Town Board Meeting Minutes
November 10 , 1994
At a regular meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York held at the Town Hall , 126 East Seneca
Street , Ithaca , New York there were present :

Call to Order : The Supervisor called the meeting to order at 5 : 30
p . m . , and led the assemblage in the Pledge of Allegiance .
Agenda Item No . 3 - EXECUTIVE SESSION :
Motion made by Supervisor Whitcomb , seconded by Councilman Niklas
to move into executive session to consider personnel , potential
litigation , and property acquisition . Carried unanimously . The
Board moved into executive session at 5 : 32 p . m .
Motion made by Councilman Niklas , seconded by Councilwoman Grigorov
to return to regular session . Carried unanimously . The Board
moved back to regular session at 6 : 10 p . m . No action was taken as
a result of the executive session .
Agenda Item No . 7 - Tompkins County Board of Representatives
Report :
Beverly Livesay - The County Board has been working diligently on
the 1995 budget . A discussion was held with Town staff about the
ways governments can cooperate and share services . Consolidation
may not be the best avenue doing some things .

Mrs . Noteboom - Last year the County Board of Elections used new
sign in books at the polling districts . The books are printed by
an agency outside the County . In 1993 there were some mistakes in
the books , an assurance was made it would not reoccur . In four of
the Town districts books this year there were two boxes with the
voters names . One name was a facsimile of the persons signature ,
and the other was for the individual to sign . The name above the
facsimile signature in some books was not the same as the
computerized printed name . The election inspectors had to ask for
identification and alter the computerized printed name so the
signature would match the voter . Some voters were not happy they
had to present identification . In some cases the facsimile
signature was blocked out and could not be read .
Agenda Item No . 7 - PERSONS TO BE HEARD :
No persons came forward to be heard .
Agenda Item No . 27 - Approval and Award of Truck Bid :
Mr . Noteboom - Two bids were received for a new 4x4 Dump Truck with
Plow to be used by the Parks Department to replace a ( 1 ) ton truck .
The bid asked for prices with and without a trade . It has been
determined more revenue would be realized from the sale of the old
truck at auction rather than the amounts offered by the bidders .
Mr . Noteboom recommended the Board accept the bid from Spencer
Ford , Inc . without trade for $ 27 , 710 . 00 . Both bids met the
specifications and were qualified .
Councilman Conley - It was advertised for a trade in , and the trade
price was asked for ?
Mr . Noteboom - Two prices were asked for in the advertisement , one
with trade and one without trade . Spencer Ford had the lowest bid
without trade .
Motion made by Councilman Niklas , seconded by Councilwoman Harrison
authorizing and directing the Highway Superintendent to purchase
one new 4x4 Dump Truck with a plow as specified for the price of
$ 27 , 710 . 00 . The Board approves and authorizes an increase to
account B7140 . 201 ( Equipment ) and an increase to B599 ( Appropriated
Fund Balance ) for $ 26 , 710 . 00 to cover the cost of the vehicle .
Carried unanimously .
Councilwoman Harrison - How was it determined the old truck would
be worth more at auction ?
Mr . Noteboom - Roy Teitsworth , Municipal Auctioneer was asked to
give an estimated value of the vehicle , he estimated $ 10 , 000 at
auction . Mr . Tettsworth will personally guarantee at least what

the highest bidder had proposed . At last year ' s auction a 1986
truck in good condition like this vehicle brought over $ 13 , 000 .
The bidders offered around $ 6 , 000 .
Agenda Item No . 4 - Report of Town Officials :
a . Town Supervisor - See attached report . The Board members have
a brief description of the Annual Meeting of the Association of
Towns meeting in New York City in February , anyone wishing to
attend inform the Town Clerk .
b . Town Engineer - See attached report .
c . Highway / Parks Superintendent - See attached report . Comments
about the road tour are welcome . Board Member ' s who wish may
arrange to go in a plow truck this winter to see what it is like .
Councilwoman Harrison - The road tour was terrific .
Councilwoman Valentino - The Board should definitely have a tour on
a regular basis , it was very informative .
e . Building Inspector / Zoning Officer - See attached report . Fire
safety inspections are underway .
d . Town Planner - See attached report . The Echovillage Slud will
come to a vote by the Planning Board on November 15 , with the Town
Board receiving it after that time . The Codes and Ordinances
Committee has revised the Sunset Provisions draft and presented it
to the Planning Board for their consideration . This would be an
amendment to the subdivision regulations .
f . Town Clerk / Receiver of Taxes - See attached report .
g . Assistant Budget Officer - See attached report .
Supervisor Whitcomb - The Town has received an award from Challenge
Industries for hiring handicapped individuals . George Eberhardt ,
hired through Challenge Industries also received an award for being
an outstanding employee . Congratulations !
h . Personnel Manager - See attached report . Insurance applications
are coming in . The staff attended employee benefit information
sessions with many good discussions resulting .
i . Attorney for the Town - The last set of deeds and documents have
been received regarding the Park Lane Extension ( Quick property ) .
Supervisor Whitcomb - The Department Heads put in a lot of time
providing these reports . They are well done and board members are
encouraged to read them ahead of the meeting .

Councilwoman Valentino - Receiving them before the meeting is very
much appreciated .
Councilman Niklas - Since the Board does not ask questions , it
indicates that the Board likes the reports .
Agenda Item No . 5 - Correspondence :
Supervisor Whitcomb - Letter from Deane and Susan Cook of Marcy
Court requesting a change in the speed limit and the installation
of stop signs . Referred to the Highway / Parks Superintendent ,
Mr . Noteboom - Discussions have been held with the Cook ' s
explaining the process for changing the speed limit . An agreement
was made there should be Children at Play signs installed . One of
the additional agenda items is for changing the traffic ordinance
to include installation of the stop signs requested . There are
stop signs needed at the end of Saranac Way and Marcy Court , and a
Dead End Sign needs to be installed at Marcy Court .
Motion made by Councilman Niklas , seconded by Councilwoman
Valentino authorizing the Town Clerk to advertise for a public
hearing to be held on December 12 , 1994 at the regular meeting of
the Town Board to consider an ORDINANCE AMENDING THE ORDINANCE
REGULATING TRAFFIC AND PARKING IN THE TOWN OF ITHACA to include a
stop sign on Saranac Way at both intersections with Whitetail
Drive ; a stop sign on Teton Court at Whitetail Drive ; a stop sign
on Marcy Court at Whitetail Drive ; and a stop sign on Saunders Road
at East King Road . Carried unanimously .
Agenda Item No . 6 - Report of Town Committees :
Councilman Niklas - The modified Sunset Provisions will be heard by
the Planning Board on November 15 , if passed the Town Board could
set a public hearing for January .
Councilwoman Grigorov - The Planning Committee has been working on
conservation zones . Some individuals who do not wish for the area
to be zoned as such attended the last meeting to offer comments .
Agenda Item No . 9 - Town Hall Space Study , Holt Architects :
Holt Architects has been retained by the Town to review a program
study for a new Town Hall , Doug Look is present to provide an
overview of the progress of this study .
Mr . Look discussed the code issues , space data sheets , and thoughts
on program adjacency , and new construction versus renovation . No
specific sites have been reviewed . Program information was
compiled from the space needs study by the Department Heads . There
are three scenarios for assigning spaces for different program

functions .
Program I is the most inclusive and includes all the spaces
requested and assigning square footage . There are more conference
rooms in this scenario , and the Department Head offices are larger ,
12 ' x15 ' .
Program Analysis lA takes all the spaces and downsizes some of the
program spaces in office areas to create a more moderate analysis .
Analysis II has moderately sized program elements with proposals to
consolidate areas . The square footage ranges from 14 , 000 down to
12 , 000 .
Councilwoman Harrison - What is the current space available in the
Town Hall ?
Mr . Look - Around 6 , 000 to 7 , 000 square feet without the court
space .
Councilman Niklas - The Justices ' store most all their documents at
home as no storage is available on Town property .
Councilwoman Harrison - Is it feasible to have the court use the
Town Board room ?
Mr . Walker - Not with the present meetings held in the Board room .
Attorney Barney - The court space will be utilized at least twice
a week , and will be the area to hold the court records .
Councilman Niklas - This area could also hold computer equipment so
the Justices could have a link with Albany .
Mr . Holt - All the spaces will be reviewed to provide multiple use
functions . The present program shows a Board room to seat up to
100 persons and a court room to serve approximately 50 . If there
was ever a need for the court to have a space larger than that a
schedule would be made to use the larger area . The Analysis ' are
broken down by - the different functions and departments . There are
also shared spaces . For the purposes of these analysis a one
story solution has been used . The net to gross ratio is 1 to 1 . 3 .
A multi level solution would have to be adjusted up to 1 . 5 because
stairs and elevators have to be provided .
Councilman Niklas - Is the cost difference in Analysis I and II
proportional to the growth footage difference ?
Mr . Look - Yes , there is no particular savings at this level . A
building twice as large would show a significant difference . The
costs are based on a square footage basis . The assumption has been
made for $ 100 per square foot depending on a specific design .

Depending on where the new Town Hall is located , town site versus
a city site ; different building regulations will have to be
complied with .
A site within the business district in the City would not allow
construction of a wood frame , Type 5 . There would be more
flexibility if it were built on a Town site . In the City it would
have to be a masonry exterior with wood frame inside . The type of
construction would effect the cost .
A cost range for ordinary construction may be from $ 90 . 00 to
$ 110 . 00 per square foot . This would depend on specific design and
the level of finish , a wood frame may drop the cost to $ 80 . 00 to
$ 100 . 00 . Specific cost will be detailed at a later date after
design development . The analysis has a design contingency of 15 %
because not everything is known about the program . Soft costs have
been included to cover miscellaneous items . Acquisition of the
site is not included in the projected cost .
Attorney Barney - What is the difference between the design
contingencies and the architectural fees ?
Mr . Look - Design contingency is not meant to cover professional
services , it is to cover a variation in the cost if the facility is
upgraded from the original .
Supervisor Whitcomb - The possible cost could be $ 1 . 5 million to $ 2
million depending on the construction / renovation , land acquisition ,
and furnishings ; higher than what was hoped .
Mr . Look - The intent at this point is to allow the analysis to be
used as a tool for setting a budget . No specific site has been
evaluated in respect to usage of a building already constructed .
Supervisor Whitcomb - The plan originally was to look at what a
generic new building would cost . Then the local real estate
industry can be notified to see what present buildings are
available within or outside the City which could be remodeled .
Those properties could be evaluated to compare purchase price and
renovations with the generic cost of a new building to help
determine the best alternative .
Councilman Niklas - The Town Board should review this information
and start looking at available properties within the - Town and City .
Parking restrictions may offer more opportunities in the Town than
the City .
Mr . Look - The process of compiling all the program information and
looking at a concept design solution is underway . Recommendations
will follow for new construction including a single story , a
multiple story building , and City versus Town . A report will be

provided compiling this information .
The City versus Town issue will have to be looked at carefully . In
all discussions with staff , parking is a big item . The staff would
also like to diminish the feeling of separateness of the various
departments . The design solution may be better as a one story
dwelling rather than a multi story . In the City business district
with the present foot print of 12 , 000 to 12 , 000 square feet , it
would have to be a multi story building .
Councilwoman Harrison - The Town Board has had conversations
regarding policy , they would support the building being in the City
as a center core to the Town . There are strong feelings among some
of the Board members that the City is a more proper location . Some
of the large rooms for meeting rooms do not have to be on the same
level as staff .
Mr . Look - In some areas parking would be on the street or in the
ramps .
The program elements have a corresponding space description sheet
which details functions . All Department Heads will review and
modify them as necessary . This information will be compiled and
finalized within the next few weeks .
Councilwoman Harrison - Is this based upon existing staff or
projections of future staff ? Has the Supervisor looked at the
comparison of the existing versus the projected ?
Supervisor Whitcomb - The staff projections include the staff
proposed for the next ten years and has not yet been studied in
detail .
Councilwoman Grigorov - Why are Town Board offices projected ?
Mrs . Noteboom - It was thought the Board may wish to work on
projects at Town Hall , however those offices could be eliminated if
the Board chose .
Councilwoman Harrison - If Analysis I is the " wish list " , Analysis
II is a modified version , and Analysis II is a paired down version ,
more could be taken off .
Mrs . Noteboom - The individual description sheets will be reviewed
and amended by the Department Heads ,
Councilwoman Harrison - Program Analysis II seems as slim a version
as feasible . Town Board offices are not necessary , and a
conference room could be used by the Board .

