Town Board Meeting Minutes
October 3 , 1994
At a regular meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York held at the Town Hall , 126 East Seneca
Street , Ithaca , New York there were present :

Call To Order : The Supervisor called the meeting to order at 5 : 30
p . m . and led the assemblage in the Pledge of Allegiance .
Agenda Item No . 3 - Report of Town Officials :
a . Town Supervisor - ( See budget message . )
b . Town Engineer - ( See attached report . )
Councilman Conley - The bids for the West Haven Road Sewer showed
two companies within $ 2 , 000 of each other . One company is based
out of town , and the other is from an Ithaca . What is the Town ' s
obligation for awarding a bid ?
Mr . Walker - If the bidder is reputable and qualified the lowest
bid must be accepted . There can be no preference given to a local
contractor . To disqualify a bid a documentable reason must exist .
c . Highway / Parks Superintendent - ( See attached report . ) A tour of
the town roads and highway projects is being planned for October 22
or October 29 ,
Supervisor Whitcomb - All Town Officials and staff should be
invited on the tour .
Mr . Noteboom - Placement of the oil and stone on Hopkins Road will
be completed tomorrow .
d . Town Planner - ( See attached report . ) The Eco Village proposal
will before the Planning Board on October 4 , Town Board members are
encouraged to attend . The Planning Board will be discussing the
SLUR , and updates on the sketch plan .
A ribbon cutting ceremony - for the South Hill Recreationway is being
planned for October 25 , or October 27 ,
Supervisor Whitcomb - The Governor or his representative may be
able to attend to cut the ribbon . Contact will be made with Ray
Bordoni of the Governor ' s office to make arrangements .
Mr . Kanter - Property acquisition regarding park and ride lots for
the octopus road project will be discussed in Executive Session .
The Planning Department is developing the Parks Recreation and Open
Space Plan update . This will be a top priority . The plan will
update past plans , make an inventory of all parks and facilities ,
make projections regarding demographics and needs assessments , and
develop specific ideas for new park facilities and trail
connections . Included will be financial projections for the next
10 to 20 years .
Councilwoman Harrison - The Planning Committee will meet
independently on October 11 , and have a citizens panel on October
17 to discuss ideas on Conservation Districts .
e . Building Inspector / Zoning Officer - ( See attached reports . )
f . Town Clerk / Receiver of Taxes - ( See attached report . ) The
financial report will be presented at the October 13 special
meeting . The Town Clerk thanked all other departments and staff
for their help in mailing out the newsletters .
Councilwoman Valentino - Two newsletters were sent to her
household . Can the labels be changed so only one is delivered to
each residence ?
Mrs . Noteboom - Normally , the labels are reviewed for duplication .
Review this time was not possible with the time frame needed to
have delivery before the brush and leaf pick up . The mailing list
is taken from the registered voters .
Councilwoman Harrison - The Supervisor ' s name should go next to the
Supervisor ' s Corner , and the Board Members names should also be
listed somewhere on the newsletter .
g . Assistant Budget Officer - ( See attached report . )
h . Personnel Manager - ( See attached report . ) Negotiations are
progressing to obtain a decrease in the proposed 28 % increase in
health insurance for 1995 . The rate is expected to be

approximately 5 % over the 1994 amount .
i . Attorney for the Town - Report will be given during Executive
Session .
Agenda Item No . 4 - Review of Correspondence :
Letter from residents of Birchwood and Pinewood Drive related to
the " Briarwood " development taking place in the wetlands northeast
of Birchwood Drive .
Supervisor Whitcomb - Referred to the Town Engineer and Public
Works Committee for discussion to respond and investigate the
residents concerns .
Mr . Noteboom has met and talked to several of the residents .
Councilman Klein - Was this a prior approval that is just getting
underway ?
Mr . Kanter - The project has been on going for several years . The
" Briarwood II " referred to in the letter has not come before the
Planning Board yet . That is an adjacent parcel with wetlands .
Supervisor Whitcomb - The wetlands were delineated a few years ago
as a result of construction .
Mr . Walker - The road is partially constructed . The water , sewer
and utilities have been constructed by the developer . Grading has
occurred on some lots including ditching to improve drainage on
individual lots .
Mr . Noteboom - The concern is that more and more water comes down
the bank .
Agenda Item No 5 , - Report of Town Committees
( See attached report by David Stotz , Town Representative Solid
Waste Advisory Committee . )
Councilman Klein - Public Works Committee meeting minutes have been
provided . Forest Home Bridge reconstruction has been main topic .
The County Public Works Committee approved the one lane bridge with j
wooden cantilever walkways . There is a question of liability from I
the engineers who designed the bridge . They have written to the
County saying that since it is a one lane bridge carrying two way
traffic , they want the County to indemnify them from any liability ,
the County wants the Town to address the indemnification . This
issue will be referred to the Attorney for the Town for his
recommendation .
Attorney Barney - If the Engineers were told by their client to

design the bridge a particular way , and it is designed that way , it
is unclear how they could feel they would not be held liable .
Councilman Klein - The Public Works Committee will discuss the Judd
Falls Road reconstruction at their next meeting . Forest Home
residents are being kept informed of these discussions .
Councilwoman Grigorov - The Planning Committee has scheduled more
meetings in order to finish the conservation districts .
Agenda Item No . 6 - Report of Tompkins County Board of
Representatives :
Dooley Keifer - Have the Engineer ' s designing the Forest Home Drive
Bridge and requesting indemnification for liability been officially
referred to the Town ?
Supervisor Whitcomb - It was discussed at the Public Works
Committee meeting after suggestion by the County Engineer .
Mrs . Keifer - The County Board has referred the issue to the County
Attorney for his advice . The County Board ' s initial reaction was
to do nothing .
Mrs . Noteboom - Additional Agenda Item No . 1 is related to this
issue . The fax transmittal from James Kazda , County Engineer
included a letter related to the " Hold Harmless and Indemnification
Clause " in the contract with the design engineer . This information
was presented to the County Public Works Construction Committee .
A contract between the County and Town will be developed in the
near future regarding maintenance and cost replacement of the
bridge .
Supervisor - Whitcomb read the paragraph which described the hold
harmless indemnity clause .
Attorney Barney - If the Engineer ' s are expecting indemnification
simply because of the design of a one lane road , the clause is too
broad . The Town cannot indemnify them from all of their design .
If indemnification is considered , it should be limited to the width
of the bridge .
Mr . Walker - This is the County ' s standard indemnification clause .
MRB is saying this clause makes them very uncomfortable . A court
could determine it substandard if the bridge is one lane on a two
lane road from a major arterial .
Mrs . Noteboom - When Mr . Kazda called and asked to have this
included on the agenda so the Town could consider accepting
liability for the Forest Home Bridge .
Councilwoman Harrison - As Representative Keifer has pointed out it

is one thing to come have a request from the County Engineer , and
another if it comes from the County Board , The County invited a
citizens committee to become involved in the drafting of the County
1995 budget . How has that been effective ?
Mrs . Keifer - The Citizens Committee was formed to help reorganize
the budget format . They have been very helpful and have held
meetings to present the revised format . Only a few people came to
the meetings . They discussed specific line items in the budget , not
the format . It is hoped the committee will consider actual details
of the budget . A sub - committee of this group made recommendations
about the contingency fund and fund restoration . The public does
not appreciate having taxes raised for these items . The County is
in bad shape with its fund balances .
Councilwoman Valentino requested information on the County ' s
decision regarding youth recreation funds .
Mrs . Keifer - The County had a request for $ 46 , 000 in funding .
Representative Joseph expected a fairly substantial reduction
request , to preempt that , he suggested funding be reduced to
$ 40 , 000 . That amount is the recommendation which has come before
the full County Board and is expected to be the maximum amount
budgeted .
Councilwoman Valentino - Will cat licensing come up at a later date
after the budget is finalized ?
Mrs . Keifer - Yes , the amount of funding the SPCA requested for cat
control has been substantially reduced in anticipation of serious
consideration of cat licensing as a way to fund cat control
expenses .
Mrs . Keifer asked that a set of the Town Board packets be sent to
the County for the three Town representatives to review .
Agenda Item No . 7 - Persons To Be Heard :
Dooley Keifer - Addressed the Board as a resident . What is the
status on Sunset Provisions on subdivisions which have been granted
approval , or those which have not moved forward ? There are
residents who hope this issue will be dealt with soon .
Mr . Kanter - The Codes and Ordinances Committee has a preliminary
proposal , and will again be discussed at their October 5 meeting .
Comments have been solicited from other Boards . The proposal may
go to the Town Board for consideration to set a Public Hearing very
soon . A draft of the proposal will be provided to Mrs . Keifer
after the meeting on October 5 ,
Councilwoman Harrison - Has the COC looked at phased subdivisions
also ?

