Town Board Meeting
February 13 , 1995
At a regular meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York held at the Town Hall , 126 East Seneca
Street , Ithaca , New York there were present :
PRESENT : John G . Whitcomb , Supervisor ; Catherine Valentino ,
Councilwoman ; Karl Niklas , Councilman ; David Klein , Councilman ;

Call to Order : The Supervisor called the meeting to order at 5 : 30
p . m . , and led the assemblage in the Pledge of Allegiance .
Agenda Item No . 3 - Executive Session :
Motion made by Councilwoman Grigorov , seconded by Councilman Niklas
to move into Executive Session to discuss personnel issues ,
litigation , and acquisition of land . Motion carried unanimously .
The Board moved into Executive Session at 5 : 31 p . m . ( Realtors who
have submitted possible location sites for Town Hall , ( Agenda No .
24 ) have requested they be kept confidential . )
Motion made by Councilman Niklas , seconded by Councilwoman Grigorov
to return to open session . Motion carried unanimously . The Board
returned to regular session at 6 : 15 p . m .
As a result of the Executive Session the following resolutions were
made :
Resolution No . 24 : Motion made by Councilwoman Valentino , seconded
by Councilman Niklas approving the application of the 3 % cost of
living increase to the base salaries of Patricia Keller , John
Williams , George Eberhardt , and JoAnn Cornish - Epps in determining
their approved salaries upon successful completion of their
probationary periods .
Motion carried unanimously .
Resolution No , 25 : Motion made by Councilwoman Valentino , seconded
by Councilman Niklas to approve increasing Patricia Keller ' s annual
salary by a 3 % cost of living allowance , adjusting her current
salary to $ 25 , 720 . 00 annually , retroactive to January 5 , 1995 ,
charged to account B8010 . 100 .
Motion carried unanimously .
Resolution No . 26 : Motion made by Councilwoman Valentino , seconded
by Councilman Niklas appointing John Williams to the position of
regular full - time Highway Mechanic at an hourly salary of $ 11 . 85 ,
retroactive to January 11 , 1995 . Full benefits apply .
Motion carried unanimously .
Resolution No . 27 : Motion made by Councilwoman Valentino , seconded
by Councilman Niklas appointing George Eberhardt to the position of
regular full - time Account Clerk / Typist at an hourly salary of
$ 7 . 50 , retroactive to January 18 , 1995 . Full benefits apply .
Motion carried unanimously .
Agenda Item No . 4 - Reports of Town Officials :
a . Town Supervisor - ( Report attached . ) Beverly Livesay , Tompkins
County Board Representative hosted a meeting with several Town
Supervisors to discuss areas of mutual interest . The Towns
collecting the Annual Solid Waste Fee was discussed . The County
was sympathetic to the issues for collection of this fee such as
increasing staff , accounting time , and other related problems . The
County will hold a meeting with Town Supervisors and Town Clerks to
negotiate the issues . The Town needs to establish estimates of
what it would cost to collect this fee . The County hopes to save
$ 20 , 000 , the Towns could spend that much if each Receiver of Taxes
were to collect the fee . The County believes they have solved the
legal issue .
The Supervisor appointed Councilman Klein to act as Interim Deputy
Town Supervisor during his and the Deputy Supervisor ' s absence
February 19 , through February 22 .
b . Town Engineer - ( Report attached . ) A formal request from the
Town of Dryden has been made to consider transporting sewage from
Dryden through a sewer district being formed at Perigrine Hollow ,
through the Town of Ithaca sewers to the Wastewater Treatment
Plant . The Town of Dryden is pursuing purchasing more treatment
capacity at the plant . The Public Works Committee will address
this at their 2 / 23 meeting , and make a recommendation to the Town
Board at the March meeting .
Supervisor Whitcomb - Mr . Varn and the Dryden Supervisor Schrug are
anxious to resolve this issue . Supervisor Schrug has come forth
with a request to the Sewer Joint Subcommittee for additional sewer
capacity .

Councilwoman Grigorov - Are there any significant advantages or
disadvantages to this proposal ?
Mr . Walker - The Town of Dryden is asking to enter into an
agreement with the Town of Ithaca to allow their sewerage to be
transported through Ithaca lines . Minor costs will have to be
negotiated based upon the volume of usage related to the
maintenance costs .
Councilwoman Grigorov - What about future capacity problems ?
Mr . Walker - It will be considered whether the Town sewer needs to
be made larger to handle the additional flow , and whether the City
sewer needs to be made larger . There are already problems in the
City . Dryden has the right as a co - signer in the Wastewater
Treatment Plant project to purchase additional capacity from the
other owners . The SJS will evaluate all these issues , and the Town
of Ithaca will have input . The basis of the agreement is so the
Town of Ithaca capacity will not be diminished by Dryden ' s request .
Councilwoman Harrison - The Town of Ithaca ' s future capacity would
be diminished , so it will be necessary to review the potential
growth .
Mr . Walker - Perigrine Hollow is within the " planning area " , and
the Town of Dryden can petition for expanded capacity to serve that
area . The SJS is in the process of rewriting the agreement to deal
with issues regarding the " planning area " , and future expansion .

Councilman Niklas - Attorney Barney should speak about the Town ' s
obligation to approve this request versus what may be the options .
Councilwoman Valentino - Are any of the proposed sewer lines
expected to be run through the Town of Ithaca park or general
purpose land ? If the General Purpose Land were changed to park
land would it harder to obtain easements for utilities ?
Mr . Walker - The sewer lines would not go through that area , and
easements for utilities would not be a problem through park lands .
Agenda Item No . 8 - Persons To Be Heard :
The Supervisor called for any persons wishing to be heard . No one
came forward to speak .

c . Highway / Parks Superintendent : ( Report attached . )
Councilwoman Grigorov - Complimented the Highway Department for
sending a special truck to the Sugar Bush Lane turn around , the
plowing was done very well and the residents were very pleased .

d . Town Planner : ( Report attached . ) The Planning Department for
the first time has a work study intern from Ithaca College working
on the Parks and Open Space Plan updates . The full cost for this
intern is being paid by Ithaca College .
e . Building Inspector / Zoning Officer : ( Report attached . ) The
department will begin utilizing the Town Justice Court for some
violations rather than using the NYS Supreme Court .
f . Town Clerk / Receiver of Taxes : ( Report attached . )
Councilwoman Valentino - Requested that the Town Clerk continue to
pursue a Cat Licensing law .
Ms . Noteboom - The Cat Licensing Task Force will reintroduce the
legislation to the County Board in the spring . More documentation
has been received promoting the necessity for cat licensing .
Supervisor Whitcomb - Thank you to all town staff who helped with
the tax collecting process during the last few days of January .
g . Assistant Budget Officer : ( Report attached . )
h . Personnel Manager : ( Report attached . ) The computer payroll
system miscalculated the annual New York Income Tax report . The
programmer was notified , but the correction will not be fixed in
time for the deadline . A temporary employee may be hired to type
the report .
Feedback has been received regarding the health insurance
prescription plan . The reduction of premiums was welcomed , but the
amount of prescription drugs not available in generic form is
higher than anticipated .
i . Attorney for the Town : Report given during executive session .
Agenda Item No . 9 - Holly Beermann Joint Youth Commission -
Ms . Beermann - The Town Board received the year end report from the
Youth Employment Service including the Town of Ithaca portion , the
Teen Conservation project , and the new Youth Work Service
activities .
It was very much appreciated that the Town of Ithaca increased
funding for the summer jobs program , and the Teen Conservation
project . The money enabled more youth than ever to participate in
summer programs . Much of the money allocated was paid to the youth
in salaries . The reports include comments from the students as to
how well they liked the program .
The Learning Web program has been very well received by the youth .
Liz Wadsworth , Project Coordinator is doing the community service

project in the Town of Ithaca . It will move next month to another
municipality .
Councilwoman Harrison - What is the criteria used to select
participants in these programs ? _
Ms . Beermann - There are a number of jobs which are dedicated to
the Town of Ithaca youth . The programs tend to reach out more to
youth at risk . However , the program needs diversity in
participants for peer and role models .
Councilman Niklas - Is there a written statement as to the criteria
for eligibility and selection ?
Ms . Beermann - It follows the normal employment guidelines . The
application form has notification of non discrimination . Many of
the children are referred from other agencies for the applicant
pool . The Town of Ithaca youth are served very well .
The Joint Youth Commission is looking forward to working with Wendi
Shaw if her appointment is approved by the Town Board .
A request has been made by the County for the Town to pay an amount
of $ 250 . 00 to the Learning Web . This was money allocated to the
Town , but not used . The County will reimburse the full amount .
The 1995 planning meeting of the Joint Youth Commission will be
held on February 28 , all Board members are invited .
Supervisor Whitcomb thanked Ms . Beermann for her dedication to the
youth and these projects .
Agenda Item No . 5 - 1994 Town Justice Dockets :
Motion made by Councilman Niklas , seconded by Councilman Conley to
accept for filing by the Town Clerk the 1994 Dockets of Town
Justice , Clarence Larkin for the year 1994 . The members of the
Town Board as required by law shall sign and date the said dockets .
Attorney Barney - The Town Board should review and sign these
dockets . They are the printed work of those cases presented to the
Town Justice . The law requires the Town Board to review these
dockets each year to insure that dockets are being prepared .
Motion carried unanimously .
Councilman Niklas - When can the Town Board expect to receive the
dockets for Justice Wallenbeck ?
Ms . Noteboom - Justice Wallenbeck is presently ill and in the
hospital , it is not known when the dockets can be produced .

Agenda Item No . 6 - Report of Town Committees :
Councilwoman Harrison - A very productive meeting was held with
Cornell personnel regarding the GEIS . It is hoped the Town Board
will be able to consider this issue at their April meeting . The
Attorney will review the document after the next meeting .
Councilwoman Grigorov - The Planning Committee has a draft
Conservation District proposal to be sent to the Codes and
Ordinances Committee for review .
Councilman Klein - The Public Works Committee discussed the work
done on Christopher Circle and methodology to contact neighborhood
associations when work is to be completed . The Highway Department
has to do work when the weather presents itself . Possibly , with
more organization it may not be necessary for maintenance to be so
drastic , ( this is no criticism of Mr . Noteboom he is dealing with
a 20 year catch up process ) .
Leaf and brush pick up could be much easier and quicker if home
owners put their leaves out to the curb in biodegradable bags .
Money would be saved because the leaf vacuum breaks down frequently
and is very expensive to replace and keep running . Mr . Schoch
determined about 8 , 000 bags would be needed based on the volume of
what is collected . The dilemma is how to distribute the bags . Is
the money that would be saved worth the effort of trying to create
a distribution system for the bags ?
Mr . Noteboom - Using bags would be substantially cheaper if the
distribution could be determined . The Highway Department could
have a supply of the bags to distribute , the newsletter would let
people know to come pick them up .
Councilman Klein - People would have to identify themselves as
residents when they get the bags and storage would be needed .
Councilwoman Valentino - These bags are very hard use . How many
people will use them ?
Councilman Klein - Tompkins County is not moving as quickly as
hoped on the design for the downstream Forest Home Bridge . The
season for project completion is fast approaching in order to bid
the project for the small window of construction . Supervisor
Whitcomb wrote to the County urging them to move along with this
project .
Mr . Walker - The time line for total completion of the project was
for October 1995 , with the bridge reopening in September . No final
designs have been seen . Based upon normal contracting procedures ,
it does not feasible the project can be completed within this
period .

