Chief Wilbur said his department does try to maintain some when
residents phone saying they are unable to keep the hydrant cleared .
Time does not allow them to take care of all of them . Chief Wilbur
said he would discuss the hydrants with Mr . Crowley of his
department to address the issue .
Mr . Noteboom said the Town now has metal flags that attach to the
hydrant which will make the hydrants visible to the fire
department . They were purchased to replace the wooden stakes
because they were more durable and would last longer . The Highway
Department is in the process of putting those flags on the
hydrants .
Agenda Item No . 3a - 3h - Report of Town Officials :
The Supervisor and Department Heads reviewed their written reports
with the Board , ( see attached ) . The Attorney for the Town had no
report .
Agenda Item No . 4 - Review of Correspondence :
a . NYSDOT - Mr . Walker and Mr . Noteboom were puzzled by the letter
determining a reduced speed limit is not appropriate for Troy Road .
They said it was their understanding all information had not yet
been received by DOT , and they were surprised a determination would
be made without all the information . They will contact NYSDOT and
find out the reason for the denial of the speed reduction .
b . Hospicare - Supervisor Whitcomb explained he wished to send a
letter to the NYS Uniform Code Board of Review regarding the appeal
before them to allow the construction of a combination Cl
Commercial and A2 residential facility in Ithaca . The letter asked
that an appropriate mechanism be utilized to permit the building of
the structure . Supervisor Whitcomb asked the Board ' s approval to
send the letter . The Town Board instructed the Supervisor to send
the correspondence .
c . Forest Home Bicentennial Committee - Liese Bronfenbrenner wrote
that Forest Home will be celebrating its Bicentennial this summer ,
and wishes permission to close off approximately one block on a
Forest Home Street to provide space for the festivities over the
July 4th weekend .
The Board didn ' t feel this would be a problem , and instructed Mr .
Noteboom to communicate with Ms . Bronfenbrenner to make the
arrangements .

Agenda Item No . 5 - Report of Town Committees :
Councilman Klein reported the Public Works Committee reviewed the
extension of sewer on West Haven Road and felt it is something
needed for the public health . The Town Hall , RFP was discussed and
three firms have been chosen for interviews to perform the RFP .
The Highway Department is in need of a new vacuum to do leaf pick
up . Mr . Noteboom will be preparing cost estimates and hopes to
purchase it this year . The two vacuums the Town has are in bad
shape . The vacuum was not budgeted this year .
The Codes and Ordinances Committee has developed a draft local law
to allow placement of Elder Cottages in some zoning areas within
the Town . The Local Law will be reviewed by the Town Board and
suggested revisions will then be made by the COC .
Supervisor Whitcomb said J . W . Stoyell had called and requested a
letter from the Town indicating their support of the Elder Cottages
because a grant is being applied for and the letter would help in
the application process . Supervisor Whitcomb will write to Mr .
Stoyell indicating the Town Board ' s support and the schedule for
the possible enactment of the local law .
Councilwoman Grigorov reported the Planning Committee met twice
during the month . They reviewed information from other
municipalities regarding systems for dealing with cash - in - lieu - of -
land payments , and relevant court decisions . Some of the points to
be decided are : 1 ) how to base fees , whether on dwelling units , to
relate it to actual need for parks , or on value of land ; 2 )
fairness to new residents , that they not bear an undue share of the
cost of new parks ; 3 ) whether the size of the subdivision should be
a factor ; 4 ) when to assess - - all at the beginning or as building
permits are issued ; 5 ) whether multifamily units can be assessed .
The Attorney for the Town ' s help is needed on some of these and
other questions .
A plan for locating future parks is needed before it can be
determined whether to assess land or money in a given area . The
plan must be somewhat flexible to take advantage of opportunities .
The CAC is working on a parks plan .
A discussion was held about site density calculations for cluster
subdivisions and a range of options was listed for consideration .
Councilwoman Harrison stated a meeting was held regarding Rt . 13
with the City to discuss mutual interests , another meeting is being
scheduled with the Department of Transportation ' s new Regional
Director .

Councilwoman Harrison received a phone call from Debra Cowan ,
Hanshaw Road asking about the highway mailbox policy . Mrs . Cowan
had a mailbox knocked over during the winter . Mrs . Cowan was not
complaining or asking that the Town pay for it . Mrs . Cowan found
the way the policy was phrased in the newsletter was somewhat
insulting . There is no way for her to put the mailbox six feet
back . Mrs . Cowan asked that the policy be worded to say , " its Town
policy that the Town will reimburse only if it meets these
criteria " . Mrs . Cowan also said she was concerned with the speed
of some of the snowplows .
Superintendent Noteboom said he would review the mailbox policy to
see if it can be worded differently .
Agenda Item No . 8 - PERSONS TO BE HEARD :
There was no one present who wished to address the Board .
Agenda Item No . 15 - Joint Youth Commission Increased Funding
Summer Workers :
Holly Beermann addressed the Board regarding the request last month
by the Joint Youth Commission to create six additional jobs for
teens this summer through the Summer Youth Program . The needs
assessment shows a need for additional jobs . The additional $ 2 , 550
would be matched by the County Youth Service funds if the Board
chose to increase the funding . The total to be paid by the Town
would be $ 5 , 100 , of which $ 2 , 550 would be reimbursed .
Motion made by Supervisor Whitcomb , seconded by Councilwoman
Harrison authorizing the Town Supervisor to contract with the
Ithaca Youth Bureau to hire the additional six youth through the
Municipal Summer Jobs program at a cost of $ 5 , 100 to be expended
from account A7320 . 404 , and that the Joint Youth Commission will
make a report to the Town Board about the funded program in the
fall of 1994 . Carried unanimously .
Agenda Item No . 9 - Public Hearing " Local Law Authorizing the
Payment of Relocation Expenses for New Town Employees "
Supervisor Whitcomb opened the Public Hearing at 7 : 00 p . m . The
Town Clerk had proof of posting and publication . The Supervisor
postponed the public hearing until after Agenda Item 6 ,
Agenda Item No . 6 - Report of Tompkins County Board of
Representatives :
Representative Livesay reported the Health and Environmental
Quality Committee has before it the proposal for cat licensing .
The Solid Waste Committee has voted to recommend to the County
Board that the solid waste fee be placed on the January tax bill .

Mrs . Noteboom mentioned the Town ' s warrant would be paid first and
that the County would not see any revenue from these fees until
February or March when the Town tax collectors would start paying
the County .
Ms . Livesay said questions had come up as to whether the Town Tax
Collectors would have to account for these funds separately , and
the answer was no . It should not cause any extra work for Tax
Collectors .
A space study is presently being conducted for County offices . It
is hoped the a facility could be located somewhere near the City to
keep the County seat centrally located .
Supervisor Whitcomb said the Town has not been kept informed of
about this study . No one has asked the Town what relation the
Town ' s space needs may be to the County ' s . The Town has not ruled
out sharing a building with the County , but it is probably not the
Town Board ' s first choice for new space .
Ms . Livesay said there has been discussion with the City regarding
intergovernmental work on computer needs . Ms . Livesay asked if the
Town would be interested in some form of computer networking with
the County and City ?
Supervisor Whitcomb said the Town might be once it has been
determined where the Town ' s new offices will be . It would not be
feasible to network to the present Town Hall ,
Ms . Livesay said the 911 emergency number should be on line in the
near future .
Mr . Noteboom asked Ms . Livesay if the rumors about the County
opening the land fill up for a possible clean up were true ?
Ms . Livesay said there has been some discussions at the Solid Waste
Committee about having a clean up day . There was just preliminary
information given , the cost would be almost prohibited . The
Committee was not disinterested in the idea , but have rules and
regulations to consider . A cooperative arrangement regarding
illegal dumping has not progressed as rapidly as planned . Ms .
Livesay has suggested to the committee that the clean up and
illegal dumping be addressed within the same context so that
progress may be made on both .