Attorney Barney - Phased subdivisions do not create the problems .
Problem come from partially developed areas which are supposed to
be fully developed . Where is it fair to draw the line with the
developer and say they have developed enough not to have it taken
away , or have it lapse ?
Councilwoman Grigorov - Will this apply to only to future
developments or some that have already been approved ?
Attorney Barney - No , they were applied for under a different law .
Subdivisions are different , once they are approved and filed at the
County Clerk ' s Office they are considered permanent . There is
really no mechanism for revocation .
Mr . Kanter - There is already a provision in the State Law that
says , " preapproved ancient subdivisions that precede existing
zoning can be brought back before the Planning Board for further
review and planning " . This would address the old subdivisions
before zoning was in place .
Attorney Barney - There are some of those subdivisions in the
Town , but it is a question of who owns them . Considered are
subdivision regulations with the sunset provision included , they
would be considered by the Planning Board after public hearing . If
the Planning Board approved , it would come to the Town Board . It
is not mandatory that the Town Board hold a public hearing .
Mrs . Keifer - Route 13 Project : John Schroader , City of Ithaca and
others have bargained long and hard with the State Department of
Transportation for enhancements on Route 13 so the State can have
its four lane highway .
It is important not to lose site of the big picture . DOT has
returned to its original desire to have Route 13 a four lane
highway wherever possible . Most of the bridge project is in the
Town of Ithaca , the City has a very small portion of it . It is
understood the Town has supported replacing or repairing the
deficient bridges in the Buttermilk area , but it is not clear if
the Town publicly asked for a four lane highway . The Town
suggested the bridges could be built four lane , and used for
pedestrians and bikes until a four lane road could be shown to be
necessary . Having two lanes with a third lane for turning might be
sufficient at this time . The Town has empathized its concerns
about the wetlands on either side of the alignment , and for the for
general ambiance of park lands where the project takes place . a
The Town ' s
public stand over the last few years is in keeping with
the character of the area . It would also help to keep speed down
in which four lane highways do not . Both the City and Town have
recognized the value of the railroad abutments as a demarcation
between the urban commercial strips of the City entrance and the
more rural character of the park land agricultural part of Route 13

in the Town .
If the Town and the City were to stand firmly together and have the
City not approve its segment becoming four lanes , wouldn ' t DOT look
very foolish designing a four lane road that suddenly becomes a
small width and then opens up again ? The shady corners project is
a four lane highway with a noticeable overpass , which seems like a
large scale project compared to the Route 13 it narrows down to .
This is another argument for not having the stretch from the City
to shady corners become four lane . DOT is supposed to be changing
its approach to designing roads with the passage of the ISTEA
legislation . The legislation encourages them to ask communities
for their views . It would be very nice if the Town and City helped
DOT move in that direction with this project .
Agenda Item No . 16 - Consent Agenda Items :
Motion made by Councilwoman Harrison , seconded by Councilman Klein
approving and / or adopting the Consent Agenda Items 16 ( a ) - 16 ( b )
resolutions as presented . Carried unanimously .
Agenda Item No . 17 - NYS Dept . of Transportation Resolutions , Route
13 :
Councilwoman Harrison - A call was received from DOT saying they
expect the Town to accept maintenance responsibility for the
sidewalks . A significant part of the placement of the sidewalks
would be on State Park land . It is unknown if the Town can require
the State Park to maintain those sidewalks . Further investigation
with State Park ' s and the City is needed . The resolution as
presented should not be voted on at this time .
Councilman Klein - The newspaper stated the City negotiated
enhancements for the portion of Route 13 to be in the City . The
Town does have some concern since DOT is going to make Route 13 a
four lane road for over a mile . The reconstruction of Route 13
north was deplorable , a large portion of the green median was
eliminated . They have created very dangerous situations . The road
did need to be moved over , but they have taken engineering license
to improve drainage by eliminating the grassy median . They have
paved the equivalent of about eight lanes with blacktop . Are they
going to do the same with the other end outside of the City ?
Councilwoman Harrison - There is no question this project will be
massive . It will be four travel lanes in one area , with a turning
lane and 8 foot width shoulders . Previously this Board was told
there was concern about the extent of this project . A committee
has been meeting to discuss things like the bridge abutment to
service the gateway , and the guiderails . There will be no median .
The argument against the shoulder should not be made , as they are
necessary for pedestrians and bicyclists . If people are riding or

walking on a shoulder where the cars are going 55 mph it won ' t be
safe without the wide shoulders . This Board did not feel in the
past it was worth arguing against a four lane road .
Supervisor Whitcomb - Concessions have been made with DOT by
removing the railroad abutments and replacing them with
bicycle / pedestrian shoulders , sidewalks , and trees .
Councilwoman Valentino - The Town Board did not officially go on
record as to whether it should be a two lane or four lane .
Councilman Klein - DOT was going to construct the four lane for a
short period of time , and the Town was concerned with collapsing
the road where Route 13A joined Route 13 . At that time this Board
asked them to look at that intersection .
Councilwoman Harrison - This Town Board did go on record approving
the four lane bridges , and was somewhat silent on two lanes versus
four lanes . When it was raised at the Town Board level there was
a distinct impression there was not a strong sentiment it should be
two lanes . -
Councilwoman Valentino - Could the Town go along with the City as
suggested by Mrs . Keifer ?
Councilwoman Harrison - It is too late , it would be wrong to do
that . This Board sent me to the Committee to negotiate for
whatever kind of concessions and enhancements the Town could get .
It would be wrong to change our stance at this point . Five months
ago it would have been very good to take that position .
Councilman Conley - State Parks was involved in that committee and
strongly supported the four lanes .
Councilwoman Harrison - The bridges are in very poor condition and
there is concern about waiting to complete the construction .
Mr . Walker - The bridges are in terrible condition . You could walk
along the railroad and look up and see through the bridge over the
railroad tracks .
Agenda Item No . 18 - Town Hall Compliance Americans With
Disabilities Act :
Mr . Frost - Contacted the Fingerlakes Independent Center a local I
advocacy group for handicap issues , and the National Center for
Disabilities Services to make sure the proposed handicap
accessibility project for the Town Hall compliance is within the
law .
A proposal has been devised to build a handicap ramp at the front
of the Town Hall using pressure treated wood . If one entered Town

Hall without going up the ramp they would use wooden stairs going
into the building . This is a less expensive method of compliance .
There are advantages to the ramp being at the front of the building
as people entering for services will enter to the front desk .
Another idea is to change the concrete ramp at the side of the
building . The original estimate for $ 9 , 600 has been decreased to
$ 8 , 600 because the width of the ramp proposed could be narrowed .
The ramp would have to be widened at the top . This would involve
a cantilever ramp over the property line onto the bank property .
Citizens Savings Bank has been contacted and they are willing with
a legal agreement to allow the Town to encroach on the line .
An automatic door opener could be added to the back door , however
the National Center for Disabilities says the Town is not required
under the law to provide an automatic door opener . If security is
a concern for this room , a door bell can be installed . The law is
different for the private sector . What other businesses must do is
different than government agencies .
If the Highway / Parks Department were to construct the ramp out
front , it would not be necessary to bid the project .
Supervisor Whitcomb - The ramp would be less obtrusive on the side
of the building where it is now . Putting it in the front would
mean taking out the garden . The front ramp would allow easier
access to the building and the Town Clerk ' s Office making it much
more convenient .
Councilwoman Harrison - Are there times when the Board room is used
and the vault door is locked ? How would access to the front of the
building permit people to come to meetings in the back ?
Mr . Frost - The back ramp would still exist , even though it would
not meet the code . Compliance would be met with the front ramp .
Councilwoman Harrison - What would happen to the building resale
value with a ramp out front ?
Mr . Frost - A private entity would find upon moving here that they
would not comply where a public entity would .
Supervisor Whitcomb - Anyone purchasing this building would more
probably have to make major renovations anyway .
Ms . Alario - There are meetings in the Board room during the day .
It could be awkward and disruptive having people come to the back
door and ringing the bell expecting service .
Councilwoman Valentino - Would the front ramp come all the way to
the sidewalk , or would there still be room for some foliage ?

Mr . Frost - The ramp was widened to minimize construction costs .
There would be some room .
Councilman Klein - There is room for the installation of a
wheelchair lift out front of the building . The lift would cost
about $ 6 , 000 . That would be the least intrusive and would be in
the price range discussed . It would also help with resale value of
the building .
Mr . Frost - It would have to be protected from the weather .
Supervisor Whitcomb - This does not have to be decided this
evening , but the Town must be in compliance by January 1 , 1995 .
Councilwoman Valentino - Staff should also give their opinion as to
where the ramp should be .
Supervisor Whitcomb - Mr . Frost is to investigate the cost of
providing a handicap lift at the front of the building and to
report on the findings at the special meeting October 13 . The Town
Board has agreed the handicap accessibility will be provided at the
front of the building , either with a ramp or a lift .
Agenda Item No . 8 - Cornell University GEIS Special Land Use
District :
Supervisor Whitcomb - A public hearing has been set for the
November meeting to discuss this issue . Concerns and requests for
information from Cornell University will be discussed this evening
so it can be researched and presented at the public hearing .
Councilwoman Harrison - A number of the Board members went on a
site visit to look at the land . ( See attached prepared concerns . )
The report includes things about which more information is needed .
It is more efficient if concerns are raised now so Cornell
University can respond .
There are a few issues which have not been mitigated as fully as
they might have been in the draft GEIS . The Board may wish to
consider mitigation measures of some of the impacts having to do
with agricultural lands , visual transition between more rural town
and the college campus , and scenic views .
Route 366 , Game Farm Road , Cascadilla Creek , and Judd Falls Road
are Precinct 7 . As proposed in the draft GEIS , this entire area is
one SLUD . There is a natural area along the creek and McGowan
Woods . Those areas are reserved for activities associated with
that type of area . The rest would be rezoned as one piece . It
would allow college campus uses requiring site specific review by
the Planning Board as projects came up .
John Weisenfeld has said the total that might be developed would be