Councilman Niklas - It is not clear what is being asked . It would
be interesting to see what the upper limit would be . The Board can
always downgrade . It would be nice to see the maximum . boundary
conditions and say it will probably not cost more than that to get
something workable . The minimum boundary conditions are almost
indefinable unless nothing is going to change in terms of staff and
the amount of space needed . This is defined with some room for
growth .
Councilwoman Harrison - The Supervisor must look through this and
decide what is really needed .
Mr . Look - The reason this information was presented is to react to
it and define the space more clearly . Mrs . Noteboom or Mr . Walker
should be notified with suggestions .
Supervisor Whitcomb established a committee of Supervisor Whitcomb ,
Councilman Klein , Mrs . Noteboom , and Mr . Walker to review these
projections .
Mrs . Noteboom - All the Department Heads will be involved in the
complete process .
Mr . Look - No specific sites have been considered . There would be
different issues to review for renovation rather than new . Many
issues would be related to the building code .
Agenda Item No 14 - Public Hearing , Traffic Ordinance No Parking
Orchard Hill Road :
The Supervisor opened the public hearing at 7 : 00 p . m . The Town
Clerk had proof of posting and publication and the Supervisor asked
for public comment .
Ray Small , 3 Orchard Hill Road - Why is this " no parking " being
considered when there are no problems ? There is no need for " no
parking " there . If it were instituted it would have to be
enforced . Could the land be posted ?
Mr . Noteboom - Councilman Conley was contacted by a member of the
public who said during hunting season people park their recreation
vehicles at the end of the road all night and created a lot of
noise . The Sheriff was unable to do anything about this parking
unless there was an ordinance prohibiting parking .
Supervisor Whitcomb - What is unclear is why these people requested
" no parking " on Orchard Hill Road when they do not live near there .
Councilman Conley - The concerns were from two residents who lived
towards the end of Orchard Hill Road . The problem was at the end
of the cul - de - sac . One resident called on behalf of two others ,

three residents were upset .
Supervisor Whitcomb - Do these residents actually live on Orchard
Hill Road , if so they would have received notification of this
public hearing .
Mr . Noteboom - A notice was hand delivered to all the residents on
the road .
Councilman Niklas - Do people who live along the road , use the road
for parking ?
Mr . Small - No , they may if they have a large gathering .
Councilman Niklas - If the objection is people parking overnight ,
could the road be posted for no overnight parking .
Councilman Conley - The gentleman who requested this was told he
would have to contact the people in the neighborhood and that if
anyone had any objections to let the Town Board know . The people
who own the land have access to it from the cul - de - sac and are
parking on the road .
Councilman Niklas - Ownership of the property does not give someone
unrestricted rights .
Councilwoman Grigorov - When this issue was first presented the
Board was given the impression they were parking near the houses ,
but it is not at all near them . Is anyone here tonight who is in
favor of this " no parking " .
Councilman Conley - Gus Freeman and Ed Austen were the residents
who made the inquiry , they are not present .
Rich Armstrong , Orchard Hill Road - The two individuals who
requested this do not live on the road . This is a hunting issue
not a parking issue . There has been no problem with hunters at the
cul - de - sac for six years . Homeowners have parties and people do
park on the road . A " no parking " is not appropriate at all , it is
a dead end . If " no parking " is instituted it should be consistent
with the other dead ends in the area .
Vicky Gail , Orchard Hill Road - I am against the ordinance because
it would not be appropriate at other times when owners want to have
a large gathering and need parking on the road .
The Supervisor closed the public hearing at 7 : 15 p . m .
Councilman Niklas - How many homes are on the road ? Has anyone who
lives on Orchard Hill Road written or called asking that this
ordinance be passed ?

Supervisor Whitcomb - No one who actually lives on the road and
there are less than ten homes on the road .
Attorney Barney - Has anyone from Orchard Hill Road other than
these non residents had the experience of being disturbed by the
hunters ?
Councilman Conley - It was my understanding the complainant lived
on the road and it was bothering them .
Supervisor Whitcomb - Mr . Noteboom , is there a safety issue with
people parking on that road regarding snow removal , fire
protection , etcetera ; particularly near the cul - de - sac ?
Mr . Noteboom - There has been no problem with those issues as of
yet .
Attorney Barney - If the Board ' s decision is not to pass this
ordinance the SEQR can be skipped .
Agenda Item No . 15 - SEQR , Traffic Ordinance No Parking Orchard
Hill Road :
No action taken .
_Agenda Item No . 16 - Enactment , Traffic Ordinance No Parking
Orchard Hill Road :
Motion made by Councilman Niklas , seconded by Councilwoman
Valentino enacting an ORDINANCE AMENDING AND RESTATING THE
ORDINANCE REGULATING TRAFFIC AND PARKING IN THE TOWN OF ITHACA , to
include no parking on Orchard Hill Road . The Town Clerk is hereby
authorized and directed to file the said Ordinance as required by
law and to send a certified copy of the said ordinance to the
Tompkins County Sheriff ' s Department who shall enforce said
ordinance . Roll call vote : Supervisor Whitcomb , nay ; Councilwoman
Valentino , nay ; Councilman Niklas , nay ; Councilwoman Grigorov , nay ;
Councilwoman Harrison , nay ; Councilman Conley , abstain . Motion
defeated .
Councilwoman Harrison - In the future the Board should received a
request in writing so it is known who and where .
Agenda Item No . 10 - Consent Agenda Items •
Motion made by Councilman Niklas , seconded by Councilwoman
Valentino approving and / or adopting the resolutions for Consent
Agenda Items 10 ( a ) - 10 ( f ) , 10 ( h ) , 10 ( i ) as presented . Carried
unanimously .

Agenda Item No 11 - Chancres Blue Cross / Blue Shield Contract :
Ms . Punger - Explanations of options for health insurance have been
presented to the Board . These options were considered to defer the
28 % increase for 1995 . Changing the method of co - payment on
prescriptions by paying $ 5 . 00 for generic drugs and $ 10 . 00 for
brand name drugs will allow the premium to be rolled back to below
what is being paid currently .
Positive feedback has been received on the employees willingness to
help participate by paying more out of pocket expense in order to
keep the premiums under control . The $ 5 / $ 10 co - pay helps to reduce
the loss ratio each year . All options reviewed take the Town out
of a large group . Next year with only the Town ' s employees
experience rating it is not known how the rates will be effected .
I personally would prefer to stay with the present coverage . The
Supervisor requested exploring other options . The $ 5 / $ 10 is being
recommended because it does help to keep the losses down . A 28 %
increase for 1995 would have been realized if the coverage were not
changed .
Motion made by Councilman Niklas , seconded by Councilwoman
Valentino approving purchasing the Blue Cross / Blue of Central NY
Regionwide II coverage with $ 5 . 00 Generic and $ 10 . 00 Brand Co - Pay
Prescription Card effective , December 30 , 1994 . Carried
unanimously .
Agenda Item No . 12 - Services Contract Insurance Consultant :
Motion made by Councilwoman Valentino , seconded by Councilman
Conley approving the extension of the insurance consulting services
by Robert Boothroyd through the end of the request for proposal
process for a fee not to exceed $ 100 . 00 , charged to account
A1910 . 400 . Carried unanimously .
Agenda Item No . 13 - Employee ' s Salaries 1995 :
Ms , Punger - The salary sheets are in the back of proposed 1995
budget .
Motion made by Councilman Niklas , seconded by Councilwoman
Valentino approving the salaries of the Town Employees for the year
1995 as per the Preliminary Budget . Carried unanimously .
Agenda Item No . 19 - Delinquent Water and Sewer Charges on 1995
Town and County Taxes :
Motion made by Councilwoman Valentino , seconded by Councilman
Niklas authorizing and directing the Receiver of Taxes to add to
the tax roll for 1995 the amount of $ 35 , 052 . 35 for Delinquent Water

and Sewer Charges including penalties . Said delinquent amount is
to become due and collectible as part of the tax bills for the Town
of Ithaca which will be mailed to property owners on December 30 ,
1994 , and which will become due in January 1995 .
Councilman Conley - There were conversations prior to the meeting
that some of these delinquents are for absentee owners who do not
know the accounts are not delinquent . It has been mentioned that
a policy should be adopted to make it easier for the property owner
to know about the unpaid bills prior to this point . This should be
explored to make the whole process easier .
Attorney Barney - The landlord can have the bill sent to them . The
owners do not wish to be bothered with the quarterly bills . If the
landlord does not get the bill sent to them they should take the
risk the bill won ' t be paid .
Councilman Conley - A policy should be set up that the bill be sent
to the landlord and then it would be their responsibility to get it
to the tenants .
Attorney Barney - Many of these delinquents are changes in
ownership . There are situations where the property changes hands
in between a billing period and a bill doesn ' t get noticed and
paid . At the end of the year the new owner has not paid because
they didn ' t know about it .
Councilwoman Valentino - If someone complains the staff points out
to them they can have the bill sent directly to them , that should
be adequate .
Motion called and carried unanimously .
Agenda Item No . 25 - Delinquent Tax Bill Notice Charge :
Mrs . Noteboom - The Town has been charging the $ 1 . 00 fee for
delinquent notices . The State has recently passed legislation
allowing the charge to be optional by each Town through a
resolution . The second notice fee is prescribed by law . The fee
pays for the postage and administrative costs of sending this
notice .
Motion made by Councilwoman Valentino , seconded by Councilman
Conley approving the collection of the $ 1 . 00 fee charged for the
delinquent tax notices . The Receiver of Taxes is hereby authorized
and directed to collect the said delinquent tax notice fee as
prescribed by law . The Receiver of Taxes is authorized and
directed to forward a certified copy of this resolution to Henry
Theisen , County Attorney ; and Lisa Stephens of the Tompkins County
Budget and Finance Office . Carried unanimously .