Call to Order : The Supervisor called the meeting to order at 5 : 30
p . m . , and led the assemblage in the Pledge of Allegiance .
Agenda Item No . 7 - Presentation by City of Ithaca Fire Department :
Chief Brian Wilbur and Deputy Chief Thomas Dorman made a
presentation to the Board regarding the mission , the chart of
administrative responsibilities , and the services provided to the
Town by the Ithaca Fire Department , ( see attached ) .
Councilman Conley questioned the Chief and Deputy Chief about the
maintenance of fire hydrants within the Town , and wanted to know
who maintains them and who is responsible for keeping the area
around them free of snow and having the grass mowed ,

Agenda Item No . 10 - SE R , " LOCAL LAW AUTHORIZING THE PAYMENT OF
RELOCATION EXPENSES FOR NEW TOWN EMPLOYEES " :
Motion made by Supervisor Whitcomb , seconded by Councilwoman
Harrison that the Town Board makes a Negative Determination of
Environmental Significance in accordance with the New York State
Environmental Quality Review Act for the proposed " LOCAL LAW
AUTHORIZING THE PAYMENT OF RELOCATION EXPENSES FOR NEW TOWN
EMPLOYEES " , and therefore an Environmental Impact Statement will
not be required . Carried unanimously .
Agenda Item No . 11 - Enactment , " LOCAL LAW AUTHORIZING THE PAYMENT
OF RELOCATION EXPENSES FOR NEW TOWN EMPLOYEES " :
Supervisor Whitcomb said this local law is the same as looked at
last month with the changes as requested by the Town Board .
Motion made by Councilwoman Harrison , seconded by Councilman Conley
enacting the " LOCAL LAW AUTHORIZING THE PAYMENT OF RELOCATION
EXPENSES FOR NEW TOWN EMPLOYEES " , the Town Clerk is authorized and
directed to file said Local Law as required by law . Roll call vote
carried unanimously .
Agenda Item No . 20 - Consent Items :
The Town Clerk noted there is a correction on Page 1 , Paragraph 4 . ,
the Town Board minutes under Also present , instead of Wesley
Skinner it should read Wendy Skinner . Councilwoman Harrison asked
that Page 7 , Paragraph 2 . , the 3rd sentence read : Assemblyman
Luster suggested a meeting with State Parks and Recreation and the
City of Ithaca to find a common voice . Also , Page 7 . , Paragraph
41 , 2nd sentence shall read : The DOT did make one change the Town
had requested , a traffic signal at 13A .
Motion made by Councilwoman Grigorov , seconded by Councilman Klein
approving and / or adopting the Consent Agenda Items 21a - 21n with
the corrections to the minutes as presented . Carried unanimously .
Agenda Item No . 21 - Independent Audit Report :
Supervisor Whitcomb felt it was a very good audit , everything was
in order . The only non - compliance issue , which was cited
previously , was the lack of Civil Service certification . The
County must make the next move towards compliance . The Town will
continue as soon as the County takes those steps .
Motion made by Councilman Conley , seconded by Councilwoman Harrison
authorizing the Town Clerk to advertise that the Town of Ithaca
Financial Report for the Year Ending 1993 is available for public
review as prescribed by law . Carried unanimously .

Agenda Item No 22 - Pollution Insurance Fuel Tanks :
Mr . Noteboom said the purchase of pollution insurance for the
highway fuel tanks was discussed at the Public Works Committee
meeting . When the tanks were installed there was no requirement to
have insurance , nor is there a requirement now . The Public Works
Committee felt that $ 1500 was a large expense for this insurance .
The system now has above ground steel tanks inside a dike built to
hold 110 % of the fuel , this should be reasonably safe . If there
was a leak , everything would leak inside of the dike tank . An oil
separator could also be placed underneath , but it is not considered
necessary .
Attorney Barney asked if the Town needs to certify adequate
financial resources to cover a leak when they don ' t have insurance ?
Mr . Noteboom said that with above ground tanks like the Town has
that is not required .
Mr . Walker said if the fuel polluted someone ' s well , the Town may
be forced to build a water system . The Town has already built a
water system where the tanks are now . The system has a great many
fail safe features , and the biggest risk of a spill is when the
tank is being filled . The trucker would have liability insurance
in that instance .
Councilman Klein said the question of coverage was asked of the
Town ' s insurance carrier when the system was put in . The carrier
said the Town did not have to have this covered , it seems if it
were necessary the insurance company would have gone the extra step
to say , " however if the Town wants the insurance there is a $ 1500
premium " . It would have been a decision to make at the time the
tanks were considered . With the experience the Town has with the
insurance company , being that the Town is not covered for so many
things , the Town should consider hiring a risk management advisor
to put together a comprehensive insurance package to get better
coverage and cooperation .
Supervisor Whitcomb said this was discussed at the Staff Meeting
and it was decided the Town could probably get the same service , by
sending out an RFP for insurance . This is the year for that RFP .
Councilman Klein said the Town has gaps in the coverage which are
very troublesome . When there is a large claim that a $ 200 rider
would have covered it seems worrisome . The insurance should be
evaluated carefully at a later date .
Attorney Barney said every insurance policy has exclusions . What
needs to happen is a presentation by the insurance company as to
what is , and is not covered .

Motion made by Councilman Klein , seconded by Councilwoman Harrison
that the Town Board does accept the recommendation of the Public
Works Committee and agrees that it is unnecessary at this time to
purchase pollution insurance to cover the fuel tanks at the Highway
Department because of the extreme low risk . Carried unanimously .
Agenda Item No . 23 - Bid Specifications and Advertisement Backhoe :
Mr . Noteboom said the specifications are generic and use
comparisons from the major brands to create specifications all
companies could bid on .
Motion made by Councilwoman Harrison , seconded by Councilman Klein
that on the recommendation of the Public Works Committee the
specifications for the new tractor / loader / backhoe be approved . The
Town Clerk is authorized to advertise and receive bids for the new
tractor / loader / backhoe . Carried unanimously .
Agenda Item No . 24 - Appointment Town Planner :
Motion made by Councilwoman Harrison , seconded by Councilwoman
Grigorov appointing Jonathan Kanter as Town Planner , effective May
30 , 1994 at an annual salary of $ 40 , 000 plus a $ 2 , 000 moving
allowance , charged to account B8020 . 100 . A six - month probationary
period applies , after which a performance and salary review will be
performed . Full benefits apply . Carried unanimously .
Agenda Item No . 26 - Acceptance of Bids South Hill Sewer Repairs :
Councilwoman Harrison said she and Councilwoman Grigorov were
amazed at the spread of the bid amounts , is this typical ?
Mr . Walker said there have been cost spreads such as this in the
past . When getting into a smaller contract a higher percentage is
reached rather quickly . The option is something the County is
paying for . The contractors with the highest bid are located
further away , and they historically bid higher . The Engineer ' s
estimate was for approximately $ 100 , 000 , this bid is 15 % lower . In
this bidding climate this is typical . Engineering staff have
inspected the contractor ' s facility and were very impressed with
the quality of the equipment and how things are run .
Mr . Walker recommended the contract be awarded to J . Cappola
Construction Company , Inc . pending the Attorney for the Town
reviewing the bid documents .
Councilwoman Harrison asked if references were checked on the
bidders ?
Mr . Walker said three other references were called , and positive
responses were heard from all of them .