The Judd Falls Road reconstruction plans are approximately 85 %
complete . They will be reviewed by the Public Works Committee to
move the project along .
Councilman Niklas - The Codes and Ordinances Committee is working
on Fees In Lieu of Park Land , and Sunset Provisions for site plan
approval in addition to other items .
Councilwoman Valentino - The first Recreation Partnership meeting
was held . There will be a kick off reception at the Youth Bureau
at 7 : 30 p . m . , February 16 . The cooperation between the
municipalities is getting off to an excellent start .
Individuals from the State Cable Commission were at the County
Cable Commission meeting to give a report . The news media have
been reporting that Governor Pataki is proposing to disband the
State Cable Commission . This is disturbing because they were given
the authority to determine rate regulations . Abolishing the State
Cable Commission will not save the State taxpayers money because
that Commission does not operate from state tax funds . Their
revenues are received from a subscriber fee to the cable company .
The cable companies are paying the cost of the State Cable
Commission . A huge vacuum will be left if the State Commission is
disbanded .
The Commission has drafted a resolution they hope the
municipalities would adopt and send to the appropriate agencies .
Resolution No . 29 : Motion made by Councilwoman Valentino , seconded
by Councilman Niklas that the Tompkins County Intermunicipal Cable
Commission supports continuation of the New York State Cable
Commission and calls upon Governor Pataki , Senators James Seward
and John Kuhl , Assemblyman Martin Luster , and the other members of
the legislature to continue support for this State Agency , The
Town Clerk is authorized and directed to forward a certified copy
of this resolution to the Tompkins County Intermunicipal Cable
Commission , the New York State Cable Commission , Governor George
Pataki , Senators James Seward and John Kuhl , and Assemblyman Martin
Luster .
Motion carried unanimously .
Councilwoman Valentino - The Attorney for the Town was concerned
with certain items in the charter and bylaws of the Cable
Commission . A meeting was held with the Charter and Bylaws
Committee of the Commission to address them . The committee did not
look favorably on any of the suggestions made by Attorney Barney .
There was particular concern regarding the financial aspects , that
some municipality has to take authority and have the Commission
expenses reflected in their budget . The Commission felt the way it
has been done in the past is sufficient .

Questions were raised about changes in the agreement having to be
approved by three fourths of those in the Commission . Their
response was that any municipality who did not approve the change
could drop out of the Commission . That would mean all , not three
quarters . -
Councilwoman Valentino - This is a concern since a Town Board
resolution states the Town would join the Commission after these
concerns were addressed . The issues brought out by this Board were
not adequately addressed by the Commission . " I can not recommend
at this point that the Town join this Commission "
Supervisor Whitcomb - It is unfortunate that they were not willing
to compromise on these issues , because the Commission is an
important vehicle for banding together to face the problems which
face the cable industries .
Councilwoman Valentino - The City of Ithaca has not joined the
Commission . An issue which could have negative effects on the Town
is the fact that the City of Ithaca and the Town of Ithaca are
farther along than the others with their model agreements . There
is a concern that the other municipalities were unwilling to listen
to the concerns about the bylaws and charter .
The Town should not formally join the Commission , permission for a
representative to attend the meetings as a non voting member is
needed . The Commission may discover in time there are changes
which need to be made . Having a non voting member to represent the
Town of Ithaca seems reasonable . There are important things these
municipalities can do together .
Agenda Item No . 10 - Public Hearing " LOCAL LAW INCREASING THE
PARTIAL TAX EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH
LIMITED INCOMES WHO ARE 65 YEARS OF AGE OR OVER " -
The Supervisor opened the public hearing at 7 : 00 p . m . , the Town
Clerk had proof of posting and publication . No persons came
forward wishing to be heard during the public hearing . The
Supervisor closed the public hearing at 7 : 01 p . m .
Agenda Item No . 11 - SEQR " LOCAL LAW INCREASING THE PARTIAL TAX
EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH LIMITED INCOMES
WHO ARE 65 YEARS OF AGE OR OVER "
Resolution No . 31 : Motion made by Councilwoman Valentino , seconded
by Councilman Niklas that the Town Board makes a Negative
Determination of Environmental Significance in accordance with the
New York State Environmental Quality Review Act for the proposed
Local Law No . 2 , 1995 a , " LOCAL LAW INCREASING THE PARTIAL TAX
EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH LIMITED INCOMES
WHO ARE 65 YEARS OF AGE OR OVER " , and therefore an Environmental
Impact Statement will not be required .

Agenda Item No . 12 — Enactment , " LOCAL LAW INCREASING THE PARTIAL
TAX EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH LIMITED
INCOMES WHO ARE 65 YEARS OF AGE OR OVER " :
Resolution No . 32 : Motion made by Councilman Niklas , seconded by
Councilwoman Valentino that the Town Board does hereby enact Local
Law No . 2 , 1995 a , " LOCAL LAW INCREASING THE PARTIAL TAX EXEMPTION
FOR REAL PROPERTY OWNED BY PERSONS WITH LIMITED INCOMES WHO ARE 65
YEARS OF AGE OR OVER " , said local law shall take effect
immediately . The Town Clerk is hereby authorized and directed to
file said local law as prescribed by law . An original copy of the
said local law shall be forwarded to the Tompkins County Assessment
Department who shall implement the said local law for the Town of
Ithaca .
Roll Call Vote : Supervisor Whitcomb , aye ; Councilwoman Valentino ,
aye ; Councilman Niklas , aye ; Councilman Klein , aye ; Councilwoman
Grigorov , aye ; Councilwoman Harrison , aye ; Councilman Conley , aye .
Roll call vote carried unanimously .
Agenda Item No . 7 - Correspondence :
a . Supervisor Whitcomb - Letter from NYS Department of
Transportation denying the request for a change in the speed limit
on Hopkins Road . Mr . Noteboom will inform the residents .
Councilman Klein - Since the new Governor is trying to find ways to
save money he may be supportive of allowing Towns within certain
parameters to modify their own speed limits . The State has to do
a very extensive and expensive survey . They count the number of
houses , access the present speed limit , and evaluate traffic ,
etcetera . It is not feasible . When a residential subdivision is
approved the Town has to apply for a reduction in speed limit . It
seems to be a waste of time and money for the Department of
Transportation .
Mr . Noteboom - There may be state legislation drafted for review
this year . It will be researched .
b . Supervisor Whitcomb - Letter from the Town of Caroline
Supervisor requesting support for the change in law to allow
establishment of seasonal roads with limited maintenance .
Councilwoman Harrison pointed out the assembly bill number on the
drafted resolution did not match the bill number of the other
presented .

Mrs . Noteboom - A call was made to Assemblyman Luster ' s office , a
copy of the bill is not available at the Ithaca office , Albany will
be called to send one to the Town .
The Board modified the drafted resolution to support a generic bill
rather than a specific bill .
Councilwoman Harrison - Upon reading the correspondence and the
bill , Assemblyman Luster ' s letter reflected the proposal met with
opposition from County Highway officials because they are reluctant
to allow the Commissioner of DOT to establish guidelines which may
become binding . That may also concern the Town . The bill from the
Town Caroline did not mention DOT . There is confusion as to which
bill will be submitted to the State legislators . The Town should
be somewhat cautious as to what should be supported .
Resolution No . 30 : Motion made by Councilwoman Harrison , seconded
by Councilwoman Grigorov that the Town Board of the Town of Ithaca
hereby supports the Town of Caroline in their request for the
reintroduction of such a bill in 1995 by Assemblyman Martin Luster .
The Town Board requests that Senator James Seward draft and submit
similar legislation for enactment by the New York State Senate ,
The Town Board urges the New York State Legislature to pass such
bills and urges Governor George Pataki to sign same . The Town
Board authorizes and directs the Town Clerk to forward a certified
copy of this resolution to the Town of Caroline , the Tompkins
County Board of Representatives , Assemblyman Martin Luster , Senator
James Seward , and Governor George Pataki .

c . Forest Home Improvement Association regarding actions of the
Highway Department in taking down a tree on Forest Home Drive .
Supervisor will respond to their correspondence .
Mr . Noteboom - There is correspondence received from individuals
who were concerned about the health of the tree and it falling on
their home . New York State Electric and Gas also had concerns
about the tree because of the wires in the area . NYSEG took down
the tree , and the Highway Department provided traffic control . The
decision to cut down the tree was made by the Highway Department ,
Councilwoman Harrison - What is the town ' s policy regarding to
notification and discussions with people who believe they own the
tree ? It is very upsetting to people to find something they care
about gone .
Mr . Noteboom - There may not have been a standard procedure in the
past . More communication is a very good idea , but maintenance will
become more difficult because there will be more dialogue before a
project can be accomplished . There are maintenance items in some
of the neighborhoods which not everyone will agree with and like .

Councilwoman Niklas - Communication is a courtesy when something of
this magnitude is to be accomplished , however letting people know
there is a problem does not mean they will get what they want .
Mr . Noteboom - The entire tree was chipped and taken to the storage
piles .
Supervisor Whitcomb - The Highway Superintendent did inform the
Forest Home Neighborhood Association during previous discussions
regarding the Judd Falls Road reconstruction project that the tree
would have to be removed . Mr . Brittain believed the tree being
removed was part of the negotiations of that project , however the
Town believed the tree was a separate issue .
Mr . Walker - The tree was leaning over the road and several years
ago half of the tree fell into the residents yard . The landowner
insisted the Town owned the tree , and that the Town immediately
remove that half of the tree from the yard .
Supervisor Whitcomb - We agree communication is necessary , however
that does not mean there needs to be a referendum of the
neighborhood when maintenance work is done .
Mr . Frost - Many calls are received by people asking about
plantings in the road right of way . They are informed they do the
plantings at their own risk . People are now also referred to the
Highway Department .
Councilman Niklas - Do people need approval to plant in the right
of way ?
Mr . Noteboom - There have been a number of instances where walls
have been built near the road . People should talk to the Highway
Department before planting because there are areas within the right
of way that they are welcome to plant in , and some areas where it
can impeded maintenance and safety .

Agenda Item No . 140 - Attendance Construction Design Course :
Councilman Klein - This is an extremely expensive course for three
days . There is some confusion as to Mr . Whitney ' s responsibility
and how attendance at this course would have a direct bearing on
those duties , particularly since the course description refers to
those who will be involved in building design . It was thought that
Mr . Whitney was involved with civil design of water and sewer
projects .
Mr . Walker - The Engineering Department does structural building
design for small structures like pump stations , etcetera . All of
the underground structures are designed as buildings . Some
retaining wall designs have been done , and it is anticipated that
some design work will be done at the Highway facility .
Councilman Klein - How will this conference relate to those issues .
Mr . Walker - The course is intensive with a design manual provided
with intensive training for engineering personnel . The course will
be beneficial to Mr . Whitney in preparing for his professional
engineering license examination . Part of Mr . Whitney ' s
professional training beneficial to the Town is obtaining the
license . It is appropriate for Mr . Whitney to attend this course .
Resolution No . 34 : Motion made by Councilman Klein , seconded by
Councilman Niklas authorizing Erik Whitney , Assistant Town Engineer
to attend the Structural Engineering Course on March 6 - 8 , in East
Brunswick , New Jersey at a cost not to exceed $ 1 , 300 . 00 for

Agenda Item No . 15 - Association of Towns of the State of New York
1995 Resolutions :
Supervisor Whitcomb - Are there any specific resolutions the Board
wishes to discuss or have the delegate address at the annual
meeting ? Added to this list will be discussion about limited use
local roads , and DOT ' s involvement in setting speed limits .
Resolution No , 35 : Motion made by Councilman Niklas , Councilwoman
Grigorov that the Town Board provisionally approves the Association
of Towns 1995 Resolutions , but hereby instructs the Town ' s
Delegate , John Whitcomb and the Alternate Delegate , Catherine
Valentino to exercise discretion in voting based upon any
information that may be provided during the floor discussions of
the resolutions at the Association of Towns Annual meeting February
19 - 22 , 1995 .