4 , 000 , 000 gross square feet , one third of everything Cornell has
now . The development of that amount is not probable .
The Forest Home traffic will be an important issue needing
consideration . The draft does not mitigate this issue . A free
parking area might keep some cars away from the area . The Forest
Home community may have other ideas to present . The Town Board may
be put in the position of having some people coming to the public
hearing saying there is a need for more mitigation .
Councilwoman Valentino - On the tour it seemed that what has been
said is close to what Cornell is saying the land is going to be
used for in the future . It does not seem that Councilwoman
Harrison ' s suggestions are unreasonable to consider .
Shirley Eagan - It was my understanding that a public hearing is
for the public to come and comment . Shouldn ' t they be listened to
first ?
Councilwoman Harrison - The Board did not want to hold up the
process by giving the list of concerns to Cornell at the public
hearing .
Shirley Egan - The public cannot comment on these concerns and
suggestions . They were not part of the GEIS or the SLUD which has
been available to the public . These suggestions are not for the
public hearing .
Supervisor Whitcomb - The public hearing will be to consider the
SLUD which has been previously developed over the months . The SLUD
has not been changed . These are issues that will come about as a
result of that public hearing .
Councilwoman Harrison - If the Forest Home community comes to the
public hearing and raises issues about mitigating traffic in Forest
Home , wouldn ' t it be better for Cornell to be able to address that
issue ?
Shirley Egan - The public hearing is not used in that way , it is
not a back and forth debate . It is a time for listening . If it
becomes a debate it makes a public hearing not as useful .
Councilwoman Harrison - " I disagree " .
Attorney Barney - A public hearing is not meant to be adversarial ,
it is for the Board to hear the pros and cons of the proposals from
the public .
Supervisor Whitcomb - It would be helpful if someone from the
public brought up an issue to have Cornell be able to respond in
some way after the public has had its say .

Shirley Egan - It cannot be guaranteed that at the public hearing
everyone involved from Cornell who may be qualified to answer some
of these questions will be there . It is anticipated that
Councilwoman Harrison ' s concerns will be the subject of discussions
as progress is made after hearing from the public .
Supervisor Whitcomb - It is extremely unlikely the Board will make
a decision after the public hearing , it will be for people to be
heard .
Agenda Item No . 9 - PUBLIC HEARING , Fire Protection Services
Contract :
The Supervisor opened the public hearing at 6 : 45 p . m . The Clerk
had proof of posting and publication . Public hearing was postponed
at 6 : 46 p . m . in order to continue discussion of Agenda Item No . 8 .
The Supervisor reopened the public hearing at 6 : 58 p . m .
Supervisor Whitcomb - The contract has been discussed at length at
other meetings with some language being revised . Everyone agrees
except about the map , and the 70 % Town share of reconstruction
costs of new fire stations .
Attorney Barney - The Town has a Fire Protection District for all
areas other than Cayuga Heights , The Town Board arranges for the
provision of fire protection and emergency services through two
contracts . One with the City of Ithaca , and one with the Village
of Cayuga Heights who provides service in the Northeast and the
village .
The contracts are the same except about Provision of Services . The
City provides protection for all areas except the Village , the
Northeast , and the hamlet of Forest Home . The Village covers the
inverse area . Between the two contracts the Town can be
comfortable there is fire or emergency protection within the Town .
There has been a question raised as to whether the definition of
the area excluded is correctly defined as the area to be taken out
of the contract . Or whether the rest of the area should be left in
the contract .
The map with a proposed Schedule A definition will now show the
area of responsibility the City would be willing to undertake in
this contract . The map and Schedule A were just received . The
Village of Cayuga Heights position should be determined because
they may have a different idea of what their coverage would be . If
so , there could be lapses in coverage or duplicate coverage .
Mr . Wilbur - There is some confusion as to what fire department
would cover the hamlet of Forest Home . What has been described as
the hamlet and what has historically been the practice of who
provides coverage are different .

The map is what could be determined in the short time allowed . It
shows what is believed to be the historic practice of providing
protection .
Mr . Lenhart , Cayuga Heights ; Jack Miller , Dispatcher ; and Mr .
Wilbur have been working to find the historical documents which
define Forest Home . Maps were reviewed to the dispatch computer to
compare what department responds to which address . Based on this
investigation the map presented was drawn .
Mr . Lenhart understands the Cayuga Heights contract specifically
names the streets for protection . It is believed those contract
street names will match what the map and Schedule A show , however
it has not yet been compared .
Attorney Barney - If the contract is approved it should be done
under the condition time be taken to confirm the Village of Cayuga
Heights will cover areas not named in this contract to insure
protection of the whole Town .
Supervisor Whitcomb - The proposed contract is better than the
current contract , it is more definitive .
Attorney Barney - True , as long as Cayuga Heights agrees with the
definition of the provision for services .
Chief Wilbur - There are bridges between Cayuga Heights in the area
south of Fall Creek . One is posted 5 tons which would not be used ,
and the other is posted at 20 tons which can be used . These will
provide access .
Attorney Barney - The contract calls for the Town to pay 70 % of any
renovations or refurbishing of the Towns fire stations and 27 % of
any renovations or refurbishing of the City stations . That was
thought to be changed to a $ 25 , 000 limit . It is clear in the
contract there is a ceiling per project . That wording may be
sufficient limitation , or maybe the Board wishes to change those
limits .
Supervisor Whitcomb - The language in the contract for the ceilings
for renovations and refurbishing are agreeable .
The Supervisor opened the floor for public comment . No persons
came forward to be heard . The Supervisor closed the public hearing

that the Town Board authorizes the Supervisor to execute the
agreement with the City of Ithaca for Fire Protection Services
commencing January 1 , 1995 and terminating December 31 , 1999 ;
subject to the approval of the language regarding the coverage of
the Town by the City and the Village of Cayuga Heights by the

Supervisor upon advice from the Attorney for the Town .
Councilwoman Valentino - Can the concerns as noted be cleared up
within the next few days ? The clarification must be done quickly .
Chief Wilbur - The definitions will be made clear in the next few
days . The attempt is to define what already is being done .
Attorney Barney - To protect the Town from a legal standpoint , a
signed agreement from the Village Board or the Mayor which
identifies the same boundary line should be secured so their
contract is the reciprocal of the City contract .
Chief Wilbur - Mr . Lenhart is receiving the Village contract this
evening , it contains some language neither party was aware of which
has more definition . The comparison will be made and the letter
from the Village can be given to the Town .
Mr . Walker - Is the Cornell Water Treatment in the City of Ithaca
area ?
Chief Wilbur - The plant is in the area protected by Cayuga
Heights , but it is included in a specifically designated area the
City would respond to .
Mr . Walker - The upstream bridge is a 5 ton limit . Judd Falls Road
in Forest Home is a 5 ton limit , not the bridge itself . How will
Cayuga Heights respond to a fire in Forest Home between the
upstream bridge and Dryden if the bridge cannot be crossed ?
Chief Wilbur - They will cross Pleasant Grove to the downstream
bridge and around Plantations Road . Using Fall Creek as a boundary
would be very precise and easy to deal with because of the bridge .
The district as presented on the map is what has been used
historically .
Mr . Walker - Would there be an increase in the cost of serving the
Town if all of Forest Home Drive from Caldwell Road to Dryden was
covered ?
Supervisor Whitcomb - The cost of fire protection is based upon the
assessed valuations of the districts . It is unlikely using the
creek as a boundary line would have an effect on that assessment .
Chief Wilbur - The City would not take exception if the boundary
were changed , the Cayuga Heights Fire Department probably would .
Councilwoman Harrison - Even if they were giving up area ?
Supervisor Whitcomb - The Town ' s concern is for consistency so that
each fire department fully understands what their obligation is to
the Town . It is fine if both departments showed up at one fire ,

but it would be disastrous if neither did .
During the fire contract discussions there was a list of items
which were felt best left for review at a later time . The review
would include defining the rolls of the Fire Commissioners ,
scheduling of fire department men and equipment , hiring practices ,
and other miscellaneous items .
Councilwoman Valentino - Wasn ' t an agreement been reached regarding
the hiring practices by proposing special state legislation ?
Chief Wilbur - Another issue to be addressed is drafting similar
code enforcement legislation in the Town and City .
Motion called and roll call vote carried unanimously .
Councilman Conley - The hydrant flags still need placement on the
road he lives on .
Mr . Noteboom - The Highway Department has some hydrant markers , the
fire department personnel can pick them up to place them .
Chief Wilbur - The hydrants will be prepared for winter shortly .
Agenda Item No . 19 - Minor Revisions Town Hall Office Space :
Supervisor Whitcomb - There are acutely overcrowded working
conditions in the Town Hall . An opportunity has been seen in the
downstairs to correct some of space needs on an interim basis .
Mrs . Noteboom and Ms . Alario were asked to investigate .
Mrs . Noteboom - There are two cost estimates for what could be
done . A wall would be taken out of the present Town Clerk ' s Office
and another built adjacent to enlarge the office . The kitchen area
and equipment would be placed in the large closet in the hallway
( kitchenette ) to make the present kitchen an office .
These minor renovations would allow Mrs . Noteboom more room
adjacent to the vault and the Supervisor ' s office , as well as
provide an office for Ms . Alario . Ms . Alario presently shares an
office with two staff .
The new furniture would allow more efficient use of space and more
desk top area for spreading out large printouts and mail outs .
Modular furniture would best conform to the wall space .
Mr . Frost - A door between the kitchenette and the proposed office
for the Town Clerk would meet the requirement for handicap
accessibility .
Councilman Conley - The furniture proposal would provide a great
deal more useable space for that limited area .