Mr . Walker said on this type of job there is a significant amount
of sewers that are bypassed in the work zone because it is for the
replacement . If the contractor is efficient they can save time and
money . This would be approximately $ 3 , 000 to $ 4 , 000 per day . The
contractor from the Inlet Valley Phase II project did not make
money because he took twice as long as it could have , as opposed to
the contractor in the first phase who moved right along .
Engineering staff has evaluated that the contractor for this
project is in the same class as the contractor in the Inlet Valley
Phase I project .
Motion made by Councilwoman Grigorov , seconded by Councilman Conley
authorizing the Town Supervisor to Award the Contract for
Construction of Sanitary Sewer Main Replacement South Hill , to J .
Cappola Construction Company , Inc . of Endicott , New York upon
approval by the Attorney for the Town of the contract documents
along with the following conditions :
1 . The Contractor delivers three fully executed sets of the
Agreement .
2 . The Contractor delivers to the Town with the executed agreement
the Contract Security ( BONDS ) and verification of insurance as
specified .
3 . The Contractor shall meet all applicable filing requirements as
specified in the contract documents .
Motion carried unanimously .
Agenda Item No . 12 - Public Hearing , Abandonment and Transfer
Unopened Portion Orchard Street :
The Supervisor opened the public hearing at 7 : 30 p . m . The Town
Clerk had proof and posting of publication .
Attorney Barney said 20 to 30 years ago when the Orchard Street and
Roat Street subdivision was completed the map prepared showed a
strip of land about 360 feet long and 50 feet wide extending from
Orchard Street south as an unopened road to be dedicated as a Town
road someday . The road has never been opened . Over the years the
adjoining landowners have utilized the land . There is a drainage
swale running through part of the land which eventually flattens
out . One of the neighbors inadvertently built a garage that
encroaches on the land , this became apparent during a survey when
the property was offered for sale . As a result , the Town was
approached as to whether the Town would be interested in abandoning
any rights it has to the land . When a road is placed on a map it
is an offer to cede that land to the Town for road purposes . The
Town has never taken any action to accept the road .

The Town does wish to preserve some of its rights with respect to
the drainage . It does not appear that the Town will ever put a
road there .
Through negotiations with all parties an agreement has been drafted
saying the Town would abandon any rights it has in and to the
strip , and simultaneously an easement to maintain the drainage
would be conveyed by the landowner .
Attorney Barney has reviewed the agreement and has some minor
comments for revisions . Attorney Barney suggested the Town Board
abandon this land subject to the agreement . The resolution would
be subject to a permissive referendum .
Supervisor Whitcomb opened the floor for comments . Tony Krizek ,
Roat Street addressed the Town Board and stated his father was the
man who mapped the road on the subdivision for this property . Mr .
Krizek was curious as to how this abandoned road will be divided
between the owners .
Attorney Barney said that one half will go to one property owner
and one half will go to the other property owner . The easement
will actually go over the pieces which will be conveyed . Legal
title by the Town would be abandoned and then the Town would get
the easement to maintain the ditch over that strip of land .
Mr . Krizek said the ditch is the only way that the water can go .
Mr . Krizek approved of this , and said the only reason the road was
never put in was because no one wanted to have to pay to put the
road in .
Supervisor Whitcomb closed the public hearing at 7 : 33 p . m .
Agenda Item No . 13 - SEQR , Abandonment Transfer of Unopened Portion
of Orchard Street :
Motion made by Councilman Conley , seconded by Councilwoman Grigorov
making a Negative Determination of Environmental Significance in

referendum has to be published , and then any member of the public
would have 30 days to come forward with a permissive referendum
signed by 5 % of the electorate in the last gubernatorial election
opposing the abandonment . If no referendum is received the

_Agenda Item No . 27 - SEQR , Small Business Tree Planning Program ,
Hospicare Trail :
Mr . Frantz said an environmental assessment was done on the project
to make a negative determination of environmental significance .
The Board received the environmental assessment related to the
project .
Motion made by Councilman Conley that the Town Board , as Lead
Agency for environmental review , and having reviewed the proposed
Small Business Tree Planing Program project for the Hospicare
Trail , a Short Environmental Assessment Form Part I . and Part II . ,
and a recommendation for a Negative Determination of Environmental
Significance prepared by the Assistant Town Planner and dated May
21 1994 , makes a Negative Determination of Environmental
Significance for the proposed action . Carried unanimously .
Agenda Item No . 28 - Small Business Tree Planting Program
Hospicare Trail :
Mr . Frantz said he sent out a request for price quotations from
nine different nurseries , including two minority enterprises . Four
price quotations were received ranging from $ 1 , 750 to a high bid of
$ 4 , 000 . Mr . Frantz recommended the contract be awarded to the
Westfalen Farm and Nursery . The only change is that the low bid
allows planting 14 trees instead of 10 . This will still allow the
Town to remain in the project budget .
There is not enough room for additional trees or to extend them
further because it is necessary to finish the project by the end of
the month . The Highway Department will be working on the drainage
on the lower portion of the trail , so plantings in that location
will have to wait .
Motion made by Councilman Harrison , seconded by Councilman Conley
authorizing the Town Supervisor to enter into a contract with
Westfalen Farm and Nursery for the purpose of installing 14 trees
on the Hospicare trail site as part of the National Small Business
Tree Planing Program , at a cost not to exceed $ 2 , 800 to be charged
to Account B7140 . 402 . Carried unanimously .
Supervisor Whitcomb thanked Mr . Frantz for working on the project
and providing a valuable asset to the neighborhood .

Councilman Conley asked if this position was subject to a civil
service exam ?
Ms . Punger said Ms . White has a civil service certification from
another County , there is a waiver . The Town complies with civil
service when they have lists . The County does not have a list
available at the present time , it would take three months .