Agenda Item No 17 - Public Hearing , SCLIWC 1995 Budget :
The Supervisor opened the public hearing at 7 : 30 p . m . The Town
Clerk had proof of posting and publication . No members of the
public wished to comment .
Supervisor Whitcomb - This budget is unchanged from the tentative
budget reviewed in October with the exception that a summary page
and the revenue account now have the appropriate account numbers
assigned to them . The dollar amounts have not changed .
Larry Parlett from SCLIWC was present to answer questions .
The Supervisor closed the public hearing at 7 : 32 p . m .
Agenda Item No . 18 - Adoption 1995 SCLIWC Budget :
Motion made by Councilman Niklas , seconded by Councilman Conley
adopting the 1995 SCLIWC Preliminary Budget as the 1995 SCLIWC
Final Budget . Roll call vote carried unanimously .

Zoning Fees :
Supervisor Whitcomb - The Town Clerk , Town Planner , and
Building / Zoning Officer have reviewed and determined the fees they
feel should be charged for various documents , permits , and
inspections within the Town .
Motion made by Councilman Niklas , seconded by Councilman Conley
authorizing and directing the Town Clerk to advertise for a public
hearing to be held at the regular meeting of the Town Board on
December 12 , 1994 at 7 : 00 p . m . in order that the Board may consider
the adoption of a resolution establishing Town Clerk ,
Building / Zoning fees and repealing the provisions of the Zoning
Ordinance and other Local Laws related thereto .
Councilwoman Valentino - How long ago were the fees set at their
current level ?
Mrs . Noteboom - The Town Clerk fees were done in December 1992 .
Councilman Niklas - Will this schedule of fees be what is used for
fees in lieu of lands ?
Attorney Barney - The fees for in lieu of lands will be done
through a different ordinance .
Mr . Frost - There are different circumstances which have dictated
raising and / or lowering fees in the building department .

Mrs . Noteboom - The Town Clerk fees have been determined with the
Town Planner based upon the cost for in house and out of house
printing costs . The number circled are the amounts recommended to
charge . It has been understood that Attorney Barney will draft a
local law which will incorporate all the fees into one so that when
the need arises to change them it can be done more efficiently . It
is unclear if one local law is enacted incorporating them all ,
since some of them are Zoning fees will it be necessary to publish
the local law in its entirety , and can the fees be changed by
simple resolution or would a local law have to be enacted each
time .
Attorney Barney - It would not matter if it were a local law or a
resolution it requires a public hearing when changing the fees . If
they are incorporated into one local law and one or two items
needed to be changed it could done with a resolution . Every fifth
or sixth amendment would require a reenactment the entire law with
all the changes .
A local law could be enacted allowing publication of an abstract
rather than the entire local law . Since the local law will be to
create a fee structure it would be a good idea to publish the law
in its entirety .
Councilman Niklas - The local law that would permit not to publish
would permit the option of publishing or not publishing so when
there were certain laws you could .
Mrs . Noteboom - Based upon what has been presented , does the Board
want the Attorney for the Town to draft a local law using these
fees ?
Councilwoman Valentino - It is not clear which fees are new and not
been charged before .
Mrs , Noteboom - On the Town Clerk list the ones crossed out are
what is presently being charged . The Six Mile Creek Report ,
Wetlands Guidelines , and Parks Recreation Open Space Plan Update
and zoning maps have not had a fee . The Open Space Report and the
Comprehensive Plan have not had an established fee but fees are
charged because they are so expensive to produce .
Supervisor Whitcomb - The Building / Zoning Officer has several
levels broken down into new fees .
Councilman Niklas - If the objective of the fee schedule is to meet
costs , is there no way to write the law such that if even if there
is a document giving costs the law itself simply addresses that the
fees meet costs ? That way each year as the cost increases
automatically the fees can be increased with changing the law .

Mr . Frost - When the former Supervisor was in office the Operating
Permits and Fire Safety Inspections were discussed to be revised .
When the fees were initially instituted in January 1993 there was
feedback on those fees . For example , an inspection of NCR complex
was done which took three days . As the law is written now they
paid $ 25 . 00 for a lot of time spent . At the same time a one
building motel on Elmira Road is paying $ 25 . 00 for what took one or
two hours . In some cases of larger properties have multiple
buildings .
Agenda Item No . 20 - Public Hearing , 1995 Town of Ithaca Budget :
The Supervisor opened the public hearing at 7 : 45 p . m . , the Clerk
had proof of posting and publication . The Supervisor postponed the
public hearing until conclusion of the discussion of Agenda Item
No . 26 .
Agenda Item No . 26 - Cont ' d :
Attorney Barney - The question was whether the Town can enact a law
which will cover costs ? $ 25 . 00 per hour may be the cost today for
Mr . Frost ' s time and administration , it may not be the cost at a
later date . That would have to be dealt with in the future . Or it
can be left as is , where no one knows exactly what the cost is .
The law would has to have denominated what the fees are and a
public hearing would have to be held . A formula could be included
for some of the items such as site plan review .
Mr . Frost - John Novar ' s argument heard by the former Supervisor is
that the Town cannot charge more than what it costs the Town to go
through the permit process and conduct the inspections . Mr Novar ' s
property is unique because of the number of buildings and the fact
there may be only one physical visit to property . Mr . Novar felt
the Town was charging in excess of what the cost was .
Mr . Novar sued the City of Ithaca which resulted in the City
changing the fees schedule . The proposal of $ 25 . 00 per hour
actually came close to what the City was charging for Fire Safety
Inspections and Mr . Novar felt comfortable that we had at least
adjusted this by providing an hourly rate that was more equitable .
Councilwoman Harrison - Mr . Frost has said there will be things
that will have a dollar limit according to the fee schedule will
take much more time . Under this schedule there is no way to cover
that ?
Mr . Frost - The value of improvement is a category for building
permits . Operating permits and fire safety inspections should go to
an hourly rate which has not been done in the past . This will
satisfy the request that it be done based upon actual costs and not

beyond .
It is not yet understood what this will mean in terms of revenues .
It may lower it on some levels and gain on others .
Attorney Barney - Is there any reason why the town could not have
the operating permits , etcetera to a minimum . An amount of " at
least " for these should be considered . . $ 25 . 00 and $ 25 . 00 per hour
does not give a real sense of what someone would be charged . If
there is a minimum the applicant would know what the least would
be .
Mr . Frost - That is something like there is now . It should be
discussed .
The Board consented to have the Building / zoning Officer and the
Attorney for the Town discuss this issue and make a recommendation
at the public hearing .

Agenda Item No . 20 - Cont ' d :
The public hearing was resumed at 7 : 50 p . m . The Supervisor asked
for any public comment on the 1995 Town of Ithaca Budget . No
member of the public wished to offer comment . The public hearing
was closed by the Supervisor at 7 : 51 p . m .
Agenda Item No . 28 - Maintenance of Sidewalks Route 13 :
Mr . Noteboom - . Part of the process of the State Department of
Transportation rebuilding Route 13 is a plan to build a sidewalk by
Buttermilk Falls State Park , The Highway Department cannot
maintain any sidewalks unless the Town Board- approves doing so ,
however the Town is responsible to maintain them by law .
Councilwoman Harrison - Most sidewalks are maintained by the
abutting property owners in Towns . Attorney Barney was asked how
that would relate to this when State Parks owns a portion of this
property . The area is privately owned for the most part .
Attorney Barney - Appologized that he had not yet researched this .
Councilwoman Harrison - There is this feeling if the State builds
the sidewalk with the technicality of a State law saying that a
City or Village is responsible for the maintenance of sidewalks .
the law does not mention Towns because they do not normally have
sidewalks in towns .

Attorney Barney - Is State DOT going to build the sidewalks
regardless of what he Town does , if so then why adopt a resolution
at all ?
Councilwoman Harrison - The Town should be prepared to maintain
those sidewalks .
Councilman Niklas - Does the Town really approve of the
construction of the sidewalks ? The result would be two resolutions
one saying the Town approves of it , and the other saying the Town
is accepting the responsibility of the maintenance . If the Town is
legally responsible for maintenance we have to do that .
Councilwoman Harrison - The Town asked for sidewalks that was part
of the discussions for desired options regarding Route 13 ,
Supervisor Whitcomb - What is the recommendation ?
Councilwoman Harrison - Postpone a resolution pending the results
of Attorney Barney ' s investigation as to whether the Board should
approve maintenance of the sidewalks .
Agenda Item No . 29 - Resolution to Secure Bond Anticipation Notes
West Haven Road Sewer :
Attorney Barney - The resolution from the bonding council Wilke ,
Farr , and Gallagher of New York City was received today . The
resolution is in order and it is recommended the Town Board adopt
the resolution .
Motion made by Councilman Niklas , seconded by Councilwoman
Valentino approving and adopting the resolution for securing Bond
Anticipation Notes related to the West Haven Road Sewer . Roll call
vote carried unanimously .
Additional Agenda Item No . 2 - Appointment Tompkins County Airport
Master Plan Land Use Committee :
Motion made by Councilwoman Harrison , seconded by Councilman Niklas
appointing Jonathan Kanter , Town Planner ; and Eva Hoffman , Planning
Board member to serve as the Town of Ithaca representatives on the
Tompkins County Airport Master Plan Land Use Committee . Carried
unanimously .
Agenda Item No . 21 - Public Hearing , Cornell University GEIS SLUD
The Supervisor opened the public hearing at 8 : 00 p . m . The Town
Clerk had proof of posting and publication .
Nancy Brcak , President , Forest Home Improvement Association - The
Association and the community are concerned about development in

our area , and are very interested in this report and its
implications . People have met as a community and in smaller groups
to consider these issues .
Bruce Brittain , Forest Home Improvement Association Traffic
Committee Chairman - The issue of development in Precinct 7 is
obviously a very important and multi faceted one . Comments will be
related to the effect on traffic in residential neighborhoods ,
especially Forest Home .
The purpose of the GEIS process is to identify potential
development related impacts and to mitigate these to the extent
possible . One of the single largest off site impacts will be
increased traffic through residential neighborhoods . No mitigation
measures for this have been proposed . The SLUD before the Board
has performance standards for a variety of off site impacts
including atmospheric emissions , glare , fire and explosion hazards ,
and vermin ; but none for the traffic impacts of nearby residential
areas .
It is requested that a performance standard be added which would
limit or even eliminate any increase in off site traffic impact .
I would be happy to assist the Town Board in any way possible in
drafting such a performance standard .
The GEIS spends a great deal of time discussing traffic issues . It
acknowledges that traffic in Forest Home will increase as a result
of development in Precinct 7 . Optimistic estimates indicate it
could be one and one half times what it is now , more realistic
estimates are that it will double the present traffic . The
negative impacts of traffic , noise , fumes , safety concerns , and
congestion will also increase . A north / south connector road could
significantly reduce the impact of Cornell development on Forest
Home by providing an alternate route for development related
traffic . Cornell University is willing to set aside the right of
way for such a connector road .
The intent of the Town is not to speed the flow of traffic through
the community , but rather to pursue an alternate route which will
reduce the traffic volume in Forest Home with the details defined
in the findings statement . All these things made people feel very
good about the GEIS and had them looking forward to the Planning
Board ' s Findings Statement . Unfortunately , when looking at the
Findings Statement it merely states when and where roads should be
widened and when and where traffic lights should be installed . It
also states that all of the Forest Home concerns can be addressed
by simply installing traffic lights . The only proposed measures
address increasing or impeding the easing flow of traffic through
the community , and there are none that address impacts of traffic
on residential neighborhoods .