Agenda Item No . 16 - 1995 Priorities Work Plan :

Supervisor Whitcomb - Thank you to Town staff for their hard work
in developing these priorities .
Ms . Alario - The internal audit plan was to be discussed with the
auditors . _
Supervisor Whitcomb - The benefit assessment policies procedures
and process will have the Planning Committee and the Town Board ' s
review . The Conservation Board will also be involved in the Storm
Water Management Plan ,
Councilwoman Valentino - What is meant about the establishment of
the Department of Public Works ?
Supervisor Whitcomb - The Public Works Committee has been
discussing this possibility . The Town seems to be moving in that
direction without a formal procedure or decision . The Town is
doing many things jointly ; Parks , Highway , Engineering . There is
consideration of hiring additional employees to do work on the
water and sewer . The Public Works Committee should discuss this
and decide if they agree with the direction this issue is taking .
Councilwoman Valentino - This would include Parks , Highway and
Engineering ?
Mr . Noteboom - Parks , Highway and water and sewer .
Mr . Walker - The infrastructure does not just include highways .
Attorney Barney - Care will have to be taken , because under Town
Law the Highway Superintendent ' s responsibilities are unique .
Supervisor Whitcomb - This has been included on the work plan only
to be considered .
Implementation of the Capital Improvement Plan should include a
prioritization of the public works projects , and a discussion
whether certain items should be deleted from that list if there is
no hope in the foreseeable future of them being accomplished .
Transportation master plan should be moved to the 1996 Priorities
Plan because the MPO is doing that planning . The major component
of the transportation plan which should be considered is the North
East Corridor Study funded by the MPO which will be started late in
the year . The Town should be prepared for planning that project .
Mr . Kanter - The Environmental Atlas has a priority B , and general
planning has it as a priority A . The Planning Department sees this
as a priority A , it will be a long term project of over two years .
Mrs . Punger - The personnel priority of drug testing for commercial
drivers should be an " A " priority since there is a federal mandate

to have it done in 1995 .
Councilwoman Harrison - Does the development and review manual
deserve a priority ?
Mr . Kanter - The development and review manual was listed because
it is very close to being complete enough to be reviewed by several
committees . The sunset provisions should also be raised in
priority since it is close to completion .
Supervisor Whitcomb - What stage is the Development Review Manual
at , and what exactly is this manual ?
Mr . Kanter - It is an outline of procedures for staff , Boards , and
applicants which could be completed in two weeks if there were time
to devote to reviewing the document . A draft has already been
completed .
Councilwoman Harrison - The Northeast Corridor Study and the MPO
Planning Study should be placed under general planning . Is a " B "
priority appropriate for the Route 96 , Park and Ride issue and the
Countywide Trail Corridor Study ?
Mr . Kanter - The Countywide Trail Corridor Study will be reviewed
and done by the MPO . The Route 96 Park and Ride will not be a
major task . The priorities seem to be appropriate .
Councilwoman Grigorov - The Planning Board is very anxious to
finish the unbuildable land issue .
Councilwoman Harrison - The Planning Committee is also anxious to
address that as an important next step .
Councilman Niklas - Codes and Ordinances should review the status
of commercial zoning and MR zoning for projects which have not been
completed . Also , the possible increase in allowed building height
should be addressed as it will be a policy decision the Town Board
will have to make . The COC needs to know if the Town Board wants
the maximum building height to be changed ?
Supervisor Whitcomb - This item will be added to the agenda for the
March meeting .
There are a number of contracts and agreements which need to be
reviewed and indexed . The Capital Plan policy decisions as to the
priorities of projects should also be added to this category .
Councilwoman Harrison - Review of the benefit assessment policies
may also be more appropriate within the Supervisor / Town Board
category .
Mrs . Noteboom - The review of contracts and agreements would fit

more appropriately into the present indexing grant for Records
.Management .
Councilwoman Grigorov - The sprinkler local law should again be
reviewed since only one member of the present Town Board was in
office when it was enacted . There are hardships and opposition
because of implications of the type of affordable housing which can
be built under this law .
Mr . Frost - The plan a few years ago was to inform people several
years in advance as to what would be the requirements . There is an
emotional difference of opinion . Notices should be sent for non
compliance with the sprinkler law . Some notices will have
responses stating the law should be maintained . In recent weeks
compromise has been considered to maintain and improve the level of
safety to follow the intent of the law when it was enacted . This
needs to be addressed in the near future because of the notice
requirements .
Councilwoman Grigorov - The sprinkler law should be looked at
before Mr . Frost sends out notices .
Supervisor Whitcomb - The sprinkler law will be reviewed at the
next Town Board meeting . If additional questions arise the Fire
Chief and members of the Builders Association can be invited to
talk about the pros and cons before letters are sent to
constituents telling them to plan to comply with the law .
Mr . Frost - " For the record , I had no particular part in suggesting
the Town have such a law , although I did do some research , the law
was not concocted my me " . " John Kanter ' s attachment " A " is rather
ambitious , but is well done regarding his suggestions for changes
to the Zoning Ordinance . These should be incorporated in the
classifications I have made . "
Mr . Kanter - The attachment was intended to be a " shopping list "
for the Town Board to use , and to bring some specific ideas to
Codes and Ordinances . All will not be completed in 1995 .
Mrs . Noteboom - The priority list should include drafting a local
law to forego having to publish amendments to the Zoning Ordinance
in their entirety .
Resolution No . 36 : Motion made by Councilman Niklas , seconded by
Councilwoman Valentino authorizing the Town of Ithaca Supervisor ,
Department Heads , and employees to implement the 1995
Priorities / Work Plan as amended for the Town of Ithaca .

Agenda Item No . 13 - Presentation Barbara Mink Tompkins County
Board of Representatives :

Supervisor Whitcomb - The County plans to move some of their West
Hill services to a downtown location and the possibility of the
Town and County joining forces to occupy the same building but
different spaces has been discussed .
The Town is considering properties for sale throughout the Town and
City . The Town wishes to make a decision within the next few
months so that plans can be made for moving in 1996 .
Ms . Mink - The County is within the same timetable . The Board of
Representatives have to make a decision as to whether to stay on
West Hill or to move downtown . Specific sites which cannot be
disclosed are being considered . The motive to move is to
strengthen the County seat , location in the City is important . The
Board of Elections site is one of the top five locations being
considered since the land is owned . It would be a difficult site
with the expense to relocate and tear down the present building .
The site is favorable in its access to the court house . There are
preferable sites closer to the mental health facility , or to other
areas downtown the clients would find easier to walk to .
Decisions will be made first before looking at sites to avoid
confusion . Most people will make a decision based on cost . The
cost is perceived as being just as expensive to stay at the present
location and do nothing for the next twenty years , as it is to
build a new building . This is due to the lack of economy of scale
of the present building .
Another scenario is to build a new building on the land presently
owned on the West Hill . This would cost as much as a new building
anywhere , and would do nothing to aide proximity to clients .
The Axiohm / NCR Corporation located in the Town has a great deal of
office space for rent .
The County departments moved would be social services and
probation . The square footage needed would be 60 to 70 thousand .
Councilwoman Harrison - Has the County talked to the City about
possible " perks " such as providing parking to lure the County
offices to the City ?
Ms . Mink - Parking is the main issue . There have been assurances
the City wants the County located downtown and they will negotiate .
Sites include the area the City was thinking of building a parking
ramp , and another already have parking . The Elections site would
be terrible for parking . There will be a need for 200 parking
spaces . The City will give no specific assurances about " perks "
until a decision has been made .
Supervisor Whitcomb - The County could possibly buy the Town Hall
for a parking lot .

Ms . Mink - There seems to be a different climate now about building
a parking structure . People on the City Common Council seem to be
more receptive .
Councilman Niklas - Have the County members _ discussed the
possibility of intermunicipal cooperation with the Town for a site ?
Ms . Mink - It has not been discussed in the Committee because a
specific site has not been chosen . Is the Town interested in being
involved with that type of agency grouping ? The warning heard was
that the Town wished to have its own identity .
The dream configuration would be to tear down the Annex Building C
and make a nice building and put the Town of Ithaca , Board of
Elections , and Assessment in it . Or the Town of Ithaca , Office of
the Aging , Senior Citizens Council , and Food Net .
Supervisor Whitcomb - The Town will not rule out these
possibilities , but the Town is proceeding with its own plans . The
Town is anxious to leave this building to have something more
compatible . Some of the identity problems could be solved
architecturally .
Ms . Mink - Is the Town looking at current buildings which meet the
Towns needs specifically ?
Supervisor Whitcomb - The Town is looking at those type , and ones
on lots where the building could be demolished .
Ms . Mink - If that is a serious option , there should be more
communication between the Town and County .
Supervisor Whitcomb - The Town has not ruled out anything , there is
some concern about cost of such a municipal building and whether it
would be beyond what has been projected to be the square foot cost
to the Town . Also , the identity issue could be a problem .
Councilman Niklas - Sharing a facility could save both entities
money , but what facilities could be shared would depend on the
groupings of the activities .
Ms . Mink - The next meeting of the Committee is February 28 , at
2 ; 00 p . m . at the Board room . The Supervisor could attend to get a
better sense of the proposals .
Agenda Item No . 17 - Procedure of Status Change General Purpose
Land to Eastern Heights Park :
Supervisor Whitcomb - Councilwoman Valentino requested this item be
looked at by the Board again because residents are concerned about
the park . The Town Board may have led them to believe this general
purpose land would be converted to park land .

There are road right of way issues , and promises which may or may
not have been made which could preclude the Town from changing the
status of this land .
Councilwoman Grigorov - The correspondence to _ Ralph Varn by
Supervisor Whitcomb explaining the Town ' s obligations regarding
what Mr . Varn said had been promises made was done very well . The
letter emphasized any decisions would be made by the Town Board and
not by someone who was Town Planner at the time .
Supervisor Whitcomb - Some developers and landowners in the area
are under the impression that Town staff made certain
representations and promises in the past about rights of way ,
etcetera . However , it is unclear that the Town Board made any
formal decision .
Councilman Niklas - During previous Town Board meetings the
residents were asked if the Town were to change the properties into
parks would there fears be lessened , and would they object to the
negotiations that were being conducted regarding roads . Some
people in the audience said , " possibly " . This was when the people
in the neighborhood addressed the Board to talk about roads and
access .
Supervisor Whitcomb - What was the precise issue at that time ?
Councilwoman Valentino - The issue was the trading of land
involving the Mrs . Quick and Mr . Frandsen ,
Councilman Niklas - The reconstruction of the issue is necessary to
understand why and what was said , and what the implications of
those statements are .
The Town Board said if this was to be changed to park land it would
cut off the possibility of building a connecting road to funnel
traffic through the neighborhood .
Councilwoman Grigorov - The commitment Mr . Varn was expecting was
much longer ago , when Larry Frabboni was Town Engineer ,
Councilman Niklas - Unless the decision is a formal promise made by
the Town Board , it is irrelevant .
Councilwoman Valentino - There are paths and trails within the
general purpose land used quite often which were built by the Town .
The proposed turn around is referred to as the " promised " section
by the Planning Board .
Mr . Kanter - This section received preliminary approval when the
original sixty lot Frandsen subdivision came before the Planning
Board in 1986 , it never went to final approval .