Councilwoman Harrison - Could the existing office furniture be
used ?
Mrs . Noteboom - The present furniture is six or more small tables
at different heights , placed together to have some uniform space .
Mrs . Alario only has a desk . Mrs , Noteboom and Ms . Alario move
back and forth between the Supervisor ' s Office and the board room
to find enough space to work .
Supervisor Whitcomb - The procurement policies and regulations
requiring three quotes would be done .
Councilman Conley - At least the types of furniture needed are
known .
Councilwoman Harrison - It seems reasonable to spend money to make
a space more useable . Since there are plans to move to a new
building and the same appearance by having like furniture is
desirable , does it make sense to spend this much money on
furnishings for two offices ? Would there be any way to make the
space useable spending less ?
Supervisor Whitcomb - The company which produces this furniture may
not be the low bidder for the new Town Hall , or still be in
business .
Ms . Alario - The stores carrying this type of furniture carried
similar models .
Supervisor Whitcomb - There are dozens of different suppliers with
many types .
Councilman Klein - The quality grade does vary with less expensive
furniture not lasting as long . There will be no guarantee this
furniture will be of any value when the offices are moved to a new
Town Hall , but maybe these units could be reused somewhere in the
new facility . A new complete furniture package would probably be
considered at that time . The price per work station as quoted is
not an unreasonable amount . Unless several companies can quote the
same product , it is hard to know what is being purchased .
Mrs . Noteboom - The investigation of prices will continue . These
amounts were thought to be the " high " estimates .
Councilwoman Harrison - The Board may wish to approve the minor
construction , but ask that more
work be undertaken to decide if use
of present equipment could be made .
Motion made by Councilwoman Harrison hereby authorizing the
solicitation of proposals for the construction of two offices .

Supervisor Whitcomb - It may be a long wait for new furniture ,
sometimes it takes several weeks .
Councilman Klein - Most companies have a quick ship program .
Attorney Barney - Work stations for their new office took six
weeks . A table was ordered seven months ago .
Councilwoman Valentino - What about the work stations , the motion
does not include them ?
Councilwoman Harrison - The motion doesn ' t include the work
stations at this point .
Councilwoman Valentino - The purchase of reasonably priced work
stations should be pursued . With the limited space using odd
furniture after spending money on construction is not going to
answer the need . The work station is a way of consolidating space
more efficiently .
Councilman Conley - The work stations are also designed with the
proper lighting .
Councilwoman Harrison - The work stations are priced twice as much
as the construction .
Mr . Walker - The construction is minor . There will not be full
partitions . Rearranging is being done to move walls in a way they
can be moved easily . Is the money budgeted for , if so it wouldn ' t
have to be bid ?
Ms . Alario - All that is necessary is to obtain three quotes .
Councilwoman Grigorov - The quotes should be sought from different
companies .
Mr . Walker - The staff has been thinking about this very hard , and
have been working to secure the best possible prices . They are
capable of receiving the quotes .
Councilwoman Valentino - One of the reasons so little construction
will have to be done is because the work station is costumed made
to fit that area . The two compliment each other . The probability
of reusing the work stations compared to building a wall is much
higher .
Councilwoman Harrison - Withdrawal of motion , approved by
Councilman Conley .
Motion made by Councilwoman Valentino , seconded by Councilman
Conley approving the reconstruction of the kitchen , storage closet ,
bathroom , and Town Clerk ' s office in the downstairs of the Town

Hall at a cost not to exceed $ 5 , 000 ; and the purchase of two work
stations for a cost not to exceed $ 8 , 000 . Funds shall be expended
from A1620 . 413 with all procurement regulations followed .
Councilman Klein - Does the quote on the work stations include
installation ?
Mrs . Noteboom - Only for the company Option Design , the other
company did not include installation .
Councilman Klein - Make sure installation is included , some of
these stations are like puzzles . It is not worth staff time to
figure out how to put it together .
Ms . Alario - The other vendor called said they would recommend
another company , but they would not install the stations .
Motion carried unanimously .
Agenda Item No . 20 - Insurance Program :
Supervisor Whitcomb - The Insurance Committee consisting of the
Supervisor , Councilwoman Valentino , Councilman Klein and Pat Punger
met with Mr . Boothroyd the Insurance Consultant . Mr . Boothroyd
completed a through analysis of the insurance program and has made
recommendations to the Committee .
The Committee is requesting authorization for the Personnel Manager
to proceed with solicitation for proposals ( RFP ) from insurance
companies based on Mr . Boothroyd ' s recommendations .
Councilman Klein - The recommendations showed deductibles are
extremely low and the Town can afford to increase those producing
savings .
Councilwoman Valentino - It was impossible to see how important
some recommended coverage will be until the costs are known from
the RFP . Then the benefit can be weighed against the cost before
a final decision is made .
Mr . Boothroyd was very good and very informed . A great deal was
learned about insurance . It was very impressive the way Ms . Punger
did the research . Mrs . Punger has extensive knowledge regarding
the current insurance the Town has and needs . Thank you to Ms .
Punger for all her hard work .
Councilman Klein - It, is necessary to authorize extension of Mr .
Boothroyd ' s services . The amount paid of $ 500 was for a limited
review . Mr . Boothroyd did not include the review of any bid
specifications .

Ms . Punger - The review of those items will not be done for a few

IMPROVEMENT AREA EFFECTIVE JANUARY 1 , 1995 " :
The Supervisor opened the Public Hearing at 7 : 30 p . m . , the Town
Clerk had proof of posting and publication . The Supervisor
postponed the Public Hearing until finalization of Agenda # 20 .
Agenda Item No . 20 - Insurance Program , Cont ' d :
Motion made by Councilwoman Valentino , seconded by Councilwoman
Harrison approving use of the 1995 Insurance Program as the Town ' s
guidelines for soliciting insurance during the upcoming requests
for proposals process . Carried unanimously .
Agenda Item No . 10 - Cont ' d :
The Supervisor reconvened the public hearing at 7 : 35 p . m .
Supervisor Whitcomb - The local law proposes combining the current
rate of $ 1 . 35 plus the surcharge of $ . 175 for $ 1 . 525 per 1 , 000
gallons , to a new rate of $ 1 . 95 per 1 , 000 gallons while lowering
the minimum bill from the current 10 , 000 to 8 , 000 . The net effect
of increasing this rate from $ 1 . 525 to $ 1 . 95 on the average 10 , 000
gallons usage per quarter would be about $ 4 . 00 each quarter more in
the sewer bill .
Last year with the 10 , 000 gallon minimum there were a number of
people who had low consumption such as the elderly , persons with
fixed incomes , and one or two person households who complained that
their minimum charge was unfair because they did not even use the
minimum . They felt they were being penalized for being
conservative . Rolling the minimum charge back to 8 , 000 gallons
negates the rate increase for those users .
Minimum users are currently paying $ 15 . 25 per quarter for 10 , 000
gallons , the new rate would go to $ 19 . 50 per quarter for 10 , 000
gallons , and $ 15 . 60 for 8 , 000 gallons .
The corporate users like Cornell University , Ithaca College and
Tompkins Community Hospital were contacted and told of the proposed
rate increase . They were invited to the public hearing .
The sewer budget for years has enjoyed a healthy fund balance . The
fund balance had been : set aside because it was anticipated the City
would be charging for preparation of joint transmission lines . The
contract for that has yet to be signed .
The cost of operations of sewer have increased dramatically . This
year there have been emergency repairs on the West Hill and the

hospital sewer . Fund balance has been depleted to within
prescribed limits by the State Comptroller of 10 % to 15 % of the
budget amount . There is a reluctance to decrease the fund balance
much further . In order to maintain a healthy fund balance and to
do the type of maintenance needed it is necessary to increase the
rate .
Councilwoman Harrison - Does the sewer fund pay for both its
operation , and capital borrowing ?
Mr . Walker - The sewer budget has several components . Payment is
made for treatment of the sewage at the Wastewater Treatment Plant
which is the largest expense , maintenance and operation of the City
collection system that is jointly used , maintenance and operation
of the Town ' s collection sewers outside the City , capital projects
and replacement , and the Village of Cayuga Heights for sewer rents .
The payment to the Wastewater Treatment Plant was $ 536 , 000 in 1994 ,
and it will be $ 596 , 000 in 1995 . This $ 60 , 000 increase is
approximately an 11 % . The first projected amount was to be a 28 %
increase . The rate is set by the Joint Sewer Committee ,
Mr . Walker - This is for the direct operational costs of the plant
distributed by consumption .
Councilwoman Harrison - Is new construction covered in this rate ,
such as the extension of the sewer line on West Haven Road ?
Supervisor Whitcomb - The money for that project is paid through a
combination of the benefit assessment fee and the operational cost
used for debt service .
Councilwoman Valentino - Since this covers repairs and maintenance
the money can be used to cover costs for repairs of the older sewer
lines the Town has .
Supervisor Whitcomb - This money covers repairs . Major capital
expenditures should be bonded in the future .
Councilwoman Harrison - What is being paid for debt service out of
these monies ?
Ms . Alario - Approximately $ 700 , 000 for principle and interest .
Mr . Walker - The sewer rate has not kept up with the inflation rate
because of the transition from the old system where the Town did
not own the treatment plant . The Town paid the City a rate of 1 . 5
times the sewage treated . As the Town became owners with the City ,
the Town took on a contractual obligation which took several years
to generate . Over this period not as much was paid to the City so
the fund balance grew . Now there has been a shortfall in revenues ,
and expenses have increased . The fund balance has been reduced to