It is also requested , that the Town Board draft its own Findings
Statement one which would flow from and be consistent with the
GEIS ; and help guide the implementation of necessary and
appropriate mitigation measures .
Two measures which would reduce traffic impacts would be an
alternate route , and reducing the need for travel through a
transportation demand management program . Progress is being made
in both of these areas at present which is commendable , but there
needs to be more work .
The long GEIS process which culminates with the Statement of
Findings and in the SLUD also provides a unique opportunity . This
is an opportunity the Town Board has never had before and probably
never will again . It is an opportunity to receive meaningful
commitments from Cornell University to fairly resolve the traffic
issue and to insure that development of Precinct 7 does not result
in an increase of traffic impact on surrounding areas .
Laura Marks - The SLUD should be thrown out entirely because it is
so bad . It should be redone by looking at the Comprehensive Plan
to see what has been talked about for the last six years . The
Statement of Findings instead of trying to address and incorporate
citizen input found ways to rationalize not addressing the citizens
concerns .
Recollection of the Comprehensive Plan was that there was repeated
talk about East Hill Plaza being a mistake . One that was not
wished to be repeated . It was suggested there be small shopping
centers that would serve neighborhoods . Precinct 7 in the GEIS
document is seen as an expansion of East Hill Plaza .
The document shows stores and facilities for the use of Cornell
employees and students . That is everyone in Tompkins , Seneca , and
Tioga County .
Once Cornell builds up Precinct 7 it can easily use the zoning to
ask for expansion out to the golf course . This would be an entire
shopping district starting at East Hill Plaza to the Triphammer
complex . That is not what was intended during the development of
the Comprehensive Plan .
It is important that the Town of Ithaca rather than saying to
Cornell what Cornell wants to hear , the Town represent the views of
the citizens for how they wish to see the Town developed . It is
important that Cornell University and Ithaca College remain class
rooms , office buildings , research laboratories , natural and
agricultural areas for research . The Town should be in favor of
Cornell University and Ithaca College remaining as educational
institutions rather than corporations .

Acknowledgement is made that Cornell being a State college may not
have to listen to anything the Town of Ithaca says anyway .
However , it is important that the Town put forth what is really
wanted for the Town . If Cornell is given a " blank check " which is
seen in the GEIS to Cornell to build anything they wish there will
be no say in any expansion . That is like giving all the cards away
before the game even begins .
Doug Brittain , 135 Warren Road - One of the reasons for the GEIS
was to help determine what the Town would look like in the future
if Cornell develops the area as the administration wishes to .
The GEIS is somewhat flawed but it still is useful in providing a
sneak preview of what can be expected . One thing which can be
expected is 4 million square feet of development which equates to
about one third the existing campus or 32 times the size of the
proposed Wal Mart . With Cornell ' s typical rate of growth it should
take approximately 10 years to have this area built out .
The SLUR would be about 67 acres of building foot print with an
additional 54 acres under blacktop and concrete for parking lots ,
sidewalks , etcetera . That is over 100 acres gone , no longer
available . Is that the best use of valuable agricultural ,
research , teaching land ?
The off site impacts will include increased traffic in Forest Home .
Thirty years ago the traffic problems were pretty much non
existent . Thirty years is about the time it takes for Cornell to
double in size , in the last thirty years they have . When the
campus doubles in size the traffic doubles . There are now traffic
problems no one envisioned thirty years ago .
The GEIS talks about four lanes on Route 366 and the NYSDOT would
prefer five lanes . Four and five lane road with traffic lights
every few hundred yards with unlivable neighborhoods is not
something to look forward to .
Luckily , it can be prevented by the Town Board setting the policies
for growth . Cornell does not set Town policy . If the Town Board
doesn ' t like the vision presented in the GEIS it does not have to
be passed . The proposed SLUR is essentially the wish list of a few
people at Cornell . The Town should have its own wish list based
upon what the citizens through the Town Board desire . What do the
residents of the Town want it to look like ?
It would be nice if people could live in a Town where traffic
problems weren ' t going from bad to worse . If the important parts
of the Orchards , experimental plots , and scenic areas . It would be
nice if the administration of Cornell would take more
responsibility for the consequences of some of their actions . The
Town Board can do this . This vision is why many of the Town Board

members ran for office . It is why many of the Town Board members
were elected into office . This is a golden opportunity for the
Town Board to say they do not want the Town to go this way . The
Town Board has the authority and power to make a tremendous
difference . The Town residents are firmly behind this concept .
Nancy Brcak - Some Town Board members may ask where were these
people earlier in the process of the GEIS . Many residents were
here , and earlier a group attempted to address the Planning Board
earlier in the process to have impact on the document . This group
was received in a cursory fashion and some very modest suggestions
and proposals asked to be incorporated into the GEIS were all
refused . That is why they are attending tonight to appeal to the
Town Board because they did try to work with the system and have an
impact at an earlier and more appropriate time . The pleas fell on
deaf ears .
Agenda Item No . 23 - Public Hearings , 1995 Assessment Rolls for
Special Benefit Districts :
8 : 15 p . m . - The Supervisor asked if anyone in attendance wished to
speak on this issue . No one wished to come forward . The Attorney
for the Town recommended postponing opening the public hearings
until conclusion of the discussion of the GEIS since there was no
person wishing to be heard .
Agenda Item No . 21 - GEIS , Continued :
Bruce Brittain - Asked to speak as a private citizen .
The SLUR for development in the Orchards area is inappropriate and
ill conceived . In response to a question to the Town of Ithaca
residents survey 85 % of residents indicated that they agreed or
strongly agreed this area was an important natural and visual asset
which should be protected and preserved . A petition several years
ago circulated in support of keeping the Orchards intact .
The development of this area , if there were a desire , should be
regulated by zoning not by a SLUD . The Comprehensive Plan
recommends eliminating SLUD ' s from zoning , not creating new ones .
The Town has started a comprehensive look at zoning and rezoning
therefore it would appropriate to have an institutional zone and to
not take the interim step of a SLUD .
The allowed uses in the SLUD appear to be too wide . It was
envisioned in the beginning for campus zoning with grassy quads ,
trees , and nature . What is proposed is shopping mall zoning . It
has restaurants , beauty parlors , convenience stores , etcetera . It
does not fit the image of what was expected . The parcel is treated
as one unit . It would make sense that those visual and
agricultural areas be separated for special treatment with

additional restrictions .
There has been verbal assurance there is a 20 year protection for
the Orchards area . If that is the case the Comprehensive Plan was
a 20 year plan of which there are only 16 years left . That 20
years goes beyond what is left in the Comprehensive Plan . It would
make sense to postpone to rezoning until the new Comprehensive Plan
is completed 16 years from now . That document will be affected by
the next 16 years of change . This makes more sense than looking at
it so far in the future now .
The Town Board should adopt its own findings . Development will
occur in Precinct 7 whether that is through a SLUD , rezoning , or
continuance to the R30 zoning presently there . The findings are a
accumulation of the whole GEIS process and they are there in order
to direct development and mitigate the impacts . The Planning
Board ' s findings statement is weak and incomplete . It will not
adequately serve the purpose . It doesn ' t not cover the noise and
traffic impacts . It has very few requirements , there are only soft
recommendations . A tremendous amount of time and effort has gone
into this process , the Town is near the end , but are not done yet .
The Supervisor closed the public hearing at 8 : 20 p . m .
Supervisor Whitcomb declared he has potential conflict of interest
regarding this issue . He is a member of the administration for the
College of Agriculture who has specific interests in this area . He
has management responsibilities for some of the land included , and
he serves on the Cornell University Land Use Committee which has
another agenda . He is also a private citizen and a member of this
Town Board .
Supervisor Whitcomb - If the Board has no objections , I would like
to stay on as Chair and act as a facilitator in as fair a manner as
possible to keep the process moving along and facilitate the
process to the best of my ability . If the Town Board has any
objections to this proposal please speak up .
Councilman Niklas - Will the Supervisor abstain from voting on this
issue ?
Supervisor Whitcomb - " I will abstain from voting . "
The Board reached a consensus to have the Supervisor continue to
chair and act as facilitator regarding this issue .
Supervisor Whitcomb - The Board should consider what should be done
from this point , I have a suggestion .
Councilman Conley - Asked to hear the suggestion by the Supervisor .

Supervisor Whitcomb - This has taken four years to this point . It
is hoped it will not take another four years to resolve . It could ,
if it were considered at the Town Board level .
It is my suggestion to appoint a subcommittee of the Board to work
with the appropriate Town staff and the Attorney for the Town to
enter into discussions with the counterparts on Cornell ' s staff and
members of the public . The Committee would try to arrive at a
consensus to present to the Town Board to consider .
Councilwoman Grigorov , Councilwoman Harrison , and Councilman Conley
volunteered to serve on this committee . The Supervisor appointed
them to the Cornell GEIS Subcommittee with Councilwoman Harrison to
serve as Chair .
Councilwoman Grigorov - There were some incorrect statements made
by some of those who spoke at the public hearing . There are some
misconceptions about some of the things related to the development
of the SLUD .
Supervisor Whitcomb - Invited Cornell University to appoint
representatives to meet with this committee .
Councilwoman Harrison - This committee should be able to meet with
those individuals they feel are appropriate to resolve the
questions raised . Rather than form the committee with specific
members , the Board ' s committee can call on those people who it
feels can answer the questions .
Something that would be useful is to know from the other Town Board
members if there are issues which have not been raised that should
be considered .
Councilman Niklas - Many things have been said without knowledge of
where the information came from . There are some things on the
public record now which should not be left there without
verification , such as the 4 million square feet of development and
that development would be 32 times the size of the proposed Wal
Mart . Where do these figures come from ? Certain questions were
raised about the protocol of the Planning Board did things . These
were serious and should not be left on the public record
unchallenged . The Committee must verify the statements or not .
Councilman Conley - What would be the appropriate staff to be
involved with this committee ?
Supervisor Whitcomb - The Town Planner , Town Engineer , and the
Attorney for the Town at the appropriate times .
Mr . Barney - What is the mission of this committee ?

Supervisor Whitcomb - The mission of the subcommittee is to review
the current Statement of Findings of the Planning Board and the
SLUD as presented , review it with Cornell . Address all concerns
and attempt to achieve some resolution of the differences .
Attorney Barney - The resolution envisioned is a determination to
adopt or recommend adoption of findings , either . the Planning
Board ' s or the Planning Board ' s findings revised , or a new set of
finding unrelated to the Planning Board ' s ; and as a result of those
findings whether there should be modifications in the SLUD , or a
new SLUD drafted . It a new SLUD is drafted it would have to go to
the Planning Board for review .
Councilwoman Harrison - The committee will figure out what should
be new or modified when it is determined what is needed .
Attorney Barney - Even modifications would have to go back to the
Planning Board . There has to be an agenda for the committee such
as findings and SLUD to be looked at .
Supervisor Whitcomb - The explanation of the committee ' s mission is
what is needed . If any items have to go back to the Planning
Board , so be it .
Councilman Niklas - It would be beneficial to see some kind of time
frame where the rest of the Town Board will receive a status
report .
Councilwoman Harrison - The committee can report on a monthly
basis . In February 1995 , a formal report and recommendation will
be made to the Town Board ,
Councilwoman Grigorov - Is there a legal time limit which should be
followed ?
Attorney Barney - There is a requirement under SEQR that findings
be adopted by the lead agency within a certain period of time .
That has occurred . In fairness to Cornell University and the
public it would behoove the Town to move this issue to closure .
The instigation originally was the Planning Board ' s desire that
there be a cohesive look at this area .
Supervisor Whitcomb asked any others to voice concerns related to
this subject to the committee either verbally or in writing in the
future . There were some detailed comments made by the public this
evening at the public hearing , perhaps those individuals wish to
present those in writing to the Board .