Councilwoman Valentino - There may be significant wetlands in the
area which have not been reviewed . The area needs to be revisited
by professionals who can delineate wetlands . Their determinations
may change the situation .
The residents of Eastern Heights were concerned about what kind of
traffic would be generated when the road opened . Recent
discussions with residents have proven the opened road has not had
an effect through the rest of the subdivision . Many people are now
taking a different route . The road being opened has helped the
traffic problem on Snyder Hill .
The residents now worry about the subdivision plans which could be
a pathway to them into the Towns park .
The general purpose land and the park are not too small an area to
look at , people will not be stopped from using the park . Something
has to be extracted from the Town of Dryden or the developer to
offset some of the costs for that park . Mr . Varn has said he would
be willing to pay for some costs for the park .
Councilwoman Grigorov - The Town of Dryden has refused to set aside
any of their land for a park because they felt there was already a
close adjacent park .
Councilman Niklas - There is a path into the Town park , does the
Town have to let them into our park ?
Councilwoman Grigorov - The path could be eliminated , but the Town
probably should not prevent people from coming to the park .
Supervisor Whitcomb - It is a big park and if the general purpose
land were added it would become an area park . The question is to
negotiate for as much as possible to offset maintenance costs from
the Town of Dryden and Mr . Varn ,
Councilwoman Valentino - The other questioned heard is access from
the blocks of private parcels .
Mr . Kanter - The Foote parcel was recently subdivided into two
parcels . Mr . Varn obtained the northern parcel to add onto
Perigrine Hollow as a future phase of development .
Councilman Niklas - That is in the Town of Ithaca , even if it is
Mr . Varn ' s property which could be built as a private road . The
Town Planning Board would have to approve construction of that
road .
Attorney Barney - The Planning Board would have to approve any
further subdivisions on that lot not the construction of the road .
Mr . Kanter - There were a great many conditions put on the lot when

the Planning Board approved the two lot subdivision . The Blanpied
property has a very steep fifty foot wide strip yo the Slaterville
Road . It is essentially landlocked . There have been various
discussions at both the Town Board and Planning Board level about
how future access could serve these project parcels . Informal
discussions and views have been shown on maps , but there has not
been a uniform agreement and no commitment as to how that would
occur . The original section these lands came from was the Eastern
Heights subdivision which has original plans showing roads which
could have provided access . This is one reason some of these
residual questions are present .
Supervisor Whitcomb - What opportunities are there now to provide
service to those parcels if they came in for subdivision approval ,
and how does it impact the decision on the park ?
Mr . Kanter - A group of potential plans from Brian Drive was to
bring a strip down from the cul - de - sac to the south .
Councilwoman Harrison - What is the current status of Brian Drive ?
Councilwoman Valentino - There is a cut through the woods .
Mr . Walker - There are plans for Brian Drive , it is a cul - de - sac in
the general purpose land . The Planning Board and Town Board have
given that preliminary approval .
Attorney Barney - The Town Board approved the location of that
road .
Councilwoman Harrison - Does that commit the Board to allowing a
cul - de - sac ?
Mr . Kanter - There has not been final approval and there is no
plat .
Councilwoman Valentino - That is where the wetland may be .
Supervisor Whitcomb - Under what premise could the Town Board
reconsider that road ?
Attorney Barney - There could be a lawsuit , Mr . Frandsen spent a
more money than ever agreed to or anticipated in putting in the
park land extension . Originally , that was to be a tripartite job .
The Quick ' s would donate the land , the Town would donate the fill
which was taken from another area , and Mr . Frandsen would do the
topping and finish work on the road . The majority of the work
ended up being done by Mr . Frandsen . As part of that there were
lengthy discussions of exchanging more of the general purpose land
to give him more lots to offset the cost that he was incurring , and
to allow him to give land to Mrs . Quick so the Town could settle
that issue . That plan did not come to fruition , the Town paid Mrs .

Quick for the portion of land used for the road . Mr . Frandsen
continued on the reliance of this configuration and spent
approximately $ 70 , 000 or $ 80 , 000 on the road . Brian Road is Mr .
Frandsen ' s road and subdivision .
Councilman Niklas - When looking at those potential land locked
southern parcels , and the possible proposal to subdivide the other
section further , isn ' t it premature to make this park right now ?
If it is kept the way it is and those lots request subdivision
approval the Town can ask for park land set aside to increase the
size of the park land . Then the general purpose land could be
converted to park to form a bigger contiguous park .
Attorney Barney - No matter who does the subdividing , legally you
would have difficulty extracting either park land or fees with a
large park there . The fees are not applicable unless a need is
established for the park land in the first place . Under the
current law the only time the Town is entitled to fees in lieu of
park land is when it has first established that a park is needed
and there is no appropriate location on the subdivided parcel to
locate that park . It would be very difficult for the Town if
someone were doing a subdivision within such close proximity to a
large park to say there is a need for a park .
Supervisor Whitcomb - What obligation does the Town have to solve
the potential landlocked problems for some of these lands ? Did the
Town create these problems ?
Attorney Barney - The issue is the ability to complete good
planning , it may be , that this area is wetlands and should be
revisited . The Town does not have an obligation for those
potential landlocked parcels . It would not be feasible to say the
Town is going to foreclose the ability to get to those parcels .
Councilwoman Harrison - The Town would not be foreclosing that
possibility , those owners could negotiate with the Quick ' s for
access .
Councilman Niklas - If that parcel remains general purpose land at
least the Town would have options .
Councilwoman Harrison - What is the Town ' s responsibility regarding
a cul - de - sac on the general purpose land as part of the preliminary
site plan approval ?
Attorney Barney - The owners would have to address the Planning
Board for final subdivision approval . After that , assuming it is
approved in that form , they would bring the Town a deed for the
land to the cul - de - sac .
Councilwoman Harrison - Will the Town find itself in a situation
where it has gone so far with the Planning Board that if the Town

Board doesn ' t make an indication now there is no interest to agree
with this ?
Councilwoman Grigorov - A difference will be made if there are
wetlands , because usually when there is preliminary approval it is
not changed unless there was some circumstance which was unknown at
the time of that approval . There may be conditions on that land
which were not considered originally .
Councilwoman Valentino - The wetland possibilities should be
investigated as soon as possible for both the Town and Mr .
Frandsen ' s sake .
Councilwoman Harrison - There are pieces of this land which might
be important for specific activities in the future , and there are
pieces that are not . The wetlands issue definitely needs
clarification .
Supervisor Whitcomb - The Planning Department will take the
necessary steps to have the possible wetlands evaluated .
Councilwoman Valentino - The Town Board needs to be on record that
they want to conserve as either open space or as a park these
lands . It has been used in this manner for years . Some form of
resolution should be adopted saying that this Town Board sees this
as land which should preserved .
Councilwoman Harrison - A site visit should be made ,
recommendations would be hard without seeing the area and knowing
what is out there .
Councilman Niklas - This Town Board which is environmentally
sensitive will not be in office forever , and if that land is not
park land when this Town Board has changed , future elected
officials could do anything they wanted with it .
Mr . Kanter - There is a condition in the State enabling laws
regarding subdivisions which allow the Planning Board to revoke a
subdivision approval after being given preliminary approval , and if
a final plat has not been submitted for consideration within 180
days from the preliminary approval . This issue does go back much
farther than that time frame . There may be legal questions as to
whether early phases of that preliminary approval have been
developed .
Attorney Barney - Brian Drive was approved to give the adequate
frontage for the two lots on Park Lane ,
Agenda Item No . 18 - Policy Outside Water District Connections :
Attorney Barney - There is a request to the Town by a homeowner in
the Town of Ulysses to connect onto a water line which was

inadvertently extended into the Town of Ulysses because the sign
designating the town lines was not in the right place and the
contractor put the water line to where the sign was .
There is no prohibition against agreeing to provide water and sewer
under those circumstances , it would be done by a contract . There
are strong policy considerations that come from an arrangement with
one person outside the Town ' s boundaries . There are also several
other areas of the Town where the water lines are close to other
municipalities water lines . What would be the position if others
requested connection .
If the Town Board chooses to allow these connections charges and
contractual arrangements would have to be agreed to .
Councilwoman Grigorov - Approval would set a precedent , and the
Town would be open to many other requests and possible problems .
Councilman Niklas - It is ironic that the Town could provide water
to someone outside the Town limits , and yet when the Town abuts to
another Town that has access to water in the areas where the Town
doesn ' t , our Town cannot contract to use their water supply because
of the Bolton Point commitment .
Attorney Barney - If this were approved , the Town would be
providing water to a resident of the Town of Ulysses from water
coming from the City of Ithaca .
The general consensus of the Town Board was not to approve the
request , the Supervisor asked the Attorney to the Town to
communicate with Mr . Ward and explain the decision .
Resolution No . 37 : Motion made by Supervisor Whitcomb , seconded by
Councilman Niklas that the Town Board reluctantly feels that at
this time it cannot extend water and sewer to dwellings outside the
Town of Ithaca boundaries under these circumstances .
Motion carried unanimously .
Agenda Item No . 19 - Water and Sewer Benefit Assessment Request :
Mr . Walker - The Village of Cayuga Heights purchased a lot south of
their wastewater treatment plant , this is a valid building lot and
has been assessed benefit for water . The Village is claiming they
would never connect the water to this property . However , there is
no guarantee that the lot would or could not be sold , so it should
be assessed the water benefit .
Councilwoman Harrison - The policy of the Town should be that
unless there is some structural or environmental cause that makes
it impossible for them to connect the water the benefit should be
charged .

Resolution No . 38 : Motion made by Councilman Niklas , seconded by
Councilwoman Valentino denying the request by the Village of Cayuga
Heights to remove the water and sewer benefit assessments on the
property located at 941 East Shore Drive .
Motion carried unanimously .
Agenda Item No . 20 - Water Benefit Assessment :
Mrs . Noteboom - Mrs . Ainsworth , 17 Orchard Hill Road is due a
refund of the benefit assessments for water on her taxes for the
years 1994 and 1995 , because the property has no access to the
water main .
Resolution No . 39 : Motion made by Councilman Niklas , seconded by
Councilwoman Harrison approving and ratifying the modification of
the water benefit assessment and the refunds paid to Mrs . Ainsworth
for her property located at 17 Orchard Hill Road , Tax Parcel No .

