transportation Committee to follow up on recommended mitigating
measures and other transportation related issues . Committee will meet with Cornell
again on 5 / 12 / 95 to hopefully finalize the above documents so that they can be
brought back to the Town Board for action.

Defininz Buildable Land : Planning Committee is revisiting the question of how to
define "buildable land " in proposed subdivisions in order to determine number of
permitted lots / dwelling units and to provide better guidelines for lot/building layout
on a site .

Monthly Report - April 1995
Records Management : Progress on the indexing of minutes and local
laws continues at a slower pace than expected . A computer virus
was found on many of the machines in Town Hall , but thanks to Mike
Ocello the virus is under control and work can continue .
Suzanne Ether .ington , Certified Archivist is coordinating the method
of indexing and will be helping to train employees . A temporary
employee will be hired in the next few weeks with grant funds to
free time for Deputy Betty Poole and Deputy Mary Saxton to learn
the indexing program .
Town Clerk : Attendance at the New York State Town. Clerks
Association 13th Annual Meeting on April 23 - April 26 , proved to
be a rewarding experience for the Town Clerk , and Deputy Mary
Saxton . A special congratulations goes to Deputy Mary Saxton for
passing her Notary Public exam while at the conference .
Sessions were held regarding conservation license issuance and
reporting requirements , games of chance , vital records , legal
requirements for Town Clerks related to land use , tax collection ,
handicap parking permits , the Freedom of Information Law ,
successful grant writing , elections , and stress management .
A special thank you to the Town Board for approving attendance at
this educational and beneficial conference , and to Deputy Betty
Poole for a fine job maintaining the office during my absence .
The first meeting of the 175th Historical / Anniversary Celebration
Committee was held on April 21 . The meeting was very exciting
because of the enthusiasm of the committee members , and all the
wonderful ideas and suggestions brought forth .
Several suggestions included lectures on the Town ' s history , nature
walks , educational brochures , spelling bees , placement of
historical monuments , a road rally , and chicken barbecue . The most
popular method for celebrating was considered to be a series of
events throughout the year , with a one day festival of some sort
ending the celebration .
Research and solicitation of volunteers has begun and will continue
in the next . several weeks .
Tax Collection : The solid waste fee being added to the tax bill is
again being discussed at other meetings with the Town Supervisors .

I attended the 13th Annual New York State Town
Clerks Association Conference from April 23 through April
26 , 1995 at the Sheraton Syracuse Convention Center in
Liverpool .
On Sunday , I attended the Office of Notary Public
Instructional Class , which was very helpful in preparing
for the exam . I took the Notary Public exam on Tuesday
and passed .
Some of the seminars I attended were on Marriages ,
Parking Permits for the Disabled , Department of
Environmental Conservation , and Stress Management . The
seminars reviewed regulations and provided updated
information which will be helpful in dealing with
customers .
Attendance at the Conference was a great experience ,
and I thank the Town Board for the opportunity .

ASSISTANT BUDGET OFFICER REPORT

The accounting staff has worked very hard and succeeded in
bringing our records up to date since our audit was completed . Our
Annual Report and Component Unit Report have been completed and
shipped off to Albany . Now staff will be able to return to other
projects that are pending such as completing the procedures manual ,
updating fixed assets spread sheets and training and education .
Bolton Point used their new water billing program for our
first quarter 1995 billing . Much time was spent reviewing various
reports and working with the Bolton Point staff to catch and
correct some of the glitches in the program . Once the " bugs " are
worked out we expect this new program to supply us with reports and
account information that will greatly help Town staff .
New spread sheets were developed for tracking refundable
review fees . These will provide smoother transfer of information
and a better audit trail of services provided .
New spread sheets were also made for Street Opening Permits
( STOPS ) . I will be working with the Highway Department to refine
the set up and extraction of information .
The Finance Committee met on 05 / 08 / 95 to review vouchers and
the Monthly Financial Reports for February , March and . April .
The Automatic Data Processing ( ADP ) Committee met on April
11th . The main topic of discussion was the virus that infected
many of the Town ' s computers . Mike Ocello discovered the virus and
quickly took measures to resolve the situation . It took several
days to clean up all the computers . We are still cleaning up the
floppy disks , Other issue addressed included training , AutoCad
licensing , and Web - Net / IthacaNet .