Agenda Item No . 25 - Little Subdivision , Deed of Conservation
Easement :
Supervisor Whitcomb said he and the Attorney for the Town have met
and discussed some of the concerns about the deed . It was decided
Mr . Barney would contact Mr . and Mrs . Little directly to negotiate
the items of concern .
Mr . Barney said Mr . and Mrs . Little wish to get a building permit .
They have asked if the Town Board could authorize by resolution the
Supervisor approving the deed so they can proceed with the permit
without being delayed for another month .
Supervisor Whitcomb agreed this could be done because the concerns
with the deed are minor .
Motion made by Councilman Conley , seconded by Councilwoman Grigorov
accepting the proposed Deed of Conservation Easement from Mr . and
Mrs . Little with changes therein as approved by the Town Supervisor
and Councilwoman Harrison with the advice of the Attorney for the
Town and Town Engineer ; and the Town Supervisor upon approval of
same is authorized to affix his signature on behalf of the Town to
such easement indicating the Town ' s acceptance and approval of
same . Carried unanimously .
Agenda Item No . 16 - Information Meeting , Troy Road Water
Extension :
Supervisor Whitcomb explained the Town is considering extending the
water from Ridgecrest Road to Troy Road even though the project was
lower on the Town ' s priority list .
Mr . and Mrs . Jack Little have offered to grant an easement and some
monetary contribution to extend the water making a direct
connection in this area to themselves and other residents . The
Town would have one year to complete the project because the
Little ' s would like to finish their home and landscaping knowing it
would not be dug up at a later date .
Daniel Walker , Town Engineer was instructed by the Town Board to
prepare cost estimates on this project . The Planning Department
was also asked to provide any planning impacts if the project was
completed .
Mr . Walker presented maps to explain the project to the Board and
the public . The existing water main is presently along Ridgecrest
Road . There are four parcels which could be served by water if the
extension were made from Ridgecrest Road . There have been several
serious requests for water from residents along these roads due to
quantity problems .

The portion which would benefit the Little ' s would be a 1600 foot
water main . The cost of this would be approximately $ 56 , 000 . To
serve the additional properties , the total length of water main
would be approximately 2900 feet serving all the parcels
represented by a petition received . The entire project would cost
almost $ 130 , 000 . There would be sufficient pressure and storage to
accomplish this . This extension would service 15 parcels .
Councilwoman Harrison asked if all the owners of those parcels
responded as to whether or not they were in favor of the extension ?
Mr . Walker said there was one parcel owner who was concerned about
the implications to the assessment , but that parcel would not be
served by the extension .
Councilman Harrison asked how big the gap would be along Troy Road
from where the water is now , and where it would be if the project
were built .
Mr . Walker said there would be two properties not served , and all
the residents were notified of this public information meeting by
mail .
Supervisor Whitcomb said a petition was received requesting the
water from all but two owners , not counting the new subdivided
lots .
Supervisor Whitcomb asked for members of the public to address the
Board regarding the Troy Road water extension ?
Jonathan Hochberg , 226 Troy Road asked what would be the
ramifications of bringing water in without sewer ? Most of the land
there is currently serviced by septic tanks and there has been some
history of poor maintenance of those systems . The introduction of
Town water may aggravate that situation .
Supervisor Whitcomb said the Town is not considering any sewer
extensions in that area , there are conflicting opinions on the
effect of bringing water to an area and the subsequent need for
sewer later on . Some people say more water is used , which
increases the sewer use . Others say that once the water is metered
and paid for , less is used .
Mr . Walker said once water is brought in sewer requests are soon to
follow . In general when public water is brought in there is a
tendency to increase the consumption of water and use by the sewer
system .

Councilman Klein asked if the Town has any mechanism to require low
flush toilets and water reducing devises for reduction of the flow
to septic systems if the water were extended ?
Mr . Walker said water conservation is always encouraged , but there
is nothing that to monitor or control this other than the State
Building Code .
Attorney Barney said to legislate a code more strict than the State
building code would require special legislation and permission from
the State .
Mr . Frost said the State building code now requires low flush
toilets be placed in newly constructed homes .
Nancy Wilson , 232 Troy Road reminded the Board of the interest for
water by the people who signed the original petition . All the
people who have a shortage of water would like to overcome that
problem , and would be willing to have their septic systems tested
and monitored to make sure no problems arose if that would help to
get the water . There are two large properties and one small
property along King Road , the owner of the small property did sign
the original petition . The owner of the large parcels would not be
affected by this extension .
Councilwoman Harrison asked Mr . Hochberg if he thought a request
for sewer would soon follow after the water was put in ?
Mr . Hochberg said he did not think sewer would be necessary .
Marty Taylor of 250 Troy Road said she signed the petition because
she wanted to be a good neighbor . Mrs . Taylor asked what happens
after the water comes by the property . What expenses are involved ,
and can the individual property owner opt not to hook to the water ,
and what it would cost .
Mr . Walker said there is no requirement for anyone to connect to
the water . There is a Town benefit assessment formula based on
housing units and frontage on the lots . There is an additional
benefit assessment made to the properties . One hundred feet is ( 1 )
unit and that costs $ 80 . 00 per year per unit whether there is hook
up to the water or not . The Town Board does have the authority to
modify or waive those fess if a lot is deemed unbuildable or
protected in some way .
Supervisor Whitcomb said if a property owner elected to hook up , it
would be at the homeowner ' s expense . The Town is presently
reviewing the benefit assessment formula in terms of protected open
space . j

Mr . Frantz reported the road is already subdivided and most of the
lots already have homes , from the land use planning perspective
this would be an infill water service to an area already developed .
The extension of water to this area would not stimulate any
substantial growth . There may be some further subdivision of some
larger lots , but it will not stimulate major development .
Councilwoman Harrison said that under the current zoning the 17
acre parcel could be subdivided .
Mr . Frantz said that parcel is currently zoned R30 and could be
subdivided into about 10 to 15 parcels . Given the configuration of
the lot it would be hard to get that many homes .
The Comprehensive Plan has this area zoned rural residential , which
is one house per acre and / or designated open space . The largest
parcel is the Eldridge Wilderness which would not be open to
subdivision , the extension of water would be in conformance with
the Comprehensive Plan .
Agenda Item No . 17 - Public Information Meeting , Coddington Road
Water Extension :
Supervisor Whitcomb stated the Town has recently received a
petition for water from the residents along Coddington Road to
extend water as far as the Coddington Road Community Center .
Mr . Walker reported the extension would come from Burns Road
approximately 2 , 000 feet to bring it to the Community Center .
The cost would be approximately $ 90 , 000 .
The Community Center has experienced problems with both quantity
and quality of water . Alternatives would be to provide a storage
facility at the Community Center fed by a well which would require
a higher level of monitoring than is currently undertaken . The
system would require daily chlorination and monitoring , and would
be more complicated . The system would cost between $ 5 , 000 to
$ 10 , 000 to be installed . It would require concrete tanks with
drainage protection around it . The Health Department has said this
type of system would be acceptable , however their preference would
be to have public water to the Community Center ,
Mr . Walker said most of the lots serviced would be in excess of 100
feet , and would be charged more than the basic benefit assessment
each year .
Louise Mudrak said there are a number of people in the audience
offering support of this extension on behalf of the Community
Center .