Agenda Item No . 21 - Sewer Benefit Assessment Refund :
Councilwoman Harrison - The topography may make it impossible for
their to be the benefit of sewer , but then it should become a
conservation easement , or something that would make it clear there
is no way to put in the sewer .
Mr . Walker - This refund was put on the taxes this year as a
mistake , last year the Town Board approved a reduction of one sewer
unit for this property . The property is not totally exempted from
benefit assessment . They have a house , the additional assessment
was because of the frontage . If they built on this frontage the
owners would have to comply with subdivision regulations . The
Planning Board would probably not grant subdivision on that land .
There would probably not be a legal lot because of the depth on
that parcel .
Councilwoman Harrison - That is not the same as not being able to
build on this land ever . The assessment formula is in error .
Mr . Walker - The assessment formula is based upon frontage and the
assumption there would be enough depth for another lot .
Councilwoman Harrison - It is not topography , but the configuration
of the land .
Mrs . Noteboom - This assessment was accidentally added to the tax
roll this year . Last year the Town Board approved the removal of
this benefit assessment .

Councilwoman Harrison - The Town Board should review the policy .
Councilman Niklas - Will a similar resolution have to be adopted
each year , or will this be taken off the tax roll ?
Mrs . Noteboom - This should have not been on the roll this year .
Councilman Niklas - If this assessment is to be officially taken
off the tax roll , then it will have to be determined if these
dimensions are proven .
Attorney Barney - Last year the Town Board officially determined
that this benefit assessment was not to appear on the tax roll in
the future . Except for an error , this would not have been before
the Board this year .
Councilman Niklas - That is understood , but the Board is now
challenging whether the relief of this assessment is valid .
Resolution No . 40 : Motion made by Councilman Niklas seconded by
Councilwoman Harrison authorizing a refund of 1 . 25 units of sewer
benefit charge in the amount of $ 102 . 50 , to be paid to Ernest E .
and Jane Hardy , 238 Enfield Falls Road , Ithaca .

Agenda Item No . 23 - Waiver of Fees , Ithacare Center , Incorporated :
Mr . Kanter - Ithacare has requested the Town waive the review fees
related to the Environmental Impact Statement they are now
preparing . Calculations indicate that approximately $ 2 , 200 has
already been spent in staff time for the initial stages and early
review work . It is anticipated that $ 3 , 800 additional staff time
will be needed .
Ithacare is basing their waiver request upon the recently enacted
local law which contained a new provision allowing the Town Board
to waive review fees for good cause shown . Ithacare is indicating
they are a not for profit corporation , a charitable organization .
Councilman Niklas - People do have to pay for Ithacare ' s services ,
but Ithacare does not make a profit .
Councilwoman Harrison - Correspondence indicates that Ithacare
provides , " housing and personal care to indigent members of the
community " .
Attorney Barney - A great many people who receive care only receive
Medicare payments .
Councilwoman Harrison - How much has the Town already spent , and
has the Town been reimbursed by Ithacare for activities to date ?

Mr . Kanter - The Town has been reimbursed $ 1 , 000 as the original
review deposit .
Councilwoman Harrison - Is that all , considering the amount of time
spent on Ithaca not related to the lawsuit ?
Mr . Kanter - The Town is now at the point where Ithacare has to be
asked for reimbursement or make a decision on the request .
Councilwoman Valentino - It is nice Ithacare is in the community ,
but this group will not be paying property taxes or costs for
services . These fees are not unreasonable , they should pay the
fees .
Councilman Klein - Ithacare did not prove their case for needing
the waiver .
Supervisor Whitcomb - Ithacare is in its present situation because
the court required them to prepare an Environmental Impact
Statement . The Town had a choice whether to pursue that avenue or
file an appeal . The Town chose not to appeal .
Councilman Niklas - Ithacare actually encouraged the Town not to
pursue an appeal .
Councilwoman Harrison - The Town residents will be subject to many
additional costs including taxes in the future . The documentation
is not sufficient to provide a comfort level for approving this
waiver of fees . The Town has spent a great deal of time and
energy , and will in the future on this .
Councilman Conley - Ithacare has to do fund raising to build this
facility . This is a facility this community needs . People have to
have this type of care other than the alternative of nursing homes .
" I am very happy it is being built , and I will do everything I can
to support it , including voting to waive the review fees " .
Attorney Barney - Ithacare is paying their costs , they are doing
the Environmental Impact Statement ,
Councilman Niklas - " In past discussions , I felt the Town should
pursue this legally as it sets a very bad precedent , I felt the
decision was not correct . I don ' t like the idea that the Town was
defeated , because the Towns case could be well made " . Ithacare
encouraged the Town not to appeal .

Agenda Item No . 22 - In Lieu of Tax Payment , ._ Sewer Benefit
Assessment Cornell University :
Mr . Walker - Historically the Town had charged a benefit assessment
to Cornell based on water consumption , it is not a normal benefit
assessment . The charge is only $ 12 . 00 per unit because they are
only paying for capital costs of the wastewater treatment plant .
Cornell has its own sewer system . In the past Cornell submitted
their consumption and the charge was computed by the $ 12 . 00 charge ,
from that the number of units were calculated by dividing that by
the normal $ 80 . 00 charge . Basicly , they have the number of units
based upon the dollar figured owed and not necessarily based upon
consumption . There is a need to have an agreement with Cornell to
approve this assessment .
The property charged this assessment is located on Forest Home
Drive and includes part of Fall Creek and the land between the golf
course and Fall Creek . This was a convenient parcel which was
arbitrarily picked to assess the benefit for the rest of the campus
which is served by Cornell ' s water .
Supervisor Whitcomb - There needs to be a formal agreement with
Cornell regarding this issue .
Mrs . Noteboom - This has previously been on the taxes , because of
the method of calculation it was inadvertently left off the 1994
and 1995 tax roll . Attorney Barney provided documentation with
Cornell to make this an In Lieu of Tax in 1994 , and now it must be
done for 1995 , a voluntary payment . A tax bill was sent to Cornell
last year .
Mr . Walker - Cornell should be charged this fee , but an agreement
for the proper amounts should be negotiated .
Mrs . Noteboom - Cornell does pay many other tax bills for water and
sewer benefits .
Resolution No . 41 : Motion made by Councilwoman Harrison , seconded
by Councilman Conley accepting the recommendation of the Attorney
for the Town to receive $ 7 , 440 for 620 sewer units on Tax Parcel
# 65 . - 1 - 1 from Cornell University as an In Lieu of Tax Payment for
1995 .

Agenda Item No , 1 Additional - Tompkins County Waterfront Project :
Mr . Kanter - Discussions have been held with Tompkins County , City

of Ithaca and the Chamber of Commerce on a cooperative waterfront
planning project . The project would focus on the southern end of
Cayuga Lake as a southern entrance to the canal system . It would
provide short term strategies for enhancements to the waterfront
areas in the City and Town limits . It would help the Town explore
opportunities for public access .
The draft outline will have some wording changed to include public
access potential and specific study elements . The study would first
consider a canal orientated visitor center where people could learn
about the canal system and discover more about the recreational and
scenic aspects of the lake shore area .
Councilwoman Harrison - Would the Town have a specific role in the
study ?
Mr . Kanter - An informal committee has been formed with members
from the participating entities . Each of those entities are being
asked to contribute $ 5 , 000 for additional study . There could be
some canal authority monies available in the future and this study
would help the availability of those funds .
Resolution No . 42 : Motion made by Councilwoman Harrison , seconded
by Councilman Niklas supporting the coordinated effort of the
Tompkins County Waterfront Project , The Town Board approves an
amount not to exceed $ 5 , 000 be paid from account # B8020 . 406 to be
used for the Tompkins County Waterfront Project , conditional on
payment of a like amount for the same purpose from Tompkins County ,
the City of Ithaca , and the Chamber of Commerce making the
contributions from all four participants equal to $ 20 , 000 . 00 .

changing field of cable television ; and
WHEREAS , the New York State Cable Commission assists municipalities in
negotiating and preparing cable television franchise agreements and . enforces certain
minimum technical and safety standards for cable television operation ; and
WHEREAS , most funding for the New York State Cable Commission does not
come from the general tax levy , but rather from fees paid on revenues of cable
television operators ; now therefore be it
RESOLVED , that the Tompkins County Intermunicipal Cable Commission supports
continuation of the New York State Cable Commission and calls upon Governor
George Pataki , Senators James Seward and John Kuhl , Assemblyman Martin Luster ,

guidelines to enable counties and towns to classify roads and bridges according to
their principle uses and to establish recommended standards to enable local highway
officials to determine the manner in which such roads and bridges should be
constructed , reconstructed and maintained ; and
WHEREAS , if the said bill were enacted it would permit towns and counties to
designate certain low volume rural roads as minimum maintenance roads ; now
therefore be it
RESOLVED , the Town Board of the Town of Ithaca hereby supports the Town of
Caroline in their request for the reintroduction of such a bill in 1995 by Assemblyman
Martin Luster ; and be it further
RESOLVED , the Town Board hereby requests that Senator James Seward draft

WHEREAS , this action is the consideration of Local Law No . 2 , 1995 a , " LOCAL
LAW INCREASING THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY
OWNED BY PERSONS WITH LIMITED INCOMES WHO ARE 65 YEARS OF AGE
OR OVER " ; and
WHEREAS , this is an Unlisted Action for which the Town of Ithaca Town Board
has been legislatively determined to act as Lead Agency in environmental review ; and
WHEREAS , at a Public Hearing held on February 13 , 1995 , the Town Board
reviewed and accepted the Short Environmental Assessment Forms Part I and Part II
prepared by the Town Planner; and
WHEREAS , the Town Clerk/Receiver of Taxes has recommended a Negative
Determination of Environmental Significance for the proposed action ; now therefore be
it
RESOLVED , that the Town Board of the Town of Ithaca hereby makes a Negative
Determination of Environmental Significance in accordance with the New York State
Environmental Quality Review Act for the proposed Local Law No , 2 , 1995 a , " LOCAL
LAW INCREASING THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY
OWNED BY PERSONS WITH LIMITED INCOMES WHO ARE 65 YEARS OF AGE
OR OVER " , and therefore an Environmental Impact Statement will not be required .

schedule establishing income levels for partial exemptions as described in the said

RESOLVED , the Town Board of the Town of ithaca does hereby enact Local Law
No . 2 , 1995 a , " LOCAL LAW INCREASING THE PARTIAL TAX EXEMPTION FOR
REAL PROPERTY OWNED BY PERSONS WITH LIMITED INCOMES WHO ARE 65
YEARS OF AGE OR OVER " , said local law shall take effect immediately ; and be it

RESOLVED , the Town Clerk is hereby authorized and directed to file said local
law as prescribed by law ; and be it further
RESOLVED , an original copy of the said local law shall be forwarded to the
Tompkins County Assessment Department who shall implement the said local law for
the Town of Ithaca .

WHEREAS , the General Townwide Fund estimated year end fund balance for 1994
is $517 , 292 . 00 , or approximately 33 . 5 % of the 1995 budgeted appropriations ; and
WHEREAS , NYS Audit and Control and our independent auditors recommend a
fund balance of around 15 % ; and
WHEREAS , these surplus funds could be placed into our Capital Reserve for
acquisition and/or construction of town buildings ; now therefore be it

Northeast Transit Contract Extension

WHEREAS , the Northeast Transit agreement between the City of Ithaca and
Swarthout and Ferris has expired effective December 31 , 1994 ; and
WHEREAS , in 1997 the City of Ithaca will be required to bid out all contracted
transit services ; and
WHEREAS , Rob Swarthout has agreed to extend the agreement for two (2 ) years
but has requested a price increase ; and
WHEREAS , with consistent ridership , State Operating Assistance , and operating
surplus the City does not expect a cost to contributors in 1995 ; now therefore be it
RESOLVED , the Town of Ithaca does hereby approve and authorize a two (2 )
year extension of the Northeast Transit contract .