a minimum . The fund balance needs to be built back up , and
maintenance which has been put off has to be completed . Over the
last ten years almost no maintenance has been on the major sewers
needing repair .
Councilman Conley - The City has also been lax in the maintenance
of their lines . The Town has some obligation to do repairs in
conjunction with the City . The City has bigger problems than the
Town . It makes good sense for the Town to maintain a healthy fund
balance .
Supervisor Whitcomb - Discussions are underway with the City to
share the large cost of repairs to the joint transmission lines .
Mr . Walker - An agreement with the City has been made for
maintenance of the sewers which are jointly used . The Town is
paying 17 % of the City operation and maintenance costs . That is a
good deal for the Town . In the next few years that may be
evaluated and the Town may be forced into a higher share of the
cost .
Councilman Conley - The Town has to be concerned with the City ' s
major repairs which could cost the Town more money .
Mr . Walker - The City has completed some capital improvements .
Attorney Barney - Items regarding what the Town may or may not do
with the City of Ithaca relating to contracts should be discussed
in Executive Session ,
Supervisor Whitcomb - Residents should pay for the true cost of the
services they are provided . The sewer fund is supposed to be self
sustaining . Raising this sewer rate is probably the most painful
decision this Town Board will make during the budget process .
Mr . Walker - The Town sewer rate is lower than what the City
charges their users .
The Supervisor invited the public to speak , no one came forward to
comment . The public hearing was closed at 7 : 47 p . m .
Agenda Item No . 11 - SEQR , Local Law to Amend Local Law # 61 1986
Sewer Rents :
Motion made by Councilwoman Valentino , seconded by Councilman Klein
making a negative determination of environmental significance in
accordance with the New York State Environmental Quality Review Act
for the above referenced action as proposed and , therefore , neither
a Full Environmental Assessment Form , nor an Environmental Impact
Statement will be required . Carried unanimously .
Agenda Item No . 12 - Enactment Local Law Sewer Rents :

Agenda Item No . 22 - Elected Officials Salaries , 1995 :
The proposed Elected Officials salaries are recommended with a 3 %
cost of living increase as adopted for staff for 1995 . The policy
is to keep these salaries in pace with inflation rather than having
no increases for several years and then increasing them large
amounts .
Motion made by Councilman Klein , seconded by Councilwoman Harrison
adopting the following salaries for the Elected Officials for the
year 1995 : Supervisor , $ 16 , 900 ; Budget Officer , $ 4 , 700 ; Town Board
Members $ 5 , 650 ; Town Justices , $ 10 , 625 . Carried unanimously .
Agenda Item No . 23 - 1995 Water and Sewer Benefit Assessments :
Supervisor Whitcomb - Presently the benefit assessment for sewer
unit is $ 78 . 00 and $ 80 . 00 for water . The water benefit assessment
is proposed to remain the same for 1995 .
The sewer benefit assessment proposed for 1995 is an increase from
$ 78 . 00 to $ 82 . 00 . The theory is this assessment pays for capital
expenditures , however this money falls short of paying the $ 700 , 000
as debt service . It pays approximately $ 500 , 000 with the balance
met out of current revenues . The sewer extension on West Haven
Road is the primary reason there is a need to raise the assessment .
Councilwoman Harrison - Please explain the $ 12 . 00 to $ 14 . 00
increase .
Ms . Alario - The $ 14 . 00 is the amount paid to the City for
operation of the sewer plant and jointly owned capital projects .
The capital costs may be increasing because of proposed capital
projects .
Councilwoman Harrison - Of the $ 82 . 00 per unit , $ 14 . 00 is for the
payment to the City and the balance is for principle and interest
payments . However , this amount does not fully cover the debt
service amount .
Supervisor Whitcomb - These revenues go to the sewer fund and
expenses are paid from this fund . This money is not placed in a
special fund to pay the debt , it goes to the sewer fund . The
purpose for appropriations are clearly identified as line items in

the sewer fund budget .
Motion made by Councilwoman Valentino , seconded by Councilman Klein
approving an increase in the sewer benefit charge from $ 78 . 00 per
unit of sewer assessment to $ 82 . 00 per unit . Of said assessment ,
$ 14 . 00 shall be for the Town of Ithaca - Ithaca Area Wastewater
Treatment Plant Improvement Area and $ 68 . 00 per unit shall be the
assessment for the Town of Ithaca Townwide Sewer Improvement
District . The increased assessment is the basis for determining
the sewer benefit assessment roll for the year 1995 .
Councilwoman Harrison - The desire was these funds pay all the
capital debt , that is not happening . Was consideration given to
increasing this assessment more and the rates less , to move towards
this assessment paying the full capital costs ?
Supervisor Whitcomb - That was not considered , if benefit
assessment rates were used to cover capital and debt service
expenditures rates would be in excess of $ 100 . 00 per unit . That is
a bargain compared to what some neighboring towns have to charge .
Ms . Alario - It is more of a burden to pay this once a year through
taxes than to split into four quarterly payments in a rate
increase .
Attorney Barney - It is fair to assert some of the debt service
against individuals using the sewer as opposed to individuals who
may not be .
Supervisor Whitcomb - It has also been suggested the entire debt be
paid through the rate doing away with the benefit assessment . This
can be analyzed in the future .
Councilwoman Harrison - This should be looked into because there
would be policy decisions which relate to land use and development
pressures .
Supervisor Whitcomb - That is a good suggestion . The Town has to
look at the entire benefit assessment formula in light of issues
which came about as a result of the Coddington Road water
extension .

Mr . Walker - The proposed water rate is approximately a 3 %
increase . The surcharge was $ . 50 ( 20 % of the cost ) . All charges
are being rolled into one base rate . The actual increase in the
total bill for 1 , 000 gallons is $ . 05 .
The base rate looks significantly higher , the surcharge has been
eliminated . Instead of a $ 2 . 50 per 1 , 000 gallon base rate plus the
$ . 50 surcharge totalling $ 3 . 00 , the rate will be $ 3 . 05 as a single
rate .
The $ 2 . 50 is the rate paid to Bolton Point ( SCLIWC ) to produce the
water and basic services . The surcharge was added for distribution
by the Town . The change is being made because a basic rate is much
simpler than having surcharges . This is a flat rate per 1 , 000 with
a minimum of 10 , 000 gallons .
Councilwoman Valentino - A flat rate is what has been needed for a
long time .
Supervisor Whitcomb - The actual rate percentage increase is 1 . 6 % .
Councilwoman Valentino - In the past , large bulk users would be a
lower rate . This rate makes more sense .
The Supervisor asked for public comment , no persons wished to
comment . The public hearing was closed at 8 : 12 p . m .

Supervisor Whitcomb - An explanation of the tentative budget is
attached . There is a slight increase in overall revenues and
expenditures . The Commission has recommended leaving the rate
( $ 2 . 50 ) the same for 1995 as there was sufficient fund balance .
The benefit assessment revenues for the five municipalities remains
the same and is not likely to change until 1997 .
The share of joint activity revenue derived from the flat $ 2 . 50
rate per 1 , 000 gallons stays the same . Services to other
governments is slightly lower based on experience of SCLIWC
administering the contractor and vendor billings .
Plumbing permit revenues will be lower than 1994 , due to a trend in
lower activity , ( less development ) . Miscellaneous refunds and
revenues has been reduced slightly .
Appropriations : Personal services average 3 % more than 1994 . Total
administration is less due to fewer planned equipment purchases and
lower insurance costs . Source of supply is up due to expected
power cost increases .
Purification is higher due to funds set aside for the Bolton Road
commitment . A road from Bolton Point to the lake has to be
repaired and completed .
The Zebra Mussel project is complete through funding several years
ago . The principle and interest payments will be made for many
years .
Agenda Item No . 25 - Adoption SCLIWC Preliminary Budget :
Motion made by Councilman Conley , seconded by Councilwoman Harrison
adopting the 1995 SCLIWC Tentative Budget as the 1995 Preliminary
SCLIWC Budget , and directing the Town Clerk to advertise for a