Elizabeth Connors , 873 Coddington Road said their water supply has
a sulphur odor so they use bottled water for drinking . It has been
tested safe for drinking . There is a quantity problem so large
amounts of laundry can not be done . The water problems experienced
are not a major concern they can be dealt with , but public water is
requested .
Supervisor Whitcomb said Mrs . McCord , 853 Coddington Road called
and stated they have a well at least 200 feet deep with a 1 , 000
gallon storage tank . They have sufficient water , but they have a
salt water problem . There is also a turbidity problem where the
water is brown . Mrs . McCord runs a day care center for 10 to 12
children , and they bring in bottled water for the children . The
chlorinator does take care of the coliform , but they would have to
install a reverse osmosis system to take care of the turbidity
problem . Ms . McCord can not afford this type of system .
Jeanne White , 102 Updike Road told the Board she has problems
related to quality and quantity . Something drastic will have to be
done with her system with public water . Mrs . White asked if this
proposed extension could be expanded to go past the Community
Center to the lower Updike Road ?
Supervisor Whitcomb said that had not been considered up to this
point .
Mr . Walker said to extend the water to the lower Updike Road would
add approximately $ 10 , 000 more .
Mrs . Connors said even though their water is not as bad as the
Community Center ' s , the community as a whole is very concerned that
the center does not have enough good water . There is a day care
program there .
The Chair of the Personnel and Program Committee for the Community
Center stated that he wanted to reiterate that the Community Center
is for the community and is not just a child care center . There is
a very real commitment by the people to that effect .
Lou Ann Bangs said three of her children have gone to the Community
Center and the fourth is in day care there now . The concern is
from a health standpoint . It is not a good situation for children .
Sometimes there is not enough water to wash , flush toilets , and for
diapering children . When children are just learning hygiene and
they are forced to practice bad habits because there is not enough
water it is terrible .

Pat Bergman has a child at the Community Center and she has learned
that not everyone has good water to drink . The teachers have to
bring bottled water in to have water for the children . The lack of
water also causes disruptions in the classroom because sometimes
teachers have to leave the room to get more bottled water . The
Community Center also buys has bottled water delivered .
Ms . Mudrak stated the water does not test for coliform , it is safe
for hand washing . There is a powerful odor with a high iron
bacteria content that clogs the system this requires shock
chlorination . Consideration had been given to putting in a
filtration system , but that has been postponed because the quantity
of water is so low . Other solutions are being investigated to
resolve both problems .
Supervisor Whitcomb asked if it were true that the well at the
Community Center had gone dry at certain times ?
Mrs . Mudrak said all it takes for the well to go dry is for the
toilets to be flushed several times , or a faucet gets left on . It
recovers but only comes back for 20 minutes and then goes dry
again . It is not something that happens everyday , usually once a
month . There is a very strict routine the staff has to follow to
compensate for the lack of water .
Supervisor Whitcomb asked if a holding tank , and filtration system
would solve the problem ?
Ann Morrissette , Director Community Center said the day care
program sustains the Community Center and keeps the Center an
active place . The contract with the Town also contributes to
keeping the Center open . The ball field programs and the summer
playground program are very active now , it can not even be
considered to expand these programs without more water . Every
night the play fields are reserved in the summer . The Town ' s
commitment to having the play fields available to the community has
meant a great deal to a lot of people . The Center does provide a
port a john , but there is no way of providing a drinking fountain .
In a great deal of small ways the water problem prohibits expansion
of the center . Long range planning would be beneficial , but can
not be done without the water problem being resolved .
Ms . Mudrak said one of the problems is financial . The center is
not supported by anyone except fees from the day care , and the
contract with the Town . A permanent easement was given to the Town
for the ball field which the center manages ,

The day care was opened because of a response to the community when
the center was reopened . A well was put in at that time which was
about 100 feet deep which provided about 3 gallons per minutes ,
that well is not retrievable . The quantity has been going down
since then . A holding tank and purifier will cost in excess of
$ 10 , 000 . The center has no idea of where the money would come from
to do this . If a holding tank is put in , will another well
have to be put in to keep water in it ? The concerns with a holding
tank would be a ) would the flow of water be sufficient , b ) would
the quality be there .
The McCord ' s put in a holding tank , a chlorinator , and a filter and
they still can not drink their water . That well is 200 feet deep .
Five years from now if up to $ 15 , 000 was spent for this system
would the center again have the same problems ? The well at the
center now is only ten years old .
Ms . Morrissette asked if the center another well were drilled would
it fracture the other wells in the neighborhood ?
Mr . Walker said drilling another well could effect the wells in the
area . There are other areas of the Town where new wells have
fractured neighboring wells creating quantity problems and making
those wells unusable .
Mr . Frantz said in many ways the Coddington Road water situation is
similar to the Troy Road situation because homes already exist
along the road . The parcels along the proposed extension to the
Community Center already have 11 homes , a cemetery , and the
Community Center . These properties are not of real concern from
the land use planning perspective . However , the problem with the
Coddington Road area is there is a 44 acre parcel , and a 111 acre
parcel which would become able to be developed with access to
water . There is also a 15 acre parcel which would not be as
significant . This would open up 150 acres of land for major
development by extending water , even if it were only extended to
the Community Center ,
Supervisor Whitcomb said the owner of the 44 acre parcel had
expressed interest in a long term conservation measure .
Mr . Frantz said the 111 acre parcel was once sold to the
Butterfield , Chase Farm Associates , when that company folded the
parcel reverted to the original owner . That is the Walker parcel .
The Town could extend the water line but if the Town does so zoning
would have to be created which would allow the Town -to serve a
critical proven need for water , but at the same time comply with
the Comprehensive Plan ' s desire to channel development away from
areas that are not appropriate . The Conservation Advisory Council

in 1990 proposed conservation zones for portions of the Six Mile
Creek Valley which would reduce the development potential for some
of the less desirable parcels . The CAC had a buffer zone concept
that would protect the land between the railroad grade and Six Mile
Creek from development . These are two options the Town can review ,
both would allow the extension of water and at the same time
control the growth development impact .
Ms . Mudrak asked if someone bought the Walker property and asked to
pay for the construction of the water main , the benefit assessment
charge , and the cost of hooking up the 500 feet to the line , could
they do it ?
Councilwoman Harrison said if they developed it and wanted public
water they would have to pay those costs .
Mr . Frantz said all the land in that area is presently zoned R30 .
Ms . Mudrak said if anyone wanted to develop that property , legally
they could do that now . $ 90 , 000 would not make the difference .
Mr . Walker said the owner would have the right to petition the Town
Board to accept the water main they would construct .
Councilwoman Harrison said the developer would not have the right
to construct the water system , they would have to ask the Town
Board .
Mr . Frantz said the problem with the zoning and the introduction of
public water is that the type of development created is the least
desirable type of development related to neighborhood character and
fiscal impact on the Town . When you have one to two acre lots and
each is going to be served by public roads , it is very expensive .
Ms . Mudrak said they are not looking to push for increased
development , those are zoning issues which are not controlled by
this water extension . It has been said that extending this water
will open up all this development , how can this be a driving force
which will allow development ?
Mr . Frantz said in his opinion the water extension would greatly
increase the potential for development in this area of the Town .
Councilwoman Harrison said there is clearly a problem and a need to
do something . The quality issue is not unsafe , it is unpalatable .
Perhaps bottled water is a reasonable way to deal with that issue .
What is the frequency of there not being any water ?