Re : Arrangements for Town Legal Counsel for
the year 1995
Dear John :
This letter is to outline the arrangements for legal services provided by our office as
attorney for the Town . It essentially restates the contents of my letter to you on the same topic
of January 10, 1994 with the only changes being the hourly rate for partners being increased from
$ 120. 00 to $ 125 . 00 and the hourly rate for associates being decreased from $ 100. 00 to $95 . 00.
The arrangements we contemplate are as follows :
1 . I agree to serve as Attorney for the Town for the year 1995 and such additional
periods as the Town Board may wish, subject to termination at any time as set forth below.
2. Services would be on an " as needed " basis and as requested or directed by the Town
from time to time. Until otherwise directed , the services would include attendance at meetings
of the Town Board , Town Planning Board, Town Zoning Board of Appeals, Town Codes and
Ordinances Committee and Town Staff; advising Town governing bodies and individuals
including the Town Supervisor, Planning Board Chair, Zoning Board Chair, and Codes and
Ordinances Chair on legal matters ; advising Town staff on legal matters ; review of legal
documents ; preparation of requested local laws , agreements , resolutions , and other legal materials ;
representing the Town in litigated matters (when feasible, authorization for such representation
will usually be sought from the Town Board before appearing for the Town , although

occasionally emergency representation may occur after consultation with the Town Supervisor) ;
assisting Town bodies and staff in connection with legal matters relating to development
proposals, environmental matters , etc . ; responding when appropriate to legal issues or questions
posed by Town residents in relation to matters pending before a Town agency ; and providing
such other duties as general counsel to the Town as may be requested or directed .
3 . Where appropriate , matters might be delegated to other lawyers in my office when the
expertise , economics , or time constraints make such delegation desirable from the Town ' s
perspective .
4. Generally , the fees for the services would be calculated on an hourly basis.
Occasionally , when we determine that perhaps more time was spent on a matter than might seem
appropriate for the result obtained , the fee may be reduced . On rare occasions , and after
consultation with the Town , when the time spent is not truly reflective of the value of the
benefits obtained by the Town , we might request an upward adjustment for that particular matter.
5 . For 1995 , the hourly rate will be $ 125 . 00 for partners and $95 . 00 for associates . This
represents approximately 15 % off of our normal hourly rates (for existing non- municipal clients
our basic rates in 1995 will be $ 150. 00 per hour for partners and $ 110. 00 per hour for associates
- new non - municipal clients may be charged higher rates) . If the Town chose to continue us for
ensuing years , it would be our intention to bill at a similar 15 % discount from normal hourly
rates as then in effect.
6 . The arrangements outlined in this letter may be ended at any time by either party for

relationship is mutual comfort with each other. If that does not exist, the Town should not have
to wait until the end of a year to seek other counsel . Obviously, if a change were being
contemplated by either of us , we would hope that whoever is deciding to end the relationship
would provide as much lead time as possible to the other so appropriate adjustments and
transitions might occur, but lengthy advance notice is not a required precondition to severing the
relationship . In the event of such severance , we would cooperate fully in transferring files and
information to the counsel chosen by the Town and would , of course , expect to receive the
agreed compensation up through the completion of the transition .
If the arrangements stated above are consistent with the Town ' s understanding , perhaps
it would be wise to execute duplicate copies of this letter for our respective files . A space for
such action is provided below. If the arrangements do not represent your understanding , please

WHEREAS , Ithacare Center , Inc . has submitted a request to the Town Board to
waive fees associated with the preparation and review of the Environmental Impact
Statement for the Ithacare Senior Living Community proposed on Danby Road ; and
WHEREAS , Local Law No . 10 of 1994 , Section 2 ( 8 ) includes provisions for the
Town Board to waive review fees and SEOR related fees for good cause shown , and
such cause may include , but is not limited to , an extreme hardship to the applicant in
paying for all or a portion of the review fees , the benefit to the general community that
would be provided by the proposed project , or other unique or special circumstances
which would warrant , in the judgement of the Town Board , such a waiver ; and

Approval Use of Funds - Tompkins County Waterfront Project

WHEREAS , the Tompkins County Department of Planning is coordinating a
strategic plan for the southern end of the Cayuga Lake Waterfront to promote the
scenic , historic , and recreational assets of the area as a " Southern Entrance to the
Erie Canal " ; and
WHEREAS , representatives from Tompkins County , the City of Ithaca , Town of
Ithaca and Tompkins County Chamber of Commerce have participated in discussions
regarding the possibility of such a study ; and
WHEREAS , the Waterfront Project would include the analysis of potential public
access to Cayuga Lake , which is included as an important strategy in the Town of
Ithaca Comprehensive Plan ( 1993 ) ; and
WHEREAS , Tompkins County is in the process of applying for a grant from the
New York State Council for the Arts to cover some of the costs of this study ; and
WHEREAS , Tompkins County has asked each of the local participants referred to
above to contribute approximately $5 , 000 . 00 toward the preparation of the Waterfront
Project ; and
WHEREAS , Account # 138020 . 406 ( Planning Study) in the 1995 Town of Ithaca

SUPERVISOR'S REPORT, FEBRUARY, 1995
Priorities for the coming year
Included in the February packet is a spreadsheet detailing the Town Priority
Work Plan for 1995 . I wish to express my appreciation to all department
heads for their ambitious and thoughtful goals and objectives . Using these as a
guide , I have summarized what I feel are the priorities the Town Board and
Supervisor should focus on in the coming year.
New Town Hall
From a standpoint of efficiency and staff morale , there is no more important
goal than the site selection and planning of a new Town Hall. By year end we
will have accumulated approximately a million dollars in our capital reserve .
The Board should select a site early in the year and retain an architect to plan
and design the new quarters with a goal of relocating in early 1996 .
Staffing
There are other issues that affect morale and productivity . Reviewing and
implementing our work plans will facilitate the development of a long term
staffing plan . That plan should include not only the number of people
required , but also strategies for continually training and upgrading the skills
and efficiency of our current employees . We are implementing a plan for
achieving conformance with Civil Service classifications . It is clear that we
must be proactive while minimizing the impact on our experienced ,
productive employees . The Town Board also needs to assess the management
structure of the Town . As presently configured , conducting the business of
the Town is surpassing the time and energy expected of a part- time
Supervisor. We should explore the need for a full time Supervisor , a Town
Manager, or perhaps a redefinition of the present reporting structure to vest
more responsibility and accountability in key staff. The correct choice will
have a significant effect on the productivity of all employees and elected and
appointed officials as well.
Long term capital and fbianeial planning
Using the Comprehensive Plan and the expectations of residents as a guide ,
we should develop a 3 - 5 year financial operating and capital improvement
plan . It is essential that we plan capital projects and major equipment
purchases years in advance , not only physically but financially. We need to
determine the real needs , the financial impacts , and the timing of capital
projects and purchases . We can no longer afford to construct and reconstruct
infrastructure on an ad hoc basis . Residents should know if and when
additional services will be provided , Our tax base is growing very slowly . Sales
and mortgage tax revenue will probably remain constant or decline . However,
property taxes must be held within the rate of inflation . We need to prioritize
the services we can afford and provide them as efficiently as possible .
Land use and zoning
Implementation of the land use provisions of the Comprehensive Plan is time
consuming and often tedious , but it is imperative that we begin to enact major
revisions of land use and the zoning regulations . Enacting conservation zones ,
completion of the parks and open space plan , revising the transportation
master plan and developing a storm water management plan are top priorities .
Sunset provisions , changes in home occupations and professional uses , and
consideration of institutional zones are also very important . Developing an
affordable housing strategy and being in a position to qualify for certain grants
is also necessary.
Electronic technology
Great progress has been made in upgrading computer hardware and software .
Continued staff training on commonly used applications is essential . Planning
for a new Town Hall should include provisions for networking and electronic
communication . Our Geographic Information System (GIS ) is being
implemented and should facilitate a number of activities from records
management and tax parcel information to mapping and land use planning . It
is important to coordinate with the City and County to be able to share
common information .
Intermunicipal cooperation
AM A key to efficiency is cooperation between the many municipalities in
Tompkins County . Sharing water and sewer services , fire protection , youth
services and transportation planning are continually being discussed and
revised . More can be done to cooperate in the use of electronic technology
and in administrative efficiency. Land use planning needs to be considered on
a county or regional basis . It makes no sense for municipalities to be
competing for tax base , when a cooperative , sensible plan for regional
economic development and sharing of the responsibilities and resources
maximizes efficiency and minimizes problems caused by suburban sprawl and
provincialism .
We have developed an ambitious agenda for 1995 . However , our staff, various
boards , committees , and volunteers have proven that they can accomplish
what they set out to do . We , as a Town Board , need to recommit ourselves to
providing the policies , direction , and encouragement necessary to facilitate
that effort .

DEVELOPMENT REVIEW
The Engineering Staff has been reviewing compliance on the
following projects that have received Planning Board approval and
are under construction :
Saponi Meadows Subdivision , Seven Mile Drive
Installation of the sanitary sewer has been completed and
installation of the water main is proceeding slowly due to
weather conditions . The contractor has submitted samples and
test results for the road base material and will probably
begin stockpiling of material on site for use when weather
conditions allow road construction .
Sanctuary Woods Subdivision , Sapsucker Woods Road
Construction of the sanitary sewer is completed and the water
main improvements has been constructed . Record drawings and
engineering certification by the developers engineer are
required prior to recommendation of acceptance of utilities .
The road bed has been cleared and stripped of topsoil and
actual construction of the road will start when the weather
conditions permit . No portion of the road has received
approval be the Town Engineer or Highway Superintendent .
WATER & SEWER
The Westhaven Road and Mecklenberg Road sewer extension is
nearing substantial completion . The flow monitoring station
is the last major item of work remaining . Site restoration
will be completed in the spring .
The Troy Road and Coddingtoh Road water extension project is
substantially complete . As built drawings and test
certifications are being submitted to the Tompkins County
Department of Health for final approval . Final restoration
will be completed in the spring .
The Town Engineer has been working with the City DPW on a plan
for improving the sewage transmission capacity that is jointly
used . The Joint Sewer agreement is under revision by a sub -
committee of the SJS regarding plant capacity and transmission
sewer improvements and maintenance responsibility . One
component of an improved sewer system is expected to be
incorporated in the NYSDOT project for improvements on the
Octopus . Final plans are not complete and I will report to
the Town Board as soon as plans and cost estimates are
available . At this point the City has been negotiating with
DOT regarding the construction of and cost of the betterment
and I expect the City to bond the package and bill the Town on
an annual basis for the appropriate share of the cost .