Tentative 1995 Budget by the Fiscal Officer , ( Supervisor ) . The
budget will be reviewed and discussed . Any revisions at this time
can be made and approved during this work session . The Town Board
will then have the opportunity to approve the Tentative Budget with
revisions as the Preliminary Budget . Any line items can be changed
after it becomes the Preliminary Budget until adoption as the Final
Budget after a public hearing with the exception of the Elected
Officials Salaries , which could be lowered but not be increased .
After the public hearing , which must be held no later than the

first Thursday following the General Election ( November ) , changes
can still be made . After any further revisions based on
discussions and comments at the public hearing the Board can adopt
the Preliminary Budget as the Final Budget . The adoption of the
budget can be adjourned on a day to day basis until November 15th .
Councilwoman Harrison If any comments are made at the public
hearing which causes the Board to further deliberate a line item ,
the Town has up to the 15th of November to adopt the budget ?
Mrs . Noteboom - To postpone the adoption of the budget after the
public hearing , a quorum of the Board must reconvene on a daily
basis to continue postponing the adoption of the budget .
Supervisor Whitcomb - Copies of the Town Budget and the
Supervisor ' s message were presented , ( see attached ) .
The budget is broken down into several different funds . Townwide
Funds are expenditures which are relevant to the entire Town , as
opposed to the Outside Village Fund which is that part of the Town _
outside of the Village of Cayuga Heights .
Source of revenues vary , they are received from real property
taxes , payments in lieu of taxes , interest and penalties , sales •
tax , etcetera .
Councilman Conley - Where do the revenues from the Town Justices
show ?
Mrs . Alario - Under fines , fees and forfeited bail .
Supervisor Whitcomb - State aid per capita was eliminated in 1991 .
Mortgage tax estimate was reduced because it is expected the " boom "
in refinancing of homes is over .
Councilman Klein - Won ' t the mortgage tax revenues be over budget
in 1994 because of Kendall Farms ?
Ms . Alario - $ 19 , 000 + was received from the Kendall project causing
an overage of revenues .
Supervisor Whitcomb - The aid for Youth / Elderly programs is
reimbursement from the County and the State for youth programs ,
Gadabout , etcetera .
More fund balance has been appropriated for 1995 .
Councilwoman Harrison - What is an appropriated fund balance ?
Supervisor Whitcomb - Each fund has unexpended dollars at year end ,
an estimate is made of those funds to determine how much can be
carried over into the next year ' s budget , or appropriated .

The Townwide Fund has a fund balance of approximately 15 % to 20 % .
The auditors have recommended keeping it about 10 % , it is argued by
the Fiscal Officer that surprises like the 1991 withdrawal of State
Aid require a healthy fund balance be maintained .
Each year is started with many expenses , but revenues through taxes
are not received until several weeks into the year . This carry
over is needed to kept cash flow adequate .
Councilman Conley - What can the State Comptroller do if the Town
does not follow their recommendations about the amount of fund
balance kept ?
Supervisor Whitcomb - They can give a written reprimand .
Attorney Barney - A healthy fund balance is beneficial when
borrowing or bonding as it shows conservatism . If the Town made a
blatant continuation of violation of the Comptroller ' s
recommendation the State could withhold aid .
Supervisor Whitcomb - The Fiscal Officer and the Assistant Budget
Officer have spent a great deal of time on the budget over the last
six weeks . This is a combined and cooperative effort of the entire
staff . Thank you .
The Supervisor reviewed each page of the budget with the Town
Board .
Budget Personal Services has an increase due to the 1 / 2 time
Accounts Clerk who is now full - time .
Mrs . Noteboom - The Town was required through December 31 , of this
year to withhold social security and medicare from the election
workers . As of January 1 , 1995 that is no longer necessary .
Election personal services appropriation has been moved to the
contractual line for election workers because they can now be paid
without being put through the payroll process .
Supervisor Whitcomb - The largest expense for elections is $ 17 , 500
being charged back to the Town from the County for administration
of election expenses . This represents charges for non -personnel
services such as printing , advertising , mailings , etcetera .
It is expected that a new Town Hall will not be accomplished in
1995 . Some appropriations have been made for equipment , buildings
and ground maintenance to make necessary repairs .
Shared services are costs for things which cannot be identified to
one specific department like office supplies . The appropriated
amount has decreased because the contract payment for the old IBM
computer system is finished .

Unallocated insurance is for the liability and fire insurance .
In 1994 there was a $ 40 , 000 contingency because of questions of how
much the State Retirement would cost . Those questions have been
resolved . In 1995 , the health insurance costs are yet unknown .
There was a possibility of a 28 % increase from Blue Cross / Blue
Shield which would have cost the Town an increase of over $ 60 , 0001 .
Raising the deductible on prescriptions from $ 1 . 00 to $ 5 . 00 and
$ 10 . 00 will negate most of that increase . Money is being left in
the contingency in anticipation of the worst scenario .
Playgrounds and recreation include the Coddington Road Community
Center expenses . Increases are in the realm of inflation .
Councilwoman Harrison - The Personal Services monies have been
removed from Playgrounds and Recreation , where would they be found
in the budget now ?
Supervisor Whitcomb - They would now be found in the part town
portion under parks .
Ms . Alario - There had always been a minimal amount budgeted under
this personal services item which had never been used .
The City of Ithaca Youth Bureau will have a substantial increase
from $ 139 , 000 to $ 160 , 000 . Part of the increase will be reimbursed
to the Town from the County ' s participation . The net increase in
total youth and community services is about $ 26 , 000 .
Councilwoman Valentino - The youth services have actually been
under funded for the last few years while the Joint Commission
worked on the best way to utilize the funds .
Supervisor Whitcomb - The community services increased from $ 10 , 000
to $ 34 , 000 for the Learning Web , Youth Corp , Jobs for Youth , and
Youth Municipal Workers .
Councilwoman Valentino - The good news about the increases is that
they are will provide more programs for the youth .
Supervisor Whitcomb - Employee benefits increases are due to the
increase in staff , 3 % cost of living raises , and inflation .
Councilwoman Grigorov - Is there an item for unemployment
insurance ?
Ms . Punger - The Town is self insured , it is not budgeted for or
used unless there is a claim .
Supervisor Whitcomb - The $ 200 , 000 transfer to Capital Reserve is
from the extra penny in the County sales tax approved in 1993 .
This will be transferred to a reserve fund in anticipation of the

purchase of a new Town Hall . Some Towns have spent the extra penny
from the sales tax . Technically , the extra penny increase is
temporary . In 1995 there could be a reversal to an 7 % sales tax
instead of 8 % . If the Town used temporary revenues to fund
permanent appropriations there would be many problems . Until the
status of the sales tax is known there is a reluctance to spend
temporary funds on current expenses .
Councilwoman Grigorov - Has any other Town reduced property taxes
with the extra penny ? Could that be done ?
Supervisor Whitcomb - The Town of Ithaca elected to put those funds
into a reserve . In 1995 a risk retention reserve will be funded to
cover items in the Town insurance which are not covered , such as
deductibles , claims not covered , etcetera . This will become more
important if the deductibles are raised .
Councilman Klein - There had been discussions about transferring
more money into the Capital Reserve , would that show in the 1995
budget or is it done in a different way ?
Supervisor Whitcomb - That transfer could be done at year end
depending upon the actual fund balance .
Councilwoman Harrison - Village of Cayuga Heights residents pay for
all of the Town staff and items outlined in the Townwide budget ?
Is that something which is required by law .
Supervisor Whitcomb - Only the staff as outlined in the Townwide
portion is paid by the Village residents . It is required by law
because these people in the Townwide portion like the Town Clerk
are providing service to people in the entire town .
Part Town Appropriations : There is a transfer from Part Town to
Highway , taking that amount out results in a decrease in the
appropriations for the Part Town approximately $ 31 , 000 due to the
elimination of the GEIS planning study , and decrease in
contingency .
Revenues : The estimated increase in sales tax revenue was left the
same in Part Town as it was not needed to balance the budget .
State Aid is up $ 10 , 000 . Conservation Corp is a revenue from the
County for the municipal workers shared with Lansing . $ 130 , 000 of
fund balance from 1994 is being utilized to cover the transfer to
highway . A major component of the Part Town Budget is the highway
portion .
Appropriations : A slight increase in the Attorney for the Town has
been appropriated .
Councilwoman Harrison - The Attorney for the Town is divided
between the two budgets . The appropriation is based on an estimate

of the services provided .
Supervisor Whitcomb - Shared services at one time was a split
between Townwide and Part Town , now it all is paid through
Townwide . The contingent line item stayed the same to cover the
anticipated increases in health insurance , if it is not used it
will go to fund balance .
There is an increase in the parks personal services for maintenance
and construction . Contractual expenses will stay the same .
The appropriation of the Youth Conservation Corp has been decreased
by $ 10 , 000 to none because of the completion of the South Hill
Trail . This year monies will be budgeted for under another line
item , Conservation Corp . The zoning portion is considerably less .
Appropriations are much the same as 1994 , with the exception of the
offset for the GEIS study . There is also funding in planning
equipment for computers and the purchase of an automobile for the
planning department . The automobile could be used by other Town
staff when it was not being used by the Planning Department .
Currently planning staff drives their own vehicles and bills the
Town . This would be an additional vehicle .
Mr . Kanter - There are three full time professional staff doing a
' significant amount of development review which should involve site
visits . There are several SEQR reviews for each Zoning Board
meeting for which site visits are made . The Parks Recreation and
Open Space update and other new projects will require site visits
to all parks . The Environmental Atlas will need site verification .
There seems to be more need for planning staff to go out and
complete field work and attend meetings . The Department Head has
been attending up to four evening meetings per week , it would be
helpful to have a car available to attend those .
Supervisor Whitcomb - The car would also be available to Town
staff , not like the zoning and engineering vehicles which are
needed on an on call basis .
Mr . Kanter - There have been times where attempts have been made to
arrange for a car to go to a site and they have not been available .
The Town has been trying to get away from use of personal vehicles
for field work . The car would be available to other departments .
This would be a good option for the whole of Town Hall . A schedule
would be coordinated for use .
Councilwoman Grigorov - Where would this vehicle be parked ?
Mr . Kanter - The alley .
Mr . Frost - With a lot of " jockeying " of cars the alley can be

managed for parking .
_ Councilman Klein - There is nothing in the budget for outside
consultants for planning issues , are we comfortable that zoning and
subdivision revisions can be completed without consultants ?
Supervisor Whitcomb - The only issue which may need a consultant
should would be if it were decided to move ahead with the lake
shore park land project .
Mr . Kanter - There is a possiblity of grant funding for that
project , but that funding will not be known until early next year .
Councilman Klein - Budgeting for sales tax revenue is very
conservative . It is virtually the same as the actual for 1993 .
Are the projections of these revenues from the County ?
Ms . Alario - There was an increase in the townwide portion of the
budget from $ 200 , 000 to $ 225 , 000 . The County would not give the
Town any projections . The last quarter monies received this year
were the same as the same quarter last year . There is no
consistency in what is received each quarter .
Supervisor Whitcomb - The projections of sales tax revenues are
based on trends and educated estimates .