Ms . Morrison said one year it happened all the time . It is not
happening right now because the water tables in the ground are
high . Anytime faucets are accidently left on with only a drip , the
well will go dry . Precautions have to be constantly met . An
inside shut off had to be installed so that no one would use the
outside faucets . This is public property , but no access can be
given to the building in the evenings and weekends because of the
water problem . The well going dry has happened with increasing
frequency over the last four years . The only activity is flushing
toilets , washing hands , and cleaning ; there are no large usages
such as laundry and showers .
Ms . Mudrak said the teaching staff asked that the Town Board
understand the water problem is a constant constraint and hassle ,
and a constant problem for the cleaning staff .
The Center cannot have fund raising events because the water supply
would not be sufficient . The few times fund raising events have
taken place , the clean up was a horrendous task because they ran
out of water . People had to take the dirty dishes home to wash .
Supervisor Whitcomb said there are two options that could be
considered by the Board . One would be to set a formal public
hearing at the next meeting to consider the extensions and then bid
the project . One would be to refer the extension to the Planning
Board for further consideration .
Councilwoman Harrison said one option would be more discussion
about the relationship of how some members may feel the extension
of water would create development pressures . It must be decided
whether to have a formal public hearing , or whether to investigate
storage and filtration for at least the Community Center maybe with
Town participation . Should these items be discussed at a formal
public hearing or before with small committees ? Maybe these issues
should go to the Planning Committee .
Ms . Mudrak said if the Community Center were to try and pay for the
storage and filtration system it would create extreme hardship ,
would there be anyway the Town could help with that money ?
Attorney Barney said the contract with the Community Center could
be reviewed to see if there were anyway that could be done .
Attorney Barney said a public hearing would only have to be held if
the Town were going to bond the extension .
Councilwoman Harrison suggested this deserves some attention and
thought , and she would be interested in a subcommittee to explore
this issue with Town staff , people from the neighborhood , and the
Public Works Committee .

Mr . Walker said he has talked to the Health Department about the
Community Center ' s problems and can prepare a cost estimate of what
the storage tank and filtration system would cost .
Councilman Conley said there are homes other than the Community
Center who have problems with water .
Supervisor Whitcomb said there is also another day care center with
problems . It is not sure how many home owners along the road are
having problems .
Mr . Walker said he also needs direction . The Troy Road and
Coddington Road are similar in that both projects could stand or
fall on their own , but if one contractor were brought in to
complete both jobs it would result in a 10 to 15 % savings on the
extensions . Portions of the Troy Road have a time constraint in
relationship to the opportunity by Mr . and Mrs . Little providing
the easement and access . The Town Board should make a decision on
this no later than August to insure meeting the deadlines of the
Little Subdivision .
Supervisor Whitcomb and Councilman Conley expressed a desire to
make the decision long before August .
Councilman Conley asked that a design cost estimate be prepared by
the Town Engineer putting the two projects together for the economy
of scale . The Town Board should move towards making a decision
rather soon when there is a full Board in attendance , even if it
takes a special meeting to make the decision .
Mr . Walker told the Board he could prepare a feasibility study with
cost estimates for the June meeting .
Councilman Klein asked if alternatives could also be studied for
the Community Center ?
Mr . Walker said he could also work on those ideas .
Councilwoman Harrison asked that a survey be completed from all the
property owners involved as to what their water problems are ,
quantity and quality . The survey would also be determined how many
people really want the water and whether the are informed about the
yearly costs and hook up costs .
Mrs . Noteboom said all the people effected where sent a notice of
this public information meeting .
Mrs . Mudrak said the Community Center also sent letters to the
property owners about the meeting .

Attorney Barney noted that in order to have a public hearing ; a
plan , report , and map has to prepared outlining what is to be done
with the cost . The Town Board would then order a public hearing
based on that information .
Motion made by Councilman Klein , seconded by Councilwoman Grigorov
authorizing the Town Engineer to prepare an Engineering Report
including a feasibility study , cost estimate , and preliminary
design for the possible extension of water to Troy Road , Coddington
Road , the Coddington Road Community Center , and Updike Road . The
Engineering Report shall include a survey of the property owners
involved as to their specific need for public water related to
quantity and / or quality problems . The report shall also include an
evaluation of an alternate water supply system for the Coddington
Road Community Center including on site storage , disinfection ,
and / or other treatment , and the feasibility of additional wells .
The cost of the report shall not exceed $ 500 each for Troy Road and
Coddington Road , and shall be presented to the Town Board at their
meeting June 13 , 1994 . Motion carried unanimously .
Councilwoman Harrison suggested that along with the report there be
an opportunity during the preparation of the report for Board
members to go over the report .
Mr . Walker said the report will be presented to the Public Works
Committee ,
Councilwoman Harrison asked that she attend the Public Works
Committee to offer input about the planning issues , and maybe a
meeting should be held at the Community Center with some Board
members to discuss the issues .
Agenda Item No . 18 - Public Information Meeting West Haven Road
Sewer Extension :
Supervisor Whitcomb stated there have been several petitions over
the years requesting the extension of public sewer along West Haven
Road . Individuals from the West Haven Road met with the Public
Works Committee and stressed their continued interest and urgency
because there are some septic systems failing , some for the second
time . Homeowners in the area are facing ma3or expenses should the
Town decide not to extend the sewer .
Mr . Walker stated the sewer was built up to West Haven Road in
1987 . The topography did not allow the inclusion of the area being
cnsidered for this extension . It would be possible to run sewer
along the northern portion of West Haven Road to service these
properties through the back lots , and then to Mecklenburg Road to
connect into the City sewer system . West Haven Road is presently
r served by public water , Mecklenburg Road is not .

The direct cost of connecting 4000 linear feet of sewer would be
approximately $ 180 , 000 . There may be a secondary cost because it
goes into the City sewer system on the West Hill where there have
been capacity problems . The Town has an agreement with the City
that the Town pays a portion of the cost on the existing sewer
system the Town uses . There is an opportunity with the State ' s
construction of the bridges to improve that sewer system . The
impact of the proposed West Haven Road sewer would increase the
share of the sewerage by 1 or 2 % . This project would serve
approximately 16 properties . The biggest potential impact is a
large undeveloped parcel that could be developed .
Mr . Frantz said that parcel is approximately 60 acres and is zoned
R15 . About 100 to 150 new dwellings are possible there . This is
a location where the Town would like to have development occur .
Mr . Walker stated there is a parcel on the north side of
Mecklenburg Road which is rumored to have a project to present to
the Planning Board in the near future with over 100 units . Public
water is already located to that property .
Councilman Klein said this West Haven Road sewer infill project
does work in relation to the Comprehensive Plan . The residents
have pointed out this area is the only segment on the whole street
that does not have sewer service . There are uncharted sewer
systems with many are over fifty years old . There is definitely a
health and safety issue .
Councilwoman Harrison said the Town is assuming that it is possible
to allow development on the same size lot as the residents on West
Haven Road . It has been said in the Comprehensive Plan there are
areas where that level of development could be looked at where it
is not thought to put any type of water and sewer in the future .
Judging by the documentation provided , the problems with septic
systems which have been occurring on West Haven Road leads one to
wonder whether the Town policy can be implemented . Can you allow
one to two acre lots and not expect years from now that water and
sewer will be placed there ?
Mr . Walker said no , not unless it is expected to spend considerable
amounts of money to replace septic systems in future years . When
the zoning was first established that amount of acreage was
adequate .
Councilwoman Harrison said it is clear as the Town starts to
implement the Comprehensive Plan the issue of these lot sizes must
be addressed . The Health Department should be included . The Town
does not want to be in the position in years to come with a policy
not to extend water and sewer and find people in trouble .