PEREGRINE HOLLOW SEWER DISTRICT
The Town Engineer has received a request from the Town of
Dryden with an engineering report from Ralph Varn the
developer of the Peregrine Hollow Subdivision in the Town of
Dryden for a sewer connection to the proposed Peregrine Hollow
Sewer District . I have reviewed the application materials and
upon direction from the Town Board I will proceed with an
evaluation and preparation of an agreement to allow the Town
of Dryden to transport sewage through Town of Ithaca sewer
lines . My recommendation will be to have the costs of
improvements required for the Dryden usage paid for by Dryden
and a maintenance surcharge to Dryden will also be set up . At
the present time the extension of service to Peregrine Hollow
has not been approved by the SJS and I do not believe that the
sewer district has state approval . Dryden will be requesting
a purchase of additional capacity in the IAWWTP for this sewer
expansion .
FACILITIES
The Town Engineer has continued to work with the Town -Clerk ,
the Highway Superintendent and the Parks Manager on a
facilities improvement plan , which includes the Town Hall
facilities and the Highway and Parks department needs .
The Town closed on the purchase of the Gatch parcel on January
31 , and plans for improvements are being prepared for a
building permit .
The Town Hall space analysis is proceeding and several
possible sites have received preliminary staff 'evaluation ,
with a summary prepared for the Town Board .

HIGHWAY AND PARKS DEPT . SUPERINTENDENT ' S REPORT , JANUARY 1995
TOWN OF ITHACA BOARD MEETING , FEBRUARY 13 , 1995
Winter arrived in January ! The highway crews worked 655 . 75 hours
clearing snow from the roads , which included 217 . 75 hours of over
time . During January we used 288 . 5 tons of salt . The South Hill
Fire Station was salted nine times and West Hill Fire Station eight
times . They were plowed once .
Although winter finally got here , the Highway crews were able to
complete many General Repairs , Permanent Improvement , Water and
Sewer , and Brush and Weed tasks this month .
The Highway crews worked 164 . 5 hours replacing signs and guide
rails . Replacing signs in the Town involves surveying the roadways
to make sure that the right sign gets installed according to the
Manual of Traffic Control Devices . The second part of our sign
AML program is to record the installation on our inventory program .
The program we have is in danger of becoming obsolete because it
won ' t rein nn nat.iar nmriito , s . The guide rail replacement was done
on Sand Bank Road at the elbow . The elbow is a sharp corner that
continually causes accidents . We are looking at different ways to
solve this problem .
General Repairs work tasks completed by the Highway crews included
regrading at the Town Highway Facility , ditching at various
locations , upgrading air lines in the Highway Facility , and several
equipment training sessions . These projects consumed 804 . 5 hours
of time with 8 . 5 of those hours as over time .
The crews spent 24 hours working at removal of brush along
roadsides , 23 hours of sewer maintenance , and 32 hours at water
maintenance tasks .
During January 159 . 5 hours of time were spent on machinery repairs .
Two of those hours were over time . Tasks completed in machinery
were : complete services of several Town vehicles , repairs to
trucks , rebuilding a lift gate , etc .

PARK AND OPEN SPACE MANAGER ' S REPORT , JANUARY 1995
TOWN OF ITHACA BOARD MEETING , FEBRUARY 13 , 1995
1 . Collection and chipping of holiday trees took 73 hours to
complete this year . The participation rate doubled from 1994 .
A total of 611 trees were collected .
2 . Relatively mild weather in January greatly decreased demands
for snow removal . A total of 117 hours were required . We
received and installed the cab for our John Deere 935 Tractor
with the snowblower attachment which we purchased last year .
We are now equipped to more efficiently maintain our walkways
and sidewalks no matter how deep the snow gets .
3 . Several workshop projects totalling 71 hours were completed .
This included mileage markers for South Hill Trail , new bins
for sign bolts and hardware , our new sawdust collection system
was set up for all our woodworking tools , Town Hall ramp
railing materials were sanded and sealed , and a map rack for
storing Highway and Parks and I-later and Sewer maps was begun .
4 . As time allowed , we continued cutting brush and pruning trees
along our bikeways following up from the i ni r ; ai rl saring done
last fall with our boom mower . Hopefully , this will serve to
mollify some complaints we received after the mower went
through .
5 . Various routine maintenance tasks totalling 316 hours
completed the rest of our effort in January .

Town Planner' s Report for February 13 , 1995 Town Board Meeting
DEVELOPMENT REVIEW
Planning staff has been working on the following projects under Planning Board
review jurisdiction:
First Residents Group at EcoVillage, Mecklenburg Road
Town Board approved proposed SLUD and conceptual plan for 30 dwelling
units ( 15 duplexes) and a community center clustered on a 30 acre parcel at
the EcoVillage site at the January 30, 1995 meeting. The First Residents' Group
is tentatively scheduled to appear before the Planning Board at the March 7,
1995 meeting for preliminary subdivision and site plan approval.
South Hill Industrial / Retail Complex (DigiComp), Danby Road
This modification of a previously approved site plan (Novarr), now consisting
of 32,500 sq. ft. of retail / office / industrial use in three new buildings and 5,000
sq. ft. of office /industrial use in an existing building received final site plan
approval at the February 7, 1995 Planning Board meeting .
Buttermilk Valley Estates, Danby Road
70 lot cluster subdivision proposed on 74 + / - acres adjacent to La Tourelle.
Planning Board approved a Scoping Outline for the Environmental Impact
Statement (EIS) at the January 17, 1995 meeting. The applicant is now in the
process of preparing the EIS.
Ithacare Senior Living Community, Danby Road
The Scoping Outline for the EIS was approved by the Planning Board at the
January 3, 1995 meeting. The applicant is now preparing the EIS. Staff has
met several times with the applicant to provide feedback on sections `of the
EIS. _
Bell' s Convenience Store, Elmira Road
The Planning Board granted preliminary and final site plan approval for the
modification of interior space at Bell's Convenience Store, located at 614 Elmira
Road, at the December 20, 1995 meeting. This involved change in interior use
from convenience store to administrative offices (Roscoe Woodworking) .
Gatch Subdivision, Seven Mile Drive
Preliminary and final subdivision approval was granted for the resubdivision
of two lots at the January 3, 1995 Planning Board meeting. This involves the
lot which was recently acquired by the Town to add to the Highway and
Parks facility.
First Assembly of God Church, Recommendation on Sign Variance, Bostwick Road
Planning Board gave a positive recommendation to the Zoning Board of
Appeals for the installation of a sign announcing the future construction of the
Church (which has received preliminary site plan approval from the Planning
Board) at the January 17, 1995 meeting.
Shore /Moen Consolidation of Lots, Mitchell Street
Planning Board granted preliminary and final approval for the consolidation of
lots at the Black Oak Lane subdivision on February 7, 1995 . Lots were
purchased by residents of the Black Oak Lane Condominiums . Consolidation
was for tax assessment purposes.
Cornell University, Mail Processing Facility, Route 366
Preliminary and final site plan approval were granted at the February 7, 1995
Planning Board meeting for conversion of an existing 11 ,700 s .f. warehouse
and garage to a mail processing facility. A positive recommendation was also
given to the Zoning Board of Appeals for Special Approval of said use.
ZONING BOARD SEOR REVIEWS
Staff completed the following SEQR reviews for the Zoning Board :
James Hider, 1134 East Shore Drive - Variance to build an addition to an
existing non-conforming house. Also height variance (32 ft requested, 30 feet
permitted).
Thompson, 101 Snyder Hill Road - Use variance to operate a non-residential
dental office with four employees.
Charles Welch and Sylvia Gatch, 110 Seven Mile Drive - Variances for
insufficient lot size and setbacks for the resubdivision of two lots. ` =
First Assembly of God Church, 197 Bostwick Road - Variance - to install sign on
future site for a new church. Sign Law allows for a sign when construction
has commenced (church has not yet received final site plan approval from the
Planning Board).

Stephen and Patricia Lucente, 3 and 4 Sanctuary Drive - Variances to construct
two new two-family homes without the required road frontage. Fourteen lots
received final subdivision approval in September 1994, but the plat has not yet
been signed or filed, since some of the conditions of approval have not been
met. Road is not far enough along for Town to accept the road or a letter of
credit.
Cornell University, Palm Road - Special approval to relocate mail processing
facility in a partially vacant warehouse / garage in Precinct 71
Stephen Nash, 261 Coddington Road - Special approval to add a second
dwelling unit to a non-conforming house / lot (insufficient lot width) . Parking
will be added to accommodate second unit.
CURRENT PLANNING DEPARTMENT PROTECTS
Planning Department staff is working on the following projects :
Environmental Atlas : Intern from Cornell Natural Resources Dept. will begin work on
project in February.
Conservation District: Planning Committee has prepared a further revised draft (3 . 0)
of a proposed Conservation District. Further research on densities, possible
boundaries, and size, uses and owners of properties in the Six Mile Creek area will
be forthcoming.
Fees in Lieu of Parkland : Town Attorney has prepared draft for Codes and
Ordinances Committee's consideration. The draft has been circulated to other boards
and committees for comment. Planning Committee reviewed and sent comments to
COC for their consideration. Staff has completed additional research on land values
in MR and R-5 Districts (these were . not included in the original research) to provide
a basis for setting fee amounts. COC is in process of revising draft proposal.
Sunset Provisions for Subdivision Approvals : A proposal to extinguish abandoned
subdivisions was forwarded to the Planning Board for their consideration as an
amendment to the Subdivision Regulations. This was discussed, and a public hearing
was held at the Nov. 15th Planning Board meeting. Concerns were raised by the
public and board members on the proposal, and in particular, about the short length
of time in which a subdivision approval would be extinguished if no sale of lots or
commencement of construction of required improvements occurs (within 3 years of
final approval) or substantial completion of construction of improvements (within 5
years) . The Planning Board has scheduled a follow-up discussion with
builders / developers at the February 28, 1995 meeting, after which a recommendation
will be sent back to the Codes and Ordinances Committee.

I_thaca-Tompkins County Transportation Council (ITCTC ): Final revisions to the 2015
Long Range Plan were made for the Policy Committee' s consideration . Staff is also
participating on a consultant selection committee for the county-wide trail / corridor
study that is scheduled to begin later this year.
Parks , Recreation and Open Space Plan Update: Staff continues to meet with the
Parks and Greenway Committee of the Conservation Board on this project. Three
chapters, "Goals and Objectives ", "Inventory" and "Analysis " have been completed in
draft and circulated to the Parks and Greenway Committee for comment. Two
remaining chapters on recommendations for future parks, trails and open space and
proposed capital improvement plan are underway, and should be completed in draft
within the next month.
Cornell GEIS / SLUR : Staff has assisted the special Town Board committee in
reviewing the GEIS Findings and proposed Special Land Use District (SLUR) for
Cornell ' s Precinct 7. Committee met with representatives from Cornell to discuss
possible revisions to SLUD . April 10th is target date to bring consideration of
adoption of SLUD back to Town Board.
Annual Report: The Planning Department's Annual Report for 1994 was prepared
and submitted to the Town Board at the January 9th Town Board meeting.
1995 Proposed Priority Work Plan: Planning Department prepared a Proposed
Priority Work Plan, met with the Planning Board, Planning Committee, Codes and
Ordinances Committee and Conservation Board to discuss department priorities,
revised the plan based on those discussions, and submitted the plan to the
Supervisor.
South Hill Recreation Way: Staff has completed final accounting and voucher
materials to submit to the State for final project closeout.
Wal-Mart DEIS: Staff has begun review of the Draft Environmental Impact Statement
(DEIS) received from the City and has discussed coordinating comments with the
Planning Board and Environmental Review Committee. Comments to the City are
due on March 10, 1995. This will be scheduled for discussion at either the February
28th or March 7th Planning Board meeting.
Cayuga Lake Waterfront Planning The Planning Department participated in
discussions with City, County and other officials, including the Chamber of
Commerce, to look into the possibility of a joint program to enhance the Cayuga Lake
waterfront. The County is preparing a grant proposal to conduct a strategic plan for
the southern end of the Cayuga Lake waterfront to promote the scenic and
recreational assets of the area, and is requesting funds from the local participants to
assist with this study. This appears to fit in with the public access feasibility study
which the Town Board has previously discussed .