PERSONNEL MANAGER ' S MONTHLY REPORT FOR

PERSONNEL CHANGES
Congratulations to JoAnn Cornish - Epps for successful completion
of the six - month probationary period as Planner II . JoAnn has
been recommended for regular appointment . Jeff Hulbert has been
recommended for appointment as a Laborer in the Highway
Department and began work on April 18 , The Town Hall and Highway
Garage will each employ Cornell CIVITAS students as well as
regular seasonal temporary workers for the summer .
FILE REORGANIZATION AND RECORDS MANAGEMENT
Recordkeeping of personnel files is serious business . Joy Daley ,
our new part - time secretary is getting acclimated to the Town ' s
personnel and insurance department and has begun the arduous task
of sorting through and reorganizing personnel and benefit files
for more efficient records retrieval and management . During this
process , Joy will work on the records management program .
CIVIL SERVICE JOB DESCRIPTIONS
Updating and formatting job descriptions in accordance with Civil
Service standards continues . The sub - committee will meet on May 5
and again near the end of May . Overtime exempt positions should
soon be complete .
INTERNAL CONTROLS TIGHTENED
Coordinating payroll processing and personnel , benefit and
insurance administration between the Town Hall , Highway and Parks
Facility , and SCLIWC has become a significant task . The Personnel
Manager has implemented department procedures that balance
figures more quickly and accurately , provide detailed information
up front from designated support staff , and improve input
accuracy . More work is still to be done over the coming months .
ANNUAL REVIEW PROCESS
Preparation for the annual performance review process has begun
and forms readied for distribution on May 1 . Two instructional
sessions will be held to aid employees in the completion of their
self - review forms . This year reviews may be completed on paper
forms or on computer disk .

the Ithaca - Tompkins county area is one of its most prized
resources ; and
WHEREAS , the development of trails , including greenways and
bikeways , provides recreational opportunities for residents and
visitors to the Ithaca - Tompkins county area to enjoy and appreciate
the immense beauty of the area ; and
WHEREAS , the utilization of trails for transportation purposes
provides other societal benefits such as enhanced health , reduced
consumption of fossil fuels and automobile traffic , and improved
air quality ; and
WHEREAS , the Tompkins County Coalition for Bicycle
Transportation and the Tompkins County Greenway Coalition have
joined forced in order to promote the trail development within the
Ithaca - Tompkins County Area ; now therefore be it

WHEREAS , a vacancy exists in the Office of Town Justice in the Town of Ithaca ,
County of Tompkins , because of the untimely death of Honorable Merton Wallenbeck ,

WHEREAS , pursuant to the power vested in the Town Board by Section 64 ,
Subdivision 5 of the Town Law, the Town Board desires to appoint an individual to fill
the vacancy created by Justice Wallenbeck' s death to serve as Town Justice through
December 31 , 1995 ; and
WHEREAS , the Town Board has reviewed a number of applicants for the position ,
and has made a decision as to the person that is to be appointed; now therefore be it

WHEREAS , the Highway/Parks Superintendent has recommended that Judd Falls
Road between Tower Road and Forest Home Drive be reconstructed to improve
drainage and replace deteriorated pavement ; and
WHEREAS , -the Town Engineer has prepared plans and specifications and a
construction schedule for the reconstruction at the direction of the Town Board ; and
WHEREAS , Cornell University will participate in the project with respect to repairs
to the Pipe Arch through which the Plantations Road passes ; and
WHEREAS , the Town Board authorized the advertisement for bid and the receipt
of bids for the Reconstruction of Judd Falls Road on March 13 , 1995 ; and
WHEREAS , the Town received bids for the reconstruction of Judd Falls Road on
April 14 , 1995 ; and
WHEREAS , the Town Engineer has reviewed the bids and qualifications of the
bidders and has recommended that the low bid of $233 , 000. 50 for the total project
which includes of a sub-total amount for base bid items of $ 183 , 470 . 00 plus a sub-
total amount for optional bid items of $49 , 530 . 50 made by , DeNinis Construction , Inc .
of Binghamton , New York is a qualified bid and that DeNinis Construction , Inc . , is a
qualified contractor ; now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca hereby authorized the
award of the contract for the Reconstruction of Judd Falls Road , to DeNinis
Construction , Inc . , for the base bid amount of $ 183 , 470 . 00 and the optional item bid
amount of $49 , 530 . 50. subject to final approval of the contract documents by the
Town Engineer and the Attorney for the Town ; and be it further
RESOLVED , payment of the contract for the said reconstruction , to DeNinis