Supervisor Whitcomb asked if the Town Board was ready to hold a
public hearing on this extension of sewer ?
Councilwoman Harrison asked how the cost would be divided for this
extension , $ 180 , 000 is a great deal of money for the extension to
14 houses . The benefit assessment is based on the road frontage ,
and then there is a sewer charge based on consumption . Those
charges are not directly related to the construction cost of
$ 180 , 000 . Would the Town borrow the $ 180 , 000 to finance the
construction and then have it go into the calculation of the
benefit charges ?
Mr . Walker said there is a townwide benefitted area , the costs
would be distributed over that area .
Councilwoman Harrison asked if $ 180 , 000 was a high figure for
providing service to this number of houses ?
Mr . Walker said this estimate is not an exceptionally high cost .
Supervisor Whitcomb said it is high per unit because there are no
units along Mecklenburg Road , the density is not there , it is open
land .
Councilwoman Harrison said it is expensive for municipalities to
extend these types of services to a locality with low density .
That is why the push would be to promote high density where these
services are , otherwise the cost per unit is too high .
Supervisor Whitcomb said that theory is fine if you are just
starting out , but what is to be done for developments that were
approved 20 to 30 years ago with the expectation that in time water
and sewer would be extended to that area ?
Councilwoman Harrison said it would have to be recognized that an
R15 zone along Mecklenburg Road makes sense .
Mr . Frantz said many of the lots in the Coddington and Troy Roads
area are in the range of one to two acres . Other municipalities
who have one acre and two acre zoning thought they could get away
from extending water and sewer and found out that it doesn ' t work .
Supervisor Whitcomb asked if any member of the public in attendance
was opposed to the extension of public sewer to West Haven Road .
No one was opposed .
Councilman Conley said in previous meetings the possiblity of
putting together a number of small water and sewer projects in
order to make the bonding more affordable was discussed . There are
other petitions from people who also are having great difficulties
with their water and sewer , such as Trumansburg Road .

Supervisor Whitcomb said it does not make sense to bond less than
$ 1 , 000 , 000 , but the water and sewer cannot be combined in one bond
issue .
Councilwoman Harrison said it would take a lot of projects to make
$ 1 , 000 , 000 .
Supervisor Whitcomb said there is enough money in the water funds
to cover the extension of the water to Coddington Road and Troy
Road . The sewer does not currently have the money for West Haven
Road , it would have to be financed .
Motion made by Councilwoman Grigorov , seconded by Councilman Conley
authorizing the Town Engineer to prepare an Engineering Report
including a preliminary design with cost estimates for providing
public sanitary sewer lines to the properties on the north end of
West Haven Road , and properties on Mecklenburg Road between the
City line and West Haven Road . The cost of this report shall not
exceed $ 1 , 000 . 00 , and the report shall be presented to the Town
Board at the June 13 , meeting . Carried unanimously .
Councilwoman Harrison asked if the Capital Improvement Project plan
called for doing the Trumansburg Road this year ?
Mr . Walker said it was a five year plan . Trumansburg Road has the
same priority as West Haven Road . They would both be infill
projects . There are failing septic systems on Trumansburg Road .
To do an accurate study for a bond issue it will be July before a
report could be completed for the West Haven Road and Trumansburg
Road .
Councilman Conley suggested that the West Haven Road be completed
as soon as possible .
Councilwoman Harrison asked that the Planning Department prepare a
memorandum showing the land use and planning implications for all
the projects on the Capital Improvements Project Plan .
A member of the public asked if there were any plans in the future
for extending public water to Mecklenburg Road ?
Supervisor Whitcomb said that there has been no plans as of this
date .
Mr . Walker said the Engineering Department has been looking at this
possibility because the City would be involved and they are
receptive to discussing this and other issues . The City has been
talking about putting a bigger pump station into the Vinegar Hill
site which might allow the Town the opportunity to extend the water
further .

Supervisor Whitcomb said that one of the things the Town is
revising the Capital Plan which would faze out over a period of
time what improvements are needed and how to do them . It is
obvious all improvements could not be done this summer . The Town
will continue to revise the plan and take care of the water and
sewer needs as quickly as possible .
Mark Morse , 161 West Haven Road mentioned one of the main points in
last year ' s petition was for the health and sanitary problems . It
is now 1994 and three of the homes are presently having health
problems because of back up . Most repairs will only work for a
short period of time because most of the septic systems on the road
are in very bad condition . The home owners are no longer thinking
about aging systems and problems , the critical point is now .
Supervisor Whitcomb said of all the projects discussed this evening
the sewer for this road seems to be the one which is less
controversial , and if approved could be completed this summer .
Mr . Walker said the survey and design work of this project would be
done by the Engineering Department . The actual construction would
have to be contracted .
Supervisor Whitcomb felt the Town does want to approve this sewer
project , but the Town has time constraints because of the legal
steps that must be followed .
John McRae , 165 West Haven Road asked the Board to move on this
project as soon as possible . When it rains showering has to be
done upstairs , the shop vacuum is used to clean out the shower
downstairs because the sewer backs up into it . The house was built
in 1959 , and it is not known where the septic tank is . If someone
digs to find it , it may be cracked , then it would have to be
replaced and there is a space problem .
Councilwoman Harrison said that it may be possible after receiving
Mr . Walker ' s report to have a special meeting to expedite this
project , however there are still legal requirements to be met .
Attorney Barney said the Town would have to wait 30 days after the
decision is made , because the project is subject to a permissive
referendum . That does not mean the Town couldn ' t be in the process
of doing the plans and design during that time . You could not
formally proceed with the bidding until the 30 days is over .
Supervisor Whitcomb thanked the residents of West Haven Road for
coming , and assured them the Town would move as quickly on this
project as was legally possible . -
Councilwoman Harrison asked that all these projects be referred to
the Planning Board for their comments .

and was not sure anything new would be related to them .
Councilman Klein suggested that Mr . Frantz ' memorandum be sent to
the Planning Board .