Affordable Housing Proposal , DeHarder Investment Corp.: Staff has spent
considerable time over the past month discussing a proposed affordable housing
project with a Florida development group (DeHarder Investment Corp . ) . Staff has
provided demographic, land use and zoning information to DeHarder for several
areas of the town, and has responded to questions regarding the town's development
review process . DeHarder is in the process of preparing a concept plan and lining
up possible funding sources, and will be requesting to appear before the Town Board
at the March 13th meeting to discuss the project.
HOMES, Inc. Proposal for Halfway House: Staff met with HOMES, Inc. to discuss a
proposal for a halfway house for recovering alcoholics to be located in the town.
This residential care facility would include fourteen beds in a 5,000 square foot
structure . The process, which comes under the N. Y. S. Site Selection Law, would
involve notification to the Town Board of the proposed site and project. The Town
Attorney is researching whether this would also have to go through the Town' s
special approval and site plan review procedures .
Eastern Heights Park Dedication of General Purpose Land as Parkland : The Planning
and Engineering Departments have done some additional research and prepared
materials to assist the Town Board with its discussion of the possible dedication of
the General Purpose Land at Eastern Heights Park as parkland . A memo and maps
are included in the February 13th meeting packets .
Inlet Valley Parkland: The Planning Department assisted the Supervisor and Town
Board with research regarding several parcels in Inlet Valley. Research focused on
-.. the parcels' potential use as parkland.
Development Review Escrow Accounts : Staff is in the process of bringing the
development review escrow accounts up to date. These accounts are used for
chargeback of staff time involved in subdivision, site plan and environmental
reviews, as well as site inspections .

Records Management : Work progresses on rehousing the archival
documents in acid free containers . The vault is presently being
reorganized and inventoried . The Planning and Engineering
Departments have been reorganizing records and sending documents
for storage to the inactive records center . The Interim Narrative
Project Report , SARA Archival Grant has been completed and
submitted for approval as a consent agenda item .
Town Clerk : Preparation , distribution , transcription and follow up
of the two Town Board meetings were the main projects for the
month . An improved system is being developed to free more time for
other duties by the Town Clerk .
A review and recommendation will be made in the next few weeks
regarding the process for taking and transcribing minutes for all
Boards .
The Cat Licensing Task Force will soon meet to discuss the method
of presentation needed to encourage enactment of a cat licensing
local law by Tompkins County ,
Tax Collection : The Town of Ithaca warrant was fully met on
January 31 , 1995 , monies received from that date will be County
funds .
The collection process went very smoothly , even though the last few
days of the month were extremely hectic . Deputy Receiver , Betty
Poole and Deputy Clerk , Mary Saxton are commended for their hard
work and dedication to the " cause " . A special thanks to Sally
Alario , Jacque White , and George Eberhardt for their wonderful
help . Their efforts contributed to a major task being accomplished
in less time . Also , thank you , to all staff who graciously
answered phone calls on days when the collection process was
overwhelmingly busy . " Outstanding team work in effect " .
The Deputy Receiver of Taxes is compiling a cost accounting of tax
collection so the Town Board may better understand the fiscal
implications of the process .
Many residents voiced displeasure they did not receive the tax
bill , or that names and addresses had been left unchanged after
notification of changes . Many complaints , this year as before ,
were received indicating the bill was confusing and looked like
" junk mail " . All comments and notification of changes will again
be forwarded to -- the proper Tompkins County department ,
espectfully submitted ,

REPORT FOR JANUARY 1995
January is a very busy month for our department . In addition to
regular duties , careful attention must be paid to year - end
transactions and balancing . Jackie and George are experiencing
their first year - end and they are certainly learning a great deal .
Much of the month was spent accumulating data for encumbering and
accruing year end expenditures and revenues . This process will
continue until mid - February . Along with this we are trying to
gather as much of the information that the auditors will need as
possible .
Time was spent reviewing solicitations from utility auditing
companies . These companies will audit our telephone or other
utility bill to see if we are eligible for refunds on tariffs or
other charges . This has worked well for other municipalities and
school districts .
I am studying some proposals from banks offering various
electronic banking services . Some of the services include tax
collection , payroll , investments , and electronic transfers . A
basic overview will be presented to the Finance Committee at their
February 13th meeting . We will then decide if we want a more
detailed investigation done on these services .
Jackie White has launched into networking . She is gathering
information on what networking does , what the Town needs and wants ,
and what system may best serve the Town . This will be a difficult ,
on - going job in addition to regular duties and I ' m pleased that
Jackie volunteered . Her expertise in this area will be of great
value during the whole process . She will be working with Mike
Ocello who will report back to the ADP Committee periodically .
Jackie will be starting a six week course at BOCES on networking in
February .
The beginning of a new budget always brings high volume
purchasing . We have been busy handling requests from all
departments , as well as requesting quotes for some large items like
computers and a copier .
The fourth quarter 1994 county sales tax to be accrued is
$ 464 , 574 . 000 - $ 111 , 999 . 59 of this will go to General Outside
Village Funds . The remaining $ 352 , 574 . 41 will go to General
Townwide Funds and be closed to the capital reserve .

PERSONNEL MANAGER ' S MONTHLY REPORT FOR
JANUARY 1995
PREPARATION FOR ANNUAL AUDIT AND TAX REPORTING
January is the busiest month for the Personnel Manager . In my
role as supervisor of the Town ' s payroll operation , all salaries ,
taxes , third party sickpay , employee deductions , especially three
pre - tax deductions must be carefully balanced between amounts
paid and figures reported and all discrepancies corrected .
Salaries paid were also balanced to the Town ' s monthly financial
reports , an involved process , in preparation of the annual audit .
This was George Eberhardt ' s first year - end , therefore extra care
was required in balancing . The annual wage statements , W - 2 Forms
were processed and mailed to employees before the January 31
deadline . Other required statements , the 1099R forms were sent to
retirees and the 1099M forms were mailed to independent
contractors . Federal and State counterparts of these reports will
be mailed in February . I am now receiving the usual flurry of
questions regarding salaries reported and duplicate forms for
those who moved without forwarding addresses .
I discovered an incorrect calculation in the annual NYS Income
Tax Report generated by our payroll program . Our program support
people are researching the problem and have notified their other
clients ; however , we will be forced to recalculate and re - type
this ten page report in order to meet the filing deadline in
February . A temp . may be hired for this typing .
IRS / SSA / HCFA data reports were completed for three former
employees - an unexpected burden at this time of year .
Long - term debt calculations for the annual financial report and
audit were completed for the NYS Retirement amortization and
incentive payments , annual vacation accruals , and retirees '
sickpay banks held in reserve for health and dental payments .
The deferred compensation reporting amounts still have to be
calculated .
The usual salary and deduction updates and changes went smoothly
and a new method for payment of the accrued salaries for 1994 and
new salaries earned , produced two labor distribution reports to
simplify the Accounting Department ' s task ( both for the Town and
SCLIWC ) of charging the . 100 accounts for the appropriate year .
At the same time , the child support collection units have been
busy and added three new employees to our garnishee list ,
necessitating a change in our payment method .
LEGAL CONCERN
After assessing an employee ' s tax withholding request was
questionable , I spoke with the Town ' s tax accountant for
advisement , then consulted Town Attorney , John Barney , for a
determination in the matter . I am proceeding as instructed by
Mr . Barney to relieve the Town of possible future liability in
the matter while assuring the employee his rights .
WASHINGTON D . C . UPDATES
On January 12 , I attended a meeting sponsored by the Tompkins
County Human Resource Assoc . An aide to Maurice Hinchey provided
updates and proposed changes being discussed in Congress that
affect personnel management , benefits , and their related tax
implications .
WORKERS ' COMPENSATION
The semi - annual audit of the Town ' s payroll and financial records
for the period July 1 , 1993 through June 30 , 1994 , was performed
on January 17 , 1995 by our workers ' compensation carrier , State
Insurance Fund . All records were in order .
U . S . Dept of Labor report , OSHA 200 - a log detailing work related
injuries and occupational illness reported in 1994 , was completed
in time for the required posting on February 1 , 19959
HEALTH INSURANCE
Our new Blue Cross / Blue Shield Contract took effect January 1 . I
answered many questions from employees and retirees throughout
the month concerning the change in the prescription plan . As
expected , those who fill the largest amount of prescriptions are
feeling the pinch . The lack of generic drugs for many subscribers
has been higher than anticipated . The reduction in premium was
welcomed by all .
COMMERCIAL INSURANCE
Our new agent , Sprague Insurance Co . , has taken the reins on the
Town ' s general liability , auto , excess , and other insurances as
of January 1 , 1995 . The transition from old to new insuring
companies has gone smoothly so far .
Several claims were filed at the turn of the year , some charged
to our former carrier , some to the new : 1 - auto claim , 2 -
liability claims .
PERSONNEL UPDATES
Assistant Zoning Officer / Building Inspector , Patricia Keller ,
Highway Mechanic , John Williams , and Account Clerk / Typist , George
Eberhardt , underwent their six - month probationary reviews . All
have been recommended for regular appointment . Gene Redman , who
was appointed Acting Highway Crew Supervisor on October 7 , 1994 ,
was recommended by the Personnel Committee for a temporary salary
increase and official approval of his appointment on February 13 .
Recruitment has begun for the new part - time secretary position
for the Personnel / Insurance Department . Interviews were scheduled
for candidates from the Civil Service List of Eligibles , but none
of the six individuals chose to interview . I then advertised to
the general public and have six candidates scheduled for
interview on Wednesday , February 15 .
Several temporary employees have been recruited , including :
Charles White , Engineering Technician , Joan Anderson , P / T CAB
secretary , Tom Mordue , P / T Engineering Aide , Geraldine Tierney ,
P / T Planning Aide , and through a first time work - study contract
with Ithaca College , D . Alan Pytcher , Planning Aide .
PERSONNEL COMMITTEE
AGENDA ITEM # 1 : Welcome and brief orientation of new committee
members , Ellen Harrison and Stephen Smith ,
AGENDA ITEM # 2 : Update on Civil Service Status ,
AGENDA ITEM # 3 : Set date and procedure for longevity awards .
Action : Date set for February 24 , 1995 in conjunction with
regular payroll run . Service dates used will be year
of service through December 31 , 1994 .
AGENDA ITE14 # 4 : Evaluation of salary increase procedure for
probationary employees with less than six months service on
January 1 .
Action : Discussion on subject . Input by Department Heads
requested . Adjourned to February meeting .
OTHER ITEM : Committee will begin to formalize many of the Town ' s
personnel and salary procedures .