Supervisor Whitcomb - There are some small changes to the budget
since adoption of the Preliminary Budget in October .

Ms . Alario - Money budgeted for the Conservation Corp was
inadvertently placed in personal services when it should have been
in contractual expenses . That is what should be adopted .
Supervisor Whitcomb - A change in part town budget was considered
to accommodate a planning study related to the item which was
discussed in Executive Session .
Mr . Kanter - If the Town Board wishes to keep options open for
pursuing the feasibility study in 1995 now would be the time to
budget for that . Later it may be more difficult to transfer
monies . The range of $ 20 , 000 to $ 25 , 000 would be sufficient to
cover appraisals and the feasibility study .
Supervisor Whitcomb - This change would occur in General Fund Part
Town under planning . In 1994 funds were appropriated for a
planning study for $ 20 , 000 . If these funds were appropriated it
would be added to that line item and the estimated fund balance
would decrease by the amount appropriated . There is a very healthy
fund balance in that account . If the funds were not expended it
would go back to fund balance at the end of the year .
Councilwoman Harrison - It seems wise to appropriate funds for this
study .
Councilwoman Valentino - Would that leave fund balance within the
10 % recommended by Audit and Control ?
Ms . Alario - Fund balance is more than 10 % .
Motion made by Councilman Niklas , seconded by Councilwoman
Valentino that the Town Board of the Town of Ithaca hereby approves
and adopts the 1995 Preliminary Town of Ithaca Budget with the

Supervisor Whitcomb - Before funds are spent from the Planning
Study line it will have to be approved by the Town Board .
Councilwoman Harrison - The total amount of money spent on highway
car related items is well over $ 1 million . The amount of money
spent on other forms of transportation is none .
Mr . Noteboom - That is not quite right . When the Highway
Department picks up leaves and brush it is not automobile related .
There are other highway items accounted for which are also not
automobile related .
Councilwoman Harrison - The Board should begin to think about other
forms of transportation . It was discussed in the Comprehensive
Plan .
Ms . Alario - The figures given to Councilwoman Harrison were 1995
budgeted figures that money has not been spent . Administrative
costs are also within the numbers .
Councilwoman Harrison - The numbers do not match what was said to
be done in the Comprehensive Plan .
Councilman Niklas - Are you saying the budget suggests the Town is
not paying enough attention to alternative transportation ? The
issue is until the Town has alternative transportation plans they
cannot be budgeted . They need to be thought about and worked on .
Cornell University has been constantly ripping up parts of the
campus and never putting in a comprehensive bicycle path system .
Councilwoman Valentino - In part of the budget there is a
substantial increase on the recreation proposals . A good
proportion of that funding is looking at transportation such as
buses and other alternatives for moving youth around the community
to take advantage of the programs . Sometimes things are hidden in
the budget .
Supervisor Whitcomb - The transportation issues are being addressed
by the Metropolitan Planning Organization which is using ISTEA
funds to achieve alternative methods of transportation .
The impact of the 1995 Budget on the tax rate will be the total of
General Fund expenditures for town wide , part town , and highway
appropriations have increased about 4 . 6 % over 1994 . The real
property taxes will increase as a result of this budget 2189 % over
1994 . Far less than the rate of inflation . The result on a house
assessed for $ 100 , 000 will be an increase of about $ 3 . 40 .
Councilwoman Valentino - Complimented the Supervisor and the staff
on . the hard work and good job on the budget .

Supervisor Whitcomb - Thanks to all the staff who contributed
greatly to keeping expenses down and helping a new Supervisor put
together a reasonable budget .
Agenda Item No . 30 - Water and Sewer Benefit Assessment Unit
Refunds :
Mr . Walker - The refund would be for the Tomlinson parcel . At the
last board meeting an extensive letter was received from Mr .
Tomlinson dealing with land he owned or owns on Bostwick Road .
Some of the parcels because of the subdivision no longer have
access to water service or they are above an elevation where
adequate water pressure can be provided .
A summary has been prepared of a reasonable refund which is due Mr .
Tomlinson assuming two years refund can be given at this date . The
recommendation is that the refund is appropriate because of the
time frame Mr . Tomlinson notified the Town the refund for 1993 and
1994 was completed . Mr . Tomlinson requested a refund for three
years , 1992 is not appropriate . The amount of the refund would be
$ 2422 . 12 . The amount is determined by tax parcel and year .
There is a legal question as to how far back can the Town give a
refund on water benefit assessments .
Attorney Barney - The law indicates the refund can be given for no
more than a year from the date the Town received the application
for the refund . The issue is whether Mr . Tomlinson filed what
amounted to an application a year ago . In researching it nothing
could be found in the Town files . However , Eric Whitney , Assistant
Town Engineer has a distinct recollection that Mr . Tomlinson filled
out the form and made the application .
There is concurrence with the Town Engineer that the Board should
consider refunding the two years even though the form could not be
found .
Mr . Walker - The application form has been found .
Attorney Barney - These properties have been subsequently been
sold , could the Town be faced with another application because of
the division of the properties .
Mr . Walker - There was an apportionment request . The subdivision
occurred some of the properties were sold and some are still owned
by Mr . Tomlinson .
Mrs . Noteboom - Has research been done to determine if the amount
refunded should be divided because of the apportionment from the
Assessment Department .

Attorney Barney - Mr . Tomlinson did not split the property until
1994 so he did pay the full tax for 1993 . Mr . Tomlinson should
receive the full refund for 1993 . There is a concern if the 1994
refund should be split between Mr . Tomlinson and the other owners .
Mrs . Noteboom - There is a worry about the precedent being set .
Attorney Barney - The resolution can be adjusted to include any
other parties the refund may be due .
Motion made by Councilman Niklas , seconded by Councilwoman Grigorov
that the Town Board authorizes a refund of water benefit charges in
the amount of $ 2 , 422 . 12 , to be paid to Ephraim Tomlinson , III ; of
if the Town Engineer and Town Clerk determine a portion of said
amount is due to a successor in interest to Mr . Tomlinson , to be
paid as so determined . Carried unanimously .
Agenda Item No , 31 / Additional Agenda Item No . 1 - Extension Water
Services Route 13 , Replacement of Fire Hydrant :
Mr . Walker - When the 12 " water main was built across the Inlet it
went to the intersection of Buttermilk and Route 13 across the
railroad tracks to link to the City ' s water connection .
At that time there were future plans in leaving a " T " at the main
so the water could at some point be extended across Route 13 .
There is an existing water main which serves the Buttermilk Falls
State Park facilities which has caused problems because of its age .
The State has offered to extend the main when they build the
highway . This could be installed at a lesser cost than if it were
installed by the Town under another contract .
Councilman Niklas - What is the purpose of the water extension ,
what would it be providing and to whom ?
Mr . Walker - This extension would not expand service , but would
continue the loop to enforce the Town ' s present supply system .
Councilwoman Harrison - Is there currently water service on the
south side where this main would run to ?
Mr . Walker - There is a water main which runs along the old Sand
Bank Road which serves the park . There are quality and flow
problems with that line . There are two or three parcels which are
not presently served which would be with this extension .
Councilwoman Harrison - Will this water extension have any ] i in
regards to development ?

Mr . Walker - The line could be extended from this extension , that
is not the intent at this time . It is being considered in order to
have the loop completed and the work done by the State at a lesser
cost . This is an extension of the Inlet Valley project . There is
still money in that project to cover this installation cost .
Councilwoman Harrison - Where would the money go if it were not
spent ? Why is this extension worth $ 42 , 000 to this Board ?
Mr . Walker - It would go back to the water fund . It is something
which would have to be done in the future to complete the loop at
a higher cost . The extension was not completed initially because
of the extensive cost of crossing Route 13 . It was not deemed to
be essential to the Inlet Valley project .
There are two resolutions requested by the State . One is for the
betterment of the water extension , and the second is for the
relocation of a fire hydrant from the existing ones on the west
side of the road to the east side of the road . The fire hydrant
cannot be moved without the betterment . The fire hydrant
relocation will not cost anything , the water extension will cost
$ 42 , 000 .
Ms . Alario - The issue of prepayment must be worked out .
Mr . Walker - The NYSDOT would like to receive payment before the
work is done . By law the Town cannot do that , the agreement would
allow the payment being made .
Councilwoman Harrison - It seems that some of the City Council
members were discussing about the fact the State is going to
complete this type of work for the City and not charge them .
Mr . Walker - No , they are not doing any work for the municipalities
without cost .
Councilwoman Harrison - The City can veto NYSDOT projects within
the City , the Town cannot .
Attorney Barney - There is a slight correctable problem . If the
Town spends $ 42 , 000 on a capital project normally it cannot be done
unless the process like what was completed for West Haven Sewer is
done . Mr . Walker has indicated this extension is within the scope
of the Inlet Valley Water Improvement . Mention of this can be made
in the resolution .
Motion made by Councilman Niklas , seconded by Councilwoman Grigorov
authorizing and directing the Supervisor enter into a Utility Work
Agreement with the NYSDOT for completion of the water main
betterment as described upon completion of the said agreement by
the Town Engineer and Attorney for the Town . The amount of $ 42 , 000

to cover the cost of the said water main betterment shall be
expended from account H8340 . 221 . The Town Clerk is directed to
forward ( 5 ) copies of the Utility Work Agreement along with ( 5 )
certified copies of this resolution to the NYSDOT . Carried
unanimously .
Motion made by Councilman Niklas , seconded by Councilwoman Harrison
that the Supervisor is authorized and directed to enter into a
Utility Work Agreement with the NYSDOT for relocation of the fire
hydrant as described upon completion of the said agreement by the
Town Engineer and Attorney for the Town . The Town Clerk is
directed to forward ( 5 ) copies of the Utility Work Agreement along
with ( 5 ) certified copies of this resolution to the NYSDOT .
Additional Item No . 3 - Octopus Reconstruction Road Detour :
Mr . Frost wished to speak as a private citizen .
Mr . Frost - My house is one of five houses on Campbell Avenue which
is proposed to be used as part of the detour during reconstruction
of the octopus .
Mr . Noteboom - During the octopus road reconstruction project it
will be necessary to establish a road detour . The crews will work
from 8 : 00 p . m . until 5 : 00 a . m . The NYSDOT is asking the Town if
they can use Campbell Avenue and Hopkins Place as a detour . These
roads were picked because the City used these roads as detours in
the past .
Discussion have been held with Mr . Frost who has other suggestions .
Vinegar Hill and Octopus Drive have been looked at for detours .
Some cars will use those . Trucks will have a great deal of
difficulty using them .
Mr . Frost - Last year the City did work on Route 79 and detoured
traffic past my house . Residents were told that project would take
three weeks and it took three months . If the Board members would
contemplate their homes having a State highway trucks and other
traffic driving by your house at odd hours of the day in does not
seem appealing and is destructive . This disruptive traffic will be
occurring during the late hours and in the middle of the night .
The State is saying this will take about one month .
I have obvious concerns for noise , dust , and safety . I have a
child who is handicapped . There is a proposed resolution from the
State which gives concern .
I have talked to the Highway Superintendent , representatives from
the City , and the State representatives about possible alternative
routes . I have come to accept the fact there are no really good
alternative routes the City is willing to agree upon . I suggested