material as a courtesy to inform them the Town Board will be having
a report from the Town Engineer .
Mr . Frantz said they are familiar with the proposed Troy Road
extension because of the Little Subdivision .
Councilwoman Harrison asked if the Planning Board had asked how it
would be related to the Comprehensive Plan ?
Mrs . Noteboom suggested that after the minutes of this meeting are
prepared she will send them to the Planning Board saying the Town
Board requests they review them and offer their comments about
these extensions before June 13 .
Agenda Item No . 3e - Report of Town Officials , Town Clerk :
Mrs . Noteboom said she had been thinking about the County ' s
suggestions . In the Town Clerk report it the dog and cat licensing
and the solid waste fees the County is thinking of change to theirs
or our jurisdiction .
The Town Board needs to consider it is the Town Clerk ' s belief the
County is trying to take more control over items the Town receives
revenues from , and put onto the Town services that are costing them
money .
It has been suggested the County wants to do the cat and dog
licensing which the Town earns revenue from . When the Town
collects taxes we extend the warrant until June 1 , to collect for
the County . The law states the Town only has to collect taxes
until April 1 , the Town extends the warrant only as a favor to the
County . The Town gives the County two free months of collecting
taxes for them .
Councilwoman Harrison asked if the Town receives any revenue from
the County for receiving the taxes after April 1 ?
Mrs . Noteboom responded no , we receive a $ 1 . 00 service charge for
the installments .
Attorney Barney said the Town also gets their warrant paid first .
The County sends the Town a warrant to collect , part is the Town
tax and part the County tax . The Town takes out their money first .
The benefit for collecting is the Town will make money on the

interest of collecting their warrant first .
Mrs . Noteboom said the County also gets the interest money . The
County insisted last year they should be receiving the interest on
the checking account on all the monies collected from January 1 .
Every bill we collect has monies that is the County ' s and the
Town ' s . Mrs . Raffensperger was firm that the interest would not be
paid to the County until the Town ' s warrant was met .
The point is the Town already collects the warrant for the County
two extra months . The County has two months of staff time and
administration costs to collect their warrant . Now the County is
telling the Town they want us to save them the money for postage ,
billing , and staff time to collect the solid waste fees on the tax
bill .
Councilwoman Harrison asked when the Town ' s warrant is typically
met , and by law the Town must collect the taxes until April 1 ?
Mrs , Noteboom responded the Town ' s warrant is met by the end of
January . The Town is giving the County the benefit of some
services so they do not have the costs . They are pushing the issue
of collecting the solid waste fees onto the tax bill without asking
the Towns how it would effect them .
It is an issue , because it sets a trend that the County is giving
the Town other services to perform for them without the Town
receiving benefit in return . The County is taking more of the Town
revenues away , but adding onto our administrative costs by
performing services for them free gratis . This should be watched .
The County is doing this with items which do not have a great deal
of controversy such as dog licenses , tax collection , solid waste
fees , election expenses , etcetera .
Councilwoman Harrison asked if these issues have been addressed
with the County ?
Mrs . Noteboom reminded the Board that Representative Livesay said
the County would be voting on the collection of the solid waste fee
at their next meeting .
Mrs . Noteboom said County officials called her on both the cat and
dog licensing and the solid waste fee collection , she suggested the
County contact the Town Clerk ' s Association within the County to
come to the monthly meeting and discuss these issues . They said
they would do that , but now it is to be voted on .
The County is not considering the Town . The Town does incur costs .
Supervisor Whitcomb asked Mrs . Noteboom to bring these issues up at
the next Town Clerk ' s meeting and report back to the Town Board ,

TRANSFER OF UNOPENED PORTION OF ORCHARD STREET
Resolution No . 105
WHEREAS , there was a subdivision map filed many years ago which showed on it a
street known as Orchard Street extending from the present terminus of Orchard Street on the
north side of Roat Street southerly across Roat Street and approximately 368 feet further south ;
and
Whereas, it does not appear that the portion of Orchard Street lying south of Roat Street
has ever been formally dedicated to the Town of Ithaca ; and
WHEREAS , there does exist a drainage swale in said unopened street for the purposes
of providing drainage along the lots adjoining Orchard Street ; and
WHEREAS , the Town has negotiated a proposed agreement between the Town , Randy
O . Wayne , the owner of the lot on the west side of said unopened portion of Orchard Street and
with the Estate of Joseph Gargiulo , the owner of the lot on the east side of Orchard Street
pursuant to which the Town abandons its interests in the unopened portion of Orchard Street and
agrees to transfer whatever rights it may have in same to said landowners in exchange for a
conveyance by each of said landowners of an easement for drainage purposes to the Town ; and
WHEREAS , the Town held a public hearing on the proposed abandonment and transfer
of Orchard Street on May 9 , 1994 ; and
WHEREAS , the Town by appropriate proceedings has determined that there is no
significant environmental impact of such abandonment and transfer;
NOW , THEREFORE , it is
RESOLVED , that the Town of Ithaca hereby abandons any interest it may have in and
to the unopened portion of Orchard Street lying south of Roat Street subject to , however,
and contingent upon , the execution and receipt of an agreement from the landowners
adjoining said unopened street on each side granting to the Town an easement for
drainage purposes along said unopened street, all as more particularly shown on a map
made by Allen Fulkerson , a copy of which is to be attached to said agreement; and it is
further
RESOLVED , that the Town Board authorizes the Town Supervisor to execute quitclaim
deeds to each of the adjoining landowners quitclaiming any rights the Town may have
in and to the title to Orchard Street, subject to the receipt of appropriate deeds from the
adjoining landowners granting to the Town the right to maintain the above referred to
drainage easement ; and it is further
RESOLVED , that the form of the deeds and easements be approved by the Town
Supervisor, Town Engineer and attorney for the Town before final execution ; and it is

Town of Ithaca provide $ 5 , 100 to create six additional jobs for
teens ; and
WHEREAS , $ 2 , 550 of the $ 5 , 100 will be matched with the same
amount of County Youth Service Funds and will be reimbursed to
the Town , leaving the Town with a net expense of $ 2 , 550 ; now

WHEREAS , the Town Board of the Town of Ithaca held a Public
Information Meeting on 5 / 9 / 94 to here public comments from the
residents of West Haven Road regarding the problems they have
with their private sanitary sewer systems ; and
WHEREAS , as a result of the comments made , the Town Board
wishes to pursue investigating the possiblity of extending public
sanitary sewer lines to these properties ; now therefore be it
RESOLVED , the Town Board hereby authorizes and directs the
Town Engineer to prepare an Engineering Report including a
preliminary design with cost estimates for providing public
sanitary sewer lines to the properties on the north end of West
Haven Road , and properties on Mecklenburg Road between the City
line and West Haven Road , and be it further
RESOLVED , the cost of said report shall not exceed
$ 1 , 000 . 00 , and shall be presented to the Town Board for their
consideration at the June 13 , 1994 Town Board meeting .

Board met and reviewed the format of the Annual Disclosure
Statements related to Local Law # 4 / 1992 , a local law " REPEALING
LOCAL LAW NO . 2 OF THE YEAR 1970 AND ESTABLISHING REVISED ETHICS
RULES APPLICABLE TO TOWN OF ITHACA OFFICERS AND EMPLOYEES " ; and
WHEREAS , based on the said review the Ethics Board has
recommended changes to the Annual Disclosure Statement ; and
WHEREAS , the Town Board has discussed and examined the
revisions as recommended ; now therefore be it