Councilwoman Harrison - Why is the State Aid Per Capital only
attributable to the Part Town and the Townwide ?
Ms . Alario - Prior to when there were cut backs in the State Aid it
was for specific things which were for part Townwide and for excess
needs . Now the Town receives one check in September instead of
quarterly , the Town can now allocate it where they wish . It has
been decided to allocate it to Outside Village . The Village gets
State Aid also .
Highway Funds : The total appropriations for highway are increasing
from $ 1 , 031 , 823 to $ 1 , 107 , 179 or 7 . 3 % due to salaries , snow
removal , and a one time capital purchase of $ 160 , 000 to replace the
Gradeall . Normally capital equipment purchases are $ 100 , 000 per
year . Mr . Noteboom has developed a five year plan to accumulate a
contingency fund in order to level off these large capital
purchases in the future .
Purchasing the Gradeall through borrowing on a BAN would be a great
deal of trouble and additional expense for interest . It was
decided the full amount could be appropriated within the 1995
budget .
Mr . Noteboom - Highway Appropriations : Increases for general
repairs were considered . It was determined they could be
maintained at the 1994 levels . Permanent improvements for regular

road improvements has the potential for affecting the CHIPS
funding . The purchase of the Gradeall will balance the decrease in
- the road improvements funding . This will help keep the total
expenses down . Drainage pipe to be used extensively next year will
be purchased at the end of this year with excess funds offsetting
the decrease in appropriations for road improvements .
Machinery repairs have been increased , brush and weed held level ,
and snow removal for salt was increased because of the unknown with
snow . Last year the snow removal budget appropriations were not
quite adequate .
Supervisor Whitcomb - Revenues : Highway has revenues from the
County for payment of plowing their roads . The primary source of
funding for the Highway comes from a transfer from Part Town . The
appropriated fund balance is relatively the same as last year . The
transfer from Part Town is up $ 100 , 000 accounting for the major
increase . The increase overall in Highway is 7 . 3 % .
Water Budget : Revenues - Composed of water benefit charges
( $ 66 : 00 ) , Bolton Point Benefit charges ( $ 14 . 00 ) , and metered water
sales . The charges were set up to pay the Bolton Point debt and
Town debt . Appropriated fund balance will be approximately the
same .
Appropriations - Slight increases for personal services . There
will be a half time water and sewer technician . There are no large
changes in the water fund , the total increase in appropriations is
5 . 3 % .
Sewer Budget : The sewer rate was the hardest to determine during
the budget process . Sorting the components and how it was
calculated previously was very difficult .
Revenues - The sewer benefit charge collection is the calculation
of 6820 units times the new rate of $ 68 . 00 per unit . The $ 104 , 000
is 7440 units times $ 14 . 00 including the 6820 and units like
Cornell University which does not have a collection system .
Cornell maintains their own system with the sewage going to the
jointly used sewers , to the City , to the wastewater treatment
plant .
Sewer consumption is based on about 362 , 000 , 000 gallons , water is
417 , 000 , 000 gallons . The sewer rates are calculated on water
consumption . Not all households who are served by water are served
by sewer .
Other revenues are about the same with the exception of interest
and earnings because of the low rates being paid by financial
institutions .
Appropriated fund balance is much less than last year because the

monies are not there to appropriate due to emergency repairs . The
sewer rates were increased to improve the cash flow in this
1 account .
Appropriations - Shows an increase in personal services for the
balance of the water and sewer technician . Joint Sewer Capital
Improvements and Regular Capital Improvements will no longer be
funded from current funds , they will be bonded .
Joint Sewer Project Wastewater Treatment Charges are increased from
the City by 11 % .
Serial bond principal is increased and the interest will be down as
the bond is paid off . The BAN interest for West Haven Sewer is
calculated in this appropriation . West Haven Sewer will be
borrowed on a short term BAN . Principal will not be paid in 1995 .
It will be rolled into a larger bond issue to fund other capital
improvements and the joint transmission lines .
The sewer is the fund the previous Supervisor gave warning about
because the lowering of fund balance would be a problem . This has
been corrected by the rate . The Supervisor read his
recommendations from his budget message , ( see attached ) .
Mr . Walker - This means no new Town extensions , if the developer
were to pay to extend water and sewer that may be approved .
Lighting Districts : Each of the districts is separately charged to
only those people who live in the area of the street lights . Each
district was established by petition of those property owners .
The appropriations are for charges of power and maintenance of the
fixtures through NYSEG . The charges are divided by property front
footage . The Town does pay from General Fund for intersection
street lights to avoid safety hazards .
Fire Protection Budget : ( See attached budget message . ) The Town ' s
share in 1995 increases from 27 % to 28 % . In 1999 the Town share
should be 32 % . As more tax exempt property or new building occurs
the ratio could change . The funding of this budget comes from
assessment to those people who live in the fire protection district
outside of the Village . The Northeast is protected within the fire
contract with Cayuga Heights .
Ms . Alario - What is being paid to the Village of Cayuga Heights
has decreased because of purchasing a vehicle which was amortized .
The largest principle payments were paid in the first few years .
Supervisor Whitcomb - There are choices which could be made in the
fire budget . Now fire protection is subsidized by sales tax
revenues . In 1994 it was $ 93 , 086 it has been reduced to $ 93 , 000 .
It could be reduced more , the citizens should be aware of the full

costs of the services provided . However , if reduced the increase
in rate would be too much . It is recommended that the sales tax be
left there . The increase of the rate could have been softened by
increasing the sales tax revenue , the danger is a never ending
spiral of increases . It should be weaned down .
Ms . Alario - There is approximately $ 8 , 000 in fund balance for this
account .
Attorney Barney - The Town could be charged by the City after 1995
for renovations to the fire stations .
Miscellaneous : Townwide , Part Town , and Highway constitutes what is
called the General Fund . Total appropriations for the General Fund
are up 4 . 63 % over 1994 . The increase in the real property taxes
will be 2 . 89 % 0
Ms . Alario - Subsequent pages show the breakdown of the rates , debt
payment schedule , and employee ' s salaries .
The Board congratulated and thanked Supervisor Whitcomb and Ms .
Alario on the excellent budget and the hard work in its
preparation .
Agenda Item No . 27 - Public Hearing Date 1995 Budget :
Motion made by Councilman Conley , seconded by Councilwoman Grigorov
directing the Town Clerk to advertise for a public hearing to be
held on November 10 , 1994 at 7 : 45 p . m . in order to consider the
adoption of the 1995 Town of Ithaca Preliminary Budget as the 1995
Town of Ithaca Budget . Carried unanimously .
Supervisor Whitcomb invited the Board to come forward with any
questions or comments within the next month before the public
hearing .
Agenda Item No . 21 - Hopkins Road Speed Limit :
Mr . Noteboom - A petition has been received requesting a lowering
of the speed limit on Hopkins Road and for the placement of
" Children at Play " signs . A resolution requesting lowering the
speed limit can be forwarded to the State for permission . The State
may not grant a lower speed limit . There is presently a 55 mph
speed on Hopkins Road , the residents are requesting it be lowered
to 30 mph . All residents signed the petition requesting the
reduction .
Motion made by Councilwoman Valentino , seconded by Councilwoman
Grigorov requesting through Tompkins County , that the New York
Traffic Safety Division consider a linear speed limit of 30 miles
per hour for Hopkins Road .