having automobile traffic go out of the City , have traffic go down
Vinegar Hill and up Route 96 . Trucks could continue up to Campbell
as proposed , that would have traffic coming down Route 96 towards
the City take the detour and reduce traffic by one half on Campbell
Avenue .
What is a concern is the prepared resolution . It talks about DOT
will provide traffic control devices and make improvements or
repairs when necessary to the road and streets . Phase I is Route
89 and 96 traffic , and Phase II for April 1996 is for a time when
there will be a new bridge constructed across the inlet which will
take Route 89 traffic in and out of the City . The detour for 1996
will only be Route 96 traffic coming down Campbell Avenue , but it
will be 24 hours per day for over six weeks . The whole project is
intended to take three years to complete . They may be only
proposing two detours now , but how many others will be seen in the
future .
The repairs mentioned in the resolution could include widening the
road not just adding shoulders . The State by the resolution if the
Town Board approves that means the State could possibly define
repairs very widely . It seems that an EAF would not be necessary
if only shoulders were repaired , but if the State were to widen the
pavement it would be necessary . They did not address that issue
when they did an EAF for the octopus .
The resolution says the Town authorizes using those detours during
the period of construction . What does that mean ? There is a
concern to give authorization without a specific time limit .
Mr . Noteboom - The Town has to pass a resolution authorizing the
use of the detours since they are Town roads . It is the only
viable detour route available . The State will not be widening the
pavement anywhere .
Councilwoman Harrison - What happens if the Board does not pass any
resolution ?
Mr . Noteboom - The Town in essence would be refusing to allow them
to use the detours .
Councilman Niklas - Can a resolution be adopted simply allowing
them to use the roads as a detour .
Mr . Noteboom - It would be better to leave the improvements in the
resolution . They probably will not do any improvements the Town
doesn ' t want them to .
Mr . Walker - Many hours have been spent this week on this detail .
If the resolution is adopted to make the improvements allowable by
the Highway Superintendent he would have protection of the roads .

They are not going to widen those roads to more than two lanes ,
they do not want to spend the money .
Mr . Frost - It is not that I have a fear they will widen the road ,
the problem is the way the resolution reads unless it is clearer
what is being improved it gives them the option of widening the
roads if they wanted to .
Councilwoman Harrison - Could the resolution read to make
improvements as approved by the Highway Superintendent and this
approval is good for one year at which it will be looked at for
renewal ?
Mr . Walker - The State would like the approval for the life of the
project because the resolution will be a part of the contract
documents . What they would do if the Board does not approve it is
not known .
Attorney Barney - Rather than make it annually have an outside date
that it ends by .
Mr . Walker - Presently it is estimated to be three years of
construction and up to five years before the project is complete .
This detour will be used when they have to close Route 96 for
approach work or utility work .
Attorney Barney - The Town may want improvements to the roads .
Mr . Noteboom - What if the State in the process destroy the base
and pavements of our roads . That is more than just an improvement .
Attorney Barney - There is a Highway Superintendent allow him to
use his discretion by saying so in the resolution , as well as
making the repairs conditional if they damage the roads .
Motion made by Councilman Niklas , seconded by Councilwoman Harrison
that the Town Board authorizes the NYSDOT to utilize Hopkins Place
from the intersection with Route 96 to the intersection with
Campbell Avenue , and Campbell Avenue from the intersection of
Hopkins Place to the Town of Ithaca town line as detours during the
period of construction . The Town of Ithaca will continue to
provide routine maintenance on the above mentioned roads and
streets including snow and ice removal . Under any circumstance the
above detour shall be terminated no later than January 31 , 1998
unless there is an extension by the Town of Ithaca Town Board . The
consent granted by this resolution be contingent upon the State ' s
agreement to restore the roads at the conclusion of the project to
at least as good condition as they were in at the time of adoption
of this resolution . The Town Clerk is directed to transmit ( 5 )
certified copies of this resolution to the NYSDOT . Carried
unanimously .

Agreement Records Management Consulting Services

WHEREAS , the State Archives and Records Administration ( SARA )
awarded funds to the Town of Ithaca through the Local Government
Records Management Improvement Fund ( LGRMIF ) to contract with an
archival consultant to develop an archival program , select records
for microfilming / preservation , and describe records through
indexing ; and
WHEREAS , the Records Management Officer ( RMO ) has interviewed
certified archivists qualified to complete the tasks as recommended
by SARA ; and
WHEREAS , the RMO has recommended the Town of Ithaca enter into
an agreement with Suzanne Etherington , Ph . D . ; Certified Archivist
whose qualifications and experience most closely meet the needs of
the Town ; and
WHEREAS , under the agreement Dr . Etherington would be paid
$ 2 , 500 , 00 for ten days work , five days in 1994 and five days in
1995 to be expended from account A1460 . 400 ; and
WHEREAS , Dr . Etherington has agreed to hold the Town of Ithaca
harmless during the term of the agreement by executing an Addendum
to the Letter of Agreement ; now therefore be it
RESOLVED , the Town of Ithaca Town Board does hereby authorize
and direct the RMO to enter into an independent contractor
agreement with Dr . Suzanne Etherington for ten days of consulting
services to help develop an archival program to select records for
microfilming / preservation , and present methods for arranging and
describing records through indexing ; and be it further
RESOLVED , five days of the said consulting services shall be
performed no later than December 30 , 1994 , and five days of said
services shall be performed no later than June 30 , 1995 ; and be it
further
RESOLVED , a payment of $ 1 , 250 . 00 shall be made to Dr .
Etherington for the five days services in 1994 by December 30 ,
1994 ; and payment for the five days services for 1995 shall be made
to Dr . Etherington by June 30 , 1995 so the Town may meet the
financial requirements of the ( LGRMIF ) grant ; and be it further
RESOLVED , the services to be performed by Dr . Etherington
shall not commence until the Letter of Agreement and Addendum to
the Letter of Agreement are signed by both parties .

Delinquent Tax Bill Notice Charge

WHEREAS , Real Property Tax Law , Chapter 680 / 1994 contains
several measures affecting tax collecting officers ; and
WHEREAS , Section 987 ( 1 ) of the said law has been amended
making the charge for sending the delinquent tax notice required by
the statute optional with each local government ; and
WHEREAS , the said law mandates the delinquent tax notice must
still be sent ; and
WHEREAS , the County Attorney has requested the Town of Ithaca
continue to charge the fee of $ 1 . 00 for the delinquent tax notices
in order to create uniformity throughout Tompkins County ; and
WHEREAS , the Town of Ithaca Receiver of Taxes recommends the
continuation of the charge for delinquent tax notices as the fee
offsets some of the financial and administrative burden of issuing
the required notices ; now therefore be it
RESOLVED , the Town Board of the Town of Ithaca hereby approves
the collection of the $ 1 . 00 fee charged for the delinquent tax
notices ; and be it further

BOND RESOLUTION DATED NOVEMBER 10 , 1994 ,
A RESOLUTION AUTHORIZING THE ISSUANCE OF $ 215 , 000
SERIAL BONDS OF THE TOWN OF ITHACA , TOMPKINS
COUNTY , NEW YORK , TO PAY THE COST OF THE
CONSTRUCTION OF A NEW 8 - INCH SEWER MAIN TO PROVIDE
SEWER SERVICE FOR A PORTION OF THE PROPERTIES ON
WEST HAVEN ROAD AND MECKLENBURG ROAD TO CONNECT TO
AN EXISTING MAIN LINE IN MECKLENBURG ROAD IN THE
TOWN OF ITHACA SEWER SYSTEM BENEFITTED AREA -
1994 .
WHEREAS , by proceedings heretofore duly had and taken
pursuant to the Town Law , the Town Board of the Town of Ithaca ,
Tompkins County , New York , duly established the Town of Ithaca
Sewer System Benefitted Area - 1994 in said Town ; and
WHEREAS , it is now desired to provide for the financing
of the construction of a new 8 - inch sewer main to provide sewer
service for a portion of the properties on West Haven Road and
Mecklenburg Road to connect to an existing sewer line in
Mecklenburg Road for such Town of Ithaca Sewer System
Benefitted Area - 1994 ; and
WHEREAS , said capital project has been determined to be
an Unlisted Action pursuant to the regulations of the New York
State Department of Environmental Conservation promulgated
pursuant to the State Environmental Quality Review Act , the
implementation of which as proposed , the Town Board has
determined will not result in any significant environmental
effects ; and
WHEREAS , it is now desired to authorize the financing of
such capital project ; NOW , THEREFORE ,

BE IT RESOLVED , by the Town Board of the Town of Ithaca ,
Tompkins County , New York , as follows :
Section 1 . For the specific object or purpose of paying
the cost of the construction of a new 8 - inch sewer main to
provide sewer service for a portion of the properties on West
maven Road and Mecklenburg Road to connect to an existing sewer
line in Mecklenburg Road , for the Town of Ithaca Sewer System
. enefitted Area - 1994 , in and for the Town of Ithaca , Tompkins
County , New York , including original furnishings , equipment ,
<<. . chinery , apparatus , appurtenances , and incidental
improvements and expenses in connection therewith , there are
hereby authorized to be issued $ 215 , 000 serial bonds of the
Town of Ithaca , Tompkins County , New York , pursuant to the
provisions of the Local Finance Law ,
Section 2 . It is hereby determined that the maximum
estimated cost of such specific object or purpose is $ 215 , 000 ,
and that the plan for the financing thereof is by the issuance
o � the $ 215 , 000 serial bonds of said Town authorized to be
issued pursuant to this bona resolution .
Section 3 . It is hereby determined that the period of
probable usefulness of the aforesaid specific object or purpose
is forty years , pursuant to subdivision 4 of paragraph a of
Section 11 . 00 of the Local Finance Law . It is hereby further
determined that the maximum maturity of the serial bonds herein
authorized will not exceed twenty years .