WHEREAS , the Town of Ithaca Planning Board , on October 18 , 1994 , granted
Final Subdivision Approval for Town of Ithaca Tax Parcel No , 56-3- 14 . 2 , 20 . 01 +/-
acres total , into two (2 ) parcels , 11 . 35 +/- acres and 8. 65+/- acres , respectively, for the
purpose of allowing the completion of the proposed Peregrine Hollow Subdivision ,
Town of Dryden ; and
WHEREAS , the Town Board is considering entering into an agreement with the
Town of Dryden for the transportation of sanitary sewage ; and
WHEREAS , the proposed Subdivision Plat for Peregrine Hollow dated September
21 1989 , revised .June 26 , 1990 , revised June 6 , 1994 , revised June 27 , 1994 , and the
drawing entitled ° Sewer Location to Peregrine Hollow within Town of Ithaca " , dated
May 19 , 1994 , revised August 22 , 1994 , revised September 10 , 1994 , revised October
31 1994 , revised January 16 , 1995 , revised April 28 , 1995 , shows a proposed
sewermain ; and
WHEREAS , the Town Board on May 8 , 1995 has reviewed the location of the
proposed sanitary sewer; now therefore be it
RESOLVED , that the Town of Ithaca Town Board hereby accepts the location of
the proposed sanitary sewer , subject to compliance by the developer with all
conditions and requirements that have been or may be imposed by the Planning
Board , and subject to approval of construction plans by the Town Engineer, and
subject to the execution of agreements acceptable to the Town Supervisor, Town
Engineer, and Attorney for the Town providing ( 1 ) for payment of transmission of
sewerage through the Town ' s lines , (2 ) satisfactory reimbursement to the Town for the
ownership and maintenance of the Eastern Heights Park , and (3) that such
agreements to be executed prior to any sewerage being permitted to flow into Town
lines .

Authorization for Town Supervisor
To Sign Sewer Use Agreement with Town of Dryden
Regarding Transportation of Sanitary Sewage
Resolution No . 93
WHEREAS , the Town of Dryden has existing sewer districts and proposed sewer
districts that require the use of Town of Ithaca sanitary sewers to transport sanitary
sewage to the waste water treatment facilities ; and
WHEREAS , an agreement to describe provided services and related costs is
required to allow the transportation of Dryden Sewage through Town of Ithaca Sewers ;
and
WHEREAS , a draft agreement has been prepared and is under consideration by
both parties ; and
WHEREAS , the Town Board is willing to enter into an agreement with the Town of
Dryden for transportation of sanitary sewage ; now therefore be it
RESOLVED , the Town Board hereby authorized the Town Supervisor to execute a
sewer use agreement with the Town of Dryden , after consultation with , and
recommendation of the Town Engineer, and after review of the document by the
Attorney for the Town .

Authorization to
Proceed with Easement Negotiations and Preliminary Design
for Eastern Heights Bicycle/Pedestrian Path
Resolution No . 94
WHEREAS , an easement has been offered to the Town of Ithaca by Frank and
Blythe Baldwin , and Royal and Susanna Colle , landowners , for the purpose of
constructing a bicycle and pedestrian path over their properties from Pine Tree Road
to Regency Lane and Park Lane , and
WHEREAS , a bicycle and pedestrian path in the proposed location would serve as
a safe and convenient off- road connection between homes in the Eastern Heights
neighborhood and the existing Town network of walkways and bikeways in the area ,
and
WHEREAS , the location of the proposed bicycle and pedestrian path is
consistent with the 1975 and 1984 Park and Open Space Plans for the Town of
Ithaca , now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca authorizes staff to enter
negotiations for an easement for said path with the landowners , and to prepare
preliminary design plans for the proposed path .

BE IT RESOLVED , the Town Clerk is hereby authorized and directed to advertise
for a public hearing to be held at the regular meeting of the Town Board , on June 12 ,
1995 , at 6: 45 p . m . , so that the Town Board may consider enactment of, an ordinance
establishing requirements for a lock box to be installed on buildings containing fire
alarm systems interconnected with the Fire Department .