Mr . Noteboom - The State does not recommend the placement of
" Children at Play " signs because the Town would be accepting
liability . There have been lawsuits where people have maintained
the Town is saying children can play in the road if these signs are
placed . Even the State sign manual doesn ' t recommend the placement
of these signs . The residents will be contacted to discuss the
signs .
There is legislation proposed which would change the process of
signing roads . Presently the State must give approval of sign
placement . The legislation would allow each Town to make the
determination of sign placement .
Motion carried unanimously .
Agenda Item No . 28 - Public Hearing Date Special Benefit Districts :
Motion made by Councilman Conley , seconded by Councilwoman Grigorov
authorizing the Town Clerk to advertise for public hearings to be
held on November 10 , 1994 at 8 : 15 p . m . to 8 : 26 p . m . to consider the
1995 Assessment Rolls for the Special Benefit Districts . Carried
unanimously .
Agenda Item No . 29 - Eastern Heights Park , General Purpose Land :
Councilwoman Valentino - The residents of Eastern Heights have
requested a change in status of the General Purpose Land to park
land .
The residents have always considered this land " park land " . There
are woods for walking and a wetland . The residents fear that as
general purpose land it could somehow be used in another way and
not be kept as open space . With the adjacent development being
built in Dryden there is a great deal of concern . The Town of
Dryden has no provisions for park land set asides in their
development approval process . Although , the Dryden development
proposal does show keeping some open space , it is not guaranteed .
Mr . Kanter - The land is located off of Slaterville Road on the
Town of Dryden border . The dedicated Town park land is 6 . 75 acres .
The general purpose land to the west is about 5 . 5 acres . There are
a number of private parcels surrounding the park land most of which
have subdivision proposals .
Councilwoman Harrison - How did the Town acquire this land ?
Attorney Barney - The Eastern Heights developers declared
bankruptcy and donated this land to the Town . At the time , the
Town was careful not to take this land as park land because once it
is declared park land it would take an act of the State legislature
to change . There was much indecision about the road access and
future development . The previous Board felt it would be better to

receive it as general purpose land . Technically , the residents do
use it as park land .
The Foote subdivision proposal brought the issue to light again
when they requested a two lot subdivision and questioned whether
there would be access to surrounding lands through the general
purpose land . It was felt if the subdivision were approved there
would be no dedicated way to have access to a public highway . The
only way to prevent a land lock of the subdivision was to have the
subdivision attached to the Dryden parcel with access to roads .
The Town Engineer at the time wrote a letter saying he thought
access would be provided .
Councilwoman Grigorov - Is there any legal obligation of the Town
to honor a letter from Lawrence Frabboni , Town Engineer in 1986 ?
Attorney Barney - No .
Mr . Kanter - In 1986 there seemed to be intent by the Town Board to
consider the possibility of access through the general purpose
land . There was hope access could be provided in some other way .
Councilwoman Harrison - It is hard to understand why it would be
the Town ' s responsibility to provide a road access .
Attorney Barney - It was understood if there were to be any
development done it would be completed at the expense of the
developer .
Councilwoman Harrison - What on going maintenance expense would
there be to the Town if this land were to be dedicated as park
land ?
Councilwoman Valentino - There is presently a commitment of trails
which the Town maintains . Most residents would not like to have
the general purpose land changed from its natural state . The
dedicated park land may need improvements for equipment , etcetera .
If the general purpose land where changed to park land it could be
preserved . As general purpose land some future Town Board could
change the status and use it for something else .
Mr . Noteboom - A concern is the road cut to Park Lane promised for
Mr . Quick , with the cul - de - sac there would be no way to connect the
road cut if the land were park land .
Councilwoman Valentino explained a solution by using the map . The
road cut to Park Lane could be made further down .
Attorney Barney - There is a question if park land can be converted
to a road way . If the general purpose land were dedicated to park
land there would probably never be a way for an access road if the
development came about .

Councilwoman Harrison - If the development occurred why couldn ' t
the road be developed through the developers land ?
Attorney Barney - The leverage is not through the present developer
who has the approval , the leverage is with the people who cannot
empower him to do anything . This is a policy issue . There is a
desire for open space and public parks , but there is also a desire
not to have extensively long cul - de - sacs with only one way of
ingress and egress .
Councilwoman Grigorov - There is a policy not to create land locked
parcels .
Supervisor Whitcomb - Action deferred until further research
completed .
Agenda Item No . 30 - Water Damage Claims :
Attorney Barney requested discussion of these claims in Executive
Session as it involves potential litigation .
Agenda Item 31 - Water and Sewer Benefit Assessment Adjustment &
Refund :
Postponed until October 13 , 1994 at the Town Engineer ' s request .
Agenda Item No . 32 - Bid Proposals West Haven Road Sewer :
Mr . Walker - Twelve contractors bid on the West Haven Road Sewer
project . The bids ranged from a high of $ 272 , 000 to the low of
$ 178 , 000 which was lower than the estimate of $ 215 , 000 . The
successful bidder is a reputable company . Recommendation the bid
be awarded to Randsco Pipeline .
Councilwoman Valentino - The second bidder was very close and is an
Ithaca company . It would have been good to be able to give the
work to a local firm , however it is understood that under State law
the low bidder must receive the job .
Attorney Barney - The lowest bidder must be given the job unless it
can be documented they are not a responsible bidder or there was a
defect in the bid .
Motion made by Councilwoman Harrison , seconded by Councilman Conley
authorizing the award of the contract for the construction of the
Town of Ithaca Sewer Improvement - 1994 , the West Haven Road
Sanitary Sewer Extension , to Randsco Pipeline for the base bid
amount of $ 178 , 127 . 00 subject to the final approval of the contract
documents by the Town Engineer and the Attorney for the Town .

Agenda Item No . 33 - Comprehensive Stormwater Management and

Erosion Control Plan :
Mr . Walker - The development of a good program will take intensive
thought . A determination of need has to be made by the Town Board
as it impacts multiple departments like the Highway , Planning , and
Building / Zoning . Personnel must also be looked at , an ordinance of
this nature requires inspections , maintenance , and plan review .
Correct implementation would require an additional staff person .
The recommendation is to research the information with the
appointment of a staff committee to include the Town Engineer ,
Building Zoning Officer , Highway Superintendent , Town Planner and
one member of the Conservation Board . The Committee would develop
specific guidelines for technical needs for the Town . There needs
to be a reason for the different levels of control . Determination
regarding administration and how to implement the plan has to be
done . The committee should answer to the Public Works Committee .
Enactment of the items necessary in subdivisions would require
responsibility of maintenance of drainage easements , as well as
fiscal responsibility .
Supervisor Whitcomb - Mr . Walker will chair this committee .
Councilwoman Grigorov - Is a stormwater management plan an
important thing to implement ?
Mr . Walker - It is important , it will take six to nine months for
implementation . If this ordinance had been in place the problems
with drainage in the Northeast could have been taken care of .
Funding has to be considered because there are numerous requests
for fixing drainage in that area . Residents do not want deep
ditches in the front of their properties , but they want their lands
drained . The problem is these homes were built in wetlands .
Mr . Kanter - The Town does not have a strong wetlands policy .
There is the wetlands guideline but the Comprehensive Plan
recommends other related things . Wetlands regulations could be
reviewed at the same time .
Supervisor Whitcomb - Appointed the Stormwater Management Committee
as recommended with Mr . Walker as Chair .
Mr . Frost - This type of legislation will only be effective based
upon what is happening in adjacent municipalities . Complete
controls will be limited due to those factors .
Agenda Item No . 34 - Staff Attendance Town Board Meetings :
Supervisor Whitcomb - Requests have been made by staff members who
for a way to construct the agenda so they could make their
contribution and leave . This is not an easy task because some

items must be addressed in Executive Session where those persons
comments may be needed .
There is a - problem with having the Executive Session earlier since
anyone could come in the room during it , or it would be hard to ask
the public to leave and stay in the parking lot .
Ms . Punger - Having the Executive Session at the end of the meeting
is a problem if a staff member needs to be present since they would
have to sit through the entire meeting before being heard .
Supervisor Whitcomb - The Executive Session will be held first at
5 : 30 p . m . and the public will be told the regular agenda will start
at 6 : 00 p . m .
Agenda Item No , 1 Additional - Cost Replacement Maintenance Forest
Home Bridge :
Councilwoman Harrison - Contrary to what was presented the lowest
cost for the sidewalk is the cantilever walkway .
Mr . Walker - That is true if a new abutment is not built , the. . final
design has not been seen .
Mrs . Noteboom - It was understood the County would be requesting
adoption of a resolution by the Board regarding a contract for
maintenance and cost replacement .
Councilwoman Valentino - Isn ' t there some discrepancy from the
correspondence and what the Town representative disclosed ?
Attorney Barney - The Town should take no action until the County
Board presents a formal contract .
Mr . Walker - The Public Works Committee of the County approved a
design concept which has been forwarded to the consultants . It asks
for the final design and to move ahead with the design construction
process . The Town has been told its contribution will be $ 40 , 000 .

Ms . Alario - The amount to purchase a Wisconsin engine for the leaf
vacuum has gone up from the amount thought needed during last years
budget process .

equipment , and decrease DB5130 . 460 vehicle maintenance by $ 704 . 00
to allow funds for the purchase of a Wisconsin engine for the leaf

` Councilman Conley - A resident who lives on a cul - de - sac off of
Orchard Hill Road has made a complaint about parking . Each year
hunters from Weedsport park their recreational vehicles at the cul -
de - sac and leave their engines running all night for power . Police
agencies have told residents nothing can be done because the Town
has no ordinance prohibiting parking on the street . The residents
have requested that an ordinance be drafted preventing parking at
the end of this cul - de - sac .
Attorney Barney - A no parking zone could be created in this area .
Supervisor Whitcomb - Mr . Noteboom is instructed to investigate
this parking problem and report to the Board at the October 13
meeting .
Mr . Walker - It is possible one of the people parking there owns a
lot at the end of the road .
Councilman Conley - The persons who park there are from another
Town , Weedsport .

Motion made by Councilwoman Harrison , seconded by Councilman Conley
to move into Executive Session to discuss potential litigation and
property acquisition . Carried unanimously .

assessment applicable to the Town of Ithaca - Ithaca Area Wastewater
Treatment Plant Improvement Area and the balance relates to the
Town of Ithaca Townwide Sewer Improvement District ; and
WHEREAS , said sewer benefit charge was last increased in
November of 1992 for the tax year beginning 1993 ; and
WHEREAS , the costs of providing the sewer services and funding