Section 4 . Subject to the provisions of the Local Finance
Law , the power to authorize the issuance of and to sell bond
anticipation notes in anticipation of the issuance and sale of
the serial bonds herein authorized , including renewals of such
notes , is hereby delegated to the Supervisor , the chief fiscal
officer . Such notes shall be of such terms , form and contents ,
and shall be sold in such manner , as may be prescribed by said
Supervisor , consistent with the provisions of the Local Finance
Law .
Section 5 . The faith and credit of said Town of Ithaca ,
Tompkins County , New York , are hereby irrevocably pledged to
the payment of the principal of and interest on such bonds as
the same respectively become due and payable . There shall be
annually apportioned and assessed upon the several lots and
parcels of land within the aforementioned Town of Ithaca Sewer
System Benefitted Area - 1994 which the Town Board shall
determine and specify to be especially benefited by the
improvements , an amount sufficient to pay the principal and
interest on said bonds as the same become due , but if not paid
from such source , all the taxable real property in said Town
shall be subject to the levy of ad valorem taxes without
limitation as to rate or amount sufficient to pay the principal
of and interest on said bonds as the same shall become due .
Section 6 . Such bonds shall be in fully registered form
and shall be signed in the name of the Town of Ithaca , Tompkins

County , New York , by the manual or facsimile signature of the
Supervisor and a facsimile of its corporate seal shall be
imprinted or impressed thereon and attested by the manual or
facsimile signature of the Town Clerk .
Section 7 . The powers and duties of advertising such
bonds for sale , conducting the sale and awarding the bonds , are
hereby delegated to the Supervisor , who shall advertise such
bonds for sale , conduct the sale , and award the bonds in such
manner as he shall deem best for the interests of the Town ,
including , but not limited to , the power to sell said serial
bonds to the New York State Environmental Facilities
Corporation ; provided , however , that in the exercise of these
delegated powers , he shall comply fully with the provisions of
the Local Finance Law and any order or rule of the State
Comptroller applicable to the sale of municipal bonds . The
receipt of the Supervisor shall be a full acquittance to the
purchaser of such bonds , who shall not be obliged to see to the
application of the purchase money .
Section 8 . The Supervisor is hereby further authorized ,
at his sole discretion , to execute a project financing and loan
agreement , and any other agreements with the New York State
Department of Environmental Conservation and / or the New York
State Environmental Facilities Corporation , including
amendments thereto , and including any instruments ( or
amendments thereto ) in the effectuation thereof , in order to

effect the financing or refinancing of the specific object or
purpose described in Section 1 hereof , or a portion thereof , by
a serial bond issue of said Town in the event of the sale of
same to the New York State Environmental Facilities
Corporation ,
Section 9 . All other matters , except as provided herein
relating to such bonds , including determining whether to issue
such bonds having substantially level or declining debt service
and all matters related thereto , prescribing whether manual or
facsimile signatures shall appear on said bonds , prescribing
the method for the recording of ownership of said bonds ,
appointing the fiscal agent or agents for said bonds , providing
for the printing and delivery of said bonds ( and if said bonds
are to be executed in the name of the Town by the facsimile
signature of its Supervisor , providing for the manual
countersignature of a fiscal agent or of a designated official
of the Town ) , the date , denominations , maturities and interest
payment dates , place or places of payment , and also including
the consolidation with other issues , shall be determined by the
Supervisor . It is hereby determined that it is to the
financial advantage of the Town not to impose and collect from
registered owners of such serial bonds any charges for mailing ,
shipping and insuring bonds transferred or exchanged by the
fiscal agent , and , accordingly , pursuant to paragraph c of
Section 70 . 00 of the Local Finance Law , no such charges shall

be so collected by the fiscal agent . Such bonds shall contain
substantially the recital of validity clause provided for in
section 52 . 00 of the Local Finance Law and shall otherwise be
in such form and contain such recitals in addition to those
required by section 52 . 00 of the Local Finance Law , as the
Supervisor shall determine .
Section 10 . The power to issue and sell notes to the New
York State Environmental Facilities Corporation pursuant to
Section 169 . 00 of the Local Finance Law is hereby delegated to
the Supervisor . Such notes shall be of such terms , form and
contents as may be prescribed by said Supervisor consistent
with the provisions of the Local Finance Law .
Section 11 . The intent of this resolution is to give the
Supervisor sufficient authority to execute those agreements ,
instruments or to do any similar acts necessary to effect the
issuance of the aforesaid serial bonds or notes without
resorting to further action of this Town Board .
Section 12 . This resolution shall constitute a statement
of official intent for purposes of Treasury Regulations Section
1 . 150 - 2 . Other than as specified in this resolution , no
monies are , or are reasonably expected to be , reserved ,
allocated on a long - term basis , or otherwise set aside with
respect to the permanent funding of the object or purpose
described herein .

Section 13 . The validity of such bonds and bond
anticipation notes may be contested only if :
1 ) Such obligations are authorized for an object or
purpose for which said Town is not authorized to
expend money , or
2 ) The provisions of law which should be complied with
at the date of publication of this resolution are

and an action , suit or proceeding contesting such validity is
commenced within twenty days after the date of such
publi cation , or
3 ) Such obligations are authorized in violation of the
provisions of the Constitution .
Section 14 . This resolution , which takes effect
immediately , shall be published in full in The Ithaca Journal
the official newspaper , together with a notice of the Town
Clerk in substantially the form provided in Section 81 . 00 of
the Local Finance Law .

This ONE ANNUAL NOTICE is being made to save time , paper , and money .

water benefit charges on the basis that assessments were
incorrectly computed based on availability of water and changes in
lot configurations as described in his letter dated August 3 , 1994 ;

WHEREAS , the Town Engineer has reviewed the claim for a refund
and has recommended a refund based on the attached summary of
calculations ; and
WHEREAS , taxes have been paid in full for the affected tax
parcels ; now therefore be it

WHEREAS , the replacement of bridges on Route 13 over Conrail ,
Cayuga Inlet and Buttermilk Creek by the NYSDOT necessitates the
adjustment of utility facilities ; and
WHEREAS , the proposed adjustment is the extension of the Town
of Ithaca ' s 12 " water main opposite Sta . BF 9 + 50 + / - , 34 ' Lt . + / - and
crossing Route 13 at CL Sta . 131 + 27 + / - ; and
WHEREAS , the estimated cost of the proposed betterment to the
Town of Ithaca water main is $ 42 , 000 . 00 ; and
WHEREAS , this water line extension is within the scope of the
1989 Inlet Valley Water Improvements ; and
WHEREAS , the Town Engineer has recommended the Town Board
enter into a Utility Work Agreement with the NYSDOT to authorize
the extension of the said water main ; now therefore be it
RESOLVED , the Town Supervisor is hereby authorized and
directed to enter into a Utility Work Agreement with the NYSDOT for
completion of the water main betterment as described upon
completion of the said agreement by the Town Engineer and Attorney
for the Town ; and be it further

WHEREAS , Tompkins County is beginning the process of writing
a new 20 Year Airport Master Plan ; and
WHEREAS , in order to acquire input from the municipalities
located near the Airport , a Land Use Committee ( LUC ) will be formed
to study the land use and access aspects of the Airport Plan ; and
WHEREAS , the LUC will be composed of representatives from the
Village of Lansing and the Towns of Dryden , Ithaca , and Lansing ;
and
WHEREAS , the Tompkins County Department of Planning has
requested that the Town Board of the Town of Ithaca appoint two
representatives from the Town of Ithaca to serve on the LUC , one of
which would be a member of the Town of Ithaca Planning Board ; now

Octopus Reconstruction Road Detour
Resolution No . 251
WHEREAS , the New York State Department of Transportation
proposes to reconstruct the intersections of Route 89 , Route 96 ,
and Route 79 at the intersection with Route 13 , commonly known as
the " Octopus " ; and
WHEREAS , in conformance with Section 42 of the New York State
Highway Law , the New York State Department of Transportation
proposes to utilize the following roads and streets as detours
during the period of construction :
Hopkins Place from the intersection with Route 96 to the
intersection with Campbell Avenue , and Campbell Avenue from the
intersection of Hopkins Place to the Town of Ithaca town line ; and
WHEREAS , the New York State Department of Transportation will
provide traffic control devices and make improvements or repairs
when necessary as approved by the Town of Ithaca Superintendent of
Highways to the above mentioned roads and streets to make them
adequate to handle additional detour traffic ; now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca does
hereby authorize the New York State Department of Transportation to
utilize the above mentioned roads and streets as detours during the
period of construction ; and be it further
RESOLVED , that the Town of Ithaca will continue to provide
routine maintenance on the above mentioned roads and streets ,
including snow and ice removal ; and be it further
RESOLVED , that under any circumstances the above detour shall
be terminated no later than January 31 , 1998 unless there is an
extension by the Town of Ithaca Town Board ; and be it further
RESOLVED , that the consent granted by this resolution be
contingent upon the State ' s agreement to restore the roads at the
conclusion of the pr03ect to at least as good condition as they
were in at the time of adoption of this resolution ; and be it
further .
RESOLVED , that the Town Clerk is hereby directed to transmit

Re: Treasurer' s Message for 1995 Operating Budget
In assembling your budget message this year, staff felt it would be helpful to summarize some of the highlights of
the 1995 Operating Budget adopted by the Commission at their Regular Meeting of September 29, 1994. Below
are comments staff believes highlight the adopted document:
Revenues :
1 . The Benefit Assessment revenue from the five (5) Municipalities remains the same as it was in 1994 . It is
likely not to change until 1997.
2 . The Share/Joint Activity revenue is derived from the flat $2 . 50 per 1 , 000 gallon Bolton Point rate structure
approved for the 1994 fiscal year. This rate level has been determined to be adequate for the 1995 Operating
Budget.
3. The Services To Other Governments revenue is lower than 1994 based on experience since S . C . L. I .W. C . has
been administrating the contracted and vender billings for the Municipalities.
4 . The Plumbing Permit Fees revenue is significantly lower than 1994 due to what appears to be a trend in lower
activity in the plumbing permit area .
5. The Miscellaneous Refunds and Revenue line has been reduced due to an anticipated lowering of revenue
from the Planergy "load curtailment" contract. Because the treatment plant is operating more in "off-peak"
power periods , our electrical power demand during "peak" periods has decreased . In shifting demand , the
plant now has less demand to curtail , therefore less curtailment for which to be
Appropriations :
1 . Total Personnel Services appropriations are 3% more than the 1994 budget amount.

SUPERVISOR' S REPORT November 10 . 1994
Although October was a relatively quiet month , I did attend several
meetings and ceremonies . The ribbon cutting, celebrating the official
opening of the. Srnith Hill Recreationway on October 25 . was a great
success attended by a number of residents, staff and state and local
officials . I would like to again express my gratitude to C,eorge Frant7. for
his fine planning of the ceremony and to all those staff, officials , and
rtsidcnU3 who contributcd to the succcss of the trail itself. It is truly a
Town landmark that will be enjoyed by many residents , present and
future.
On October 27 , I was privileged to speak at the Forest dome Improvement
Association's 1994 annual meeting. I outlined the Town's transportation
plans for that area , including a discussion of the GEIS , the N . E . Corridor
Study. and the. plans fnr re.ronstruction of Judd Falls Road and the down
stream bridge. A spirited question and answer session followed my
presentation . Forest Home asked me to convey its appreciation to the
Board for its commitment to public participation and its sensitivity to
F. M . 'a prublems w-id conccrns .
Better housing For Tomplans County was awarded a grant of more than
$200 , 000 for the placement of Elder Cottages in the County. I was pleaQed
to attend the ceremony on November 1 and to hear appreciation expressed
for the Town of Ithaca's pioneering role in zoning to accommodate these
homes for the elderly. Without the Town's support, BHTC would have had
difficulty securing this important. grant..
I also attended several information and planning sessions on various
topics , including the Ithacare court decision , improved inter-municipal
cuoperaLion, and Lha puts5ible acquisition of additional area park and
recreation lands .

DEVELOPMENT REVIEW
The Engineering Staff has been reviewing compliance on the
following projects that have received Planning Board approval and
are under construction :
Saponi Meadows Subdivision . Seven Mile Drive
Health Department approvals of the water and sewer plans have
been received and installation of the sanitary sewer has been
started .
Chase Pond Subdivision ( Saunders Road ) . East King Road
All improvements required from the contractor have been
completed . Additional subsurface drainage to has been
completed along the diversion and appears to be functioning
well .
Shalebrook Subdivision . ( Perry Lane ) . Bundy Road
The final paving ( top course ) has been completed and accepted
by the Town . The letter of credit for Perry Lane has been
released .
Sanctuary Woods Subdivision , Sapsucker Woods Road
Construction of the road and improvements has begun with
clearing of the road ROW and stripping of topsoil . Utility
installation is scheduled to start the week of November 7th .
WATER & SEWER
The Westhaven Road and Mecklenberg Road sewer extension
contract has been awarded to Randsco Pipeline and the
contractor has scheduled a construction start for November 15 .
1994 with substantial completion anticipated for mid December .
Final restoration will be completed in the spring . All
affected landowners have received notification letters .
The Troy Road and Coddington Road water extension project
contract has been awarded to R . L . Stevers and construction
started November 7th on Troy Road . Substantial completion of
the project is expected by mid December and final restoration
will be completed in the spring . All affected landowners have
received notification letters .
FACILITIES
The Town Engineer has continued to work with the Town Clerk .
the Highway Superintendent and the Parks Manager on a
facilities improvement plan . which includes the Town Hall
facilities and the Highway and Parks department needs .
WATERSHED AND STORM WATER MANAGEMENT
The Town Engineer has been working on developing a draft
stormwater management policy and regulation document based on
the NYSDEC model .

During the month of October the Highway crews spent 665 hours or
45 . 5 percent of their time in General Repairs work . This time
included hot patching roads , regular road repairs , cleaning
ditches , maintenance around Town Barn , and repairs to Forest Home
Drive Bridge .
In October the Town conducted its semi - annual brush pick up .
Preparing for and actual time completing consumed 323 hours or 22 . 1
percent of time . During brush pick up we have the use of three
chippers which makes the pick up much quicker . We did have to send
out a crew the following week to pick up some extra brush piles ,
though . All and all , the brush pick - up went smoothly . I would
like to take this time to thank the Highway and Parks crews for a
job well done .
The Highway crews spent 165 . 5 hours or 11 . 3 percent of their time
on Permanent Improvement projects . The projects included
installing culvert pipes by hydrants , putting up guide rail ,
installing subsurface drainage , and putting in shoulders .
Water Maintenance took 6 . 9 percent of the crews ' time or 101 hours
which included replacing an out of service hydrant . There are
about 25 hydrants around Town that still function but need
repairing .
Machinery maintenance and getting prepared for snow removal took
13 . 3 percent and . 9 percent respectively , for totals of 194 and 13
hours .
We have a couple of upcoming events worth noting . The first one is
a Confined Space Entry Training program that has been set up with
Lovell Safety for November 15 , 1994 . We have invited our
neighboring towns to participate . We are also going to have a CDL
( commercial driver ' s license ) driver evaluation and training
program during December .

16 Repairs to the walkway on the Upstream Bridge in Forest Home
were made , totalling 32 hours .
2 : Several lawn repairs , seedings , and some plantings requested
by Engineering Department were done . These jobs required 32
hours to complete .

3 , Various regular maintenance tasks on South Hill Trail were
done , requiring 25 hours during_ October . A ribbon cutting
ceremony to officially open the trail was held on October 25 ,
1994 .
49 All eight play structures were inspected for . safety problems
and several repairs were made , totally 58 hours .
5 . Mowing at all park and trail sites required 81 hours . This
included the use of Highway ' s new flail mower to trim back the
trail canopy along all sections of the East Ithaca Recreation
Way ,
6 . Parks contributed 151 worker hours during the Town - wide brush
pick - up held the week of October 17 through 21 . This included
call backs at several locations due to brush being put out
after the first pass through Town .
7 . Leaf removal at all park and trail sites was begun after brush
pick - up . So far , a total of 26 worker hours have been spent
on this annual task .
80 Numerous routine maintenance items , requiring 281 hours ,
completed our efforts for the month .

Town Planner' s Report for November 10 , 1994 Town Board Meeting
DEVELOPMENT REVIEW
Planning staff has been working on the following projects under Planning Board
review jurisdiction:
Foote / Varn Subdivision, Slaterville Road
Two lot subdivision, including parcel that would be added to adjacent
Peregrine Hollow development in Dryden, received final subdivision approval
at October 18th meeting.
First Residents Group at EcoVillage, Mecklenburg Road
Sketch plan discussion for 30 dwelling units (15 duplexes) and a community
center clustered on a 30 acre parcel at the EcoVillage site continued at the
October 4th and 18th Planning Board meetings, along with the referral of the
proposed SLUD from the Town Board for Planning Board recommendation.
Town Attorney, Town Planner, Town Engineer and Town Highway
Superintendant worked with the Planning Board and applicant to revise the
SLUD. A public hearing on the SLUD was held by the Planning Board at the
November 1st meeting, and a recommendation to the Town Board is
anticipated at the November 15th meeting.
South Hill Industrial / Retail Complex (DigiComp), Danby Road
Sketch plan was discussed at the September 20th Planning Board meeting.
This is a modification of a previously approved site plan (Novarr), now
consisting of 32,500 sq. ft. of retail / office / industrial use in three new buildings
and 5,000 sq. ft. of office / industrial use in an existing building to be renovated.
Primary access would be added off of the NCR site entrance. A public hearing

Staff is preparing the following SEQR reviews for the Zoning Board:
- Janice Cornish, 509 Five Mile Drive - Special approval to add second dwelling unit
to residential building on non-conforming parcel.
- Douglas Armstrong, 975 Taughannock Blvd. - Temporary use variance to permit
five unrelated individuals to occupy a single-family residence.
CURRENT PLANNING DEPARTMENT PROTECTS
Planning Department staff is working on the following projects:
Environmental Atlas : Staff met with Conservation Board to get project back on track.
This work will be ongoing over the next one to two years and will be formatted to be
compatible with a Geographic Information System (GIS) when implemented .
South Hill Recreation War: Nature trail brochure was completed and printed.
Ribbon cutting ceremony to mark official completion of trail was held on October 25,
1994,
Conservation District: Planning Committee met with a discussion group on October
17th to provide input on a proposed Six Mile Creek Conservation District. There was
mixed reaction to the idea of stricter development controls in this area. Planning
Committee will discuss next steps at their November meetings.
Fees in Lieu of Parkland: Town Attorney is preparing draft for Codes and Ordinances
Committee' s consideration.

Ithaca-Tompkins Coun Transportation Council (ITCTC): (Nothing further to report.)
Park-and-Ride Lot Study - Rt. 96 / Octopus Project: (Nothing further to report. )
Grant Application with City of Ithaca: The Town and City of Ithaca completed a
grant application to the State under the "Consolidation and Administrative Sharing"
(CASH) Program. The joint project would develop a model for combining the City,
Town and Cornell water systems and conduct an analysis using digitized information
to determine the most cost effective and dependable water system to serve all
interests . Grant awards will be announced soon.
Parks , Recreation and Open Space Plan Update: Staff has reinitiated an update of the
1977 and 1984 Park and Open Space Plans. Project will include a demographic
analysis and population projections to help identify future needs; an updated
inventory of existing park facilities; identification of needs for different areas of the
town; identification of potential future parks, trail connections and open space areas;
and a financial analysis of the implications of adding new park facilities, open space
properties, etc.
Noah' s Boat Club : (Will be discussed at November 10th Board meeting. )
New York Planning Federation Conference: Town Planner attended planning
conference at The Nevele from October 23rd to 26th. Sessions attended included:
approaches for regional cooperation; affordable housing; SEQR update; innovations in
resource management; legislative and case law update; open space planning
strategies; and a mock planning board hearing.

October 1994 Monthly Report
Records Management : Suzanne Etherington , Certified Archivist will
be at Town Hall on November 15 , to begin work on the archival
records and the indexing system . The SARA Regional Officer will be
visiting on November 17 , to review progress and offer
recommendations .
I was pleased to be asked by 'my fellow Town Clerk ' s to arrange a
day in early December to provide a tour and informational training
session on the Town ' s Records Management Program . Many other Town
Clerk ' s want to begin their programs and wish to learn how our
program was developed . The SARA Regional Officer will be invited
to attend .
Town Clerk : A second cat licensing survey has gone out to 500
random households in the County selected from the assessment rolls .
The new survey was prepared because there were many complaints from
the smaller towns that it was biased . The new survey has been
drafted differently to address that complaint .
The proposed cat licensing local law has been prepared and given to
the County Attorney for review . After revision , the County Board
will review and possibly set a public hearing . All Town Boards
will be sent results of the latest survey and encouraged to adopt
a resolution in favor of or opposed to the cat licensing .
Deputy Town Clerk , Mary Saxton has been preparing a new listing of
property name labels by using the tax roll . The new listing will
insure a newsletter is sent to each property in the Town and will
help eliminate duplication to one address .
Election Day preparations went smoothly . The Town Clerk will
deliver suitcases on Monday , and visit each polling place on
Election Day to address any Election Inspectors concerns .
The renovation of the Town Hall to provide an additional office
space began on November 7 . The renovations including completion of
the offices and meeting the ADA requirements in the downstairs
bathroom will take approximately two weeks . Construction of the
handicap parking ramp is also underway .

The month of October was spent on several different projects
including training , records management , and inventory . We are
attempting to get a majority of our projects completed by year end .
1-Ie have been monitoring our cash flow and estimated year end Lund
balances to assure that our finances remain sound until the end of
the fiscal year .
Petty cash in the Accounting Department was audited by the
Town Clerk . Both cash and receipts were in balance .
I met with Planning staff to discuss review fees and escrows .
We will be working to clear up as many tee distributions as
possible and examining and updating this procedure in the future .
The Town Clerk and I had several meetings with vendors to
gather information and prices on the construction and furniture for
new office space . We will be spending less money then originally
expected . Work will begin the first week of November and we hope
to be settled into our new offices by year end .
Hike Ocello has been a great help working with me to develop
several different specs for various computer purchases . With
surplus funds we will be getting five new computers . Thanks 1-like !
The ADP Committee met on October 31 , 1994 to discuss the next
phase in our project to standardize and upgrade computers and
software .
At their annual awards dinner on October 6th , Challenge
Industries presented the Town of Ithaca with an award in
recognition of our hiring individuals with disabilities .

PERSONNEL MANAGER ' S MONTHLY REPORT
PERSONNEL CHANGES
Several Town employees hired last spring under went their six
month probationary reviews . Deputy Town Clerk , Mary Saxton , and
Parks Grounds Assistant , Tim Eighmey , have been recommended for
regular appointment .
INSURANCE RFP PROCESS
Weeks of work went into preparation and mailing of spec packets
to six area . insurance agents . The response has been overwhelming
and applications and requests for information have satuated the
Personnel / Insurance Office for weeks . We hope to receive quotes
by November 28 , and an insurance package selected for the
December 12 Town Board Meeting ,
REVIEW OF BLUE CROSS / BLUE SHIELD CONTRACT CHANGES
The Personnel Manager has conducted a thorough evaluation of
three alternate health insurance plans and presented suggested
changes to the employees for their input . A recommendation
including supportive information has been provided to the Town
Board for review .
EMPLOYEE BENEFIT PROGRAMS
Three 1 - 1 / 2 hour programs were presented by the Personnel
Manager , one at the Highway Facility , two at the Town Hall , to
accommodate the schedules of all staff members . Updates and
changes to coverages or procedures were provided in detail .
Included in each program was a segment on violence in the
workplace and the need for awareness and prevention . The
questions and response at all programs was animated and full of
valuable feedback .
